Notification

Jammu, the 13th April, 2015.

SRO-123.––In exercise of the powers conferred by the proviso tosection 124 of the Constitution of Jammu and Kashmir, the Governor herebymakes the following rules, namely :––

1. Short title and commencement.––(1) These rules may be calledthe Jammu and Kashmir Information Department (Subordinate) ServiceRecruitment Rules, 2015.

(2) They shall come into force from the date of their publication inthe Government Gazette.

2. Definitions.––In these rules, unless the context otherwiserequires,––

(a) “Administrative Department” means the department of theGovernment in the Civil Secretariat holding administrativecharge of the service ;

(b) “Board” means the Jammu and Kashmir State “ServiceSelection Board” ;

(c) “Cadre” means the cadre of the service ;

(d) “Government” means the Government of Jammu andKashmir ;

(e) “Head of the Department” means the Major Head of theDepartment holding the administrative control of theorganization ;

(f) “Member of the Service” means a person appointed to a postin the (Subordinate) Service under the provision of theserules ;

(g) “Post” means a permanent post carrying a definite time scalesanctioned by the competent authority ;

(h) “Rules” means the Jammu and Kashmir InformationDepartment (Subordinate) Service RecruitmentRules, 2015 ;

(i) “Schedule” means a schedule annexed to these rules ;

(j) “Selection Agency” means the agency constituted by theGovernment for making recruitment to a particular class ofpost ;

(k) “Service” means the Jammu and Kashmir InformationDepartment (Subordinate) Service ;

(l) “State” means the Jammu and Kashmir State ;

(m) Words and expressions used in these rules but not definedshall have the same meaning as are assigned to them in theJammu and Kashmir Civil Services (Classification, Controland Appeal) Rules, 1956/Jammu and Kashmir Civil ServiceRegulations.

3. Constitution of service.––(1) From the date of commencementof these rules, there shall be constituted the “Jammu and KashmirInformation Department (Subordinate) Service”.

(2) The Government may, at the commencement of these rules,appoint to the service any person who at the commencement of theserules is holding in substantive capacity any post included in the cadre of theservice.

(3) Provided that for the purposes of initial constitution of the service,a person holding any post in substantive capacity, to which he was appointedby the competent authority under rules, incuded in the cadre of the servicein its sanctioned scale of pay shall be deemed to have been appointed to theservice under these rules if he/she is fully qualified to hold the post underthese rules unless he/she opts otherwise within 15 days from thecommencement of these rules.

Explanation :—The words holding means a person holding a post includedin the cadre of the Jammu and Kashmir InformationDepartment (Subordinate) Service in its sanctioned scaleof pay on regular basis under orders of the competentauthority and will not cover the persons holding a post onex cadre/deputation basis or on ad hoc basis or in a stopgap arrangement.

4. Strength and composition of the service.––The authorizedpermanent and temporary strength of the cadre and the nature of the posts


included therein shall be determined by the Government, from time to timeand shall, at the initial constitution of the service under these rules, be suchas specified in Schedule-IA and IB annexed to these rules :

Provided that the Government may create temporary posts in thecadre of the service for specified period or purpose as may be considerednecessary from time to time.

The Government shall, at the interval of every five years or at suchintervals as may be necessary, re-examine the strength and composition ofthe cadre of the service and make such alteration therein as it deem fit.

5. Qualification and method of recruitment.––(1) No person shallbe eligible for appointment or promotion to any post in any class, categoryor grade in the service, unless he possess the qualification as laid down inSchedule IIA & IIB of these rules and fulfills other requirements ofrecruitment as provided in the rules.

(2) Appointment to the service or class may be made––

(a) By direct recruitment ; or

(b) By promotion ;

(c) partly by (a) and partly by (b) in the ratio and in a manner asmentioned against each post in Schedule-IIA & IIB :

Provided that all the posts under direct recruitment shall befilled through J&K SSB as per the rules/orders of theGovernment issued for the purpose :

Provided further all the posts to be filled by promotion/transfershall be filled through Departmental Promotion Committee/J&K SSB unless any post/category of posts is exempted fromthe purview of the SSB.

The department shall refer vacancies in the direct/promotion quotato SSB and Departmental Promotion Committees as the case may be interms of SRO-166 dated 14-06-2005.

6. Probation.––(1) Persons appointed to the service either by directrecruitment or by promotion shall be on probation for two years and theirconfirmation to a class or category shall be made under the provisions ofJammu and Kashmir Civil Services (Classification, Control and Appeal)Rules, 1956.

(2) The pay of a person appointed to the service under these rulesshall be regulated as per the provisions of Jammu and Kashmir Civil ServiceRegulations or general rules as issued from time to time.

7. Reservation in appointments.––While making appointments eitherby promotion or by direct recruitment, reservation shall be made inaccordance with the rules and orders issued from time to time for membersof Scheduled Castes/Scheduled Tribes/Backward Classes or any othercategory or class of permanent resident of State under the provisions ofJammu and Kashmir Reservation Act, 2004 and the rules in force.

8. Training and departmental examination.––Persons appointedto the service by direct recruitment/promotion shall be recruited to undergosuch training from time to time during the course of probation and to passduring the period of probation or training such departmental examinationas the Government may prescribe :

Provided that the Government may exempt either wholly or partly,from such training or departmental examination persons who have passedthe departmental examination or undergone training declared by Governmentto be equivalent to a departmental examination or training prescribed underthese rules.

9. Eligibility of Government servants for direct recruitment.––A person already in the Government service may apply through properchannel for direct recruitment to a vacant post in any particular class orcategory in the service, if he/she possess the educational and other


qualifications prescribed for recruitment to such class or category of posts.The upper age limit of such Government servants shall be as provided inthe general rules :

Provided that in the case of a post which requires a higher degree ofspecialization an/or experience, the Government may prescribe higher agelimit.

10. Maintenance of seniority lists.––Seniority of the members ofthe service shall be regulated under the Jammu and Kashmir Civil Service(Classification, Control and Appeal) Rules, 1956. The Directorate ofInformation shall maintain an up-to-date and final seniority list of membersof the service.

11. Residuary matters.––In regard to matters not specificallycovered by these rules, the members of the service shall be governed bythe rules/regulations and orders applicable to the State Civil Service ingeneral.

12. Interpretation.––If any question arises relating to theinterpretation of these rules, the matter shall be referred to the AdministrativeDepartment whose decision thereon shall be final and binding.

13. Repeal and savings.––(1) With the commencement of theserules, the Jammu and Kashmir Information (Subordinate) ServiceRecruitment Rules, 1993 are hereby repealed.

(2) Notwithstanding such repeal, any appointment order made oraction taken under the provisions of the rules so repealed shall deemed tohave been made or taken under the corresponding provisions of these rules.
