Search and Seizure—Plain View— Evidence of a Crime (Bloody Clothing).

Warrantless seizure of bloody clothing at hospital where defendant was being treated for gunshot wound was lawful. Defendant’s freedom of movement was not re-stricted by police but was due to physical condition. Miranda warnings not required because defendant was neither in custody nor deprived of freedom of movement in a significant way.

SteinBerg, J., February 14, 2019. The defendant, Michael Del Cristo, arrived at Lehigh Valley Hospital—Muhlenberg with a gunshot wound and several baggies of crack cocaine. As a result of the discovery of the crack cocaine by the police, the defendant was charged with Possession With Intent to Deliver a Controlled Substance1 and Possession of a Controlled Substance.2

On November 15, 2018, counsel for the defendant filed an Omnibus Pretrial Motion, including a Motion to Suppress Evi-dence. It is alleged in that motion that the defendant was being treated at Muhlenberg Hospital for a gunshot wound when the police arrived to investigate the cause of the defendant’s wound. During the ensuing discussion, the police informed him that his clothing would be taken into evidence. The defendant was asked if he needed anything from his clothes before they were seized, and the defendant retrieved a “black soft shell case.” He was asked by Officer Ralph Gontz of the Bethlehem Police Department about the contents of the case, and the defendant opened the case and exposed the crack cocaine.

The defendant alleges that no search warrant was secured to search the case, and the defendant did not consent to the search of the case. A hearing on the suppression motion was held on January 9, 2019, during which Officer Gontz testified.

Officer Gontz’s version of events is not substantially different from counsel’s motion to suppress. However, his testimony added certain salient facts, including the defendant’s explanation about the shooting, and the officer’s reason for seizing the clothing. The defendant explained that he was shot during a robbery outside of an establishment identified as Broadway Social in Bethlehem. His clothing, which was bagged by hospital personnel, was seized be-cause it had visible blood which might be relevant to the shooting investigation.3

Officer Gontz asked the defendant if he needed anything from his clothing, and the defendant then retrieved the case from his jacket pocket. He was about to put the case in his pants when Officer Gontz inquired about the contents of the case. The defen-dant, of his own volition, opened the case exposing the crack co-caine.4

The defendant testified at the suppression hearing and con-firmed Officer Gontz’s testimony. Although injured and con-nected to an I.V., he testified that he understood everything the officer asked of him. He believed that Officer Gontz was treating him as a victim. He also testified that he was “okay with the police taking his clothing.” He readily admitted that he did not object to the police request. Moreover, he admitted that he knew cocaine was in the case, and that was the reason he was trying to hide it.

DISCUSSION

The seizure of the defendant’s clothing was solely intended to assist in the police investigation regarding his shooting, not to further a drug investigation. The defendant was not suspected of any wrongdoing. Likewise, the offer to him by the police to retrieve needed items from his clothing was not intended to uncover any

drugs nor any criminal conduct. The defendant’s display of the crack cocaine was an unintended consequence of the gunshot investigation.

Even so, this search and seizure conundrum begins with de-termining whether the warrantless seizure of the defendant’s cloth-ing was justified. Both the testimony of Officer Gontz and the photographs taken at the hospital demonstrate that blood was on the defendant’s clothing. The blood was in plain view, and the of-ficer was lawfully in the defendant’s hospital room. The plain view doctrine, which is applicable to search and seizure issues under both the Fourth Amendment of the United States Constitution, and Article I, Section 8 of the Pennsylvania Constitution, permits a war-rantless seizure where: “(1) the police have not violated the Fourth Amendment in arriving at the location from which the item could be viewed; (2) the item is in plain view; (3) the incriminating char-acter of the item is immediately apparent; and (4) the police have a lawful right of access to the item itself.” Commonwealth v. Jones, 605 Pa. 188, 201, 988 A.2d 649, 656 (2010); see also, Commonwealth v. McCree, 592 Pa. 238, 245, 924 A.2d 621, 625 (2007); Common-wealth v. Turner, 982 A.2d 90, 92 (Pa. Super. 2009). Here, the only plain view doctrine requirement that requires discussion is the in-terpretation of the phrase “the incriminating character of the object must be immediately apparent.” It has been consistently held that the “incriminating character of the item” is not limited to contraband, but encompasses evidence of a crime. See Jones, supra at 204, 988 A.2d at 658; Turner, supra; Commonwealth v. Davenport, 453 Pa. 235, 244, 308 A.2d 85, 89 (1973) (Plain view doctrine is not limited to inherently contraband goods.); United States v. Davis, 690 F.3d 226 (4th Cir. 2012) (collecting cases) (An item need not itself be contraband before it has an “incriminating nature,” but instead, an item need only be evidence of a crime.); Chavis v. Wainwright, 488 F.2d 1077, 1078 (5th Cir. 1973) (Clothing in plastic hospital bag was properly seized from stabbing victim in hospital without a warrant as evidence of an assault.). The defendant’s bloody clothing was evidence that he was injured in the shooting. It might also have had unknown evidentiary qualities that could only be determined after scientific analysis. Therefore, Officer Gontz lawfully seized the de-fendant’s clothing.

able from the within case.5 The defendant in Silo stabbed his mother to death. During the course of the police investigation, the defendant, who was hospitalized, became a suspect. The police returned to the hospital and without a warrant seized his clothing from the nurses. The clothing, upon inspection, was found to con-tain blood stains. Here, although the defendant’s clothing was also seized without a warrant, he was not a suspect in a crime, and the blood was observed in plain view, justifying the clothing’s seizure. The defendant also had no objection to the clothing’s seizure.

The lawful seizure of the defendant’s clothing permitted the police to inventory the items seized. However, that became un-necessary when the defendant retrieved the case from his pocket and, upon inquiry, disclosed its contents to Officer Gontz. The crack cocaine was in plain view and rightfully seized. Once again, Officer Gontz was lawfully in the hospital, the cocaine was in plain view when the case was opened, the incriminating character of the cocaine was immediately apparent, and the police had a lawful right of access to the case and cocaine when the defendant opened the case.

Finally, the defendant was neither seized nor subject to a custodial interrogation when Officer Gontz inquired about the contents of the case. His freedom of movement was not restricted by any action on the part of the police, but was due to his physical condition. See Commonwealth v. Johnson, 556 Pa. 216, 239, 727 A.2d 1089, 1100 (1999). The defendant, by trying to place the case in his pocket, may have made Officer Gontz suspicious, but that suspicion did not trigger Miranda6 warnings. Commonwealth v.

The United States Supreme Court has stated the “ul-timate inquiry is ... whether there [was] a ‘formal arrest or restraint on freedom of movement’ of the degree associated with a formal arrest.” Commonwealth v. Boczkowski, 577 Pa. 421, 447, 846 A.2d 75, 90 (2004) (quoting Stansbury v. California, 511 U.S. 318, 322 (1994)). Officer Gontz’s inquiry regarding the contents of the case was not a custodial interrogation.

Fento, 363 Pa. Superior Ct. 488, 492, 526 A.2d 784, 786 (1987); Commonwealth v. Clinton, 905 A.2d 1026, 1031-33 (Pa. Super. 2006); Commonwealth v. Perry, 710 A.2d 1183, 1185-86 (Pa. Super. 1998).

Additionally, no seizure occurred when Officer Gontz asked the defendant about the contents of the case. The interaction was a mere encounter, and Officer Gontz was free to ask the defendant questions without implicating the Fourth Amendment “as long as they did not convey a message that [the defendant] was required to comply with their request.” Commonwealth v. Singleton, 169 A.3d 79, 83 (Pa. Super. 2017) (Officers did not subject the defen-dant to a seizure when they approached him in a public place and asked him what was inside a bag.); Commonwealth v. Young, 162 A.3d 524 (Pa. Super. 2017) (Defendant was not subject to a seizure when police approached defendant on a public street and asked him if he possessed anything “that could harm them.”). Here, as in Singleton, the request for information was not accompanied by a “mandate to comply, physical restraint, or any show of authority.” Singleton, supra.

For all the foregoing reasons, the Motion to Suppress must be denied.

New Clean Slate legislation has recently been signed into law in Pennsylvania that allows for individuals to petition the courts to have their criminal records sealed if the person has been free from conviction for 10 years for an offense that resulted in a year or more in prison and has paid all court-ordered financial debts.

Additionally, the new law allows automatic sealing of records for second or third-degree misdemeanor offenses that included a less than two-year prison sentence if a person has been free from convictions for 10 years, as well as sealing of criminal history records related to charges that resulted in non-convictions.

“The Golden Rule in Pennsylvania’s Code of Civility” Presented by: John P. Servis, Esq.

Adopted in 2000 and amended in 2005, Pennsylvania’s Code of Civility is designed to express principles that encourage judges and lawyers to treat each other, and the judicial system, with dignity and respect. The Code is divided into two parts: A Judge’s Duties to Lawyers and Other Judges, and the Lawyer’s Duties to the Court and to Other Lawyers. In this seminar Attorney John Servis will examine both parts with primary emphasis on the duties of lawyers. He will consider some practical examples of these principles, and their intersection with the Rules of Professional Conduct where applicable.

Attorney John Servis is a solo practitioner in Orefield, PA who focuses on drafting wills and other estate planning documents. He graduated in 1982 from Cornell University with a B.A. in classical language. He received his J.D. from American University in 1985, and his LLM in Taxation from Villanova University in 1995. Attorney Servis is a 30-year member of the bars of Pennsylvania, New Jersey and the District of Columbia.

Most recently, Attorney Servis earned an M.A. in history from Lehigh University in 2011. He is chairperson of BALC’s Continuing Legal Education Committee. He also serves on the Board of Trustees of the Lehigh County Historical Society. Since 2006, Attorney Servis has been a member of the Organization of American Historians. His primary areas of interest and research in history are 19th and 20th century American history, intellectual history, women’s history, African American history and labor history.
