RESIDENTIAL MOBILE HOME PARKS BY-LA!,]

A By-law t o regulate the establishment, extension, design and servicing of mobile home parks, pursuant t o Section 714 of the Municipal Act.

WHEREAS sec t ion 709(1) of the Municipal Act allows the Board of Variance t o hear and determine any appeal by a person ~ iho al leges t h a t enforcement of the s i t i n g requirements within a mobile home park under a by-law pursuant t o 714( i ) would cause h i m undue hardship; i n which case t h e Board may t o the extent necessary t o give e f f e c t t o ii;s determinat ion, authorize such minor variance from the applicable provisions of t h e by-law as , i n i t s opinion,

( i ) is desirable f o r t he appropriate development of t h e s i t e ,

( i i ) maintains the general i n t en t and purpose of t he by-law,

"mobile home park" means any parcel of land on which are located two o r more mobile homes any one of which is l e s s than 91 m (298.5 f t . ) from any other mobile home on t h a t parcel and f a c i l i t i e s c l ea r ly a n c i l l a r y to the mobile homes in t h a t park and which may incl ride

roads, u t i 1 i t y se rv ices , garbage disposax si t e s , buf fe r a reas , a dwelling uni t f o r the accommodation of the ownerjoperator, recreat ion a r ea s , i d e n t i f i c a t i o n s igns , tenant s to rage a reas , comon s t o r a g e a reas f o r the s torage of those recreat ional veh ic les . boats and s imi l a r items belonging t o the occupants of the park, and buildings or s t ruc tu re s anc i l l ary t o t h e above;

"mobile home space" means an area of land f o r t h e i n s t a l l a t i o n of one mobile home with permiss ib le addit ions and s i t ua t ed within a mobile home area ;

"mobile home pad" means t h a t portion of a mobile home space, designated, designed and prepared f o r t h e support of a mobile home. I t may contain s e r v i c e connections ;

"owner" means a reg is te red owner, o r agent , l e s s o r , o r manager o f , o r any person who operates , a mobile home park;

"potable water" means water which is apporved f o r d r ink ing purposes by the Medical Health Off icer i n accordance w i t h the Health Act;

"Regional Board" means t he governing and execut ive body of t he Regional D i s t r i c t of Fraser-Cheam;

"Regional D i s t r i c t " means the Regional District o f Fraser- Cheam as incorporated pursuant t o t h e Municipal Act;

(b ) cause o r allow a mobile home t o be parked o r t o remain i n a mobile home park

i n contravention of t h i s by-law.

( 1 Subject t o sec t ion 1.06 ( 2 ) the prov is ions o f t h i s by-law do not apply t o a mobile home park o r any p a r t of a mobile home park e x i s t i n g p r i o r t o coming i n t o ' f o r c e of t h i s by-lsw.

( 2 ) No person sha l l be compelled t o upgrade e x i s t i n g parks t o the standards of t h i s by-law; b u t any up- grading sha l l not lessen the compliance wi th the by-law and expansion s h a l l meet by-law provis ions .

Administration

1.07 (1) The Building Inspector o r such other person appointed by the Regional Board sha l l administer t h i s by-law.

(2) Persons appointed under subsection (1) may enter any mobile home park a t any reasonable time f o r the purpose of administering o r enforcing t h i s by-law.

Violation

1.08 (1) I t sha l l be unlawful f o r any person t o cause, s u f f e r o r permit the establishif*nt, extension, o r operation of a mobile home park i n contravention of t h i s by-law o r otherwise t o contravene o r f a i l t o comply w i t h t h i s by-law.

(2) I t s h a l l be unlawful f o r any person t o prevent o r obs t ruc t any o f f i c i a l appointed under sub- sec t ion (1) of sect ion 1.07 from carrying out h i s du t ies under t h i s by-law.

MOBILE HOME PARK APPLICATION, APPROVAL AND PERMIT

Application Plans and Specif icat ions

All applications f o r approvzl of plans and specif icat ions s h a l l be made i n wri t ing and sha l l contain

( a ) the name and address of t he applicant;

(b ) the intended use of the land;

(c ) a general description of the locat ion of the land and the f u l l legal descr ipt ion of the land on which the proposed niobile home park i s t o be es tabl ished, constructed, a1 t e r ed , o r extended;

(d) a map sho>~ing the locat ion of the source o f t he proposed water supply, and the l oca t ion and e x t e n t of the area proposed f o r sewage d i sposa l , waste- water disposal , and garbage disposal ;

( e ) two f u l l s e t s of working drawings t o s c a ? e showing:

Approval and Permit ..

(1) No person s h a l l locate ,es tabl ish , c o n s t r u c t , a l t e r , extend expand o r subdivide a mobile home park u n t i l w r i t t e n approval of de t a i l ed plans and s p e c i f i c a t i o n s is received and permit issued by the Inspec tor .

(2) Written approval and permit under subsec t ion (7) sha l l not be given u n t i l a sewage d i sposa l permit has been issued, water supply and system and garbage disposal msthod has been approved by the au thor i ty having ju r i sd i c t i on .

( 3 ) The Inspector s h a l l examine each complete appl icat ion f o r a mobile home park permit and s h a l l no t i fy the appl icant i n wri t ing rqithin 60 days e i t h e r t h a t t he perniit i s issued o r t h a t i t is refused.

( 4 ) The Inspector may:

( a ) require the appl icant t o provide addi t ional re levant information, including b u t no t l imi ted t o topographic and s o i l condit ion data ;

(b) conduct inspect ions and t e s t s in the v i c in i t y of the s i t e of the proposed mobile hone park.

(5 ) I f the issuance of a mobile home park permit is refused, the Inspector sha l l not i fy the appl icant i n wr i t i ng of t h e reasons f o r refusal .

(6 ) A mobile home park permit sha l l permit t he establishment of a mobile home park on the

(d) The value of construction s h a l l be the cont rac t p r ice together with a reasonable allowance f o r ex t ras o r such construction value t o be calculated o r f ixed by the Building Inspector according t o the submitted plan and spec i f i ca t i ons .

GENEWL PROVISIONS

No person sha l l locate a mobile home o r o!inerrs residence except on a well-drained s i t e t h a t is a t a l l t imes f r e e of stagnant pools, and i s graded f o r rapid drainage.

SEWAGE SYSTEMS

The owner of a mobile home park sha l l provide f o r the disposal of a l l wastewater and of a l l body wastes t h a t a re generated within the mobile home park by providing a sewage system connected t o a l l plumbing f i x tu re s and sewage l a t e r a l s i n the mobile home park.

In each mobile home space a l a t e r a l sevrer terminus sha l l be gas t i g h t , protected from mechanical dcmage and protected from storm water i n f i l t r a t i o n .

A l l outdoor vents where required shal l extend 2 m (6.552 f t . ) above the surrounding grade. Outdoor vents sha l l be securely fastened t o a 90 mm by 90 mm (3.543 i n . by 3.543 in . ) c~inimum wood- preservat ive- t reated cedar post securely embedded in t he ground o r have equivalent support .

A cleanout sha l l be i n s t a l l e d wherever a sewer-line changes d i rec t ion more than 45 degrees. All outdoor cleanouts sha l l be c a s t iron t h a t shall be access ible ; t h e i r posi t ion sha l l be indicated on the ground. All pa r t s of any cleanout extension sha l l be c a s t i ron and terminate a t a protected locat ion e i t h e r below access covers o r in a concrete pad. A cleanout may be omitted a t the upstream end of a sewer-line serving mobile homes, provided t h a t the uppermost terminus services a mobile home and i s designed and i n s t a l l e d f o r use as a cleanout point .

( a ) the s to r age and disposal of inflammable l iqu ids and o i l s ;

( b ) the i n s t a l l a t i o n , maintenance, ca r r iage , and use of compressed-gas systems

a r e required t o be i n accordance w i t h the regulat ions of the Fire Marshal Act.

Any garbage t h a t i s t o be disposed of on the parcel on which the mobile home park is s i t u a t e d is sub jec t t o t he requirements of the Po:] ution Control Act, 1967.

Any sewage system i n a mobile home park o r elsewhere i s required t o be designed and approved pursuant t o e i t h e r the Health Act o r the Pol lut ion Control Act, 1967 whichever appl ies .

A l l e l e c t r i c a l wiring and i n s t a l l a t i o n s i n a wobile home park o r elsewhere a r e sub j ec t t o the provision of t he Electr ical Energy Inspection Act.
