Reasons for Conditions:

1 To comply with Sections 91, 92, and 93 of the Town and Country Planning Act 1990 (whichrequires the National Park Authority to reconsider the proposal afresh after a period of years).

Appeals to the Secretary of State

If you are aggrieved by the decision of, your local planning authority to refuse permission for theproposed development or to' grant it subject to conditions, then'you can appeal to the Secretary ofState for the Environment under Section 76 of the Town and Country Planning Act 1990.

If you want to appeal, then you must do so within 6 months of the date of this'notice, using a formwhich you can get from the Planning Inspectorate at Customer Support Unit, Temple Quay House,2 The Square, Temple Quay, Bristol BS1 6PN, telephone No. 0117 372 6000 or www.planning­inspectorate.gov.uk.

The Secretary of State can allow a longer period for giving notice of an appeal, but he will notnormally be prepared to use this power unless there are special circumstances which excuse thedelay in giving notice of appeal.

The Secretary of State need not consider an appeal if it seems to him that the local planningauthority could not have granted planning permission for the proposed development or could nothave granted it without the conditions they imposed, having regard to the statutory requirements, tothe provisions of any development order and to any directions given under a development order.

In practice, the Secretary of State does not refuse to consider appeals solely because the localplanning authority based its decision on a direction given by him.

Purchase Notices

If either the local planning authority or the Secretary of State for the Environment refuses permissionto develop land or grants it subject to conditions, the owner may claim that he can neither put theland to a reasonably beneficial use in its existing state nor render the land capable of a reasonablybeneficial use by the carrying out of any development which has been or would be permitted.

In these circumstances, the owner may serve a purchase notice on the Council (District Council,London Borough Council or Common Council of the City of London) or, where the land is situated ina National Park, the National Park Authority for that Park in whose area the land is situated. Thisnotice will require the Councilor Authority to purchase his interest in the land in accordance with theprovisions of Part VI of the Town and Country Planning Act 1990.

The National Park Authority has a duty to conserve and enhance the National Park, and adopteddevelopment plan policies reflect the duties set out in Structure Plan Policy GS1. Development willnot normally be permitted where it is incompatible with the policies in the development plan or it isincompatible with the National Park's statutory purposes.

Local Plan Policy LH4 for extensions or alterations to dwellings emphasises that extensions should'not detract from the character, appearance or amenity of the original building, its setting orneighbouring buildings'. LPP LC4 considers design, layout and landscaping and points out thatparticular attention will be paid to scale, form, mass and orientation in relation to existing bUildings'and stresses that detailed treatment should be of a high standard' that respects, conserves andenhances the landscape, built environment and other valued characteristics of the area'.

Full Planning Permission is sought for a single storey extension with small gable to the rear of abungalow situated on Haddon Drive in Bakewell. The extension is considered as an enhancementand the design respects the integrity of the original building.
