Reserve for Xatives should be declared at Korseman: Now, therefore, I, the saic1 Lieutenant­Govemor, ,,·ith the advice of the Executive Council, c1o hereby declare an area. of 19,745 acres in tl1c Dundas district, more particularly described in the Schedule hereto, to be a Rosene for Natives.

WHEREAS it is enacted by section 10 of the Native Administration Act, 1905-1941, that the Governor may by Proclamation declare ancl Crown Lancls to be Reserves for Natives ancl abolish any reserve so cleclarecl; and ,vhereas by Proclamations issued uncler the Native Ad­ministration Act, 1905-1941, and published in the Gov­ernment Gazette on the 16th clay of August, 1940, and the 4th clay of June, 1943, the Governor c1eclarecl an area at Norseman, more particularly clescribecl as reserve 22179, and clefinecl in the Schedule to such Proclamations to be a Reserve for Nati\·es; ancl whereas it is now deemed desirable and expedient to abolish the saic1 re­serve: Xow, therefore, I, the said Lieutenant-Governor acting. with the advice and consent of the Exccutiv~ Council ancl in exercise of the power in that behalf conferred bv section 10 of the Kntive Administration Act, 1905-1941, c1o hereby abolish the Reserve for Natives as c1eclarecl and clescribecl ancl clefinec1 in the hereinbefore mentioned Proclamations published in the Goi,ermnent Gazette on the 16th clay of August, 1940, anc1 4th day of ,Tune, 1943, as aforesaid.

WHEREAS the Council of the Municipality of Kalgoorlie has certified to me that, under the provisions of the Municipal Corporations Act, 1906-38, the seYeral sums set forth in the schedule hereunder are now due and unpaid by the persons whose names are set opposite the said sums as the registered proprietors of the pieces of land situated and described in the Certificate of Title, ancl containing the measurements, more or less, all as set forth in the Schedule, being arrears of rates and interest due to such Council in respect of such land; and whereas such Council has required me, after the expiration of three months from the date thereof, to issne my warrants of (•xeeution against such lands, unless the. moneys mentionen. in such 8d1cdnlc are sooner pai<l: This is to give notice niat in pursnancc of such Certificate I shall issue my Warrnnts of Execution accordingly at the expiration of three months from the date thereof, unless the abovemcntioned sums ac·erne,1 due on the land to the lfith clay of "Febrnar.v, Hl46, and all expenses incurred arc sooner paid.

AlJ 01·ertilllc shall stand alone and be paid for iu addition to the ordinary wage, at the rate of time ancl a quarter for the first t,rn ( 2) homs and time and a half thereafter.

Ovntime shnll be paid for all time of duty:-· (a) in excess of the hours prescribed in Clause 3; or (b) after eight and one-half (81/2) hours on Mon­

da:i-s to Fridays inclusive and eight (8) hours on Saturdays; or

( c) before the prescribed stm-ting time or after the prescrihed ':flnishing time.

,3.-Holiday Pay. }'or all time of cluty on holidays ( see definitions),

payment shall be made at the rate of ordinary time ( one day's pay) in ucldition to the weekly ·wage, except on Good Friday and Christmas Day, when all time on rluty shall be paid for at the rate of one and a half fln~- 's pay in addition to the weekly wage. Any ,rnrker required to work on a holiday shall be paid at least half a day's wage at holiday rate.

The provisions of clause 7 as to starting time shall not apply to deli\'ering to ships at J<'rernantlc or hos­pitals.

13.-'J'enn.

In the cYent of the holidays 1n·oscrihcd under 'l'he Bread Act, Hl03-1H38, being rnrietl or cancelled, letwe to appl,1- to the Court for a Yariation of clauses 5, 1:5 ( e) and 16 is hereby resened to any party hound by this Award.

14.-Ueneral Conditions.

(a) A copy of this Award shall lie kept in a place where the industry is being canicd on ,Yherc it is easil"­aecessiblo to the workers.

(b) ,Juniol'S may he employed in the following pro­portion: One junior to enry fiyc (5) adult hread cart­ers employed.

( c) Not more than one easnal hand may be employed at any time, and then only where there arc three ( 3) weekly workern employed.

( d) Employers shall, when engaging workers, state definitely whether such 1YOrker is engaged as weekly or cnsual hand.

(e) Employers shall notify their workers on the ,rnrk­ing· clay immediately preceding a holiday if their sn­Yices are required nPxt day. }'ailing such notice, the ,rnrker shall be entitled to take the holiday and to receiYe a full week's wage.

15.-Definitions. ( a) ''Junior'' shall mean any person under tlw age

of twenty-one (21) years in receipt of less than adult

(b) '' Casual hand'' s1iall mean a worker engaged as such, whose contract of service shall be an hourly one ten11inable at any time without notice.

(c) 'l'he "RepresentatiY0 of the Union" shall mean any person authorised in writing by the president and secrebuy of the Amalgamated Roac1 Transport Union of Workern, Perth.

( cl) '' Bread carter'' shall mean and include any person employed delivering or conveying bread any\\'here other than at the shop or bakehouse of his employer.

(a) A Board of Reference is hereby appointed fol' the purposes of the Award. Such Board shall consist of a clrnirmnn and two (:2) other representatives, one to be nominated by each of the parties. There arc a~signed to such Boanl, in the (•Ycnt of no agreement being nnhecl at bebrnen the pnrties to the Award, the function of-

( i) adjusting any matters of clifferenee which may a rise between the parties from time to time, exce1;t such as im·olve interpretations of the provisions of 1:lw A,rnrc1 or any of them;

(ii) classifying ancl fixing wages, rates and con­ditions for any occupation or c:illing not specifically 111entioned in the Award;
