Under sub-section (1) of section (15) of the Tamil Nadu Highways Act, 2001 (Tamil Nadu Act 34 of 2002), the Governor of Tamil Nadu here by acquires the land specified in the schedule below measuring to an extent of 8.04.70 Hectares (4.59.20 Hectares dry and 3.45.50 Hectares Manavari) of lands a little more or less required to wit for forming ring Road to Mannargudi town branching and merging at km 35/2 of Kumbakonam-Mannargudi-Adhirampattinam Road (SH66) in 24. Melavasal Village, Mannargudi taluk in Tiruvarur District.

No.II(2)/HwMP/511/2019.— The Governor of Tamil Nadu having been satisfied that the lands specified in the Schedule below have to be acquired for Highways purpose for forming Road Over Bridge in Salem District, Omalur Taluk, Omalur and Puliampatty Village at Km 12/8 of Suramangalam-Omalur road (via Muthunaickenpatty) (Major District Road 696) in lieu of existing Level crossing No.7 Railway K.M.6/200-300 between Magnasite and Omalur Railway Station and it has already been decided that the entire amount of compensation to be awarded for the lands is to be paid out of the funds controlled or managed by the Divisional Engineer (Projects), Highways Department, Salem District after considering the cause shown by the owner (or) other person having interest on such lands as the case may be do hereby publish the following notice under

sub-section (1) of Section 15 of the Tamil Nadu Highways Act, 2001 (Tamil Nadu Act 34 of 2002).

NOTIcE

Under sub-section (1) of Section 15 of the Tamil Nadu Highways Act, 2001 (Tamil Nadu Act 34 of 2002) the Governor of Tamil Nadu hereby acquires the land specified in the Schedule below measuring to an extent of 1490.0 sq.mtrs of wet lands in Salem District, Omalur Taluk, Omalur and Puliampatty Village to the same, a little more or less needed for forming Road Over Bridge in Salem District, Omalur Taluk, Omalur and Puliampatty Village at Km 12/8 of Suramangalam - Omalur road (via Muthunaickenpatty) (Major District Road 696) in lieu of existing Level crossing No.7 Railway K.M.6/200-300 in between Magnasite and Omalur Railway Station.

The plan of the lands is kept in the office of the District collector, Salem and may be inspected at any time during office hours.

No.II(2)/LE/521/2019:--In exercise of the powers conferred by Section 87 and 88 read with Section 91-A of the Employees’ State Insurance Act, 1948 (central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the permanent employees of the N. Kamaludeen Noor Sait Beedi company, Tirunelveli from the operation of the said Act for the Period of from 23.9.2018 to 22.09.2019.

(1) The above exemption is subject to the following conditions namely.

(a) The aforesaid Management wherein the employees are employed shall maintain a Register showing the names and designations of the exempted employees.

(b) Notwithstanding the exemption, the employees shall continue to receive such benefits under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notification operates.

(c) The contribution for the exempted period, if already paid shall not be refunded.

(2) The employer of the said management shall submit in respect of the period during which that Management was subject to the operation of the said Act (hereinafter referred to as "the said period") returns in such form and


containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.

(3) Any Social Security Officer appointed by the corporation under sub-section (1) of Section 45 of the said Act, or other official authorised in this behalf shall, for the purpose of;

(i) verifying the particulars contained in any return submitted under sub-section (1) of Section 44 of the said, Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees State Insurance (General) Regulations, 1950 for the said period; or

(iii) ascertaining whether the employees continue to be entitled to the benefits provided by the employer in cash and in kind, being benefits in consideration of which exemption is being granted under this Notification; or

(iv) ascertaining whether any of the provisions of the said Act had been complied with during the period when such provisions were in force in relation to the said workshop and store be empowered to,

(a) require the principal or immediate employer to furnish to him such information as he may consider necessary, or

(b) enter any Management, office or other premises occupied by such principal or immediate employer at any reasonable time and require any person found in charge thereof to produce to such Social Security Officer or other Official and allow him to examine such documents, books and other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

(c) examine the principal or immediate employer, his agent or servant, or any persons found in such Management Office or other premises, or any person when the said Social Security Officer or other official has reasonable cause to believe to have been an employee, or

(d) make copies of or take extracts from any register, account book or other document maintained in such Management office or other premises.

Exemption to the Permanent Employees of theTamil Nadu Cements Corporation Limited, Ariyalur for certain period under the Act.

No.II(2)/LE/522/2019.—In exercise of the powers conferred by Section 87 read with Section 91-A of the Employees’ State Insurance Act, 1948 (central Act XXXIV of 1948), the Governor of Tamil Nadu hereby exempts the Permanent employees of Tamil Nadu cements corporation Limited Ariyalur from the Operation of the said Act for the Period of One Year from 01-02-2019 to 31-01-2020.

(1) The above exemption is subject to the following conditions, namely.


(b) Notwitstanding the exemption, the employees shall continue to receive such benefits under the said Act to which they might have become entitled to on the basis of the contributions paid prior to the date from which exemption granted by this Notification operates.


(2) The employer of the said shall submit in respect of the period during which that Management was subject to the operation of the said Act (herein after referred to as "the said period") returns, in such form and containing such particulars as were due from it in respect of the said period under the Employees State Insurance (General) Regulations, 1950.





(iv) ascertaining whether any of the provisions of the said Act, had been complied with during the period when such provisions were in force in relation to the said management and store be empowered to,

Explanations.- (1) Dearness Allowance.- In addition to the minimum rates of basic wages fixed above, the employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance is linked to the Average consumer Price Index of chennai city for the year 2010, that is 161 points (with base 2001=100) and for any further raise of every one point over and above 161 points, an increase of Rupees 1.18 per point (Rupees One and Eighteen paise only) per day shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the first April on the basis of the average of the consumer price indices for the preceeding twelve months, that is from january to December.

(iii) The first calculation of the dearness allowance shall thus be effective from the date of publication of this Notification in the Tamil Nadu Government Gazette based on the Average of chennai city consumer Price Index for the previous year.

(2) where the nature of work is the same, no distinction in the payment of wages shall be made between men and women employees.

(3) To arrive at monthly rates of wages, the daily rates of wages shall be multiplied by 30.

(4) wherever the existing wages are higher than the minimum wages fixed herein, the same shall be continued to be paid.
