Alleging that anotherdoze of discriminatorytreatment had been admin-istered to Jammu region inthe form of drastic cut insubsidized Kerosene oilsupply to the region, Mr.Harsh dev Singh,Chairman-JKNPP & for-mer Minister said that BJPgovernment seemed to behell-bent to break its ownexisting records of its high-ly biased conduct againstits own core political con-stituency during the lastfew years. He said that thefigures provided by the FCSand CA department had re-vealed that while Kashmirregion was being floodedwith Kerosene oil supply,the Jammu region was be-ing made to content with amere sprinkling. Not onlythat some districts ofJammu were altogether de-prived of the supply ofKerosene only to transfertheir respective quotas toKashmir based districts.He was addressing mediapersons after admitting in-to party fold around 25

NPP Supremo, Prof.Bhim Singh has urgedPresident of India, Shriramnath Kovind to con-vene an urgent meeting ofall the recognized politicalparties in J&K to seek theiropinion on what needs tobe done to save Jammu andKashmir from the presentdisaster created by forcingstatehood into two Unionterritories namely,Jammu & Kashmir andLadakh. NPP Supremo hasurged the President ofIndia to call an urgentmeeting of all three recog-nized political partiesnamely, NationalConference, PdP and J&KNational Panthers Party asthere are only three recog-nized political parties inJ&K including in Ladakhalso. NPP Supremo hasstrongly argued withKashmir-based regionalpolitical parties likeNational Conference andPdP to wash the presentsituation and the tempera-ment of some national po-litical parties in the coun-try. He advised NationalConference and PdP lead-ers to keep in mind thatJKNPP is also a recognizedpolitical party in J&K andLadakh and no politicalparty shall be allowed to ig-nore Jammu province andits leadership. He hopedthat the present situationcreated in J&K shall be un-derstood by the Kashmiripolitical parties also whohave been calling all partymeeting as it is appearingin the newspapers with no

political participation ofPanthers Party which has astrong mandate of the peo-ple. NPP Supremo con-veyed to NC leaders to con-sult the leadership of PdPand JKNPP also. He saidthat Article 370 has totallya different meaning andmandate compared toArticle 35-A in Chapter-IIIof the Indian Constitution.Prof.Bhim Singh advisedNational Conference lead-ership and the PdP that thesituation deserves to bediscussed in a close meet-ing of the leadership of allthe three recognized politi-cal parties. He expressedsurprise that someKashmiri leaders claimingto be representatives of allJ&K people have failed tounderstand that Article 35-A was not the part of theIndian Constitution as itwas introduced by thePresidential Order in 1954only to keep the control ofChapter-III on fundamen-tal rights. Article 35-A wasonly a three months man-date to keep Kashmirileader Sheikh Mohd.Abdullah without claimingany fundamental right in1954. NPP Supremo, a Sr.Advocate in the SupremeCourt and Bar-at-Law hasbeen arguing and even to-day his writ petition ispending in the SupremeCourt against the existenceof Article 35-A. Prof.BhimSingh said that Kashmirileaders have forgotten thatfundamental rights weretaken away from J&K by35-A and that could nothave lasted for more thansix months though this 35-

He said that he is plan-ning to hold a meeting withthe leadership of all threerecognized political partiesfirst and sort out thatArticle 370 should not beconfused into Article 35-Awhich is dead and gone. 6. Bidders must quote for all the particulars of the item in the Technical Bid and in the price schedule/BOQ of financial bid. Under the circum-stances, a query of that nature isquite justified. If there is anythingthat is constant with the evolution ofmankind, it is conflicts and wars. thenature, type and duration of warsmay differ but conflicts have neverleft the human race. Prehistoric soci-eties were violent and nothing seemsto have changed. As per the ImperialWar Museum (UK) data, militaryconflicts took place every year in the20th century, too. there were onlyshort periods of time when the worldwas free from war. the total numberof deaths caused by armed conflictduring the 20th century has been es-timated at 187 million. It, therefore,necessitates deliberation as to why,despite making unbelievableprogress, humankind is unable to re-solve differences through non-vio-lent means. Von Clausewitz states inhis classic book On War that, “War isnothing but a duel on extreme scale.War is, therefore, an act of violenceintended to compel our opponent tofulfil our will. War is a mere continu-ation of policy by other means.”Wars are executed when vital inter-ests of a nation are threatened.Military and other instruments ofnational power are employed on theadversary to execute a national or

political policy, mostly as a last re-sort, when other efforts have not suc-ceeded. the summation is that twoor more nations are involved and itconcerns each country’s basic andfundamental values.

this brings us to the thought thatis this relevant in today’s intercon-nected, digitised and highly com-mercial world? One needs to consid-er, first, whether the vital nationalinterests would change or be negoti-ated, if threatened and second, in thehighly interdependent world, wouldit be possible to negotiate a settle-ment by means other than war?Vaclav Smil, after examining armedconflicts of the past two centuries, inthe book, global Catastrophes andtrends: Next Fifty years says, “themost important finding regarding

future likelihood of violent conflictscomes from Lewis Fry richardson’ssearch for causative factors of warand his conclusion that wars arelargely random catastrophes whosespecific time and location we cannotpredict but whose recurrence wemust expect.” the probability ofwars and conflicts in future cannotbe ruled out. However, the natureand scale may be different. the pos-sible spectrum of conflict in today’sworld is very wide indeed. A nationmay choose to fight a war with its ad-versary even by proxy, as Pakistan isexecuting in Kashmir for the last fourdecades. At the lowest end of thespectrum is the low-intensity con-flict and at the highest is nuclear war.However, the level of escalation,once commenced, cannot be con-

trolled fully as the adversary neednot be governed by the escalatoryladder that one has planned to exe-cute. depending upon how soon thenational intention is fulfilled, con-flicts/wars could be limited in scope.It could be limited to a particular ge-ographical area, limited by interna-tional/binational commitment, lim-ited by use of weapon systems or lim-ited by time. A classic example oflimited conflict is the Kargil Warwherein it was limited to the geo-graphical area of Kargil, limited byIndia not crossing the Line ofControl (LoC) and was terminatedon July 26, 1999, once all thePakistani encroachments were evict-ed. With modern technologies, warscould also be fought by kinetic, non-kinetic means or a combination ofboth. Whereas the lethality of kineticweapon systems is ever-increasing,in terms of range, accuracy andstand-off attacks, the threat of non-kinetic systems like in the field of cy-ber and space is indeed very potent.New systems like directed EnergyWeapons (dEW) can bring a changeto warfare. Likewise, a well-orches-trated cyber attack can immobilisean adversary. History has shown thatskilful employment of new weaponsystems can significantly enhancethe chances of victory. All institutions have beencreated to serve and protect therights and interests of citizens, thustheir utility has necessarily to beviewed from the perspective of anaam aadmi (common man). Wehave thus to examine how far hasthe CAg addressed the daily con-cerns of the masses. Each time aCAg is appointed, there is alwaysmuch noise regarding the mannerin which the executive selects thecandidate and how such proceduresare detrimental to the independ-ence of the body. But does this aloneaccount for the functioning of theAudit department? the CAg makesbig news when critical reports onimplementation of certain schemesare published. the CAg’s report onacquisition of rafale, allocation of

coal blocks, auction of spectrum,conduct of the Commonwealthgames and so on brought it into thelimelight. However, do such reportsaddress the concerns of an ordinarycitizen? the Union and Stategovernments spend humongousamounts of money on welfareschemes to provide basic amenitiesto the underprivileged. It is in theform of free grain, housing, health,pension, free education, supply oftextbooks and so on. People livingBelow the Poverty Line (BPL) areentitled to such facilities, thus it is adetermining criteria for a host ofbenefits. the preparation of theBPL list is mired in controversywith complaints regarding inclu-sion of ineligible people and exclu-sion of eligible ones. Has the CAgever taken up an audit of such animportant activity? One of thedefining features of good gover-nance is speedy grievance redres-sal. A robust system in which an in-dividual lodges a complaint and aneffective machinery that looks intoit verifies its genuineness and pro-vides a quick remedy. Allgovernments have created sepa-rate departments for addressingpublic grievances. It is often seenthat complaints from the public are

routinely disposed of with a stan-dard answer “settled.” Has the CAgever verified whether the complainthas been settled? Has he ever com-mented on the effectiveness or ro-bustness of the grievance redressalmechanism? the right toInformation (rtI) Act was intro-duced with great fanfare and wasmeant to empower citizens. Underthe rtI, all departments were toproactively disclose information. Acursory examination ofgovernment websites would show

that they are hopelessly outdatedand one cannot even find the tele-phone numbers of key officials. I recall it to be asource of trusted information andthe news anchors, who pioneeredand brought the news to our homes,used to be respected, well-read andthoughtful individuals. this mightseem unimaginable and incompre-hensible to young readers today be-cause television news now appears tobe unrecognisable as being thefourth pillar of democracy it wasdecades ago. News media has under-gone dramatic changes from thoserose-tinted days when the news wasnot a 24x7 business but a way to keepcitizens informed about what was go-ing on in their country and across theworld. the advent of cable news, pio-neered by news organisations in theUnited States (US) like CNN,changed all that and made newschannels a 24x7 source of contentbut essentially with the same amountof information. CNN dealt with thissituation by no longer limiting itselfto the news at all. As reported in theEconomist, CNN has filled its chan-nels with original films and televi-sion series that are either licensed by

it or produced in-house. It has foundmajor success by adopting this ap-proach. For example, when it got onboard the late celebrity chef AnthonyBourdain to travel to exotic places ina show titled Parts Unknown, ithelped the channel attract close toeight million new viewers.therefore, news channels now areless about the news and more aboutthe views. television news today canbattle any soap opera for trPs. If youwant to see how thin the line betweena soap opera and a news channel is,

just look at the manner in which thedeath of an actor, Sushant Singhrajput, has been dealt with by newschannels with his alleged girlfriend,rhea Chakraborty, at the centre ofthe media trial. Just to give you anidea of what counts as news nowa-days, one national media channelran a programme titled Sushant parrhea ka kaala jaadu (Sushant was avictim of rhea’s black magic) with aheavy dose of graphic images and analarming lack of intelligence. Whennews channels show content like

this, they not only speak about thestory but inevitably (and, perhaps,intentionally) become the storythemselves. the coverage by certainsegments of the “news” media duringthis entire episode has been misogy-nistic, hateful and frankly speaking,a source of embarrassment for acountry that calls itself the largestdemocracy in the world. We must notforget that one of the basic tenets ofprogressive democracy and a fair le-gal system is that anyone accused of acrime is presumed innocent untilproven otherwise. It is a principlethat these “news” channels are wellaware of, as evident by the fact thatthey keep this in mind when speak-ing about Pragya thakur, a 2008Malegaon bomb blast accused andcurrent Member of Parliament butforget about it when it comes to thedeath of an actor. this farcical mediatrial has truly revealed the rot thathas set in deep in the field of journal-ism. News anchors and organisa-tions that produce and broadcast thistype of news need to think long andhard about the pressures and impactof such incessant media coverage. Ithas the potential to lead to cases ofdepression and, possibly, even sui-cides. I pray that we never see suchan outcome but what if such an un-fortunate situation does arise? sis have raised fundamental questions about how

to ensure the health and well-being of the world's

people and how nations must cooperate to advance the

tice. today is the time for bold leadership on clean energy

and climate action. India shall take the lead to be at the

helm of the ambitious leadership we need. India can be-

come a true global superpower in the fight against climate

change if it speeds up its shift from fossil fuels to renewable

energy. India's proportion of renewable energy rose from

17 per cent to 24 per cent while coal-fired power declined

from 76 per cent to 66 per cent. this is a promising trend

that needs to continue. renewable energy needs to grow.

And coal use must be phased out. that must be our story of

smarter, stronger, cleaner economies for the 21st century,

creating more jobs, more justice and more prosperity. All

the countries, especially the g20 countries shall be urged

to commit to carbon neutrality before 2050 and to submit,

well before the November 2021 UN Climate Change

Conference, more ambitious nationally determined con-

tributions and long-term strategies that are aligned with

the goal to limit the temperature increase to 1.5 degrees.

Indian leaders shall also take the decisions, make the in-

vestments and adopt the policies necessary to continue

this vital journey. India must end its reliance on polluting,

financially volatile and costly fossil fuels and instead in-

vest in clean, economically resilient solar power. today, as

we endure the twin crises of COVId-19 and climate

change, this effort has never been more important. A rap-

idly heating world threatens even more disruption and ex-

poses even further our world's deep and damaging imbal-

ances. As nations look to recover from the COVId pan-

demic, their commitment to doing better would include

transforming economic, energy and health systems to save

lives, create stable, inclusive economies and stave off the

existential threat of climate change. India has a key role to

play in that vital effort as India has all the ingredients for

exerting the leadership at home and abroad envisioned.

slips. But the government is in a rush to clear the ZMP be-

cause it wants to expedite the 900-km Char dham high-

ways project, which will connect the four pilgrimage sites

of gangotri, yamunotri, Kedarnath and Badrinath, easing

pilgrim access. Hence, against better counsel, the project is

on course. this despite the geological Survey of India

(gSI) report on the 2013 tragedy categorically saying that

landslides and flooding had been caused by the ever-en-

croaching and rampant construction. Successive

governments have overlooked geological features and

drainage patterns, and allowed illegal construction on riv-

er banks and over natural water channels in the name of in-

frastructure development in the hills. If the current ob-

server group’s warning is ignored, we could be looking at a big-

ger tragedy. the project preparations have already caused incalcu-

lable and long-term damage to the Himalayan ecology. trees

have been felled, hills have been cut and excavated materi-

al has been dumped without valid permission on various

stretches, burying flow channels and threatening local

habitat. there is brazen misuse of old clearances issued to

the Border roads Organisation (BrO) during 2002-2012

and over 200 km have been added on their basis. this is

not only illegal but also defeats the regulatory purpose

since the scope of work has changed drastically and the

present road widening work requires major excavations

into hill sides. Plus, there has been a violation of the apex

court’s directive as the Uttarakhand government had said

in an affidavit in April 2019 that stretches where work had

not begun would be subject to the assessment of the

Supreme Court. But in clear violation, at least 60 km of the

stretch has been coopted into the site map. Besides, the

Ministry disregarded the panel’s view that the developer

should not start new work and restore vulnerable slopes

before the yatra season to avoid landslides. As it is, there

has been a lot of heartburn over the new Environment

Impact Assessment (EIA) draft Policy 2020.

Environmentalists have accused the government of not

just watering it down but also taking away the voice of the

people who would be affected by development proj-

ects the most. And violations for a project that is consid-

ered to be Prime Minister Modi’s dream will only erode the

government’s credibility where its environmental commitment

is concerned.

When a crisis deepens, every country, includingthose with friendly relations, would consider the overallstrategic scenario prevailing at that time and react keepingtheir own national interests in mind. Such reactions neednot necessarily be in favour of one or the other adversary.In other words, a country should have the capacity to de-fend itself. this would lead us to the aspect of capability de-velopment. the significant facet to be deliberated is skillvis-à-vis intention. Whereas intentions can change withina short period of time, proficiency cannot. Capability, to becredible, must be consistent over long periods of time andmost importantly, keep the threat of war in mind. Any dilu-tion in perception of threat of war can immensely set backproficiency development, thereby seriously impacting anation’s war-waging power. Capacity development has toconsider future technologies, too. Advancement of tech-nologies in the world and their possible usage by the adver-sary need to be constantly scanned and systems upgradedto meet these challenges. Prior to World War II, despite aban, the germans developed tanks and air power, un-known to the world. And when the Allies learnt about it, itwas too late and these systems contributed notably togerman victory in battles. the entire spectrum of conflict,from low-intensity conflict to nuclear war, as also threatsfrom kinetic and non-kinetic use of systems need to be fac-

tored in. While weapons/equipment/other war-like mate-rial form one part of capability development, the other im-portant part is human resources development. A highmorale of the armed forces is a battle-winning factor. So isthorough training of all personnel in war-like conditions,in an all-arms integrated environment. Another vital ele-ment in capacity development is strategic self-reliance indefence production. the war-waging capability of thearmed forces can be seriously neutralised if anyweapon/equipment, ammunition or even a small part of asystem, being imported from another country, is denied ordelayed. As per SIPrI (Stockholm International Peaceresearch Institute), in 2019, India was the third-highestmilitary spender of the world at $71.1 billion, next only tothe US and China. Plus, in the time period between 2015-2019, India was the second-largest importer of weapons,accounting for 9.2 per cent of the world’s arms import. thegovernment’s policy of Atmanirbhar Bharat has created awin-win situation. On one end, strategic self-reliance canbe achieved and on the other, it can create opportunitiesand much-needed employment in the country. However, itis necessary to highlight that such systems produced in thecountry have to be world-class, meeting the operational re-quirements of the armed forces in terrain and situationsthat they need to be employed in. Any faulty productionwould endanger the lives of soldiers and the security of thecountry, besides being economically self-defeating in thelong-term. India has always been a peace-loving country,with no territorial ambitions and has contributed to theworld in every field. Such an attitude is instilled in the cul-ture of majority of Indians. Hence conflicts and wars arenot desirable. though India is a peace-loving nation, whenthreatened, the capability must exist to completely annihi-late the adversary and protect our culture. Another valuewhich is deeply embedded in Indian culture is Ahimsa.this word is sometimes misunderstood and portrayed asmeek submission. Whereas, it has quite a different mean-ing. Ahimsa prohibits thoughts of causing injury to others.It does not mean that if physically threatened, you do notretaliate. you should retaliate and strike the attacker sohard that he is rendered incapable of any further threat.the fear of defeat, just by the strength of your retaliationwould, therefore, suffice to keep him away. this is deter-rence by capability development.

Instead of protecting theirown community, that has been the unfortunate victim ofviolent crimes and pressures, some television anchorshave used their influence and the platform to focus their

stories on the influence of black magic in an ongoing inves-tigation. this is the true tragedy of television news. I oftenhear that news channels are in a race for trPs and need todo whatever they can to get attention as it is a question ofsurvival. While this is an explanation, it is far from an ac-ceptable one. Justifying the action of news anchors, by say-ing that news channels can only survive the new reality of24x7 reporting by compromising all journalistic integrity,is no different from defending corrupt bureaucrats orpoliticians who say that they can only survive in their fieldby taking bribes and junking their integrity. they are alldrinking from the same well. In fact, when I was speakingto my son, who is a lawyer, about the sad state of affairs oftelevision news, he exclaimed that it’s not all bad becausethese “journalists” have added a layer of respectability tothe lawyers. In the end, however, any real change can onlycome from the actors on the screen themselves. History isthe only real judge and when this period is looked back atby future generations, anchors, who had the opportunity tomould generations, will either be classified as Edward rMurrows or risk being called spokespersons of a formatthat can only be said to be inspired from radio rwanda.

Computerisation has been introducedin a big way in government departments as it not onlymakes life easy for the citizens but brings in greater trans-parency. A huge amount of money has been invested inthis exercise. Ideally a citizen should be able to accessgovernment services like obtaining various kinds of cer-tificates online. Has the CAg ever examined the effective-ness of computerisation on service delivery? An institu-tion becomes vibrant and retains the trust of citizens aslong as the people can identify with it. Citizens would re-pose trust in it as a guardian of their rights and protectorof their interests if they perceive it to be doing so. do theyhave such a perception about the CAg? the CAg’s officehas to increasingly focus its attention on what is trou-bling our citizens. Public delivery of services should al-ways be the focus area if the institution is to remain rele-vant. there is yet another area which needs to be revisit-ed. Over the years, the Audit department has beenlabouring under the belief that accountability is best en-forced through post-event fault finding. the approachhas been to identify cases of malfeasance, infraction ofestablished procedures and waste of public money. Whilethese are important findings, does it provide any kind ofassurance to citizens regarding systemic integrity?

Should the CAg not be looking at systemic issues ratherthan wasting its resources in examining one-off transac-tions? the other issue that needs to be debated is whetherthe CAg should blow his whistle post-event. Can we notmove into a system wherein the institution renders ad-vice and suggests a course of action before the event? Likea system of advance ruling? this would be in the largerpublic interest. What is the point of blowing the whistleafter public money has been wasted? It is better that weprevent a wrongdoing rather than comment after themischief has been done. the Indian CAg is perhaps theonly organisation which looks at the functioning of alltiers of government. the Union government, Stategovernments, Union territories, Urban Local Bodiesand Panchayats. It is the only organisation, which looksat such varied departments of government like atomicenergy, space, defence, Public Sector Units and so on. Ithas over the years acquired rich and varied expertise. thetalent pool available is unmatched. It should direct its en-ergies for more purposeful activity. Public interest wouldbe best served if it moves into a more collaborative ratherthan a confrontationist mindset. I write this not to criti-cise the functioning of the CAg but to remind ourselves tostep back and start looking at things from a different per-spective. I would have succeeded in my efforts if it gener-ates a healthy debate.

It was informedin the meeting that the district admin-istrations have started the measuresfor sending asymptomatic patients tohome quarantine and scale up sam-pling/testing in offices, business es-tablishments and other vulnerableplaces. the dC Udhampur informedthat the district administration hasidentified nine vulnerable locationsincluding Business establishments,Banks and government Offices in the
