I. PENDAHULUAN

1. Pemilihan Negara

Hubungan diplomatik antara Indonesia dan Kanada diresmikan pada

tahun 1953, dimana sejak saat itulah terjalin kemitraan yang erat dan

bersahabat antara keduanya. Hubungan bilateral terus meningkat melalui

kerjasama yang didasarkan pada tujuan bersama, misalnya perdagangan dan

investasi, pengentasan kemiskinan, penekanan resiko bencana alam dan

pandemic, memerangi terorisme internasional, memajukan tata pemerintahan

yang baik (good governance) dan hak asasi manusia, dan sebagainya.

Kanada, negara dengan GDP USD 1,821,424,139,311 dan GDP per

kapita USD 52,219 serta populasi 34.880.491 (data Bank Dunia 2012), memiliki

beberapa investasi langsung di Indonesia antara lain di bidang pertambangan,

minyak dan gas, keuangan, jasa, lingkungan dan agrifood. Sedangkan

Indonesia, merupakan negara tujuan investasi Kanada ketiga di Asia setelah

Jepang dan Hongkong dan kedua di Asia Tenggara setelah Singapura.

Investasi tunggal Kanada di Asia berada di Indonesia yaitu perusahaan

tambang PT. INCO di Soroako, Sulawesi Selatan, dengan nilai investasi sekitar

CAD 3,5 – 4 milyar. Tahun 2010 Kanada menempati peringkat ke-15 dari 39

negara-negara investor di Indonesia dengan nilai CAD 140,9 juta pada tahun

2010 menurun dari CAD 245,3 juta pada tahun 2009.


Intensitas hubungan ekonomi negara Indonesia dan Kanada mengalami

perkembangan positif, antara lain ditandai dengan pertemuan Menteri

Perdagangan kedua negara yang dilakukan beberapa kali di sela-sela berbagai

pertemuan internasional. Peningkatan devisa asal Kanada umumnya dari

sektor perdagangan, investasi, pariwisata, serta bantuan kerja sama

pembangunan.

Produk ekspor utama Indonesia ke Kanada adalah: karet, paperboard,

furniture, textile, footwear, plastics, leather, cacao, coffee, prawn, dan lain-lain.

Sedangkan produk impor Indonesia dari Kanada adalah: wheat & meslin,

fertilizers, woodpulp, machinery, aircraft, nickel, salt & sulfur, optic medical

instrument, plastic, dan lain-lain.

Statistics Canada per 28 Februari 2014, menyatakan bahwa rata-rata

nilai eskpor Indonesia ke Kanada antara tahun 2009 – 2013 adalah USD

1,237,795,000. Tahun 2013 merupakan peningkatan 1.45% dari nilai ekspor

tahun 2012 yang sebesar USD 1,314,368,000 menjadi senilai USD

1,333,370,000 di tahun 2013. Neraca perdagangan Indonesia terhadap

Kanada mengalami kenaikan 40.32% dari USD 367,622,000 di tahun 2012

menjadi USD 515,862,000 di tahun 2013.

Sementara itu, neraca perdagangan Indonesia dengan Kanada per

tahun 2013 menurut data BPS yang diolah oleh Departemen Perdagangan

dapat dilihat pada tabel berikut ini,

2. Pemilihan Produk

Sub sektor industri Tekstil dan Produk Tekstil (TPT) Indonesia

merupakan salah satu sub sektor yang patut diperhitungkan. Hal tersebut

dikarenakan industri tekstil dan garmen merupakan salah satu sub-sektor

industri hilir bersifat padat karya. Selain garmen atau pakaian jadi, produk

tekstil dari Indonesia yang mulai dikenal di pasar global adalah produk-

produk keperluan rumah tangga karena memiliki kontribusi yang cukup

tinggi pada nilai ekspor TPT di Indonesia.

Salah satu sub sektor tekstil kebutuhan rumah tangga adalah produk HS

630130 – Selimut Katun (Cotton Blankets), yang jika dilihat pada statistik

impornya ke Kanada selama periode 2009-2013 berpeluang tinggi untuk

ditingkataan.

Kebutuhan negara Kanada akan produk HS 630130 – Selimut Katun

(Cotton Blankets) sebagian besar disuplai oleh negara-negara produsen

Asia terutama China, India dan Pakistan. Pada periode 2009–2013, negara-

negara Asia rata-rata mensuplai lebih dari 80% per tahun kebutuhan

Kanada akan produk tersebut. Kemudian disusul oleh negara-negara

dengan ekonomi padat karya lainnya seperti Bangladesh, Portugal,

Thailand, Turkey, dan lain-lain. Kenyataan tersebut seharusnya

mempengaruhi upaya Indonesia untuk terus memperluas pangsa pasarnya

ke negara ini. Selain sesuai dengan acuan perekonomian Indonesia yang

semestinya banyak terkonsentrasi pada usaha jenis padat karya, tekstil dan

produk tekstil Indonesia sudah semakin dikenal dunia karena berkualitas

baik, sehingga bisa menjadi salah satu produk ekspor andalan negara.

Menurut data Statistics Canada, per tahun 2013 Indonesia berada di

posisi ke-11 diantara negara pengekspor produk – Selimut Katun (Cotton

Blankets) non elektrik ini bagi Kanada; posisi mana masih berpeluang untuk

ditingkatkan.


Adapun dipilihnya negara Kanada sebagai sasaran pemasaran produk

ini, adalah dikarenakan negara ini selalu tinggi permintaannya terhadap

produk Selimut Katun (Cotton Blankets) dari seluruh dunia, sebagaimana

terlihat pada Tabel-1 berikut ini:

Meskipun persaingan pasar dunia untuk produk tekstil sangat ketat,

Indonesia tetap berkesempatan luas untuk mempromosikan kelebihan

produknya, yaitu bukan hanya mengandalkan “harga murah” seperti pada

umumnya negara lain, tetapi justru mengedepankan produk “bermutu baik”

serta disain yang lebih kreatif dan kompetitif.

a. Geografis

Kanada menempati setengah bagian utara Amerika Utara, berbatasan

dengan Amerika Serikat di selatan dan Alaska di barat laut. Terbentang

dari Samudra Atlantik dan Selat Davis di timur sampai ke Samudra

Pasifik di barat; yang menjadi moto negara ini. Sedangkan di utara

terletak Laut Beaufort dan di timur laut adalah Samudra Arktik – Tanah

Hijau (Green Land). Luas total wilayah Kanada adalah 9.984.670 km2

dengan 9.093.507 km2 merupakan daratan dan 891.163 km2 wilayah

perairan. Iklim di Kanada tidak merata, dimana di wilayah utara dingin

dan beku sepanjang tahun, sedangkan di wilayah selatan mengalami 4


musim, yaitu dingin (-20 hingga 6 Celsius), semi, panas (15 hingga 25

Celsius) dan musim gugur.

b. Pemerintahan

Hak istimewa sebagai kepala negara Kanada dipegang oleh seorang

Gubernur Jenderal, yang umumnya merupakan politikus senior atau

orang Kanada lainnya yang menonjol, yang diangkat oleh Ratu atas

nasihat Perdana Menteri Kanada. Ratu Inggris dan khususnya Gubernur

Jenderal, memimpin hanya atas nama saja serta sedikit sekali memiliki

kekuasaan yang sesungguhnya, karena mereka hampir selalu bertindak

sesuai nasihat dari Kepala Pemerintahan (Perdana Menteri) Kanada.

d. Infrastruktur

Kanada portofolio adalah Transportasi, Infrastruktur dan Komunitas

pemerintahan Kanada. Hal ini memandu Departemen federal

mempertanggung-jawabkan pengembangan dan penyampaian

kebijakan program infrastruktur. Tahun anggaran 2007, infrastruktur

Kanada meluncurkan rencana $33 miliar selama tujuh tahun menangani

kebutuhan infrastruktur lokal dan regional, skala prioritas nasional bagi

masyarakat Kanada: yaitu ekonomi yang lebih kuat, lingkungan yang

bersih dan masyarakat yang lebih baik. Rencana ini meliputi investasi

infrastruktur berkaitan dengan air bersih, air limbah, angkutan umum,

dan prioritas skala nasional lainnya yang akan tetap berjalan hingga

tahun 2014. Pada anggaran 2009, pemerintah Kanada mengumumkan

tentang pemberian program stimulus jangka pendek sebagai bagian dari

upaya mengatasi efek resesi global.

Rencana program infrastruktur ekonomi yang disampaikan oleh

Infrastructure Canada membantu komunitas di seluruh negeri melalui

pendanaan proyek-proyek yang sudah siap dan bisa segera dimulai.

Pendanaan mana diantaranya untuk perbaikan jalan dan jembatan,

pembangunan sarana masyarakat serta meningkatkan fasilitas air

minum. Pada anggaran 2011, pemerintah Kanada berkomitmen untuk

bekerja sama dengan para mitra usaha guna mengembangkan rencana


jangka panjang bagi infrastruktur jangka panjang yang akan terus

berlangsung setelah tahun 2014.

II. POTENSI PASAR KANADA

Tanaman penghasil bahan atau kain katun yaitu kapas, biasa tumbuh

atau ditanam di seluruh wilayah dunia yang beriklim lebih hangat. Ada lima

jenis utama dari kapas yang diproduksi di seluruh dunia: Mesir, Sea Island,

Amerika Prima, Asiatic dan Upland. Kapas dapat tumbuh baik di bawah kondisi

tadah hujan dan irigasi. Tanaman kapas yang berdaun, semak hijaunya dapat

tumbuh hingga 3,5 meter, meskipun mereka biasanya dipangkas menjadi

sekitar 1,2 meter di perkebunan komersial. Serat kapas tumbuh terdiri dari

buah atau bola kapas, yang muncul dari krim tanaman dan bunga merah muda,

serta biji kapas.

Serat kapas dipisahkan dari bijinya dan diolah menjadi bahan atau kain

katun untuk berbagai macam produk termasuk pakaian, kain produk rumah

tangga, bola kapas, dan banyak lagi. Sementara biji atau benihnya dapat

dihancurkan untuk menghasilkan minyak biji kapas, minyak goreng populer,

dan daunnya dapat digunakan sebagai mulsa. Kapas merupakan salah satu

tanaman tertua di dunia dan telah memainkan peran sentral dalam mendukung

perkembangan industri tekstil.

Saat ini negara produsen kapas terbesar dunia adalah Amerika Serikat,

China, India, Pakistan, Uzbekistan, dan berbagai negara di Afrika tengah dan

barat.


Sekitar tahun 1940-an, kapas menyumbang 88 % dari semua kebutuhan

serat manusia. Saat ini jatuh menjadi hanya 44 % saja, sebagian dikarenakan

meningkatnya penggunaan serat sintetis seperti polyester dan nylon. Namun,

pasar produk berbahan katun tetap tinggi di masyarakat dunia, karena katun

mempunyai beberapa kelebihan yang tidak dimiliki jenis kain lainnya,

diantaranya:

1. Katun adalah kain yang bersifat “ Hypoallergenic”, yang berarti sangat

ideal bagi mereka yang rentan terhadap alergi atau iritasi kulit dan

secara luas digunakan dalam bidang medis di seluruh dunia. Adapun

penggunaan katun di dunia medis terutama untuk kebutuhan scrub

medis, kasa, perban, dan lain-lain.

2. Sifat kain katun yang lembut saat disentuh, memberikan kenyamanan

tersendiri bagi pemakainya. Bahkan dengan keunikan teksturnya, katun

juga dapat menjadi pelindung dari panas teriknya matahari dan

memberikan rasa hangat bagi pemakainya dalam kondisi cuaca yang

dingin dan berangin. Katun juga merupakan kain yang dapat “bernapas”,

karena memiliki kemampuan untuk mentransfer kelembaban yang

berasal dari kulit dengan kecepatan lebih tinggi daripada bahan sintetis.


3. Kapas tergolong material organik, sebab dilihat dari segi produksi, katun

menggunakan bahan kimia dan pestisida yang lebih sedikit maka oleh

sebab tidaklah salah apabila kapas merupakan serat alami yang penting

dan ramah bagi lingkungan. Serat bahan katun juga merupakan sumber

daya yang dapat diperbaharui atau dengan kata lain barang yang

terbuat dari kapas dapat diproduksi pada tingkat yang lebih cepat

daripada manusia dapat mengkonsumsinya. Kapas juga termasuk

produk biodegradable, berarti bahan yang akan terurai dalam lingkungan

alam sedangkan bahan Non-biodegradable, seperti karet contohnya

membutuhkan waktu ribuan tahun untuk dapat terurai (membusuk).

Bahkan popok sekali pakai atau diaper sekalipun membutuhkan waktu

sekitar 500 tahun untuk terurai, sehingga membuat popok berbahan

katun sebagai pilihan yang jauh lebih ideal dan ramah lingkungan.

4. Karena kekuatan dan serat alaminya bahan katun membuat biaya

perawatan menjadi lebih hemat, berbeda dengan serat bahan buatan

manusia seperti polyester yang cenderung memerlukan perawatan yang

lebih mahal.

5. Kapas tidak banyak menyusut selama di cuci beberapa kali

dibandingkan dengan kain lainnya, terutama bila udara kering, kapas

dapat menyerap air hingga 1/5 dari berat sebelum mulai menjadi

lembab, bahkan di kelembaban rendah, untuk tetap statis bebas, tahan


lama, juga menunjukkan lecak/ kusut lebih sedikit dan oleh sebab itulah

maka kain katun banyak digunakan dalam kebutuhan rumah tangga

seperti gorden, sprei, selimut, handuk mandi, dan pakaian.

Nilai ekspor Indonesia ke Kanada untuk produk-produk rumah tangga

berbahan baku katun cenderung meningkat dari tahun ke tahun. Fluktuasi

antara tahun 2009 – 2013 ditunjukkan pada Grafik-1 berikut ini.

Produk kebutuhan rumah tangga tersebut termasuk selimut, sprei dan

sarung bantal, taplak meja, gorden (curtain), home furnishing dan interior.

Diantara sekian produk tersebut, ekspor utama Indonesia berupa sprei dan


sarung bantal, kemudian gorden, home furnishing articles, selimut, taplak dan

kain-kain toilet dan dapur. Masih banyak produk rumah tangga katun lainnya

yang tidak atau belum pernah diekspor Indonesia seperti misalnya tenda,

matras, produk home interior blinds, dan lain-lain,

Sebagaimana produk berbahan katun pada umumnya, salah satu

produk rumah tangga dengan HS 630130 yaitu – Selimut Katun (Cotton

Blankets) jenis non-elektrik banyak diminati masyarakat Kanada yang faham

dan sangat mempehatikan keunggulan-keunggulan bahan katun sebagaimana

tersebut diatas.

Peluang pasar produk – Selimut Katun (Cotton Blankets) di negara

Kanada dapat dikatakan cukup tinggi, dimana selama periode 2009 – 2013

rata-rata permintaannya USD 10,106,476 yang hanya disuplai dari 86 negara;

namun dari sekian negara penghasil tersebut hanya beberapa negara yang

aktif dan rutin menyuplai setiap tahunnya termasuk Indonesia.

2.1. Analisa Ekspor Produk Selimut Katun (Cotton Blankets) Dari

antara tahun 2009 – 2013 cukup fluktuatif sebagaimana terlihat pada

Grafik-2 berikut ini.

Dimana pada tahun 2009 nilai ekspor Kanada ke dunia untuk –

Selimut Katun (Cotton Blankets) adalah sebesar USD 1,466,664 kemudian

turun 32.91% menjadi USD 983,978 di tahun 2010. Tahun berikutnya

merupakan penurunan 42.69% dari tahun 2010, menjadi USD 563,965.

Kemudian tahun 2012 terjadi peningkatan 38.21% dari tahun sebelumnya

sehingga berada di posisi nilai USD 779,446. Sedangkan tahun 2013, nilai

ekspornya meningkat 5.19% dibanding tahun 2012, dengan nilai ekspor

USD 819,936.


Secara rata-rata untuk periode 2009 – 2013 tersebut, Kanada

tercatat mengekspor produk – Selimut Katun (Cotton Blankets) ke dunia

senilai USD 922,797.80 per tahunnya. Nilai ekspor tertinggi terjadi di tahun

2009 senilai USD 1,466,664 dan terendah di tahun 2011 senilai USD

563,965.

Ekspor – Selimut Katun (Cotton Blankets) Kanada selama lima tahun

tersebut tercatat ke 63 negara dimana rata-rata 85.38%-nya bertujuan ke

negara Amerika Serikat, kemudian adalah ke negara United Kingdom

dengan rata-rata 4.58%. Negara pengimpor ketiga terbanyak adalah

Pakistan dengan rata-rata 0.74%, kemudian negara keempat adalah China

2.2. Potensi Pasar Ekspor Produk Selimut Katun (Cotton Blankets) Dari

Kanada Ke Dunia

Untuk mengimbangi ekspor dan kebutuhan dalam negerinya, Kanada

mengimpor – Selimut Katun (Cotton Blankets) dari negara produsen lain,

dimana pada Grafik-4 berikut ini secara jelas ditunjukkan fluktuatif maupun

trend nilai impor dan ekspornya selama tahun 2009 – 2013.

Sepuluh negara utama pengekspor produk – Selimut Katun (Cotton

Blankets) ke Kanada secara berturut-turut adalah China, India, Pakistan,

United States, Bangladesh, Portugal, Turkey, Thailand, Germany dan Austria.

Berdasarkan perhitungan rata-rata Tabel-2 dan Grafik-5 berikut ini

selama periode 2009 – 2013 bisa dilihat bahwa impor – Selimut Katun (Cotton

Blankets) dari negara posisi teratas per tahun 2009 yaitu China, rata-rata

sebesar 43.61% atau senilai USD 4,412,814 per tahunnya. Kemudian Pakistan

rata-rata sebesar 24.19% atau senilai USD 2,415,584 . Selanjutnya India,

dengan rata-rata 17.68% atau senilai USD 1,802,581 per tahunnya.


Negara di posisi keempat adalah United States, selama 2009 – 2013

rata-rata mensuplai 5.93% atau senilai USD 596,270 per tahun. Selanjutnya

Portugal rata-rata mengekspor 2.16% atau senilai USD220,426. Negara

keenam Bangladesh rata-rata mengekspor 1.58% atau senilai USD 161,384.

Kemudian Thaliand di posisi ketujuh dengan rata-rata mengekspor 0.53% atau

senilai USD 54,270. Selanjutnya Austria dengan rata-rata mengekspor 0.47%

atau senilai USD 47,420. Germany rata-rata mengekspor 0.34% atau senilai

USD 34,371. Posisi kesepuluh adalah Turkey, dengan rata-rata mengekspor

0.33% atau senilai USD 33,678.

Dari 10 negara pensuplai utama tersebut, Kanada rata-rata mengimpor

96.71% dari rata-rata keseluruhan impor Kanada selama 5 tahun, atau senilai

USD 9,778,799 dari USD 10,108,839. Sementara suplai dari negara lainnya

rata-rata 3.29% atau senilai USD 330,040. Suplai dari Indonesia hanya rata-

rata 0.17% atau senilai USD 16,939 per tahunnya selama periode tersebut.

Dari 86 negara produsen – Selimut Katun (Cotton Blankets) yang

mensuplai (atau pernah mensuplai) produk tersebut ke Kanada, hanya satu-

satunya negara Sweden di posisi ke-14 yang cenderung mengalami kenaikan

suplainya dari tahun ke tahun selama periode 2009 – 2013. Sementara negara

Indonesia menempati posisi ke-11 per data impor tahunan di tahun

Indonesia berada di posisi ke-2 setelah Thailand di lingkungan

pengekspor – Selimut Katun (Cotton Blankets) ke Kanada dari negara-negara

� Mutu TPT Indonesia umumnya masih sulit menembus pasar bebas

yang konsumennya berselera tinggi. Kenyataan ini mengakibatkan

harga per unit produk masih relatif rendah.

� Industri TPT Indonesia masih tergantung pada komponen impor,

terutama untuk memproduksi produk kualitas ekspor.

� Industri TPT Indonesia masih berperan sebagai ”tukang jahit” bagi para

pialang TPT internasional, karena desain, pemilihan warna, potongan

masih didikte oleh pialang luar negeri.

� Perusahaan TPT kecil di Indonesia belum berperan dalam industri TPT

yang masih sangat tergantung pada ”konglomerat” yang menguasai

sebagian besar dari pasar ekspor maupun segmen pasar menengah

ke atas dalam negeri.

� Pengaturan tata niaga, terutama pembagian kuota dinilai para

produsen barang TPT masih jauh dari ”baik”.

Sedangkan hambatan ekternal adalah berupa sikap proteksionis

beberapa negara maju yang membatasi ekspor produk TPT dari negara-negara

berkembang melalui penetapan kuota dan bea masuk. Pengaturan kuota

dilakukan negara tersebut melalui Multi Fiber Agreement (MFA) dan World

Trade Organization (WTO). Pada masa depan sistem kuota sedikit-sedikit akan

diabaikan sesuai dengan ketentuan WTO. Meskipun demikian, Indonesia harus

mampu menciptakan pasar baru untuk TPT di negara non-kuota, supaya

pertumbuhan industri TPT Indonesia dapat ditingkatkan.


III. PELUANG DAN STRATEGI

3.1. Peluang

Indonesia mengekspor beragam jenis tekstil dan produk tekstil dalam

lebih dari 15 sub-sektor pada kode HS 6-angka, sebagaimana data

inatrims.kemendag.go.id, rata-rata ekspor tahunannya adalah sebesar USD 30-

90 juta. Berdasarkan statistik yang dimuat dalam South East Asia Textile

Business Review 2009 (Edisi pertama), Indonesia menguasai 1,6% pasar

ekspor tekstil serta 1,7% pasar ekspor garmen dunia. Pasar ekspor tekstil dan

garmen terbesar Indonesia adalah United States, Uni Eropa dan Japan.

Sementara menurut data Asosiasi Pertekstilan Indonesia (API), produk

TPT Indonesia memiliki daya saing yang relatif baik di pasar internasional. Hal

ini disebabkan Indonesia memiliki industri pertekstilan yang lengkap dari hulu

ke hilir, yakni dari produk serat (fibers), produk benang/pemintalan (spinning),

pertenunan (weaving), rajutan (knitting), pakaian jadi (garment), dan produk

tekstil lainnya (other textile). Indonesia memiliki industri pemintalan (spinning)

yang besar di kawasan Asia dan Oceania. Demikian pula dengan industri

pertenunan yang produksinya kedua terbesar setelah China, serta industri

pakaian jadi yang dikenal di dunia internasional.


Tekstil dan Produk Tekstil juga merupakan salah satu produk andalan

ekspor Indonesia ke Kanada. Salah satu sub sektor produk TPT adalah

Peluang pasar produk ini cukup besar di Kanada, hal mana ditunjukkan

3.2. Strategi

Dalam meningkatkan penetrasi pasar ekspor di Kanada,

beberapa strategi yang perlu direkomendasikan untuk pengembangan

Rekomendasi bagi Pemerintah Indonesia

1. Peningkatan networking antara perwakilan perdagangan di Kanada,

khususnya ITPC Vancouver dan Atase Perdagangan Ottawa,

dengan pelaku bisnis dan pemerintah Kanada;

2. Pengembangan fasilitas promosi dagang bagi dunia usaha Indonesia

yang akan mempromosikan produknya di Kanada;

3. Baik ITPC Vancouver ataupun Atase Perdagangan Ottawa, dapat

berperan aktif dalam menjalin komunikasi dengan dunia usaha

Indonesia untuk saling dapat bertukar informasi mengenai

perdagangan suatu produk di Kanada.

4. Kementerian Perdagangan dan Kementerian Perindustrian dapat

membantu dunia usaha Indonesia dalam pembuatan label ke

Kanada disesuaikan dengan yang ditetapkan standar pemerintah

Kanada.

5. Faktor-faktor penting lainnya yang mempengaruhi ekspor – Selimut

Katun (Cotton Blankets) dari Indonesia adalah:

a) Peraturan pemerintah yaitu, deregulasi tentang tarif pajak ekspor,

dan lain-lain.

Notes.

1. This Section does not cover:

(a) Animal brush-making bristles or hair (heading 05.02); horsehair or horsehair waste (heading 05.11);

(b) Human hair or articles of human hair (heading 05.01, 67.03 or 67.04), except straining cloth of a kind commonly used in

oil presses or the like (heading 59.11);

(c) Cotton linters or other vegetable materials of Chapter 14;

(d) Asbestos of heading 25.24 or articles of asbestos or other products of heading 68.12 or 68.13;

(e) Articles of heading 30.05 or 30.06; yarn used to clean between the teeth (dental floss), in individual retail packages, of

heading 33.06;

(f) Sensitized textiles of headings 37.01 to 37.04;

(q) Abrasive-coated textile material (heading 68.05) and also carbon fibres or articles of carbon fibres of heading 68.15;

(r) Glass fibres or articles of glass fibres, other than embroidery with glass thread on a visible ground of fabric (Chapter 70);

(s) Articles of Chapter 94 (for example, furniture, bedding, lamps and lighting fittings);

(t) Articles of Chapter 95 (for example, toys, games, sports requisites and nets);

(u) Articles of Chapter 96 (for example, brushes, travel sets for sewing, slide fasteners, typewriter ribbons, sanitary towels

(pads) and tampons, napkins (diapers) and napkin liners for babies); or

(v) Articles of chapter 97.

2. (A) Goods classifiable in Chapters 50 to 55 or in heading 58.09 or 59.02 and of a mixture of two or more textile materials are

to be classified as if consisting wholly of that one textile material which predominates by weight over any other single

textile material.

When no one textile material predominates by weight, the goods are to be classified as if consisting wholly of that one

textile material which is covered by the heading which occurs last in numerical order among those which equally merit

consideration.

(B) For the purpose of the above rule:

(a) Gimped horsehair yarn (heading 51.10) and metallized yarn (heading 56.05) are to be treated as a single textile

material the weight of which is to be taken as the aggregate of the weights of its components; for the classification of

woven fabrics, metal thread is to be regarded as a textile material;

(b) The choice of appropriate heading shall be effected by determining first the Chapter and then the applicable heading

within that Chapter, disregarding any materials not classified in that Chapter;

(c) When both Chapters 54 and 55 are involved with any other Chapter, Chapters 54 and 55 are to be treated as a

single Chapter;

(d) Where a Chapter or a heading refers to goods of different textile materials, such materials are to be treated as a

single textile material.

(C) The provisions of paragraphs (A) and (B) above apply also to the yarns referred to in Notes 3, 4, 5 or 6 below.

3. (A) For the purpose of this Section, and subject to the exceptions in paragraph (B) below, yarns (single, multiple (folded)

or cabled) of the following descriptions are to be treated as ''twine, cordage, ropes and cables'':

(a) Of silk or waste silk, measuring more than 20,000 decitex;

(b) Of man-made fibres (including yarn of two or more monofilaments of Chapter 54), measuring more than

10,000 decitex;

(c) Of true hemp or flax:

(i) Polished or glazed, measuring 1,429 decitex or more; or

(ii) Not polished or glazed, measuring more than 20,000 decitex;

(d) Of coir, consisting of three or more plies;

(e) Of other vegetable fibres, measuring more than 20,000 decitex; or

(f) Reinforced with metal thread.

(B) Exceptions:

(a) Yarn of wool or other animal hair and paper yarn, other than yarn reinforced with metal thread;

(b) Man-made filament tow of Chapter 55 and multifilament yarn without twist or with a twist of less than 5 turns per metre

of Chapter 54;

(c) Silk-worm gut of heading 50.06, and monofilaments of Chapter 54;

(d) Metallized yarn of heading 56.05; yarn reinforced with metal thread is subject to paragraph (A) (f) above; and

(e) Chenille yarn, gimped yarn and loop wale-yarn of heading 56.06.

4. (A) For the purpose of Chapters 50, 51, 52, 54 and 55, the expression ''put up for retail sale'' in relation to yarn means,

subject to the exceptions in paragraph (B) below, yarn (single, multiple (folded) or cabled) put up:

(a) On cards, reels, tubes or similar supports, of a weight (including support) not exceeding:

(i) 85 g in the case of silk, waste silk or man-made filament yarn; or

(ii) 125 g in other cases;

(b) In balls, hanks or skeins of a weight not exceeding:

(i) 85 g in the case of man-made filament yarn of less than 3,000 decitex, silk or silk waste;

(ii) 125 g in the case of all other yarns of less than 2,000 decitex; or

(iii) 500 g in other cases;

(c) In hanks or skeins comprising several smaller hanks or skeins separated by dividing threads which render them

independent one of the other, each of uniform weight not exceeding:

(i) 85 g in the case of silk, waste silk or man-made filament yarn; or

(ii) 125 g in other cases.

(B) Exceptions:

(a) Single yarn of any textile material, except:

(i) Single yarn of wool or fine animal hair, unbleached; and

(ii) Single yarn of wool or fine animal hair, bleached, dyed or printed, measuring more than 5,000 decitex;

(b) Multiple (folded) or cabled yarn, unbleached:

(i) Of silk or waste silk, however put up; or

(ii) Of other textile material except wool or fine animal hair, in hanks or skeins;

(c) Multiple (folded) or cabled yarn of silk or waste silk, bleached, dyed or printed, measuring 133 decitex or less; and

(d) Single, multiple (folded) or cabled yarn of any textile material:

(i) In cross-reeled hanks or skeins; or

(ii) Put up on supports or in some other manner indicating its use in the textile industry (for example, on cops, twisting

mill tubes, pirns, conical bobbins or spindles, or reeled in the form of cocoons for embroidery looms).

5. For the purpose of headings 52.04, 54.01 and 55.08 the expression ''sewing thread'' means multiple (folded) or cabled yarn:

(a) Put up on supports (for example, reels, tubes) of a weight (including support) not exceeding 1,000 g;

(b) Dressed for use as sewing thread; and

(c) With a final ''Z'' twist.

6. For the purpose of this Section, the expression ''high tenacity yarn'' means yarn having a tenacity, expressed in cN/tex

(centinewtons per tex), greater than the following:

Single yarn of nylon or other polyamides, or of polyesters...........................................60 cN/tex

Multiple (folded) or cabled yarn of nylon or other polyamides, or of polyesters...........53 cN/tex

Single, multiple (folded) or cabled yarn of viscose rayon.............................................27 cN/tex.

7. For the purpose of this Section, the expression ''made up'' means:

(a) Cut otherwise than into squares or rectangles;

(b) Produced in the finished state, ready for use (or merely needing separation by cutting dividing threads) without sewing or

other working (for example, certain dusters, towels, table cloths, scarf squares, blankets);

(c) Cut to size and with at least one heat-sealed edge with a visibly tapered or compressed border and the other edges

treated as described in any other subparagraph of this Note, but excluding fabrics the cut edges of which have been

prevented from unravelling by hot cutting or by other simple means;

(d) Hemmed or with rolled edges, or with a knotted fringe at any of the edges, but excluding fabrics the cut edges of which

have been prevented from unravelling by whipping or by other simple means;

(e) Cut to size and having undergone a process of drawn thread work;

(f) Assembled by sewing, gumming or otherwise (other than piece goods consisting of two or more lengths of identical

material joined end to end and piece goods composed of two or more textiles assembled in layers, whether or not

padded);

(g) Knitted or crocheted to shape, whether presented as separate items or in the form of a number of items in the length.

8. For the purposes of Chapters 50 to 60:

(a) Chapters 50 to 55 and 60 and, except where the context otherwise requires, Chapters 56 to 59 do not apply to goods

made up within the meaning of Note 7 above; and

(b) Chapters 50 to 55 and 60 do not apply to goods of Chapters 56 to 59.

9. The woven fabrics of Chapters 50 to 55 include fabrics consisting of layers of parallel textile yarns superimposed on each

other at acute or right angles. These layers are bonded at the intersections of the yarns by an adhesive or by thermal

bonding.

10. Elastic products consisting of textile materials combined with rubber threads are classified in this Section.

11. For the purpose of this Section, the expression ''impregnated'' includes ''dipped''.

12. For the purpose of this Section, the expression ''polyamides'' includes ''aramids''.

13. For the purposes of this Section and, where applicable, throughout the Nomenclature, the expression ''elastomeric yarn''

means filament yarn, including monofilament, of synthetic textile material, other than textured yarn, which does not break on

being extended to three times its original length and which returns, after being extended to twice its original length, within a

period of five minutes, to a length not greater than one and a half times its original length.

14. Unless the context otherwise requires, textile garments of different headings are to be classified in their own headings even if

put up in sets for retail sale. For the purposes of this Note, the expression "textile garments" means garments of headings

61.01 to 61.14 and headings 62.01 to 62.11.

Subheading Notes.

1. In this Section and, where applicable, throughout the Nomenclature, the following expressions have the meanings hereby

assigned to them:

(a) Unbleached yarn

Yarn which:

(i) has the natural colour of its constituent fibres and has not been bleached, dyed (whether or not in the mass) or printed;

or

(ii) is of indeterminate colour (''grey yarn''), manufactured from garnetted stock.

Such yarn may have been treated with a colourless dressing or fugitive dye (which disappears after simple washing

with soap) and, in the case of man-made fibres, treated in the mass with delustring agents (for example, titanium

dioxide).

(b) Bleached yarn

Yarn which:

(i) has undergone a bleaching process, is made of bleached fibres or, unless the context otherwise requires, has been

dyed white (whether or not in the mass) or treated with a white dressing;

(ii) consists of a mixture of unbleached and bleached fibres; or

(iii) is multiple (folded) or cabled and consists of unbleached and bleached yarns.

(c) Coloured (dyed or printed) yarn

Yarn which:

(i) is dyed (whether or not in the mass) other than white or in a fugitive colour, or printed, or made from dyed or printed

fibres;

(ii) consists of a mixture of dyed fibres of different colours or of a mixture of unbleached or bleached fibres with coloured

fibres (marl or mixture yarns), or is printed in one or more colours at intervals to give the impression of dots;

(iii) is obtained from slivers or rovings which have been printed; or

(iv) is multiple (folded) or cabled and consists of unbleached or bleached yarn and coloured yarn.

The above definitions also apply, mutatis mutandis, to monofilament and to strip or the like of Chapter 54.

(d) Unbleached woven fabric

Woven fabric made from unbleached yarn and which has not been bleached, dyed or printed. Such fabric may have been

treated with a colourless dressing or a fugitive dye.

(e) Bleached woven fabric

Woven fabric which:

(i) has been bleached or, unless the context otherwise requires, dyed white or treated with a white dressing, in the piece;

(ii) consists of bleached yarn; or

(iii) consists of unbleached and bleached yarn.

(f) Dyed woven fabric

Woven fabric which:

(i) is dyed a single uniform colour other than white (unless the context otherwise requires) or has been treated with a

coloured finish other than white (unless the context otherwise requires), in the piece; or

(ii) consists of coloured yarn of a single uniform colour.

(g) Woven fabric of yarns of different colours

Woven fabric (other than printed woven fabric) which:

(i) consists of yarns of different colours or yarns of different shades of the same colour other than the natural colour of the

constituent fibres);

(ii) consists of unbleached or bleached yarn and coloured yarn; or

(iii) consists of marl or mixture yarns.

(In all cases, the yarn used in selvedges and piece ends is not taken into consideration.)

(h) Printed woven fabric

Woven fabric which has been printed in the piece, whether or not made from yarns of different colours.

(The following are also regarded as printed woven fabrics: woven fabrics bearing designs made, for example, with a brush

or spray gun, by means of transfer paper, by flocking or by the batik process.)

The process of mercerization does not affect the classification of yarns or fabrics within the above categories.

The definitions at (d) to (h) above apply, mutatis mutandis, to knitted or crocheted fabrics.

(ij) Plain weave

A fabric construction in which each yarn of the weft passes alternately over and under successive yarns of the warp and

each yarn of the warp passes alternately over and under successive yarns of the weft.

2. (A) Products of Chapters 56 to 63 containing two or more textile materials are to be regarded as consisting wholly

of that textile material which would be selected under Note 2 to this Section for the classification of a product of

Chapters 50 to 55 or of heading 58.09 consisting of the same textile materials.

(B) For the application of this rule:

(a) where appropriate, only the part which determines the classification under Interpretative Rule 3 shall be taken into

account;

(b) in the case of textile products consisting of a ground fabric and a pile or looped surface no account shall be taken of

the ground fabric;

(c) in the case of embroidery of heading 58.10 and goods thereof, only the ground fabric shall be taken into account.

However, embroidery without visible ground, and goods thereof, shall be classified with reference to the embroidering

threads alone.

Supplementary Note.

1. For the purposes of giving effect to Appendix 6 of Annex 300-B of Chapter Three of the North American Free Trade

Agreement, goods of the tariff items contained in subheadings 5112.11, 5112.19, 5509.31, 5801.35 and 5801.36 are entitled

to the United States Tariff subject to the condition set out in the Order Amending the Schedule to the Customs Tariff

(Conditions for Special Provisions for the Purposes of the United States Tariff (UST)).
