SECTION 5 ITESTITICTIONS ON USE:

The tennis courts are for tennis only. No Skateboards. Bicycles. Roller Blades or anyother recreational devices shall be allowed. Persons found violating this section ol thisOrdinance will be subject to a fine not to exceed $100 or by imprisonment in the CountyJail for not more than tive (5) days or by both such fine and imprisonment. Persons inviolation of this section more than once shall be subject to double fines andimprisonment. Anyone wishing to give lessons on the courts must receive authorizationfrom the city and pay. in advance, a $5.00, (five dollar) fee per individual lesson.

SECTION 6 BALL MACHINE:

In the event that The City of Donnelly purchases a tennis ball machine, it shall be usedfor free by individual members of the Donnelly Tennis Club and if the machine is used

for lessons, the machine will be rented liom the City of Donnelly at a rale of $5.00 perlesson. In the event that a non-member rents the machine, it shall be rented at a rate of$5.00 per hour.

SECTION 7. EFFECTIVE I)AI'E:

This Ordinance shall be in full force and effective from and after the 16fi auy ofAugust 2008

AN ORDINANCE OF THE CITY OF DONNELLY, IDAIIO, ESTABLISHINGREQUIREMENTS TOR A BUSINESS LICENSE TO PROVIDE PERSONNEL CHARGEDWITH THE RESPONSIBILITY OF PROTECTING THE HEALTH AND SAFETY OF THEPUBLIC AND THE ENVIRONMENT WITH INFORMATION RELATING TO BUSINESSOPERATIONS WITHIN THE CITY THAT WILL AID THEM IN PROVIDING POLICE,FIRE AND ENVIRONMENTAL PROTECTION AS WELL AS INFORMATIONREGARDING CONTACT PERSONS IN THE EVENT OF AN EMERGENCY. IT IS THEFURTHER PURPOSE OF THIS ORDINANCE TO PROVIDE THE CITY WITHINFORMATION REGARDING THE TYPES OF BUSINESSES OPERATING WITHIN THECOMMUNITY IN ORDER TO FACILITATE RECRUITMENT AND RETENTION OFBUSINESSES AND TO FURTHER THE ECONOMIC DEVELOPMENT OF THECOMMUNITY.

Section l:

A. APPLICABILITY:

The provisions of this chapter shall be applicable to all wholesale and retail businessesand all activities, occupational callings, trades, pursuits or professionsthat conduct business from a location within the City ofDonnelly with the objectof gain, profit, benefit or advantage. Each business location shall be deemed aseparate business unless it is a specific annex to the main location ofthe business.The license is not intended to repeal any license or fianchise provisions ofanyother Ordinance of the City of Donnelly, nor is the license to be considered awaiver ofany other requirements of compliance with any federal, state and locallaws.

B. LICENSEREQUIRED:

No person shall engage in any business within the City of Donnelly for whichlicensing is required by this Ordinance, without having submitted a licenseapplication to the City Clerk and receiving a general business license inaccordance with the provisions ofthis Ordinance. This license shall be in additionto any other license required by other sections of this Ordinance. Such licenseshall be valid for one calendar year so long as the ownership, management, natureofthe business or location ofthe business remains unchanged.

C. EXEMPTIONS:

I . The fee provisions of this chapter shall not apply to:

a. Persons qualirying as a nonprofit business, including charitableactivities, within the meaning of Section 501 (CX3) of the United States IntemalRevenue Code. Possession ofa certificate ofsuch status from the Intemal RevenueService shall be required to qualifu for this exemption.

b. Any agency ofthe United States govemment and any politicalsubdivision ofthe State of Idaho.

c. Persons who occupy space at a flea market, but shall apply to theofthe flea market.

2. In addition, both the fee and license provisions ofthis chapter shall not applyto:

a. Persons who make occasional sales oftheir own household propertynot more than twice each calendar year;

b. Domestic servants, newspaper carriers or casual labor not included as

temporary employees ofa regularly conducted business;

c. Lessor's ofany residential property having one (l) or two (2) familyunits.

D. LICENSEAPPLICATION:

A general license application shall be provided by the City Clerk and the application shall containinformation including, but not limited to, the name, residence address and residence phone number ofthe owner and manager ofthe business, the street and mailing address ofthe place ofbusiness, thebusiness phone number, and the nature of the business to be conducted at such address and any otherinformation deemed necessary by the City for the health and safety ofemergency service personnel orutility service providers. Every application shall be personally signed by the owner or his agent.

E. LICENSE FEE:

F. DISPLAYOFLICENSE:

Every business required under this Chapter to obtain a general business license shall display suchlicense in a prominent location upon the business premises. No business shall loan, sell, give or assignto any other person or allow any other person to use or display, or to destroy, damage or remove, or tohave in his possession any license which has been issued to said business.

A license fee in an amount set by resolution ofthe City Council has to be paid at the time theapplication is submitted to the City Clerk and prior to the issuance ofa general business license. AlsoCity services will not be tumed on until the licensing is complete.

G CHANGE OF OWNERSHIP, MANAGEMENT, NATURE OF BUSINESS ORLOCATION OF BUSINESS:

1. Whenever the ownership, nature of the business or location of any business within the

City is changed, a new license application reflecting the change shall be presented to the

City Clerk within ten (10) days of said change. The date ofthe issuance ofthe new licenseshall be the new anniversary date for license renewal.

2. Whenever the management of the business changes, the City Clerk shall be

notified in writing of the name ofthe new manager, residence ad&ess and

residence phone number ofthe new manager.

H. COMPLIANCE WITH LAWS:

Licensees shall comply with all applicable federal, state and local laws and regulations.

l. A general business license may be denied, suspended or revoked for failure of theapplicant to comply with the provisions of this Chapter.

I. SUSPENSION OR REVOCATION OF LICENSE:

ln the event it is brought to the attention ofthe City Council that a violation has taken place, beforerevoking or suspending such license, the City Council shall cause notice to be served upon thelicensee, setting forth in general terms of the violation or violations claimed to have been committedand such notice shall provide a time for the licensee to respond to the allegations. The City Councilmay revoke or suspend the license if the City Council finds that the license was issued in enor or thatlicensee has violated the provisions of this Chapter and no refund ofany unused portion of the licensefee shall be made to the licensee.

J. APPEAL:

Any applicant who has made application for a license under the provisions of this chapter and who hasbeen denied such a license, or any person holding a license which is revoked or suspended under theprovisions of this chapter, may request a hearing before the City Council.

Section 2: SEVERABILITY.

The Ordinance is hereby declared to be severable. Should any portion of this Ordinance be declaredinvalid by a court of competent jurisdiction, the remaining provisions shall continue in full force andeffect and shall be read to carry out the purpose(s) of the Ordinance before the declaration of partialinvalidity.

Section 3: REPEAL OF CONFLICTING PROVISIONS.

All provisions of the cgnent Donnelly Municipal Code or Ordinances of the City of Donnelly which

conilict with the provisions of this Ordinance are hereby repealed to the extent ofsuch conflict.

Section 4: EFFECTIVE DATE.

This Ordinance shall be effective upon passage and publication as provided by law'

Enacted by the city council as an ordinance of the city of Donnelly on the 1Oth day ofMarch,2008.

PLEASE TAKE NOTICE that the City of Donnelly hereby publishes rhissummary of Ordinance No.193, amending the City of Donnelly Zoning Ordinance to addan Article XVI regulating subdivisions entitled: AN ORDINANCE AMENDING THEDONNELLY CITY ZONING ORDINANCE NO. 171 TO CREATE A NEW ARTICLEXVI REGULATING SUBDIVISIONS; AND TO PROVIDE AN EFFECTIVE DATE.

The purpose of this Atticle is to provide regulations, development standards,required improvements, and procedures for the subdivision ofproperty, includingplatting, re-platting, and recordation ofsubdivision plats within the City of Dorurelly andfor input on projects in the City's Area of Impact. The ordinance amends the City ofDonnelly Zoning Ordinance No. 171 to add a new ARTICLE XVI regulatingSubdivisions. The new ordinance provides the following sections:

For the purpose of this Article, the following terms, phrases, s'ords' and their

delvatlons shall have the meaning given herein' When not inconsistent with the

context, words used in the present tense include the future, words in the plural

number hclude the singular number, and words in the singular number include the

plural number.

Administrator. The City Council shall designate the City Engineer' Planning and

Zoniag Adninistrator, or other qualified person to administ'er the regulations of this

Ordinance.

Alley. A minor way which is used primarily for vehicular serwice access to the back

or side of properties otherwise abutting a street'

Bike Path. A hard surfaced path which has been created for non-motorized

transportation and is usually physically separate from automobile travel lanes'

City. The City of DomellY, Idaho.

City Street Standards. Those standards set forth in the City of Donnelly Master

Transportation Plan. Prior to adoption of this plan, all proposed road and street

design shall be approved by the City Engineer.

Community Housing. Residential units that are occupied by local employees' local

retirees, a-nd other long term community residents as their primary home' that is

affortlable for low to moderate income households and have restrictions that willpreserve their affordability into the future through deed restrictions'

Contlominiun. A.n estate consistiug of an undivided interest in common in real

property, together with a separate interest in real property, or any combination

thereof.

16.2.10 Double Frontage Lot. A Iot other than a corner lot having frontage on two (2) parallel

16.2.11 Driveway. A non-dedicated, vehicular access constructed on private property

providing access to not more than five residential dwelling units'

16.2.12 Finat Plat. The final map, drawing, and related docr:ments by which the subdivision

is presented to the city for approval, and which, if approved, will be submitted to the

County Recorder for recording.

16.2.13 Gateil Commulity. Residential community served by private streets with restrictedaccess by means ofa gate or aly other means ofaccess control'

16.2.14 Infrastructure. The facilities, properties, supports, and utilities which provide

services.

16.2.15 Lot Line Atljustment, A change or motlification of easement lines or boundary lines

between existing lots, parcels ofland, or properties, which does not reduce the area,

frontage, width, depth, or building set-back lines of each lot, parcel ofland, orproperty below the minimum zoning requirements and which does not create

additional lots or new streets.

16.2.16 Lot Split. A oue time division of a]l original parcel futo not nore tha.n two (2) lots.

Such a split shall not reduce the area, frontage, width, depth, or building set-back

lines of each lot, below the minimum zonilg requirements and shall not create any

new streets. Ifan original parcel has already had been divided, subsequent divisions

16.2.17 Master plan. A comprehensive plan, prepared by the City, which indicates the

generaliocations recommended for the various functional classes of public works,

f,laces a-nd structures and for the general physical development of the City and any-amendment

to such plan or part of such plan separately adopted and any amendment

to such plan or pat thereof. In the absence of any formally adopted plan, the general

policy ofthe City on the matter in question will govern'

16.2.18 Original Parcel or Irct. Any lot or parcel, held in single ownership, which was created

prior to JanuarY 1, 1985.

16.2.19 Owner. A-ny inilividual, firm. Association, syndicate, co-partnership, corporation'

16.2.28 Street: Col]ector or Secondary. A street which carries traffic from loca] or milorstreets and which serves for the circulation of tra.ffic il residential areas or

develoPments.

16.2.29 Street: Cul-de-sac or Dead-end. A street with only one outlet'

16.2.30 street: Loca] or Minor. A street used primarily for access to the abutting properties.

16.2.31 Street: Private. A street which provides vehicular and pedestriaa access to more

than five tlwelling units, or within a non-residential development, but is not accepted

for a dedication or maintenance by the City.

16.2.32 subdivider or Developer. Any individual, firm, association, syndicate, corporation,

trust of other legal entity commencing proceeding under this Title to effect a

subdivision of land hereunder for himself or for another.

16.2.33 subdivision. Any division of land or real property into two (2) or more parts, or a

modification ofbouldaries of a parcel of land that includes a new street'

16.2.34 Townlouse Development. A plalled residential project of two or more townhouse

ulits, which may be constructed as single building{s) containing two or more

townhouse units. Each unit within the development shall be separated from theatljoiaing u.nit or units by fire walls as required by the current building code in effect

at the time of constructioD. Each unit shall have its own access to the outside, and

no unit located over another unit in part or in whole. AII townhouse developmentsshall be platted under the procedures contained herein

16.2.35 Townhouse SubJot. The lot resulting fiom platting a residential townhousedevelopment, Townhouse sub-lots shall have a minimum area equal to that of theperimeter of each individual townhouse unit and an additional area three (3) feet inwidth to any access opening, measured at the foundation. Any detached accessorystructures shall be contained within the perimeter ofthe town house sub-lot exceptas otherwise permitted herein.

16.4.2 Approval ofthe Preliminary Plat

a. Preliminary plat approval shall require a public hearing and the proceedings shallbe conducted pursua:rt to Article 14 of this Ordinance. . The Administrator shallalso tra-nsmit copies to the water and sewer district having jurisdiction, and theDonnelly Rural Fire Protection District, as well as any other agency that mayhave an interest i.n the property being divided.

b. Prior to scheduling of a public hearing, all changes required by the Administratorshall be completed on the preliminary ptat.

c. Letters fiom each public agency haviag jurisdiction shall be received prior toscheduling of a public hearing.

d. One (1) copy ofthe approved preliminary plat shall be retained at the DonnellyCity Hall for public inspection and one (1) copy ofthe approved plat shall bereturned to the applicant, along with a written statenent of any changes ormodifications imposed by the Commission or Cou:lcil.

16.4.3 Final Plat

a. The final plat must be submitted to the city for council approval within one (1)calendar year from the date of Council approval ofthe preliminary plat, ,nlessthe Council approves a-n extension of tine.

b. The applicant must request an extension within one ( 1) calendar year fiom thedate of Council approval of the preliminary plat. Ihe request must be in writingand accompanied by a fee established by Council Resolution.

c. The Administrator sharr review the fi,,ar prat apprication to ensure that theapplication submitted is consistent with the preliminary plat approved by thecity coulcil. The conditions inposed on the apprication Ly the bommiss-ion andCouncil must be either co'npleted or shown on pla-ns or the plat prior to placingthe filal plat on the Council agenda.

d. The Administrator shall traosmit three (3) copies of the final constructiondrawings to the Ci!y's Engineer for approval. TVo (2) copies of the constructiondrawings approved by the Engi:reer shall be retr:rned to the applicant stampedapproved, and one (1) copy stamped approved shall be kept at Donnelly City HalI.The Administrator shal arso tra-nsmit copies to the watei arnd sewer districthaving jurisdiction, and the Donnelly Rural Fire protection District, as well asany other agency that may have an interest in the property being divided.

16.4.4 Final Plat, ContentsFinal Plat application shall contain at least the following information:

1. Name address a.ud phone number of the developer.2 A proposed final plat prepared by a professionar engineer or surveyor licensed in

the state ofIdatro, which meets a minimum ofthe requirements ofr0-t30+ IdahoState Code, as may be amended.

3. Final construction drawings4. A.ny other iaformation deemed necessary by the Administrator, or Council5 Eight copies of the information, except the constructions drawings, ofwhich six(6) copies shall be submitted.6. A fee established by Cou_ncil R€solution.

16.4.5 Final Plat Approval

a. The city clerk shan place the finar plat on the couac agenda within 45 days ofreceipt of the completed application.

b. The council shall determine whether the finar plat compries with the approvedpreiiminary plat, together with the conditions or modifications ruq"""ted ut tt etime of preliminary plat approval.

16.5.1

Conbining Preliminary and Final Plats

An applicant may combine the preliminary and final plats if the following apply1. Ihere are no more thaa ten (10) lots in the proposed subdivision.2. The are no new street dedications

In lieu of actua-l construction, and with the consent ofthe City Council, the developermay prowide the City such security as may be acceptable to the City, in a form and inan amount equal to the cost ofthe engineering and improvements not previouslyinstalled by the developer, plus fifty percent (507o). Such security shall fully securea.ud guarantee completion ofthe required improvements within one (1) year from thedate said security is issued. If aly extension ofsaid one (1) year is granted by theCity, each additional year, or portion thereof, shall require an additional twentypercertt (\QVo) tobe added to the amount ofthe original security initially provided.

Improvements RequiredIt shall be a requirement ofthe developer to construct the minimum improvementsset forth herein, for the subdivision, to all City standards.

16.6 Permits

16.6.1 No building pernits shall be issued until the City's Engineer has verified, in writingtn the City Clerk, that the improvements required for the protection of health and theprovision of safety are completed, including: approved potable water system, anapproved wastewater system, adequate fire flows approved by the Donaelly RuralFire Protection District completed streets, utility services, and approved drailagesystem.

16.7.1 Water, sewer, and streets are required i-n all districts

16.7.2 Curbs, gutters, and sidewalks are required in all districts unless waived by theCouncil-

16.7.3 Ground cover a.nd./or la.ndscaping with adequate irrigation shall be proyided in allcorrrmon areas which are not used for parking.

16.7.4 Adequate drainage shall be provided for storm water, melt water, and shall beconsistent with the best management practices under State and Federal storm andmelt water regulatory programs. AIl drainage plans shall be approved by the CityEngineer, and meet the minimum of a 100 year storm event.

16.7.5 Alleys shall be provided in the Central Business District.

16.7.6 Street lights shall be provided at intersections with collector or arterial streets asdetermined by the Administrator. The homeowners association will be responsibiefor the maintena-nce and upkeep of street lights. Lighting will be irl accordance with

be included on the final Construction Drawings, and./or Final Plat-

16.5.2 A combination of preliminary and final plat approval shall require a public hearing.The proceedings shall be conducted pursua:rt to Article 14 of this Ordinance.

16.5.3 The applica-ut shall be required to pay both the preliminary a.nd final plat fees.

16.8 DevelopmentStandards

The configuration a-nd development of proposed subdivisions shall be subject to theprovisions fou-nd hereunder, and shall be subject to the development restrictions,guidelines and direction found within the Donnelly Comprehensive Plan, theapplicable zoning district regulations, and any other applicable Ordinance or policy ofthe City of Don-nelly.

16.8.1 Sbeets, Alleys, Driveways, Easements, Pathways, and Snow Storage

AII streets in the subdivision must be platted and meet the standards specified inthe City of Donnelly Master Transportation Plan and, where applicable, the"Staadard Approach Po1icies" adopted by the State of Idaho Diwision of Highwaysshall apply.

b. Streets shall be aligaed in such a na.nner to provide through a:rd efficient accessfrom ald to adjacent developments and properties and shall provide for theintegration ofthe proposed streets with the existing pattern.

The developer sha.Il provide storm sewers and./or drainage areas of adequate sizeand number to contain the runoff upon the property in conformance with thelatest applicable Federal, State and local regrrlatiotrs. The developer shallprovide copies of state permits for shallow injection wells (drywells). Drainageplans shall be reviewed and approved by the City's Engineer. The developershall provide a copy of the EPA's "NPDES General Permit for StormwaterDischarge from Construction Activit/ affecting more than one (1) acre.

Private streets shall meet the requirements of the City of DonnellyMaster Transportation Plan. Private streets shall not serve more than five, (b),single dwelling units, or equivalent..

g Driveways may provide access to not more than five, (5) single residentialdwelling units. No portion of the required fire lane width of any driveway may beutilized for parking. Driveways shall not be named.

h. Driveways loDger than 150 feet must have a turnaround area approved by theDonnelly Rural Fire Protection District. Fire lane signage must be provided as

approved by the Donnelly Rural Fire Protection District.

i. Driveways accessing more than one (1) residential dwelling unit shall be

maintained by an owner's association, or in accorda:rce with a plat note.

j. Required frre lanes, whether in private streets or driveways, shall comply withall regulations set forth in adopted fire codes.

k. Alleys shall be provided in all CBD developments.

l. Dead end alley shall not be allowed.

m. Where possible, infrastructure shall be located i-n a public street, except in theCBD contiguous with Highway 55, in which case it shall be located in a public

alley ifpossible.

n. Alleys shall have adequate drainage and shall be approved by the City'sEngineer, and City staff.

o. Easements shall be provided, where necessary, to provide access for emergency

services, utility maintenance, public access, private access, or any such purpose.

The width of such easements shaJl be approved by the City Engheer.

p. Saow storage areas shall be provided, and shall not be less tha-n twenty frvepercent (25Vo) of prarking, sidewalk, a-ud other circulation areas. If the subjectstorage area is not on the platted property, a recorded agreenent for a snowstorage area ofthe appropriate size shall be provided by the developer, subject toapproval by the City Engineer. At no time wiII snow storage be allowed into thetraffic area of any Fire Lane, Cul-de-sac, multiple residence driveway, or privatestreet.

16.8.2 Lots and Blocks

a. The length, width, and shape of blocks shall be determined with due regard toadequate building sites, suitable to the special needs ofthe t;rye of usecontemplated, the zoning requirements as to lot size and dimension, the need forconvenient access ald safe circulation, and the limitation ald opportunities oftopography.

b. AII lots shown on the subdivision plat shall conform to the minimum standardsfor lots in the District in which the subdivision is plamed.

Double fiontage lots shall be prohibited except where unusual topography, amore integrated street plan, or other conditions ma}e it undesirable to meet thisrequirement. Double frontage lots are those created by either public or privatestreets, but not by driveways or alleys. Subdivisions providing a platted commonspace oftwenty five (25) feet or more between any street right-of-way and anysingle row oflots shall not be considered to have double frontage lots. Thecommon space shall be laldscaped as approved by the Commission. Access shallbe allowed only on the lesser pubiic streets, meaning, ifa collector and a localstreet create a double frontage lot, the access location shall be required on the

b. No subdivision shall be approved which affects the ability of political subdivisions

of the state, including the school district, to deliver services withoutcompromising quality of service delivery to current residents or imposing

substa-utial atlditional costs upon current residents, unless the developer provides

forthemitigationoftheeffectsofsubtlivision.Suchmitigationmayinclude,butis not limited to the following:

16.8.4 Cuts, Fills and Grading

a. Proposed subdivisions shall be carefully planned to be compatible with naturaltopography, soil conditions, geology and hydrology ofthe site, as well as tominirni2s su{s, fills, alteration of topography, streams, drainage channels, and

disruption of soils or vegetation. AII development withil the floodplain areas

shall comply with the requirements of the Flood Hazard Overlay Districtregulations of this Ordinance (Article 6.10)

b. A preliminary soil report, floodway study, grouadwater study, and drainagecalculations prepared by a qualifi.ed engileer, may be required by theAdministrator, Commission aad./or the Couacil as part of the preliminary platapplication.

Areas within a subdivision which are not well suited for development because ofexistirrg soil conditions, steepness of slope, geology, or hydrology shall beallocated for open space for the benefrt of future property owners within thesubdivision.

f. Where existing soils and vegetation are disrupted by subdivision development,provision shall be made by the developer for re-vegetation of disrupted areas withperennial vegetation sulficient to stabfize the soil upon completion oftheconstruction, including temporary irrigation for a su.fficient period to establishthe vegetation. Uatil such time as said vegetation has been installed andestablished, the developer shall maintain a.nd protect all disturbed surfaces fromerosion-

g. FiIl for structures or roads shall be compacted to at least ninety five percent(95%) of maximum density as determined by the America.n Association StateHighway Transportation Officials (AASHTO) and American Society of Testingand Material (ASTM).

Cut and filI slopes shall be no steeper than two horizontal to one vertical, andthree horizontal to one vertica.l respectively, without soil analysis and design byan engineer licensed in the State of Idaho. Cut and fill slopes shall not bepermitted near natural or manmade slopes greater thal cited above without anengineered analysis. Mechanical stabilized slopes are allowed with writtenapproval of the City Engineer. Subsurface drainage shall be provided asnecessary for stability.

Shoulders and toes of cut a:rd fill slopes shall be set back from structures andproperty lines as necessary to accomnodate drainage features or draitragestructures.

16.9 Construction and Guaranty of Construction

16.9.1 Prior to the start ofany construction, it shall be required that a pre-constructionmeeting be conducted with the developer or his authorized representative/engineer,the contractor, the City's Eugineer associated agencies, and appropriate City staff.A-n approved set ofplaas shall be prowided to the developer a-nd contractor at suchmeeting.

16.9.2 Upon final approval, three sets of revised plans are required: two (2) sets ofrevisedplans shall be returned to the developer at the pre-construction conference with theCity Engineer's written approval thereon. One set ofsaid approved final plans shallbe retained on site at all times for inspection purposes and to note all field changesupon.

16.9.3 The developer shall guaraatee all improvements pursuant to this section for not lessthan one (1) year from the date offrnal acceptance by the City, except that parksshall be guaranteed and maintained by the developer for a period of two (2) years.

6. Any other information which may reasonably be required by theAdministrator, City's Engineer, Commission, and /or the Council

16.9.4 The developer shall construct all streets, alleys, drainage systems'-water and sewer

facilities, landscaping, fill, cuts and utilities in conformance with the approved plans'

16.9.5 Prior to the acceptance by the City of any improvenents installed by the developer'

two (2) sets of "as built pians and specifications" certified by the developer's engineer

shall be filed with the City's Engineer.

16.10 Lot Line Adjustments, Lot Splits

16.10.1 Applications for lot line a justments and lot splits shall be approved by the

Adninistrator, and shall contain the following idormation:

a. Name , address and phone number of the applicant

b. Two (2) copies ofa Record of Survey prepared by a professional engineer or

surveyor licensed in the State of ldaho.

c. A fee established by City Council Resolution

16.10.2 The Adrninistrator sha-ll review the application to determine whether the lo(s)conform(s) to the development standards of the applicable zone The administratorshall approve or deny the application based upon such review'

16.10.3 The Administrator shall notify the applica-nt, in writing, of the determination. one(1) copy of the plat shall be returned to the applicant. If the Administrator finds thatthe aiilication does not comply with this Ordina-nce, the Administrator shall also

inform the applicant of the reason for the non-complia-nce.

16.11Amended Plats

In the event a plat of a subdivision has been recorded and substantiai changes are

proposed which change the subilivision materially, or does not qualifu for a lot line

adlostment, the portion ofthe subdivision in which these changes are proposed must be

approved, and the prior plat vacated, il accordance with the regulations set forth inIiaho Code 50-1306a. Any change in street location will require an amended plat forthe portion of the plat that is affected. If the Administrator finds that the proposed

changes materially alter the nature and character ofthe subdivision, the amended platshall be subject to the subdivision process of 16.4

16.12 Street Vacations

16.12.1 Applications for vacation ofa public right-of-way, alley or easement shall complywith Idaho Code 50-311 and 50-1317 through 50-1325, as amended.

16.12.2 Street vacations shall require a public hearing and the proceedings shall be

conducted pursuant to Article 14 of this Ordinance.

16.12.3 The Commission and the Council shall consider the following items in making theirrecommendation a-nd decision:

The application and testimony of the applicant and such other informationbrought forth with regard to the proposed vacation.

AN ORDINANCE ESTABLISHING THE SALARIES OF THE MAYOR AND COUNCILMEMBERS OFTHE CITY OF DONNELLY, REPEALING CONFLICTING ORDINANCES AND PROVIDING ANEFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF DONNELLY, IDAHO:

SECTION I. MAYOR AND COUNCIL SALARIES.

Commencing January 1,2008, the salaries ofthe Mayor and ofthe members ofthe Donnelly City Council shall beas follows:

(a) The Mayor shall receive a monthly salary in the sum oftwo hundred dollars (5200.00); and

(b) Each member ofthe Council shall receive a monthly salary in the sum ofone hundred dollars ($100.00)

SECTION 2. REPEAL OF CONTLICTING PROVISIONS.

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR THEFISCAL YEAR BEGINNING OCTOBER 1,2007, APPROPRIATING THE SUM OF$I,973,793.00 TO DEFRAY THE EXPENSES AND LIABILITIES OF THE CITY OFDONNELLY FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAXUPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSESFOR WHICH SAID APPROPRIATION IS MADE.

BE lT ORDAINED by the Mayor and City Council of the City of Donnelly, Valley County,ldaho.

Section 1 : That the sum of $1 ,973,793.00 be, and same is appropriated to defray thenecessary expenses and liabilities of the City of Donnelly, Valley County, ldaho for thefiscal year beginning October 1,2007 and ending September 30, 2008.

Section 2: The objects and purposes for which such appropriation is made, and theamount of each object and purpose is as follows:

BE IT ORDAINED BY THE MAYOR AND CITY COLJNCIL OF THE CITY OFDONNELLY. IDAHO:

SECTION l. FNDINGS: Theci ty council ofthe city of Donnclly hereby finds that saidcity has a population not in excess often thousand (10,000) according to the most recentcensus and is a city that derives the major portion of its economic well being from peoplecatering to recreational needs and meeting needs ofpeople traveling to said destinationcity for an extended period of time; that said city has a significant economic dependenceupon visitors and travelers passing through or staying in the community and said city; andthat said visitors and travelers require services of said city which place an undue burdenupon the taxpayers of said city.

SECTION 2. DEFINITIONS: For the purposes olthis Ordinance, the following terms.phases, words and derivations shall have the meanings given herein:

(A)sleep

Occu C Rentaling accommodations

: Means and includes the rental or leasing oflodging and otherto members of the public for a fee of any hotel room, motel

room, condominium, vacation rental. home, room, recreational vehicle park (RV park)space, camping space or any other sleeping accommodations, except where a residence ismaintained continuously under terms of a lease or similar agreement for a period inexcess of thirty (30) days.

(B) Occupancy Rental Tax Charge: Means and includes the total sales price for therental use or temporary occupancy ofan Occupancy Rental.

(c) In the City of Donnelly means within the rnunicipal boundaries ofthe City ofDonnelly, Valley County, Idaho.

(E) Taxpaver: Means any person subject to or liable ibr any taxes imposed by thisOrdinance.

SECTION 3. IMPOSITION OF THREE PERCENT (3%) OCCUPANCY RENTALTAX:_The city of Donnelly hereby imposes and shall collect certain local option non-property taxes, as follows:

(A) An additional or new (depending on the nature ofthe Occupancy Rental provider)three percent (3%) occupancy tax on the Occupancy Rental Tax Charge from allOccupancy Rentalst and

(B) When the sales price involves a fraction ola dollar, said local option non propertytaxes shall be collected on that liactional po(ion ofthe price by adding thereto the taxbased upon a bracket system. The bracket system for the collection ofthe three percent(3%) occupancy tax shall be as set forth in exhibit A. attached to Ordinance 197 andmade a part hereof. The retailer shall calculate the tax upon the entire amount ofpurchases ofthe consumer made at a particular time subject to this Ordinance, and notseparately upon each item purchased. The retailer may retain any amount collected undersaid bracket system which is in excess of the amount of tar for which they are liable tothe city during the period as compensation lbr the work ofcollecting said tax.

(C) All monies collected and/or retained under the provisions of this Ordinance shallbe held in trust for the city of Donnelly and fbr payment thereolto the city clerk in themanner and at the times provided in this Ordinance.

SECTION 4. DURATION OF TAXES: The non-property taxes authorized and collectedunder this Ordinance are hereby imposed for a duration offive (5) years from theeffective date of this Ordinance.

SECTION 5. PURPOSES OF TAX REVENUES: The local option non-property taxrevenue derived from and collected under this Ordinance shall be used onlv for thefollowing purposes:

(A) New paving, parking, bike paths, public transit. and transportation:

(D) Person: The term "person" includes any individual, firm, co-partnership. jointventure, association, social club, fraternal organization. corporation, estate, trust, businesstrust, receiver, trustee, syndicale. cooperative. assignee, or any other group orcombination acting as a unit.

(B) Matching funds to leverage grant funding:

(C) Public Salityr

(D) Parks and land acquisition for new parks thcilities:

(E) City beautification including. but not limited to. open space acquisition. streetscapes.burial of overhead utility lines:

(F) Recreational and cultural activities and facilities including, but not limited to, library,community art and cultural events;

(G) Animal shelter support (MCPAWS)l

(H) Economic grow'th. marketing. advertising. promotion and development:

(l) A General Capital Improvement Fundl and

(J) Direct costs to collect and entbrce the tax.

SECTION 6. IIEARING AND REVIEW BY CITY COUNCIL:

(A) The city council shall have the responsibility to develop annual budgets and makespecific recommendations lor the use of the local option non-property tax revenuesderived from the taxes assessed pursuant to this Ordinance

(B) The City Council will annually host at least one public meeting prior to its annualbudget hearing for the upcoming tiscal year. At such meeting, the City Council shall hearall requests which have been made for the use ofthe non-property tax revenues.Following the public meeting. the City Council shall develop a proposed budget for theuse ofthe said revenues to be included in the overall Citv budget

SECTION 7. CITY CLERK TO ADMINISTER REGULATE AND COLLECTTAXES: The city clerk of the city of Donnelly is hereby authorized and empowered toadminister, regulate and collect payment of all non-prope(y taxes adopted and imposedby this Ordinance. Said clerk shall have all of the powers set forth in this Ordinancetogether with those additional powers necessary and proper to carry out the provisions ofthis Ordinance as provided under this Ordinance and Idaho law.

CREAI'ION OF PROPERTY TAX RELIEF AN D GENERAL CAPITAI,IMPROVEMENT FUNDS : Pursuant to ldaho Code section 50-1045 . there is herebvcreated in the office ofthe city clerk a lund to be designated as the ,,municipal propertytax relieffund." SECTION 9. PERMITS RE UIRED AND ISSUANCE OF PERMITS:

(A) Every person desiring to engage in or conduct the business ofOccupancy Rentalswithin this city shall fi[e with the city clerk an application lbr a city of Donnelly localoption non-property tax permit fbr each place ofbusiness. A separate permit is requiredfor each place ofbusiness uithin the city. Every application lor said permit shall be madeupon a form prescribed by the city clerk and shall set forth the name under which theapplicant transacts or intends to transact business, the location ofthe business or places ofbusinesses, and such other information as the city may require. The application shall besigned by the owner. if they are a natural person; or in the case ofan association orpartnership, by a member or partner; in the case of a corporation, by an executive officeror other person authorized by the corporation to sign the application.

(B) Upon filing an application meeting the requirements set out in subsection (A) of thissection, the city clerk shall issue to each applicant a permit for each place ofbusiness. Apermit shall not be assignable. and shall be valid only lbr the person in whose name it isissued and for the transaction ofbusiness at the place designated therein. It shall at alltimes be conspicuously displayed at the location for which it was issued. Issuance ofapermit may be subject to additional requirements as set forth in this Ordinance.

(C) On the face of the permit shall be affixed a municipal non-property tax number whichshall be used by the applicant as an identifying number on all filing, payment andcorrespondence with regard to the non-property tax imposed under this Ordinance.

SECTION 10. METHOD FOR PAYMENT OF TAXES:

(A) The taxes imposed by this Ordinance shall be computed and paid for each calendarmonth. Said taxes are due and payable to the city clerk on or before the twentieth day ofthe succeeding month. The amount oftax paid shall be computed on all sales subject tota\ation under this Ordinance. Each person required to hold a city of Donnelly localoption non-property tax permit and number shall file a city of Donnelly local option non-property tax return and a copy of their Idaho state sales tax retum for the month at thesame time said taxes are paid to the city clerk. unless said person has been permitted inwriting by the ldaho state tax commission to file quarterly sales or use tax relurns.Persons who have been permitted to file other than monthly retums shall notifu the cityclerk in writing and the city clerk thereupon may require reporting of state tax retumsover some other period. but shall require payment oftaxes on a monthly basis.

(B) The first payment ofta\es under this Ordinance shall be due and payable together onFebruary I 8, 2008, for that period beginning January I , 2008, and ending January 3 I,2008. Ihereafter all payments shall be made monthly.

(C) A city of Donnelly local option non-property tax retum shall be filed each and everymonth by every person engaging in sales subject to taxation under this Ordinanceregardless ofwhether or not any tax is due. Returns shall be signed by the person

required to file the return or by a duly authorized agent.

(D) A valid sales tax exemption certificate issued by the Idaho state t&\ commission uponfiling a copy thereof with the city clerk shall have the same effect to exempt the sale fromthe taxes imposed hereunder as in the Idaho sales tax act.

SECTION I1. AUDITS AND DEFICIENCY DETERMINATIONS:

(A) The city clerk may order an audit ofany taxpayer under this Ordinance for thepurpose of ascertaining the correctness or completeness of any return or payment.

(B) Ifany error or omission is discovered in such audits or in any other way, the cityclerk may compute and determine the amount oftax due upon the basis offacts obtainedfrom such information within its possession and assert a deficiency. One or moredeficiency determinations may be made for the amount due for one or for more than oneperiod. In making such a determination, the city clerk may offset overpayments against

arnounts due. Further, said determinations shall be made for the period or periods inrespect to which the person f'ails to make a retum and shall be based upon anyinformation which is in the city clerk's possession.

(C) The city clerk shall give written notice of its determination and the amount of itsdeficiency, including interest, at the rate of twelve percenr (12yo) per annum from thedate due, to the person from whom such deficiency amount is due. Such notice may begiven personally or mailed to the person at the address fumished to the city clerk in thenon-property tax permit application.

SECTION 12. REDETERMINATION OF DI]FICIENCY:

(A) Any person against whom a deficiency determination is made under this Ordinance,or any person directly interested, may petition in writing fbr a redetermination withinthirty (30) days after service upon the person ofnotice thereof. Ilthe petition forredetermination is not filed within the thirty (30) day period, the determination becomesfinal at the expiration of the period.

(B) If a petition for redetermination is filed within the thirty (30) day period. the cityclerk shall reconsider the determination and, ifthe person so requests in the petition.grant the person an oral hearing and give said person ten (10) days'notice of the time andplace of the hearing personally or by mail addressed to the person at the addressfumished to the city clerk in said person's application for a non-property tax permit.

INTEREST ON DEFICIENCY:SECTION 13: APPEALS

(A) When a redetermination is made, the city clerk shall give notice to the taxpayeragainst whom the redetermination is made. Within thirty (30) days of the date uponwhich such notics of redetermination is mailed or served, the ta,xpayer may file an appealwith the city council or may file a complaint with the district court fbr review of the cityclerk's redetermination. There shall be no right of review to the city council nor to thedistrict court on the determination oftaxes due made by the city clerk unless a

redetermination has been timely filed. No assessment ofa deficiency in respect to the taximposed by this Ordinance or proceeding to collect for its collection shall be made. begunor prosecuted until such notice has been mailed to the taxpayer and expiration ofsuchthirry (30) day period after notice ol redetermination. nor. if a protest is filed. until adecision on the protest becomes final. Ilthe taxpayer does not protest to the city councilor file an action in district court within the time prescribed in this section, the deficiencyshall be assessed and shall become due and payable upon notice and demand from thecity clerk.

(B) Interest upon any deficiency shall be assessed at the same time as the deficiency andshall become due and payable upon notice and demand liom the city clerk and shall becollected as part ofthe tax at the rate of twelve percent (12%) per anmrm from the dateprescribed fbr payment ofthe tax.

SECTION 14. COLLECTIONS AND ITNFORCEMENT: As soon as practical aftermonthly city of Donnelly local option non-property tax return and pa),rnent is filed, thecity clerk shall examine the same and determine the correct amount of the tax. For thepurpose ofascertaining the correctness ofany payment determining the amount oftaxdue u'here none has been made. determining liability ofany person for any tax payableunder this Ordinance, or the liability at law or in equity ofany person in respect to anytax provided by this Ordinance or collecting any such liability. the city clerk. or dulyauthorized deputy, is authorized: a) to examine the books, papers, records, or other datawhich may be relevant or material to the inquiryl b) to summon the person liable for thetax or any officer, agent or employee ofsuch person, or any person having possession,custody or care ofbooks ofaccounting containing entries relating to the business of theperson liable for the tar, to appear before the city clerk. or deputy, at a time and placenamed in its summons to produce such books, papers. records or other data and/or givesuch testimony under oath as may be relevant or material to such inquiry.

SECTION I5. REFL]NDS LIMITATIONS AND INTEREST:

(A) If the city clerk determines that any amount due under this Ordinance has been paidmore than once or has been erroneously or illegally collected or computed, the city clerkshall set forth that fact in its records and the excess amount paid or collected may becredited on any amount due or payable to the city clerk for non-property taxes fiom thatperson. and any balance refunded to the person by whom it was paid or to his successors.administrators or executors.

(B) No such credit or refund shall be allowed or made after one year from the time thepayment was made unless, before the expiration ofsuch period. a claim therefore is filedby the taxpayer.

(C) Interest shall be allowed on the amount of such credits or refunds at the rate of twelvepercent (12%) per annum from the date that such tax was paid.

(D) Appeal from the city clerk's decision denying in part or in whole a claim for refundshall be made in accordance with the laws of the state of Idaho with regard to claimsagainst municipalities.

SECTION I6. RESPONSIBILIIY FOR PA\'MENT OF TAXES:

Every person with a duty to account for or pay over any tax imposed by this Ordinanceon behalfofa corporation, as an oflicer employee ofthe corporation. or on behalf of apartnership, as a member employee ofthe partnership, shalI be personalIy liable lorpayment of such tar. plus penalties and inlerest.

(A) The amount oftares imposed under this Ordinance shall be assessed within three (3)years ofthe time the retum upon which the tax asserted to be due was or should havebeen frled. whichever is later; provided. however, if a deficiency determination orassessment has been made within the prescribed time, such tax may be collected within a

period of six (6) years after assessment. The running of limitations provided by thissection shall be suspended for the period during which the city clerk is prohibited frommaking the assessment or from collecting or proceeding in court due to a petition forredetermination or an appeal therefrom, and for thirty (30) days thereafter.

(B) In the case oftaxes due during the lifetime ofa decedent, the tax shall be assessed,and any proceeding in court without assessment for the collection ofsuch tax shall bebegun, within six (6) months after *ritten request therefore (filed after the retum is made)by the executor, administrator. or other fiduciary representing the estate ofsuch decedentunless the assessment is stayed by a petition for redetermination or any appeal therefrom.

(C) In the case of a false or fraudulent retum \!'ith intent to evade tax, or ofa lailure tofile a return, the tax may be assessed, or a proceeding in court for collection of such taxmay be begun without assessment. at any time within three (3) years after the date of thediscovery ofthe facts constituting the fraud.

SECTION 18. SUCCESSOR S'I,IABII,ITY:

(A) If a vendor liable for any amount oftax under this ordinance sells out his business orstocks and goods, the vendee shall make an inquiry to the city clerk and withhold liom

SECTION 17. PERIOD OF LIMITATION UPON ASSESSMENT ANDCOLLECTION:

the purchase price any amount oftax that may be due under this Ordinance until suchtime as the vendor produces receipt stating that no amount is due.

(B) lf the purchaser ofbusiness or stock of goods fails to withhold lrom the purchaseprice as above required, they are personally liable for the payment ofthe amount requiredto be withheld by them.

SECTION I9: GENERAL ADMINISTRATION BY CITY CLERK:

(A) The city clerk shall enforce the provisions olthis Ordinance and may prescribe, adoptand enforce rules and regulations relating to its administration and enforcement. The cityclerk may employ qualified auditors for examination of taxpayers' books and records, andshall also employ such accountants. investigators. assistanls. clerks. and other personnelas are necessary for the etficient administration of this Ordinance, and may delegateauthority to its representatives to conduct hearings. or perfbrm other duties imposed bythis Ordinance. Ifthe Taxpayer is found to be in violation of this Ordinance, costs of theaudit and administrative 1'ees are herby authorized and may be assessed by the City.

(B) Taxpayers in the city of Donnelly shall keep such records, receipts, invoices, andother pertinent papers as the city clerk may require. Each such taxpayer who files tarpayments required under this Ordinance shall keep all such records for not less than four(4) years after making such payments unless the city clerk in writing authorizes theirdestruction.

(C) The city clerk, or any person authorized in writing by the clerk, may examine thebooks, papers, records, and equipment ofany taxpayer or any person liable for any tax,and may investigate the character ofthe business ofthe person in order to verify theaccuracy ofany retum made, or if no retum is made by the person, to ascertain anddetermine the amount required to be paid. Any taxpayer rl.hose pertinent records are keptoutside of the city must bring the records to the city lor examination by the city clerkupon request ofthe latter, or by agreement with the city clerk permit an auditordesignated by the city clerk to visit the place where the records are kept, and there auditsuch records.

SECTION 20. PENALTIES:

(A) Any person who violates any provision of this Ordinance shalt be guilty ofamisdemeanor, punishable by up to one year in the countyjail. and./or one thousand dollar($ I ,000.00) fine. or both. Furthermore. each month in which a person fails to report, orintentionally fails to compute accurately, or intentionally fails to disclose accurately thetotal amount of sales or rentals or the amount oftax to be paid. as imposed under thisOrdinance, shall be considered a separate offense.

(B) Any person who violates any provision ofthis ordinance shall have his city ofDonnelly local option non-property tax permit and tax number revoked. The ciiv clerkshall send wriften notice of revocation of said permit and tax number to the pe;it holder

by mailing the same by certified mail to the address given on the permit application. Thepermit holder shall have ten (10) days from the date said notice is mailed to file a writtenrequest olappeal with the city counci[. challenging said revocation. If no appeal is timelymade, said revocation becomes final. Whenever a person subject to this Ordinance has

had said permit and tax number revoked. the city clerk shall not reissue said permit norissue a new permit to said person until said person places with the city clerk a bond orother sufficient security in the amount equal to thee (3) times the actual, determined, orestimated average monthly amount olta\ payable by such person pursuant to thisOrdinance.

(C) The city clerk. whenever it is deemed necessary to ensure compliance with thisOrdinance, may require any person subject to this Ordinance to place with it suchsecurity as it may determine. The amount of said security shall not be greater than three(3) times the estimated average monthly amount payable by such persons pursuant to thisOrdinance. The amount ofthe security may be increased or decreased by the city clerk at

any time, subject to the limitations set forth above.

(D) Any person who violates any provision of this Ordinance shall have all city ofDonnelly local option non-property tax permits revoked.

(E) Any amount oftax due under this Ordinance for which a person fails to report oraccurately compute shall become a lien upon the property of said taxpayer on the datethat the same becomes due. and the city may seek to enforce said lien and collect all taxesand interest due, together with the reasonable costs ofcollection, including attomey fees,

in a court of competent jurisdiction.

(F) For the purposes ofproper administration of this Ordinance, and to prevent evasion ofsaid local option non-property taxes, the burden ofproving that a rental is not a rentalunder this Ordinance is upon the person who makes the rental in question.

(A) Any person who is required to collect and pay over any tax imposed by thisOrdinance and fails or refuses to pay over to the city the same when due in accordancewith this Ordinance shall be liable and pay a penalty charge equal to five percent (5%) ofthe tax not paid, or a minimum ofthirty-five dollars ($35.00) (whichever is greater). Thecity clerk shall assess and collect said 1'ee at the time any delinquent tax payment istendered. The permit holder shall have ten (10) days from the date payment is made tofile a written appeal with the city council challenging said penalty determination. If noappeal is timely made as herein provided, said penalty detemtination shall be linal.

(B) Any person who is required to collect, truthfully account for, and pay over any taximposed by this Ordinance and who willfully lails to collect such a tax or truthfullyaccount for or pay over such a tax. or willfully attempts in any manner to evade or defeatsuch a tax or pafnent thereof, shall, in addition to other penalties provided by law, beliable to a penalty equal to the amount ofthe tax evaded, or not collected. or not

SECTION 2I. PENALTY CHARGES:

accounted for or paid over. The city clerk shall determine and assess such penalties, andthe same shall become due and payable upon notice and demand fiom the city clerk. Thecity clerk shall send written notice ofsuch penalty charge to the permit holder by mailingthe same by certified mail to the address given on the permit application. The permitholder shall have ten ( l0) days lrom the date said notice is mailed to file a written requestofappeal with the city council challenging said penalty charge determination. Ifnoappeal is timely made as herein provided. said penalty charge determination shall betlnal.

SECTION 22. EXEMPTIONS: Only those transactions which are exempted from thetaxes imposed by the state ofldaho pursuant to the sales tax act . as that act may beamended, are also exempt from the provisions ofthis Ordinance.

(A) No city clerk ofthe city of Donnelly, Valley County. Idaho. nor any duly authorizeddeputy city clerk. agent or employee shall dil'ulge or make known to any persons. in anymanner, any information whatsoever submitted or obtained, directly or indirectly,pursuant to this Ordinance, or to permit any non-property tax retum or informationsupplied with regard thereto, or any copy thereof, or any paper or book so obtained, to be

seen or examined by any person except as provided by law; provided, that in any actionor proceeding brought for the collection. remission, cancellation, or refund ofthe wholeor any part ofa tax imposed under this Ordinance, or for enforcing the penaltiesprescribed for making false or fraudulent retums, any and all information contained in orprovided with said retums may be made accessible to the elected and appointed officials,officers, and representatives ofsaid city charged with enforcing or defending the same,

all such retums, information, statements and correspondence relating thereto may beproduced into evidence in any action, civil or criminal. directly pertaining to such retumsor the tax imposed on the basis of such retums.

(B) The Donnelly city council, under such rules and provisions as it may prescribe, maypermit, notwithstanding the provisions of this Ordinance as to secrecy, the commission ofintemal revenue ofthe United States or its delegate or the proper officer olany stateimposing a tax to inspect the non-property tax retums or information provided orobtained in connection therewith. or may lurnish to such ol'ficer. or his authorized agent.copies or an abstract thereoL

(C) Nothing in this Ordinance shall prohibit a taxpayer. or authorized representative uponproper identification. lrom inspecting and copying his own non-property tax retums andinformation supplied therewith.

SECTION 24. COMBINED ADMINISTRATION : In the event that any other form of alocal option tax receives voter approval and becomes a city ordinance, the city counciland the city clerk are hereby authorized to combine administration and regulation ofnon-property taxes for efficiency purposes.

Further, that each monthoffailure to comply with, violate or evade the tax constitutes a separate offense.Furthermore that permits may be revoked for violation; security deposits may berequired; and that property tax liens may be imposed against the taxpayer.

Section 2l entitled " PENALTY CHARGES" provides for the imposition of penalties foruntimely payment or refusal to collect the taxes owed to the City. including a minimumpenalty of thirty-five dollars ($35).Section 22 entitled "EXEMPTIONS" provides that only those entities with qualifiedexemptions under the Idaho sales tax act are exempt from compliance with the DonnellyLOT tax and ordinanceSection 23 entitled "CONFIDENTIALITY OF INFORMATION" provides forconfidentiality oftaxpayer information; the availability to adopt rules and regulationsregarding the same and that taxpayer do have access to their own information.Section 24 entitled "COMBINED ADMINISTRATION" provides the City may combineadministration of the program and its duties with other LOT tax progrruns or collectionefforts.Section 25 entitled "SEVERABILITY" provides that if any provision ofthe ordinance isdeclared invalid; unenforceable or unconstitutional by a court with competentjurisdiction, such decision shall not affect the remaining portions of said section,subsection, paragraph, clause or phrase of this Ordinance.Section 26 entitled "REPEALER CLAUSE" provides lor the repeal ofany ordinances orresolutions (or parts thereo0 contrary to the new ordinance.Section 27 entitled "EFFECTIVE DATE" provides for an effective date ofJanuary l,2008, subject to sufficient voter approval and publication.Exhibit A which is a three percent (3%o) tax table based upon the bracket system.
