He said that gov- ernment of Jammu and Kashmir is mandated to take a call on the release of detained mainstream political leaders. According to ,, Union Home Minister Amit Shah while giving replies to a volley of queries in Lok Sabha termed the sit- uation in Jammu and Kashmir 'absolute peace- ful'. He said Jammu and Kashmir is witnessing normalcy where people are busy in daily affairs. While criticizing Congress party, Shah said though the situation in J&K is peaceful but oppo- sition tried to portray the situation deteriorated. "Congress is trying to divide the people and exploiting the situation of J&K which is absolutely peaceful. He said in every district of Kashmir, shops and business establish- ments have resumed their affairs while long queues of traffic jams are being witnessed every day. He added, it was Congress party who told earlier on the floor of this house that if Article 370 would be scrapped, J&K will witness huge blood- bath and a durable cur- few while maintenance of law and order in the state. Shah further said howev- er the situation is evident for everyone. "There is no need to keep things into hide. There was no bloodbath and no curfew, even not a single bullet was fired by police after abrogation of Article 370", Shah said. Shah asserted "At least seven lakh patients have got OPD consultations in government run hospi- tals across Jammu and Kashmir post abrogation of Article 370. Curfew and other kind of restric- tions have been fully lift- ed from all police sta- tions. Not a single death has been reported since August 5". Amit Shah while slam- ming Congress party stated that if Congress is alleging that political activity has been declined during BJP rule in J&K, it should have at least introspect what it has said. "Political activi- ty has never been mar- ginalized in J&K. Panchayat and Block Development Council (BDC) elections were conducted peacefully in recent past in which over 95% voting has been recorded. Is this not a political activity?" Shah questioned. Over the detention of mainstream political leaders post abrogation of Article 370, Home Minister Amit Shah said "We don't want any mainstream political leader to be jailed even for a day. Let the author- ities of J&K to take a call on their release". Lashing out on oppo- sition, Shah added that "Congress should keep this in mind that it had jailed Late Sheikh Abdullah for eleven years when Late Indira Gandhi was Prime Minister of the country. But we are not Congress; we don't want to follow the footsteps of Congress party". been set up in varioushigher secondary institu-tions which includeGovernment HigherSecondary School atSonwar with 30 comput-ers, Higher SecondarySchool at Amira Kadalwith 20 computers,Higher Secondary Schoolat Rajbagh with 20 com-puters, MP HigherSecondary School atKhanyar with 20 comput-ers and Higher SecondarySchool at Soura with 40computers.

The totalnumber of computersinstalled at these centres isaround 500 - including 30computers at the TRCfacilitation centre whereprioritised facilitation toNEET aspirants began as

the registration for theexam opened onDecember 2. Officialsfrom the NationalInformatics Centre or NICof DC Office Srinagar willbe available at each centreto provide technical assis-tance to aspirants submit-ting their examinationforms. Technical teams ofhost institutions will alsobe available to supervisethe operation of these cen-tres.

Seven of these centreswill open for users fromtomorrow whereas theother four includingBemina Degree College,Islamia College of Science& Commerce, Sri Pratap

College and Soura HigherSecondary School willopen on Thursday.Deputy CommissionerSrinagar Dr Shahid IqbalChoudhary visited sever-al of these centres toinspect their establish-ment.

Speaking on the occa-sion Dr Shahid said thateach of these centres willhave a register for users tonote their experiencesabout the service offeredto them. He said the feed-back will be used toimprove the serviceswherever required.

Each of these centres iswell-equipped to takecare of all parts of theform submission processincluding OTPs for verifi-cation and online fee forthe exam.

Meanwhile the districtadministration has pro-vided 50 laptops to theseinstitutions where thesecentres have been set up.The provision is aimed atenhancing relevant capa-bilities of these institu-tions to help their stu-dents. It will also help inthe ongoing NEET regis-tration process in the cen-tres set up at these institu-tions.

FC issued these direc-tions while chairing ameeting held here todayto review the status ofwork on NursingColleges, ANM and GNMschools besides B.Sc Para-Medical courses.

He directed the offi-cials to ensure that all thefacilities with regard tolaboratory, equipment,furniture and other utili-ties shall be put in placefor proper functioning ofthese schools.

The FC was informedthat two GNM schools inUdhampur and Akhnoorbesides three ANMschools in Kishtwar, Reasiand Ramban have beenmade operational inJammu division in thefirst phase. In the secondphase, seven ANM andGNM schools which are atvarious stages of comple-tion will be made func-tional within the commit-ted deadline.

Regarding progress onANM schools in Kashmir,it was informed thatANM schools have beenmade functional inShopian and Bandiporawhile GNM schools inPulwama and Kulgam

have also been opera-tionalised.

The FC directed theconcerned officers toensure completion of allpending works of ANMand GNM schools withinthe deadline.

He said that the gov-ernment is planning tostart Super Specialitycourses in Nursing at theGovernment MedicalColleges (GMC), Jammuand Srinagar by 2020. Inthis regard, he directedthe officers to seekapproval from Universityof Kashmir and IndianNursing Council.

He also directed theconcerned officials tomake operational the BScNursing School in Jammuwithin a month's timebesides ensuring func-tioning of nursing schoolsin Anantnag andBaramulla from April2020 in makeshift arrange-ments till the works on themain buildings are com-plete.

SRINAGAR, DEC 10: In pursuance of Court Orderin PIL No. 23/2017 regarding prevention of cruelty tothe animals, a meeting was chaired by DivisionalCommissioner, Kashmir Baseer Ahmad Khan to reviewsteps taken for prevention of cruelty to the animals.

to the Hindu migrants from Pakistan

who are living in the city and they are

now looking forward to the bill get-

ting a nod from the Rajya Sabha.

Premchand, who had shifted here

from Pakistan in 2005 and applied for

citizenship later, expressed happiness

over this development. "The govern-

ment has given a new life to us. We

express our gratitude to Union Home

Minister Amit Shah and the BJP gov-

ernment for giving us a chance to live

in India with dignity," he said,

adding that he has applied for citi-

zenship. Hindu Singh Sodha, the

president of the Seemant Lok

Sangathan, an organisation fighting

for the rights of the migrants, said

this amendment would make more

migrants eligible for citizenship.

"This amendment would make more

er. People had earlier been compelled

to wait for 11 long years in this coun-

try before applying for citizenship,"

said. He said earlier the bill could not

get the nod of the Rajya Sabha. "We

look forward to the bill being passed

in the Upper House as well," Sodha

said, adding that the process of grant-

ing of citizenship also needed to be

expedited as it progressed at a snail’s

pace. Earlier, the migrants apply-

ing for citizenship were required to

have stayed in India for at least 11

years, but under the proposed legisla-

tion the required period of stay has

been reduced to six years. Another

Hindu migrant from Pakistan said

the passage of the bill was in the right

direction. "Though, six years is also

not a short period, we are still happy

that it was cut in half," he said and

expressed hope that it would save

them from the trouble of repeated

formalities and permissions that

require documents. The bill, which

seeks to provide Indian citizenship to

non-Muslim refugees coming from

Pakistan, Bangladesh and

Afghanistan after facing religious

persecution there, was passed in the

Lok Sabha a little past midnight on

Monday after a heated debate that

lasted over seven hours.

Signs that the economy

is going south have been

flashing for some years

now. But all suggestions

and criticisms regarding

the economy were greet-

ed by apparatchiks, apol-

ogists, advocates and

adherents of the ruling

dispensation by a combi-

nation of denial and

hubris.

The defence trap

That many of the crit-

ics were also beneficiar-

ies of the ancien regime

didn’t help matters.

Given their pathological

hatred for the PM

Narendra Modi-led dis-

pensation, their criticism

was seen as more politi-

cal than economic. But

many people with no axe

to grind against the Modi

government, and who

actually wanted to see it

succeed were also sound-

ing a note of caution on

the direction the econo-

my was headed.

But the stock response

was to ignore them after

accusing them of igno-

rance or prejudice or

even an agenda. The bot-

tom line is that there was

a deep aversion in the

ruling party camp to

paying any heed to bear-

ers of bad news on the

economy. However, ulti-

mately the truth will out.

Startling numbers of how

industrial production

was falling, how invento-

ries (especially in the

auto sector) were rising

and forcing companies to

close factories for days

and lay off workers,

started pouring in, cul-

minating in the distress-

ing news that growth

was down to 4.5 per cent.

To be fair to the gov-

ernment, within weeks of

the disastrous budget

presented in July, some

corrective measures were

taken, including a signif-

icant cut in corporate

taxes. But the reforms

still don’t go far enough

or deep enough.

If anything, they are

tentative and unlikely to

kickstart the economy,

much less instil confi-

dence in the productive

sections of the economy,

those who create wealth,

that they will be facilitat-

ed instead of being treat-

ed as criminals and

penalised for being suc-

cessful. Nor is there any

confidence that they

won’t be harassed by

every two-bit babu, or be

obstructed at every stage

by an extortionist

bureaucracy demanding

their rents in exchange

for letting people do

their business.

The biggest problem

for the government now

is a credibility issue. This

is partly a function of the

fact that governments

find it difficult to speak

the truth because admit-

ting failure makes for

bad politics. This then

catches the government

in a trap. The very nature

of an official’s job

demands that she

defends every action of

the government and talks

up the economy. This is

the reason why officials

continue to deny that the

economy is heading

towards a crisis and

quarter after every weak

quarter, officials keep

insisting that the slow-

down has bottomed out

and the revival of the

economy is around the

corner. The trouble is

that the loss of credibility

— the same guys first go

blue in the face denying

that the economy was

sliding, then claim that

the economy will

rebound in the next quar-

ter, which never seems to

come — ensures that

their attempts to talk up

the economy fall flat

because no one takes

what they say seriously.

Junk outdated ideas

The simple truth is that

the government just

doesn’t get the fact that

its whack-a-mole

approach to tackling the

economy’s problems isn’t

going to work. Nor will

doubling down on poli-

cies that have proven to

be failures — reviving

Air India for example —

lead to any kind of

improvement.What India

needs is sensible but

sweeping reform; what

India is getting is Soviet-

style targets for the

b u r e a u c r a c y .

Complicated and convo-

luted procedures

designed by the unimagi-

native bureaucracy only

fuel corruption and act as

a disincentive for busi-

nesses from becoming

part of the system.

Worse, they spawn extor-

tion and tax terrorism.

GST is a prime exam-

ple. The most path-break-

ing reform of the Modi

government has become

a millstone around the

neck of businesses

because of the complexi-

ties in complying with

the procedures, paper-

work and some utterly

bizarre provisions of the

GST regime.

Stimulate commerce

The really surprising

part is that PM Modi has

a pretty good under-

standing of what needs to

be done. Take out all his

speeches from the 2014

Lok Sabha election cam-

paign and it is clear he

had the right ideas on

how to take the economy

to new heights. And yet,

when it comes to imple-

mentation, many of his

flagship projects have

simply not taken off.

For instance, the ‘Make

in India’ programme has

nothing to show for it

and only a masochist

would want to ‘Make in

India’ given the sort of

obstacles and headaches

manufacturing involves

— it is so much easier to

import from China and

make a handsome profit

than undergo the torture

of making in India. The

government has of course

done reasonably well in

its social welfare projects.

It has managed to touch

the lives of hundreds of

millions of people who

until now had only

received lip service from

the politicians and the

Indian state. But the

thing is that the govern-

ment cannot sustain

these welfare projects if

its coffers are empty; but

the coffers won’t fill up

until businesses make

money, which will not

happen if profits are

treated as evil and wealth

is considered a sin, and

businessmen are seen as

criminals. Unfortunately,

the BJP government

seems to have imbibed

and internalised the

Communists’ contempt

for sensible economics.

Revive the Indian economy, don't defend it

Citizenship is the legal right tobelong to a particular country. Inother words, citizenship bestowsupon individuals membership in anational political community.Citizens enjoy civil and politicalrights in a sovereign state. Kudos toPM Modi and Home Minister Shahfor passing this historic bill in LokSabha.Our PM Modi has rightlyexpressed delight over the passageof the Citizenship (Amendment) Billin the Lok Sabha, saying the pro-posed law is in line with India's cen-tury's old ethos of assimilation andbelief in humanitarian values. It isnice that the Lok Sabha passed theBill with 311 votes in favour and 80against it a little past midnight aftera debate that lasted more than sevenhours. Shah has rightly claimed thatthe Narendra Modi government wascorrecting the failure of the pact thatJawaharlal Nehru and the thenPakistan Prime Minister Liaquat AliKhan sealed in 1950. As stated byShah, the bill had nothing to do withthe National Register of Citizens andpromised the NRC would indeed beimplemented across the country andnot a single "infiltrator" would bespared. According to CitizenshipAct 1955, an illegal migrant is a for-eigner who enters the country with-out valid travel documents, like apassport and visa, or enters withvalid documents, but stays beyond

the permitted time period. Illegalmigrants may be imprisoned ordeported under the Foreigners Act,1946 and the Passport (Entry intoIndia) Act, 1920.

It is a step in the right directionfor all those suffered at the hands ofthese 3 countries. Government hastaken right decision of accepting therefugees particularly of Hindus who

are forcibly converted into otherreligions than Sikhs Buddhists pars-es etc. The bill aims at providingIndian citizenship to 6 minoritycommunities from Bangladesh,Pakistan and Afghanistan. The com-munities are Hindu, Christian, Sikhs,Buddhist and Jain. Currently for aperson to get Indian citizenship, heshould have resided in the countryfor 11 years. The bill intends toamend this as 6 years. Introduced onJuly 19 in the Lok Sabha, theCitizenship Amendment Bill 2016seeks to allow illegal migrants fromcertain minority communities inAfghanistan, Bangladesh andPakistan eligible for Indian citizen-ship. In other words, it amends the

Citizenship Act of 1955.According the Citizenship Act,

1955, illegal migrants can either besent to jail or back to their own coun-tries. In Assam, the protest is onrights and livelihood of ethnic com-munities on passage of the bill. Afterthe bill is passed, thousands of illegalmigrants will be deported accordingto Assam Accord. The Citizenship

Act, 1955 prohibits illegal migrantsfrom acquiring Indian citizenship.The Bill amends the Act to providethat the following minority groupswill not be treated as illegalmigrants: Hindus, Sikhs, Buddhists,Jains, Parsis and Christians fromAfghanistan, Bangladesh andPakistan. However, to get this bene-fit, they must have also been exempt-ed from the Foreigners Act, 1946 andthe Passport (Entry into India) Act,1920 by the central government. Italso appeals for the minimum yearsof residency in India to apply for cit-izenship to be lessened from at least11 to six years for such migrants.

The bill is applicable to all statesand union territories of the country

and the beneficiaries of the canreside in any part of the country.According to the Citizenship(Amendment) Bill, 2019, members ofHindu, Sikh, Buddhist, Jain, Parsiand Christian communities, whohave come from Pakistan,Bangladesh and Afghanistan, tillDecember 31 2014, facing religiouspersecution there, will not be treated

as illegal immigrants but givenIndian citizenship.

The Union Home Minister hasalready assured full support for thestate governments in the implemen-tation of the bill. There is no doubtthat this bill will provide the right tolive with dignity to the minoritiesfrom these three countries that havesuffered religious persecution andlived a hellish life for decades. Let ussee the Bill in a positive light as itseeks to address the plight of perse-cuted minorities who had no otheroption aside from coming to Indiaillegally. The government must alsotake suitable steps to assure that therights and socio-cultural identity ofindigenous people is not affected.

The issue of illegalimmigrants fromBangladesh, Myanmarand Pakistan will eventu-ally be solved with thepassage of this Bill. It is anirony that Rohangyas liv-ing in various parts ofIndia have been used asthe vote bank alongwiththe Bangladeshi illegalimmigrants by the politi-cal parties in India. Inorder to detect and deportsuch people, the CAB willbe followed by NRCwhich is being monitoredby the Apex Court.

Chrungoo also madean appeal to the Lt.Governor, administrationand the bureaucracy ofthe UT of Jammu andKashmir to advice its offi-cers and the executivestaff not to involve anyRohingya illegal immi-grants in any sort of socio-economic activity or ini-tiative at the cost of publicexchequor. All suchengagements at an officiallevel will be treated asillegal and immoral in anevent of an investigationand verification and thoseerring officials engagingthese illegal immigrantswill be held responsiblefor such an engagement.

In the meeting, threadbare discussions with regardto the demands related to mecadamization, education,healthcare, power, water, road connectivity, construc-tion of play fields, protection bunds, approach roads toagricultural fields, filtration plants, foot bridges, retain-ing walls, lanes & drains, widening of roads, augmenta-tion of water supply schemes, installation of high volt-age transformers, HT & LT poles with conductors,establishment of Micro Banking Branches, AnganwadiCentres sheep & veterinary units, handicraft trainingcentres and upgradation of educational and health insti-tutions were raised during B2V1 programme.

The DDC directed the officers to prioritize thedemands of urgent need and stressed to assess the fea-sibility of demands raised during B2V1.

1,256 projects of 22 depart-ments set to be completedtill March 2020, 422 belongto PHE department, 180 toR&B department, 168 toPDD, 76 to I&FC depart-ment, 104 to SchoolEducation, 77 to YouthServices, 50 to Health and48 each to Housing andIndustries departments.

It is pertinent to men-tion here that around 2,534languishing projects,worth Rs 6,654 crore, havebeen financed under JKID-FC to fast track theircompletion. These projectsare believed to be of highpublic importance andwould greatly ease theday to day lives of generalpublic on completion.

The Committee also decided to undertake various meas-

check the duplication of scholarship schemes and make the

procedure for applying for different schemes through single

The Pakistani troopsresorted to intenseshelling and firing alongthe Line of Control (LoC)in the Shahpur Kirni andBalakote sectorsovernight, triggeringpanic among civilians,they said. "Pakistan initi-ated unprovoked cease-fire violation by firingfrom small arms andintense shelling with mor-tars along the LoC in theBalakote sector," a defencespokesperson said. TheIndian Army was retaliat-ing in a befitting manner,he added. In the Shahpursector, the Pakistan Armytargeted villages with 120-mm mortar shells, trigger-ing panic among the vil-lagers, officials said.Mohammad Showkat(30), a villager, wasinjured in the shelling andhospitalised late onMonday night, theyadded.

NEW DELHI, DEC 10:One of the convicts in theDecember 2012 Nirbhayagang-rape-and-murdercase, who was lodged inMandoli Jail here, hasbeen shifted to Tihar, jailofficials said on Tuesday.

Pawan Kumar Guptawas shifted to Tiharrecently, Director General(Prisons) Sandeep Goelsaid.

Gupta is lodged in JailNo 2 of Tihar, where twoother convicts in thecase—Mukesh Singh andAkshay—are also lodged,while Vinay Sharma is inJail No 4 of Tihar, anotherjail official said.

Meanwhile, one of thefour convicts, AkshayKumar Singh, moved theSupreme Court Tuesdayseeking review of its 2017judgment handing downdeath penalty to all ofthem in the 2012 Nirbhayagang rape and murder

case.The apex court, on July

9, 2018, had dismissed thereview pleas filed by threeother convicts in the case.

Akshay, 31, who hadnot filed the review pleaearlier with other threeconvicts, has now movedthe apex court with thepetition, his lawyer APSingh said.

The top court had earli-er dismissed the reviewpleas by Mukesh (30),Pawan Gupta (23) andVinay Sharma (24), sayingno grounds have beenmade out by them forreview of the verdict.

The apex court in its2017 verdict had upheldthe capital punishmentawarded to them by theDelhi High Court and thetrial court in the case ofgangrape and murder ofthe woman here.

One of the accused inthe case, Ram Singh, hadallegedly committed sui-cide in the Tihar Jail here.

A juvenile, who wasamong the accused, wasconvicted by a juvenilejustice board. He wasreleased from a reforma-tion home after serving athree-year term.

‘Nirbhaya’, meaningfearless, is the changed

name of the 23-year-oldphysiotherapy intern,who was raped and bru-talised in a moving bus insouth Delhi by six men,including the bus driver,conductors and helpers,on December 16, 2012.

After receiving treat-ment in New Delhi for afew days, she was trans-ferred to the MountElizabeth Hospital inSingapore, where she suc-cumbed to her injuries onDecember 29, 2012.

All the accused in thecase, including a juvenile,were arrested andcharged with sexualassault and murder. Oneof them, Ram Singh, diedin police custody. The restwent on trial in a fast-track court.

The juvenile was con-victed of rape and murderand given the maximumsentence of three years’imprisonment in a reformfacility.

On September 10, 2013,the four remaining adultaccused were found guiltyof rape and murder andthree days later, sen-tenced to death by hang-ing. On March 13, 2014,the Delhi High Courtupheld the verdict and thedeath sentences.

The Bill was passed inthe Lok Sabha after divi-sion of votes with 311 inits favour and 80 againstit, following a marathondebate which continuedtill 12.06 a.m. on Tuesdayafter beginning at about 4p.m. the previous day.

In Tripura, road andrail traffic were badlyaffected and thousands ofpassengers were strandedas the picketers did notallow the plying of vehi-cles and trains.

As per the calculationsof the BJP’s floor man-agers, the effectivestrength of the RajyaSabha is 238. The NDA’scurrent strength is 105 inthe House, including 83members of the BJP, six ofJanata Dal (U), three ofShiromani Akali Dal(SAD), one each from LJPand RPI(A) and 11 nomi-

Kejriwal had approached the high court seeking

quashing of summons issued to him as an accused in

the case and challenged two orders of a trial court

which had refused to quash the summons against him.

A magistrate court summoned Kejriwal to appear

before it on Aug 7, after a criminal complaint by the

founder of social media page, 'I Support Narendra

Modi', alleged the AAP leader had re-tweeted the

defamatory video.

The chief minister challenged the magistrate's order

before a sessions court, which dismissed his plea.

He then challenged the sessions court order in the

high court, saying the trial court failed to appreciate

that his tweet was not intended or likely to harm the

complainant.

terrorists operating from its soil. "Pakistan must take action

The Lt. Governor observed that there is a pressingneed to revamp the tourism sector and directed the offi-cers to assess the functioning of the TourismDevelopment Authorities in J&K and take necessarymeasures for restructuring the same.

Taking serious note of the delay in some of theHealth Infrastructure projects, the Lt. Governor direct-ed for fixing responsibility for the inordinate delays andinitiating strict action against the erring officers. He fur-ther asked the officers to expedite the remaining proj-ects under PMDP with clear timelines for their timelycompletion.

The Lt. Governor asked the officers to coordinatewith Government of India regarding funds and submitthe proposal to the concerned quarters for additionalfunds, if required, to complete the development projectsin time.

Pertinently, Prime Minister's Development Package(PMDP) was announced for Jammu & Kashmir andLadakh in November 2015 with a total outlay of Rs 80,068 cr with Rs 58, 625 cr allocated for Jammu andKashmir for the completion of 54 major projects underthe package, out of which 35 projects were to be execut-ed by UT Administration and agencies while 19 projectswere taken up by the Central Government.

It was further informed that a total of 15 projectsunder PMDP in J&K stand completed including proj-ects like Chenani-Nashri Tunnel, Batote- Kishtwar-Sinthantop road, Jammu-Udhampur National Highwaystretch. The meeting was also briefed that the upgrada-tion work of MA Stadium is nearing its completion andthe stadium is likely to be thrown open for the gameswithin next few days.

Association, the Advisor stated that the powers of theregistration have been vested to the Revenue Officers inthe Union Territory of Jammu and Kashmir in line withthe practice in the rest of the country, under the CentralRegistration Act, 1908.

“It is also a step towards having a ‘UniformRegistration System’ in the country and for integratingit with the Digitization of the Land Records and theRegistration of the transactions pertaining to the landand other immovable property in the country, he main-tained.

Jammu Bar Association projected its demands seek-ing that the office premises of Sub-Registrars of JammuCity should be clubbed and located at a place nearer tothe High Court Complex for the convenience of theLawyers, who have to attend the normal courts and getthe registration done at the respective Sub-RegistrarOffices as well.

The representatives of the Lawyers said that theseSub-Registrar offices should be located in the premisesof JDA Complex, where court of the Special Tribunal isfunctioning, and is nearer to the High Court Complex.

The Bar members also demanded that circularinstructions of the High Court, issued in the past, whenthe powers of IG Registration were vested in it, provid-ing that drafting and vetting of deeds shall be done byqualified and licensed Lawyers, be continued.

Responding to the demands, Advisor Sharmaassured that every effort will be made to provide a suit-able building for registration offices near High CourtComplex and District Courts for the convenience of thegeneral public as well as Lawyers community.

Sharma said that the building would be consideredfor housing the offices of Sub-Registrars of Jammu city,if sufficient accommodation is found available there.

About the demand of drafting and vetting, theAdvisor said it will remain with the Lawyers as is thepractice across the country. “Whenever anyone has toget any legal document like registration of sale deed ofimmovable property, will deed, partnership deed, orregistration of any testamentary and non-testamentarydocuments done under the Registration Act, these willalways go to the qualified and licensed Lawyers andthat he does not see that their role has diminished” headded.

The FC Revenue, while speaking on the occasion,said that the government has created a full-fledgedDepartment of Registration comprising of 77 Sub-Registrars and 20 Registrars and their supporting staffinvolving creation of around 466 posts for the conven-ience of the general public and that of the Lawyer com-munity, who render valuable services in the registrationprocess. He further said that the Government has decid-ed to appoint 26 full-time Sub-Registrars, 4 each inJammu/Srinagar city and one each at the Districts of the

remaining 18 District Headquarters.The FC further emphasized that Lawyers’ communi-

ty has a very important role in ensuring correct andproper registration of various deeds. He assured theLawyers that they shall continue to play role in the reg-istration process as they were doing earlier.

He, however, allayed the apprehension of theLawyers that their practice would be affected with theintroduction of new system.

The FC said that no such copy of Circular instruc-tions has yet been provided to the Government by theBar Association, which may be provided and that itshall be duly considered by the Government in light ofthe provisions and norms of the Registration Act.

The Advisor appealed the members of Jammu BarAssociation to call off their strike in the interest of peo-ple, who are suffering due to the strike. He assured thatthe government shall make sincere efforts to addresstheir genuine concerns and hoped that the Bar wouldcall off strike and trust the government for implemen-tation of the assurances and move forward on the issueto ensure transparent, efficient and modern registrationsystem in the UT of J&K in which the lawyers will haveto play a significant and important role.

DB dismiss...houses, shops etc."A Division Bench of Jammu & Kashmir High Court

Jammu Wing Comprising Chief Justice Gita Mittal andJustice Rajesh Bindal did not find any merit in the peiti-ton and dismissed the same.

While dismissing the application, DB observed thatconduct of the applicants needs to be deprecated. It isnothing else but forum shopping or bench hunting. Iftheir conduct is seen and what transpired during courseof the hearing of the earlier CM No.4961/2019, earlierwrit petition WP(C) No.2834/2019 and subsequentlyduring the course of hearing of the present application,it is seen that though applications and the writ petitionsare filed by selective persons, who are some of the resi-dents, however, most of the residents of the area arepresent in person in Court.

21. Noticing the facts further, it is evident that CMNo. 4961/2019 was filed by 26 residents of the areapraying that either they be allowed to be impleaded asparty respondents in the public interest litigation orthey may be allowed to intervene to safeguard theirinterest. When the applicants were not able to persuadethe Court to pass any order in their application, writpetition bearing WP(C) No. 2834/2019 came to be filedduring pendency of the aforesaid application. Theaforesaid writ petition was filed by 14 residents, out ofwhich two parties were common. The writ petition wasfiled with the prayer that notice issued directing thepetitioners to vacate the land in their possession be setaside and direction be issued to the official respondentsto rehabilitate the petitioners therein by providing themplots. It was nothing else but bench hunting.

DB further observed that the PIL No. 35/2018was listed before the Division Bench whereas the afore-said writ petition was to be listed before the SingleBench, as per roster. When the matter was listed beforethe Single Bench on July 30, 2019, the following orderwas passed "The issue with regard to the extension ofJammu Airport is a subject matter, which is pendingbefore the Division Bench of this Court in PIL No.35/2018. Therefore, it will be appropriate to list thismatter alognwith the aforesaid PIL. Registry is directedto do the needful.'" Thereafter, the aforesaid writ peti-tion was also taken up alongwith PIL No. 35/2018.During the pendency of the aforesaid writ petition, interms of the offer made by the administration, plotswere allotted to all the outstees in the draw of lots heldin their presence. They were handed over possessionthereof. They had undertaken to handover vacant phys-ical possession of the area to the authorities concernedon or before 20.11.2019. At the time of passing of theaforesaid order on September 20, 2019, CM No.4961/2019 filed by some of the residents was also dis-posed of. Thereafter, two writ petitions bearing WP(C)Nos. 4201/2019 and 4202/2019 came to be filed. Thesewere listed before the Single Bench (Rajesh Bindal-J) on18.11.2019. Some of the petitioners, who appeared inperson, when were not able to convince the Court toissue notice or grant any interim relief, sought adjourn-ment on the ground that their counsel was not avail-able. The writ petitions were adjourned to 30.12.2019.

DB further observed that when the residents ofthe area were not able to get any relief in the aforesaidtwo writ petitions, which were listed before the Singlebench, the present application has been filed by theapplicants who are already before this Court as peti-tioners in WP(C) No. 4201/2019. The prayer made inthe application is substantially the same as was made inthe writ petition. It was stated in para 16 of applicationthat with the same very prayer WP(C) Nos. 4201/2019& 4202/2019 has already been filed which was listedbefore the Single Bench presided over by one of us(Rajesh Bindal-J) on 18.11.2019, however, due suspen-sion of work by the members of the Bar, the petitionersappeared in person, however, interim stay was notgranted to them and the writ petitions were adjournedto December 30, 2019. . The fact remains that thesame very counsel, who had filed the writ petitions andmentioned the reason of his non-appearance on the datewhen the writ petitions were taken up, as suspension ofwork by members of the Bar, appeared before theDivision Bench on November 20 & 21, 2019 when theresolution of the Bar was still in force. Strikes by theadvocates has been strongly deprecated by the SupremeCourt of India time and again. The idea of filing presentapplication in the petition which was filed in publicinterest was merely to somehow or the other to get aninterim order from the Court. This aspect of the mattercould be immediately noticed only as one of us (RajeshBindal-J) was also presiding over the Single Benchbefore whom the writ petitions were listed and happensto be a member of the Division Bench as well. The ideaof filing the present application is nothing else but aneffort of bench hunting.

DB further observed that as far as the merits of theapplication is concerned, what the applicants haveprayed for in the application filed is a substantive reliefinvoking the provisions of Section 24(2) of the 2013 Actpraying that the acquisition of the land owned by themhas lapsed. It is not a writ petition filed by the appli-cants. Rather the main writ petition has been filed inpublic interest where infrastructure facilities for the air-port at Jammu are sought to be upgraded. In fact, for thesame relief the applicants have filed writ petitions asnoticed above, which are still pending. Such an applica-tion filed in the public interest litigation is totally mis-conceived, hence deserves to be dismissed. DB furtherobserved that the contention raised by the learnedcounsel for the applicants on the merit of the controver-sy is also prima facie misconceived, though we are notrecording any final opinion on the issue. Section 24(2) ofthe 2013 Act only talks about acquisition under theLand Acquisition Act, 1894 and not the State LandAcquisition Act, Svt. 1990. The contention of the coun-sel for the applicants to rewrite the legislation byParliament may be misconceived and dismissed thesame.

168-hr-long AJKPC...block-level protests across Jammu and Kashmir

from December 20 to December 30.On the last day of hunger strike, the Director Rural

Development Department (RDD) Jammu, SudershanKumar visited the site of hunger strike and listened tothe various demands of AJKPC members.

During the interaction, the Director said that it wasbeyond his competence to fulfill all major demandsbeing raised by the AJKPC and he would take up thematter with higher authorities. Agitated over the help-lessness expressed by the Director RDD, the protestingSarpanches marched towards the busy Tawi bridge toblock the traffic.

The Sarpanches had a scuffle with the large contin-gent of police personnel who tried to stop them frommarching towards Tawi bridge. In the process, thepolice personnel detained over 300 Sarpanches andshifted them to District Police Lines (DPL). Later, theywere released from the police custody on surety bonds.

Earlier, senior Sarpanches from various parts of J&Koffered juice to the Panchayat members, includingAJKPC president Anil Sharma and Jitender Singh, toend their 168-hour-long hunger strike.

While addressing the protesting Sarpanches, Sharmaaccused the Union government of only paying lip serv-ice to Panchayat members without bothering about realissues confronting them.

He said that J&K administration and the Union gov-ernment have no concerns for rural masses as theyfailed to clear Rs 1,000-crore MGNREGA liabilitiesdespite repeated requests. He demanded that theCentre should immediately clear all liabilities underMGNREGA scheme and fulfill other genuine demandsof Sarpanches and Panches in J&K without any delay.

He also demanded adequate security cover toPanchayat leaders and enhancement of their monthlyhonorarium to a respectable and reasonable amount.

The AJKPC senior leader while announcing the sec-ond phase of agitation and said, “the Sarpanches andPanches would hold block level protests fromDecember 20 to December 30 to bring J&K administra-tion and the Central government out of deep slumber.Our Sarpanches and Panches would submit memoran-dums to their respective Deputy Commissioners fromJanuary 2 to January 12, 2020”.“Even if the governmentfails to resolve the genuine issues of rural masses andelected Panchayat members, we will gherao the CivilSecretariat in the month of March. Our struggle willcontinue till rural masses and Panchayat members getjustice,” the AJKPC leader said.

SMS services werestopped as a “precautionary measure” on October14, a few hours after postpaid mobile phone connec-tions were restored in the Valley. Mobile connec-tions were suspended on August 5 after the Centreabrogated Article 370 and bifurcated the state intotwo union territories.

While scrutiny, it was found that the consign-ments were being dispatched from authorised deal-ers to the traders based in J&K under proper invoic-es.

The Supreme Courtwill Tuesday begin hear-ing on a bunch of petitionschallenging the constitu-tional validity of the revo-cation of the provisions ofArticle 370. The Articlegranted special status tothe erstwhile state ofJammu and Kashmir.

A five-judge benchheaded by Justice N.V.Ramana and comprisingJustices S K Kaul, R.Subhash Reddy, B.R.Gavai and Surya Kant willbegin the hearing on theplea filed by NationalConference, Sajjad Lone-led J&K PeoplesConference and CPI (M)leader Mohd YousufTarigami.

In November, the courtsaid it would hear all theissues of all parties con-cerned at length, and

refused to pass any inter-im order. On Monday,Justice Ramana asked theSolicitor General TusharMehta and senior advo-cate Raju Ramachandranto come prepared on theissues.

The court asked for acommon compilation tostreamline the process ofhearing.

Earlier, the apex courthad put restrictions onfresh plea challenging therevocation of Article 370,

and also said it wouldhear only two pleas,which have raised impor-tant issues.

Besides, these two peti-tions, other petitions arealso pending before thecourt. A plea was filed byShah Faesal, bureaucrat-turned-politician, alongwith Shehla Rashid, andthere was another pleafiled by a group of formerbureaucrats and defenceofficers challenging theCentre's decision.

The provisions ofArticle 370 that grantedspecial status to the erst-while state were abrogat-ed on August 5. Theregion was bifurcated intotwo Union Territories,slicing Ladakh out as aseparate UT.

The entire mainstreamand the separatist leader-ship of J&K was putbehind bars hours afterthe Centre abolished thespecial status and blockedall the communicationchannels that connectedthe region with the outerworld.

The administrationhas, however, released ahandful of leaders afterthey agreed to sign bonds,stating they would notspeak on matters relatedto the nullification ofArticle 370 or hold anyprotests against its revoca-tion.

Supreme Court To Hear Petitions Against WithdrawalOf Jammu And Kashmir's Special Status

NEW DELHI, DEC 10:An amount of Rs 4,800crore has been approvedfor 4.5 lakh employees oferstwhile Jammu andKashmir for certainallowances under the 7thPay Commission, LokSabha was informedtoday.

In a written reply,Minister of State forHome G Kishan Reddysaid the Centre has beenfully committed to theoverall development ofthe erstwhile state whichincludes giving certain7th Pay Commissionallowances like ChildrenEducation Allowance,Hostel Allowance,Transport Allowance,LTC, Fixed MedicalAllowance to theemployees.

These employees werenot getting theseallowances earlier.

The Centre has nowapproved an estimated

cost of Rs 4,800 crore, forall such employees, whoare now working inJammu and Kashmir,and Ladakh, sinceOctober 31, the day thesetwo UTs came into exis-tence.

Reddy also stated thatafter the creation of thetwo UTs, a total of Rs14,559.25 crore as the bal-ance share of 14thFinance Commissiongrants, share of taxes thatwere being given to theerstwhile state of Jammuand Kashmir has beenapportioned among the

two new UTs.Out of this, Rs 2,977.31

crore has already beenreleased to Jammu andKashmir and Rs 1,275.99crore has already beenreleased to Ladakh tilldate.

On account of Article35A and other constitu-tional ambiguities, thepeople of these regionswere denied full rightsenshrined in theConstitution and otherbenefits of various cen-tral laws that were beingenjoyed by other citizensin the country.

J&K High Court quashes detention of 2 people under PSA

SRINAGAR, DEC 10: The Jammu and Kashmir HighCourt has quashed the detention of two people underthe controversial Public Safety Act (PSA), officials saidon Tuesday. Justice Ali Mohammad Magray passedorders, quashing the detention under the PSA ofMohammad Ashraf Ganaie of Sopore and ImtiyazPahloo of Srinagar, on Monday, the officials said.While Ganaie was detained under the PSA for hisalleged involvement in timber smuggling, Pahloo wasdetained under the controversial law for his allegedinvolvement in stone-pelting incidents, they said. ThePSA was enacted by the government headed byNational Conference founder Sheikh MohammadAbdullah in 1978 as a deterrent to curb felling of greentrees in the forests of Jammu and Kashmir but the lawwas later used to detain separatist leaders and theirsympathisers following the onset of militancy in thestate in 1990. Three-time chief minister FarooqAbdullah, son of the National Conference founder,was detained under the PSA by the administration fol-lowing the abrogation of Article 370 provisions.

Tuesday said its future course of action would be taken only

after party patron and MP Farooq Abdullah and party vice

president Omar Abdullah were released by the Jammu and

Kashmir administration. The Abdullahs, along with a host of

other political leaders, have been detained since August 5

when the central government announced its decisions to

abrogate Jammu and Kashmir''s special status under Article

370 of the Constitution and divide the state into two union

territories. In a brief statement, the party said no leader has

been authorised to speak on its behalf. "The National

Conference has not authorised any individual leader to speak

on behalf of the party. The leaders giving statements are

doing so only in their individual capacity. As the party has

said earlier, the NC will discuss the road ahead once all party

leaders under detention are released, including president

Farooq Abdullah and vice president Omar Abdullah," it said.

The statement came after media reports quoted NC leader

Mustafa Kamal saying that the party would not take part in

any political process until the statehood and Article 370

were restored in Jammu and Kashmir. Farooq Abdullah, a

former chief minister, has been detained at his house under

the stringent Public Safety Act from September 17 after

remaining under preventive custody from August 5. His son

Omar Abdullah, also a former chief minister, has been under

preventive custody at a government house since August 5.
