Preface

This report is an outcome of the four weeks Internship program of Institute of law, Nirma

University for the students of 4th semester. The main constituents are the report on

fieldwork carried out during the internship, the research on related issues/cases/matter and

the weekly report of my work. I have tried my best to do justice with my activities and

EXECUTIVE SUMMARY

Overview

This internship started from 4th December 2020 and ended on 4th January 2021. This became an enriching internship which had a powerful impact on me. The Senior advocate under whom I worked is a very inspirational with a very powerful cause of making the world a better place. His methodology and the desire to work keep you going with enthusiasm and alertness. He constantly made sure that certain things are best for me to perform with utmost perfection. His perfection in itself could be very humongous mission for us to attain. Due to the Covid-19, I had missed the chance to go the High Court or other Trail courts as all the hearings were online.

Summary of weekly work done

Week 1

In the starting I was asked to introduce ourselves and were questioned about the basics of law and about the academic background. On the first day I was introduced with some basics of research techniques and tricks followed by one small assignment. Later in course of time all the rules and regulations of the office were explained with other rules relating to paper work and clerical work. I was given the research topic and was asked to research upon it, the question of law was related to Section 498A of IPC and Defamation. I was questioned on law of torts and were asked to submit a note on the essentials of defamation along with recent case laws relating Dowry Harassment. This case dealt under Section 499 and section 500 of the Indian penal code which defines the criminal defamation and the punishment for the same. Among other case laws we referred to the case of Subramanyam Swamy vs. Union of India, were the court was of the opinion that criminal defamation is not violative of fundamental right to freedom of speech and expression under Article 19(1)(a) of the Indian Constitution, being a permissible restriction under Article 19(2). It was also held that Section 499 and 500 of IPC are not discriminatory, arbitrary, or violative of right to equality under Art 14 of the constitution. Another research for the case was given, it was a civil dispute case relating to the revocation of joint power of attorney, in this case One of the co- owners holding ownership of the property desires to cancel the Power of Attorney given t and the question of laws was whether the permission and consent of the other co- owner is required to revoke/cancel the Power of Attorney. Also, I was asked to research on the legal status of property of the first brother after the cancellation of the power of attorney. In this case I was explained about the various types of power of attorney and their cancellation process and about their rights, power and duties. I had to researched with the help of commentary and online sources, in this case we understood the difference between general power of

attorney and specific power of attorney for. Also, I was asked to research upon the differences between registered power of attorney and unregistered power of attorney with the process and procedure of their cancellation. I had to find case laws regarding the same and submit with their analysis. In the end of the week, we were given some part of clerical job. I was supposed to file the papers in the court on the next day for which we had to arrange and fill the papers with complete and relevant information, in this process we learnt about various legal terminologies and the procedure of filing the suit/petition in the court.

Week 2

In the starting of the second week, I worked on the Administrative Law. I was asked to research upon the subject of Government Order. The research was based on the question whether the state can form a body on its own without the permission of the central government though there is a body already established and working for the same purpose. The second research in this week was based on the subject of Arbitration and conciliation. Research was prominently based on the enforcement of Arbitral Award. The question of law was whether arbitral award can be enforced by a person who is not a party to the arbitration proceeding.

Week 3

In the starting of the third week, I was informed about the latest developments which took place in the case relating to the quash filing which was filed the previous week and were asked to start researching upon the development. In this case respondent had filed multiple FIR’s in different police station, basing on the FIR the police had seized all the bank accounts of the plaintiff, and was unable to access them for basic necessities. We were told to research upon the Section 91 and Section 102 of CrPC. Section 91 of CrPC deals with the summons to produce document or other thing which is necessary or desirable to the investigation, enquiry or trail. Followed by this research we were given a small drafting work i.e., Demand Notice for the amount due to the party for the services rendered and research based on the conflict between the power of attorney and principal.

Week 4

In the last week of the internship, we worked on the Evidence Law under the Section 63 and 65. Research was based on the question, is a xerox of a xerox permissible in the court of law.

A Brief of Law Firm

Allied Law Offices has been established recently by the three friends who have worked

and interned under the Senior council S. Niranjan Reddy. Allied Law offices is

Partnership Legal Firm which managed by the young team of lawyers who are very open-

minded and dynamic with a strong research-oriented approach located in Hyderabad. The

Introduction

This internship was filled with a lot of opportunities and learning, this internship gave me a

realistic and firsthand experiences which cannot be understood by reading the theory. This

internship made me aware of the branches and practicality of the laws and gave me higher

perception of law. on the first day of the internship, I was very anxious, puzzled and the same

time I was very excited for the new opportunities in my way.

Due to the Covid-19 physical hearing was not allowed and all the cases were heard virtually

which was a drawback for me, but I got the chance to observe the way the lawyers argue

virtually. All the lawyers in the firm are very passionate and hard working they have helped me

understand the basics of working of the courts and the procedure from hearing the clients to

arguing the case before the Judge.

This was my first legal internship which was a new world to me, I have learnt the way of

speaking to clients and to deal with their emotions and troubles. Mostly I have done the research

work followed by some drafting.

Outcome of your learning and observations during the internship

I have learnt a lot from this internship, it taught to have patience and listen to client and have a

burning desire to learn things. All the lawyers working in this internship were very helpful and

supportive, I had many doubts regarding the basics and which were simple but the advocates

have been very diligent with me and explained me all the matters in detail.

This internship has been a enriching experience for me, this internship has taught me about the

mannerism to be practiced in the office and the court.

This internship became an enriching internship. This internship taught me to apprehend legal

issues, to analyze the cases, to prepare clients for cross examination, to bring out the specified

records from the clients and to get facts from reliable resources.

The cases I have worked on are prominently of civil in nature. All the lawyers were very keen

and knew the inside out of every case and they were very alert regarding any development and

gave at most attention to the case. The working environment of the office was a bit casual but

when it came to work the team was very serious and worked very efficiently. One of the lessons

I have learn and would carry with me throughout my life is noting every single and simplest fact

or development in the case, which plays very important role.

Conclusion

The experience I gained from working under Allied Law Offices is one that I will cherish for

the rest of my existence. This internship gave me a one-of-a-kind angle of Law courts. I learnt to view

the same instances from numerous views through the clients and the advocates I met. This experience

was an addition to my learning and knowledge. This was totally cherishing and knowledgeable

internship. This perspective of Law was exceptional from the theoretical views which have been
