No. 7330/15 Agri.WHEREAS by "The Plant Diseases Act, 1914," it isenacted that the Governor may by Proclamation revokeor vary any Proclamation made under the said Act: Nowtherefore I, the said Governor, acting by and with theadvice and consent of the Executive Council, do herebyvary the Proclamation made under the said Act on the10th day of March, 1915, and published in the Govern-ment Gazette on the 12th day of March, 1915, wherebythe use, carriage, and storage within the State of anycovering in which any such fruits as are specified in theschedule to the said Proclamation have been contained,and from which such fruits have been unpacked or re-moved, was prohibited being varied by adding a furtherproviso to the said Proclamation as follows:

"Provided, also, that the coverings known as "FlatCases," and having the dimensions of 26in. x 13? /tin. x51 /,in., which have contained any of the aforesaid fruitsmay be used as coverings for tomatoes only, in that por-tion of the State North of the 33rd parallel of Southlatitude, if such coverings have, before being so used,been thoroughly steamed at the Government Fruit Shedsat Fremantle to the satisfaction of the Officer in Chargeof such Fruit Sheds and have been legibly branded onboth sides in stencilled letters not less than one inch inheight with the words "Government Steamed" and onone end with the word "Tomatoes."

THE following Report and Finding of the Chief Har-bour Master into the beaching of the s.s. "DunsterCastle" about six miles West of Shoal Cape, on themorning of the 7th of July, 1916, has been approved bythe Hon. the Colonial Secretary.

I beg to report having held a Preliminary Inquiry intothe circumstances attending the beaching of the s.s."Dunster Castle" about six miles West of Shoal Cape,on the morning of the 7th July, 1916.

The "Dunster Castle" is a single-screw steamer,155 tons gross, and 62 nett register, No. 128012, ownedby George Bell, Melbourne, Frederick Schroder, Master.

After hearing the evidence of the Master, Mate, andEngineer, I have to report that the s.s. "DunsterCastle" left Esperance for Albany in very light trimon the 4th July, at 8.30 a.m., at which time the weatherwas line, wind moderate W.N.W. Towards midnight thewind had increased to a gale from the N.W., whichbrought up a heavy sea, causing the vessel to labourheavily. At 5 a.m. on the 5th the wind shifted toS.S.W., and as no headway was being made, the coursewas altered to S.E., with the intention of returning toEsperance, Rocky Island at the time being S.W. distantseven miles.

Headway was made to the Eastward, but the ship wassetting bodily to leeward towards the land, and whenapproaching Butty Head, two miles distant, it was foundthe vessel could not weather the head, the wind havingdrawn to S.S.E. The course was then altered to S.W.with the view of getting off shore, fierce gale stillblowing with mountainous seas.

At 10 a.m, on the 6th, Rocky Island bore W.N.W., dis-tant 10 miles. Still blowing hard from Southward, withheavy squalls and thick rain. At this time the engineerreported the bilge pumps choked, and water in the shiphad risen over the stokehold plates, consequently hecould not keep a full head of steam. As the pumpscould not be cleared at sea, the Master decided to seekshelter in Fanny Cove, but owing to the land beingobscured by rain, he mistook a point of land to theWest of Fanny Cove for the Bay itself, and broughtup there with both anchors down.

The ship hung on until the following morning, keep-ing the engines moving slow ahead to ease the strain onthe cables. At 7.15 a.m. the starboard cable parted,and ship then started to drag broadside on towards thebreakers.

As the vessel had not sufficient power to force herway out of the Bay, the Master decided to beach her,which he did successfully on soft ground, head in shore,without damage to the hull of the vessel.

After consideration of the above evidence, I find (a)That the casualty was due to the exceptionally heavyweather, the vessel being in light trim, and water get-ting below thereby preventing the Engineer from keep-ing a full head of steam; (b) That no blame is attach-able to the Master and Officers, as every endeavourwas made to bring the vessel into port when it wasfound that the weather was too much for her.

No further action is necessary.

REGULATIONS.1. Second-hand that fruit eases having the dimensions

of 2Gin. x 131/(bi. x 51 /.in. may be used in that portionof the State north of the 33rd parallel of south latitudefor the purpose of packing tomatoes only: provided thatsuch cases have, before being so used, been thoroughlysteamed at the Government Fruit Sheds at Fremantleto the satisfaction of the Officer-in-Charge of such FruitSheds.

2. All cases treated under these regulations shall,before being removed from the Government Fruit Shedshe legilwly branded on both sides in stencilled letters notless than one inch in height with the words "Governmentsteamed," and on one end with the word "Tomatoes."

3. Any person intending to use second-hand flat fruitcases for the purpose of packing tomatoes shall deliverall such cases, complete with lids attached, to the Officer-in-Charge of the Government Fruit Sheds at Fremantlefor the treatment mentioned in the preceding regula-tions: provided that not less than 50 eases will be re-ceived at any one time from any such person.

4. Cases will be treated daily (except Saturdays)between the hours of 9 a.m. and 2 p.m., and any casesintended for treatment must be delivered at the Shedsnot later than 5 p.m. on the previous day.

5. The owner of any cases delivered for treatmentshall provide at his own expense sucC labour for thepurpose of stacking, branding, or otherwise dealing withsuch cases as may be directed by the Officer-in-Charge.

6. The following fees shall be paid for the treatmentof cases.

For the first 100 eases or part of 100 cases -1/ d.per case.

Over 100 eases -1/4d. per ease.All fees shall be paid in advance at the office of the

Fremantle Harbour Trust, and no cases will be receivedfor treatment unless accompanied by a receipt lir thepayment of such fees.

(4.) No additional charge will be made for labour,either under Section A or B.

(5.) The above charges include inspection and brand-ing fee of the Health Authority. Any fees payable forinspection by the Commonwealth authorities to be paidby the owner.

(6.) The following charges shall be payable by theowner in respect of all stock brought in for slaughterfrom the saleyards or elsewhere while such stock areawaiting slaughter: -

of per clay.No charge will be made for the first 24 hours.

BY virture of the provisions of " The Water Boards Act, 1904," and " The Water Supply, Sewerage, and Drainage Act, 1912,"notice is hereby given to all parties interested, and whose names are mentioned in the schedule hereunder, that the sums set forthopposite their respective names have now been due and unpaid for twelve months in respect of rates made and assessed by theLeonora Water Board, being the Water Board for the Leonora Water Area, and by the Minister of Water Supply, Sewerage,and Drainage, upon land situated as specified in the said schedule and described in the certificate of title and containing themeasurements more or less as set forth in the said schedule, and payment of the said sums is now required and the owners ofthe said properties and all other persons interested therein are hereby warned that in default of payment of the said sums, togetherwith all expenses caused by the non-payment of the same, on or before the twelfth day of October, 1916, to the Clerk in Chargeof the Water Supply Department at Leonora, a petition will be presented to the Supreme Court praying the said Court to orderthe said properties or a competent part thereof to be sold pursuant to the provisions of the said Acts.
