When we are working on the issue the general election 2019 are going on So there is aquestion who will be in power after election For me it does not matter but what really matter forus is to whom we are casting our vote and why

Another burning issue is sexual harassment allegations on Chief Justice of India

It is right that before voting one must be aware of his rights but it is also important that heknow the bigger picture very well During the current election 2019 menrsquos right organizationasked to vote NOTA which is basically denying all candidates They have reasons to do so If westudy the manifesto of major parties like BJP amp Congress we find that there is nothing aboutmen Political parties are not interested in men anymore They care for womenrsquos vote but theydonrsquot care for menrsquos vote

I would like to share one example When Mr Modi visited Varanasi for his Namakan hemeet kids The news was all over Indian media Did he really meet kids Technically yes but if welook the news deeply he meet only Female Kids There was not even one Male Kid What doesthat mean

Now the question is if we are cast our vote to nota who is going to get benefit and who willbe in power also it is important if it can damage Indias growth

Last election was in 2014 and BJP get a bumper majority in Lok Sabha The majority BJPget was after a long time and BJP get majority because of various reasons one of them was thepromises made by Mr Modi as well as his publicity management

Once BJP get a bumper majority and it become the strongest govt in recent years weexpect a very good work too But if we analyze 5 year report card of BJP govt my finding is thework done by BJP govt is just normal one I can not remember a single issue where they were ableto use their bumper majority They could have used their majority for solving Kashmir issue orthey could have solved Ram Mandir issue The majority could have been used in many way butunfortunately the govt choose to work like any other govt and outcome is also normal Many willrise a question that BJP was not having majority in RS but expert will be able to explain that BJPwas having bumper majority in LS and they could have worked freely without having majority inRS We give bumper majority and BJP did not used it now if we give just sufficient majority thesituation will be more or less same That means if we are casting nota and BJP did not get bumpermajority still the situation will be same

But main question is what if BJP just goes out of equation because of nota as they goes outin Rajasthan My view is it does not matter who comes into power BJP performed well when weare talking about Railway Services but they failed at the job front I agree that BJP govt has takenhard step for security but govt is not just for safai amp security Govt is for a wider reason and whenwe look widely their performance was not extraordinary but their 5 year record is just normal just

like last govt (Manmohan Singhrsquos) In short I can say if for next 5 year BJP comes into power orCongress or any other front it may not matter as long as we are expecting a normal performanceand I can not see any leader who can give a push

So if Menrsquos Right organizations asking for cast Nota to put forward their demands ofHuman Rightrsquos Violations of Men I am ok with that and request every Menrsquos Right Supporter todo so without thinking that they may be damaging something

Sexual Harassment allegations against Chief Justice of India (CJI) Another burning issuetoday is sexual harassment allegation against CJI A former employee of SC of India has madeallegations of Sexual harassment against CJI Ranjan Gogoi in an affidavit The affidavit is sent toall the judges of SC on Apr 19 2019 For detail anyone can google In past we have observed thata large number of false allegations of Sexual Harassment or Rape are framed because of variousreason Does that mean I am saying allegations on CJI are false Well CJI denied the allegationsbut my concern is not about the truthfulness of allegations but my concern is about how thesituation handled CJI continue working on his post and in-house investigation going on I canremember a recent incident from Gurgaon where an employee was suspended from his post assoon as company get complain I also can recite 1000s cases where men get suspended as soonas allegations were made Even I can remember Bollywood cases where people come forward anddenied working with the directoractor etc who get allegations during MeToo movement Buthere we are looking at very different scenario We are facing a situation where CJI is on his postworking without any problem even after allegations and parallel investigation going on Why onlyCJI is getting this special treatment why not all Indian men deserve the same respect till they areproven guilty When a men get suspended or sent to jail just because of allegation it is directattack on his Human Rights as well as his dignity

I stand with CJI with full support but I also demand the same treatment for other men too

A witness cannot be said to be an interestedwitness merely by virtue of being a relative of the victim

The witness may be called interested only whenhe or she derives some benefit from the result of alitigation in the decree in a civil case or in seeing anaccused person punished the Supreme Court observedwhile rejecting a defence contention in a criminal appeal

Defense had raised an argument that thetestimonies of interested witnesses who are relatives ofthe deceased should not have been relied upon by theTrial Court Sadyappan was convicted by the Trial Court(which was later upheld by the High Court) for the murderof his neighbour Selvam Thangaraj

In the appeal filed by the accused the court thattheir testimonies has stood the rigour of cross-examination and though they may be related but theycould not be labelled as interested witnesses It saidCriminal law jurisprudence makes a clear distinctionbetween a related and interested witness A witnesscannot be said to be an interested witness merely byvirtue of being a relative of the victim The witness maybe called interested only when he or she derives somebenefit from the result of a litigation in the decree in acivil case or in seeing an accused person punished

Referring to their testimonies which corroboratedthe prosecution version the bench dismissed the appealand observed Though they are related to each other andto the deceased as well their evidence cannot bediscarded by simply labelling them as interestedwitnesses After thoroughly scrutinizing their evidencewe do not find any direct or indirect interest of thesewitnesses to get the accused punished by falselyimplicating him so as to meet out any vested interest

Some witnesses in this case had stated that as thedeceased did not turn up after leaving home at 11 pm on

the previous night they went in search of himand found his dead body in Vaalaithope Oneof them who is a nephew of the deceased alsodeposed in his statement that when he went toSirumugai Police Station he saw the accusedpersons there and witnessed their confessionalstatements recorded by the policeThe wife ofthe deceased had stated that the deceased waslast seen together with the accused

The Supreme Court has observed thatthe incidents which had taken place betweenhusband and wife much before latters death bysuicide could not be treated as the conductwhich drove her to commit suicide

Jagdishraj Khatta was convicted by theHimachal Pradesh High Court under Sections498A and 306 of the Indian Penal Code byoverturning the acquittal recorded by the TrialCourt Khatta was convicted by the High Courtrelying on (1) the testimonies of the relatives ofthe deceased that the accused husband actedin a cruel manner against the deceased in frontof her relatives and (2) the letter allegedlywritten by the deceased around the time of herdeath to her parents

The court observed that the incidentsnarrated by the relatives had taken place muchbefore the deceaseds death It said As theHigh Court itself indicated somewhatcontradictorily reliance on the instancestestified to by the witnesses would not beappropriate as the said incidents had takenplace much before the deceaseds death and

could not be treated as conduct which drovethe deceased to commit suicide

The High Court had also observed thatall those incidents had taken place much beforethe commission of the suicide by the deceasedand therefore they cannot be treated as theimmediate cause of provocation for thedeceased to take the extreme step

As regards the reliance placed on letterthe bench agreed with the accused contentionthat the letter has not been proved to havebeen written by the deceased and issurrounded by suspicious circumstances Thefact that the deceased had never written anyother letter to her family after her marriage buthad rather been in touch with her relativesthrough the telephone further strengthens thecase of the appellant the bench added

Setting aside the High Court judgmentthe bench restored the Trial Court order ofacquittal

HC suggests to exclude consensual sex withgirl aged above 16 from rigours of POCSO Act

Redefine child exclude consensual sexafter the age of 16 from POCSO Madras HCMore liberal provision can be introduced in theAct itself in order to distinguish the cases ofteenage relationship after 16 years from thecases of sexual assault on children below 16years

The Madras High Court has suggested toredefine the definition of Child under Section2(d) of the POCSO Act as a person below 16

years of age instead of 18 years so that anyconsensual sex after the age of 16 or bodilycontact or allied acts can be excluded from therigorous provisions of the POCSO Act

The Judge took note of a report thatmajority of cases involving minor girls are dueto relationship between adolescent boys andgirls Though under Section 2(d) of the ActChild is defined as a person below the age of18 years and in case of any love affair betweena girl and a boy where the girl happened to be16 or 17 years old either in the school final orentering the college the relationship invariablyassumes the penal character by subjecting theboy to the rigours of POCSO Act the courtsaid The judge further observed When thegirl below 18 years is involved in a relationshipwith the teen age boy or little over the teenage it is always a question mark as to how suchrelationship could be defined though suchrelationship would be the result of mutualinnocence and biological attraction Suchrelationship cannot be construed as anunnatural one or alien to between relationshipof opposite sexes But in such cases where theage of the girl is below 18 years even thoughshe was capable of giving consent forrelationship being mentally maturedunfortunately the provisions of the POCSO Actget attracted if such relationship transcendsbeyond platonic limits attracting strong arm oflaw sanctioned by the provisions of POCSOAct catching up with the so called offender ofsexual assault warranting a severeimprisonment of 710 years

The court said that more liberalprovision can be introduced in the Act itself inorder to distinguish the cases of teen agerelationship after 16 years from the cases ofsexual assault on children below 16 years

The Act can be amended to the effectthat the age of the offender ought not to bemore than five years or so than the consensualvictim girl of 16 years or more So that theimpressionable age of the victim girl cannot betaken advantage of by a person who is mucholder and crossed the age of presumableinfatuation or innocence

The Judge further said that more thantreating such growing incidence of sexualassault on women and children as a legal issuedealing with the offenders of sexual assault byresorting to most deterrent provisions of Penallaws the cause for such perverse and wickedbehaviour among some men who wereotherwise normal in their disposition need tobe examined and studied

The Society must collectively introspectwhat is it that drives some men to unleash theirlibidinous rage on hapless children and womenof all age The cause for such abominabledeviant conduct on the part of the perpetratorsof sexual crime on children and women isperhaps became of access to uncensoredpornographic and erotic materials that areavailable on the internet 24 X 7 Access to suchprovocative and lewd sites lead to criminalsensuality that drives the perpetrators tocommit such appalling crimes on children andwomen in complete depravity When mindsare filled with lust smouldering all the time bywatching pornographic site of all kinds on thehandset or otherwise such crimes are thenatural result of the depraved minds

The judge also suggested constituting ahigh level committee comprising persons ofeminence from various walks of life like Socialauditor psychologists Social Scientist etc toinvestigate and study the malady afflicting theSociety

Divorced wife cannot file application underDomestic Violence Act application filed underSs 12 and 18 rejected in absence of ldquodomesticrelationshiprdquo

The High Court refused to interfere withan order of the Judicial Magistrate asconfirmed by the Sessions Judge whereby theapplication filed by the applicant under Section12 and 18 of the Protection of Women fromDomestic Violence Act 2005 was dismissed

The applicant married to the respondentin 1999 However a decree of divorce underSection 13 of the Hindu Marriage Act 1955 hadbeen passed by the family court in 2008 at theinstance of the husband The application underthe DV Act was filed by the applicant in 2009ie subsequent to the grant of divorce Therespondent resisted the application on theground that there was no ldquodomesticrelationshiprdquo between them and therefore anyapplication under DV Act was not maintainableThe application was rejected by the JudicialMagistrate as well as the Sessions JudgeAggrieved thereby the applicant filed thepresent revision application

After perusing a conspectus of decisionsof the Supreme Court as well as High Courtsthe Court came to the conclusion that no reliefcould be granted to the applicant It wasobserved ldquoIn the present case divorce wasgranted by the family Court vide order dated30-06- 2008 Application under the DV Actwas filed in the year 2009 At the time of filingof application under the DV Act the applicantwas not the wife There was no domestic

relationship between them Hence orderspassed by the learned JMFC Nagpur andmaintained by Additional Sessions JudgeNagpur in Criminal Appeal No 235 of 2015 areperfectly legal and correctrdquo In such view of thematter the revision application was dismissed

Transwoman a Bride under Hindu MarriageAct

The marriage between a cisgender manand a transgender woman on Monday receivedthe blessing of the Madras High Court in amanner of speaking Sitting at the MaduraiBench Justice GR Swaminathan observed ldquoAmarriage solemnized between a male and atranswoman both professing Hindu religion isa valid marriage in terms of Section 5 of theHindu Marriage Act 1955 and the Registrar ofMarriages is bound to register the same

By holding so this Court is not breakingany new ground It is merely stating theobvious Sometimes to see the obvious oneneeds not only physical vision in the eye butalso love in the heartrdquo

The Court had been moved byArunkumar and Srija after the state authoritiesrefused to register their October 2018marriage In this case Srija was a transgenderwoman While she had been born intersex shehad identified herself as a woman which wasalso reflected in her state Ids

The government authorities took thestance that the marriage between Arunkumarand Srija could not be recognised as Srija is atransgender person This was interpreted by


the authorities to mean the Srija is not awoman

Justice Swaminathan howeverdisagreed emphatically particularly in view ofthe Supreme Courtrsquos 2014 NALSA judgmentwhich had recognised the self-identificationrights of transgender persons He states in hisjudgment

ldquoI am unable to agree with the stand ofthe learned Government Advocate hellip As rightlypointed out by the learned counsel appearingfor the writ petitioner the issue on hand is nolonger res integra In the decision reported in(2014) 5 SCC 438 (National Legal ServicesAuthority vs Union of India) the HonrsquobleSupreme Court upheld the transgenderpersonsrsquo right to decide their self identifiedgender The central and State governmentswere directed to grant legal recognition of theirgender identity such as male female or thirdgenderhellip hellipWhen the right of the transgenderpersons to marry has been upheld by theHonrsquoble Supreme Court in the very nature ofthings they cannot be kept out of the purviewof the Hindu Marriage Act One can have a civilmarriage One can also have a sacramentalmarriagehelliprdquo

Sex and Gender are not the same

Recalling the principles affirmed in theNALSA judgment Justice Swaminathanproceeded to observe ldquoSex and gender are notone and the same A personrsquos sex is biologicallydetermined at the time of birth Not so in thecase of genderhellipthe Honrsquoble Supreme Courtheld that Article 14 of the Constitution of Indiawhich affirms that the State shall not deny toldquoany personrdquo equality before the law or theequal protection of the laws within the territoryof India would apply to transgenders also

Transgender persons who are neithermalefemale fall within the expression lsquopersonrsquoand hence entitled to legal protection of laws inall spheres of State activity as enjoyed by anyother citizen of this country

Discrimination on the ground of sexualorientation or gender identity thereforeimpairs equality before law and equalprotection of law and violates Article 14 of theConstitution of India Article 19(1)(a) and Article21 were expansively interpreted so as toencompass onersquos gender identity alsordquo

It was noted that the NALSA judgmentwas also cited with approval in the Right toPrivacy case as well as Navtej Joharrsquos caseconcerning the decriminalisation ofhomosexuality in India

Coming to the instant case the Courtpointed out that after Srija identified herself asa woman the state does not have the power todeny her of that identity

ldquoIn the case on hand the secondpetitioner herein has chosen to express hergender identity as that of a woman As held bythe Honrsquoble Supreme Court this falls within thedomain of her personal autonomy and involvesher right to privacy and dignity It is not for theState authorities to question this selfdeterminationrdquo

ldquoBriderdquo under Hindu Marriage Actincludes transwomen

The Court went on to reject the Statersquoscontention that a transgender woman couldnot be viewed as a ldquoBriderdquo under the HinduMarriage Act

ldquoThe expression ldquobriderdquo occurring inSection 5 of the Hindu Marriage Act 1955cannot have a static or immutable meaning As


noted in Justice GPSinghrsquos Principles ofStatutory Interpretation the court is free toapply the current meaning of a statute topresent day conditions A statute must beinterpreted in the light of the legal system as itexists todayhellip hellip Seen in the light of the marchof law the expression ldquobridersquo occurring inSection 5 of the Hindu Marriage Act 1955 willhave to include within its meaning not only awoman but also a transwoman It would alsoinclude an intersex persontransgender personwho identifies herself as a woman The onlyconsideration is how the person perceivesherselfrdquo

Transpersonrsquos right to marry has beenrecognised by the Supreme Court

The Court further pointed out that theSupreme Court has specifically recognised theright of marriage for transgender persons inparagraph 119 of the NALSA judgmentMoreover the right of persons to marry aperson of choice has also been specificallyendorsed in Hadiyarsquos case the High Courtjudgment highlights

The Court proceeded to remark ldquoFortoo long the transgender personsintersexpeople have been languishing in the marginsThe Constitution of India is an enablingdocument It is inviting them to join themainstream Therefore it would be absurd todeny the transgenders the benefit of the socialinstitutions already in place in themainstreamldquo

In view of these observations the Courtallowed the writ petition and directed the stateto register the marriage of the petitioners

Further the judge also pointed out thatthe marriage in the case was an inter-castemarriage Therefore the petitioners were alsoeligible for benefits provided by the state to

encourage inter-caste marriages under theDrAmbedkar Scheme for Social Integrationthrough Inter- Caste Marriages

Issue GO against forced SexReassignment Surgery (SRS) on Intersexchildren

While dealing with the case JusticeSwaminathan also took note that the SupremeCourtrsquos mandate against forced surgicalprocedures on intersex children was beingobserved more in breach than compliance Asobserved in his judgment rdquo [intersex children]must be given their time and space to find theirtrue gender identity But the parents make theinfant undergo sex reassignment surgery (SRS)hellip hellipthe Honrsquoble Supreme Court in NALSA casecategorically stated that no one shall be forcedto undergo medical procedures including SRSsterilisation or hormonal therapy as arequirement for legal recognition of theirgender identity But what is happening inreality is more in breach of this judgementgiven by the Honrsquoble Supreme Courtldquo

He went on to observe that a particulargender cannot be forcibly thrust on non-binarypersons

ldquoA person who is in the Third Category isentitled to remain beyond the duality ofmalefemale or opt to identify oneself as maleor female It is entirely the choice of theindividual concernedrdquo

In view of the same the Court has nowdirected the Tamil Nadu government to issue aGovernment Order to uphold the NALSAjudgment and to ldquoeffectively ban sexreassignment surgeries on intersex infants andchildrenrdquo The government is expected tosubmit a compliance report regarding thissame within eight weeks


The Court also noted that the stateshould undertake awareness programmes tode-stigmatise the birth of intersex children

ldquoThe parents must be encouraged to feelthat the birth of an intersex child is not a matterof embarrassment or shame It lies in the handsof the Government to launch a sustainedawareness campaign in this regardldquo

In this backdrop the Court alsoexpressed its appreciation for recent Tamilfilms that involved transgender characters

ldquoRecent Tamil Films such as ldquoPeranburdquowhere Mamooty marries a transgender andldquoSuper Deluxrdquo where Vijay Sethupathi plays therole of a transgender and is also a parent to thechild he has fathered are encouraging trendsrdquoremarked Justice Swaminathan

Before parting with the matter JusticeSwaminathan also expressed gratitude tointersex activist Gopi Shankar from Madurainoting that his work has had been a humblingand enlightening experience for the Court

The Land of Kings is a story or the life of a kid who bornand live in difficult conditions but finally rise to rule Thetime period of story is very very old even when the time

was not even counted

Chapter 001 THE CAVE

Long long time ago when human society was notso developed human just started to live in groupsdevelopment in science was just started machine wasjust invented human were doing his work by hands menand women both were equal no-one was dependent onothers major work in hand was to earn food At the edgeof Himalayas in a small even very small village of 9 or maybe 10 houses a kid was born

No-one knows the real name of the kid but thevillage name was Navrang and when the kid was younghe get the same name The village today may not exist onmap but at that time it was a small but very beautifulvillage surrounded by hills

North side of village was having a series of snowcovered hills and the south side was having a series ofhills covered with greenery Greenery was extended tillthe human eye can see and snow was extended till theend of hills But natural conditions toward hill was sodifficult that no-one crossed it Those hills when notcovered with ice provide leafs of medical importanceSame time the forest was so dense that no-one dare to

enter into that Still the trees at the edge offorest provide them fruits

No-one from the village remember ifsomeone entered deep into the forest stillstories circulate about the existence of badcreatures and monsters No-one saw thosemonsters no-one knows the truth but theybelieve in stories Rest two sides were humanfriendly Third side of village was blocked byriver the river not only provide them drinkingwater but also support their fields This sidewas most important for village but same timethe river also block villagers path The last sidewas a plain field most useless for villagersUseless because stories tell the end of the plainfield was a big village but it is so far that no-one had traveled in living memories

We donrsquot know the name of newly bornkid but his future name is Navrang so we willuse the same right from beginning

Navrang was a kid just an ordinary kidbut physically stronger then neighbor kids Heis just 10 year old but he looks like 15 year oldBecause of his physical strength only he wasaccepted as a leader in between neighbor kidsThe leadership was just limited to playing inriver and on hills It was Navrangrsquos right tojump into river first he was first who get rightto catch fish from river But fortunately henever pushed his right it was just accepted byother kids No-one remember how and whenNavrang was accepted as a leader but most kidremember one incident which might be firstwhere he get throne of leadership

It was summer a little hotter then pastfew years even calling it year is not justifiedbecause year or month is not the unit of timeyet we can say season although it is rare to getfish in river but sometime people get smallfishes It was lucky day for the group of 20 kids

when a young kid jumped into river and caughta big fish Same time it was kidrsquos bad luck thathe could not come out because of water flowOther kids helped him to come out and thatcost him share in fish which he didnrsquot botherBut issue rise when two kids demanded alarger share just because one jumped into riverand second because he made it eatable Theissue was resolved peacefully by Navrang bysharing in between 18 kids Two fighting kidsdidnrsquot get any share same time they dare not torise voice against Navrang because of hisphysical power Probably that was thebeginning of Navrangrsquos leadership

One day when it was almost dark kidsback to home stoves ready for dinner suddenlya loud bang was witnessed by manyunfortunately they didnrsquot bother just becausesuch sounds was common in hills Sometimefalling ice and sometime creature in forestcreate such noise that was the common excusefor villagers But today was not an ordinary daytoday the sound started but never ended formany The sound was not unusual but it wasbecause of natural disturbance the end ofdisturbance was also the end of village Nextmorning when nature calm down the villagewas under tons of ice

Nature is cruel enough to end entirevillage but same time it allow to surviveNavrang and 3 of his friends The remaining ofvillage is nothing more the four kids Village isunder ice their food stock is under ice theirfield is under ice river is also missing eitherchanged path or just stopped in short there isnoway to survive further at-least not here It istime when Navrang need to extend hisleadership from just playing to survive Otherthree kids depends on him now

Although Navrand is also kid but heknow he has to find the way to survive and takestand against nature Here they can surviveduring day time but the night going to killthem Itrsquos time to believe the stories and reachnext village which is somewhere in the end ofplain field very very far Without food andcloths it is impossible to reach The only wayleft is going inside forest where they can getfruits and they can spend night if they get caveBut what about the creatures living insideforest

Navrang choose to enter the forest asusual rest three friends follow him Well beforethe evening all four kids entered inside forestSoon they realize that the forest is so densethat sunlight not even touching ground and asthey are moving inside the darkness risingAfter couple of hours when Navrang with hisfriends reached at the top of a small hill it isalmost night and light canrsquot be seen anywherenear but they see the empty cave to serve themfor night But what if the stories of unknowncreatures are true

It is almost end of night when suddenlyNavrang saw fog all around the cave fog hehas seen thousands of time but what he hasnot seen in past is fog limited in a small regionThe fog Navrang witnessed was just around thecave rest of the forest was free Next morningwas good for them because they find almostevery necessary thing nearby and cave wasenough hot to survive

It is time to decide if they can stay herefor rest of life or they should go further intoforest As usual Navrang was leader and hisdecision was accepted by all and his choice wasto stay in hot amp calm cave and same time hedecide to explore the forest This place wassuitable for them because they get food from

nearby trees cave provide them warm and safestay for medicine they can visit hillsoccasionally and last night was peaceful Hisonly worry is the regional fog What he can doif he saw the fog again tonight

The place where Navrang saw fog lastnight was not far from the cave but the place isseparated from cave by a small river whichthey canrsquot cross Also the place it slightlyhigher therefore there is no way to investigatethe place Even I am not sure if the fear allowthem to investigate There was nothing specialduring that day except they searched nearbyplaces for the foot-steps of creatures theycollected fruits and water for night also theymade few arrangements to cover the cave

Unfortunately the four kids searchednearby cave but they didnrsquot bother to see theend of cave where someone was waiting forthem in dark
