Friday: Upon your return to Rome following your cruise, you’ll betransferred to the Grand Hotel Beverly Hills and check in. Lunch is atleisure. Around 3:00 pm you’ll transfer by coach to Rome city centre andalong with your English-speaking guide begin your 3-hour guided tour of thecity (by coach and on foot). Your panoramic tour by coach includes visits ofSt. Peter’s Basilica (outside), Lungotevere and the Colosseum (outside).You’ll see Rome’s major sites; Castel Sant’Angelo, Isola Tiberina, PiazzaVenezia, Circus Maximus, Arco di Costantine, Via Cavour, Santa MariaMaggiore, Piazza Della Repubblica and Via Nazionale. Terms & conditionsFor purposes of these Terms & Condi-tions the words “you,” “your,” “passen-ger” and “cardholder” refer to eachperson who books or otherwise pur-chases or receives goods and servicesarranged through Sunquest. The words“Sunquest,” “our” and “we” refer toThomas Cook Canada Inc., its parents,subsidiaries, affiliates and agents.

Sunquest makes arrangements withsuppliers who provide travel servicessuch as air travel, cruises, hotels, buses,sightseeing, car rental or other activitiesincluded in your booking. The travelservices are subject to the conditionsimposed by these suppliers, and their li-ability may, in turn, be limited by theirtariffs, conditions of carriage and inter-national conventions and arrangements.Sunquest does not own, manage, oper-ate, or control any vehicle, hotel, resort,cruise ship, restaurant, or other supplierof services, and is not responsible fortheir acts or omissions.

How To Make A Booking: Simply call orvisit your travel agent and they will contactSunquest for reservations.

Payment Requirements: Where a vaca-tion is booked 45 days or less before thedeparture date – full payment is due imme-diately. Otherwise, a non-refundable de-posit of $450.00 per person plus applicableinsurance is due immediately on bookingand the balance or final payment is due noless than 45 days prior to departure date.

The deposit is due at the time of bookingand is non-refundable. Sunquest reservesthe right to cancel a booking where anypayment is not received within 5 days of itsdue date.

Credit Cards: When a credit card is usedto confirm and pay for a booking, you, thepassenger, and/or the cardholder give con-sent to Sunquest for the card’s use.

The cancellation charge compensatesSunquest for damages arising from cancel-lation, including, among other things,pre-payment made on booking of travel andother services and administration costsinvolved in processing a cancellation. Bybooking a vacation you agree that thecancellation charge is a genuine estimate of

damages to Sunquest of any cancellationand is not a penalty. Sunquest may arrangefor the resale of any holidays you cancelwithout refund to you.

Changes to a Booking: Changes to a con-firmed booking can only be made prior to45 days before departure. An administra-tion fee of $25.00 per person plus GST willbe charged for each change. You will alsobe responsible for any price increase ongoods and services from the original reser-vation date to the date of change. No priceadjustments shall be made if the price forsuch goods and services has decreased. Ifa change is made to the room occupancy,including the addition to or reduction of thenumber of occupants, you will be responsi-ble for any resulting increase in price. Namechange requests may be denied due tohotel policy and conditions.

Requests for changes less than 45 days be-fore departure will not be accepted and willmake the booking subject to full cancella-tion charges. Name changes or name cor-rections within this period will be treated asa cancellation and rebooking.

Dietary Needs: Special dietary requestsfor vegetarian, diabetic, low-fat, low-sodium, or low-cholesterol diets can bearranged at the time you make your cruisereservation. As MSC Cruises requires thedetails of your request not later than 14days prior to your sailing date, please askyour travel agent to inform Sunquest ofyour requirements at the time of booking.

Children: Unless otherwise stated,children’s prices are restricted to those2-11 years of age at the time of departureand only when sharing a room with 2 fullpaying adults.

Infants: Passengers under the age of 2 forthe duration of the holiday are consideredinfants and will fly free of charge (1 infantper adult allowed). A reservation, however,is required for each infant. Please note thatinfants are not assigned a seat and are notallotted baggage allowance. If an infantturns 2 years of age during the vacation, anairline ticket must be purchased for his orher travel to and from the destination.

Customs & Immigration: Customs and/orimmigration officials can deny a personentry into their country at their own discre-tion. A previous criminal record could be anobstacle in international travel. Sunquestcannot be held responsible for denied entryunder any circumstances.

Tickets:

1) Tickets are available 30 days prior toflight departure. All tickets and vouchersare produced in electronic format andwill be forwarded to your travel agent.E-documents must be presented alongwith proper identification (see section on

Documentation) at check-in for departureflight, return flight, and for otherpurchased services such as hotelaccommodation, a cruise and carrentals. Please review for accuracy.

2) For bookings made within 72 hours offlight departure, e-tickets will be availablefrom our representative at our airportcounter prior to check-in.

3) All e-tickets are valid only for the flightpurchased and cannot be exchanged forother flights or departure times.

4) If an e-ticket is lost in destination, therewill be a $25.00 administration feecharged for a replacement. Please con-tact your local Sunquest representative.

Flights and Carriers: All flight times, flightitineraries, carriers and aircraft types aresubject to change with or without notice.The carriers and Sunquest also reserve theright to add en route stops. It is recom-mended that you contact the airline within24 hours of departure to confirm your de-parture time. It is also recommended thatyou arrive at the airport 3 to 4 hours prior todeparture to allow sufficient time for check-in and security clearance. Airline cut-offtimes vary between 45 and 60 minutes.Please check with the airline directly. Youagree that Sunquest cannot be held re-sponsible or liable if you miss your flight orare denied boarding. If you book air only,you must provide your contact number atyour destination to your travel agent andthe local Sunquest representative so youmay be advised of any changes to your re-turn flight. Failure to do so may result in youmissing your flight and you agree thatSunquest cannot be held responsible or liablefor any resulting expenses. Carriage andservice performed and tickets issued aresubject to the terms referred to on suchtickets, the rules relating to liability by theWarsaw Convention (as amended), andthese Terms & Conditions. Sunquest makesarrangements with Alitalia and Air Transat.Air transportation complaints are solely theresponsibility of the airline concerned.

Baggage: Each passenger is entitled tocarry 2 standard-sized pieces of checkedluggage. On flights to Italy, Alitaliaallows 1 piece - 23kg. Magnifica classallows 64kg (2 pieces not to exceed 32kgeach). There may be a charge for excessbaggage. Please contact the airlines formore details. Sunquest reminds cruiseguests that cabin storage is limited.Please contact the airline for more details.All baggage remains at your own riskthroughout the trip. Due to security restric-tions, liquids and gels, as well as manyother items, are not permitted in carry-onluggage. Prescription medications shouldbe kept in the original container andpacked in carry-on luggage. Please checkwith the airline prior to departure for themost up-to-date regulations in order toavoid items being confiscated at security. Inthe event that your baggage is delayed atyour destination or upon your return home,please contact the airline representative be-fore leaving the airport. Failure to do so willinvalidate your claim. Independent contrac-tors over which we have no control performbaggage handling and we cannot assumeresponsibility for loss of, or damage to,baggage or other possessions. Due to thecarrier’s limit of liability, please do notcheck valuable items such as jewellery andcameras. Please also limit the valuables (in-cluding electronic equipment) you take withyou on holiday and use the safety depositboxes provided at hotels or on cruise ships.Please ensure you have adequate insur-ance to cover your belongings throughoutyour holiday.

Connecting Flights: If you have a connectingflight, you should allow ample time(minimum 3 hours or overnight) betweenflights. Sunquest cannot accept anyresponsibility for additional chargesincurred for airfares or other expensesdue to missed flights, irregular airoperations or flight time changes.

Sunquest Representative& Problem Handling:A Sunquest representative will meetpassengers upon arrival at your destination.If you have any questions, queries orproblems while in destination or on boardyour cruise, you must contact the localrepresentative, cruise line representative,on board cruise staff, transfer agent orhotel management directly as applicable.Failure to report your concerns maypreclude your right to a claim.

Travel Insurance: It is strongly recom-mended that all travellers obtain ade-quate insurance coverage to protectthemselves should they be obliged tocancel a holiday due to health problemsor unforeseen circumstances. You maypurchase such insurance from your travelagent at the time of booking. You may alsowish to purchase medical insurance. Youagree that Sunquest shall not be responsi-ble or liable for health problems that mayarise or become aggravated while travellingor at your destination. Standards of medicalcare may differ from those in Canada.Treatment may be expensive, payment inadvance may be required and provincialhealth care coverage may be limited.

Documentation: It is solely your respon-sibility to obtain, at your own expense,all the documentation required by rele-vant government authorities and thecruise line for the purpose of your holi-day. Required documentation may varydepending on citizenship status. Specialdocumentation may be required for mi-nors travelling alone; for children whohave a different surname than the adultswho accompany them; or for single par-ents travelling with children. Prior to de-parture, you should check with yourtravel agent and/or the relevant con-sulate and the cruise line about whatdocumentation is required. A valid pass-port is required. For information on theCanadian Government Passenger Pro-tect program, please visit www.passen-gerprotect.gc.ca. Landed immigrantswithout Canadian citizenship or a Perma-nent Resident Card may be deniedboarding upon return to Canada. In theevent that a passenger does not pos-sess the documentation required by thecruise line, airline or government authori-ties for each port of call, passage orentry to the destination may be refused.If passage or entry is refused, Sunquestwill not be held liable and will not issueany refund.

Special Requests: Sunquest cannotguarantee specific requests such asroom location, adjoining rooms, bedpreference, in-flight meal requirements,skycots, etc. On board dining requestsfor a given table size or early or late seat-ing will be accepted at the time of book-ing. While Sunquest will attempt toadvise service providers of such re-quests, it cannot be held responsible ifsuch requests cannot be fulfilled or iflocal surcharges are applied.

Sometimes majorchanges to your holiday arrangements maybe required due to circumstances beyondour control, such as hotel overbooking,cruise cancellation, unexpected mainte-nance problems or due to market condi-tions. Major changes may include changeof destination, change of departure orreturn by more than 24 hours, change ofitinerary, change of hotel, ship or accom-modation booked. In these circumstances,Sunquest reserves the right to substitutehotel and other arrangements for arrange-ments of comparable value without noticeor liability.

Force Majeure/Act of God: Sunquest isnot responsible or liable for changes or can-cellations made that relate to or arise as aresult of hostilities, acts of war or threat ofwar, riots, civil disturbances, terrorist activ-ity, industrial disputes, natural and nucleardisasters, fire, epidemics or health risks,technical problems with transport as well asflight delays due to weather or for mechani-cal reasons, government action, closed orcongested airports or ports, supplier insol-vency, governmental acts and other eventsbeyond our control. The National HurricaneCenter in Miami considers June 1st toNovember 30th inclusive Hurricane Sea-son. This must be taken into consideration

when you book your vacation. You agreethat Sunquest does not assume any re-sponsibility, and is not liable, for the costsor other consequences that arise out of orresult from inclement weather conditions atany time of the year.

Hotel Ratings: Star ratings are our opinionand can differ from official gradings. Ourrating is relative to general standards ineach destination so our four-star hotel inone destination can be different to our four-star hotel in another. Ratings are based onmany factors including hotel location andfacilities as well as feedback from ourcustomers and staff.

Facilities & Services: Cruise Lines andHotels may curtail or alter some facilitieswithout notice, usually for purpose of ongo-ing maintenance and improvement. Youagree that Sunquest shall not be held re-sponsible or liable if, due to the acts oromissions of others, some services, bonusfeatures or facilities described in thisbrochure, cease to be available or are notworking. The behaviour of other guests andthe cancellation of services for any reasonare beyond Sunquest’s control. All effortsare made to ensure accuracy at the time ofprinting this brochure. Descriptions andphotographs are representational only andare not a guarantee that everything will beexactly as depicted at the destination. Youagree that Sunquest shall not be held re-sponsible or liable for modifications thatcan take place after publication, includingdamage or beach erosion due to storms ortidal conditions. Services such as à la cartedinners, daily activities programs, spa serv-ices and bonus features are on a first-come, first-serve basis and may requirereservations. Certain services and activitiesmay be withdrawn by the hotel or cruiseline for reasons such as weather conditionsand number of participants. All withdrawnfeatures are non-refundable. Spa servicesare at additional charge unless otherwisestated. Room upgrade bonus features aresubject to space availability at check-in andcannot be guaranteed prior to your arrival.Bonus features do not have a cash value.

Hotel Check-in & Check-out: Due to hotelhousekeeping requirements, regardless offlight times, hotel check-in is normally after3:00 pm on the day of arrival. Hotel check-out time is normally 12 noon. All-inclusiveprivileges begin at check-in and end atcheck-out.

Unused Services: No refunds or adjust-ments will be made to you for portions ofyour vacation not taken or used.

Prices & Cost Increases: All prices,unless otherwise stated, are per personbased on two adults sharing one hotelroom or cruise cabin. All prices advertisedin this brochure are in Canadian dollars anddo not include GST (where applicable) andtaxes. The prices advertised in thisbrochure are based on fixed costs at thetime of print. These costs are dependant onfuel costs, rate of exchange and/or otherfactors. Sunquest reserves the right to in-crease the price. Should the price increasebe greater than 7%, you have the right tocancel the contract for travel services andobtain a refund of all monies paid to Sun-quest, unless the price increase is the resultof government taxation or fuel surchargeallowed by the Canadian TransportationAgency. Every effort will be made to adviseyour travel agent of any price increase atleast 15 days prior to your departure date.

In the event of an error in published rates,you will be given the option to accept thechange or to cancel for a full refund of allmonies received by Sunquest.

Prices may be adjusted in response tomarket conditions or other factors and maychange at any time. Changing conditionsrequires a response to booking trends thatcannot be forseen and may result in priceincreases or decreases dependent uponthe product and dates of travel. Pricereductions made in response to marketconditions are offered as an incentive tonew bookings only

Special Needs Passengers:We welcomepassengers with special needs. Any specialservices required such as separate trans-fers must be advised to Sunquest at time ofbooking so we can determine the availabil-ity and cost of such services prior to con-firming the booking. Althoughreasonable attempts will be made toprovide the services requested, Sunquestdoes not guarantee that the airport, transfervehicles and/or accommodations while indestination will be wheelchair accessible.Facilities for special needs passengers inhotels, and on cruise ships may be limited.Services required for a passenger withspecial needs may not be available and/orsubject to local surcharges or advance pay-ments. Please check with your travel agentprior to booking.

Notice of Claims: You must notify Sunquest,in writing by registered mail, of any claimyou may have, or claim to have, againstSunquest, within 30 days from the eventgiving rise to the claim. Should you not filea written complaint with Sunquest within30 days from the end of your vacation, youwill be presumed to be satisfied with theservices received and to have waived anyand all claims that you may have hadagainst Sunquest. Sunquest will not re-spond to any claims or demands madeafter the expiration of the 30-day delay. Youmay not commence any legal proceedingagainst Sunquest unless you have submit-ted a notice as set out above. Under no cir-cumstances shall Sunquest be liable to youfor an amount in excess of the total amountpaid to Sunquest for your vacation.

Air Only & Government Approval: All flightsfor Inclusive Tour Charter (ITC) holidays andair-only Advanced Booking Charter (ABC)flights are operated pursuant to the rules ofthe Canadian Transportation Agency andsuch flights have been approved by theAgency on behalf of Sunquest.

Compliance: You agree to comply with anyreasonable instructions issued by Sunquestor its representatives during your vacation.

Applicable Law: Regardless of your holidaydestination, any dispute between you andSunquest shall be interpreted in accor-dance with the laws of the place of yourdeparture from Canada and internationalconventions and agreements referred toherein. Notice: No agent or representativeof Sunquest or any other service providerhas the authority to modify or waive anyprovision of these Terms and Conditions.

Arbitration: Any claim or dispute (includ-ing, without limitation, any unresolvedclaims concerning any services bookedthrough, or provided by, Sunquest andclaims made directly by you or by anyoneconnected to you or claiming through you)relating to or arising from your purchase of

a holiday, or the goods and services pro-vided by or through Sunquest, must bedecided by one arbitrator, to the exclusionof the Courts. The arbitration shall be gov-erned by the National Arbitration Rules ofthe ADR Institute of Canada, Inc. or itssuccessors or a replacement Administrator.The seat of the arbitration shall be in theprovince in which you reside. The decisionof the arbitrators shall be final and bindingupon the parties. The present arbitrationclause applies to all claims made as part ofa class action or other representativeaction, it being expressly understood andagreed to that the arbitration of such claimsmust proceed on an individual (non-class,non-representative) basis.

Cancellation of Services: In the eventthat certain services are cancelled, Sun-quest will have no responsibility beyondthe refund of all monies received by Sun-quest for such cancelled services, whichwill be deemed to constitute full settle-ment if any claim you might have againstSunquest for the cancellation.
