The Nomination papers were taken up for scrutiny at 11.00A.M. During the course of scrutiny when the three nomination papers of sri. syed Mudeer Aga was taken up for consideration there was an objection by the ElectionAgent of sri. Banuprakash as well as the Election Agent of sri. Iqbal Ahmed saradagi , they contended that the nomination paper of sri.Syed Mudeer Aga should be rejectedon that grounb that the Affidavit is on a Stamp paper of Rs.20l- and not Rs.50/- as stated in the instructions to the candidates issued by the office. Then the nomination papers sl.No.Ig and l9 of sri.rqbal Ahmed saradagi were taken up for scrutinr,.candidate sri.D.s.veeraiah raised objections that sri.IqbalAhmed saradagi has filed Affidavit on a stamp paper varueof Rs.20l- and not Rs.50/- as stated in the instructions toCandidates.

They have fired written objections and copies wereserved on the respective candidates and they were giventime to rebutt the objections in writing before 3.00 p.M. on02.06.2012.

since similar objections have been raised on thenomination papers of sriyuths tqbal Ahamed saradagi,syed Mudeer Aga and B.s. suresh. I considered theirnomination papers together.

Now the following points are for consideration :-

(1) whether instructions to candidates issued afongwith the nomination papers are binding.

(2) whether the nomination papers of (a) sri syedMudeer Aga (b) sri B.s. suresh and sri tqbaf Ahmadsaradagi who have fifed affidavits with a stamp paper ofvalue of Rs.20l- are liabfe for rejection.

fn the Instructions to candidates(item No.7) it has beenmentioned that affidavits must be on Rs.50/- stamp papersduly sworn in before first cfass Magistrate/Notary. Instructionsto the candidates prepared by the office was suppfied atongwith the nomination papers and they are onry to hetp thecandidates to fite their nomination papers and thoseinstructions are not above the taw prevaifing in the state. fnview of aforesaid articfe 4 of-stamp Act the statement in theinstructions is not correct.

Article 4 of the schedure to Karnataka stamp Act 1957 isas foflows:

Hence, according to the faw in force in the state stamprequired for an affidavit is Rs,20l- .

At the time of scrutiny of nomination papers I havebrought to the notice of atf the candidates and theirrepresentatives the folrowing guidelines in the handbook forreturning officers.

Presumption of Validitv

There is a presumption that every nomination paperis valid Unless the contrary is prima facie obvious or has beenmade Out. In case of a reasonable doubt as to the validity ofa Nomination paper, the benefit of such doubt must go to theCandidate concerned and the nomination paper should beheld to be valid. Remember that whenever a candidate'snomination paper has been improperly rejected and he isprevented thereby from contesting the election, there is alegal presumption that the result of the election has beenmaterially affected by such improper rejection and theelection will, therefore, be set aside. There is no such legalpresumptionnecessarily in the converse case where a candidate'snomination has been improperly accepted. It is always safer,therefore, to be comparatively more Iiberal overlookingminor technical or clerical errors rather than strict in yourscrutiny of the nomination papers, and the AssistantReturning Oflicer has read the provisions regarding groundsfor rejection of nomination paper.

The Election Commission of India in its letter dated 1$

September 2011, has stated regarding affidavits to be filed by

the candidates along with their nomination papers as follows:

"(lV) The affidavits are required to be swornbefore a First Class Magistrate or a Notary Public.fn a Writ Petition (No.8682 of 2011 and M.P. No.1 of2011) the Hon'ble Madras High Court has directedthat the duly sworn affidavits shoufd be on stamppaper of the vaf ue of Rs.20/-.

(V) The value of Stamp paper for affidavits isprescribed under the State Act and hence variesfrom State to State. In view of the abovementioned order of the Hon'ble Madras HighCouit, the Commission has directed that in futurethe affidavits to be filed by the candidates (inStates other than Tamilnadu) should be on stamppaper of such denomination as prescribed under t

the State Law of the State concerned on thesubject. In Tamilnadu the affidavit should be onRs.20l- stamp paper as per the direction of theHon'ble High Court."

According to the clarif ications of Election Comrnission

the candidates have to file their affidavits on stamp paperc as

per the law prevailing in the State. The law prevailing in the

State of Karnataka regarding filing affidavits is the Karnataka

Stamp Act 1957. As per the said Act, vide Art. 4 in the

schedule, stamp value prescribed for filing Affidavit is Rs. 20-

and not Rs.50/- as stated in the instructions to the candidates.

Those instructions do not modify the law.

Accordingly I f ind no merit in the objections and t

pronounce the following order.

ORDERAfter taking into consideration alt the facts, provisions

of stamp Act and Rules, I hold that the affidavits fi led by Sri

Syed Mudeer Aga, Sri B.S. Suresh and Sri lqbal Ahmad

Saradagi are in accordance with law and that the nomination

papers of Sri Syed Mudeer Aga, Sri B.S. Suresh hnd Sri lqbat

Ahmad Saradagi are valid and I accept them.

Order is pronounced today, Monday, the 4th June 2A12.

' >/ Now I take up the objections raised regarding the nominationpape:s of the sri K.Govindraj. sri Raghunath Rao Mafkapurethrough his representative Mr.Vivek S Reddy raised objection thatSri K.Govindaraj is holding an office of profit and is disqualified underArt.191 of Constitution of India as he is President of Karnatakaolympic Association and member of Sports Authority of Karnataka.

I permitted them to file their written objections if any andgave time to Sri K. Govindraj for rebutting the objections by 3.00 pM

on 2nd June 2012 and informed them that the matter will be taken upfor consideration on Monday 4th June 2012 at 10.00 AM.sri K. Govindaraj, filed written objections. I heard both sides.

Following point arises for consideration and decision.

whether sri K.Govindaraj by virtue of being president,

Karnataka olympic Association and also being a Member of sportsAuthority of Karnataka is disqualified under Article 191 of theConstitution.

Articfe 191 reads thus:

"191 Disqualif ication for membership. A person shalf be

disqualified for being chosen as, and for being a member of theLegisfative Assembfy or Legislative Council of a State -

(a) if he holds an office of profit under the Government of

fndia or the Government of any state specifled in the

extracted above. Hence Sri K. Govindaraj is not disqualif ied under

art icle 191 of the Constitution. Payment of remuneration if any is nct

relevant.

Both the organizations are covered under Karnataka

Legislature (Prevention of disqualif ication) Act, 1956,(Act 4 of 1957).

Hence there is no merit in the objections raised regarding the

nomination paper of Sri K. Govindaraj.

Therefore, I pronounce the following order:

ORDER

The nomination papers of Sri K. Govindaraj is valid and I accept

the same.

This order is pronounced this day the Monday, the 4th June

2012 .
