OVERVIEW

1.1 Purpose

The purpose of the Monthly Arrest and Citation Register CAR) reporting system is to collect accurate information on all adult and juvenile arrests in Californi'a in sufficient detail to allow identification of individual arrests so that they may be linked with subsequent court activity.

Information develuped from the system provides statistical arrest data for local, county, regio~al, and state agencies and is used by the Federal Bureau of Investigation (FBI) in their annual accounting of arrests in California.

The AR reporting system replaces the Bureau of Criminal Statistics' (BCS) summary system of arrest reporting. (Monthly Report - Adult Felony Arrests, JUS 703; Monthly Report - Adult Misdemeanor Arrests, JUS 703.1; and Monthly Report - Arrests of Youths under Eighteen, JUS 741.) It satisfies all FBI reporting requirements, also eliminating the age, sex, and race reports of arrested persons. (Federal Forms 12-90 and l2-90a.)

1.2 Submitting Data

Arrest and citation data can be reported manually (Form JUS 750, Appendix III), by punch cards (format Appendix IV), or magnetic tapes (format Appendix V). This data should be submitted monthly within ten working days following the end of the report period. Send the completed JUS 750 forms to the Bureau of Criminal Statistics, P. O. Box 13427, Sacramento, California 95813. Send punch cards and magnetic tapes to Department of Justice, AIS Operations, Control Unit, P. O. Box 13307, Sacramento, California 95813.

1.3 Requesting Forms

Requests for additional JUS 750 forms should be sent to the Bureau of Criminal Statistics, P. O. Box 13427, Sacramento, California. 95813. Mention the exact name of the form in your request.

1.4 Planning Considerations

Data submitted on punch cards or magnetic tape must meet specific BCS statistical requirements and be compatible with Department of Justice equipment. When submitting data on punch cards or magnetic tape, provisions should be made to submit a test run prior to submission of actual data. This will ensure material is in the proper format, tape labels are correct, and will enable any problems to be solved prior to processing actual data.

1.5 Resolving Errors

Any data element submitted which does not meet BCS requirements will be resolved by telephone call, letter, or field contact with the submitting

agency. BCS should l.e provided with an up-to-date listing of individuals to be contacted at each participating agency for resoluticn of any reporting errors.

REPORTING STANDARDS·

2.1 Gene:xal

Make only one (1) line entry per arrest regardless of the number of charges involved. Multiple charges may be entered on Form JUS 750, in which case, BCS will select the highest offense. Card or tape entries must have only the highest offense coded. The following types of arrests are to be reported:

Citations for misdemeanor offenses such as shoplifting, petty theft, etc.

b. Those listed under Section 40303 VC: 10852, 10853, 23103, 23104, 2800, 2804, 20002, 23109, 14601, 14601.1, 23332, and 2813.

4. Traffic warrants including:

a. 40508 VC, failure to appear. (For this type warrant, specify the violation as 40508 VC rather than the original traffic offense.)

b. 42003 vr~ failure to pay fine.

5. Civil drunk arrests per 647f£ PC.

6. Federal offenses - Give spe~ific offense on Register, including illegal aliens, narcotic offenses and military (AWOL). For statistical purposes, federal offenses are classified as felony level offenses.

7. Probation and parole violations. Include whether it is a felony (F) or misdemeanor (M) violation.

8. Failure to register for narcotics (11850 H&S) and sex offender (290 PC) violation arrests.

9. Contempt of court.

Show the last name, f:h:st name, and middle name. The arrested person's name should always be printed or typed clearly and completely. If no middle name is available, use NMN. Use initials only if they represent the arrestee's true name.

(1) Del. - This refers to a delinquent act by juveniles only, such as runaway, truant, curfew, or incorrigible (see Lines 1 and 2, Appendix VI).

(2) Msd. and (3) Fel. - If a juvenile is arrested on a misdemeanor or felony, circle the (2) or (3) as applicable (see Lines 3 and 4, Appendix VI). Adult arrests can only be a (2) or (3) (see Lines 5

and 6, Appendix VI).

Civil drunk occurrences per 647ff PC should be given a (2) Msd. level.

Federal offenses are always (3) Fel. for statistical purposes.

Enter the exact code section number from the appropriate code on Form JUS 750. If punch cards or magnetic tapes are the input method, use three digit BCS offense codes (Appendix VIII), or CJIS Arrest Register Codes (Appendix IX).

Municipal and County Codes - Write out the actual charge(s) although code numbers may be included for local purposes (see Line 7, Appendix VI). N~mb~rs alone are not sufficient since BCS does not have local code h.s t~ngs.

Juvenile 601 01 602 W&I Codes - When a juvenile arrest is made on the authority of either 601 or 602 W&I, state the specific reason for arrest. The Code Number 601 or 602 W&I by itself is too general and wi1l.not be coded by BCS. If it is a 601 charge, indicate whether ~t is runaway, incorrigible, truancy, loitering, out of control, or curfew (see Lines 1 and 2, Appendix VI). If it is a 602 charge, indicate specific offense such as burglary auto theft etc (see Line 3, Appendix VI). ,. .

Local warrant - Any warrant issued within the jurisdiction of the arresting agency. Indicate that the arrest was made on a warrant and show the charge (see Line 8, Appendix VI).

Examples: (1) Warr. - 459 PC (2) Warr. - 11357 H&S

Bench warrants - Warrants usually issued by a court when a person fails to appear as ordered. A bench warrant arrest should be entered as B/W followed by the actual offense(s) (see Line 9, Appendix VI).

Example: burglary, "B/WBurg."

When there is an arrest on a new offense and there are also local warrants pending, enter the highest offense (see Line 12, Appendix VI). The level and disposition sections should be determined by the highest offense only.

Outside warrants - Any warrant issued outside of the jurisdiction of the arresting agency. Indicate that the arrest was made on an outside,warrant and show if the offense was a felony or misdemeanor. Do not lnclude the specific offense (see Lines 10 and 11 Appendix VI). '

Examples: felony, "Out Warr-Fel." misdemeanor, "Out Warr-Misd."

Fe~eral Offenses - When there is .,an arrest on a federal offense, wr~te out the actual charge such as AWOL, alien, etc. Use of a code section in addition to a title section, such as "Title 18," covers many different violations and cannot be properly coded by BCS (see Line 13, Appendix VI).

Leave blank for BCS use.

2.12 Status

The only purpose of the status column is to determine how many individuals are cite~ versus those actually delivered to jail.

Juveniles

a. If a juvenile is cited in lieu of being delivered to juvenile authorities, circle or enter code (1) "Cite."

b. When juveniles are transported to a juvenile holding facility of any type, circle (2) under "Book."

c. If juveniles are neither cited nor booked, circle or code (3) "Other" on the Jus 750, or code 3 on card or tape (see Line 2, Append ix VI).

2.1'3 Law Enforcement Disposition

This is the action taken by the law enforcement agency after an arrest has been made. Do not confuse this section with court dispositions. Circle ONLY ONE DISPOSITION.

1. Adults

a. Circle or code (1) ReI., for those released under 849b PC or other sections when no further action is planned by the arresting agency, or the prosecutor has refused to issue a complaint. Civil drunk occurrences per 647ff PC or those individuals placed on other diversion programs by the local agency. including those deemed not arrested, should show a disposition of (1) ReI.

APPENDIX I

Glossary of Terms

.\rrest - (California Penal Code Section 834)

"An arrest is taking a person into custody, in a case and in the manner authorized by law. An arrest may be made by a peace officer or by a private person."

(California Penal Code Section 835)

"An arrest is made by an actual restraint of the person or the defendant, or by his submission to the custody of an officer. The defendant must not be subjected to any more restraint than is necessary for his arrest and definition."

Arrest - Juvenile

Because of the wider range of police involvement in juvenile control than in the control of adults, a major problem is to specifically define police contacts that, for statistical purposes, are arrests and those that are not considered arrests. Police contacts in the juvenile control field can be separated into two basic types: (1) contacts that rf:quire subsequent action, and (2) contacts that do not require subsequent action..

1. Contacts that require an action subsequent to the initial contact are: arrests. Contacts of this type include those that result in the transportation of juveniles to the officer's headquarters and a subsequent arrest report or booking record completed whether released to parents, placed in a juvenile hall; jail, or other detention facility, or released on their own recognizance. Also included in this group are juveniles released after tpey have been issued citations wherein they agree to appear at the probation department for further consideration of the case. In like manner, juveniles cited to appear later before a juvenile officer or other person within the police agency would be considered as an arrest. It will be noted that each type of action listed requires an action subsequent to the initial contact before the incident can be terminated.

2. Contacts that do not require subsequent action generally are in the field contact or field interrogation category. They involve situations where juveniles are stopped, questioned, or identified, and possibly reprimanded or requested to disperse or return home. In these situations no further action is taken by the police and the matter is closed. This type of contact is not considered an arrest for statistical purposes.

Other contacts that are not to be identified as an arre~t Lor statistical purposes are requests, during field contacts, for juveniles to call at the officer's headquarters or some other specified location for an interview. These appointments, usually investigative interviews,

are considered voluntary actions of the juvenile. If the juvenile refuses to comply with the officer's request, and is thereafter ordered to comply, his compliance would then be considered an arr~st.

There are some situations, however, that require only initial contacts to qualify as arrests. These are contacts where the juvenile's responsibility for an offense is admitted but the incident is recorded and closed by the police during the initial interview. These contacts are conside1:,;<,d arrests. This type of a.ction may be more clearly defined by ~{ting an example:

A juvenile has stolen property from a neighbor. An officer called to the scene may apprehend the juvenile, reprimand him, and secure the return of the property, and conclude the entire case without the necessity of subsequent action.

In the situation as outlined, there was an offense, the offender was arrested, the investigation was completed, official action was taken, and the case was terminated while the officer was at the scene.

Citation -

Citation refers to that procedure used when an individual is not booked but is cited to appear later to answer for an offense for which he could have initially been booked.

Disposition -

Disposition' refers to the police disposition of an arrest, not the court disposition. The police disposition should, however, include the action taken by the prosecutor and accurately account for an individual's entry into lower court, superior court, or the juvenile justice system if the police disposition is something other than released, turned over, or handled within the department.
