Study of the 1945 photographs indicates the area surrounding tha site to be largely fields apparently for grazing. On the site, a factory building occupies the south eastem comer of the property. An administration block is situated to the south of the main buildings and dumpin#*of fill is cleariy visible to the west of the facturykp to the bank of the Stany Creek, khich waa not canalised at that time, and also along what appears ta be the northern side of the factory at that time.

In the northwest comer of the developed part of the sib is a separate building that may have been a boiler house and the spoil heaps ta the east along the north boundary may be furnace wastes or cod sbckpiles. There is dso a small building adjacent to k h t y r a Road that has a tall thin chimney that appears tu be the flue to a boiler house ar incinerator. This was confirmed during the interviews. This structure is dose tu the eventual location of the electrical sub-station still present on the eastern side of the site.

EXECUTIVE SUMMARY

Environmental Health Services (Australia) Pty. Ltd. (EHS) was commissioned by Westend Market Pty. Ltd. to undertake investigations, to determine the extent of asbestos contamination along the southern boundary of the Westend Market Site located at 47 McIntyre Road, Sunshine.

The history of the site shows that it was previously owned and operated by James Hardie Industries who manufactured asbestos cement products on the site for many years. When Hardies ceased production and sold the property (1984), a large volume of asbestos waste was buried on site and covered with clean fill under the direction of the Environmental Protection Authority Victoria (EPA).

In late July 1994, a small areas of exposed fiiable asbestos debris was discovered along the southern boundary of the site. A brief investigation canied out later that year by EHS revealed that the edge capping along the southem boundary was inadequate and that burrowing animals were exposing asbestos debris along this boundary.

This present investigation explored the southern boundary in detail examining the distribution of asbestos material and the proximity of the contaminated soil to the surveyed boundary. The investigation has shown that the existing fence is between 0.5m and 1.5m south of the actual surveyed boundary. There is also evidence of fill material and asbestos contaminated soil on the southern side of the fence line.

It may be concluded that the present situation is a direct result of the original remediation works. Clearly the fence has been erected in the wrong location and there has been an inadequate edge capping used to secure the asbestos waste on the site. -

The proximity of the Melbourne Water sewerage easements to this boundary complicates the possible courses of action that may be considered to bring the situation under control. However, three remediation options have been proposed for consideration with approximate costing.

A Site Assessment

of the Southern Boundary - Westend Market.

1. INTRODUCTION

Environmental Health Services (Australia) Pty. Ltd. (EHS) was commissioned by Westend Market Pty. Ltd. to undertake investigations, to determine the extent of asbestos contamination along the southern boundary of the Westend Market Site located at 47 McIntyre Road, Sunshine.

1.1. BACKGROUND

The history of the site shows that the site was owned and operated by James Hardie Industries who manufactured asbestos cement products on the site for many years. When Hardies ceased production and took the decision to sell the property, it was decided that residual asbestos bearing material should remain on the site. This decision was, no doubt, based on minimising the risk of liberating airborne asbestos to the atmosphere by moving the asbestos to a landfill elsewhere. The asbestos was buried on site and covered with clean fill under the direction of the Environmental Protection Authority Victoria (EPA). The EPA also placed the site on the State Register of Contaminated Sites, where it remains today. The site was purchased by McIntyre Industrial Park in 1985. Since that time the site has been operated as Melbourne Westend Market.

In late July 1994, a small quantity of exposed friable asbestos debris was discovered along the southern boundary of the 47 McIntyre Road site. This was subsequently removed and the area reinstated by covering uith crushed rock. In August 1994, a visual assessment of the south boundary was canied out by EHS to determine if there were indications that asbestos debris was leaving the Westend Market site. This investigation revealed no evidence to indicate asbestos debris was leaving the Westend site. However, there were indications of asbestos contamination being exposed due to animal diggings along the vertical edge of the fill.

This current investigation has been prompted by concerns expressed by Melbourne Water as to the status of their easements adjacent to the southern boundary of the Westend Market site.

1.2. AIMS OF THE INVESTIGATION

The scope of work to be carried out by EHS is as follows:

The site is generally flat with the majority of the site covered by asphalt and buildings. The block is 540m long and 170m wide. Buildings housing the Melbourne Westend Market are located at the east end of the property. The west end of the property has been extensively filled to a depth ranging between 0.5 metre at the eastern end to 3.6 metres at the west end. The existing chain mesh fence is in poor condition and has been pushed over in some places due to the weight of soil against it.

2.1. LOCATION

The site is located at 47 McIntyre Road, Sunshine Melway reference Map 27 8G (see Appendix A). The specific study area is that portion of the southern boundary that extends fiom the south west comer of the property 300 metres east of that point.

Appendix A also contains site drawings pertinent to the investigation. The title documents show that a 9.14 metre easement of carriageway exists along the north side of the southern boundary. A Melbourne Water sewerage easement exists along the southern side of the southern boundary. There is also an open drain under the responsibility of Melbourne Water that shares the eastern end of the boundary.

2.2. GEOTECHNICAL RECORDS

The scope of work codines the investigation to the fill material along the southern boundary. Soil information was recorded at each sample location in the form of Bore Logs (attached aS Appendix D). Geotechnical work was performed by Robert Johnson a Geotechnical engineer.

In general terms, the soil was poorly compacted with fill material variable in nature, with some areas containing large basalt rocks and concrete pieces. The presence of these large inclusions creates voids within the soil that are very attractive to a variety of feral animals

3. ENVIRONMENTAL REGULATIONS & CRITERIA

When determining if a site may be contaminated to a level that is a risk to human health or the environment it is usual, in Victoria, to compare results against established soil criteria. n e Victorian EPA adopts these criteria as guidelines for determining if a site needs to be investigated in detail. It is generally accepted by EPA Victoria and the Health and Safety Organisation, that the criteria level for asbestos is one percent. That is, soils that contain less than 1% asbestos are considered not to be contaminated. The EPA appreciate that the quantification aspects of asbestos contamination is a somewhat contentious issue, since the National Association of Testing Authorities (NATA) will not grant accreditation for laboratories to report asbestos concentrations. The EPA accept a visual estimation of asbestos concentration for purposes of soil contamination assessments.

4. LAND SURVEY i

The study area was surveyed by Mr. George Szirom, a licensed surveyor, and was pegged at forty metre intervals using a five metre off-set. The drawings reflecting this survey have been attached as Appendix B. Sample locations were measured from these reference points to ensure that sample information was accurate and reproducible.

5. SOIL INVESTIGATION

Soil sampling was undertaken on June 29, 1995. A back-hoe was used to cut narrow trenches into the battered edge. This sampling technique allowed the entire soil profile to be viewed and recorded. The trenches were cut deep enough into the batter to expose the soil to a minimum depth of 1 metre north of the true boundary, and extended down to the natural soil layer. The soil profiles shown in the attached Bore Log report reflect the soil structure at this point. .. Samples of soil were taken for analysis at various locations to confirm visual observations regarding asbestos contamination.

The attached site plan showing sample locations together with other pertinent structures are attached in Appendix B.

5.1. SOIL SAMPLING

5. I . I . Sample Locations As discussed in the previous Section, the exact location of each sample location was determined by measuring form the survey pegs installed by the surveyor. Twenty one sample locations were established within the study area, their locations are shown in Appendix C

5.1.2. Sampling Technique Sampling was carried out using a back-hoe to excavate trenches at each sample location. Soil samples were taken using stainless steel utensils into lOOg plastic jars.

5.1.3. Sample Information Each sample was given a unique number which was recorded in the sample register along with other observations such as colour, odour, texture, time, date, name of sampler and weather conditions at the time of sampling (Appendix F).

5.2. SOIL AYALYSIS

Laboratory analysis for asbestos was carried out by EHS, a laboratory accredited with the National Association of Testing Authorities, Australia (NATA). Laboratory reports for the samples tested are attached as Appendix E. NATA accreditation allows EHS to perform qualitative identification of asbestos types in bulk samples by polarised light microscopy and dispersion staining. However, because NATA believe estimates of concentration are unreliable, they will not grant approval to report asbestos concentrations on NATA endorsed reports. We are, however, able to estimate asbestos concentrations and report them on non-NATA reports.

6. QUALITY ASSURANCEIQUALITY CONTROL

6.l. QUALITY ASSURXYCE

6.1.1. Sample Equipment Samples were taken using stainless steel utensils. All utensils were washed in detergent then rinsed in tap water and finally in distilled water between samples.

6. 1.2. Sample Containers and Preservation Soil samples were taken into laboratory sterile plastic containers. All samples were stored in cool (4 deg C) conditions for delivery to the laboratory.

The chain of custody documentation has been used to ensure sample integrity. Copies of the Chain of Custody Records have been attached as Appendix C. Information includes identification number, date and time of sampling, analysis requirements, preservation and storage conditions.

6.2. QUALITY CONTROL

6.2.1. Laboratory Quality Control EHS laboratories are NATA accredited to carry out asbestos identification on bulk samples. As part of their accreditation, they are required to institute a very thorough in-house quality control programme which includes programme of analysing duplicates and standards. However, h s

accreditation does not allow quantification of asbestos content. The asbestos content of soil samples expressed in this report have been determined by visual estimation.

- 7. AiiALYSIS RESULTS

Samples of soil were taken from a number of sample locations. It became apparent during the investigation that asbestos bearing material could be readily identified by visual examination. These observations were substantiated by taking samples for laboratory analysis. The laboratory analysis results have been attached as Appendix E. .

The most effective way of looking at the results of this survey is to look at the drawings contained in appendix D. The drawings show the study area in plan view with the fill boundary, asbestos boundary and the true boundary marked. They also show the corresponding one metre off-set cross section view for the study area.

7.1. PLAN VIEW OBSERVATIONS

1. The existing boundary fence has been positioned between 1.2 and 0.5 metres south of the true property boundary. The fill on the Westend property has spilled over the true boundary and even extends past the existing fence line in places. Asbestos debris is present up to 1.5 metres south of the true boundary.

7.2. ONE METRE OFF-SET SECTION VIEW

This section has been used so that a realistic estimation .may be made of the quantity of contaminated soil that would need to be moved to clear the boundary entirely. 1. Asbestos is not present between the 90m site and the 150m point.

8. CONCLUSIOiVS

The results of this investigation has demonstrated the following The asbestos contamination is well defined in layers. The asbestos identified in the area between the 300m and 150m may be described as an amorphous fibrous matrix, light tan in colour, which appears to have been deposited as a semi-liquid slurry above the natural soil layer. The asbestos identified between the 20m and 80m mark was predominantly asbestos cement fragments interspersed with the tan fibrous material identified at the east end of the study area.

1. The existing fence is not a true indication of the boundary and in general terms appears to lie outside the Westend Market boundary by between 0.5 m and 1.2 m. In fact the roadway and guttering east of the 3OOm sample site is 0.5 metres over the boundary.

2. The fill used to cover the asbestos along the southern boundary has spilled past the fence in some areas and extends some 2 m over the boundary in some areas.

3. Asbestos contamination was identified on both sides of the true boundary. At the present time the asbestos is contained under a sometimes shallow covering of clean fill material. However, as described in the EHS investigation carried out in 1994, it is likely that from time to time asbestos will be exposed by burrowing animals or by water erosion. There is no doubt that the edge capping along most of the boundary studied is inadequate.

9. DISCUSSION

Asbestos presents a health hazard, in that there is potential for harm, whereas risk examines the probability of the harm becoming actual. Asbestos presents a risk only when it is airborne. The risk to health increases as the number of fibres inhaled increases. Increased exposure would therefore pose an increased health risk.

Asbestos which has been incorporated into a stable matrix can be found in many working environments. Provided the matrix remains stable and no airborne fibres are produced, it presents

no increased health risk. The mere presence of asbestos, therefore, does not indicate that a health risk exists.

I .

When evaluating the desree of risk associated with asbestos-bearing material, a number of factors need to be considered in respect of the exposure risk to the various risk groups. The main groups that may be considered are, people working with the contaminated material, other people working on the site not directly associated with asbestos work and people living and working on surrounding properties. The most important qualities to be considered are the type and quantity of asbestos present in the material. The friability of the material (which is the propensity for fibres to become airborne) is another important factor.

This investigation has shown that where asbestos was identified it usually contains both amosite and chrysotile asbestos (brown and white), one sample also contained crocidolite asbestos (blue). Asbestos concentrations ranged between 10% to 30% which is considered to be high concentrations. It is worth noting the asbestos contamination was visibly present on all occasions usually showing up as discrete band in the soil. There was no evidence of asbestos having been mixed in the fill material.

When considering the risk of exposure to any airborne hazard, the propensity for the material to become airborne is of vital importance. The asbestos bearing material identified in most samples was found to be soft and pliable. Fortunately due to recent weather conditions, it was also damp so there was little chance of fibre release. However, if the material was disturbed when dry, there is likely to be a significant risk of releasing airborne fibre.

The Westend Market site is a contaminated site, and is presently on the Register of Contaminated Sites. When the propep was sold to Westend Markets the asbestos on the site was intended to be in a stable condition with the asbestos being adequately isolated by a capping of clean fill. We understand that the capping was carried out to the satisfaction of the EPA. However, it is evident &at the southern boundary was either never properly surveyed or the boundary was ignored when the asbestos contamination and capping was being distributed on the site. It is also evident the edge capping was inadequate for the purpose that it was designed.

It is apparent that when the site was remediated under EPA direction, the correct boundary was

either not determined or was ignored. Even the asphalt roadway at the east end of the southern boundary is approximately 0.5 metre over the true boundary. Under normal circumstances this would not be considered an insurmountable problem. The simplest approach would be to negotiate with the neighbour to re-define the boundary to take into account the existing status. However, this option is complicated by the presence of a Melbourne Water sewerage easement which exists on the south side of the tru-e boundary.

There are a number of options that may be considered to fix the problems identified in this investigation. Three options have been considered in the following sections, these are as follows:

Option No. 1. Option No. 2.

Add edge capping to required depth without removing existing material. Remove sufficient material from the edge to enable an adequate edge capping to be added inside the true boundary. Remove sufficient material fiom the edge to enable a retaining wall to be ins tal led.

The south western boundary has a depth of fill ranging between one and three metres. This fill is "battered" back at an angle. The angle of the batter must be such that the soil will not slump or slip which is dependent on the geological nature of the soil. Another consideration, is maintenance of the batter. If the batter is to be grassed to bind the soil and prevent burrowing animals invading the soil, the angle must allow mowers to be used safely. Given these considerations it is recommended that the batter angle should be no greater than 30" to the horizontal.

For an edge capping to be effective it needs to cover the asbestos to a minimum depth of one metre. This investigation has shown that in some places the covering is very thin, not more than 100 mm in places. Therefore, additional fill would be required to meet these minimum requirements. Ths would extend the edge of the batter on average 1.5 metres over the true boundary.

The following table sets out some of the advantages and disadvantages of this option.

A total of 400 cubic metres of solid clean fill will be required to form an adequate edge capping on the existing batter. There is at present a considerable quantity of clean fill stock piled on site which could be used for this.purpose. It is estimated that the cost of an excavator and additional clean fill would be around %S,OOO.

10.2. OF'TION 2.

As described in Option 1, an adequate edge capping requires a minimum cover of 1 metre of clean fill and the maximum barter angle of 30" to the horizontal. In order to bring the bottom of the batter back to the true boundary will require the excavation of existing clean fill and asbestos contaminated soil. By using the bore log data an estimate may be made on the quantity of soil that would be required to be removed to hlfil these requirements. These calculations show that a volume of about 400m' of contaminated soil would need to be removed and replaced with clean fill. There will also be 500 m3 of clean fill to be removed which may be re-used for the edge capping.

The following table sets out some of the advantages and disadvantages of this option.

Excavation and disposal of asbestos contaminated soil on site will require specific work practices to ensure that personnel working on the site and surrounding properties are adequately protected. These work practices would need to be detailed in a site specific work plan which would be passed to the EPA and the Health and Safety Organisation (HSO) for comment prior to starting work. To a large extent the cost will depend on the dust suppression techniques employed and occupational health restrictions. However, the work is expected to take approximately five days to complete using an excavator and two trucks. The estimated cost is expected to be around $16,000. This estimate includes cost for the preparation of plan of works and management of occupation health issues.

10.3. OPTION 3 - RETAINING WALL.

Another approach is to install a reinforced retaining wall to contain the asbestos and to prevent burrowing animals from digging into the contaminated zone. This option would require some excavation of contaminated soil to allow the wall to be constructed on the Westend site. The wall would be required to be 210 metres long to an average height of 1.2 metres.

RE: ASBESTOS

MPL Environmenul Serviw (Vic) Pty Ltd was conuacted by Silverene pty Ltd to investigate an environmental issue relating to asbestos exposure. A preliminary walk through on the 28th August 1996. along the stony creek embankment area and adjoining railway way lines on the southern boundary of the West End marker. exposed asbestos debris was visually observed on the surface and protmding from the soil.

The asbestos present was in the following forms: sheering debris friable “sandy” matrix debris

Samples were taken and examined from the soil surface, the run - off intruding into stony creek, and loose sheeting debris present in clumps. All results confirmed asbestos to be present.

According to EPA guidelines “Transport and Disposal of Waste Asbestos”

“Inkediate coverage prior to compaction with a layer of soil at least 300mm thick or by a layer of waste at least 1.0 metre thick.

No deposition of asbestos within 2 metres of the final tipping surface of h e landfill.”

The above standards implemented by the EPA, has not been conformed. An inspection carried out with Mr Peter Chugg representing Work Cover agrees that the site currently in the form it is in, has certain risks associated with it.

The site in its current condition has eroded in certain sections exposing asbestos. During the inspection of the site area, it was observed that young children were using the area as a walk path, whereby mud containing asbestos debris was being stepped on while walking. This poses a risk of asbestos becoming transported off the si tehto homes, schools or &y other areas the children may be going to. Adjacent workers have also been noted to carry out earthworks. disturbing any asbestos present.

Attached is the NATA Endorsed wtificate confirming the asbestos present and &;e report written by Mr Peter Chugg representing Work Cover.

SCOPE OF WORKS AT:

Melbourne Westend Market

1. SITE LOCATION The Melbourne Westend Market is located at 47 McIntyre Road, Sunshine.

2. WORKS LOCATION The work will involve the encapsulation of exposed asbestos in soil along the western end of the southern boundary and the south end of the western boundaxy of the property.

3. STATUS OF SITE The western cnd of the site will cordoned off. No unauthorized people will be permitted in the area without approval fiom the supervising Occupational Hygienist.

4. EXIXNTOFWORKS The asbestos contractor shall provide all necessary plant, labour, tools and equipment for the following:-

a. Barricade and sign the following areas: the entire western boundary of the property. along the northern boundary of the creek to the point where the creek turns south, and from there to the southwest comer of the Westend market building.

b. Provide dust suppression during all earth moving activities in the exposed asbestos area.

Dust suppression Will be maintained by the use of water. Care must be taken to use enough water to keep the material damp. Care must also be taken to prevent excess watcr leaving the site. The contractor may need to provide water tankers and pumps for this purpose.

C. Provide personnel to cover the prepared area with a plastic membrane and steel mesh that will be supplied by Westend Market. The plastic and steel mesh will be 6 metres wide and run the length of the exposed embankment.

.. d. Dig approximately 60 holes at the bottom of the embankment and erect fence posts as supplied by Westend Market.

e. Any loose visible asbestos debris noticed outside the encapsulation area will be picked up and baggd in asbestos labeled bags.

-2- 4. Site facilities The site will have a site hut, toilet and facilities for decontamination as required.

5. Training All non asbestos removal contractors who are required to work on the site (e.g. excavator operator and concrete applicators) will receive appropriate training which will enable them to cany out their rcspective tasks in a safe manner and without risks to their health and safety and the health and safety of other employees. They will be required to demonstrate safe work practices before they carry out the work. Records of all training will be maintained. Training and respiratory fit testing will be Canid out by a qualified Occupational Hygienist fiom Environmental Health Services.

6. Environmental Environmental management for the site will be carried out by Environmental Health Services. The issues of concern for this project will be to miaimise the release of asbestos h r n the site to air, water and soil. This will be achieved by using work procedures that will miDjmise the risk of releasing asbestos fibres by using dust suppression and supervision of all work by a suitable qualified individual. All machinery will be decontaminated prior to leaving the site and no asbestos contaminated soil will leave the site.

7. Monitoring Air monitoring for airborne asbestos will be carried out during all asbestos related activities. Monitoring will be carried out on the perimeter of the work area and will be reported daily. Some personal asbestos monitoring will also be carried out on selected individuals.

8. HoursofWork Normal hours of work will be permitted between 7 am and 5 pm daily.

ENVIRONMENT PROTECTION AUTHORITY of 477 Collins Street, Melbourne, VIC 3000

AND

AND BRlMBANK CITY COUNCIL

I N T R 0 D U C T I O N:

A. The Owner is the registered proprietor of the premises known as 47 McIntyre Road, Sunshine ("the Site"), being the property described in Certificate of Title Volume 9231 Folios 119 and 120.

B. The Site is within Brimbank City Council. ("Council")

C. On or about 7 May 1997 it was agreed between the Environment Protection Authority ("EPA") and the Owner that they would enter into a s173 Agreement pursuant to the Planning and Environment Act 1987 ("the Agreement") to implement a Site Management Plan. It was agreed the Agreement would remove any necessity for the site to remain registered on the Priority Sites Register.

D. The Site Management Plan is defined as the Site Management Plan dated June 1997 or any subsequent document, as amended from time to time by agreement between the Owner and the EPA and attached as Schedule 1 to this Agreement.

IT IS AGREED as follows:

1 This Agreement is made pursuant to section 173 of the Planning & Environment Act 1987.

2 This Agreement shall come into force immediately upon execution by all of the parties hereto and shall run with the land.

The Council, the Owner and Environment Protection Authority agree and declare that the obligations imposed on the Owner under this Agreement are intended to take effect as covenants which shall be annexed to and run at law and in equity with the Site and bind the Owner and the Owner’s successors, assigns, assignees, transferees, purchasers, mortgagees and the registered proprietor or proprietors and any person obtaining possession of the whole or part of the Site for the time being of the Site and every relevant part thereof (other than the Council) as if each of those successors had separately executed this Agreement.

The Council, the Owner and Environment Protection Authority shall do all things necessary (including signing any further agreement, acknowledgment or document) to enable the Council Registrar of Titles to enter a memorandum of register this Agreement and any amendments to this Agreement or to Schedule 1 of this Agreement on the Certificate of Title to the Site in accordance with Section 181 of the Planning and Environment Act 1987. The Owner shall pay any necessary costs associated with the registration of this Agreement or any amendments to it on the Certificate of Title.

The Council and Environment Protection Authority hereby covenant and agree with the Owner that entry into this Agreement and full compliance with the Site Management Plan satisfies the obligations imposed on the Owner to manage the site.

Owner’s Warranties and Covenants

The Owner warrants and covenants that:

it is the registered proprietors (or entitled to be so) and the beneficial owner of the Land;

there are no mortgages, liens, charges, easements or other encumbrances or any rights inherent in any person affecting the Site not disclosed by the usual searches;

the Site or any part of it is not subject to any rights obtained by adverse possession or subject to any easements, rights or encumbrances mentioned in Section 42 of the Transfer of Land Act 1958;

it has not granted any option or entered into a contract of sale or lease in regard to the Site or any part thereof which option, contract or lease is still subsisting;

it will use it’s best endeavours to implement the Site Management Plan; and

it will implement the Site Management Plan including:

(0 ensuring training requirements pursuant to the Site Management Plan are performed; and

!' overseeing the operation of the Site Management Plan.

7 EPA's Covenants Priority Sites Register

7.1 The EPA covenants that as soon as practicable after this Agreement has been Registered on the Certificate of Title for the Site it will delist and will not in the future list the site from the Priority Sites Register or on any similar registration system which purports to list contaminated sites, provided while:

(9 the owner of the site complies with the provisions of the Site Management Plan; and

(ii) while there are no contaminants on the site other than asbestos.

7.2 EPA reserves the right to relist the Site on the Priority Sites Register or on any similar registration system during the operation of the Agreement if

(a) any part of this Agreement is determined by a court, arbitrator, tribunal or other competent authority to be unenforceable, illegal, or void; or

EPA decides that the Site Management Plan is not being complied with. Prior to making such a decision, EPA will consider submissions from the Owner; or

subject to clause 5, the Authority decides that the Site Management Plan does not meet the requirement of protecting the "environment" (as defined in S.4 of the Environment Protect Act 1970) from the asbestos on the Site; or

(d) this Agreement is, for any reason, not registered on the Certificate of Title for the Site; or

(e) the Agreement is terminated by any of the parties.

7.3 In the event that the Authority decides the Site Management Plan does not meet the requirement of protecting the environment pursuant to section 7.2(c), EPA will consult with the Owner with the objective of amending the

1 INTRODUCTION

,,This Site Management Plan sets the framework for a maintenance program designed to ensure that the condition of the capping, used to isolate asbestos on this site, is adequately maintained. This will be achieved by the management of the site adopting the elements outlined in this Site Management Plan. The Site Management Plan includes the following elements:

Delegated positions and responsibilities.

Site drawing showing the location of encapsulated asbestos (Appendix A).

Details of site restrictions and security measures.

Details of the inspection program.

Independent inspections and monitoring requirements.

A procedure for notification to responsible bodies if asbestos is uncovered.

Action plan to deal with asbestos that is uncovered for any reason.

Training requirements for inspection personnel.

2 POSITIONS AND RESPONSIBILITIES

3 LOCATION OF ASBESTOS MATERIALS

The location of encapsulated asbestos material shown on the attached site drawing, has been derived from site information and observations gained from previous investigations. /

4 RESTRICTED ACCESS AND SECURITY

A perimeter fence around the property will be maintained to restrict unauthorised access to the site. Access to the site will be restricted to entry from McIntyre Road.

5 SITE INSPECTION PROGRAM

The purpose of the site inspection program is to institute a system that will identify any deterioration or disruption of the capping on the site that may result in asbestos being exposed. This will be achieved by instituting a regime of regular detailed site inspections coupled with continuous monitoring by staff and security personnel. All maintenance and security personnel will be given sufficient training to enable them to identify actions that may cause asbestos to be uncovered. They will be given the responsibility to report activities, which may uncover asbestos, to the SM who will take appropriate action. Security personnel will be instructed to immediately report any potential asbestos occurrences, noted during their routine security inspections, to the Site Manager.

5.1 ROUTINE SITE INSPECTIONS

The Site Manager will carry out routine site. inspections in accordance with the inspection.criteria-- .__

outlined below. The Site Manager and his deputy will be trained in the hazards of asbestos and be able to recognise possible indications of exposed asbestos. Asbestos training requirements for the Site Manager have been outlined in Section 8 of this S M P .

5.2 INDEPENDENT SITE IKSPECTIONS AND MONITORING REQUIREMENTS

The Site Manager shall engage an approved Occupational Hygienist to provide specialist advice relating to training, site inspections, risk assessments, asbestos fibre monitoring and asbestos identification, where required.

The Occupational Hygienist will advise on potential sources of exposure to asbestos fibres and advise on appropriate procedures where work is required in areas known to contain asbestos. The Hygienist will also carry out whatever air monitoring and soil testing as he sees fit to satisfy himself that a risk of asbestos exposure does not exist.

5.3 FREQUENCY OF INSPECTIONS

Routine inspections will be carried out on a monthly basis. Inspections by the Occupational Hygienist will be carried out annually.

Routine site inspections carried out monthly by the Site Manager will identi@ any exposed asbestos and/or damage to the capping and other surfaces of the site. The scope of these inspections will include the following:

The entire southern and western boundary of the property will be inspected together with adjacent surface areas of the site. Areas of the site where asbestos is known to be buried (See Appendix A). Particular attention will be given to evidence of capping failure or unauthorised disturbance. All observations and conclusions regarding the integrity of the encapsulation on the site will be recorded in the Site Inspection Register. If it is suspected that asbestos material has been uncovered immediate steps must be taken in accordance with Section 7 of this SMP.

Independent inspections will be carried out by an Occupational Hygienist annually or at the request of the Site Manager.

The Occupational Hygienist will review the routine site inspection reports and carry out a detailed site inspection.

The Occupational Hygienist will report in writing to the Site Manager within 14 days of completing each inspection.

5.5 &-ASSESSMENT AND IYSPECTION PROGRAM

The SMP will be reviewed annually. A key feature of the review is the development of a re-inspection program. Management of the Westend Market site, the Site Manager and an Occupational Hygienist will carry out the review.

6 NOTIFICATION AND AVAILABILITY OF REPORTS

The Site Manager shall inform site personnel and contractors likely to be engaged in working on the site about the presence of asbestos.

The minimum information should include the following facts:

Asbestos containing materials (ACM) are buried on site. Asbestos is only a health hazard when disturbed and when fibres are made airborne and are inhaled. Work Procedures must be adopted to ensure areas containing ACM are not disturbed.

The site must be inspected periodically by an Occupational Hygienist and additional measures must be taken, where required, to protect the health of site occupants, employees and clients.

The SMP, all inspection reports and Occupational Hygienist reports will be made available to EPA on request.

Should asbestos become uncovered during unauthorised works, the EPA and Victorian Workcover Authority will be notified.

7 ACTION PLAN FOR EXPOSED ASBESTOS

Because of the identified presence of asbestos under the soil on this site, excavation activities must be strictly controlled to prevent uncontrolled asbestos exposure. Should the SM believe that current or proposed work is likely to uncover asbestos, the SM should seek advice from an Occupational Hygienist. A risk assessment will be carried out and suitable work instructions issued prior to any refurbishment or demolition work likely to involve excavation or other works that might result in asbestos exposure.

If asbestos is uncovered or suspected the Site Manager must be informed immediately. The Site Manager will carry out an inspection of the area. If the SM has reason to believe asbestos has been uncovered, or suspects the material may contain asbestos, the following actions shall be taken immediately.

Remove all personnel from the immediate area.

Cover the asbestos and ACM.

Cordon off the area to prevent people entering the area.

Call an Occupational Hygienist to inspect the site to take samples for identification and assess the risk.

If the Occupational HFgienist considers that there is a risk to human health, or the environment, then an action plan will be instituted to control the immediate risk. A long-term control plan will be developed in consultation with the EPA and Victorian Workcover Authority.

Removal of asbestos or asbestos contaminated soil from this site will be carried out in accordance with the requirements of the Victorian Occupational Health and Safety (Asbestos) Regulations 1992, the EPA Regulations relating to the transport and disposal of Prescribed Waste and the method for Excavation of Asbestos Contaminated Soil, attached as Appendix B.

8 TRAINING

The Site Manager will undergo an asbestos awareness training session to be able to adequately undertake his duties. Training should be competency based and include the following topics:

Asbestos types, occurrences, health effects, identification, recognition, exposure pathways. toxicity, physiology, control measures and State and Federal Codes of Practice and Legislation relating to asbestos. In particular, training should include site specific information relating to environmental issues concerning asbestos in soil.

APPENDIX B EXCAVATION OF ASBESTOS CONTAMINATED SOIL

Without in any way limiting the provisions of requirements of paragraph7.6, the following actions must be carried out:

Prior to excavation or other activities dealing with ACM the EPA and Victorian Workcover Authority (VWA) must be advised that the excavation activities will be taking place.

The area must be cordoned off and signed appropriately to allow a buffer zone around the removal area.

Personnel carrying out the removal work must be Class A VWA Approved Asbestos Removal Contractors.

Excavation must be carried out using dust suppression techniques such as water sprays to minimise the risk of airborne dust release.

Machinery and equipment must be decontaminated prior to leaving the designated contaminated excavation area.

Work should be supervised and monitored by a qualified Occupational Hygienist. As a minimum, air monitoring should be carried out on the perimeter of the excavation area to measure the efficiency of dust suppression procedures.

5 SITE INSPECTION PROGRAM The purpose of the site inspection program is to institute a system that will identify any deterioration or disruption of the capping on the site that may result in asbestos being exposed. This will be achieved by instituting a regime of regular detailed site inspections coupled with continuous monitoring by staff and security personnel. All maintenance and security personnel will be given sufficient training to enable them to identify actions that may cause asbestos to be uncovered. They will be given the responsibility to report activities, which may uncover asbestos, to the SM who will take appropriate action. Security personnel will be instructed to immediately report any potential asbestos occurrences, noted during their routine security inspections, to the Site Manager.

5.1 ROUTINE SITE INSPECI~ONS

The Site Manager will carry out routine site inspections in accordance with the inspection criteria outlined below. The Site Manager and his deputy will be trained in the hazards of asbestos and be able to recognise possible indications of exposed asbestos. Asbestos training requirements for the Site Manager have been outlined in Section 8 of this S M P .

5.2 bi'DEPENDENT SITE lrVSPECTIONS AND MOMTORING REOUIREMENTS

The Site Manager shall engage an approved Occupational Hygienist to provide specialist advice relating to training, site inspections, risk assessments, asbestos fibre monitoring and asbestos identification, where required.

The Occupational Hygienist will advise on potential sources of exposure to asbestos fibres and advise on appropriate procedures where work is required in areas known to contain asbestos. The Hygienist will also carry out whatever air monitoring and soil testing as he sees fit to satisfy himself that a risk of asbestos exposure does not exist.

5.3 FREOUENCY OF INSPECTIONS

Routine inspections will be carried out on a monthly basis. Inspections by the Occupational Hygienist will be carried out annually.

5.4 bJSPECTION FORMATS

. 1. Routine site inspections, carried out monthly by the Site Manager will identify any exposed asbestos and/or damage to the capping and other surfaces of the site. The scope of these inspections will include the following:

The entire southern and western boundary of the property will be inspected together with adjacent surface areas of the site. Areas of the site where asbestos is known to be buried (See Appendix A). Particular attention will be given to evidence of capping failure or unauthorised disturbance. All observations and conclusions regarding the integrity of the encapsulation on the site will be recorded in the Site Inspection Register. If it is suspected that asbestos material has been uncovered immediate steps must be taken in accordance with Section 7 of this SMP.

2. Independent inspections will be carried out by an Occupational Hygienist annually or at the request of the Site Manager.

3. The Occupational Hygienist will rehew the routine site inspection reports and carry out a detailed site inspection.

4. The Occupational Hygienist will report in writing to the Site Manager within 14 days of completing each inspection.

5.5 MANAGEMENT PLAN REVIEWS

The SMP will be reviewed annually. A key feature of the review is the development of a re- inspection program Management of the Westend Mwket site, the Site Manager and an Occupational Hygienist will carry out the review. AN relevant information will be assessed during the ~eview including:

Incident reports Environmental Investigation reports

NOTIFICATION AND AVAILABILITY OF REPORTS

The minimum information should include the following facts:

Asbestos containing materials (ACM) are buried on site. Asbestos is only a health hazard when disturbed and when fibres are made airborne and are inhaled.

If the Occupational Hygienist considers that there is a risk to human health, or the environment, then an action plan will be instituted to control the immediate risk. A long-term control plan will be developed in consultation with the EPA and Victorian WorkCover Authority.

Removal of asbestos or asbestos contaminated soil fiom this site will be carried out in accordance with the requirements of the Victorian Occupational Health and Safety (Asbestos) Regulations 1992, the EPA Regulations relating to the transport and disposal of Prescribed Waste and the method for ficavation of Asbestos Contaminated Soil, attached as Appendix B.

8 TRAINING

The Site Manager will undergo an asbestos awareness training session to be able to adequately undertake his duties. Training should be competency based and include the following topics:

Asbestos types, occurrences, health effects, identification, recognition, exposure pathways, toxicity, physiology, control measures and State and Federal Codes of Practice and Legislation relating to asbestos. ln particular, training should include site specific information relating to environmental issues concerning asbestos in soil.

9 RECORDS

1. The Site Manager will maintain detailed records on all activities pertaining to asbestos.

The records will include the following:

Inspection reports work request forms documentation that the contractors have been made aware of asbestos containing materials on the site. other certificates and notices fiom regulatory authorities asbestos identification reports and fibre monitoring results

Prior to excavation or other activities dealing with ACM the EPA and Victorian Workcover Authority (VWA) must be advised that the excavation activities will be taking place.

The area must be cordoned off and signed appropriately to allow a buffer zone around the removal area.

Personnel carrying out the removal work must be Class A VWA Approved Asbestos Removal Contractors.

Excavation must be carried out using dust suppression techniques such as water sprays to minimise the risk of airborne dust release.

Machinery and equipment must be decontaminated prior to leaving the designated contaminated excavation area.

Work should be supervised and monitored by a qualified Occupational Hygienist. As a minimum, air monitoring should be carried out on the perimeter of the excavation area to measure the efficiency of dust suppression procedures.

Following excavation, validation sampling and analysis must be performed by a suitably qualified person to ensure that the clean-up has been effective.

The universal soil loss equation is designed to predict the long term, average annual mil loss fiom sheet and rill erosion at a specified site under managed conditions. The equation is empirically derived and can be represented by:

K- Soil erodibility

Rainfall erosivity is a measure of the erosive force of rain in a normal year.

Soil erodibility is a measure of the susceptibility of soil particles to detachment and transport by rainfill and runoff. It can be normally expected to range from less than 0.020 on soils with low erodibility, from 0.021 to 0.040 for soils with moderate erodibility, and above 0.041 for soils with high erodibility. At the subject site, it ranges fiom 0.023 to 0.025 for subsoils to 0.040 to 0.048 for topsoils.

Both slope length (metres) and gradient (percent) have major effects on possible soil loss. They should be recorded as typical upper values for the site or unit in question. In the USLE the slope and length criteria are normally treated as a single entity, LS. The slope and gradients used forsoil loss calculations in this report are given in Table 1.

P - Erosion control practice

C - Cover

Erosion control practice is reflected in the roughening or smoothing of the soil surface by machinery, ie. those practices that reduce velocity and flow directly downhill. An erosion control factor of 0.5 was used in this report.

The cover factor is the ratio of soil loss from land under specified crop conditions to the corresponding loss f?om bare soil and is taken as 1.0 with no soil cover.

The cover factor for erosion control matting is 0.1 and the cover factor for 100% vegetation cover is 0.01. Cover fixtors for the site ranged fiom 0.05 to 0.1.
