The conditional use of works and resources in the case of educational
resources available in an information commons is a distinctive
characteristic of the “Open Educational Resources” and could, probably,
best be served through the use of use of standard licenses, i.e. pre-
formatted licenses which are available for use ‘as-is’ such as the Creative
Commons licenses.1 These are the so called “standard electronic licences,
which can be adapted to meet particular licence applications” and have been
recommended for licensing of Public Sector works through the PSI
Directive as amended (see Directive 2013/37/EU; Directive 2003/98/EC;
Greek Law 3448/2006; Greek Law 4305/2014).2

The term “Open Educational Resources” which first came into use at a
conference hosted by UNESCO3 in 2002,4 is used to describe the open
provision of educational resources in the form of digitized materials, offered
freely and openly for educators, students, and self-learners to use and reuse
for teaching, learning, and research, which are accessible mainly through
ICTs and IP networks, either through digital libraries5 or not, and are
available for consultation, use and adaptation by a community of users for

movements stems from the organization’s statutory goals; according to article 1 clause 2 of
UNESCO’s constitution, the purposes and functions of the Organization includes the following: Maintain, increase and diffuse knowledge: By assuring the conservation and protection of the world’s inheritance of books, works of art and monuments of history and science, and recommending to the nations concerned the necessary international conventions; By encouraging
cooperation among the nations in all branches of intellectual activity, including the international exchange of persons active in the fields of education, science and culture and the exchange of publications, objects of artistic and scientific interest and other materials of information; By initiating methods of international cooperation calculated to give the people of all countries access to the printed and published materials produced by any of them. UNESCO has recognized that
among the organization’s objectives are the following: 1) Attaining quality education for all and lifelong learning; 2) Mobilizing science knowledge and policy for sustainable development; 3)
Addressing emerging social and ethical challenges; 4) Building inclusive knowledge societies
through information and communication. Thus, in the areas of its competence, UNESCO’s role
is to improve access to information and knowledge for the Member States through appropriate
use of information and communication technologies. Open access to scientific information and research is one of the many programs on which UNESCO works to increase access to

non-commercial purposes.6 By its statute UNESCO has been a fervent
supporter of Openness7 and has evolved as one of the major international
key-role players in the promotion of Openness, Open Access and Open
Educational Resources.8 UNESCO as well as other international leagues of
academic institutions such as The League of European Universities,9 the

European University Association10 and Science Europe11 among others
have all turned into Open Access policies and Open Educational Resources
as a means for the implementation of Openness in academic research and
libraries. Open Educational Resources implemented through open
technological platforms allow all individuals to learn, anywhere, anytime,
through any device, with the support of anyone.12 Thanks to Open
Educational Resources (OER), and namely MOOCs,13 teachers and
education institutions can reach thousands of learners from all five
continents simultaneously showcasing that language is not always a
barrier. The implementation of OER and supporting technologies enhances
cooperation among learners, educators, researchers and institutions and
allows them to create, share and discuss content with peers from all over
the world.14 The appearance of disruptive innovation like MOOCs has the
potential to transform higher education and create new competition and
centers of excellence among universities worldwide. One positive example is
the recent launch of the European MOOC Initiative15 by the European
Association of Distance Teaching Universities. Such an initiative proves
that working across borders provides the necessary scale to generate new

education solutions which would otherwise be out of reach if designed by
each institution on its own.16
Thus, the meaning of “Open Educational Resources” includes:17
1. Learning content such as full courses, courseware packs, content
modules, collections, journals etc.
2. Tools such as software to support the development, use and reuse,
delivery of content, searching mechanisms for locating content,
learning management systems, content development tools,
communities for content aggregation etc.
3. Implementation resources such as the Creative Commons licenses
which promote open publishing of materials, design principles and
policies that mandate the provisions upon which content is accessible
and available for use, reuse, adaptation etc.
Openness is about the right and the ability to modify, repackage, and
add value to a resource.18 This kind of openness blurs the traditional
distinction between the consumer and the producer of resources. The term
“user-producer” is sometimes used to highlight this blurring of roles.19 In
that sense, Openness leveraging upon open educational tools including OER
should make possible the following three freedoms:20
1. The freedom to study a work and apply knowledge offered from it.
2. The freedom to redistribute copies, in whole or in part, of a work.

3. The freedom to make improvements or other changes, i.e. to make
adaptations, to the content of a work, and to release modified copies of
it.
These freedoms are based on principles and definitions on the
substance of open source, open knowledge21 and open source/free software22
as they have been shaped by Openness movements. Major Openness
opinion-leading organizations include the Free Software Foundation23 and
the Open Source Initiative24 that have set the terms of “Free/Libre and
Open Source Software”25 as well as the definitions of “Free Cultural
Works”26 and “Open Knowledge”27 which are a source of inspiration toward

the definition of Openness principles in the Creative Commons licensing
suite28 as well as the Open Data Commons Open Database License (ODC
ODbL),29 the Attribution License (ODC By)30 and the Public Domain
Dedication and License (PDDL).31
Regarding the Open Knowledge licenses the following few points are
worthwhile noting: the Open Knowledge Foundation32 stressed the
importance for the adoption of the Panton Principles for Open Data in

Science33 as well as the Open Knowledge Foundation’s Principles on Open
Bibliographic Data34 which are leveraged upon in the creation of Open
Knowledge Foundation’s Open Database License (ODbL)35 and which are all
of great usefulness to works produced either by legal entities or natural
persons no matter whether they are operating and producing in the private
or in the public sectors.
The ODbL was included in the set of Open Data Commons licenses
and dedications developed by Open Knowledge Foundation with the aim to
create a licensing suit focused on the protection of databases in the EU
legal environment. The Open Data Commons licensing suit includes the
Open Data Commons Attribution license (ODC-By) which allows licensees
to copy, distribute and use the database, to produce works from it and to
modify, transform and build upon it for any purpose.36 If content is
generated from the data that content should include or accompany a notice
explaining that the database was used in its creation. If the database is
used substantially to create a new database or collection of databases, the
licence URL or text and copyright/database right notices must be
distributed with the new database or collection.
The ODC-By is a simplified version of the ODbL. It grants the same
rights, and contains most of the same restrictions, with the exception that
it does contain neither the share-alike requirement nor the prohibition
against including the database with technological protection measures.

This makes it a very open license, and as long as the notices are kept
intact, it is very easy to comply with.
The project for the creation of ODbL was started as an independent
work by Jordan Hatcher and Prof. Charlotte Waelde in 2007 and was
funded by the software company Talis in an effort to create the successor to
the Talis Community License. The development of ODbL finally replaced
the Talis Community License.37 This first effort produced the ODbL. The
spark for the ODbL creation was the realization that the Creative
Commons licensing suite, at least until version 3.0 of CC licenses, was not
covering the database right specifically which the ODbL creators believed
left some institutions in Europe at potential risk due to market failure as
they could license only their Copyright and not the database sui generis
right. It was therefore felt that a database specific license was needed.38
The ODbL license grants the following rights:
1. Extraction and re-utilization of the whole or a substantial part of the
contents.
2. Creation of a derivative database; e.g. this includes any translation,
adaptation, arrangement, modification, or any other alteration of the
database or of a substantial part of the contents.
3. Inclusion of the database in unmodified form as part of a collection of
independent databases.
4. Creation of temporary or permanent reproductions by any means and in
any form, in whole or in part.
5. Distribution, communication, display, lending, making available, or
performance to the public by any means and in any form.

In exchange, the user must fulfil several conditions. These include
the obligation to keep copyright and database notices intact, and this being
a share-alike license, the user must release any derivatives under the
terms of the ODbL. The user is also forbidden from releasing derivatives
imposing any form of technological protection measure. Most of the other
provisions in the license are similar to those found in CC licenses.
Regarding the use of standard Open Licensing such as the Creative
Commons licensing and the Open Data Commons licensing suites for
licensing the open Educational Resources there have been in Greece
sporadic attempts to make available OERs in the academic environment of
tertiary education. The first endeavors regarding open educational
resources in Greece came over in 2000 in Aristotle University of
Thessaloniki and the National Kapodistrian University of Athens. Yet, the
current amount of open educational resources which are based on relevant
institutional repositories in Greece is 62 in total.39
Research findings40 from surveys conducted between March 2012
and March 2013 by a team of researchers under the guidance of Professors
Maria Bottis and Aphrodite Malliari indicated the following which are some
of the results coming out of OER-relevant research in Greece:
1. The majority of respondents consist of younger people who
belong to lower faculty level. Younger people are more familiar with new
technologies and OER creation and management.
2. The fact that academia gave incoherent answers when asked
to mention OER programs or initiatives they are participating in, enhances

the idea of OER respective information lack. In addition, results from the
question about the inhibitors that prevent professors from using OERs
were focused on lack of information about OER creation and use, lack of
administration support and lack of a model for an open content initiative.
3. Economic issues seem to be a factor of a great importance for
the perceived creation and use of OERs in the academic environment in
Greece. The current economic situation in Greece which imposes state
budget and expenditure cuts is related to the demand of academia for more
flexible educational materials with more quality and less cost through
academia collaboration by creating, using and reusing, under specific terms
OERs in order to achieve better educational content and enhance freedom
of teaching in classroom.
4. Academia in Greek public colleges are quite productive as far
as the educational and research content are concerned and show high
interest in OER creation, though not through a coordinated manner due to
OER policy lack. Only human-centered sciences use OERs to a limited
extent in contrast to natural and earth sciences that use OERs extensively.
5. Faculties, though mentioning a lot the economic factor to
express the difficulties they face, appear to be ready to take action
regarding educational and research content creation and management
through alternative forms, such as OERs for which they recognize a list of
benefits.
6. Faculty believe that OER creation, use and sharing enhance
freedom of teaching, widening access to educational material both for
students and professors, benefiting students all over Greece, enhancing
content quality, promoting new ideas and enhancing scientific research.

Under the name “Kallipos”41 the Hellenic Academic Libraries Link
(hereinafter HEALlink) has created the site http://www.kallipos.gr/ in which a
repository of OERs in the Greek academic environment is presented. “Kallipos”
is being developed by HEALlink, the National Technical University of Athens
(NTUA) and the National Research & Technology Network (EDET s.a.).
“Kallipos” is funded by the European Social Fund and the Hellenic Ministry of
Education’s Program for Education and Lifelong Learning.
The purpose of the “Kallipos” action is the production and delivery of Open
Access electronic books, i.e. the creation of Open Educational Resources (OERs)
which will be used by the students of Greek Universities (Universities and TEI).
The e-Books created will not replace printed books, but they will work
complementary to them. Thus, the intended purpose for the creation and use of
“Kallipos” is to evolve into a Hellenic Repository of Electronic Academic Books is an
OER system intended for storage, long term preservation and promotion of the
submitted works and contained therein learning objects. Each textbook that is
submitted to “Kallipos” through its subsystem for monitoring writing activity per
author is enhanced with metadata. “Kallipos” has been designed to be and operates
as a repository of OERs and learning objects intended for tertiary education in
Greece; its interface is compatible with external systems such as the Greek Registry
of Open Courses. Through “Kallipos” a member of the Greek academic environment
either student of teacher can search the full text of all books available to it, can
navigate all the textbooks and learning objects based on a pre-formatted hierarchy
of scientific disciplines and subjects as well as on the author’s name and the
academic institution and the author’s school; additionally, “Kallipos” allows for
reading online or through a print-out, reproduction of works and learning materials
available through it. The implementation of “Kallipos” system is based on free and

open source software DSpace, which is adapted and suitably expanded to meet the
Hellenic Repository of Electronic Academic Books’s functional requirements.
Beneficiaries for the funding intended for OERs through “Kallipos” may be:
1. Teachers and University Lecturers,
2. Professors and Visiting Professors,
3. Emeritus and Retired Professors,
4. Special Class Lecturers,
5. Special Scientists (with doctoral degrees),
6. Researchers and Professors from foreign institutions.
First priority for funding is given to writing e-books and study guides from
beneficiaries whose proposals meet the following criteria:
1. Relate to at least one undergraduate level course of either a Department or a
Program of Study and/or belongs to at least one of the respective scientific
categories included in the Subject invitations.
2. It is possible to use the e-Book for the teaching of more than one course at
undergraduate level in similar Departments / Programs of Study.
3. The content covers required syllabus.
4. Capitalize on as many new technologies as possible and make use of interactive
and multimedia learning objects.
The main characteristics of OERs which are produced and are made available
through “Kallipos” are the following:
1. They are books in digital format, readable by electronic devices (e.g., electronic
readers, tablets, mobile phones or PCs).
2. They include multimedia (images, sounds, videos, graphs) and/or interactive
objects.
3. They have the opportunity for interactivity and ease of navigation, such as
search, add and share notes, and to link to external information resources.
4. Each chapter and interactive e-book object may constitute an independent
“learning object” that could be detached and reused in another book or become
available on the internet or another electronic medium.

The e-Book format used for books and learning objects available through “Kallipos”
is mainly be EPUB (version 3), an open free access standard, used worldwide for
creating electronic books. It is Preferred by “Kallipos” because it supports the
following:

Multimedia and interactivity
It incorporates improvements in the layout and appearance of pages
It supports many languages
It has accessibility improvements for people with visual impairments.
As of the beginning of implementation of “Kallipos” Action there have been
targeted subject invitations to cover all the thematic categories of the curricula of
all the University Departments (both Universities and TEI) in Greece. Each call has
been communicated to the beneficiaries who may then submit a proposal for
funding. There are already five (5) Subject Invitations published in five respective
areas:
1st Call was for Engineering and Computer Science
2nd Call was for Physical Sciences
3rd Call was for Medical Sciences and Life Sciences
4th Call was for Economic, Political and Social Sciences as well as Agricultural
Sciences
5th Call was for Humanities and Law as well as Arts and Letters
The “Kallipos” program makes provisions for the creation of five Competent
Thematic Committees which are assembled of experts following a public call for
expressions of interest; their main task is to coordinate the evaluation of proposals
for the creation of electronic books and learning objects intended for use through
“Kallipos” and, upon completion of these materials, the approval of funding for
them. The approval of funding for proposals becomes public.
Regarding the financing for the creation of OERs for “Kallipos”, each
prospective writer can submit a proposal as main author (or participate as a co-
author) for more than one proposal, taking into account the following:

The maximum funding amount of a positively-evaluated proposal is ten
thousand euro (€ 10000), including the fees for the Critical Reader which is €
1000.
The maximum fee that a person gets paid as an author (main or co-author) is
defined to fifteen thousand euro (€ 15000).
The maximum remuneration of any activity either as a writer, critical reader or
assessor in the “Kallipos” Action and throughout the duration of the project is
twenty thousand euro (€ 20000).
The level of remuneration for the other participants in the authorial effort is
determined by the senior author.
Details of the procedures, under which the beneficiary shall submit a funding
proposal for writing an OER, are provided at the site of “Kallipos”. Suffice it to say
for the sake of this conference participation that the maximum duration for writing
an OER after receiving the initial positive evaluation and approval of the funding
proposal is one (1) year and minimum duration is four (4) months. Minimum
requirement for the successful completion of the writing effort is the delivery by the
author of all the original materials (text files, pictures, drawings, interactive
objects, video production, figures, shapes, etc.), as well as the metadata and the
book in PDF format. Finally, the conversion of the e-book in EPUB format can be
done either with the responsibility of the main author or by the “Kallipos” staff, in
consultation with the writing group and depending on the techniques, and
particular features it may need.
So far Kallipos has produced OERs through five separate calls/actions. As
of February 17, 2015, there have been 3775 teaching members of academic
community in Greece registered to Kallipos. These members are:

Finally, and regarding licensing for the produced OER to become
available through “Kallipos” currently, there is only the option of choosing
between two among the six Creative Commons licenses and specifically
chose between the ported Greek version 3.0 of Creative Commons license
Attribution—Non-Commercial—Share Alike (CC BY-NC-SA v.3.0) or the
ported license Attribution—Non-Commercial—No-Derivative (CC BY-NC-
ND v.3.0). “Kallipos” does not accept the Creative Commons licenses
Attribution—Non-Commercial (CC BY-NC v.3.0), the Attribution—Share
Alike (CC BY-SA v.3.0), the Attribution—No-Derivatives (CC BY-ND v.3.0),

and the Attribution (CC BY v.3.0); the main reason for “Kallipos”
preference to only two of the six Creative Commons licenses, namely the
most restrictive of them, is related to beneficiaries’ expressed preferences to
the aforesaid two CC licenses as well as their negative response furnished
to “Kallipos” regarding the possibility of enriching the licensing options
with more licenses of the available Greek version of Creative Commons
licensing suite.
As of the time of the composition of this paper there’s no option for
choosing for OERs produced for “Kallipos” the Greek translation of Creative
Commons license Attribution—Non-Commercial—Share Alike (CC BY-NC-
SA v.4.0) version 4.0 or of the license Attribution—Non-Commercial—No-
Derivative (CC BY-NC-ND v.4.0) version 4.0 simply because the Greek
organization representing the Creative Commons in Greece has yet to
produce the Greek translation of CC licenses v.4.0 despite the fact that CC
v.4.0 licensing suite has been in the market as of November 25, 2013.
The author of this paper who was the sole contractor42 of National
Research and Technology Network s.a. for the authorship of the Greek
Creative Commons licensing suite version 2.5, and who was also the author
of the Greek Creative Commons licensing suite version 3.0, produces and
provides in the Annex herewith of this paper the Greek translation of
Creative Commons license Attribution—Non-Commercial—Share Alike
(CC BY-NC-SA v.4.0) version 4.0 as well as the Greek translation of
Creative Commons license Attribution—Non-Commercial—No Derivatives

Η άσκηση των εκχωρούμενων με την άδεια αυτή εξουσιών (όπως ορίζονται παρακάτω)
από το δικαίωμα πνευματικής ιδιοκτησίας και τα συγγενικά δικαιώματα σημαίνει ότι
αποδέχεσαι και συμφωνείς ότι δεσμεύεσαι από τους όρους και προϋποθέσεις των όρων
αυτής της διεθνούς δημόσιας άδειας Creative Commons Αναφορά, Μη-Εμπορική
χρήση, Παρόμοια Διανομή v.4.0. Στο βαθμό που αυτή η άδεια μπορεί να ερμηνευτεί ως
σύμβαση, σου εκχωρούνται οι εξουσίες που περιγράφονται στο περιεχόμενο της άδειας

α. «Παράγωγο Έργο (Τροποποίηση)» σημαίνει ένα έργο που υπόκειται σε
πνευματική ιδιοκτησία ή συγγενικά δικαιώματα βασισμένο στο αδειοδοτούμενο έργο
και το οποίο συνίσταται σε μετάφραση, αλλαγή, προσαρμογή ή μετατροπή ή με
οποιονδήποτε άλλο τρόπο τροποποίηση του αρχικού έργου κατά τρόπο που ν’
απαιτείται η άδεια του αδειοδότη υπόψη της νομοθεσίας περί πνευματικής
ιδιοκτησίας και συγγενικών δικαιωμάτων. Για τους σκοπούς αυτής της δημόσιας
άδειας, όπου το αδειοδοτημένο έργο είναι μουσικό έργο, παρουσίαση στο κοινό ή
ηχογράφηση, Παράγωγο Έργο υφίσταται οσάκις το αδειοδοτημένο έργο συνίσταται σε
συγχρονισμένη εικόνα και ήχο.
β. Η άδεια του δημιουργού του Παράγωγου Έργου σημαίνει την άδεια που
αποδέχεται αυτός για το δικό του δικαίωμα πνευματικής ιδιοκτησίας ή συγγενικό
δικαίωμα για τις συνεισφορές του στο τροποποιημένο έργο σύμφωνα με τους όρους και
τις προϋποθέσεις αυτής της δημόσιας άδειας.
γ. BY-NC-SA συμβατή άδεια σημαίνει μια άδεια που αναφέρεται στη λίστα των
συμβατών αδειών που βρίσκεται σε http://creativecommons.org/compatiblelicenses
και που έχει εγκριθεί από τον φορέα Creative Commons ως παρόμοια στην ουσία
άδεια μ’ αυτήν τη δημόσια άδεια.
δ. Πνευματική ιδιοκτησία και σχετικά δικαιώματα σημαίνει τα δικαιώματα της
πνευματικής ιδιοκτησίας και τα σχετικά με αυτά συγγενικά δικαιώματα στα οποία
περιλαμβάνονται τα δικαιώματα των ερμηνευτών ή εκτελεστών καλλιτεχνών, των
παραγωγών φωνογραφημάτων (των παραγωγών υλικών φορέων ήχου), των παραγωγών
οπτικοακουστικών έργων (των παραγωγών υλικών φορέων ήχου και εικόνας), των
ραδιοτηλεοπτικών οργανισμών, των εκδοτών εντύπων∙ επίσης, περιλαμβάνεται το
δικαίωμα ειδικής φύσης του δημιουργού βάσης δεδομένων (sui generis database
rights), ανεξάρτητα από το πώς τα ανωτέρω δικαιώματα αναφέρονται ή
κατηγοριοποιούνται στο νόμο. Για τους σκοπούς αυτής της Δημόσιας Άδειας, τα

δικαιώματα που αναφέρονται στο τμήμα 2(β)(1)-(2) αυτής δεν προβλέπονται ως
σχετικά δικαιώματα πνευματικής ιδιοκτησίας ή δικαιώματα πνευματικής ιδιοκτησίας.
ε. Αποτελεσματικοί Τεχνολογικοί Περιορισμοί σημαίνει τα τεχνολογικά μέτρα
προστασίας που, σε περίπτωση έλλειψης κατάλληλης εξουσίας, δεν μπορούν να
παρακαμφθούν υπόψη νομικού πλαισίου σύμφωνα με το άρ.11 της Συνθήκης
Πνευματικής Ιδιοκτησίας της 20ης Δεκεμβρίου 1996 του Παγκόσμιου Οργανισμού
Πνευματικής Ιδιοκτησίας και παρόμοιων διεθνών συνθηκών.
στ. Νόμιμοι Περιορισμοί και Εξαιρέσεις σημαίνει επιτρεπόμενη εύλογη/δίκαιη
χρήση (fair use/fair dealing) ή ιδιωτική αναπαραγωγή ή άλλη εξαίρεση ή περιορισμό
στο δικαίωμα πνευματικής ιδιοκτησίας ή στα σχετικά μ’ αυτό δικαιώματα που
εφαρμόζεται στη χρήση που κάνεις επί του αδειοδοτημένου έργου.
ζ. Στοιχεία Άδειας σημαίνει τα χαρακτηριστικά της άδειας που αναφέρονται στον
προσδιορισμό αυτής της άδειας Creative Commons. Τα στοιχεία άδειας αυτής της
δημόσιας άδειας Creative Commons είναι η Αναφορά του δημιουργού ή δικαιούχου, η
Μη-Εμπορική χρήση του έργου, και η Παρόμοια Διανομή του παράγωγου έργου.
η. Το αδειοδοτημένο έργο σημαίνει το έργο λόγου ή τέχνης, τη βάση δεδομένων ή
οποιοδήποτε άλλο στοιχείο το οποίο ο αδειοδότης διαθέτει με αυτή τη δημόσια άδεια.
θ. Τα εκχωρούμενα δικαιώματα σημαίνει τις εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και σχετικών (συγγενικών) δικαιωμάτων που σου
παραχωρούνται από τον αδειοδότη που έχει την εξουσία γι’ αυτό για τη χρήση από
εσένα του αδειοδοτημένου έργου με την προϋπόθεση της τήρησης των όρων της
παρούσας δημόσιας άδειας.

ι. Ο αδειοδότης σημαίνει το φυσικό ή νομικό πρόσωπο ή πρόσωπα που εκχωρούν τις
εξουσίες του δικαιώματος πνευματικής ιδιοκτησίας και συγγενικών δικαιωμάτων
σύμφωνα με αυτή τη δημόσια άδεια.
ια. Μη Εμπορική χρήση σημαίνει χρήση που δεν αποσκοπεί σε εμπορικό
αντάλλαγμα ή οικονομικό όφελος. Για τους σκοπούς αυτής της δημόσιας άδειας η
ανταλλαγή αδειοδοτημένου έργου με άλλο έργο που υπόκειται σε πνευματική
ιδικτησία ή συγγενικά δικαιώματα με μέθοδο online διανομής αρχείων (file-sharing)
ή παρόμοια μέθοδο περιλαμβάνεται σε μη εμπορική χρήση εφόσον δεν υπάρχει
πληρωμή ή οικονομικό αντάλλαγμα σχετικό με την μέθοδο της online διανομής
αρχείων.
ιβ. Διανομή σημαίνει την παροχή έργου στο κοινό με οποιονδήποτε τρόπο ή μέθοδο
προϋποθέτει την προηγούμενη άδεια για την άσκηση των εκχωρούμενων εξουσιών,
όπως της εξουσίας αναπραγωγής, διασκευής, μετάφρασης, δημόσιας εκτέλεσης,
παρουσίασης στο κοινό, διανομής, εκμίσθωσης και δημόσιου δανεισμού, εισαγωγής,
μετάδοσης μέσω δορυφόρου ή καλωδιακής μετάδοσης ή αναμετάδοσης, και διάθεσης
του έργου στο κοινό με τρόπο στον οποίο συμπεριλαμβάνεται η δυνατότητα του
κοινού να έχει πρόσβαση στο έργο από τόπο και σε χρόνο της επιλογής του.
ιγ. Το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης δεδομένων
σημαίνει το δικαίωμα που προβλέπεται στην Οδηγία 96/9/ΕΚ του Ευρωπαϊκού
Κοινοβουλίου και του Συμβουλίου της 11ης Μαρτίου 1996 για τη Νομική Προστασία
των Βάσεων Δεδομένων όπως αυτό έχει τροποποιηθεί και ισχύει καθώς και άλλα
παρόμοια δικαιώματα που ισχύουν οπουδήποτε στον κόσμο.
ιδ. Εσύ, σημαίνει το φυσικό ή νομικό πρόσωπο που ασκείς τις εκχωρούμενες εξουσίες
σύμφωνα με το περιεχόμενο αυτής της άδειας.
2. Τμήμα Δεύτερο—Σκοπός

α. Παροχή άδειας
1. Υπό την προϋποθεση της τήρησης των όρων αυτής της άδειας, ο
αδειοδότησης με το κείμενο αυτό σου παρέχει, για όλον τον κόσμο, χωρίς
εύλογη αμοιβή, χωρίς δικαίωμα υπο-αδειοδότησης, μη αποκλειστική, μη
ανακλητή άδεια να ασκήσεις τις εκχωρούμενες εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και συγγενικά δικαιώματα επί του
αδειοδοτημένου έργου, και ειδικότερα:
Α. Την εξουσία της αναπαραγωγής και διανομής του αδειοδοτημένου
έργου, εν όλω ή εν μέρει, αποκλκειστικά για μη εμπορική χρήση, &
Β. Την εξουσία της παραγωγής, αναπαραγωγής, και διανομής
τροποποιημένου έργου βάση του αρχικού αδειοδοτημένου έργου
αποκλειστικά για μη εμπορική χρήση.
2. Εξαιρέσεις και Νόμιμοι περιορισμοί: Προς άρση αμφιβολιών, σε περίπτωση
εφαρμογής εξαιρέσεων ή νόμιμων περιορισμών από το δικαίωμα
πνευματικής ιδιοκτησίας ή τα συγγενικά δικαιώματα, αυτή η δημόσια άδεια
δεν έχει εφαρμογή και δεν απαιτείται εσύ να συμμορφώνεσαι με τους όρους
και προϋποθέσεις αυτής της άδειας.
3. Διάρκεια: η διάρκεια αυτής της δημόσιας άδειας προσδιορίζεται στο Έκτο
Τμήμα (α) αυτής.
4. Μέσα και μορφότυπος∙ επιτρεπτές τεχνικές τροποποιήσεις: ο αδειοδότης
εκχωρεί σ’ εσένα τις αδειοδοτημένες εξουσίες από το δικαίωμα πνευματικής
ιδιοκτησίας για κάθε μέσο και μορφότυπο είτε γνωστό είτε μέλλοντα να
υπάρξει, και την εξουσία να κάνεις αναγκαίες τεχνικές τροποποιήσεις του
έργου για τη χρήση αυτού σε κάθε μέσο και μορφότυπο. Ο αδειοδότης
παραιτείται από ή /και συμφωνεί να μην ασκήσει δικαίωμά του για να σου
απαγορεύσει να κάνεις τεχνικές τροποποιήσεις αναγκαίες για να ασκήσεις
τις εκχωρούμενες εξουσίες, συμπεριλαμβανομένων τεχνικών τροποποιήσεων
του έργου που είναι αναγναίες για την παράκαμψη αποτελεσματικών
τεχνολογικών μέτρων προστασίας του έργου. Για τους σκοπούς αυτής της

δημόσιας άδεας, η διενέργεια τροποποιήσεων που προβλέπονται στο Τμήμα
Δεύτερο (α)(4) αυτής της άδειας δεν θα συνιστά παράγωγο έργο.
5. Περαιτέρω χρήστες.
Α. Εκχώρηση από τον αδειοδότη—αδειοδοτούμενο έργο: κάθε χρήστης
του αδειοδοτούμενου έργου γίνεται εκδοχέας αυτόχρημα από τον
αδειοδότη των εκχωρούμενων εξουσιών από το δικαίωμα της
πνευματικής ιδιοκτησίας υπό τους όρους και τις προϋποθέσεις της
παρούσας δημόσιας άδειας.
Β. Πρόσθετη εκχώρηση από τον αδειοδότη—παράγωγο έργο: κάθε
χρήστης του παράγωγου έργου που δημιουργείς εσύ γίνεται εκδοχέας
αυτόχρημα από τον αδειοδότη των εκχωρούμενων εξουσιών από το
δικαίωμα της πνευματικής ιδιοκτησίας για να τις ασκήσει και επί του
παράγωγου έργου υπό τους όρους και τις προϋποθέσεις της άδειας του
δημιουργού του παράγωγου έργου.
Γ. Απαγόρευση περιορισμών περαιτέρω χρήσης: Σου απαγορεύεται να
επιβάλλεις ή προτείνεις πρόσθετους ή διαφορετικούς όρους ή
προϋποθέσεις, ή να εφαρμόσεις αποτελεσματικά τεχνολογικά μετρα
προστασίας στο αδειοδοτούμενο έργο, εάν από την επιβολή, πρόταση ή
εφαρμογή τέτοιων όρων, προϋποθέσεων ή τεχνολογικών μέτρων
περιορίζεται η άσκηση των εκχωρούμενων εξουσιών από το δικαίωμα
πνευματικής ιδιοκτησίας από οποιονδήποτε χρήστη του
αδειοδοτημένου έργου.
6. Μη αναγνώριση. Το περιεχόμενο αυτής της δημόσιας άδειας δεν συνιστά
ούτε μπορεί να ερμηνευτεί ότι συνιστά παροχή άδειας σε εσένα, ούτε
συνιστά ερμηνεία κατά τον ίδιο τρόπο των χρήσεων του έργου που εσύ
κάνεις, ώστε να εμφανίζεσαι ή να επικαλείσαι ότι δήθεν σχετίζεσαι με τον
αδειοδότη δημιουργό του αδειοδοτούμενου έργου ή με τρίτους στους
οποίους γίνεται αναφορά σχετικά με το αδειοδοτούμενο έργο σύμφωνα με τα
προβλεπόμενα στο Τρίτο Τμήμα (α)(1)(Α)(i) αυτής της άδειας, με σχέση
χορηγίας, συναίνεσης ή επίσημης αναγνώρισης.

β. Άλλα δικαιώματα.
1. Οι εξουσίες από το ηθικό δικαίωμα της πνευματικής ιδιοκτησίας όπως η
εξουσία περιφρούρησης της ακεραιότητας του έργου, δεν περιλαμβάνονται στο
περιεχόμενο των εκχωρούμενων εξουσιών αυτής της δημόσιας άδειας, ούτε
περιλαμβάνονται σ’ αυτό δικαιώματα περί την ιδιωτικότητα, την
προσωπικότητα ή παρόμοια δικαιώματα. Εντούτοις, και στο βαθμό που αυτό
είναι αναγκαίο για να ασκήσεις τις εκχωρούμενες με την άδεια αυτή εξουσίες, ο
αδειοδότης παραιτείται από ή/και συμφωνεί να μην ασκήσει τέτοια δικαιώματα
ή εξουσίες των οποίων είναι δικαιούχος προκειμένου να σου επιτραπεί ή
άσκηση των εκχωρούμενων εξουσιών και όχι για άλλο λόγο.
2. Δικαιώματα επί ευρεσιτεχνιών ή δικαιώματα επί εμπορικών σημάτων δεν
περιλαμβάνονται στο περιεχόμενο αυτής της δημόσιας άδειας.
3. Στο βαθμό που αυτό επιτρέπεται από το νόμο, ο αδειοδότης παραιτείται από το
δικαίωμα είσπραξης αμοιβής από εσένα για την άσκηση των εκχωρούμενων
εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας, είτε απευθείας είτε μέσω
οργανισμού συλλογικής διαχείρισης μέσω εθελοντικής ή αναγκαστικής
παροχής αδείας για την είσπραξη της αμοιβής. Σε κάθε άλλη περίπτωση, ο
αδειοδότης ρητά επιφυλάσσεται για την άσκηση του δικαιώματός του να
εισπράξει αμοιβή από την εκχώρηση εξουσιών του δικαιώματος πνευματικής
ιδιοκτησίας του για κάθε χρήση του έργου του πλην των μη εμπορικών
χρήσεων.
3. Τμήμα Τρίτο—Προϋποθέσεις αδειοδότησης
Η εκχώρηση ορισμένων εκ των εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας σε
εσένα περιλαμβάνει τα εξής:
α. Αναφορά δημιουργού
1. Εφόσον μοιράζεσαι το αδειοδοτημένο έργο συμπεριλαμβανομένων
των τροποποιήσεών του, οφείλεις:
A. Να διατηρείς τις παρακάτω αναφορές στο αδειοδοτημένο
έργο εφόσον αυτές έχουν περιγραφεί από τον αδειοδότη:

i. Αναφορά του/-ών δημιουργού/-ών του
αδειοδοτημένου έργου καθώς και αναφορά σε
οποιονδήποτε τρίτο ορίζεται ότι πρέπει να
αναφέρεται, με κάθε εφικτό τρόπο που
προσδιορίζεται από τον αδειοδότη
συμπεριλαμβανομένης της αναφοράς με ψευδώνυμο
αν αυτή ζητείται.
ii. Αναφορά της ισχύος δικαιωμάτων πνευματικής
ιδιοκτησίας.
iii. Αναφορά της παρούσας δημόσιας άδειας
iv. Αναφορά της σημείωσης για την αποποίηση ευθύνης
και παροχή εγγυήσεων.
v. Αναφορά του Κανονιστικού Αναγνωριστικού Πόρου
(URI) ή του υπερσυνδέσμου του αδειοδοτούμενου
έργου στο βαθμό που αυτό είναι δυνατόν.
B. Να παρέχεις ενδείξεις για τις τροποποιήσεις του
αδειοδοτούμενου έργου που έκανες, καθώς και ενδείξεις
για κάθε τροποποίηση που έγινε πριν από τις δικές σου.
C. Να παρέχεις ενδείξεις ότι το αδειοδοτούμενο έργο
υπόκειται στους όρους αυτής της δημόσιας άδειας, και να
συμπεριλαμβάνεις στις ενδείξεις αυτές είτε το πλήρες
κείμενο αυτής είτε το Κανονιστικό Αναγνωριστικό Πόρου
(URI) ή τον υπερσύνδεσμο αυτής της δημόσιας άδειας.
2. Μπορείς να ικανοποιήσεις τους όρους της αναφοράς σύμφωνα με
το Τρίτο Τμήμα (α)(1) αυτής της άδειας με κάθε εύλογο τρόπο
υπόψη του μέσου και των δεδομένων του τρόπου με τον οποίο
μοιράζεσαι το αδειοδοτούμενο έργο. Για παράδειγμα, μπορεί να
συνιστά εύλογο τρόπο ικανοποίησης της υποχρέωσης αναφοράς η
παροχή του Κανονιστικού Αναγνωριστικού Πόρου (URI) ή του

υπερσυνδέσμου μιας πηγής στην οποία υπάρχει η απαιτούμενη
πληροφόρηση για την αναφορά του αδειοδοτούμενου έργου.
3. Εφόσον απαιτηθεί από τον αδειοδότη, πρέπει να αφαιρέσεις
οποιαδήποτε αναφορά από τις προβλεπόμενες στο Τρίτο Τμήμα
(α)(1)(Α) στο βαθμό που αυτό είναι εφικτό.
b. Παρόμοια διανομή.
Επιπλέον της υποχρέωσης αναφοράς σύμφωνα με το Τρίτο Τμήμα (α) της
άδειας αυτής, εφόσον κάνεις διανομή παράγωγού έργου από το
αδειοδοτούμενο έργο οφείλεις να ενεργήσεις τα εξής:
1. Η άδεια του δημιουργού του παράγωγου έργου πρέπει να είναι
άδεια Creative Commons που περιέχει τα ίδια στοιχεία
άδειας με αυτά αυτής της δημόσιας άδειας, της παρούσας
έκδοσης ή μελλοντικής, ή να είναι άδεια συμβατή με την άδεια
BY-NC-SA.
2. Πρέπει να περιλαμβάνεις το πλήρες κείμενο της άδειας ή το
Κανονιστικό Αναγνωριστικό Πόρου (URI) ή τον υπερσύνδεσμο
της άδειας του δημιουργού του παράγωγου έργου. Οφείλεις να
ικανοποιήσεις αυτήν την προϋπόθεσης με κάθε εύλογο τρόπο
υπόψη του μέσου και τρόπου με τα οποία διανέμεις το
παράγωγο έργο.
3. Σου απαγορεύεται να επιβάλλεις ή προτείνεις πρόσθετους ή
διαφορετικούς όρους ή προϋποθέσεις, ή να εφαρμόσεις
αποτελεσματικά τεχνολογικά μετρα προστασίας στο
αδειοδοτούμενο παράγωγο έργο, εάν από την επιβολή, πρόταση
ή εφαρμογή τέτοιων όρων, προϋποθέσεων ή τεχνολογικών
μέτρων περιορίζεται η άσκηση των εκχωρούμενων εξουσιών
από το δικαίωμα πνευματικής ιδιοκτησίας από οποιονδήποτε
χρήστη του αδειοδοτημένου παράγωγου έργου.

4. Τμήμα Τέταρτο—Το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης
δεδομένων
Όπου η εκχώρηση εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας περιλαμβάνει
το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης δεδομένων προκειμένου να
κάνεις χρήση του αδειοδοτούμενου έργου, τότε:
α. Προς άρση αμφιβολιών το περιεχόμενο του Δεύτερου Τμήματος (α)(1) σου
παρέχει το δικαίωμα να εξάγεις, κάνεις χρήση, αναπαράγεις ή διανείμεις το
σύνολο ή σημαντικό μέρος εκ του περιεχομένου της βάσης δεδομένων
αποκλειστικά για μη εμπορικό σκοπό.
β. Αν περιλαμβάνεις το σύνολο ή σημαντικό μέρος εκ του περιεχομένου της
βάσης δεδομένων σε βάση δεδομένων στην οποία εσύ έχεις δικαίωμα ειδικής
φύσης κατασκευαστή βάσης δεδομένων, τότε η βάση δεδομένων (και όχι τα
περιεχόμενά της) στην οποία εσύ έχεις δικαίωμα ειδικής φύσης είναι παράγωγο
έργο για το σκοπό και την έννοια του Τρίτου Τμήματος (β)∙ και
γ. Οφείλεις να συμμορφωθείς με τους όρους του Τρίτου Τμήματος (α) εφόσον
μοιράζεσαι το σύνολο ή σημαντικό μέρος εκ του περιεχομένου της βάσης
δεδομένων.
Προς άρση αμφιβολιών, το Τέταρτο Τμήμα προβλέπει συμπληρωματικές υποχρεώσεις
σου και δεν αντικαθιστά τις προβλεπόμενες σε άλλα τμήματα υποχρεώσεις σου όπως
περιγράφονται σε αυτήν τη δημόσια άδεια ως εκχωρούμενες εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και συγγενικά δικαιώματα.
5. Τμήμα Πέμπτο—Εγγυήσεις και Περιορισμός της ευθύνης
α. Εκτός αν άλλως ορίζεται από τον αδειοδότη σε διαφορετικό κείμενο, ο
αδειοδότης παρέχει το αδειοδοτούμενο έργο «ως έχει» και «όπως διατίθεται» και
δεν παρέχει καμία εγγύηση σχετικά με το αδειοδοτούμενο έργο είτε ρητή είτε
τεκμαιρόμενη από σύμβαση ή άλλως. Η μη παροχή εγγυήσεων περιλαμβάνει τον
τίτλο, την εμπορευσιμότητα, την καταλληλότητα για ορισμένο σκοπό, τη
νομιμότητα, την έλλειψη λανθανόντων ή εμφανών ελαττωμάτων, την ακρίβεια,
την παρουσία ή απουσία λαθών, είτε γνωστών είτε αγνώστων. Όπου η παροχή

εγγυήσεων δεν επιτρέπεται είτε εν όλω είτε εν μέρει, αυτή η δήλωση περί μη
παροχής εγγυήσεων δεν έχει εφαρμογή και σε εσένα.
β. Στο βαθμό που αυτό επιτρέπεται από το νόμο, ο αδειοδότης δεν έχει νομική
ευθύνη έναντι σου (συμπεριλαμβανομένης της ευθύνης από αμέλεια) για
οποιαδήποτε άμεση, ειδική, έμμεση, τυχαία, επαγόμενη, αδικοπρακτική ζημία,
κόστος ή δαπάνη που προκαλούνται από αυτή τη δημόσια άδεια ή από το
αδειοδοτούμενο έργο, ακόμη και στην περίπτωση που ο αδειοδότης γνωρίζει το
ενδεχόμενο της πρόκλησης τέτοιων ζημιών, κόστους ή δαπανών. Όπου ο
περιορισμός της νομικής ευθύνης δεν επιτρέπεται είτε εν όλω είτε εν μέρει, αυτή
η δήλωση περί περιορισμού της νομικής ευθύνης δεν έχει εφαρμογή και σε εσένα.
γ. Η ανωτέρω δήλωση περί μη παροχής εγγυήσεων και περί περιορισμού της
νομικής ευθύνης πρέπει να ερμηνεύεται κατά τέτοιο τρόπο ώστε, στο βαθμό που
αυτό επιτρέπεται από το νόμο, να ισοδυναμεί με πλήρη περιορισμό της νομικής
ευθύνης και παροχή καμίας εγγύησης.
6. Τμήμα Έκτο—Διάρκεια και Παύση
α. Αυτή η δημόσια άδεια περί την εκχώρηση εξουσιών από το δικαίωμα
πνευματικής ιδιοκτησίας έχει διάρκεια για όλο το χρόνο ισχύος του
δικαιώματος πνευματικής ιδιοκτησίας και των σχετικών δικαιωμάτων. Ωστόσο,
σε ενδεχόμενη μη συμμορφωση με τους όρους αυτής της δημόσιας άδειας, τότε
παύει αυτοδίκαια η εκχώρηση των εξουσιών από το δικαίωμα πνευματικής
ιδιοκτησίας και σχετικών δικαιωμάτων.
β. Σε περίπτωση παύσης των εκχωρούμενων εξουσιών επί του αδειοδοτούμενου
έργου σύμφωνα με το Έκτο Τμήμα (α), τότε μπορεί:
1. Να γίνει αποκατάσταση της προτέρας της παύσης εκχώρησης των
εξουσιών του δικαιώματος πνευματικής ιδιοκτησίας και σχετικών
δικαιωμάτων εφόσον υπάρξει άρση της προσβολής των δικαιωμάτων
εντός τριάντα ημερών από τη δική σου γνώση της αιτίας της
προσβολής. Για την αποκατάσταση αυτή δεν απαιτείται άλλη
προϋπόθεση.

Περί τη χρήση των δημόσιων αδειών Creative Commons
Οι δημόσιες άδειες Creative Commons παρέχουν ένα σύνολο όρων και προϋποθέσεων που οι
δημιουργοί και οι άλλοι δικαιούχοι κάνουν αποδεκτές προκειμένου να διανέμουν έργα πνευματικής
ιδιοκτησίας και να ασκήσουν δικαιώματα που προσδιορίζονται στο περιεχόμενο της δημόσιας άδειας
που ακολουθεί. Η παρακάτω πληροφόρηση αποσκοπεί σε ενημέρωση και μόνον, δεν είναι πλήρης, και
δεν συνιστά περιεχόμενο των αδειών Creative Commons.
Πληροφόρηση για τον αδειοδότη:
Οι δημόσιες άδειες Creative Commons διατίθενται για χρήση από αυτούς που επιθυμούν να
επιτρέψουν στο κοινό να κάνει χρήση του αδειοδοτούμενου έργου που άλλως περιορίζεται από το
δικαίωμα πνευματικής ιδιοκτησίας, καθώς και χρήση συγκεκριμένων άλλων δικαιωμάτων. Οι άδειες
Creative Commons δεν ανακαλούνται. Οι επιθυμούντες να αδειοδοτήσουν έργα θα πρέπει να
διαβάσουν και κατανοήσουν τους όρους και προϋποθέσεις της άδειας που επιλέγουν πριν ενεργήσουν
την αδειοδότηση. Οι αδειοδότες θα πρέπει, επίσης, να εξασφαλίσουν τα δικαιώματά τους πριν
αδειοδοτήσουν τα έργα τους ώστε το κοινό να μπορεί να κάνει χρήση των αδειοδοτούμενων έργων όπως
προβλέπεται. Οι αδειοδότες πρέπει να επισημαίνουν οποιοδήποτε στοιχείο του έργου δεν υπόκειται

στην αδειοδότηση. Αυτή η επισήμανση περιλαμβάνει οποιοδήποτε στοιχείο έργου αδειοδοτημένο με
άλλη άδεια Creative Commons ή στοιχείο έργου υποκείμενο σε νόμιμο περιορισμό ή εξαίρεση από το

Πληροφόρηση για το κοινό:
Κάνοντας χρήση μιας από τις δημόσιες άδειες μας, ο αδειοδότης εκχωρεί στο κοινό άδεια να κάνει
χρήση του αδειοδοτούμενου έργου υπό συγκεκριμένους όρους και προϋποθέσεις. Αν η αδειοδότηση του
αδειοδότη δεν είναι αναγκαία για οποιονδήποτε λόγο—για παράδειγμα, γιατί τυγχάνει εφαρμογής
οποιοσδήποτε νόμιμος περιορισμός ή εξαίρεση από το δικαίωμα πνευματικής ιδιοκτησίας—τότε η
χρήση του έργου γι’ αυτό το λόγο δεν διέπεται από τους όρους αυτής της άδειας. Οι άδειες Creative
Commons παρέχουν μόνον δικαιώματα πνευματικής ιδιοκτησίας και άλλων δικαιωμάτων που ο
αδειοδότης έχει την εξουσία να εκχωρήσει. Η χρήση του αδειοδοτημένου έργου μπορεί να τυγχάνει
περιορισμών από άλλους λόγους στους οποίους περιλαμβάνονται τυχόν δικαιώματα πνευματικής
ιδιοκτησίας τρίτων ή άλλα δικαιώματα στο αδειοδοτούμενο έργο. Ο αδειοδότης μπορεί να
συμπεριλαμβάνει ειδικούς όρους, όπως την επιθυμία του να επισημαίνονται όλες οι τροποποιήσεις στο
αδειοδοτημένο έργο ή να περιγράφονται αυτές. Παρόλο που δεν απαιτείται από τις άδειες Creative
Commons, συνιστούμε να γίνονται σεβαστοί οι ειδικοί όροι του αδειοδότη εφόσον αυτοί είναι εύλογοι.

Αναφορά, Μη-Εμπορική χρήση, Όχι Παράγωγα έργα v.4.0 Διεθνής Άδεια
Η άσκηση των εκχωρούμενων με την άδεια αυτή εξουσιών (όπως ορίζονται παρακάτω)
από το δικαίωμα πνευματικής ιδιοκτησίας και τα συγγενικά δικαιώματα σημαίνει ότι
αποδέχεσαι και συμφωνείς ότι δεσμεύεσαι από τους όρους και προϋποθέσεις των όρων
αυτής της διεθνούς δημόσιας άδειας Creative Commons Αναφορά, Μη-Εμπορική
χρήση, Όχι Παράγωγα έργα v.4.0. Στο βαθμό που αυτή η άδεια μπορεί να ερμηνευτεί
ως σύμβαση, σου εκχωρούνται οι εξουσίες που περιγράφονται στο περιεχόμενο της
άδειας υπό τον όρο της αποδοχής σου των όρων και των προϋποθέσεων της άδειας
αυτής. Ο αδειοδότησης του εκχωρεί τις περιγραφόμενες στην άδεια εξουσίες υπόψη
των ωφελημάτων που έχει ο αδειοδότης από την αδειοδότηση του έργου με τους όρους
και προϋποθέσεις αυτής της άδειας.
1. Τμήμα Πρώτο—Ορισμοί

α. «Παράγωγο Έργο (Τροποποίηση)» σημαίνει ένα έργο που υπόκειται σε
πνευματική ιδιοκτησία ή συγγενικά δικαιώματα βασισμένο στο αδειοδοτούμενο έργο
και το οποίο συνίσταται σε μετάφραση, αλλαγή, προσαρμογή ή μετατροπή ή με
οποιονδήποτε άλλο τρόπο τροποποίηση του αρχικού έργου κατά τρόπο που ν’
απαιτείται η άδεια του αδειοδότη υπόψη της νομοθεσίας περί πνευματικής
ιδιοκτησίας και συγγενικών δικαιωμάτων. Για τους σκοπούς αυτής της δημόσιας
άδειας, όπου το αδειοδοτημένο έργο είναι μουσικό έργο, παρουσίαση στο κοινό ή
ηχογράφηση, Παράγωγο Έργο υφίσταται οσάκις το αδειοδοτημένο έργο συνίσταται σε
συγχρονισμένη εικόνα και ήχο.
β. Πνευματική ιδιοκτησία και σχετικά δικαιώματα σημαίνει τα δικαιώματα της
πνευματικής ιδιοκτησίας και τα σχετικά με αυτά συγγενικά δικαιώματα στα οποία
περιλαμβάνονται τα δικαιώματα των ερμηνευτών ή εκτελεστών καλλιτεχνών, των
παραγωγών φωνογραφημάτων (των παραγωγών υλικών φορέων ήχου), των παραγωγών
οπτικοακουστικών έργων (των παραγωγών υλικών φορέων ήχου και εικόνας), των
ραδιοτηλεοπτικών οργανισμών, των εκδοτών εντύπων∙ επίσης, περιλαμβάνεται το
δικαίωμα ειδικής φύσης του δημιουργού βάσης δεδομένων (sui generis database
rights), ανεξάρτητα από το πως τα ανωτέρω δικαιώματα αναφέρονται ή
κατηγοριοποιούνται στο νόμο. Για τους σκοπούς αυτής της Δημόσιας Άδειας, τα
δικαιώματα που αναφέρονται στο τμήμα 2(β)(1)-(2) αυτής δεν προβλέπονται ως
σχετικά δικαιώματα πνευματικής ιδιοκτησίας ή δικαιώματα πνευματικής ιδιοκτησίας.
γ. Αποτελεσματικοί Τεχνολογικοί Περιορισμοί σημαίνει τα τεχνολογικά μέτρα
προστασίας που, σε περίπτωση έλλειψης κατάλληλης εξουσίας, δεν μπορούν να
παρακαμφθούν υπόψη νομικού πλαισίου σύμφωνα με το άρ.11 της Συνθήκης
Πνευματικής Ιδιοκτησίας της 20ης Δεκεμβρίου 1996 του Παγκόσμιου Οργανισμού
Πνευματικής Ιδιοκτησίας και παρόμοιων διεθνών συνθηκών.

δ. Νόμιμοι Περιορισμοί και Εξαιρέσεις σημαίνει επιτρεπόμενη εύλογη/δίκαιη
χρήση (fair use/fair dealing) ή ιδιωτική αναπαραγωγή ή άλλη εξαίρεση ή περιορισμό
στο δικαίωμα πνευματικής ιδιοκτησίας ή στα σχετικά μ’ αυτό δικαιώματα που
εφαρμόζεται στη χρήση που κάνεις επί του αδειοδοτημένου έργου.
ε. Το αδειοδοτημένο έργο σημαίνει το έργο λόγου ή τέχνης, τη βάση δεδομένων ή
οποιοδήποτε άλλο στοιχείο το οποίο ο αδειοδότης διαθέτει με αυτή τη δημόσια άδεια.
στ. Τα εκχωρούμενα δικαιώματα σημαίνει τις εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και σχετικών (συγγενικών) δικαιωμάτων που σου
παραχωρούνται από τον αδειοδότη που έχει την εξουσία γι’ αυτό για τη χρήση από
εσένα του αδειοδοτημένου έργου με την προϋπόθεση της τήρησης των όρων της
παρούσας δημόσιας άδειας.
ζ. Ο αδειοδότης σημαίνει το φυσικό ή νομικό πρόσωπο ή πρόσωπα που εκχωρούν τις
εξουσίες του δικαιώματος πνευματικής ιδιοκτησίας και συγγενικών δικαιωμάτων
σύμφωνα με αυτή τη δημόσια άδεια.
η. Μη Εμπορική χρήση σημαίνει χρήση που δεν αποσκοπεί σε εμπορικό
αντάλλαγμα ή οικονομικό όφελος. Για τους σκοπούς αυτής της δημόσιας άδειας η
ανταλλαγή αδειοδοτημένου έργου με άλλο έργο που υπόκειται σε πνευματική
ιδιοκτησία ή συγγενικά δικαιώματα με μέθοδο online διανομής αρχείων (file-sharing)
ή παρόμοια μέθοδο περιλαμβάνεται σε μη εμπορική χρήση εφόσον δεν υπάρχει
πληρωμή ή οικονομικό αντάλλαγμα σχετικό με την μέθοδο της online διανομής
αρχείων.
θ. Διανομή σημαίνει την παροχή έργου στο κοινό με οποιονδήποτε τρόπο ή μέθοδο
προϋποθέτει την προηγούμενη άδεια για την άσκηση των εκχωρούμενων εξουσιών,
όπως της εξουσίας αναπαραγωγής, διασκευής, μετάφρασης, δημόσιας εκτέλεσης,
παρουσίασης στο κοινό, διανομής, εκμίσθωσης και δημόσιου δανεισμού, εισαγωγής,

μετάδοσης μέσω δορυφόρου ή καλωδιακής μετάδοσης ή αναμετάδοσης, και διάθεσης
του έργου στο κοινό με τρόπο στον οποίο συμπεριλαμβάνεται η δυνατότητα του
κοινού να έχει πρόσβαση στο έργο από τόπο και σε χρόνο της επιλογής του.
ι. Το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης δεδομένων σημαίνει
το δικαίωμα που προβλέπεται στην Οδηγία 96/9/ΕΚ του Ευρωπαϊκού Κοινοβουλίου
και του Συμβουλίου της 11η; Μαρτίου 1996 για τη Νομική Προστασία των Βάσεων
Δεδομένων όπως αυτό έχει τροποποιηθεί και ισχύει καθώς και άλλα παρόμοια
δικαιώματα που ισχύουν οπουδήποτε στον κόσμο.
ια. Εσύ, σημαίνει το φυσικό ή νομικό πρόσωπο που ασκείς τις εκχωρούμενες εξουσίες
σύμφωνα με το περιεχόμενο αυτής της άδειας.
2. Τμήμα Δεύτερο—Σκοπός
α. Παροχή άδειας
1. Υπό την προϋπόθεση της τήρησης των όρων αυτής της άδειας, ο
αδειοδότησης με το κείμενο αυτό σου παρέχει, για όλον τον κόσμο, χωρίς
εύλογη αμοιβή, χωρίς δικαίωμα υπο-αδειοδότησης, μη αποκλειστική, μη
ανακλητή άδεια να ασκήσεις τις εκχωρούμενες εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και συγγενικά δικαιώματα επί του αδειοδοτημένου
έργου, και ειδικότερα:
Α. Την εξουσία της αναπαραγωγής και διανομής του αδειοδοτημένου
έργου, εν όλω ή εν μέρει, αποκλειστικά για μη εμπορική χρήση, &
Β. Την εξουσία της παραγωγής, αναπαραγωγής, αλλά όχι της διανομής
τροποποιημένου έργου βάση του αρχικού αδειοδοτημένου έργου.
2. Εξαιρέσεις και Νόμιμοι περιορισμοί: Προς άρση αμφιβολιών, σε περίπτωση
εφαρμογής εξαιρέσεων ή νόμιμων περιορισμών από το δικαίωμα πνευματικής
ιδιοκτησίας ή τα συγγενικά δικαιώματα, αυτή η δημόσια άδεια δεν έχει
εφαρμογή και δεν απαιτείται εσύ να συμμορφώνεσαι με τους όρους και
προϋποθέσεις αυτής της άδειας.

3. Διάρκεια: η διάρκεια αυτής της δημόσιας άδειας προσδιορίζεται στο Έκτο
Τμήμα (α) αυτής.
4. Μέσα και μορφότυπος∙ επιτρεπτές τεχνικές τροποποιήσεις: ο αδειοδότης
εκχωρεί σ’ εσένα τις αδειοδοτημένες εξουσίες από το δικαίωμα πνευματικής
ιδιοκτησίας για κάθε μέσο και μορφότυπο είτε γνωστό είτε μέλλοντα να
υπάρξει, και την εξουσία να κάνεις αναγκαίες τεχνικές τροποποιήσεις του
έργου για τη χρήση αυτού σε κάθε μέσο και μορφότυπο. Ο αδειοδότης
παραιτείται από ή/και συμφωνεί να μην ασκήσει δικαίωμα του για να σου
απαγορεύσει να κάνεις τεχνικές τροποποιήσεις αναγκαίες για να ασκήσεις τις
εκχωρούμενες εξουσίες, συμπεριλαμβανομένων τεχνικών τροποποιήσεων του
έργου που είναι αναγκαίες για την παράκαμψη αποτελεσματικών
τεχνολογικών μέτρων προστασίας του έργου. Για τους σκοπούς αυτής της
δημόσιας άδειας, η διενέργεια τροποποιήσεων που προβλέπονται στο Τμήμα
Δεύτερο (α)(4) αυτής της άδειας δεν θα συνιστά παράγωγο έργο.
5. Περαιτέρω χρήστες.
Α. Εκχώρηση από τον αδειοδότη—αδειοδοτούμενο έργο: κάθε χρήστης
του αδειοδοτούμενου έργου γίνεται εκδοχέας αυτόχρημα από τον
αδειοδότη των εκχωρούμενων εξουσιών από το δικαίωμα της
πνευματικής ιδιοκτησίας υπό τους όρους και τις προϋποθέσεις της
παρούσας δημόσιας άδειας.
Β. Απαγόρευση περιορισμών περαιτέρω χρήσης: Σου απαγορεύεται να
επιβάλλεις ή προτείνεις πρόσθετους ή διαφορετικούς όρους ή
προϋποθέσεις, ή να εφαρμόσεις αποτελεσματικά τεχνολογικά μέτρα
προστασίας στο αδειοδοτούμενο έργο, εάν από την επιβολή, πρόταση ή
εφαρμογή τέτοιων όρων, προϋποθέσεων ή τεχνολογικών μέτρων
περιορίζεται η άσκηση των εκχωρούμενων εξουσιών από το δικαίωμα
πνευματικής ιδιοκτησίας από οποιονδήποτε χρήστη του
αδειοδοτημένου έργου.
6. Μη αναγνώριση. Το περιεχόμενο αυτής της δημόσιας άδειας δεν συνιστά
ούτε μπορεί να ερμηνευτεί ότι συνιστά παροχή άδειας σε εσένα, ούτε συνιστά

ερμηνεία κατά τον ίδιο τρόπο των χρήσεων του έργου που εσύ κάνεις, ώστε να
εμφανίζεσαι ή να επικαλείσαι ότι δήθεν σχετίζεσαι με τον αδειοδότη δημιουργό
του αδειοδοτούμενου έργου ή με τρίτους στους οποίους γίνεται αναφορά
σχετικά με το αδειοδοτούμενο έργο σύμφωνα με τα προβλεπόμενα στο Τρίτο
Τμήμα (α)(1)(Α)(i) αυτής της άδειας, με σχέση χορηγίας, συναίνεσης ή
επίσημης αναγνώρισης.
β. Άλλα δικαιώματα.
1. Οι εξουσίες από το ηθικό δικαίωμα της πνευματικής ιδιοκτησίας όπως η εξουσία
περιφρούρησης της ακεραιότητας του έργου, δεν περιλαμβάνονται στο
περιεχόμενο των εκχωρούμενων εξουσιών αυτής της δημόσιας άδειας, ούτε
περιλαμβάνονται σ’ αυτό δικαιώματα περί την ιδιωτικότητα, την προσωπικότητα ή
παρόμοια δικαιώματα. Εντούτοις, και στο βαθμό που αυτό είναι αναγκαίο για να
ασκήσεις τις εκχωρούμενες με την άδεια αυτή εξουσίες, ο αδειοδότης παραιτείται
από ή/και συμφωνεί να μην ασκήσει τέτοια δικαιώματα ή εξουσίες των οποίων
είναι δικαιούχος προκειμένου να σου επιτραπεί ή άσκηση των εκχωρούμενων
εξουσιών και όχι για άλλο λόγο.
2. Δικαιώματα επί ευρεσιτεχνιών ή δικαιώματα επί εμπορικών σημάτων δεν
περιλαμβάνονται στο περιεχόμενο αυτής της δημόσιας άδειας.
3. Στο βαθμό που αυτό επιτρέπεται από το νόμο, ο αδειοδότης παραιτείται από το
δικαίωμα είσπραξης αμοιβής από εσένα για την άσκηση των εκχωρούμενων
εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας, είτε απευθείας είτε μέσω
οργανισμού συλλογικής διαχείρισης μέσω εθελοντικής ή αναγκαστικής παροχής
αδείας για την είσπραξη της αμοιβής. Σε κάθε άλλη περίπτωση, ο αδειοδότης ρητά
επιφυλάσσεται για την άσκηση του δικαιώματός του να εισπράξει αμοιβή από την
εκχώρηση εξουσιών του δικαιώματος πνευματικής ιδιοκτησίας του για κάθε χρήση
του έργου του πλην των μη εμπορικών χρήσεων.
3. Τμήμα Τρίτο—Προϋποθέσεις αδειοδότησης
Η εκχώρηση ορισμένων εκ των εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας σε
εσένα περιλαμβάνει τα εξής:

α. Αναφορά δημιουργού
1. Εφόσον μοιράζεσαι το αδειοδοτημένο έργο, οφείλεις:
Α. Να διατηρείς τις παρακάτω αναφορές στο αδειοδοτημένο
έργο εφόσον αυτές έχουν περιγραφεί από τον αδειοδότη:
i. Αναφορά του/των δημιουργού/-ών του
αδειοδοτημένου έργου καθώς και αναφορά σε
οποιονδήποτε τρίτο ορίζεται ότι πρέπει να
αναφέρεται, με κάθε εφικτό τρόπο που
προσδιορίζεται από τον αδειοδότη
συμπεριλαμβανομένης της αναφοράς με ψευδώνυμο
αν αυτή ζητείται.
ii. Αναφορά της ισχύος δικαιωμάτων πνευματικής
ιδιοκτησίας.
iii. Αναφορά της παρούσας δημόσιας άδειας
iv. Αναφορά της σημείωσης για την αποποίηση ευθύνης
και παροχή εγγυήσεων.
v. Αναφορά του Κανονιστικού Αναγνωριστικού Πόρου
(URI) ή του υπερσυνδέσμου του αδειοδοτούμενου
έργου στο βαθμό που αυτό είναι δυνατόν.
Β. Να παρέχεις ενδείξεις για τις τροποποιήσεις του
αδειοδοτούμενου έργου που έκανες, καθώς και ενδείξεις για
κάθε τροποποίηση που έγινε πριν από τις δικές σου.
Γ. Να παρέχεις ενδείξεις ότι το αδειοδοτούμενο έργο υπόκειται
στους όρους αυτής της δημόσιας άδειας, και να
συμπεριλαμβάνεις στις ενδείξεις αυτές είτε το πλήρες κείμενο
αυτής είτε το Κανονιστικό Αναγνωριστικό Πόρου (URI) ή τον
υπερσύνδεσμο αυτής της δημόσιας άδειας.
2. Μπορείς να ικανοποιήσεις τους όρους της αναφοράς σύμφωνα με
το Τρίτο Τμήμα (α)(1) αυτής της άδειας με κάθε εύλογο τρόπο
υπόψη του μέσου και των δεδομένων του τρόπου με τον οποίο

μοιράζεσαι το αδειοδοτούμενο έργο. Για παράδειγμα, μπορεί να
συνιστά εύλογο τρόπο ικανοποίησης της υποχρέωσης αναφοράς η
παροχή του Κανονιστικού Αναγνωριστικού Πόρου (URI) ή του
υπερσυνδέσμου μιας πηγής στην οποία υπάρχει η απαιτούμενη
πληροφόρηση για την αναφορά του αδειοδοτούμενου έργου.
3. Εφόσον απαιτηθεί από τον αδειοδότη, πρέπει να αφαιρέσεις
οποιαδήποτε αναφορά από τις προβλεπόμενες στο Τρίτο Τμήμα
(α)(1)(Α) στο βαθμό που αυτό είναι εφικτό.
4. Τμήμα Τέταρτο—Το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης
δεδομένων
Όπου η εκχώρηση εξουσιών από το δικαίωμα πνευματικής ιδιοκτησίας περιλαμβάνει
το δικαίωμα ειδικής φύσης του κατασκευαστή βάσης δεδομένων προκειμένου να
κάνεις χρήση του αδειοδοτούμενου έργου, τότε:
α. Προς άρση αμφιβολιών το περιεχόμενο του Δεύτερου Τμήματος (α)(1) σου
παρέχει το δικαίωμα να εξάγεις, κάνεις χρήση, αναπαράγεις ή διανείμεις το
σύνολο ή σημαντικό μέρος εκ του περιεχομένου της βάσης δεδομένων
αποκλειστικά για μη εμπορικό σκοπό.
β. Αν περιλαμβάνεις το σύνολο ή σημαντικό μέρος εκ του περιεχομένου της
βάσης δεδομένων σε βάση δεδομένων στην οποία εσύ έχεις δικαίωμα ειδικής
φύσης κατασκευαστή βάσης δεδομένων, τότε η βάση δεδομένων (και όχι τα
περιεχόμενά της) στην οποία εσύ έχεις δικαίωμα ειδικής φύσης είναι παράγωγο
έργο για το σκοπό και την έννοια του Τρίτου Τμήματος (β)∙ και
γ. Οφείλεις να συμμορφωθείς με τους όρους του Τρίτου Τμήματος (α) εφόσον
μοιράζεσαι το σύνολο ή σημαντικό μέρος εκ του περιεχομένου της βάσης
δεδομένων.
Προς άρση αμφιβολιών, το Τέταρτο Τμήμα προβλέπει συμπληρωματικές υποχρεώσεις
σου και δεν αντικαθιστά τις προβλεπόμενες σε άλλα τμήματα υποχρεώσεις σου όπως
περιγράφονται σε αυτή τη δημόσια άδεια ως εκχωρούμενες εξουσίες από το δικαίωμα
πνευματικής ιδιοκτησίας και συγγενικά δικαιώματα.

5. Τμήμα Πέμπτο—Εγγυήσεις και Περιορισμός της ευθύνης
α. Εκτός αν άλλως ορίζεται από τον αδειοδότη σε διαφορετικό κείμενο, ο
αδειοδότης παρέχει το αδειοδοτούμενο έργο «ως έχει» και «όπως διατίθεται» και
δεν παρέχει καμία εγγύηση σχετικά με το αδειοδοτούμενο έργο είτε ρητή είτε

αυτό επιτρέπεται από το νόμο, να ισοδυναμεί με πλήρη περιορισμό της νομικής
ευθύνης και παροχή καμίας εγγύησης.
6. Τμήμα Έκτο—Διάρκεια και Παύση
α. Αυτή η δημόσια άδεια περί την εκχώρηση εξουσιών από το δικαίωμα
πνευματικής ιδιοκτησίας έχει διάρκεια για όλο το χρόνο ισχύος του
δικαιώματος πνευματικής ιδιοκτησίας και των σχετικών δικαιωμάτων. Ωστόσο,
σε ενδεχόμενη μη συμμόρφωση με τους όρους αυτής της δημόσιας άδειας, τότε

παύει αυτοδίκαια η εκχώρηση των εξουσιών από το δικαίωμα πνευματικής
ιδιοκτησίας και σχετικών δικαιωμάτων.
β. Σε περίπτωση παύσης των εκχωρούμενων εξουσιών επί του αδειοδοτούμενου
έργου σύμφωνα με το Έκτο Τμήμα (α), τότε μπορεί:
1. Να γίνει αποκατάσταση της προτέρας της παύσης εκχώρησης των
εξουσιών του δικαιώματος πνευματικής ιδιοκτησίας και σχετικών
δικαιωμάτων εφόσον υπάρξει άρση της προσβολής των δικαιωμάτων
εντός τριάντα ημερών από τη δική σου γνώση της αιτίας της
προσβολής. Για την αποκατάσταση αυτή δεν απαιτείται άλλη
προϋπόθεση.
2. Να γίνει αποκατάσταση της προτέρας της παύσης εκχώρησης των
εξουσιών του δικαιώματος πνευματικής ιδιοκτησίας και σχετικών
δικαιωμάτων εφόσον υπάρξει σχετική ρητή δήλωση του αδειοδότη.
Προς άρση αμφιβολιών, αυτό το Έκτο Τμήμα (β) της άδειας δεν καταργεί ούτε άλλως
επηρεάζει δικαίωμα του αδειοδότη να αξιώσει αποζημίωση για την παραβίαση από
εσένα δικαιωμάτων του από αυτή τη δημόσια άδεια.
γ. Προς άρση αμφιβολιών, ο αδειοδότης μπορεί να παρέχει το αδειοδοτούμενο
έργο με διαφορετικούς όρους ή προϋποθέσεις ή να παύσει τη διανομή του
αδειοδοτούμενου έργου οποτεδήποτε. Ωστόσο, εφόσον ενεργήσει έτσι, αυτό δεν
σημαίνει ότι παύεται αυτή η δημόσια άδεια.
δ. Η ισχύς των οριζόμενων στα Τμήματα Πρώτο, Πέμπτο, Έκτο, Έβδομο και
Όγδοο αυτής της άδειας διατηρείται παρά την λήξη της ισχύος αυτής της
δημόσιας άδειας.
7. Τμήμα Έβδομο—Λοιποί Όροι και προϋποθέσεις
α. Ο αδειοδότης δεν δεσμεύεται από τυχόν πρόσθετους ή διαφορετικούς όρους
και προϋποθέσεις που προτείνονται από εσένα εκτός αν έχει αυτό συμφωνηθεί
ρητά.
β. Οποιαδήποτε συμφωνία, κατανόηση, ή πρόταση όρων σχετικά με το
αδειοδοτούμενο έργο που δεν περιγράφεται στο περιεχόμενο της παρούσας

άδειας συνιστά περιεχόμενο ξεχωριστό και διακριτό από το περιεχόμενο των

8. Τμήμα Όγδοο—Ερμηνεία
α. Προς άρση αμφιβολιών, αυτή η δημόσια άδεια δεν αποσκοπεί και δεν θα
ερμηνεύεται ωσάν να αποσκοπεί να μειώσει, περιορίσει, δεσμεύσει ή επιβάλλει
περιορισμούς σε οποιαδήποτε χρήση του αδειοδοτούμενου έργου που θα
μπορούσαν να γίνουν σύννομα (νόμιμοι περιορισμοί και εξαιρέσεις) χωρίς την
