Pursuant to the provisions of the Rights of Way Management Regulations, 333 CMR 11.00, in order to apply herbicides to control vegetation along rights of way, a 5-year Vegetation Management Plan (VMP) and a Yearly Operational Plan (YOP) must be approved by the Department of Agricultural Resources (DAR). 45 DAY PUBLIC NOTICE

Public Review: The DAR in particular seeks the verification of sensitive area locations reported in the YOP. The DPW itself has a limited ability to survey the geography, land use, and the water supplies through which the rights of way are located. However, other City Departments may have most of this information readily available, and the particular knowledge to better certify the sensitive areas in this community. Therefore, the DPW requests and urges the assistance of the Conservation Commission and the Board of Health in reviewing the completeness and accuracy of the maps contained in the submitted documents. The DAR has established the following procedures for this review. The VMP, YOP, and a copy of this notice will be sent by the applicant (Holyoke DPW) to the Conservation Commission, Board of Health (or other designated health agent), and to the head of government (City Mayor) of the community where herbicides are to be applied along the rights of way during the calendar year 2010. Municipal agencies and officials will have forty-five (45) days following receipt of the plans to review maps contained in the documents that indicate the location of “sensitive areas not readily identifiable in the field” for inaccuracies and omissions. “Sensitive Areas” are defined in Section 11.02 (a-f) of the Rights of Way Management Regulations. Municipal agencies and officials are requested to forward the VMP and YOP to the appropriate officials in their municipality qualified to certify the accuracy of sensitive area locations as indicated on the maps. The maps should be “corrected” and returned to the applicant. Also, a copy of the maps with these corrections indicated should be sent to the DAR to the address listed below, within the forty-five day review period. If a City or Town needs more time to carry out this review, it should send a written request for an extension to the DAR and state why there is a “good cause” for requesting additional time. All corrections are required to be made by the applicant, and corrected maps sent back to the City or Town before the YOP can be considered “approved” by the DAR for vegetation maintenance in that municipality. Any dispute on the part of the applicant regarding corrections made by municipal authorities should be indicated in writing to the DAR and the City or Town which requested the disputed changes, within fifteen (15) days of receipt of the request. The DAR will decide whether or not the YOP should be approved without the requested changes. The DAR will consider the “final approval” of a YOP individually for each municipality. The final twenty one (21) days of the public review period can serve concurrently to provide public notification as required by Section 11.07 of the Rights of Way Management Regulations, if the applicant has an approved VMP, and if all the requisite City or Town offices which have received copies of the YOP have completed their review and corrections have been duly made by the applicant and approved by the DAR. Failure by the City or Town to respond to the applicant’s submission of the YOP within the forty-five (45) day public review period will be considered by the DAR to indicate agreement by the municipal officials with the sensitive area demarcations as provided by the applicant in their YOP. IV. Herbicides Application Techniques and Alternative Control Methods:

Roadway vegetation management will involve IPM management techniques, including active planting to encourage appropriate competing vegetation, mechanical control methods (street sweeping and vacuuming, hand cutting, mowing, selective trimming) and chemical control (e.g., foliar herbicide treatment and cut stump treatments). The particular method(s) chosen will be based on a variety of factors to establish an easily maintainable, stable plant population that will not interfere with vehicles or pedestrians. The method chosen for a given vegetation problem will also attempt to achieve a long term, low maintenance vegetation program through the encouragement of a stable herbaceous community.

Alternative control measures will include programs to encourage growth of desirable grasses and wildflower beds, along with various landscaping and visual improvement projects focused along City roadways (e.g., adopt-an-island program, cut stump, clearing and grubbing, selective clearing and thinning).

Chemical controls include foliar treatments and cut stump treatments. Mechanical controls include planting, street sweeping and vacuuming, hand cutting, mowing and selective trimming (refer to pages 4 through 7 of the VMP for detailed descriptions of these techniques).

VI. Flagging Methods to Designate Sensitive Areas on the Rights-of-Way:

Sensitive areas are identified as public ground water supplies, public surface water supplies, private drinking water supplies, surface waters, wetlands, habitat areas, and agricultural areas. For the purpose of identification, sensitive areas are separated into two categories, identifiable and not readily identifiable areas in the field.

Sensitive areas not readily identifiable in the field include public groundwater supplies,

wetlands, private water supplies and public surface water supplies. The process by which sensitive areas were determined were as follows:

a) areas to be sprayed were walked to determine sensitive areas;

b) questionable areas were checked by the CC; and,

c) BOH records were reviewed to locate wells of older homes that do not conform to today’s stringent setback requirements. Homeowners were contacted in cases where no records were available.

These areas will be flagged or otherwise marked as “no spray zones” (e.g., via the use of high visibility spray painted “orange arrows”) applied to adjacent curbs, sidewalks or road surfaces according to the table below:

VII. Procedures and Locations for Handling, Mixing and Loading of Herbicide Concentrates:

All mixing and loading of herbicides will be conducted at the central facility where the herbicides are stored (refer to appendix E). Only the amount of herbicide necessary as determined by monitoring results will be mixed to carry out the vegetation control. The vehicle carrying out the spray operation will be equipped with a spill kit, including a bag of absorbent, activated charcoal, leak-proof container a broom and a shovel. A clipboard log of the herbicides on the vehicle will be kept on the vehicle (refer to appendix E). Herbicide labels, fact sheets and/or material safety data sheets should be carried on-site by the applicator. As soon as any spill is observed, immediate action by the applicator will be taken to contain the spill and protect the environment. The cause of the spill must be identified and secured. Spill containment will be accomplished by covering the spill with an absorbent material or, for large spills, building clay or soil dikes to impede spill progress. Until completely cleaned, the general public will be protected against accidental exposure by placing barriers, posting signs or flagmen at strategic locations. If a fire is involved, care will be taken to avoid breathing fumes from any burning chemical. In the event of a spill, information on safety precautions and clean-up procedures may be gathered from herbicide fact sheets, labels, and the sources listed on page 7 of this YOP, under Section VIII entitled “Emergency Contacts”. Minor spills will be remedied by soaking up the spill with an absorbent material and placing it in a leak proof container for proper labeling and disposal. Dry herbicides, such as granulars, will be swept-up or shoveled-up directly in leak proof containers for proper disposal. All contaminated soil will be placed in leak proof containers, removed from the site and disposed of properly. Activated charcoal will be incorporated into the soil at the spill location at a rate of 7 pounds per thousand square feet to inactivate any herbicide residue. Any spill will be reported to the Pesticide Bureau. In addition to the Pesticide Bureau, the DEP Incident Response Unit will be notified of any spill in excess of the reportable quantity (“RQ”) value for the herbicide.

SCOPE OF WORK

The proposed work involves the application of herbicides to control target vegetation along City roads in accordance with the Rights of Way Management Regulations (333 CMR 11.00) and the Holyoke DPW’s Vegetation Management Plan (VMP). The VMP has been approved by the Department of Agricultural Resources, and became effective for a five (5) year period starting in 2008. Primary target vegetation locations include: traffic islands; curbing; expansion joints; sidewalks; median barriers; pavement crevices; sign and delineator posts; poison ivy, oak and sumac; proposed wildflower beds; and other areas adjacent to City roads and intersections. Additional landscape and visual improvement projects will be focused along City roads, and will address the management of vegetation problems in those areas in the most environmentally sound manner while minimizing vegetation control in the long term (i.e., selecting pruning, thinning, clearing, cut stump, and foliar herbicide treatments). Any applicator of herbicides will hold a valid pesticide license/certificate from the DAR, and will adhere to the operational guidelines set forth in the VMP.

o Don proper hand protection (Latex Examination Gloves or similar protection), eye protection (safety glasses w/side shields or chemical goggles, water proof shoes or over shoes, long-sleeved shirts and pants prior to handling, mixing and applying.

o Read the herbicide “label” and “Material Safety Data

Sheet” (MSDS) thoroughly before applying. Keep a copy of the label, MSDS and herbicide application log with you at all times during application.

o For low volume directed spray applications, mix and

apply the manufacturer’s suggested rate (see applicable label) for the herbicide. Apply only by hand using a low to moderate pressure or low to moderate-ranged, large droplet spray.

o Avoid contact with your hands, skin, mouth or eyes.

Rinse exposed skin or eyes with copious amounts of cold water, as soon as possible.

o Remove and discard your gloves, and wash your hands

with soap and water before eating, smoking, or applying cosmetics.

o Record all applications daily per the “herbicide

application log”.

APPLICATION INSTRUCTION

REVISED 3/3/08

o After each daily application, return all unused herbicide

to its closed, original container, and lock inside the pesticide storage cabinet in Bay #1 of the DPW.

o The empty container retains vapor and product residue.

Do not reuse original container. Triple rinse sprayer & nozzle after each use, and triple rinse the product container when empty; apply rinse water with sprayer to weeks, as you would apply the normal product/water mixtures. Do this so as to avoid creating any wastes of this product, which would need to be disposed of in an approved landfill for pesticide disposal. After rinsing, puncture the empty container and dispose of it in sanitary landfill or by incineration.
