Section 1. Pursuant to the provisions of the Municipal lmprovement Act of1913 (Division 12 of the Califomia Streets and Highways Code), Proposition2lS(Articles Xlll C and Xlll D of the Califomia Constitution), Section 53753 of theCalifornia Government Code, Los Angeles Administrative Code Sections 6.1 to6.15, and the competitive bidding requiremgnts of the City of Los Angeles, theCouncil of the City of Los Angeles hereby confirms the levy of special assessmentand orders all the work and acquisitions (if any), described and refened to inOrdinance No. 178,137 and the Enginee/s Report adopted by the City Councilforthe district. Reference is hereby made to the ordinance and report for furtherparticulars in connection with the work and the serial bonds provided therein.

If weighted'1,1O" votes are in excess of weighted'YES'votes, Councilabandons the project in accordance with Proposition 218 and the Street Lighting Policyadopted by the City Cormcil on December 19,1997 (which requires properly owners tofully pay for mainte,lrance of the steetlights).

2. The Board of Public Works advertise.s for constuction bids to be received and opened on orbefore the first Wednesday preceding the public hearing date.

3. A copy of this report be provided to the affected Courcil office and the Mayor's Office ofEconomic Development.

FISCAL IMPACT STATEMENT:

l. If adopted installation costs of $179,200.00 will be assessed to the property owners. Thesefrtnds will be deposited in a project firn{ and be used to construct tle proiect and reimburseCity deparenents.

DISCUSSION:

This project was initiated by the granting of a majority petition by the City Cormcil on January 18, 2005,and proposes the installation of new modern and ornamental steet lights tbroughout the boundaries of theproposed lighting districl

This proposed project will provide for increased nighttime vehicular and pedestrian traffic safety, and willbe a decorative steetscape improvement

The total estimated constuction cost of the project is $179,200.@, which is proposed to be assessed inaccordance with ctrrrent City policy and will be funded through cash collections imrneaiately after theassessments are confirmed, and through assessment bonds for the upaid assessments. These costs areshown in the Engine€rs r€port. Section 13 of the Ordinance of Intention provides for a credit to theproperly owners if there is a surplus of fimds rernaining after constuction is completed. The averageinstallation assessment is about $9,400.

This project proposes to assess 19 parcels for operation and rnainte,lrance. The estimated total annual costof steet lighting maintenance is $2,130.63.

The passage of Proposition 218 on Novernber 5,1996, requires a vote of the properly owners pnor toCoucil confirming and levying the assessme,nts for installation and rnainteirance. The baltot will consistof a single vote for both the installation and maintenance assessnrents.

Upon adoption of this report and the tansmitted Ordinances of Inte,lrtion" Cormcil will set a date forhearing appeals and the last day to receive coryleted assessment ballots. A hearing to be held by yourBoard will be scheduled at least one week pnor to the date of the ptrblic hearing before the City Councilto review and resolve any appeals concerning the proposed maintenance asses$nexrts. If the assessme,lrtballot proceeding, as required by Propsition 218, approves these assessrnents, the City Comcil mayconfirm and levy the assessments.

If a majority of the weighted votes by property owners is against the assessrnen! the assessment will notbe iqposed. In accordance with Proposition 218 and the Street Ligbting Policy adopted by the CityCormcil on December 19, 1997, (which requires property owners to pay fully for street lightingmaintenance), the project will not be constucted.

The protests which are received as described in the Administrative C.ode, are for the consideration of theCotmcil, but are not binding. Only a rnajority vote against the assessrre,nts is binding.

All mailed assessnre,lrt ballots will be received at the address indicated on the ballot or at the site of thepublic testimony, and be included in the tabulation of a majority protes! if any. An assessment ballotmay tle submitte4 changed, or withdrawn prior to the conclusion of the public testimony on the proposedassessment at the hearing.

This project does not require the preparation of an environmental document. It is categorically exemptunder Article trI, Section 3, and Class 3 (10) of the City of Ios Angeles Guidelines for theImplementation of'the California Environmental Qtulity Act. Because the current guidelines wererevised after the Council concurred on this categorical exemption on January 9, 20M, the Council isrecommended to find this project exempt under the current guidelines. THE PEOPLE OF THE GITY OF LOS AhIGELESDO ORDAIN AS FOLLOWS:

Section 1. Pursuant to the provisions of Los Angeles Administrative CodeSections 6.95 - 6.127 and to the requirements of Califomia Govemment Code Section53753, and Proposition 218 (Articte Xlll C and Xlll D of the Califomia Constitution),lheCouncil of the City of Los Anleles hereby orders that the necessary electroliers andappliances be mdintained anE electric cdnent be fumished forthe period of 12 monthsehiling June 30,2007, for the lighting of those certain streets and places described inthe oriinance r6fened to as Ordinaice No. 178138, Deslgnatiod: OXFORD AVENUEAhlD HOBART BOULEVARD Llghtlng District, The ordinance enumerated is theordinance of intention adopted by the eity Council for the district. Reference is herebymade to the ordinance and the report of the Board of Public Works mentioned there forfurther particulars in connection with the improvement.

Sec. 2. The assessments for the lighting of the district designated in Section 1 ofthis ordinance, made and filed by the Board of Public Works putsuant to the provisionsof Los Angeles Administrative Code Sections 6.95 - 6.127, arg h.erqby app,rov.ed andconfirmedl and these assessments are hereby ordered to be levied upon the lots orparcels of land within the district declared by the City Counci! to be the district to bebenefitted by the improvement.

Sec. 3. The Board of Public Works is hereby authorized and directed to causethe improvements to be made in accordance with the plans and specifications and, asmay abpear to the Board to be necessary, to issue interdepartmental or otherpurLnaie orders for each of the improvenients or for portions of them, pursuant to theLos Angeles Administrative Code.

Honorable Councilmembers:

In accordance with Proposition 218, the City of Los Angeles provided notice to the property owners of theparcels in the proposed Oxford Avenue and Hobart Boulevard Lighting Disfiict as specified in the subjectCouncil File. Along with that notice, each property owner received an assessment ballot weighted by theamount of the parcel's proposed assessme,nt. I have tabulated the assessrrent ballots delivered to my office bythe final hearing date of February 16,2007.

The Street Lighting Maintenance Assessment Distict received a majority of weighted ballots in favor of theassessment. As a result, the City may impose the proposed additional annual maintenance assessme,nts for theDisfrict. The certified results of the tabulations are attached. I have also forwarded a copy of these results to theDepartrre,nt of Public Works, Bureau of Street Lighting; for their information.

RECOMMENDATIONS FOR COUNCIL ACTION:

1. DENY the protests and confirm the assessme,lrts.

2. ADOPT the Ordinance levying the assessme,nts and ordering the maintenance of the lighting system.

I POUCY - STREET LIGHTING ASSESSMENTS

New steetlights are proposed in the Oxford Avenue and Hobad Boulevard Neighborhood. Theproposed installation is frnanced by assessments to the property ownets in the Oxford Avenue andHobart Boulerrard Lighting District Project (total: $179,200). This is your Notice of Proceedingsnecessary to furaqce the installation of this new lighting near your property. In accordance withProposition 218 (which requires that new and increased assessments be subject to approval byproperty owners), this Notice and Ballot is being sent to you for your vote.

I ASSESSMENT-AMOUNTANDBASIS

Only those properties with nearby streetlights have special benefit, and pay an assessment. Theamount assessed for installation is spread equally among the properties within the district asproportioned to the infrashuchrre adjacent to the properbr.

Your property, being near the proposed sEeedights, has special benefrt, and is proposed to pay streetIighting installation asscssments consistent with Council Policy. Assessments for irstallation may bepaid within 30 days after confrmation, or may be paid over l0 years, and are then billed semi-annually by the City Treasurer (see enclosure). If the final cost for constructing the project is lowerthan estimated, refunds will be made to property owners. If the final cost for corxhucting the project ishigher than estimated, the City will assume responsibility for the remaining costs.

. ASSESSMENTINFORMATION

Proposed installation assessment for the entire disaict, composed of 19 parcels, for the 11 newsteetlights is $ 1 79,200.00.

1 HOW PROPOSITION 21E BALLOTING WORKS

Votes arc evaluated according to the following guidelines:

l. Only property owners, or their duly authorized r€presentatives, may vote.2- You must actually vote for your ballot to be counted. Only those ballots received can alfect the

outcome.3. Your ballot is weighted propodionally by the amount of the proposed assessment. Ballots

representing larger assessments have a larger weight than ballots for smaller assessments.4. The assessment will be levied only if the weighted "yes" ballots equal or exceed the weighted

'ho" ballots.5. If there is a weighted majority of 'ho" ballots received, regardless of how few ballots are

retumed, the assessment shall not be irrposed and the pmposed sheetlights will not be installed.

I BALLOTPROCEDURES

In ordet for ballots to be counted, they must be received by the City no later than the date of the "FinalPublic Hearing", indicaled in this Notice. Retum the ballot sheet by following the instructions on theballot. The weighted count of yes and no votes will be counted by the City Clerk and repoded to theCouncil at a meeting after the Final Public Hearing. The Council will then consider the vote rcsultsand other information, and may confirm and levy the assessments, unless there is a majority of 'ho"votes.

An Odinance of lntention to confirm the assessment and orderthe improvementof OXFORD AVENUE AND HOBART BOULEI,ARD MODERN AND ORNAMENTALLIGHTING DISTRIGT A'13-L057004:t pursuant to the Municipal lmprovement Act of1913 (Division 12 of the Califomia Streets and Hlghways Code), Proposition2lS(Articles Xlll C and Xlll D of the Califomia Constitution), Section 35753 of the CalifomiaGovemment Code, Sections 6.1 to 6.15 of the Los Angeles Administrative Code, andthe competitive bidding requirements of the City of Los Angeles, and to detennine thatbonds shall be issued.

THE PEOPLE OF THE CITY OF LOS ANGELESDO ORDAIN AS FOLLOWS:

Section 1. The public interest, convenience and necessity require, and it is theintention of the Councilof the City of Los Angeles to oderthe following sheet lightingimprovement be made:

five modem and six omamental street lights on:

from Hobart Boulevard to Washington Boulevard.

Sec. 2. All of this work and improvement shall be mnstructed in accordance withplan D-32956 and standard specifications refened to on the plan, atlon file in the officeof the Bureau of Stueet Lighting. The plan and specifications should be refened to for afull and detailed description of the work or improvement.

Sec. 3. The Council hereby makes all costs and expenses of the improvements,including incidental expenses, chargeable upon the district to be benefted.

Sec. 4. The Council hereby determines and declares that the district, whichreceives special benefit from the improvements, and is to be assessed to pay the costsand expenses of the improvements, is described by Map A-20003 hereby approved bythe City Council, and on file in the office of the City Clerk. The map shall govem for alldetails as to the extent of the assessment distict. The City Clerk is hereby directed tofile with the County Recorderwithin 15 days of the adoption of this ordinance, a copy ofthe assessment district map.

Sec. 5. That the proceedings for the improvements shall be conducted inaccordance with the Municipal lmprovement Ac-t of 1913 (Division 12 of the CalifomiaStreets and Highways Code), Proposition2lS (Articles Xlll C and Xlll D of theCalifomia Constitution), Section 53753 of the Califomia Govemment Code, LosAngeles Administrative Code Sections 6.1 to 6.15, and the competitive bidding

crequirements of the City of Los Angeles.

Sec. 6. The Boad of PublicWorks shall prepare notices and ballob of theimprovements to be mailed by the City Clerk to each property owner affeciled by theassessment and have the notim published in newspaperc of general cirullation anddistributed in several areas of the City in the mannerand form and within the timerequired by law.

Sec. 7. The City Clerk shallmnduct an assessment ballot proceeding forthislighting district, as required by Proposition 218 (Artide Xlll D of the CalifomiaConstitution). Ballots shall be mailed with the hearing notices. The Clerk shall count,certiff, and report tte rcsults to the Council. The Council shall not impose theprcposed assessment if the count of the weighted onoo votes is greaterthan theweighted Yes" votes, and the proposed lighting system willthen noJ be constructed. lntrabulating the ballots, the ballots shall be weighted according to the proportionalfinancialobligation of the affected property due to the imprcvement.

Sec. 8. Serial bonds in registered forn bearing interest at the rate of not toexceed nine percent per annum shall be issued under the provisions of thelmprovement Act of 1911 to represent each assessment of $150 or more remainingunpaid for 30 dap from the reordation date of the assessment. Each bid must be made upon the bid letterfumished by the City of Los Angeles.Each bid shall be fortte entire amount of the bonds to be issued at a single rate ofinterest, and any bid for less than all bonds to be issued or for varyrng rates of interestwill be rejected. Any bid for less than par must provide for an interest rate on the bondsat nine percent per annum. ln case of tie bids, the awarding bidderwill be detenninedby lot.

A certified or cashie/s check for $2,900 payable to the order of the City of LosAngeles, must accompany each bid as a guarantee thatthe bidder, if successfi.rl, willaccept and pay for the bonds in accordance with the terms of the bid. The successfrrlbidde/s check shall remain in the hands of the Treasurer until all of the bonds are paid.The City will determine the lorest responsible bidder as soon as possible folloring theopening of bids, but not to exceed 30 days afterthe date for receipt of bids. The bidguarantee of an unsuccessful bidderwill be refumd upon the determination occuning.

The successftrl bidde/s bid guarantee shall be retained by the City as liquidateddamages in the eventthe successftrl bidderdoes not payforthe bnds atdelivery.However, the City may seek to recover additional damages fiom the failure to pay forthe bonds if damages result.

The City reserves the right to not issue the bonds unti! confirmation ofassessment and ordering of the work. Therefore, even though the City selects a lowestresponsible bidder, the City may thereafter decide not to go forward with the projct andthe contemplated bond issue. ln that event, the bid guarantee will be retumed and theCity will have no other obligation to the successful bidder. The determination ofwhether to go fonrard or not to go fonrard with the projec't and bond sale will be madewithin 60 days of the date for receipt of bids, and if not so determined, at the end of the60 days, it shall be deemed that the City has determined not to go fonrard with theproject or with the bond sale.

Chamber on the third floor of City Hall, Room 340, 200 N. Spring Street, Los Angeles90012. Any person objecting to their assessment may file a written protest or appealwith the City Clerk at any time prior to the headng by Crty Council. Any person mayalso present written or oral comments at the City Council hearing on this mater. Theprotest must contain a description of the property in which each signer owns aninterest, sufficient to identifu the property, and be delivered to the City Clerk, and no

prctests otherthan those presentd tithin the time specifted will be considercd.

Ballots arc due to the City Clerk at any time prior to the close of the publichearing on the prcposed improvement and assessment. The City Clerks office shallprepare a report of the assessment ballot prcceeding results to the City Council.

Sec. 10. The estimated total cost of the proposed improvernent is $179,200,which includes the estimated cost of mnstruction, and the estimated anpunt ofincidental and contingency expenses. The assessablb portion of incidental expensesshall not exceed 47o/o of lhe assessable portion of the cost of construction.

Sec. 11. The proposed improvement is hereby refend to the Direc'tor, Bureauof Street Lighting, and the Director is hereby directed to make and file wtth the CityClerk, an Enginee/s report in wrtting. The presentd and filed detailed Enginee/sreport is purcuantto the requirement of Artide Xlll D, Section 4(b) of the CalifomiaConstitution.

Sec. 12. There is hereby created and established within the treasury of the Cityof Los Angeles an imprcvement fund for this project to be known as the "Fund forlmprovement of the Oxford Avenue and Hobart Boulevard Modem and OmamentalLighting District.'

Sec. 13. That any surplus remaining fom the assessment in the improvementfund afterthe completion of the improvernent and the payment of allclaims shall beused as a refund upon the assessment and any supplemental assessment, in themanner provided in Section 10427.1of the Califomia Streets and Highways Code.

Sec. 14. The City Council hereby determines that the public interest will not beserved by allowing the property owners to take the contract for the work to be doneu nder these proceed ings.

The proposed proJect would install (5) frve modern and (6) six ornamental typeelectrolier steetlights along Odord Avenue between Washington Boulevard andHobart Boulevard.

Abstract: The Bureau of Steet Lighting, for the Board of Public Works, is responsible for the designand processing of all steet lighting assessment-financed installation projects, underprocedures of the Muricipal Irnprovemant Act of 1913 and the Improvernent Act of 1911.Other codes which apply are the City Charter, Los Angeles Adrninistrative Code, CityCouncil Steet Irryrovement Policy, California Government Code and the competitivebidding requireme,nts of the City of Los Angeles.

Proposition 218, section 4 (b), requires that *...All assessments shall be supported by adetailed engineer's report prepared by a registered professional engineer certified by the Stateof Califomia.., ". It fi:rther requires in section 4 (D that "...in any legal action contesting thevalidity of any assessment, the burden shall be on the agency to dernonstrate that the propertyor properties in question receive a special benefit over and above the benefits conferred onthe public at large and that the arnount of any contested assessment is proportional to, and nogreat$ than, the benefits conferred on the property orproperties in question..."

The purpose of this report is to respond to the specific requirements of Proposition 218 andState law, for the subject steet lighting installation assessment district.

Part A - INSTALLATION ASSESSMENTS

1. Surrrrany

On Novembq 5,1996 the voters of California approved Proposition 218, which became part ofthe California Constitution. It imposes additional requirements on local govemment whanassessments for steet lighting installation are proposed. This engineer's report provides a sectionon City policy and background for steet lighting installation assessm€,nts and on themethodolory of the calculation of the assessme,lrts. It also explains the City's policy regardingspecial and general benefit provides inforrration about this specific projec! and satisfies therequiremants of Proposition 21 8 regarding Engineering's Reports.

City fimding is provided for steet lighting, for part of the cost on major streets and collectors, aswell as for tunnels, brridges, and minimal traffio safety lighting installed on wooden pow€r poles.Under City Policy, funding for permanent steet lighting, which directly benefits narbyproperties, is financed by assessments only.

There are five basic types of projects for street lighting installation in the City, each with its ownprocess and financing sourc€s. There are Assessmen! Private Developmen!Replacement/Rehabilitation, Capital Improvernent and Utilitarian projects. Some projects havemore than one type of financing. The following is a brief description of each:

a. Assessment street lighting projects benefit nearby properties. They are designed to meetCity steet lighting standards, which include a specific level of illumination/ luminanceand uriformity of illumination/ luminance on the roadway and sidewalk areas. Lights arespaced at regular intervals in the completed system. These projects generally utilize steelor concrete poles and tmdergrorurd wiring. These projects are financed with assessmentsto nearby be,nefiting properties, and they are owned by The Departnent of Public Worls.

These projects are processed under the mrmicipal Irnprovement Act of 1913 and theImprovanent Act of 1911 (See California Streets and Highways Code), which providethe means though which the City government may assist property owners in obtainingcommmity improvemants, including steet lighting. The City acts as a tustee forproperty owners inasrnuch as project design and processing as well as construction andfinancial administration are performed by the City for the group of property ownersinvolved.

b. Private Development projects install permanent steetlights similar to the assessmentprojects. They are financed and consfircted by the private developer as a condition ofapproving a subdivision, z.one change, conditional use, steet vacation, tract or parcelrnap, or other change which affects the lan{ its zoning or use, lot dimansions, etc.

c. Replacement Lighting/ rehabilitation projects include the modernization and/ orreplacernent of older, Iess efficient and deteriorated street lighting with effective,

economical equipment. The cost of this system is paid through the City's Rehabilitationaccounts that are frmded by the annual steet lighting maintenance assessments.

d. Capital improvement projects utilize public funds from various sources to install, replaceand modi$ street lighting at locations where properties do not significanfly benefit, orthere are no adjacent properties, such as with bridges and fimnels.

e. Under the utilibrian Lighting Prograng lights are installed on existing wooden powerpoles at intersections and points of hazxd, but no closer than 300 feet apart. They areintended to be interfun, minimal taffic safety lighting only. The installation andmainte,nance costs of utiliarian lighting are financed by the Los Angeles Departnelrt ofWater and Power through their Electric Rates.

Special Benefft is the direct benefit to a prqperty, and to its owner or users, based on theinstallation of nearby steet lighting which is designed to illuminate the roadway and sidewalk infront of the specific properly at night. When there is only a single streetlight in front of or nearthe property in question, there is special benefit to the extent that the roaduay and sidewalk areilluminateq notwithstanding that the sheet lighting system for the block is inconrplete.Proposition 218 allows the assessment of properties which receive special benefit to the extentthat the assessment is not greater than the reasonable cost of the proportional special benefitconferred on those parcels.

General Benefrt is defined as a benefit to properties in the surrounding community or a benefit tothe public in general resulting from the improvements, activities or services to be provided by theproject. These benefits include the benefit from street lighting systems for locations that do notbeirefit specific properties, as well as interim lighting for minimal traffic safety on wooden pow€rpoles and p€rman€nt lighting at intersections with mast arm or taflic vehicular heads. Proposition218 require,s the City to finance ganeral benefit costs from other than property assessments. Thesecosts are financed from public fru:ds.

4. EOW STREET IJGHTtr{G INSTALLATION ASSESSMENTS ARE CALCULATED

GENERAL

The Bureau of Street Lighting (Oeparrnent of Public Works) has overall responsibiliff fordesigry processing and constnrction of street lighting in Los Angeles. Most streetlights areinstalled by private contractors rmder contract with the Deparfrneirt of Public Works except forstreetlights installed r:nder private developments. The total cost of installation, and therefore theassessments, incltrdes the cost for construction by an electrical contactor along with City costs ofdesign, processing and inspection, called "incidentals".

After the assessments for a project are confirmed by the City Council, (prior to constructionstarting), each benefiting property owner is billed. The assessme,nt may be paid in full or in part,and any remaining amormt may be paid with interest in installments over a period of up to 10years, depending on the size of the assessme,nt. The method of financing the cost of permanent steet lighting installation in the City, for lightingwhich benefits specific properties, and after subtracting any public funds, is assessment of thosecosts to the benefiting properties. Properties which do not receive special benefit, as definedherein, re not assessed. Council Steet Inrprovement Policy is the primary guide for eligibilityforpublic funds financing, and determination of the need for assessments.

METHoDoLoGY

Based on Council policy, as delineated in the Los Angeles Administrative Code and assessme,ntproceedings, asses$ne,nts are for the total amomt of the installation cost, less any public fundscontibutedby the City.

The total estimated construction cost is based on bids for previous projects, and on current datafrom electrical suppliers and other sources.

a. Identify all parcels which will have a special benefit conferred upon them and upon which anassessmeirt will be imposed.

The report includes, by means of tansmittals, asses$n€,nt diagrams which identiff the parcelswhich will have special benefits, and trpon which an assessment will be irnposed. These areidentified on each diagram by means of a bormdary ttnt includes all such parcels, and assessmentide,ntification and assessor numbers which also appear in the assessme,nt roll.

b. The proportionate special benefit derived by each identified parcel shall be determined inrelationship to the entirety of the ...installation. maintenance and operation expenses of a publicimorovement.

c. No assessment shall be imposed on any parcel which exceeds the reasonable cost of theproportional special benefit con rred on that parcel.The calculation of each installation assessment is based on the final installation cost forconstructing the project. If the final cost for constructing the project is higher than estimated, theCity may assume responsibility for remaining costs. If the final cost for constucting the projectis lower than estimated, refunds will be made to property owners.

d. Only special benefits are assessable and an agency shall separate the general benefits from thespesial benefits conferred upon a parcel.

The cost of installing the street lights adjacent to the parcel will provide only local benefit, andonly service these local properties, thus constituting a special benefit. The cost of maintenanceand operation of the lighting system on the stneet adjacent to the parcel in question is fullyassessed to the barefiting parcels on the stee! because it is a type of system that is consideredspecial benefit only. All general benefits, if any, to the surrormding community and public inge,neral from the special benefit street lighting system are inangible and are not quantifiable.Additionally, as described in Part A section 3, general benefit street lighting is a different type oflighting system than the assessable systenl and is therefore not a part of the assessment for eachparcel.

e. Parcels within a district that are owned or used by any agency. the State of Califomia or theUnited States shall not be exenrpt from assessment unless the agency can demonstrate by clearand convincing evidence that those publicly owned parcels in fact receive no special benefit.

All'lublic propert5/" parcels are identified and included in the'assessme,nt roll which is a part ofthis report. None of the cost of installation, operztion and mainte,nance of these parcels isassessed to any other parcel. The current City budget includes public fimds which will pay Cityand United States assessments; other agencies shall be billed for their asses$nents.

RECOMMENDATIONS

That the majority petition from the properly owners be granted and that the Board ofPublic Works and the Director of the Bureau of Street Lighting be instructed toproceed.

That proceedings be initiated for this petition under the Municipal lmprovement Act of1913 and Sections 6.1 - 6.5 of the Los Angeles Administrative Code for theonstruction of a modem street lighting system to cunent strandards under the title"Oxford Ave & Hobart Blvd Modem and Omamental Street Lighting Districf.

The Ortord Ave & Hobart Blvd Modem and Omamental Street Lighting District - Projectproposes the construction of a modem and omamental street lighting system on thefollowing streets.

Ortord Ave between Washington Blvd and Hobart Blvd

The new street lighting system would provide an appropriate level of illumination inaccordance with City strandards. :. .; .

Propefi owners have expressed their desire for the construction of a modem andomamential lighting system. At the time the petition was circulated for this project, propertyourners were given information on appea;ance and cost of lighting equipment for a modemand omamental street lighting system.

After reeipt of a majority petition (567o) in favor of this project, the Bureau of Street Lightingmailed a "Straw vote' to earery property owner within the boundaries of the proposeO prqeAto ensure that they all have knowledge of the proposal and the costs involved in theonstruction of the new street lighting system. Based on the results of the Straw Vote,Plopely owners representing 60.3% of the proposed assessment are in favor of the project.The Class 'B' estimate for the cost of this improvement is $245,000, whicfr wdutO beassessed to all properties with benefiting street frontage.

This proposed project would provide for increased nighttime vehicular and pedestrian trafficsafety, as well as being a detenent to crime.

This project is categorically exempt under Article Vll, Section 1, Class 3 (10) of the LosAngeles C.E.Q.A. Guidelines.
