2. In the Order second read above, the Special Judgeunder the Tamil Nadu Protection of Interests of Depositors(in Financial Establishments) Act, 1997 (Tamil Nadu Act 44of 1997) has passed Orders in O.A.No. 23 of 2008, dated10th March 2008 filed by the accused proprietor,Thiru T. Gunasekaran, son of Thanagamuthu Gounder ofThiruvalargal Sindhu Finance, Palappampatti, UdumalpetTaluk, Coimbatore District to the effect that the ad-interimorder of attachment effected in G.O.Ms.No. 290, Home(Courts-IIA) Department, dated 5th April 2006 be raised.

3. The Competent Authorioty and District Revenue Officer,Coimbatore and the Inspector General of Police, EconomicOffences Wing-II, Chennai in their letter third and fourth readabove, had requested to pass necessary orders based onthe above said Court Order.

4. In compliance of the said Orders of the Special Judgein O.A.No. 23/2008, dated 10th March 2008 and in exerciseof the powers conferred by Section 3 of the Tamil NaduProtection of Interests of Depositors (in FinancialEstablishments) Act, 1997 (Tamil Nadu Act 44 of 1997), theGovernor of Tamil Nadu hereby rescinds the Governmentorders issued in G.O.Ms. No. 290, Home (Courts-IIA)Department, dated 5th April 2006.

Ad-Interim order attaching of Properties due to default inreturn of deposits by Vivasayigal Tin Vellamandi,Lakshmipuram, Theni District.

No. II(2)/HO/39/2009.—Whereas, complaints have beenreceived from number of depositors that Vivasayigal TinVellamandi, Lakshmipuram, Theni District a FinancialEstablishment which has defaulted the return of depositsmade by the depositors after maturity;

2. And, Whereas, the Government are satisfied that thesaid Financial Establishment is not likely to return the depositsto the depositors and hence, the Government have to protectthe interests of such depositors;

3. And, Whereas, the immovable properties specified inthe Schedule to this order are alleged to have been procuredby the certain partners of the said Financial Establishmentfrom and out of the deposits collected from the depositors;

4. Now, Therefore, in exercise of the powers conferredby Section 3 of the Tamil Nadu Protection of Interests ofDepositors (In Financial Establishments) Act, 1997 (TamilNadu Act 44 of 1997), the Governor of Tamil Nadu herebymakes an ad-interim order attaching the immovable propertiesof Thiru A.K.S. Ramadoss, son of A.K. Subbiah, Tmt. RathaRukmani, wife of A.K.S. Ramadoss and S.K. Srinivasan, sonof Krishnasamy alias Sanhinikrishnasamy, Partners ofVivasayigal Tin Vellamandi, Lakshmipuram, Theni District asspecified in the Schedule to this Order and transfers thecontrol over the said properties to the Competent Authoritynamely, the competent Authority and District Revenue Officer,Theni District appointed under the provisions of the said Act,for the purpose.

5. The Competent Authority is requested to pursue furtheraction in accordance with the procedures laid down in sub-sections (3) and (4) of Section 4 of the said Act and alsothe formalities prescribed in the Tamil Nadu Protection ofInterests of Depositors (in Financial Establishments) Rules,1997.

6. The Special Public Prosecutor, Special Court for theTamil Nadu Protection of Interests of Depositors (In FinancialEstablishments) Act, 1997 is requested to render necessaryassistance to the competent Authority, filing the application,before the said Special Court.
