Grievance Description : Request for transfer of grievance to Government of Assam for online disposal of grievance GOVAS-E-2014-00065 dated 24-04-2014 which, despite passage of more than more than 20 months, remains pending and unopened with Shri Mahtabuddin Ahmed, Commissioner and Secretary, Deptt of Pension & Public Grievances, Assam Sectt(Civil), Assam Sachivalaya, Dispur, Guwahati - 781006. REASONS FOR URGENCY/SUMMARY OF SUPPORTING DOCUMENT (i) Since Year 2013, Ministry of Railways officials are causing criminal harassment of their officer Sh Praveen Poddar JAG/IRSEE posted in N F Railway. In this regard, RTI appeal RSECT/A/2016/60001 dated 02/02/2016 was disposed on 04/03/2016 by way of referral to Railways and CVC. Instead of taking corrective action, harassment was enhanced by way of enhanced fraudulent deduction from salary towards fraudulent claim of unauthorised absence from duty and connected damage rent recovery. (ii) In this regard, CVC Complaint 20265/2016 dated 09/03/2016 (7th attachment) against CVO/DoPT is apparently under process with CVC. Since CVC Complaint portal is not working since 26/10/2016, latest status is not known. (iii) Email dated 27/06/2013 to the then Honourable Minister Sh Ghulam Nabhi Azad and CVC Complaint 20265/2016 was informed to DDA/CBI Sh Santosh Rastogi on 09/04/2016 (Page 19 of 6th attachment). (iv) Despite non-payment of fee for RTI application, email dated 09/04/2016 to DDA/CBI was treated as RTI application by Sh Pankaj Singh SP cum CPIO/CBI vide letter dated 31/05/2016 (8th attachment) and transferred to Northern Railway. (v) Ignoring the above lapse, DyCVO/M/Northern Railway Sh Vinod Kumar again treated the matter as RTI application and transferred the case to Railway Board vide letter dated 07/06/2016 (9th attachment). (iii) Immediate refund of damage rent recovery for residential accommodation. FACTS: (1) On 09-4-2015 (Page 27 of SD), grievance MORLY-E-2014-13854 dated 08-12-2014 under process with Additional CSC-NFR was informed to AM (Staff)-RB with copy to Sh Ranjit Kumar DVSNT. (2) On 11-4-2015, Sh A S Pandey SG-IRSEE and complainant took joint decision (Page 26 of the attachment) regarding resumption of duties by Sh A S Pandey and complainant proceeding to HQ for further instructions. (3) On 13-4-2015, matter was informed to Sh K P Singh DyCPO-Gaz-NFR through both email and paper mode (Page 23-24 of SD). Since then, Sh K P Singh DyCPO-Gaz-NFR continues to deny receipt of document. (4) On 20-06-2016 (Pl see supporting document), matter was informed to CVC. In July 2016, CVC referred complaint to Adviser-Vig-RB Sh Sunil Mathur who has not till date informed disposal of complaint. (5) The latest decision communicated online on 03/02/2017 w.r.t grievance PRSEC/E/2016/13886 dated 01/11/2016 is malafide. Parawise comments is as follows: (A) Salary for July 2015 and August 2015 was fraudulently not paid in violation of RBE 79/2011 dated 03/06/2011 and informed to AGM/NFR Sh Lokesh Narayan through clarification dated 03/02/2017 to grievance PRSEC/E/2016/13886. In addition, for fraud FIR No. 782/2015 dated 25/09/2015 against APO/Gaz/NFR Sh U Hazoari and others is still under investigation at Dibrugarh Police Station, (B) Application for quarter retention was given to DyCPO/Gaz/NFR on 13/04/2015 (Page 23-24 of supporting document) in both paper and email form. Document was also submitted to GM/NFR Sh Chahatey Ram on 15/11/2016 after meeting with him and recently reminded again on 25/01/2017. Regarding role of CVO/NFR Sh Rajesh Agrawal CVO/N F Railway in protecting officials named in the FIR, CVC Complaint 10109/2014 was registered under Whistle Blower protection Act 2011. The Complaint was referred by CVC to CVO/MoR on 02/06/2014. Status of complaint has not been informed by Railways.

As per verbal information given by my reporting officer Sh Hari Om Sharma CEE/Planning/NFR, fresh conspiracy is being hatched to trap me or financially hurt me in unlawful manner. As informed to IO of Jalukbari Police station and as per documentary evidence available with me, official at highest level are involved. Accordingly RTI appeal CABST/A/2014/60023 dated 18/07/2014 has been registered. CBI/Guwahati made some discreet enquiries in February 2014 and they accordingly referred the matter to RB Vigilance on 26/02/2014. However Sh G V Reddy ED (Vig/L)/RB (CVC Complaint 3983/2014) as AA (RTI) informed on 23/05/2014 that ref from CBI has not been received. On 08/07/2014, Sh S P Beck, Director (Vig/SNT)/Railway Board (CVC Complaint 687/2014) as PIO informed that position remains same as on 10/02/2014. In June 2014, CBI/Guwahati wrote to me to not to write to them. The sequence of event indicates malicious motive. So it will be prudential if the FIR is transferred to CBI.

14. 04/07/2014

As documentary evidence of harassment, CSC(RPF)/NFR letter dated 04/11/2013 was given to Jalukbari Police Station. Despite passage of more than 7 months, CEE/NFR (Sh B P Verma, one of the accused in FIR) has not communicated his decision w.r.t CSC advise. In this regard, RTI request MORLY/R/2013/62684 dated 28/11/2013 remains pending.

15. 27/06/2014 On account of delay in disposal of this grievance, matter has been reported to PMO vide RTI appeal PMOIN/A/2014/60086 dated 17/06/2014.

On 10/06/2014, Railway Board RTI Cell transferred one RTI case regarding complaint against Sh R S Virdi, GM/NFR to Railway Board Vigilance. On 11/06/2014, Railway Board issued orders for GM/CON/N F Railways to look after duties of GM/NFR on the grounds of Sh Virdi proceeding on leave.

Now AGM/NFR has given vague and evasive response on 27/05/2014 for my RTI query relating to APAR. Now Secy to GM/NFR states on 08/05/2014 that representation dated 03/12/2013 against APAR has not been received. On the other hand, Sh Arjun Kumar states that representation is under process. Hence there is contradiction.

Sh Arjun Kumar issued third letter on 12/05/2014. As part of conspiracy, Sh Rajesh Agrawal, CVO/N F Railway directly rejected 6 RTI requests involving officials mentioned in the FIR. On 16/05/2014, Railway Board issued orders for placement of two batches junior to me in Selection Grade and denying the same to me for third year.

Copy of APAR (Annual Performance Appraisal Report) of complainant finalised on 28/11/2013 was given to Assam Police Jalukbari Police Station as documentary proof of harassment. Representation against APAR was submitted on 03/12/2013 to GM/NFR Sh R S Virdi (one of the 4 officials mentioned in FIR). Against DOPT norms of disposal within 45 days, till date disposal has not been done. In this regard, grievance MORLY/R/2014/02308 dated 10/03/2014 was disposed on 09/05/2014 by CEE/NFR Sh B P Verma (another official mentioned in FIR) without ensuring disposal of representation. CEE/Planning/NFR Sh Arjun Kumar (3rd official mentioned in FIR) issued two highly damaging open letter on 08/05/2014 stating that complainant is

On account of delay in disposal of the issue after nearly one year, on 22/04/2014, the complainant was mobbed, abused, threatened and confined by Md. Afshar Khan, SSE/Drawing alongwith staff/union members in the office of CEE/NFR Sh B P Verma (one of the 4 officials mentioned in FIR) in chamber of DyCEE/TL/NFR who is witness to the incident. Relief sought: 1) Disposal of appeal by officer other than EDVL Sh G V Reddy 2) Supply of latest and updated information duly considering the grounds for appeal 3) Referral of CVC Complaint 687/2014 and 3983/2014 to CVC for re-examination based on accumulated information from February 2014 onwards . Grounds for appeal: i) Continuing violation of section 7(1) and 19(6) of RTI Act by DVSNT (CVC Complaint 687/2014) and EDVL (CVC Complaint 3983/2014) as explained in attachment based on response dated 28/07/2014 of RB Vigilance ii) Email was sent to DVSNT on 23/05/2013 when illegal and coercive Medical Examination of appellant was going on. Instead of taking immediate corrective/preventive action, DVSNT continued to issue false/malicious information or no Information or simply denial of receipt of communications

iii) On getting no response from DVSNT, FIR No. 393/13 was registered on 24/05/2013 against GM/NFR, CEE/NFR, the then CEE/Planning/NFR (Sh S K Puri) and the then CESE/NFR (Sh Arjun Kumar) at Assam Jalukbari (Guwahati) Police Station. iv) On 29/05/2013, CVC Complaint 15443/2013 was registered against GM/NFR. In December 2013, DVSNT informed that complaint has been referred to Electrical Directorate. ED/EEM Sh S K Saxena has not responded to RTI appeal MORLY/A/2014/60226 dated 20/02/2014 till date. v) On account of absence of response from RB Vigilance, Sh Arjun Kumar reported on my APAR on 31/05/2013 when medical examination was still going on. Reporting under such conditions is illegal and against natural justice. vi) On account of absence of response from RB Vigilance, Sh B P Verma CEE/NFR reviewed my APAR on 18/06/2013 when medical examination was still going on. Review under such conditions is illegal and against natural justice. vii) After registering of RTI request, CEE/NFR and CESE/NFR made illegal and post facto addition in my APAR on 04/10/2013. viii) On account of absence of substantive response to RTI request, GM/NFR accepted my APAR on 28/11/2013 with adverse comments, average grading and unfit assessment. Till date, he has not disposed representation dated 03/12/2013 against APAR ix) CVC Complaint 687/2014 against PIO is pending with CVO/MoR. The CVC Complaint 8341/2013 for which CVC Complaint 687/2014 was registered is under process by CVC.

X) In gross violation of DOPT norms, Sh Arjun Kumar stated on 08/05/2014 that representation against APAR is under process. xi) Without ensuring disposal of RTI request, Sh G V Reddy, ED (Vig/L)/RB (CVC Complaint 3983/2014) disposed RTI appeal MORLY/A/2014/60595 dated 09/05/2014 on 27/05/2014 xii) DVSNT (CVC Complaint 687/2014) disposed RTI request MORLY/R/2014/62396 dated 03/04/2014 on 08/07/2014 after disposal of appeal by EDVL.
