4. A meeting of the Task folce, formed for speedy implementation of targets set for

public transport inder the Accessible lndia Campaign, was held on 24 7 2019 to discuss

issues relaling to retlo-fitment in the on-road old buses'

5, After detailed deliberations in the said meeting, it was decided that all the STUsmay ellsule implementation ofthe following as part ofthe Accessible India Campaign:

i. All the bus stops ard bus portv terminals should be made firlly accessible.

ii. All the buses op€rated by the STUS/STCs may be made disabled-friendly ina time bound manner.

Sufficient number of wheelchairs for differendy abled passengers may bemade available at all bus ports/ terminals.

Properly visible and marked space be made available at all bus stops, ports/terminals.

Proper signages be fixed at appropriate places indicating seats for differentlyabled.

Adequate handrails and provision ofhuman assisranc€ be made available tothe differently abled passengers.

Audio-visual infonnation systems for visually and heariry impairedpassengen may also be made available in the buses.

Emergency button provision near the seat of the designated disabled s€at

may be made.

Where ramp is not possible, povision may b€ made fo! human assistance

for the differently abled passengeN to facilitate to board the buses.

6. This Minisrry has been communicating with the states regularly to achieve the

targets of Accessible India Campaign. For ready reference the earlier communications

issued to the States are listed below:

i. Letter No RT-l l0l7l07/201l -MVL dated 56 May, 20tl(copy enctosed)

legarding procedure for alteration in Motor vehicles to facilitate the

mobility of physically challenged person.

ii. Letter RT-l l02l/40/2014-Mvl dated 14-06-2016 (copy enclosed),

Ministry detailing the procedure for guidelines for grant of driving lic€nces

& regist ation certificates to differently abled persons.

iii. Advisory dated 26n June, 2018 issued by this Ministry (copy enclosed) for

undertaking various steps to achieve the targets of Accessible India

Campaign.iv. Advisory dated 21.11.201'1 to States/ Uts (copy enclosed) regarding

procedure for providing driving license for persons having monocular

Recentty in the meeting of Committee of Secreta.ies hetd on Zt,,January 2019 itwas decided that the M/o Road Transport and Highways may ensure that at teast 25ts ofGovernment owned public transport is made fu(y accessible by March ZO19. AIL bus stopsand terminals may arso be made ac(essible in coordination with States/ urs. rn thisregard, Secretaries of MoRIH and DEpwO would also be conducting a iojnt videoconferencing with MD of SRTUs and concerned officiats of States/ UTs for f-o[ow up.4. Accordingly, the State Gova./ UTs are requestecl to undertake the following steprto achieve the targets of Accessible lndia Campaign: _

li 25% of Govt, owned public transport vehicles as we[ as att the privare passengervehicles shoutd be made tulty accessibte by March 2019.

(ii) lmmediate actions to be taken to make all bus stops/ terminals/ports Accessiblefor the use of persons with DisabiUties.

(iii) Exptore feasibitity and take immediate steps for retro-fitment of buses jnctudinginnovative sotutions such as providing wooden or metaltic pfank to provide easyaccess to wheel chaired passengers.

(iv) Facittties for speedy Licensing and registration may be provided to differenttyabted persons.

5. The achievements of targets of A€cessible lndia Campaign made by STUS/ SRll.Jsare enctosed at annexure.

6. This Ministry has been Communicatiog with the states aegutarly to achjeve thetargets of Accessible lndia Campaign. For ready reference these are listed betow:

(i) Letter No RT-ji017/07l2O1.t.MVL dated 5'n May, 20.t1(copy enclosed) regardingprocedure for alteration in Motor Vehicles to facilitate the mobitity of physicallychalleoged person.

(iv) Advisory dated 2'1.11.2017 to States/ UTs (copy enctosed) regarding procedure forproviding driving ticense for persons having monocutar visions.

7. This Ministry has also notified BUS BODY CODE: AIS:O5Z vide notification cSR 287(E) dated 22-04.2014, which contains speciat provisions for Oisabled passengers.

8. The Llinistry has from time to time b€en reminding all the State Road TransportUnde.takings {5RTU5) to furnish the status o, accessibte buses. The progress is listed in theAnnexure to this tetter. The progress of the SRTUS of your state ray plurr" be seen andcorrective action may please be taken at the earliest to achieve the targets of 25%.

This Ministry had received in the past a number of representations fromphysicatty chattenged persons, hightighting the problems being faced by them dueto non-avaltabitity of invatid carriages in the maiket as welt as the poticy ofbannjng atteration in motor vehictes under Sectlon 52 of the i,lotor Vehictes Act,1988. These issues were considered by the,llinistry in the past. ln order to ensurethe mobitity of physicat(y chattenged people, this Mhistry had laid down certalnprocedure.

2. As far as two wheeted vehicLes are concerned, this Ministry had laid down adetaited procedure vide Resotution No. RT&.H-'I'1011/12l01-MVi dated 23'd July,2008 to attow the State Governments to approve such cases. The atteration coutdhowever be done in the manner prescribed by this Ministry and that too only by an

authorized workshop. Laying down such a procadure was necessary to ensure thesafety of physicatty chatlenged persons as wettEs the safety of other road us€rs. lthas been blought to the notlce of this Ministry that there are no such authorizedwork shops in many parts of the country. As such, the physicalty chatlengedpersons are unabte to get their vehiale modified to suit their requirement.

3. ln fact, it is the responsibitity of concerned State GoYernments to identifyand authorize such work shopt for the convenience of Physicatty chal{engedpersons. ln case this is not possible, the States wilt haYe to insPect the vehlcle

before registration and satisfy themsetYes that such modified vehicles are not

safety hazards.

4. As far as four wheelers are concerned, the number of such cases not beilgvery large, the Alinistry has been grantinq exemntion on a case to case basis on thebasis of the recommendations made by the concerned State Govdrnment.Recentty, this Ministry has received a request from Government of Maharashtra toauthorize tbe State Governments to issue the permission for such alteration in thefour whi5ters retrofitted by authorized retrofitter so that detay in issuingpermission could be avoided and the need of physicalty chattenged person coutd beat addressed. lt has also been brought to the notice of this liiriistry that the Retrofitment /Adaptation kit do not modify/change the originatity of the vehicte exceptmere adaptation/convenience whereby a driver does not need to use his ctutch (

in the case of AUTOCLUTCH Kit) or uses his hands to operate the break oracceterator ( in the case of HAND CoNTROL kit). There is no modification made inthe engine or the gearbox. The original pedals are atso not modified or removedand atso none of the parameters entered in the Registration Certificate of thevehicle are affected or changed,

5. ln view of the above, it is suggested that the concerned authority in thelStatE may inspect the vehicte and in case the alteration do€s not attract theprovisions of Section 52 of the Motor Vehictes Act, 1988, the same need not bereferred to this Ministry.

They aro fuliy cmpowered to deal with alteraliolsof vchicles for differently abled pcrson a: this would avoid harassment andfscilitate the mobility ofdifferertly abled persoN.
