Mayor Brown opened public recognition on agenda related items and with noone wishing to speak Mayor closed the public recognition.
Mavor's Comments
Mayor Brown read and presented a Proclamation to Ms. Chloe Warrenrecognizing her many accomplishments. Ms. Warren was crowned Ms.Tennessee Fairest of the Fafu 2020 and Sumner County Outstanding Teen.

Mayor also spoke about Station Camp High School hosting "Every Kid is a HeroDay" and it's great success.
Union Stem School student Lucy Blaylock won the Tennessee PrudentialCommunity Spirit Award. Ms. Blaylock makes love blankets for people all overthe world that have some type of challenge/difficulty in their life.
Mayor announced several upcoming events
Mayor Brown and Gallatin Chamber of Commerce Executive Director Kim Bakerare joining together to form "Baker and Brown." Mayor said this will be a talkshow to help people learn more about Gallatin and the community.

As required by T.C.A. 6-51-L08 (c), the Gallatin City Council shall conduct a public hearing and
present a report on the status or progress of plans of service (see Exhibit A).
The City comprises 32.5 +/- square miles. The annexations and plan of services occurringbetween March 2008 and November 2019 [including separate 26 actions of connection totaling3,700.183 acresl are included in this report (Table D). The table describes the specific
annexation classifications and the status of provisions of Municipal Services.
The City prepared this report on the progress of Plans of Service for certain properties annexed
into the corporate limits of the City of Gallatin from March 18, 2008. The annexed properties
include properties annexed by Ordinance (priorto May, 2015)and properties and rights-of-wayannexed by Resolution (after May, 2015). Annexations completed prior to a 2015 change in TN
statue included voluntary and involuntary annexations approved by Ordinances of the City
Council. Annexations completed after 20L5, included only voluntary annexations approved by a
Resolution of the City Council. All annexations require a separate Plan of Service to be adopted
in conjunction with the annexation request.
Annexations for St. Blaise Estates and Long Hollow Pike areas (Ordinance Number OI202-t8 and
Ordinance Number C,0802-73].remain open until the necessary sewer infrastructure is installed
to service both areas. Gallatin Public Utilities has prepared plans and has the capactiy butrequires necessary rights-of-way/easements to install two required collector lines servicing
these areas. The remainder of the Plans of Service are satisified.

Police
L. All services provided by the City of Gallatin Police Department were made available tothe annexed areas on the effective date of annexation.

Fire Services
L All services provided by the City of Gallatin Fire Department were made available to theannexed areas on the effective date of annexation.
2. Gallatin Fire Station #4 was constructed in 201L and staffed immediately to primarily
service the north and west areas of Gallatin pursuant to the Plan of Service indicated in
Annexation 2008-01.
3 Gallatin Fire Station #5 was completed in 2019 and staffed immediately to primarily
service the south areas of Gallatin.
4. Fire hydrants have been installed acrossthe annexed areas pursuantto NFPA Life
Standards in both the Gallatin Public Utilities service areas and the White House UtilityDistricts.
5 The necessary equipment and personnel have been added to satisfy the Plan(s) ofService as indicated below:
o Additional uniformed personnel and equipment at Fire Station #4o Additional uniformed personnel and equipment at Fire Station #5
Water
1. Water service is provided by the City of Gallatin Public Utilities (GPU) or White House
Utility District (WHUD) and a small area served by the Bethpage-Castalian Springs UtilityDistrict (BCSUD) (see web page). All properties annexed as described in the report have
public water service from one of the utility districts or the Gallatin Public Utility District.
2 lnside-City rates have been established in the annexed areas serviced by Gallatin Public
Utilities.
3 Public water is provided for fire protection service and is currently available by GPU,
WHUD, or BCSUD.

4. Gallatin Public Utilities, White House Utility District and Bethpage/Castalian Springs
Utility District established service area boundaries effective May 28,2008. This includedproperties within and outside the City boundaries (Exhibit C).
Wastewater

T Sanitary sewer service is provided by White House Utility District and/or Gallatin Public
Utilities.
After annexation in 2008, the Gallatin Public Utilities completed a major sewer trunkline into the Liberty Branch basin area. Service is available pursuant to existing GPU
service policies.
Three (3) collector lines as described in City of Gallatin Ordinance - o4802-L3(Annexation Area 1) and City of Gallatin Ordinance o1202-I8 (St Blaise Estates) have not
been installed. Gallatin Public Utilities has plans to installthese lines when theappropriate easements are aquiried and demand is present.
4. Developers of commercial, industrial and residential projects have extended service
lines or necessary trunk line infrastructure to support existing, planned, or futuredevelopment in the annexed areas pursuant to Gallatin Public Utility or White House
Utility District policy consistent with each plan of service.
Gas
Gallatin natural gas service lines have been extended to properties consistent with theplans of service. All properties are within the GPU service area. lnside city rates apply
to existing or new customers since the effective date of each annexation.
Refuse Collection/Streets/Pu blic Works
Solid waste collection service is available to the annexed areas since the effective date
of each annexation. Each customer is required to contact the Public Works Department
to activate the services. A monthly service fee of S12.00 is required for each residential

Building lnspections/Code Enforcement
All services provided by the City of Gallatin Codes Department became available upon
the effective date of each annexation. No additional personnel or equipment was called
for in the Plans of Service.
Planning and Zoning
All services provided by the City of Gallatin Planning Department became available upon
the effective date of each annexation. No additional personnel or equipment was called
for in the Plans of Service.
Street Lighting/Eledric Service
All customers within the annexed areas are serviced by the Gallatin Department ofElectricity. These areas were previously served by the Cumberland Electric Membership
Cooperative or had no service due to a lack of development.
Street lights have been installed in all annexed areas pursuant to established Gallatin
Depa rtment of Electricity policies.
Street lights will be installed along portion of roadways as described in resolution
Number R1909-52 after completion of construction.
Recreations/Parks
The benefit and use of all recreational facilities and programs provided by the City ofGallatin Parks Department (formally Leisure Services Department)were made available
on the effective date of annexation(s).
AnimalControl
The City of Gallatin Police Department provides animal control to all areas of the City
This service was made available to annexed properties on the effective date of the
annexation(s).
With the public hearing concluded, per T.C.A. 6-51-108, The City of Gallatin has met its
obligations for reporting on the status of plans of service associated with annexations
conducted by the City through L2/3L/20L9
This report covers all annexations between May, 2008 (Ordinance No, 00802-14) through
October, 2019 (Resolution No. R1909-52).

6-51-101. Part definitions and definitions for $ 6-51.-301
As used in this part and 5 6-51-301, unless the context otherwise requires:
(1) "Larger" and "smaller" refer to population and not area;
(2) "Municipality" or "municipalities" means any incorporated city or cities, or town or towns, and does not include any utility
district, sanitary district, school district, or other public service district, whether organized under public or private acts; and
(3) "Notice" means publication in a newspaper of general circulation in the municipality at least seven (7) days in advance of a
hearing. The notice shall be satisfied by inclusion of a map that includes a general delineation of the area or areas to be
annexed by use of official road names or numbers, or both, names of lakes and waterways, or other identifiable landmarks, as
appropriate.

6-51-102. Plan of services.

(b)
(1) Before any territory may be annexed under this part, the governing body of the municipality shall adopt a plan of services
establishlng at least the services to be delivered and the projected timing of the services. Upon adoption of the plan of
services, the municipality shall cause a copy of the plan of services to be forwarded to the county mayor in whose county the
territory being annexed is located. The plan of services shall be reasonable with respect to the scope of services to be provided
and the timing of the services.
(2) The plan of services shall include, but not be limited to: police protection, frre protection, water service, electrical service,
sanitary sewer service, solid waste collection, road and street construction 6nd repair, recreational facilities and programs,
street lighting, and zoning services. If the rnunicipality maintains a separate school system, the plan shall also include schools
and provisions specifically addressing the impact, if any, of annexation on school attendance zones. If the municipality does
not maintain a separate school system, then the municipality shall provide written notice of the annexation to all affected
school systems as soon as practicable, but in no event less than thirty (30) days prior to the public hearing requirement set
forth in subdivision (b)(+). The plan of services may exclude services that are being provided by another public agency or
private company in the territory to be annexed other than those services provided by the county.
(3) The plan of services shall include a reasonable implementation schedule for the delivery of comparable services in the
territory to be annexed with respect to the services delivered to all citizens of the municipality.
(4) Before a plan of services may be adopted, the municipality shall submit the plan of services to the local planning
commission, if there is one, for study and a written report, to be rendered within ninety (90) days after such submission,
unless by resolution of the governing body a longer period is allowed. Before the adoption of the plan of services, a
municipality shall hold a public hearing. Notice of the time, place, and purpose of the pubiic hearing shall be published in a
newspaper of general circulation in the municipality not less than fifteen (15) days before the hearing. The notice shall include
the locations of a mlnimum of three (3) copies of the plan of services, which the municipality shall provide for public inspection
during all business hours from the date of notice until the public hearing.
(5) A municipality may not annex any other territory if the municipality is in default on any prior plan of services.
(6) If a municipality operates a school system, and if the municipality annexes territory during the school year, any student
may continue to attend such student's present school until the beginning of the next succeeding school year unless the
respective boards of education have provided otherwise by agreement.

6-51-103. Quo warranto to contest annexation ordinance - Appellate review
(a)
(1)
(A) Any aggrieved owner of properly that borders or lies within territory that is the subjecl of an annexation ordinance prior to
the operative date thereof, may file a suit in the nature of a quo warranto proceeding in accordance with this part, 5 6-51-301
and title 29, chapter 35 to contest the validity thereof on the ground that it reasonably may not be deemed necessary for the
welfare of the residents and property owners of the affected territory and the municipality as a whole and so constitutes an
exercise of power not conferred by law. Notwithstanding any other section in this chapter, for purposes of this section, an
"aggrieved owner of property" does not include any municipality or public corporation created and defined under title 7,
chapter 82 that owns property bordering or lying within the territory that is the subject of an annexation ordinance requested
by the remaining property owner or owners of the territory and whose property and services are to be allocated and conveyed
in accordance with S 6-51-111, $ 6-51-112 or $ 6-51-301, or any contractual arrangement otherwise providing for such
allocation and conveyance.
(B) Subdivision (a)(1XA) does not apply to the counties covered by subdlvision (a)(2),
(2)

according to the 1980 federal census or any subsequent federal census, and in any county with a population of not less than
two hundred eighty-five thousand (285,000) and not more than two-hundred ninety thousand (290,000) based upon the 1980
federal census.
(b) The rendering of services under a mutual aid agreement, an automatic response agreement, an operational agreement, or
any other agreement as allowed under a comprehensive growth plan, pursuant to chapter 58 oF this title, or the providing of
mutual aid or assistance under the Mutual Aid and Emergency and Disaster Assistance Agreement Act of 2004, compiled in
title 58, chapter 8, is not admissible as evidence against the municipality in any action brought under this section or title 29,
chapter 14.
(c) The municipality shall have the burden of proving that an annexation ordinance is reasonable for the overall well-being of
the communities involved.
(d)
(1) If more than one (1) suit is filed, all of them shall be consolidated and tried as one (1) in the first court of appropriate
jurisdiction in which suit is filed. Suit or suits shall be tried on an issue to be made up there, and the question shall be whether
the proposed annexation is or is not unreasonable in consideration of the health, safety and welfare of the citizens and
propefty owners ol the territory sought to be annexed and the citizens and property owners of the municipality. Should the
court find the ordinance to be unreasonable, or to have been done by exercise of powers not conferred by law, an order shall
be issued vacating the ordinance and the municipaljty shall be prohibited from annexing, pursuant to the authority of g 6-51-
I02, any part of the territory proposed for annexation by such vacated ordinance for a period of at least twenty-four (24)
months following the date of such order. In the absence of such finding, an order shall be issued sustaining the validity of such
ordinance, which shall then become operative thirty-one (31) days after Judgment ls entered unless an abrogating appeal has
been taken from the judgment, or unless the presiding court grants the municipality's petition to defer the effective date
pursuant to subdivision (d)(2).
(2) Upon petition of the municipality, the presiding couft may, as part of the judgment sustaining the validity of the
annexation ordlnance, order that the effective date of the ordinance be fixed as December 31 following the date of entry of the
judgment or determination of appeal. In making any order underthis subdivision (d)(z), the court shall consider the necessity
of the deferred effective date to render municipal services to the annexed territory within a reasonable time. The petition shall
be filed by the municipality in the presiding court where the annexation ordinance is being contested ln a quo warranto
proceeding as provided in this section.
(e) If on appeal judgment shall be against the validity of such ordinance, an order shall be entered vacating the same and the
municipality shall be prohibited from annexing, pursuant to the authority of 5 6-51-102, any part of the territory proposed for
annexation by such vacated ordinance for a period of at least twenty-four (24) months following the date of such order. Ifjudgment shall be in tavor of the validity of such ordinance, it shall become operative forthwith by court order and shall not be
subject to contest or attack in legal or equitable proceeding for any cause or reason. the judgment of the appellate court being
final.
(f) Should the terrltory hereafter sought to be annexed be the site of substantial industrial plant development, a fact to be
asceftained by the court, the municipality shall have the burden of proving that the annexation of the site of the industrial
plant development is not unreasonable in consideration of the factors above mentionedr including the necessity for or use of
municipal services by the industrial plant or plants, and the present ability and intent of the municipality to benefit the
industrial plant development by rendering municipal services thereto when and as needed. The policy and purpose of this
provision is to prevent annexation of industrial plants for the sole purpose of increasing municipal revenue, without the ability

necessory interceptor and trunk sewer lines to serve the substantially developed onnexed
areas will be completed in 5 years.
D-3 Construction of collector lines in the substantially developed annexed areas will be
completed within 5 years. Residences, commercial, and industrial properties willthen be
connected to the wastewater system in accordance with current policies of the city.

B. Currently the developed residentiol properties are using sanitary septic sewer systems.
The Gallatin Public Utilities Department will provide sanitary sewer service policy in the
annexation area on the effective dote of the annexation. The installation of a sanitary
sewer line to service the annexation area will begin within six (6) years after the effective
date of the annexation. However, if the annexation area has future development prior to
six (6) yeors, then the developer will be responsible for the instollation of the sanitorysewer line.
The two (2) sanitary sewer lines called for in O0802-L3 are described below.
"An approximately 3200 linear foot, 18" sanitary sewer line extending from Neals Lane to an
existing manhole on the northwest side of TN-386, roughly following the path of Rankin Branch
Creek."
and
"An approximately 500 linear foot sanitary sewer line, crossing Liberty Branch Creek, and
running parallel to Long Hollow Pike between it and a branch of Liberty Branch Creek."
The sanitary sewer collector line called for in 001202-18 as described below:
" An approximately 1880 linear feet of sanitary sewer line extending from St Blaise Road and
Highway 386 to an existing sanitary sewer manhole near Station Camp Creek within the
Kennesaw Farms Development."

and intent to beneflt the area annexed by rendering municipal services, when and as needed, and when such services are not
used or required by the industrial plants.
(9) During the time that any annexation ordinance is being contested as provided in this section, the annexing municipality
and the county governing body or any affecled school, sanitary or utility district, or all such districts, may enter into an
agreement to provide for new, expanded, and/or upgraded services and facilities, including, but not limited to, equipment, land
and buildings, and capital expenditures, including sale of bonds, to finance such services and facilities, which agreement shall
include an equitable division of the cost and liabilities of such capital expenditures between the annexing municipality and the
county governing body or any affected school, sanitary, or utility district, or all such districts, upon final determination of such
contested annexation ordinance,
(h) When territory is annexed that is located in a county other than one in which the city hall of the annexing municipality is
then located, any suit filed pursuant to this section for the purpose of contesting the annexation ordinance shall be filed in the
county where the city hall of the annexing municipality is located. The chancellor, howeveq shall change the venue to a county
that is adjacent to either the county where the annexing municipallty's city hall ls located or the county where the proposed
annexation is located.
(i) When a final judgment is rendered in a quo warranto suit contesting a proposed annexation, the municipality shall notify
the county mayor of the outcome of the litigation, so the county may keep abreast of the status of a pending annexation,
Similarly, when a municipality files an appeal of a decision in a quo warranto suit, the municipality shall notify the county
mayor of the pending appeal.

6-51-104. Resolution for annexation by referendum - Notice.
(a)
(1) A municipality, when petitioned by interested persons, or upon its own initiative, by resolution, may propose extension of
its corporate limits by the annexation of territory adjoining to its existing boundaries; provided, however, no such resolution
shall propose annexation of any property being used primarily for agricultural purposes. Notwithstanding this part or any other
law to the contrary, property being used primarily tor agricultural purposes shall be annexed only with the written consent of
the property owner or owners.
(2) A referendum is not required to effectuate annexation ofterritory if:
(A) All of the property owners within the territory proposed for annexation consent in writing; or
(B)
(i)
fa) Two-thirds (2/3) of the property owners within the territory proposed for annexation consent in writing;
(b) The total area of the property owned by the owners consenting to annexation under subdivision (a)(2)(B)(i) is more than
one-half (L/2) of lhe territory proposed for annexation; and
(c) The proposed annexation consists of nine (9) or fewer parcels;
(ii) Subdivision (a)(2XB) is repealed January 7,2023-
(b)
(1)
(A) A copy of the resolution, describing the territory proposed for annexation, shall be promptly sent by the municipality to
[he iast known address listed in the office of the property assessor for each property owner of record within the territory
proposed for annexation. The resolution shall be sent by first class mail and shall be mailed no laterthan fourteen (14)
calendar days prior to the scheduled date of the hearing on such proposed annexation. The resolution shall also be published
by posting copies of it in at least three (3) public places in the territory proposed for annexation and in a like number of public
places in the municipality proposing such annexation, and by publishing notice of such resolution at or about the same time in
a newspaper of general circulation, if there is one, in such territory and municipality. The resolution shall also include a plan of
services for the area proposed for annexation. The plan of services shall comply with the requirements of S 6-51-102,
including the public hearing and notice requirements, prior to the adoption of the resolution. Upon adoption of the plan of
services, the municipality shall cause a copy of the resolution to be forwarded to the county mayor in whose county the
territory being annexed is located.

(B) A person or persons with personal knowledge of the mailing of the resolutions to each property owner of record pursuant
to subdivision (bX1XA) may submit a notarized affidavit to the presiding officer of the municipality attesting that such
resolutions were mailed in accordance wlth this subdivision (b)(L). Failure of a property ownerto receive a notice that was
mailed pursuant to subdivision (b)(1XA) shall not be grounds to invalidate the annexation.
(2) After receiving the notice from the municipality as provided in subdivision (b)(1), the county mayor shall notify the
apPropriate departments within the county regarding the informdtion received from the municipality,
(c) A resolution proposing annexation by written consent of the property owner or owners shall become effective only upon
adoption of such resolution by the municipality,
(d)
(1) A municipality may by resolution propose annexation of territory that does not adjoin the boundary of the main part of the
municipality, without extending the corporate limits of that territory, if the territory proposed for annexation is entirely
contained within the municipality's urban growth boundary and is either:
(A) To be used for industrial or commercial purpose or future residential development; or
(B) Owned by one (1) or more governmental entities,
(2) A resolution under this subsection (d) shall be ratified only with the written consent of the property owner or owners.
(3) For purposes of this subsection (d), the boundary of the main part of the municipality is defined as the corporate limits of
the territory containing its town seat or city hall. Territory that does not adjoin that boundary before a proposal to annex it is
introduced cannot be annexed except as provided in this subsection (d).
(4) The resolution shall include the plan of services adopted under q 6-51-102. The plan shall be prepared by the municipality
in cooperation with the county in which the territory is located. The municipality and county shall enter into an interlocal
agreement pursuant to $ 5-1-113 to provide emergency services for any interceding properties and to maintain roads and
bridges comprising the primary route to the area thus annexed as the municipality and county deem necessary.

Part 1 Annexation
6-51-108. Rights of residents of annexed territory - Plan of service and progress report.
(a) Residents of, and persons owning property in, annexed territory shall be entitled to rights and privileges of citizenship, in
accordance with the annexing municipality's charter, lmmediately upon annexation as though such annexed territory had
always been a part of the annexing municipality. It shall be the duty of the governing body to put into effect with respect to an
annexed area any charter provisions relating to representation on the governing body.
(b)
(1) This subsection (b) shall apply to any municipality whose annexation ordinance becomes effective by court order pursuant
to S 6-s1-103(d).
(2) Within ten (10) days after the date on which a court order is entered sustaining the validity of a proposed annexation, any
annexing municipality to which this subsection (b) applies shall submit written notification, meeting the requirements of
subdivision (b)(3), to each person owning real property in the territory that the territory will become a pad of the municipality.
In the event an appeal is taken from the court order, the annexing municipality shall notify the property owners in writing of
the pending appeal. If on appeal the court affirms the validity of the proposed annexation, the municipality shall submit written
notification, meeting the requirements of subdivision (b)(3), to the propefty owners within ten (10) days of entry of judgment
of the appellate court.
(3) The advance written notification shall include the date on which the annexed territory becomes a part of the municipality,
a detailed description of the annexed territory, and the reasons for the annexation. The notification shall be sent by first class
mail to the last known address listed in the office of the propefty assessor for each property owner of record within the
annexed territory.
(4) A person with personal knowledge of the mailing of the notification shall submit a notarized affidavit to the presiding
officer of the annexing municipality attesting that the notifications were mailed in accordance with subdivision (bX3).
(c) Upon the expiration of six (6) months from the date any annexed territory for which a plan of service has been adopted
becomes a part of the annexing municipality, and annually thereafter until services have been extended according to such
plan, there shall be prepared and published in a newspaper of general circulation in the municipality a report of the progress
made in the preceding yeartoward extension ofservices according to such plan, and any changes proposed therein. The
governing body of the municipality shall publish notice of a public hearing on such progress reports and changes, and hold
such hearing thereon. Any owner of property in an annexed area to which such plan and progress report are applicable may
file a suit for mandamus to compel the governing body to comply with the requirements of this subsectlon (c).

(d) A municipality may amend a plan of services by resolution of the governing body only after a public hearing for which
notice has been publlshed at least fifteen (15) days in advance in a newspaper of general circulation in the rnunicipality when:
(1) rhe amendment is reasonably necessary due to natural disaster, act of war, act of terrorism, or reasonably unforeseen
circumstances beyond the control of the municipality;
(2) rhe amendment does not materially or substantlally decrease the type or level of services or substantially delay the
provision of servlces specified in the original plan; or
(3) The amendment:
(A) Proposes to materially and substantially decrease the type or level of services under the original plan or to substantially
delay those services;
(B) Is not justified under subdivision (d)(f ); and
(C) Has received the approval in writing of a majority of the property owners by parcel in the area annexed. In determining a
majority of property owners, a parcel of property with more than one (1) owner shall be counted only once and only if owners
comprising a majority of the ownership interests in the parcel petition together as the owner of the particular parcel,
(e) An aggrieved property owner in the annexed territory may bring an action in the appropriate court of equity jurisdiction to
enforce the plan of services at any time after one hundred eighty (180) days after an annexatlon takes effect and until the
plan of services is fulfilled, and may bring an action to challenge the legality of an amendment to a plan of services if such
action is brought within thirty (30) days after the adoption of the amendment to the plan of services. If the court finds that the
municipality has amended the plan of services in an unlawful manner, then the court shall decree the amendment null and void
and shall reinstate the previous plan of services. If the court finds that the municipality has materially and substantially failed
to comply with its plan of services for the territory in question, then the municlpality shall be given the opportunity to show
cause why the plan of services was not carried out, If the court finds that the municlpality's failure is due to natural disaste[
act of wari act of terrorism, or reasonably unforeseen circumstances beyond the control of the municipality that materially and
substantially impeded the ability of the municipality to carry out the plan of services, then the court shall alter the timetable of
the plan of services so as to allow the municipality to comply with the plan of services in a reasonable time and manner. If the
court finds that the municipality's failure was not due to natural disaster, act of war, act of terrorlsm, or reasonably unforeseen
circumstances beyond the control of the municipality that materially and substantially impeded the ability of the municipality to
carry out the plan of services, then the court shall issue a writ of mandamus to compel the municipality to provide the services
contained in the plan, shall establish a timetable for the provision of the services in question, and shall enjoin the municipality
from any further annexations until the services subject to the court's order have been provided to the court's satisfaction, at
which time the court shall dlssolve lts injunction. If the court determines that the municipality has failed without cause to
comply with the plan of services or has unlawfully amended its plan of services, the court shall assess the costs of the suit
against the municipality.

WHEREAS, the owner of the property submitted a complete application to rezone 40.38 +l-
acres with a Preliminary Master Development Plan for Patriot Angels Phase 2,located in the City ofGallatin, Tennessee; and
WHEREAS, the zoning map amendment conforms to the general plan of the area includingthe established Greenlea Business Center Character Area and that the public necessity,
convenience, and general welfare will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning has adequate public utilities, infrastructure,and private or municipal services necessary to serve the existing and proposed development and
population permitted by the requested zoning, or such necessary services and facilities will be
provided upon development of the property; and
WHEREAS, the rezoning will be compatible with the sunounding environment and willprotect the public health, safety, and welfare and will not be injurious to other property orimprovements in the area in which the property is located; and
WHEREAS, the Gallatin Municipal-Regional Planning Commission reviewed and
recommended approval of the proposed rezoning with Preliminary Master Development Plan in
GMRPC Resolution 2019-160; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
Zoning Ordinance and Tenn. Code Ann. $ l3-7-203; and
WHEREAS, the City Council approved by majority vote ofthe members present the rezoning
request ofthe described property; and
NOW, THEREFORB, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF GALLATIN, SUMNER COUNTY, TENNESSEE as follows:
Section 1. The City Council of the City of Gallatin does hereby rezone 40.38 +l- acres from

WIIEREAS, THE CITY OF' GALLATIN has determined that it no longer needsand proposes to vacate certain right-of-way, initially platted as McClellan Circle and nowknown as Randolph Circle, in the Vertrees Subdivision; and
WHEREAS, the Owners of the adjacent properties to the certain right-of-wayrequested the City to abandon said right-of-way; and
WHEREAS' The Gallatin Municipal-Regional Planning Commission reviewedand recommended to the City Council abandonment of said right-of-way consistent withTitle 13, Chapter 3, Section 3l l, Tennessee Code Annotated; and
WHEREAS, the Gallatin Charter, Article II, Section I (13) authorizes the CityCouncil to vacate, abandon and dispose of property and/or right-of-way within thecorporate limits by ordinance.

Due to communication and surveying problems, the process did not proceed in a timelymanner
ln November, 2019, the applicant approached the City Planner requesting an update onabandonment status.
Proposed AbandonmentThe right-of-way adjacent to applicant's property is unimproved and is 25 feet wide by97.70 feet in length. No City departments have expressed any concerns with abandoningthe right-of-way. There is a P.U.D.E. on the front (westerly) portion of the right-of-wayproperty lot along the roadway of Randolph Circle. The applicant owns property on thesouth side of the right-of-way which includes lots 38-41, Block 'C'. Another person owns lot1, Block 'E' on the north side of the right-of-way. lf vacated each of the adjacent propertyowners would obtain one-half of the former right-of-way located adjacent to their property.
Engineering DivisionThe Engineering Division certified that the applicant submitted all the necessary documentsfor the abandonment of the right-of-way of this portion of Randolph Circle.

RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS BY THE CITY OFGALLATIN, TENNESSEECARELLTON, PHASE 2-A
WHEREAS, THE CITY OF GALLATIN PLANNING COMMISSION hAS
recommended acceptance by the City of Gallatin of the public improvements in the
development hereinafter named Carellton, Phase 2-A; and
WHEREAS, THE CITY OF GALLATIN ENGINEERING DIVISION heTeby
certifies that the public drainage infrastructure, rights-of-way, and public easements inCarellton, Phase 2-A have been satisfactorily completed and have been installed inaccordance with the approved plans and specifications and that there has been fullcompliance with the City of Gallatin Subdivision Regulations; and
WHEREAS, THE CITY OF GALLATIN PUBLIC UTILITIES DEPARTMENThereby certifies that the public utility improvements in the development described hereafterhave been satisfactorily completed and have been installed in accordance with the approvedplans and specifications and that there has been full compliance with the City of GallatinSubdivision Regulations and City of Gallatin Municipal Code.
NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN,TENNESSEE, pursuant to Chapter 3, Section 3-105, et seq. of the SubdivisionRegulations of Gallatin, Tennessee, that the public drainage infrastructure, rights-of way,public easements, and public utility improvements, as described in Carellton, Phase 2-A,Plat Book 29, Page(s) 173-175, recorded on April 4, 2016 in the Register's Office forSumner County, are hereby accepted by the City of Gallatin, Tennessee.

RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS BY THE CITY OFGALLATIN, TENNESSEECARELLTON, PHASE 1B
WHEREAS, THE CITY OF GALLATIN PLANNING COMMISSION hAS
recommended acceptance by the City of Gallatin of the public improvements in the
development hereinafter named Carellton, Phase lB; and
WHEREAS, THE CITY OF GALLATIN ENGINEERING DIVISION heTeby
certifies that the public drainage infrastructure, rights-of-way, and public easements inCarellton, Phase 18 have been satisfactorily completed and have been installed inaccordance with the approved plans and specifications and that there has been fullcompliance with the City of Gallatin Subdivision Regulations; and
WHEREAS, THE CITY OF GALLATIN PUBLIC UTILITIES DEPARTMENThereby certifies that the public utility improvements in the development described hereafterhave been satisfactorily completed and have been installed in accordance with the approvedplans and specifications and that there has been full compliance with the City of GallatinSubdivision Regulations and City of Gallatin Municipal Code.
NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN,TENNESSEE, pursuant to Chapter 3, Section 3-105, et seq. of the SubdivisionRegulations of Gallatin, Tennessee, that the public drainage infrastructure, rights-of way,public easements, and public utility improvements, as described in Carellton, Phase 1B,
Plat Book 28, Page(s) 122-126, recorded on April 2, 2014 in the Register's Office forSumner County, are hereby accepted by the City of Gallatin, Tennessee.
BE IT FURTHER RESOLVBD BY THB CITY OF GALLATIN,TENNBSSEE, that this Resolution shall take effect from and after its final passage, thepublic welfare requiring such.

FOXLAND CROSSING, PHASE I2A
WHBREAS, THE CITY OF GALLATIN PLANNING COMMISSION hAS
recommended acceptance by the City of Gallatin of the public improvements in thedevelopment hereinafter named Foxland Crossing, Phase l2A; and
WHEREAS, THE CITY OF GALLATIN ENGINEERING DIVISION heTCbY
certifies that the public drainage infrastructure, rights-of-way, and public easements inFoxland Crossing, Phase 12,{ have been satisfactorily completed and have been installedin accordance with the approved plans and specifications and that there has been fullcompliance with the City of Gallatin Subdivision Regulations; and
WHERBAS, THE CITY OF GALLATIN PUBLIC UTILITIES DEPARTMENThereby certifies that the public utility improvements in the development described hereafterhave been satisfactorily completed and have been installed in accordance with the approvedplans and specifications and that there has been full compliance with the City of GallatinSubdivision Regulations and City of Gallatin Municipal Code.

WHEREAS, all ef,forts shall be made to provide a safe and hazard'free workplace foremployees of the City of Gallatin; and
WHEREAS, Public Fntity Partners seeks to encourage the establishment of a safe workplaceby offering a "safety Partners" Matching Grant Program; and
