2. DefinitionsIn this Proclamation unless the context requiresotherwise:I) "Civil Servant" means a person employed per-

manently or temporarily by a government office;provided, however, that it shall not include thefollowing:(a) government officials with the rank of deputy

minister, deputy commissioner and with otherequivalent ranks or above;

(b) members of the House of Peoples' Represen-tatiyes and.the House~f the Federation;

3) "Position" means a set of related tasks intended t('r'beperformed, full lime; by a civil servant: ~

4) "Promotion" means, assigning a civil servant to ahigher grade;

5) "Commission or Commission~r" means the FederalCivil Service Commission or Commissioner, respec-tively;

6) "Head ofa Government Office" rneans a govern-ment official who directs the office and includes hisdeputy; ,

7) "Medical Certificate'~ means a certificate on thehealth condition of a civil' servant issued by amedical institution licensed by the appropriateauthority;

8) "Salary" means base pay and periodical incrementsauthorized for a grade of a position.

PART TWOPosition Classification, SalalY

Scale and Allowances3. Classification of position

1) A position shall be classified to a class of positionsand grade on the basis of the type of service,function, profession or occupation, difficulty andcomplexity of duty, extent of responsibilities andrequisite education, experience, knowledge, abilityand skill.

2) Reclassification of a position shall be carried outwhere:'

.(a) the original classification has been found to be

In error; ,

(b) new information not previQusly bro~ght tolight justifies a different classification; or

(c) the duties and responsibilities of the positionhave so changed as a result of changes in thestructure and systems of the organization.

3) When a position already occupied by a civil servantis reclassified pursuant to Sub-Article (2) of thisArticle: '

(a) to a higher grade, civil serVant occupying theposition shall be promoted to the higher gradeif he meets the qualification requirementsthereof;

(b) to a lower grade or if the civil servantoccupying the position does not meet thequalification requirement when reclassified toa higher grade, the provision of Sub-Article(7) of Article 24 shall apply.

4) No appointment, promotion, transfer or demotionshall be made to any position which has not beenclassified.

4. Powersand Duties of the Commission and Govemmentomc~. .I) The commission shall:

(a) determine the classes of posi~ipns and gradesto which all positions' in government officesshall be distributed as well as the qualificationrquirements for each class of positions;

(b) prepare class specification for each class orpositions;

(c) classify positions to classes of positio,ns andgrades on the.basis of organizational set up orgovernment offices and job specificationssubmitted to it in accordance with Sub-Article(2)(b) of.this ArtiCle and supervise the im-plementation of same;

(d) examine and decide on comments and com-plaints forwarded by government offices andcivil servants on classification of positions:

(e) issue directives on classification of positions.2) Every Government office:

(a) shall prepare its organizational set up andsubmit same to the Commission for approval:

(b) shall, on the basis of its organizational setup.fill in detail the tasks and responsibilities oreach position in the form designed for suchpurpose and submit to the commission rorclassification. .

(c) may forward its comments to the Commissionon the classification of a position prior to ilsimplementation;

(d) shall ensure that the final classification or aposition is properly implemented.

5. Salary.ScaleI) The CO'mmission shall undertake studies on salary

scales to be applicable to civil servants and suhmitsame to the Council of Ministers for approval; andsupervise their proper implementation upon ap-proval.

2) A salary scale shall contain the base and l11aximumpay and steps indicating periodical increments roreach grade.

3) The Commission shall .undertake periodicalrevisions of salary S(;;~lcsbased on economic chan-ges and othe.rrelevant co.nditions and submit same tothe Council of Ministers at least once every fiveyears.

6 Equal Pay l'orEqual workAll positions of equal value shall have equal base salary

7. Payment of SalaryAny Government office, shall, at the end of every month.make payments of salary to civil servants or their legalrepresentatives.

8. Increment of SalaryI) Civil servants may be .entitled to periodical salarly

increments as may be determined by the councilorMinisters.

2) The salary increments to be made to civil servantswith satisfactory, above satisfactory and outstandingperformances shall vary accordingly,

3) The provisions of Sub-Article(l) ofthis Article shallnot be applicable to a civil servant whose pelt'or-mance is unsatisfactory.

9. Attachme(1tand Deduction ofSaJary ,

I) The salary of a civil servant may not be attached ordeducted except in accordance with:

(a) the consent of the civil servant;(b) court order; or .(c) the provisionsof the law.

2) Monthlydeductionsfrom the salaryof a civil servantto be made pursuantto Sub-Article (I) (b) or (c) ofthis Article shall not .exceedone third of his salary.

10. Allowances

1) . Any allowance shall be paid for the purpose ofcarrying out the functions of the civil service.

2) The Commission shall undertake studies on thepayment of various allowances and submit same tothe Council of Ministers and, upon approval,supervisetheir implementation.

PART THREEStaffing and Perfom'1anceEvaluation

CHAPTER ONESelection and Recruitment

11. Eligibility1) The followingshallnotbe eligibleto be civil servants:

(a) a person under the age of 18 years;(b) a person who has been convicted by a court of

competentjurisdiction of any crime committedin connectionwithhis dutiesas acivil servantorbreachof trust, theft or fraud, unlesshe hasbeenreinstated in accordance with the law;

(c) without prejudice to Sub-Article (1) (b) of thisArticle, a civil servant wh.ohas been dismissedon grounds of disciplinary offence, before thelapseof two yearsfrom the date of his dismissaI..

2) NotwithstandingSub-Article(1) (a) of thisArticle, theCommissionmay issuedirectiveson circumstancesinwhichyoungpersonsabove the age of 14andunder 18may be appointed as civil servants and on theconditionsof serviCeapplicable to them.

12. Apppintment of ForeignersA person who is not an Ethiopian national may not beeligible to be a permanentcivil servant.

13. Filling of vacancies1) There shall be no discrimination amongjob seekers

or civil servants in filling vacancies because of theirethnic origin, sex,'religion, political outlook or anyother ground.

2) A vacant position shall be filled only by a personwho meets the qualification required for theposition and scores higher than other candidates.

3) Withoutprejudiceto the provisionsof Sub-Articles(1) and (2) of this Article,preferenceshallhe givento:a) female candidates; and.b) members of nationalities comparatively less

represented in the government office,having equal or close scores to that of other candidates.'4)~ Notwithstanding the provisions of Sub-Articles

(1)-(3) of this Article, priorities of appointmentshall be given to candidates with disabilities whomeet the minimum passing score.

5) Vacancies may be filled through recruitment,promotion or transfer on the basis of humanresource planning.

14. Vacancy Announcement and Examination for Recruit-ment

1) Government offices shall advertise every vacantposition to be filled by a new dvil servant.

2) The Commission'may issue directives with regardto advertisingvacant positions and the preparationand conductingof examinations and disclosing theresults thereof.

3) Notwithstanding Sub-Articles (1) and (2) of thisArticle, every government office may solicitgraduates of higher educational institutions forrecruitment in cooperation with the institutions.

The candidate who has scored the highest mark fromamong the competitors; and passed the examinationshall submit medical certificate to prove his fitness forservice ~nd written testimony to prove that he has nopolice record with regard to crimes r~ferred to in Sub-Article (1)(b) of Article 11 of this Proclamation.

16. Appointment and Oath of Fidelity

1) A newly appointed civil servant shall be servedwith a letter of probational appomtment, singed bythe head or any other authorized official of thegovernment office, stating the title and grade of hisposition, his salary and date of commencement ofhis appointment, together with job descriptions ofhis position.

2) The appointed civil servant shall, before- commen-cement of his work, tak~ the following oath offidelity: .

"I-being a civil servant solemnly and sin-cerely swear that above all else faithfully servethe people, and at all times respect the Cons-titution and the.1aws of the Country and will notdisclose to any party the secret revealed to me byreason of my duties"

17. Detennination of Starting Salary

Any newly appointed civil servant shall be paidthe base salary as fixed by the civil service salaryscale for the position he has been ~ppointed;provided, however, that payment of step salaryhigher than the base salary may be authorized bythe Commis,sion where it is deemed necessary.

18. Probation

I) The purpose of probation shall be LUprove thecompetence of a newly appointed civil servantthrough follow-up of his performance.

2) The period of probation of a civil servant on theposition of his appointment shall be for six months;provided however, in doubtful cases, it .may beextended for an additional period of three months.

3) Where the civil servant on probation is absent fromhis work due to employment injury and withoutprejudice to the provisions of Sub-Articles (2) and(4) of Article 45 of this proclamation, he shall beallowed to complete the remaining probationperiod following the date of his recovery.

19. Pennanent Appointment

I) A letter of permanent appointment shall be issuedto a civil servant who has completed his probation.

2) Where the government office failed to evaluate theperformance of the civil servant, before the expirydate of the probation pt;riod and without prejudiceto the responsiblity of the official concerned, theperformance evaluation shall be carried out withinone month following the probation period;provided, however, that if the g(wernment officefurther fails to carry out the evaluation, the civilservant shall be deemed permanently appointed asof the date of his initiaLappointment

20. Tempormy Appointment

I) Without prejudice to Sub-Article (2) of this Article,a government office may appoint a temporary civilservant only for a job which is not of a permanentnature, provided, however, that a governmentoffice may, where circumstances so require, ap-point a 'temporary civil servant to a permanentposition.

2) A government office may, upon obtaining thepermission of the commission, appoint a foreignnational on a temporary basis where it is provedthat it is impossible to fill a vacancy that requires ahigh level professional by an Ethiopian throughpromotion or recruitment.Without prejudice to the provisions of this Artide.the Commission may issue directives on therecruitment of temporary civil servants.

21. Objectives

Promotion shall be given for the purpose of enhancingthe performance of government offices.

I) Any permanent civil servant may compete for

promotion unless he is prohibited because ofdisciplinary penalties.

2) The Commission shall issue detailed directives on

the promotion of civil servants.

Revocation of Promotion

Without prejudice to the provisions of Article 66( 10) ofthis Proclamation, any promotion obtained on the basisof false representation regarding qualification or gran-ted in contravention of the law shall be revoked at anytime.

CHAPTER THREETransfer

24. Internal Transfer

I) A government office may, whenever necessary.

transfer a civil servant to another similar position ofan equal grade and salary or to another place of workwithin the government office.

2) Any tranfer to be made under Sub-Article (I) of this

Article shall be carried out on the basis of com-petition whenever there are civil servants within thegovernment office applying for the transfer.

3) Notwithstanding the provisions of Sub-Article ( I)

of this Article, a civil servant may, without affectinghis salary, be temporarily assigned to anotherposition, for not more than a year, irrespective of thegrade or type of functions where it is required toprevent the occurrence or rectify the damage of anydisaster to the government office.

4) Where it is proved by a medical certificate that a

civil servant is unable to carry out the functions ofhis position or to reside in his place of work due tohis health condition. he shall be transferred toanother suitable position or place of work with:

(a) the same grade where such vacant position is

available; or(b) a lower grade where a vacant position of the

same grade is not available and he is willing tohe transferred to a position of lower grade.

Transfer limn another Government Omce

I) The filling of a vacant position in any governmentoffice byihe transfer of a permanent civil servanlfrom another government. office shall he madewhere 'the office is closed or his position isabolished and the commission so decides.

2) A civil servant tranferred under this Article shall heentitled to his previous salary and benefits acquiredby virtue of his grade and service.

.3) A permanent civil servant may, where it is neces-sary and the government office and the civil servantso agree, be'seconded to another government officeto perform a specific duty for a period not ex-ceeding one year.

4) Where a civil servant is seconded in accordancewithSub"Artitle (3)'of this Article:

"(a) 'his salary and other benefits shall not heaffected because of his assignment;

(h) his performance shall be evaluated hy thegovernment office to which he is secondedand shall be sent to his employer;

(c) he shall be subjected to disciplinary measuresto be taken by his employer whenever hecommits discipinary offence.

26. Performance Evaluation

I) The purpose of performance evaluation shall he 10enable civil servants:

(a) effectively discharge their duties in accor-dance with the expe~ted level. quality stan-dardsand time; .

(b)-identify their strengths and weaknesses:(c) improve their"future performances and de-

velop' self initiative.2) Performance evalu'ation shall be transparent and

shall be carried out with the collective participalionof-civil servants working together.

29. Overtime Work

The Commission shall issue directives on the options ofgranting compensatory leave or overtime pay to a civilservant who has worked overtime; provided, however.that the rate of overtime pay shall be equal to the rate ofthe regular pay.

30. Public HolidaysI) Any civil servant shall incur no reduction in his

regular pay on account of having not worked on apublic holiday or on a day offices are closed by theorder of the government.

2) A civil servant ordered to work on apublic holiday.due to compelling circumstances, shall be entitledto overtime pay.

CHAPTER TWOAnnual Leave

ObjectivesI) The purpose of annual leave is to enable a civil

servant get rest and resume work with renewedstrength.

2) A newly appointed civil servant shall not heentitled to annual leave before serving for elevenmonths.

3) There shall be no payment in lieu of annual leave;provided, however, that payment may be made forunused annual leave due to termination of appoint-ment.

32. Duration of Annual Leave

I) A civil servant shall be entitled to annual leave of20 working days for his first year of service.

2) A civil servant having a service of more than a yearshall be entitled to additional leave of one workinl!day for every additional year of service; provided.however, that the duration of annual leave shall notexceed 30 working days.

3) previous service rendered in any government officeshall be considered for the application of Suh-Article (2) of this Article.

33. Granting of Annual LeaveI) Annual leave shall be granted within the budget

year in accordance with a leave made known to thecivil servants and prepared on the basis of dueconsideration of the interest of the governmentoffice and, as much as possible, the perference ofeach civil servant.

2) A civil servant shall be entitled to advance paymentof his monthly salary at the time of taking hisannual leave.

34. Postponement of Annual LeaveI) The head of a government office may authorize the

postponement of annual leave for two budget yearswhere the government office, due to compellingreasons, is unable to grant a civil servant his annualleave within the same budget year; providedhowever, that the accumulated leave shall begranted to the civil servant in the third budget year.

2) Notwithstanding the provisions of Article 3 I(3) ofthis Proclamation a civil servant whose annualleave is postponed for two years, in accordancewith Sub-Article (I) of this Article may claimpayment in lieu of half of his accumulated leave.

CHAPTER TIlREEMaternity Leave, Sick Leave

and Other LeaveS

35. Maternity Leave

1) A pregnant civIl servant shall be entitled to:(a) paid leave for medical examination in accor-

dance with a doctor's recommendation;(b) paid leave before deiivery if recommended

by a doctor.2) Apregnant civil servant shall be entitled to a period

of 30 consecutive days of maternity leave with paypreceding the presumed date of her confinementand a period of 60: consecutive'days of maternityleave after her confinement.

3) If the pregnant civil servant does not deliver on thepresumed date, the days subsequently taken beforeher confinement shall be replaced by the annualleave she is entitled to within the budget year or thatof the following budget year if no annual leave isleft.

4) The civil servant shall be entitled to sick leave inaccordance with Article 36 or 37 of thisProclamation, if she becomes sick after completionof her inatern~ty leave under sub-Article (2) of thisArticle.

36. Sick Leave

1) Any cjvil servant shall be entitled to sick leavewhere he is unable, to work due to sickness.

2) The duration of sick leave to be granted to apermanent civil servant in accordance with Sub-Article (1)of this Article shall not exceed eightmonths in a year or twelve months in four years,whether counted consecutively or separately star-ting from the first day of his sickness.

3) Sick leave to be granted in accordance with Sub-Article (2) of this Article shall be with full pay forthe first three months, with half pay for the nextthree months and without pay for the last twomonths.

4) Where any civil servant is absent from work due tosickness:(a) he shall, as soon as possible, notify the

government office unless prevented by forcemajeure;

(b) he shall produce a medical certificate in caseof absence for three consecutive days or formore than six days within a budget year.

37. Sick Leave for Temporary Civil Servants

A temporary civil servant who is unable to work due tosIckness shall be entitled to sick leave in accordancewith the contract he has entered into with the govern-ment office.

38. MarriageLeave

Any civil servant shall be entitled to leave with pay forthree working days when he concludes marriage.

39. Mourning Leave1) Any civil servant s~all be entitled to leave with pay

for three consecutive days in the event of the deathof his spouse, descendant, ascendant or any otherrelative, up to second degree, by consanguinity oraffinity.

2) A civil servant shall be entitled to leave with pay (orone day in the 'event of the death of his close relativeor friend other than those specified in Sub-Article( l) of this Article; provided, however. that suchleave shall not exceed six days within a budgetyear.

Special Leave with PayAny civil servant shall be entitled to special leave withpay where:I) he is summoned by a court or any other competent

authority, for the time utilized for the same pur-pose;

2) he participate in the election of government of-ficials, for the duration of the voting.

41. Special Leave without PayWhere a civil servant, upon sufficient ground, appliesfor a special leave without pay, the head of thegovernment office may authorize the grant of such leaveif it does not adversely affect the interest of the office.

42. Medical Benefits

1) A permanent civil servant shall have the right to getall medical services, free of charge, in governmentmedical institutions.

2) A permanent civil servant shall have the right to getmedical services, with half pay, in governmentmedical institutions for his spouse and minorchildren.

3) The Commission, the Ministry of Finance and theMinistry of Health shall jointly undertake studiesregarding the amount of contributions to be madeby civil servants towards the medical benefits theyare entitled to under this Article and submit samefor the approval of the Council of Ministers.

4) The amount of contribution to be determined underSub-Article (3) of this Article shall be made equalfor all civil servants.

PARTFIVEOccupational Safety and Health

43. Employment InjUlYI) The definition given to the term' 'employment

injury" under the appropriate labour proclamationshall also apply to the provisions of this Part.

2) Notwithstanding the provisions of Sub-Article ( I)of this Article, any injury sustained by the de-liberate act of the civil servant, in particular, hy hisnon-observance of express safety instructions or hyreporting to work in a state of intoxication shall notbe deemed an employment injury.

44. Saftey MeasuresI) Any government office shall have the respon-

sibility-to:(a) ensure that the work place does not cause

hazard to the health and safety of civilservants;

(b) Provide civil servants with protective devicesand materials and give them instructions ontheir usage.

2) Any civil servant shall have the obligation to:(a) ohserve directives issued in relation to safety

and health:(h) properly use safety devices and give thcm

instructions on their usage.(c) promptly inform the concerned official of any

situation which he may have reason to helievccould present a hazard.

Medical Benefits and Injury Leave

I) The government office shall cover ~he necessarymedical expenses incurred by a civil servant due toemployment injury.

2) Any civil servant who has sustained an em-ployment injury shall be entitled to injury leavewith pay until he recovers and resume work or untilit is medically certified that he is permanentlydisabled; provided, however, that the leave sogranted sh.allnotexceed 12 months.

3) A civil serVantwho is unable to recover and resumework within 12 months shall be entitled to the

benefits, provided for under Article 46 of thisProclamation.

4) Where the civil servant delays his recovery by notfollowing the treatment properly or by his non-observance of doctor' s instructions, his entitlementof the m'edicalbenefits arid leave under Sub-Article(1) and (2) of this Article shall cease.

46. Disabilty, Pension and Compensation

I) A permanent civil servant who has sustainedpermanent total or partial disabilty due to em-ployment injury shall be entitled to benefitsprovided for in the relevant pension law.

2) A temporary civil servant who has 'sustainedpermanent total disability shall be entitled tocompensation amounting to five times of his annualsalary. '

3) Where the disability sustained by the temporarycivil servant is permanent partial disability, theamount of compensation shall be calculated on thebasis ofthe sum referred to in Sub-Article (2) ofthisArticle and shall be,proportional to the degree of

. the disability.4) Injuries, causing serious deformity although not

resulting in disability, shall be considered aspermanent partial disability for the purpose of theprovisions of this Article.

5) Where an employment injury resulted in the deathof the civil servant, his survivors shall be entitledto:(a) survivors pension gratuity payable under the

relevant pension law if the deceased was apermanent civil servant; or

(b) compensation under Sub-Article (2) of thisArticle, if he was a temporary civil servant.

47. Exemption from Tax

Any payment to be made pursuant to Article 46 of thisProclamation shall be exempt from taxation and maynot be attached, deducted by way of set off or assignedby the beneficiary.

Claims of Compensation from Third Party

I) Where the injury sustained by the civil servant iscaused by the fault of a third party, the governmentoffice shall be entitled to claim compensation fromthe third party an amount equal to the expenseswhich it has incurred due to the injury.

2) In the event that the civil servant receives compen-sation from the third party that caused the injury,the government office may deduct from the salaryof the civil servant, the expenses incurred pursuantto Article 45 of this Proclamation.

49. Objectives

A ci,vilservant may be trained to improve his capabilityand achieve better performance or to prepare him forhigher responsibility ba~ed on career development.

50. Responsibility to Train Civil Servants

I) Every government office shall have the duty toidentify the training needs ofthe office and the civilservants and to prepare plans and budget fortraining and thereby ensure that the .civil servantsreceive the necessary training and furnish infor-mation thereon to the Commission.

2) The Commission shall:(a) train human resource management staff on

the basis of the training needs of governmentoffices;

(b) coordinate and support the training programof the different government Offices.

3) To make the training of civil servants effective, theCommission shall issue a policy with regard to theconditions of their training locally and abroad andsupervise the implementatiQn of same.

PART SEVEN

Managing infonnation'Profile ofCi~il Servants

51. Personnel Records

1) Every government office shall keep personnelrecords containing all relevant information regar-ding each permanent civil servant.

2) A civil ,servant shall have access to all informationcontained in his personnel records or to have a copythereof.

3 Any person other than the concerned administrativestaff shall not have, access to personn~l recordsunless authorized by the head of the governmentoffice.

4) It is prohibited to deposit any document in thepersonnel records of a civil servant without hisknowledge.

5) Every government office shall be responsible forkeeping personnel records of civil servants for aperiod determined in the directives issued by thegovernment'offiCe authorized by law.

52. Statistical Data

The Commission shall have the duty to collect andcompile statistical data relating to civil servants.

54. Ethical Conduct of Civil Servants

Any civil serva~t shall adhere to the provisions of thisPart and other directives issued by the government onethical conduct of civil servants.

55. Secrecy

I) Except to the concerned organ, any civil ,servantway not disclose 't9 any person cIassificd infor-mation that might endanger the security of the Stateand the Public.

2) Without prejudice to the provisions of Sub-Article(I) of this Article, any civil servant may provideany information relating to his duty.

56. Prohibition of Engagement in Other Activities

I) No civil serVant shall engage 'in any other activitywhich might impair his service or be in conflictwith his duties or inconsistent with his position as acivil servant.

2) .Without prejudice to the provisions of Sub-Article( I) of this Article, a civil servant may, afterinforming the government office, engage in anyother activity during his leisure time.

57. Neutrality from Political InvolvementI) Any civil servant may not use his position 10

promote his political interest and thereby engage in'discriminatory practices.

2) Without prejudice to the generality of Sub-Arlicle(I) of this Article, it is prohibited for any civil

servant to uS,e his regular working hours andpositions for soliciting support or instigating op-position for or against any political party ormembers thereof.

58. Conflict of Interest

I) Any civil servant shall report in writing to hissuperior every case in which a conflict betwecn hisprivate interest or that of his relative or friend andhis duties has risen.

2) Where the case stated in Sub-Article (I) of thisArticle arises and if the superior to whom the sameis reported finds it necessary may assign anothercivil servant to execute the duty.

59. Gifts

No civil servant may demand or accept any gift in returnof services rendered or expected.

60. Declaration of Income

When necessary and upon request of the governmentoffic,e, any civil servant shall declare all his incomeother than his salary.

6) . Compulsory Medical Examination

I) Any civil servant shall have the obligation to takemedical examination, with the exception for HIV/AIDS, when required by the government office onsufficient grounds related to the service.

2) Expenses incurr~d pursuant to Sub-Article (I) ofthis Article shall be covered by the governmentoffice.

66. Olfences Entailing Rigorous Penalties

5) to initiate physical violence at the place of work;6) neglect of duty by being alcoholic or drug addict;7) to acocpt ordemand bribes; ,

10) to commit an, act of misrepresentation orfraudulent act;

I) Every government office stlall establish a dis,.ciplinary committee which shall. investigate dis-ciplinarychargesbrought againstcivil servantsaijdthereby submit recommendationsto the concerned

. officials.,2) Before imposinga disciplinarypenalty on any civil'

servant, he should be informed of the allegedoffence and be given the chance to defend himself.

3) Without prejudice to the provisions of Sub Article(15) of Article 17of the Federal Ethics and Anti-COrruptIOnCommission EstabJishment Procla-mation No.' 235/2001, disciplinary measures may

.68~. Suspension from Duty

I) A civil servant may be suspended from duty bywith 'holding his salary for a period not exceedingone month if that course of action is necessary inthe interest of the civil service.

. which his dismissal is to be expected if it is provedagainst him., '

69. Period of Limitation

I) Disciplinary measure shall not be taken against acivil servant who has committed an offense en-

tailing ~imple disciplinary penalty unless sllchmeasureis taken,with six months, excluding the

.,time. required for investigation from the time thebreach of discipline is known.

2) No disciplinary charge shall be brought against t\civil servant who has committed an offense en-

tailing rigorous disciplinary penalty unless suchdi-st;iplinarycharge is brought within, a year fromthe ttme the commission of the offense is known,

3) The official ~ho has failed 'to take the measuresspecified under Sub-Article (1) or (2) of this Articlcshall be held responsible.

70, Establishment of the Administrative Tribunal

I) An Administrative Tribunal which hears and de-

cides appeals brought by-civil servants is herebyestablished. ".

72. pe,ci~ion C{fthe Ad1J1i~istrativeTribunal.1) The Adminis~rative Tribunal may, after hearing the

appeal, confirm or reverse the dec,ision or vary thedeCision in favor of the appellant.

2) , The copies of the decision shall .be given to bothparties. '

3) :rhe decision of the Administrative Tribunal onquestion of facts shall be final; provided, however,that anyone of the parties may appeal to the FederalSupreme Court on question of Jaw within 30 daysfrom the date of the decision of th~.AdministrativeTribunal.

73..Execution

I) Any government office against which a decision isgiven by the Administrative Tribunal shall have theobligation to immediately execute the decisIon.

2) Where the beneficiary of a decision pleaded tni,\nhe, decision of the Administrative Tribunal given i'n

accordance witb Article 72 of this Proclamation is

not executed within 30' days, the AdministrativeTribunal shall refer the decision to the Federal FirstInstance Court for its~enforcement.

3) The head of the goverIlment office who failed toexecute the decisionof the Administrative Tribunalshall be liable for the damage sustained by theoffice and the civil servant.

PART ELEVENTelmination and Extension of Service

74. Resignation

1) Any civil servant may, by giving a one month priornotice, resign at any time.

2) Where the service .of the civil servant is indispen-sable and he could not be replaced easily, the head'of the government office may delay his release for aperiod not exceeding three ":l°nths.

75. Telminationdue to Illness ,

I) Where a permanent civil servant is unable toresume work within the time specified underArticle 36(2) of this Proclamtion, he shall, with norequirement of a medical certificate, be deemedunfit for service and be discharged.

2) The service of any temporary civil servant may beterminated where he is unable to resume work at the

end of the sick leav~ granted to him pursuant toArticle 37 of this Proclamation.

3). Without prejudice to the provisions of Article 4~(2)of this Proclamation, where a civil servant who hassustained employment injury is medically deter-mined to be permanently disabled, his service shallforthwith be ten:ninated.

76. Termination on Grounds of Inefficiency

I) The service of a permanent civil servant may beterminated where his performance evaluation resultis unsatisfactory. for two successive evaluationperiods despite exerting all his knowledge andability to accompli.sh his,work.

2) Notwithstanding the provisions of Sub-Article (I)of this Article, a civil servant whose performanceevaluation result is above satisfactory for fivesuccessive years may not be dismissed on groundsof inefficiency unless his performance ,result be-comes un~atisfactory for the following three suc-

, cessive evaluation periods:

79. Retrenchment .'

1) Any civil servantshallb~retrenchf?dwhere:(a) his position is abolished; ..

(b) the government office is closed;or(c) redundancy of man power is created;and where it is not possible to transfer. him' inaccordance with Article 24(7)or 25(1) of thisProclamation or where he is reluctant to' accept aposition of a lower grade. '

2) Retrenchment of a civil servant in accordance withSulr:Article (1)(c) of this Article shall be madewhen it is proved that his performance andqualification is lower when compared with othercivil servants holding the same position.

Termination on Disciplipary Grounds.

1) The service of a permanent civil servant shall beterminated where:'(a) a disciplinary penalty under Sub-Article

(1)(f) :of Article 65 of thisProclamation isimposedon him; and . "

(b) the penalty is not canceled on appeal made. . ,itoder this Proclamatiofi, -

2) Where the penalty is mitigated or canceled on, appeal, the civil servant shall be entitled to,

without interest, the payment of the remaining ofhis salary withheld during the appeal.

3) The service of a temporary civil servant shall beterminated withou~any,additional formality where:

(a) a penalty of dismissal is imposed on him; or(b) the term of his employment expires.

81. Retirement

1) Unlessa civil servant is retainedin servicebeyondthe retirementage, his service shall be terminatedwithoutany additionalformalityon the last day ofthe last month in which he attained the retirement

age determinedby law.2) The civil servantshallbe notifiedof his retirement

in writingthreemonthsprior to his retirement.

82. Certificateof Service

Wheretheserviceof a civilservantis terminatedforanyreason or where he so requests, he shall be providedwith a certificate of service indicating the type anddurationof his service,his salary and the reasonfor thetermination.

83. Severance Pay

1) Any civil servant who has been retrenched underArticle 79 of this Proclamation and is not entitled to

pension allowance shall be paid:

(a) his salary of three months for the first year ofhis service; and

(b) one-third of his monthly salary for each

additional year of his service;provided, however, that such payment shall

not exceed his salary of 12 months.

2) A civil servant who has completed his probation

and served for less than one year shall be entitled to

severance pay in proportion to his service.

3) without prejudice to the provisions of the relevant

pension law, where the service of a permanent civilservant is terminated due to his death, an amount

equivalent to his three month's salary shall be paid

to his spouse or dependent who have been madeknown to the government office in writing.

84. Extension of Service

l) The service of a permanent civil servant may be

extended beyond his retirement age for a period up

to five years at a time and for a period not exceeding

ten years in total.2) The service of a civil servant may be extended

under Sub-Article (1) of this Article where:

(a) his qualification, special skill and ability isfound to be essential to the governmentoffice;

(b) it is not possible to replace him by another

civil servant through promotion, transfer orrecruitment;

(c) he is proved fit for service by medicalcertificate;

(d) he has agreed to the extension of his service;and

(e) the extension is approved by the Commission.
