In all these case major reason for fire is the careless attitude and neglect of fire safety advisory by the people who manage the hotels and establishments. Hence, the members are requested to take adequate precautions to make their Eating House fire retardant and make their establishments fire compliant by periodical fire audit. • The Supreme Court has given a historic judgment in the writ petition filed by AHAR in Dance Bar case by staying the draconian Section 33A of Mumbai Police and instructing the Mumbai Police to renew the license of Dance Bars. He congratulated Shri Bharat Thakur, Chairman, Performance Bar committee and his team for the landmark judgment. He said we have employed Shri Kapil Sibbal, an eminent lawyer as our counsel. The final verdict is reserved for 5th November 2015. He advised the Bar owners to do the business within the laid down norms and earn the living with dignity. He sought the support, cooperation and contribution of each and every Performance Bar owners in this final battle which can revive the industry.

• The recent tragedy in City Kinara Hotel, Kurla was very tragic. The subsequent rampant drive by MCGM officials damaging and destroying the property without giving proper notice is not justified and this created a phobia in the minds of Restaurateurs. He advised each and every hotelier to strictly follow the fire safety norms and make their Restaurant

fire safety compliance and display the board to that effect in their establishment. He also advised the members to get the fire and electrical i n s t a l l a t i o n s duly audited periodically.

• The Ministry of Finance, Central Government had invited suggestions, objections in Direct and Indirect Taxes for the ensuing Budget from our Association. We had submitted our suggestions and objections as an Association.

• We have been invited by the Sales Tax commissioner for a workshop on GST on 28.10.205. Our delegation attended the same and have given their inputs.

• Our delegation was also invited by the Municipal Commissioner Shri Ajoy Mehta and delegation briefed him about the action of MCGM, following the Kurla fire, overstepping their authority. The Municipal Commissioner directed AHAR to make all their member Restaurants fire safety norm compliant and display a board to that effect. He also agreed to our suggestion of simplifying licensing conditions, to do away with the duplication of licenses etc. He requested AHAR to submit the same in a booklet. We have formed a committee for the purpose and will be submitting our observations, recommendation etc. soon.

• In case of any excessive measures taken by the MCGM after the City Kinara Hotel incident of breaking, dismantling, sealing of licenced Restaurants, he advised them to file Petition against the authorities. He further said AHAR will provide them with all logistic support.

• The President appreciated the efforts and support of Shri Niranjan Shetty, AHAR- MCGM Committee

Chairman and BJP Spokesman for his involvement in getting the appointments, arranging the meetings with the Chief Minister and the Municipal Commissioner.

33A by Supreme Court, which also directed the State Government to renew the PL of the Performance / Dance Bar. Due to urgency we have

employed eminent lawyer and Ex Union Minister Shri Kapil Sibbal to represent our case. We had to spend lot of fund in this matter which is going on for the last 15 years. He said the final hearing and judgment will be heard on 5th of November 2015. We hope we will get a fair judgment and the Dance Bar/Performance Bar industry can revive and survive. He requested all Performance Bar

owners to contribute their might and support the Association in the legal fight.

Shri Niranjan Shetty - Chairman-MCGM Committee

After the City Kinara fire incident, we are constantly in touch with Chief Minister’s office and were able to meet him and convince him about our genuine grievances. The CM was kind enough to instruct the Municipal Commissioner to speak to our delegation. The Meeting with Municipal Commissioner was very positive and has taken the heat off and tension from the minds of Hoteliers and Restaurateurs.

Shri K. K. Mahale – Chairman - Hawker action Committee.

We have got a very important Bombay High Court judgment on 23.10.2015 instructing the MCGM to evict the illegal food hawkers within two months.

On the occasion, Shri Gopal Shetty, MP was honored for his support to the Hotel & Restaurant Industry.

Replying to the felicitation, Shri Gopal Shetty said that he will help the Association is getting the piped gas connection from MGL which is very safe and will not lead to any accident. The instruction of the Municipal Commissioner, which is very positive to the industry, should be percolated to the ward level. Zone V - Shri Ravindranath Nire:

The MOH had asked the told the Hotel Samrat to close down for not having of Fire NOC. Our delegates met the MOH and sorted out the same.

Zone VI Shri Sunil Patil:In the case of Mallika Bar

Asalpha, a case of riot was registered against the Hotelier inspite of few local customers creating trouble and damaging the properties. Due to our efforts and on producing the CCTV footage the SI Asalpha Police Station has arrested all the culprits.

Zone VII -Shri Rajan Shetty: The Manager of a Restaurant was arrested in a harassment case. He was freed without any charge after the AHAR delegation met the concerned SI.

Zone VIII - Shri Jagdish Shetty: The fire tragedy in City Kinara has resulted in rampant drive by MCGM officials. We have told members to take all precautions and make their establishment fire compliant.

Zone IX - Shri Sudhakar T Shetty:

After the Kurla fire tragedy the drive by MCGM officials are on. Many of the compound walls, Sign Boards etc. were removed.

Zone X - Shri Anil Salian: In the current year we have collected an amount of Rs. 6 lakhs as membership fees. Due to the Kurla Hotel fire tragedy all officials of different departments are taking advantage of the situation and harassing the Restaurateurs.

Donation to Chief Minister Drought Relief Fund.

Shri Bharat Thakur Chairman Performance Bar: Donated an amount of Rs.1,00,000/- on behalf of his committee.

Shri Anil Salian, Vice President, Zone-X and his team donated an amount of Rs.1,25,000.

The President said that we will take a fresh appointment from the Chief Minister and hand over the amount collected by AHAR to the Chief Minister Drought Relief Fund. He said that it is our social responsibility to respond to natural calamities in the State. He advised

NEW DELHI: Dance bars will be back in business soon in Maharashtra following the Supreme Court’s stay on a law banning dance performances in bars, hotels and restaurants in the state.

However, the court did give power to licensing authorities to regulate indecent dance performances. It said that the state must ensure that the dignity of women artists is protected.

Maharashtra’s law - that banned dance performances -- was very similar to a previous law that was declared unconstitutional by the apex court, said a bench of Justice Dipak Misra and Prafulla C Pant.

The apex court had, in 2009, struck down a similar law saying that banning dance performances was unconstitutional. After that, the state government passed another law in 2014 with similar provisions.

The court however added a rider to its interim order and allowed the licensing authorities in the state to regulate indecent dance performances at bars and other places.

“However, we have a rider that no performance of dance will be remotely expressive of any kind of obscenity…The licensing authority can regulate such dance performances so that individual dignity of woman performer is

not harmed,” the bench said.Additional Solicitor General

Tushar Mehta, appearing for Maharashtra said at the outset that interim relief may be granted to the Association and added that 2014 amendment in

the Act is distinct by its nature.The Maharashtra government

had brought an amendment in 2005 — the Bombay Police Act — which was challenged in high court by an asso ciation r e p r e s e n t i n g restaurants and bars.

The Bombay High Court on April 12, 2006 had quashed

the government’s decision and declared the provision as unconstitutional saying that it is against Article 19(1)(g) (to practise any profession, or to

carry on any occupation, trade or business) of the constitution.

However, the state government had moved the apex court against the high court’s order that same year.

On July 16, 2013, the Supreme Court upheld the Bombay High Court verdict quashing the state government’s order and had said that the ban violated the constitutional right to earn a living. The state assembly however, on June 13, 2014, passed the

Maharashtra Police (second amendment) Bill which prevented licenses for dance performances in three star and five star hotels.

Hotel City Kinara fire incident an eye openerMUMBAI: The recent fire incident in which

eight promising young lives from seven of them from Don Bosco College were lost due to the fire in Kurla restuarant; an urgent college project submission proved a blessing for their friends, who were about to join them for lunch.

Hotel City Kinara a Chinese food joint located opposite Holy Cross School, around 1.30 p.m. While the restaurant had a valid eating house licence, locals claimed that the mezzanine floor, where the fire broke out, was illegal. The deceased were seated on the mezzanine floor, which was used as a family seating room.

The police findings about the cause of fire lead to two cylinders on the mezzanine floor. One of them was empty. Gas was being supplied to the ground floor through a pipeline. Prima facie, it appears that the pipe developed a leak and caused a spark. The fire

then spread all over the restaurant,” said a fire official. The victims were taken to BMC-run Rajawadi hospital, where they were declared dead on arrival.

The tragedy could have been worse as many students were at the college. The ground-plus-one-storey restaurant was old and crowded, but its inexpensive menu appealed to most students struggling with shoestring budgets.

Expensive food at the canteen had, in fact, pushed many other students to eat at the more economical City Kinara.

The conclusion is that most of the fire and ceiling collapse happening due to improper fitting of furniture and fixtures.

AHAR as a responsible organization has advised its members to get timely fire and electric audit and display the same prominently at a visible location that the eating house is fire compliance.

The BMC has initiated action in most of the wards where it demolished illegal extensions of hotels and seized unauthorized gas cylinders and unguarded items that can be fire

hazardous. They have also taken action for not exhibiting licences, lack of NOC from fire department & health licences, seized counters of Pav Bhaji in front of the restaurants.

BMC action on Restaurants The BMC has also been demanding NOC from Environment dept. While the Environment dept. says that they have stopped issuing NOCs since last few years.

In these circumstances AHAR has asked all its members to strictly follow the guidelines issued by Fire

department. It has also asked its members to obtain Fire NOC from the department incase they do not possess one or have misplaced them.
