The top court agreed to examine the plea jointly filed by the law stu- dent and his advocate fa- ther, alleging that the prices of medicines, med- ical devices and medical consumables were inflated in collaboration and con- nivance with the drug man- ufacturers. A bench of Justices S A Bobde and L Nageswara Rao issued no- tice and sought reply from Centre and all states on the matter in four weeks. Advocate Vijay Pal Dalmia, the joint petitioner with son Siddharth Dalmia, ap- peared in person and said by taking advantage of the ignorance, their plight and adverse circumstances of the patients in hospitals across India, people were being compelled to buy medicines from there or their in-house pharmacies. Highlighting the prob- lems faced during the treat- ment of his mother who was last year diagnosed with breast cancer, the law student in his plea said she had to undergo surgery, which was to be followed by six rounds of chemothera- py and other treatments along with Biceltis injec- tions every 21 days. During the course of treatment, it came to their notice that Biceltis injection was sold to them at a MRP of Rs 61,132, while the same med- icine manufactured and marketed by the same com- pany was being sold in the open market at a discount- ed rate of Rs.50,000. Besides, on purchase of four injections, one injec- tion was given free of cost to the patient towards the pa- tients' support programme by the company. The plea said that by giving a free injection, the effective cost per injection came to around Rs 41,000, but it was being sold at a MRP of Rs.61,132. He said the entire treatment till now has incurred a cost of Rs 15 lakh and the total esti- mate of complete treatment will be around Rs 30 lakh. Dalmia said the hospital and their in-house pharma- cies did not give them the free injection, being offered by the medicine company, and they, for the first time, realised the existence of an organized methodology adopted by the hospitals, nursing homes and health care institutions for "fleec- ing and looting" patients by compelling to buy medi- cines only from them. "These acts of financial malpractices by the hospi- tals all over India are against the humans, hu- manity, morality and the right of the citizens of India to live a dignified and re- spectable life, and the fact that it is also obligatory on the Respondents to provide best and affordable health care to the citizens of India," the plea said. Attorney General (AG) K K Venugopal told a bench headed by Chief Justice Dipak Misra that an inter- locutor, appointed by the Centre to hold talks with all stakeholders to resolve the Kashmir issue, was discussing these issues and it was an "ongoing process". Dineshwar Sharma, former director of the Intelligence Bureau (IB), was appointed the Centre's interlocutor for J and K on October 23 last year. Article 35A, which was incorporated in the Constitution by a 1954 Presidential Order, ac- cords special rights and privileges to the citizens of J and K and denies proper- ty rights to a woman who marries a person from out- side the state. The expenditure was incurred on ad- vertisements in the print and electronic me- dia as well as outdoor publicity, the central government agency said in response to the application filed by city-based RTI activist Anil Galgali. The Bureau of Outreach Communication under the ministry said the government spent Rs 4,343.26 crore on adver- tising its programmes across media plat- forms. This included Rs 1732.15 crore on ad- vertisements in the print media (from June 1, 2014, to December 7, 2017) and Rs 2079.87 crore in the electronic media (from June 1, 2014, to March 31, 2018). Sources told Kashmir News Service (KNS) that most of the government de- partments were reluctant in sharing case histories of the accused. “ Over the years hundreds of cases have been sent to different government departments for action and on the basis of evidence collected, pri- ma facie charges have been established against identi- fied officials, however so far action has been taken only in few cases and ac- tion against the remaining hundreds were pending,” sources in the State Vigilance organization told KNS. The development comes ahead of Prime Minister Narendra Modi's visit to the state on May 19. According to the officials, the security forces will continue to conduct 'cordon and search operation' for the next three to four days. "BSF troops saw a movement of (five) suspicious persons little away from the border fence. Based on that, a high alert was sounded and searches are being conduct- ed," Kathua Superintendent of Police (SSP) Sridhar Patel told PTI. All the troops have been alerted and the search opera- tion will go on for the next three to four days, he said, adding ad- ditional check points have been setup and highway has been monitored. The Army is con- ducting aerial surveillance through helicopters and so far nothing has been found, the offi- cer said. The security installa- tions along the highways in Kathua, Samba and Jammu dis- tricts have been put on alert. The fencing is intact and there is no breach in the border fenc- ing, the SSP said. Movement of suspected militants carrying bags was detected in Kathua district's Tarnah Allah area, which is close to the I-B, the offi- cer said. Details of Jammuand Samba Districtswere shared with theVice-Chairperson,wherein he was briefedthat till date 106 caseshave been filed underSection 138-NIA byJammu District againstthe defaulters, out ofwhich 97 are pending/under trial and 09 standdisposed off. Similarly,Samba District has, tilldate, filed 23 cases forrecovery from the de-faulters, out of which 03have been disposed offand 20 cases are pend-ing/ under trial. TheVice Chairperson,Balbir Ram Rattan, wastold by the LegalAssistant that thesecases have been filed indifferent Courts atJammu and theCorporation Counselsare pursuing the sameso that the loaned mon-ey is recovered fromsuch beneficiaries, whohave turned out to bedefaulters.

The ViceChairperson, on thisoccasion, made a fer-vent appeal to the bene-ficiaries to be regularin depositing theirmonthly instalment tothe Corporation as thesame money is to beprovided to other needyunemployed people ofthe weaker sections toset up their own earn-ing units and be self re-liant.

They alleged thatpreviously they got theirsalary jointly in a groupcomprising of seven mem-bers and salary released inthe name of one head mem-ber of the group and he dis-bursed it among rest of themembers of the group. Butnow for the last two years,the salary released in thename of head of the groupand that head kept the entireamount of salary with him

and do not bother to give it toother members of the group,which is a great injusticewith them. As a result otherVDC members of the groupremain without salary andcome at the verge of starva-tion. In this context, thesedeprived VDC members ranfrom pillar to post and ap-proached the concerned au-thorities but no heed paid totheir genuine request. Theycomplained that despite pro-viding security cover to thevillagers, the govt. also uti-lize their services on differ-ent occasions like celebra-tion of all national and statefestivals, awareness campsof all nature, fair & Dangal inany corner of the village andabove all facing militancythreats in odd situation. Butin lieu of this they get only ameagre salary of Rs.800/[email protected]/- per day which is in-sufficient and inadequate ascompared to their job re-quirement. They demandedthat either their salary be

credited in their individualaccount or a certificate ofdisbursement be obtainedfrom the head of the VDCgroup member duly signedby all of them.

They further demandedthat their wages should beenhanced up to Rs.3000/-Per Month in view of theirtough and risky nature ofjob as some of the VDCmembers have even sacri-ficed their lives while fight-ing militants in prone andsensitive areas. Flaying the authoritiesat the helm of affairs inUniversity of Jammu (JU),the National SecularForum (NSF) expressed re-sentment over the deterio-rating system inDirectorate of DistanceEducation (DDE) which ledto failure in reviving thePG courses in Economicsand Political Science whichwere closed three yearsago. Addressing a pressconference, NSF StateSecretary Ishtiaq Naiklambasted the ViceChancellor for derailingthe academic process inDDE owing to his preju-dices and vested interest.“It is the poor administra-tion of Vice Chancellorwhich led to closure of PGcourses in Economics andPolitical Science whichwere otherwise runningsmoothly in DDE,” he said.

The Vice Chancellorfailed to fix the responsibil-ity of closure of those cours-es and didn’t even try to re-vive those as if he had inter-est in the same, he saidadding that the Vice

Chancellor only played pol-itics and spoiled the aca-demics in DDE by promot-ing favoritism and nepo-tism.

The growing conflict between Dalitsand Hindutva must be seen in the contextof the paradigm shift in U.P. politics. UttarPradesh’s pivotal importance to Indianpolitics is hard to exaggerate. Anyone whowishes to rule India must control thisState. The Bhartiya Janata Party’s (BJP’s)biggest win in 2014 came from U.P., whichwas instrumental in providing NarendraModi with a clear majority in the LokSabha. The party won 73 (with its ally) ofthe State’s 80 seats, while its nearest rivals,the Samajwadi Party (SP) and theCongress, got only five and two seats, re-spectively. The BJP repeated this perform-ance in the 2017 Assembly election, win-ning 325 seats (with its ally) in the 403-member State Assembly, which is about80% of the seats. No party has ever regis-tered such a colossal tally, not even IndiraGandhi, whose party, the Congress, hadwon 309 seats in the then 425-memberAssembly in 1980. An alienation But bare-ly a year after its stunning victory the situ-ation has changed significantly. Thestrongest sign of the changing public moodis the growing alienation of Dalits from thegovernment. Even though many Dalitsvoted for the BJP in 2014, they feel exclud-ed from access to power and the benefits itbrings. Attacks on Dalits have not ceasedeven after the national furore over theSaharanpur violence in May 2017. A Dalitstudent of Allahabad University waslynched in February. Some of the BJP’sScheduled Caste MPs from U.P. wrote tothe Prime Minister to express their an-guish over these incidents. One of them ac-cused the government of only paying lipservice and not doing anything for the ben-efit of the community. This unusual devel-opment had occurred just days after the

BJP lost in its bastions, Gorakhpur andPhulpur (which is part of Allahabad dis-trict), to the SP-Bahujan Samaj Party(BSP) alliance in the by-elections pushingscores of Dalits towards the anti-BJPcamp. Elements of a strategy The growingconflict between Dalits and Hindutva mustbe seen in the context of the paradigm shiftin U.P.’s politics which is increasingly de-fined in narrow majoritarian terms, evenas the BJP is seeking to co-opt the op-pressed groups within its electoral um-brella. Two key elements of the BJP’s elec-toral strategy are inclusion/visibility ofDalits and exclusion/invisibility ofMuslims. It has shown that it can win elec-tions without Muslims even though theyconstitute a fifth of the State’s population,which is larger than the population of sev-eral Muslim-majority countries. By con-trast, it has made every effort to demon-strate its love for Dalits. But they are un-

happy with the terms of endearment sincethey want greater Dalit representation toaddress their concerns regarding socialexclusion, food preferences, education,employment, housing, and so on. The BJPhas consistently used religious polarisa-tion to trump the caste divide in U.P., but ithasn’t succeeded; in fact, the divide hasbeen exacerbated by the cold caste and sub-caste calculations of its top leadership toundercut old forms of caste mobilisation.Moreover, the attempts to assimilateDalits within the fold by invoking the lega-cy of B.R. Ambedkar or the symbolism ofcommunal inter-dining is not enough tocool tempers of Dalits who face discrimi-nation and atrocities despite the stringentprovisions of the Scheduled Castes andScheduled Tribes (Prevention ofAtrocities) Act, 1989. The instrumental useof both gestures is obvious to everyone; notsurprisingly, these gestures have failed to

quell the growing tide of discontent, withmany Dalit voters losing patience with theruling dispensation.

Elusive developmentDalit inclusion will work when their

core concerns are addressed and whenthere is overall development, which theState badly needs. Development and eco-nomic growth has, of course, been a con-stant leitmotif in the electoral campaignsof the BJP since 2014. But there is no evi-dence to show that Chief Minister YogiAdityanath is the leader who can deliverdevelopment for the State. In fact, the veryidea of development was sidelined by hiscontroversial appointment. He was in-stalled as Chief Minister to polarise publicopinion on Hindu-Muslim lines, and not topromote integration through develop-ment. His elevation signalled a decisiveshift from the dual strategy of combiningHindutva and development to a singularembrace of Hindutva which has been usedas a weapon of mass mobilisation to offsetthe fissures of caste, class, language andculture. Asked about Opposition partieslinking his speeches and work to Hindutvaand not development, the Chief Ministerreplied that “Hindutva and developmentare complementary to each other... Thosewho are opposing Hindutva are in fact op-posing development and Bharatiyata”. Inother words, even the optics of develop-ment and the claims of taking everyonealong through development will be sacri-ficed at the altar of Hindu nationalismahead of the 2019 election. Going by the pol-icy decisions of his government, the cowappears to be the fulcrum of the U.P. mod-el. Ever since the institution of Waqfswas established in 1185 AD, no attempthas been made to curb its adverse effects.On the contrary, the law was made morefavourable to the stakeholders. Whetherthe Uttar Pradesh Government can re-claim properties which stood on agricul-tural land or transfer them as Waqf assetsby holders having no ownership is a topi-cal question. It appears that the AllahabadHigh Court had asked the Government toreclaim them. However, the apex courthas, on appeal, stayed the judgement. Itwould, therefore, be interesting as well asrelevant to know how the institution ofWaqf was established in India.

The Muslim strategy, ardently sup-ported by self-styled secularists, is to in-sist that the Babri is a disputed propertywhich is best adjudged by a court of law.Since in our country justice is invariablydelayed, the hope is that no decision islikely to be made in the foreseeable future.Thereafter, the scope for an appeal is enor-mous. To play on the soft sentiments ofmost Hindus may not be difficult, espe-cially on the plea that a property whenturned into a Waqf goes into the owner-ship of Allah, the merciful. The Waqfs arethe biggest urban landlords in India.Their origin dates back to the life andtimes of Prophet Muhammad. The institu-tion began with a place called Khaybar inArabia. It was the genius for turning aconquered property into an inalienableownership. So is written by Asaf AA Fyzeein his book, Outlines of MuhammadanLaw, Oxford University Press (OUP),

Delhi, 1999.Joseph Schacht, an international au-

thority on Islamic law, in his book, origi-nally published by OUP in 1964, said, “TheWaqf has one of its roots in the contribu-tions to the holy wars which Muhammadhad incessantly demanded from his fol-lowers in Medina”. For one thing, a Waqfproperty is an outcome of conquest. If anyfurther proof of expropriation was re-quired in this context, the temple-turned-mosque provides it. The corollary of thisdevelopment would be that the conflictover the temples should extend to ques-tion the validity of the institution of Waqfitself. Uncannily, none other than theCaliph of all Sunni Islam and the Ottomanemperor thought it fit to abolish the insti-tution in his empire in 1917. Thus, thereare no Waqfs in Turkey, Libya, Egypt,Sudan, Lebanon, Syria, Jordan and Iraq.In 1956, on the morrow of Tunisian inde-pendence, President Habib Bourguibaabolished Waqfs. Although every Waqifor donor claims that he has handed overthe property to Allah, the merciful,Muslim leaders, ranging from the conser-vative Caliph to the modern Bourguiba,did not think so. Fyzee goes on to observethat the importance of the institution willbe better understood if we take into con-sideration the enormous extent of Waqfland or the possessions of the Dead Handin the various countries of Islam. In theTurkey of 1925, three-fourth of the arableland, valued at 50.000.000 Turkish pounds,was endowed as Waqf. At the end of the19th century, one half of the cultivableland in Algiers was dedicated. Similarly,in Tunis, one-third; and in Egypt one-

eighth of the cultivated soil was ‘in theownership of God’. But it was already re-alised by the beginning of the 20th centu-ry, first by France and later in Turkey andEgypt, that the possession of the DeadHand spelled ruin. The institution of Waqfwas in some respects a handicap to thenatural growth and development of ahealthy economy. In 1830, the FrenchGovernment took over the habous or Waqfin Algiers, and later on in Morocco.Elsewhere, Government control wasmade more stringent. In 1924, the Turkishrepublic abolished the Ministry of Waqfsand it was taken over by a general directo-ry, or by the secular state administration,as we would call it. In Egypt, it wasMuhammad Ali who first confiscated all

agricultural Waqfs and compensated thebeneficiaries and in 1924, the WaqfMinistry came directly under the controlof Parliament. Although in Russia, Waqfsexisted in Muslim districts for centuries,soon after the revolution, such endow-ments were confiscated and declared stateproperty. The religious motive of Waqf isthe origin of the legal fiction that Waqfproperty belongs to God; the economic ru-in that it brings about is indicated by thesignificant phrase ‘The Dead Hand’. Waqf,to some extent ameliorates poverty, but ithas a dark side too. Political alignments should not comein the way of defending the fiscal rights ofStates. My fellow Finance Ministers in theStates, I hope you will agree that the awardof the Finance Commission is vital to Statefinances. Some of us who met initially atThiruvananthapuram, Kerala, and later atAmaravati, Andhra Pradesh, are worriedabout the implications of the terms of refer-ence (ToR) of the Finance Commission de-termined by the Union government. The is-sues related to inter se distribution of re-sources are what have drawn attention andmade headlines. But the issues at stake aremuch larger. What the ToR challenge arethe federal values enshrined in theConstitution and the modicum of fiscal au-tonomy State governments enjoy. I amwriting this open letter just in case youhave misunderstood that our concerns arelimited to a change in the population baseyear, from 1971 to 2011, which would in factaffect not only the southern States in gen-eral but also other States where populationgrowth has declined. We will certainly bemaking our legitimate claim not to be pe-nalised for implementation of the nationalpopulation policy. As has always been thecase, in the memorandum we are to submitto the Finance Commission, we can agreeto disagree as to what the best criteria forhorizontal distribution are. But all of us inthe Union of India have a common stake inthe vertical distribution of resources be-tween the Union government and theStates as a whole. I am afraid that for politi-cal reasons many of us are failing to under-take this national duty to defend the rightsof States on the one hand and the fiscal fed-

eralism of the country on the other. I wantto raise before you, in public, some of the is-sues in the ToR which are going to adverse-ly affect the financial resources and fiscalautonomy of States. If any of my fellowFinance Ministers has a different opinion,please join me in a public debate. I fervent-ly hope that at least some of you will do so.First, is there any Finance Minister who

will welcome a reduction in the share oftaxes of the States from the 42% that wasawarded by the 14th Finance Commission?This is precisely what the ToR propose todo. What else is the meaning of item 6(iv) inthe ToR? Never before in India’s historyhas the Finance Commission been asked toreview the award of its predecessor. A re-minder of certain facts: 32% of the 13th

Finance Commission and 42% of the 14thFinance Commission are not comparable.The first refers to non-plan revenue expen-diture and the second to total revenue ex-penditure. Plan grants have been terminat-ed. Further, the Government of India hasincreased our share of Centrally sponsoredschemes so that the overall devolution as ashare of GDP has remained more or lessthe same. The goods and services tax (GST)has further worsened vertical devolutiondue to the 50:50 sharing of taxes. You justread the ToR with respect to the GST whereit is made out that the GST is going to ad-versely affect Central resources. Thewhole argument of an asymmetric GSTburden is a joke. Second, the idea of feder-alism ensures that every citizen of India isprovided comparable public services andtaxation. It is for this purpose that theConstitution has provided for the provi-sion of revenue deficit grant. No FinanceCommission can review this. How is it thenthat item 5 in the ToR says, “TheCommission may also examine whetherrevenue deficit grants be provided at all”?Don’t you agree that this is an infringe-ment on the constitutional rights given toStates? Borrowing rights Third, the ToRwant to curtail borrowing by States fromthe present 3% of Gross State DomesticProduct (GSDP) to 1.7% if the FiscalResponsibility and Budget ManagementReview Committee has its way with its rec-ommendation. We have just started exer-cising borrowing rights as recommendedby the 14th Finance Commission. If this isreversed, this will severely curtail capitalexpenditure of States. Further, there is amischievous angle to the ToR which has

Environmental educa-tion as a separate subjectshouldn’t fall victim to theneed for reducing the cur-riculum load. The subject isvital for comprehension ofexisting global concerns. Amajor policy issue that hasbeen pending for over twodecades now deserves a de-cision in the context of theformulation of the new edu-cation policy. The urgencyof preparing a new curricu-lum framework for schooleducation that must re-place the one prepared in2005. It is accepted in all ed-ucationally alert and activesystems that school cur-riculum revision must takeplace within five years, ifnot earlier. It need not de-pend on policy change.

No nation can afford tocontinue with textbooksprepared, say, in 2005 insubjects like environmen-tal education or computereducation in the year 2018-19. This is not only a centu-ry of change but a centuryof the ‘pace of change’.Systems have to be ener-gised and activated accord-ingly. The issue of environ-mental education as a sepa-rate subject is as importantas that of reducing curricu-lum load. The issue war-rants comprehension of theexisting developments inglobal concerns on envi-ronment and climatechange. The UNESCO-UN-EP Congress onEnvironmental Educationand Training held aroundthree decades ago in 1987,realised the urgency creat-ed by environmental degra-dation and its visible andfearsome futuristic impli-cations agreed:“Environmental educationshould simultaneously at-tempt to create awareness,transmit information,teach knowledge, develophabits and skills, promotevalues, provide criteriaand standards and presentguidelines for problem-solving and decision-mak-ing. It, therefore, aims atboth cognitive and affec-tive behaviour modifica-tion. The latter necessitatesboth classroom and field ac-tivities. This is an action-oriented, project-centred

and participatory processleading to self-confidence,positive attitude and per-sonal commitment to thegoal of environmental pro-tection. Furthermore, theprocess should be imple-mented through an inter-disciplinary approach.”

Localmedia reports suggested that the first round of seatrials will be to test the aircraft carrier’s propul-sion, reliability and power. The aircraft will also betested for its speed, efficiency of communicationand radar systems, manoeuvrability and will alsobe checked for its armament capabilities. Reportssuggested that the trials are going to take place inthe Bohai Sea, inner gulfs of Yellow Sea and also inKorean Bay. The surrounding areas near DalianSea, parts of Bohai and Yellow seas were cordonedoff by the Liaoning Maritime SafetyAdministration. The activities that are going totake place for eight long days will be crucial forChinese Navy and the People’s Liberation ArmyNavy (PLAN) has high expectations from the air-craft carrier. The launch of Shandong is strategical-ly very important for India’s plan in Indian OceanRegion. Firstly, the new Chinese aircraft carrierhas displacement level of 70,000 tons and can carrymore number of fighter jets than India’s aircraftcarrier. It is also equipped with advanced S-bandradars and is also armed with HQ-10 missile batter-ies. Some experts might see this development asovershadowing India’s aircraft carrier projects.However, it would take a long time for Shandong tobe completely operational in the IOR. The geopoliti-cal dynamics in high seas have changed since last 18months. The focus is not just on East of Malacca, butalso on the West of Malacca Strait. The Chinesehave understood this factor really well and want toinfluence the entire region. They have establishedthemselves strongly on Djibouti in the West andwant to extend the same power over Eastern waters.India will have take measures to compete withChina in the changed international scenario.

S Athar Husain and SKhalid Rashid, in their work, Waqf Laws andAdministration in India, Eastern Book Company,Lucknow,1968, have traced their history. According tothem, Sultan Muizuddin Sam Ghaor dedicated two villagesin favour of the Jama Masjid of Multan and handed its ad-ministration to Shaikhul Islam. Another commentator,Ahmedullah Khan has recalled several properties whichwere brought under Waqf much earlier. For example, thedargah of Moinuddin Chishti at Ajmer Sharief as well asNagaur in Rajputana, Hansi and Ajodhan in Punjab, thedargah-i-Sabiri at Kalyar and the dargah of ShaykhAhmed’ Abdal Haqq at Rudauli. The Government of inde-pendent India found it expedient not to interfere with theoperation of the Waqf laws. Political expediency dictatedthis unfortunate approach just as Article 44 of theConstitution with regard to the personal law of theMuslims has remained a pious lip-service.

I appeal tothose who are in agreement to join us in this effort to pro-tect the constitutional rights of States. Let political alignmentsnot stand in the way of defending the rights of States.

The by-election results demonstrate that if thetwo main Opposition parties combine, they can give theBJP a run for its money. If there is one State whereOpposition unity can upset the BJP’s plans for majorityrule in 2019, it is U.P.

In classes Iand II, children are supported in recognising the social andnatural environment without any distinction or division.As children move ahead to the upper primary, they begin toappreciate the inter-relationship of “science, technologyand human enterprise”. This is the stage where the teacherhas to strengthen and concretise it with his efforts that takedue note of the curiosity and creativity of the child whichbegins to explore wide dimensions. This is the right stage tointroduce environmental studies. At the upper primarystage, children must be encouraged to comprehend man-made phenomenon and their import and implications. Bythis stage, the child himself begins to analyse the “world be-fore him”. Under the guidance of committed teachers,he/she begins to question some of the approaches of the eld-ers that do not fit in the civil behaviour. This could includecasual approach to cleanliness, wastage of water, electrici-ty and food, smoking among others. The value of clean airand water and role of trees, green cover and forests impactstheir thought and action. By the time they complete 10 yearsof schooling, children could become fully active and alert tojoin the march towards saving the planet earth.

In spiteof several global initiatives launched by individual coun-tries and also motivated and encouraged by the interna-tional agencies, things are getting from bad to worse.Taking a comprehensive view, 17 Sustainable DevelopmentGoals (SDG) were delineated and accepted for achievementby all UN countries. In these, the SDG-4 pertains to educa-tion: “Ensure inclusive and equitable education and pro-mote lifelong learning opportunities for all.” The conceptof “Education for Sustainable Development” (ESD) is “com-monly understood as education that encourages changes inknowledge, skills, values and attitudes to enable a moresustainable and just society for all. ESD aims to empowerand equip current and future generations to meet theirneeds using a balanced and integrated approach to the eco-nomic, social and environmental dimensions of sustain-able development”. Essentially, the concept of ESDemerged out of the global realisation that education could,and must, play its part in preparing people to confrontgrowing environmental challenges that were emerging infrightening proportions and threatening the very existenceof the planet earth. In India, considerable work in environ-mental education has been accomplished through theschool education sector, creation of a ministry of environ-ment and the creation of professional institutions by theGovernments and voluntary bodies. One issue needs to beresolved at the policy level as it has been pending for overthree decades. The Supreme Court of India had, in 1991 andin 2003, directed the NCERT to prepare a model syllabusmaking the study of environmental education a separatecompulsory subject. It was in March/April 2003 that theNCERT submitted a detailed model syllabus to the Court asper its directive. It was not objected by any of the StateGovernments. Hence, the Court issued orders for its imple-mentation. Several State Governments went ahead accord-ingly. However, after the change of the Government in 2004,the contention submitted to the Court was that all that need-ed to be included in the Environmental Education is al-ready being covered in the curriculum and the textual ma-terials, in an infusion approach. A solution may be hiddenin the right response to the query: Does the infusion ap-proach impact equally or more than what its study as a sep-arate subject could achieve? It must be resolved early.

The Delhi Police today filed a chargesheet in a court here accusing Congressleader Shashi Tharoor of abetting the sui-cide of his wife Sunanda Pushkar.

Tharoor is the only person who has beenarrayed as an accused in the case. The po-lice in its charge sheet, which runs intoaround 3,000 pages, has also alleged thatTharoor had subjected his wife to cruelty.

The police filed the charge sheet in themysterious death of Pushkar beforeMetropolitan Magistrate DharmendraSingh, who will consider it on May 24. It alsourged the court to summon Tharoor as anaccused. Pushkar was found dead in a luxu-ry hotel room on the night of January 17,2014. The Congress leader has been chargedunder sections 498 A (husband or his rela-tive subjecting a woman to cruelty) and 306(abetment of suicide) of the Indian PenalCode. The charge sheet, which includes sev-eral annexures, said that Pushkar diedwithin three years, three months and 15days of her marriage with Tharoor, who is

the Lok Sabha MP fromThiruvananthapuram. The couple had en-tered into wedlock on August 22, 2010.

Pushkar was found dead in the suite ofthe South Delhi hotel on January 17, 2014.The suite was sealed that night itself for in-vestigation. An FIR was registered by DelhiPolice on January 1, 2015 against unknownpersons under IPC section 302 (murder).

North Korea's latestand largest undergroundnuclear test last year waspowerful enough to move amountain, say scientistswho found that the bombwas 10 times stronger thanthe one dropped by the USon Hiroshima during WorldWar II.

Researchers, includingthose from NanyangTechnological Universityin Singapore andUniversity of California,Berkeley in the US, showedhow the explosion alteredthe mountain above the det-onation. The nuclear test onSeptember 3, 2017 took placeunder Mt Mantap at the

Punggye-ri nuclear test sitein the country's north, rock-ing the area like a 5.2-mag-nitude earthquake, accord-ing to the study publishedin the journal Science.

Based on seismicrecordings from global andregional networks, and be-fore-and-after radar meas-urements of the ground sur-face from Germany'sTerraSAR-X and Japan'sALOS-2 radar imagingsatellites, researchersshowed that the under-ground nuclear blastpushed the surface of MtMantap outward by asmuch as 3.5 metres and leftthe mountain about 0.5 me-tres shorter. By modelling

the event on a computer,they were able to pinpointthe location of the explosionand its depth, 400-600 me-tres below the peak.

They also located moreprecisely another seismicevent, or aftershock, thatoccurred 8.5 minutes afterthe nuclear explosion, put-ting it some 700 metressouth of the bomb blast.This is about halfway be-tween the site of the nucleardetonation and an accesstunnel entrance and mayhave been caused by the col-lapse of part of the tunnel orof a cavity remaining from aprevious nuclear explosion.

"This is the first timethe complete three-dimen-

sional surface displace-ments associated with anunderground nuclear testwere imaged and presentedto the public," said TengWang of the EarthObservatory of Singaporeat Nanyang TechnologicalUniversity. Putting all ofthis together, the re-searchers estimate that thenuclear test, North Korea'ssixth and the fifth inside Mt.Mantap, had a yield be-tween 120 and 300 kilotons,about 10 times the strengthof the bomb dropped by theUS on Hiroshima duringWorld War II.

That makes it either asmall hydrogen, or fusion,bomb or a large atomic, or

fission, bomb. The explo-sion occurred more than a450 metres below the sum-mit of Mt Mantap, vaporis-ing granite rock within acavity about 50 metresacross - the size of a footballstadium - and damaging avolume of rock about 300metres across.

The blast likely raisedthe mountain two metresand pushed it outward up to3-4 metres, though withinminutes, hours or days therock above the cavity col-lapsed to form a depres-sion.Eight and a half min-utes after the bomb blast, anearby underground cavitycollapsed, producing the4.5-magnitude aftershock

with the characteristics ofan implosion.

Subsequently, a muchlarger volume of fracturedrock, perhaps 1-2 kilome-tres across, compacted,causing the mountain tosubside to about 0.5 metreslower than before the blast.While it is possible to dis-criminate explosions fromnatural earthquakes usingseismic waveforms, the un-certainty can be large, re-searchers aid.

Explosions often triggernearby earthquake faults orother natural rock move-ments that make the seis-mic signals look earth-quake-like, confusing theanalysis.

Pakistan Prime Minister Shahid Khaqan Abbasi saidtoday that former premier Nawaz Sharif clarified to himthat his statement about the Mumbai terror attack was"misreported". Abbasi said this while talking to seniorjournalists after an emergency meeting of the NationalSecurity Committee (NSC) - Pakistan's top civil-militarybody - that condemned Sharif's "fallacious" statement andtermed it as "incorrect and misleading". Sharif, for thefirst time, questioned Pakistan's policy to allow the "non-state actors" to cross the border and "kill" people inMumbai as he publicly acknowledged in an interviewthat militant groups are active in the country. Abbasisaid he also held a meeting with Sharif after the NSCmeeting and asserted that Sharif did not say what was re-ported in the media about the Mumbai attack. "A few sen-tences (from the newspaper interview) were blown out ofproportion and context. I have clarified those (state-ments)," Abbasi asserted. Stating that the NSC dismissedthose words which were misreported, Abbasi said themeeting did not condemn Sharif but incorrect reportingof his interview. "Indian media is giving the issue a differ-ent hue, and we should not be a part of it," he said. Abbasisaid there was no tension between the civil and military.He said misunderstandings are removed in the light ofthe facts. He expressed full support for Sharif and said theentire party, including party president Shehbaz Sharif,stands with him. "Nawaz Sharif is still our Quaid(supreme leader) ," he said. He said that no one forced himto talk to the media and it was his own decision to give theexplanatory statement. Abbasi said that he will not re-sign and complete the term.

The Flight 3U8633, op-erated by SichuanAirlines, was en routefrom southwest China'sChongqing Municipalityto Lhasa, capital of TibetAutonomous Region. Itwas forced to divert toChengdu, capital ofSichuan Province, state-run Xinhua news agencyreported.According to theCivil AviationAdministration of China(CAAC), part of the cock-pit window broke as theAirbus A319 flew overChengdu, the report said.

Other media reportssaid part of the cockpitwindow fell out in mid-flight.

The crew enactedemergency code 7700 andlanded in Chengdu. All

passengers are safe, al-though the co-pilot sus-tained injuries on the faceand waist, and anothercrew member was slight-ly hurt during the emer-gency landing, accordingto the CAAC.

Sichuan Airlines con-firmed the diversion, andsaid that an investigationis under way. The planelanded in Chengdu at 7:46am today.

He added that the bomb-ings may have also been mo-tivated by the arrest of JADleadership, including jailedradical Aman

Abdurrahman, and werelinked to a deadly prison ri-ot staged by Islamist prison-ers at a high-security jailnear Jakarta last week.

Abdurrahman has beenconnected to several deadlyincidents, including a 2016gun and suicide attack inthe capital Jakarta that leftfour attackers and fourcivilians dead.

Despite their apparentallegiance to IS, the church-bombing family were not re-turnees from Syria, policesaid Monday, correctingtheir earlier statements.

against two Deputy Commissioners namely AshokParmar & Atul Dullo, Basant Ram, the then Tehsildar; OmPrakash the then Girdawar; Saleem Bandey, the thenPatwari. The Commission in its report dated 30.05.2008, in-ter alia, held that transfer of any title or interest in immov-able property on the basis of an unregistered deed cannotvest the land or any rights in the transferee. Thus, thetransfer was made in violation of provisions of Transfer ofProperty Act. It was also held that Basant Ram, the thenTehsildar, without giving an opportunity of hearing to thecomplainant and in stark contravention of Section 28-A(2)of J&K Agrarian Reforms Act, attested the mutation to di-vest the complainant of his rights in the property. Thus,the Tehsildar acted in hot haste and his action amounts to‘allegation’, as defined in Section 2(3) of theAccountability Commission Act (hereinafter referred toas ‘the Act). It was further held that the Act does not barCommission’s jurisdiction to consider a complaint in re-spect of quasi-judicial order. It was also held thatGirdawar acted in violation of Section 138 of Transfer ofProperty Act, as he changed the entry on the basis of un-registered deed. The Patwari also recorded mutation inthe Mutation Register notwithstanding the fact that leasewas not registered. It was held that Tehsildar, Girdawarand Patwari, therefore, deserve punishment in accor-dance with Rule 30 of Civil Services (Classification,Control & Appeal) Rules, 1956. Accordingly, recommenda-tions were made to terminate services of Basant Ram, thethen Tehsildar; Om Prakash the then Girdawar; SaleemBandey, the then Patwari and in respect of two DeputyCommissioners, namely Ashok Parmar and Atal Duloo,who did not take any action for a period of two years, it washeld that they owe an explanation to the StateGovernment and the same will be well advised to look intothe matter and to take necessary steps. Against this orderof State Accountablity Commission, present bunch of peti-tions filed. Division Bench after hearing Sr. Advs D CRaina, P N Raina, Advocates Rahul Pant, Adarsh Sharma,Manik Mahey, JA Hamal for the petitioners whereas Sr.Adv KS Johal with Adv RS Jamwal for the complainantwhereas Adv Parnav Kohli for the SAC, observed thatAfter having noticed the relevant statutory provisions aswell as the well settled legal principles referred to in thepreceding paragraphs, we may advert to the facts of thecase. From perusal of the contents of the perpetual leasedeed, it is axiomatic that complainant Mangotam Dasshad transferred his rights in the land admeasuring 3kanals 10 marlas and had duly sworn in an affidavit,which shows that the possession of the land was handedover to Jeet Singh in the year 1987. Mangotam Dass in theaffidavit has stated that entry in revenue records may beeffected in favour of Jeet Singh and he has no objection tothe same. Therefore, Basant Ram, the then Tehsildar, onthe basis of the report submitted by the Patwari, whichwas endorsed by the Girdawar, was required to attest themutation in view of Section 28-A of the J&K AgrarianReforms Act. It is also pertinent to mention here that theorder of attestation of mutation dated 14.05.2002 was up-held by the appellate authority vide order dated 27.02.2002and on a revision being preferred before the J&K SpecialTribunal, the matter was remanded to the Tehsildar forfurther enquiry on the ground that no opportunity of hear-ing was afforded to the complainant. It is also pertinent tomention here that the Deputy Commissioner, Udhampuron the basis of the report dated 04.02.2003 had directed theAssistant Commissioner (Revenue) to put up the draftcharge-sheet against the delinquent officials and, there-fore, the finding of the Commission that no action was tak-en by the Deputy Commissioners is perverse. TheCommission has failed to appreciate the expression ‘alle-gations’ as used in Section 2(3) of the Act in its proper per-spective. It ought to have appreciated that complainantbeing a tenant was conferred the rights of prospectiveowner under Section 8 of the J&K Agrarian Reforms Actand, as such, the complainant was not competent to trans-fer the land in terms of the Section 28 read with Section 28-A of the Act. The Commission has also failed to take intoaccount the fact that Section 32 of the J&K AgrarianReforms Act has an over-riding effect on the provisions ofSections 107 and 138 of the J&K Transfer of Property Act.Therefore, the finding recorded that the perpetual leasedeed was not a registered document and same could not berelied upon by the then Tehsildar for invoking Section 28-A of the J&K Agrarian Reforms Act is perverse. In anycase, some erroneous interpretation of provisions of lawcould not have brought the action of the delinquent offi-cials within the purview of the expression ‘allegations’ asdefined under Section 2(3) of the Act. DB further observedthat It is pertinent to note here that there is no allegationof corruption, favourtism, nepotism or lack of integrity inthe complaint and neither any corrupt motive has been at-tributed to the delinquent officials in the complaint. It isalso pertinent to mention here that the Commission hasalso not recorded any finding in its recommendations thatthe delinquent officials, namely, the petitioners are eitherguilty of corruption, favourtism, nepotism or lack of in-tegrity or the orders were passed for improper or corruptmotive. In other words, the findings recorded by theCommission do not bring the action of the petitionerswithin the meaning of the expression ‘allegations’ as de-fined under Section 2(3) of the Act. In any case, the misin-terpretation of a statutory provision could not have beentreated as a misconduct and on the aforesaid basis, it couldnot have been concluded in law by the Commission thatthe petitioners are liable for disciplinary action underRule 30 of the J&K Civil Services (Classification, Control& Appeal) Rules, 1956. DB further observed that So far asthe submission made by the learned counsel for theCommission that the petitions are premature is con-cerned, from perusal of Section 21 of the Act, it is evidentthat after receipt of the report of the Commission, the com-petent authority shall examine the report within a periodof 90 days from the date of receipt of such report and there-after, communicate to the Commission the action taken orproposed to be taken on the basis of the report. In the in-stant case, the Commission had only submitted the recom-mendations, on which the action was yet to be taken by thecompetent authority, which would have given cause of ac-tion to the petitioners to approach the court.

to ensure that cleaning of roads to places of congregationalprayers like Hazratbal, Jama Masjid, Peer Dastageersahib and other places is done on round the clock basis.She also directed the two Departments for management ofdog menace on the streets during nights so that people arenot inconvenienced during Fajr andTarawih prayers. TheChief Minister directed deployment of adequate manpow-er to manage and regulate traffic during peak hours at ma-jor junctions like Parimpora, Batwara and Rambagh, ma-jor towns of the State and on National Highway.Mehbooba Mufti also directed making available transportfacility, sanitation and street lighting for devotees toplaces of congregational prayers like Dargah Hazratbal,Jama Masjid, Srinagar, Jama Masjid, Jammu, HazratPeer Dastageer Sahib, Srinagar and other places acrossthe State. She also directed setting up of health facilitiesnear the places of congregational prayers in view of thehot summer season at Jammu. The Chief Minister direct-ed the PDD authorities to install High Mast lights atprominent places in the capital cities, particularly down-town Srinagar and Jama Masjid, Khanqah i Mou’la etc.where people generally pass through for offering congre-gational prayers. She directed strict regulation of powersupply during peak hours of Sehri and Iftaars and makingadequate number of transformers available for replace-ment so that people don’t face any difficulty in gettingpower supply. The meeting was briefed by the DivisionalCommissioners of Kashmir and Jammu about thearrangements put in place by the administration. She wasinformed that adequate arrangements of sanitation, streetlights, essential supplies and transport have been madeand also Control Rooms have been set up at district head-quarters where people can call in case of any difficulty.

The Chief Minister was informed that a RamadhanHelpline is being established at all district headquarterswhich people can contact in case of any distress. She wasalso informed that in many districts a revised curtailmentschedule of power has been prepared to ensure that no cur-tailment takes place at Iftaar and Sehri times.Additionally, she was informed that PDD has constitutedQuick Reaction Teams(QRT) to respond to any request forhelp to people in case of transformer damage or any otherdisruption in power supply. Another counsel appearing forthe petitioners said it was a "human issue" as around fivelakh people had migrated out of the state, were residing inplaces like Delhi and cannot go back to the valley.

A petitioner's counsel also referred to Article 14 (equal-ity before law) and Article 21 (protection of life and person-al liberty) of the Constitution and said those who have mi-grated from the valley have the right to return. However,Dwivedi told the court that since the issue required inter-pretation of the constitutional provision, no interim ordershould be passed in the matter. The state government,while defending Article 35 A, had cited two verdicts by theconstitution bench of the Supreme Court in 1961 and 1969which had upheld the powers of the President underArticle 370(1)(d) of the Constitution to pass constitutionalorders. The Article was incorporated in the Constitutionin 1954 by an order of President Rajendra Prasad on the ad-vice of the Jawaharlal Nehru Cabinet. It empowers thestate legislature to frame any law without attracting a chal-lenge on the grounds of violation of the Right to Equality ofpeople from other states or any other right under theConstitution. The apex court had on August 14 last yearsaid a constitution bench may examine whether Article35A was gender-biased and violative of the basic structureof the Constitution. The court while hearing a plea earlierby Dr Charu Wali Khanna, a Kashmir resident, had indi-cated that if the Article violated basic structure of theConstitution or was ultra vires, the issue may be dealt withby a five-judge bench. It had tagged the plea challengingArticle 35A with a similar petition that is pending for hear-ing by a three-judge bench. The state government had ear-lier said that the issue has already been "prima facie set-tled" by a full bench of the High Court in its verdict in 2002.In the case, the high court had, by a majority view, heldthat a daughter of a permanent resident of Jammu andKashmir marrying a non-permanent resident will not losethe status of a permanent resident.

Howeversources said that nothing has been done in this regard.One of the top officials of the Vigilance commission saidthat there is a deluge of complaints being received by theState Vigilance Organization and vigilance commissionfrom last few years. “In a number of complaints in 2015- to2017, allegations are mainly about violation of codal for-malities in the award of contracts in works, purchases, ap-pointments, promotions and transfer, denial of servicesby the government departments etc,” he said. The officialsaid that often these complaints are lacking in specificsand with the result the department doesn't attract provi-sions of the Prevention of Corruption Act. The people be-lieve that the officials in departments and government-owned corporations have not shown accountability asthere are no checks and inspections. The duties of depart-mental vigilance officers and district vigilance officersare explicitly defined in Jammu and Kashmir StateVigilance Commission Rules, 2013. Their role is to checkCorruption in departments, even on the basis of media re-ports. It is to mention here that the government had earli-er decided to order premature retirement of ‘corrupt andincapable’ officials, who have not been able to deliver intheir respective departments. The government had alsoconstituted a high-level committee headed by ChiefSecretary and the committee was to be the final authorityto take action against the corrupt officials. Late MuftiMohammad Sayeed in 2015 affirmed his commitment tobring transparency and accountability in the state admin-istration when he removed tainted officials and non-per-forming bureaucrats from the plum postings. The chiefminister Mehbooba Mufti had also admitted that corrup-tion was a major challenge in the state with various anti-graft agencies having received thousands of complaints inthis regard. “Corruption is a major challenge for the gov-ernment and its adverse effects on the society cannot beunderestimated,” CM had said. Meanwhile one of the sen-ior ministers in the government told KNS that the Stategovernment has directed authorities in all the depart-ments to act promptly on the graft enquiries conducted bythem or the State Vigilance Organization (SVC) against of-ficials. “The departmental vigilance officers and districtvigilance officers have been directed to adopt a multidi-mensional approach for checking corruption allegationsagainst government officials,” the minister said wishednot to be named. The minister also claimed that the offi-cers of departments were also directed to take departmen-tal action on the enquiry reports, wherever necessary,and not to wait for the outcome of enquiry/investigationbeing conducted on the same charges by VigilanceOrganization or State vigilance commission. "Permit the petitioners to be ac-companied at all times by two lawyers as and when theyare summoned" by the state police, the plea said, addingthat the probe in the case be handed over to an "indepen-dent agency". The plea has sought a direction to restrainthe Crime Branch officials from "harming" and "harass-ing" the students and their families. The victim, belongingto a minority nomadic community, had disappeared fromnear her home in a village close to Kathua in the Jammuregion on January 10. Her body was found in the same areaa week later. However, police sources saidthe user is a Kashmiri Muslim who had sent out abusivetweets against Kashmiri Pandits following the tweets by aPandit on Saturday. If that is so,even if the inter se seniori-ty is re-determined be-tween the appellant andthe private respondentherein, the same wouldnot, in the ordinarycourse, be a direction,which would affect the in-terest of the appellant and,therefore, even if such a di-rection is passed, the ap-pellant should have nogrievance. In any case, it

would be appropriate thatthe official respondents dothe requisite exercise,which becomes necessaryespecially in view of the di-rections to the respondentsto determine as to whetherthe promotion to the post ofProfessor granted infavour of the appellant wasin contravention of the rec-ommendations of PublicService Commission. Anyfinding in the affirmativewould also bring the appel-lant lower in seniority al-though she claims that shewould still figure senior tothe private respondent. Inany case, the direction tore-determine the seniorityinter se between the appel-lant and the private respon-dent, suffers from no ille-gality and cannot be inter-fered with. DB further ob-served that an apprehen-sion was expressed by theappellant that in the garb ofre-determining the seniori-ty, inter se, between the ap-pellant and the private re-spondent, the Govt. waslikely to promote the pri-vate respondent from datesearlier in point of timefrom which she stood pro-moted. This, according tothe learned counsel for theappellant, would causeprejudice to her interest.However, the apprehen-sion expressed is totallypre- mature. For all, weknow the Govt. may not doany such thing and if at all,any such orders are passed,it would be open to the ap-pellant to avail her reme-dies in law. The Centre, whichfaced flak over delayingthe filing of the draftCauvery managementscheme, today submittedit for approval in theSupreme Court to ensuresmooth water distribu-tion among the four south-ern riparian states. Abench headed by ChiefJustice Dipak Misra,which on May 8 had sum-moned the Secretary ofUnion Water ResourcesMinistry to bring withhim the draft scheme, tookon record the draft andsaid it would examine thescheme on May 16. "Weneed to examine whetherthe said scheme is in con-sonance with our(February 16) judgment,"the bench, which alsocomprised Justices A MKhanwilkar and D YChandrachud, said. "Wewill not go into the cor-rectness of the schemeframed by the Centre butexamine only one issue, asto whether the schemeconforms to the judgmentor not," it said. AttorneyGeneral K K Venugopal,appearing for the Centrewhich was accused by thebench of committing"sheer contempt", said thegovernment was facing adilemma regarding thename to be given to thebody, sought to be createdby the scheme dealingwith the task of supervis-ing the sharing of Cauverywater as per the apexcourt's judgement.
