AbducJng of Crew from Tuq Boats in Waters offEast Sabah and South Ph:l:lloilles

Following the spate of incidents involving the abducting of crew from tug boats in thewaters of East Sabah and South Philippines, the shipping industry are advised to adoptthe following measures:

. Stringent watch-keeping while the ships are anchored.

. Keep vessel's surroundings well-lit and switched on the flood lights.

. Enhance vigilance, increase secu ty watch rotations and sound the alarm whenunknown people are sighted in the vicinity or on board the ships.

. lvlaintain a continuous watch to the advisories being issued on NAWEX.

. Report all incidents in accordance with the llilo IVSC circular of 1334.

. Reroute/Avoid area if feasible.

. l\.4aintain continuous communications with enforcement agencies/company.

Background

1. Within a period of three weeks (26 March 20'16 - 15 April 2016), the ReCMPFocal Point (Philippines) reported to the ReCAAP ISC about three incidents of abductingof crew from tug boats in the waters off East Sabah and South Philippines. The incidentsoccurred on board tug boat Brahma 12 on 26 March 2016, tug boat Masslye 6 on 1 April2016 and tug boat Henry towing barge, Chrlsti on '15 April 2016.

2. lndonesian-registered tug boal B@hma 72 towing barge, Anand l2loaded wilh7,000 metric tons of coal departed Kalimantan, lndonesia for a power plant in Batangas,Philippines when 17 perpetrators armed with firearms boarded the tug boatfrom one greyspeed boat powered by three outboard engines and one wooden-type motorised pumpboat propelled by double built-in engine. The perpetrators forcibly abducted all its 10lndonesian crew, and abandoned the tug boat. The exact date, time and location of theboarding have yet to be determined.

subsequently turned over to the local police for custody. Two days after the tug boat wasfound, Mr. Joey Mirasole, Operations Manager of World Mariners Philippines who is alsothe Manila-based agenlot Bruhma 72 was informed by the ownet ot Brahma ,2 that theAbu Sayyaf Group (ASG) claimed responsibility over the incident and allegedlydemanding 50 million pesos (S$1.45 million) in ransom for the release of the crew. Amedia articlelmentioned that the owner ol Brahma 12 has reportedly agreed to payransom for the release of the 10 crew.

4. The Philippine Coast Guard (PCG)elements in Bongao, Tawi-tawi conducted PortState Control lnspectitonol Brahma 72 at Languyan lvlunicipal Police Station on 30 March2016 and reported that several navigational equipment were missing, including the GlobalPositioning System (GPS), radar apparatus, radio communication and firefightingequipment. The PCG is working closely with the Philippine Armed Forces, PhilippineNational Police and other enforcement agencies to galher relevant information andupdates about the whereabouts of the abducted crew.

5. On 1 April 2016, Malaysian-registered tug boat Mass/Ve 6 with nine crew on boardwas underway from Manila, Philippines towards Tawau for bunkering. Between'18'15and1840 hlS in the vicinity about 27 nm southeast of Sempoma, Sabah, East Malaysia, eightperpetrators armed with firearms approached and boarded the tug boat. Theperpetrators, allegedly spoke Tagalog-English, took with them four Malaysian crew intheir speed boat, along with their mobile phones and laptops.

6. The shipping company managed to establish contact with the remaining crew onor at about 2000 hrs on 1 April 2016, and reported the incident to the Malaysian MaritimeEnforcement Agency (MMEA), Philippines authorities based in Zamboanga City,Philippines, and the ReCMP lSC. The remaining five crew continued their voyage toTawau, Sabah escorted by a MMEA ship. The Royal Malaysian Navy (RMN) andMalaysia Marine Police vessels had reportedly stepped up maritime and security patrolsin vicinity.

On 15 April 2016, an lndonesian-registered tug boal Henry, towing barge, Chrlsliwhile underway from Cebu, Philippines to Tarakan, lndonesia was boarded by armedperpetrators from a speedboat at approximately 25 nm southwest off Sitangkai lsland,Tawi-tawi. The tug boat was fired at, and one of the crew was injured and four others

8. As a measure to prevent recurring of such incidents, the Malaysian Governmenthas imposed a temporary ban on the trade route between Sabah and southern Philippinesuntil a comprehensive plan is formulated to ensure the safety and security of crew. lnaddition, the Malaysian Marine Police had deployed boats along with ships from theMMEA and the Rl\,rN to enforce the ban3. lt was also reported that the Philippines andMalaysian authorities will meet to discuss measures to address these recent incidentsoccurring at the border4. The lndonesian military had called for joint maritime patrols withthe Philippines and Malaysia; and lndonesia had reportedly dispatched two warships tothe area5.

At the higher level, the President of lndonesia, Mr. Joko Widodo called uponlndonesia, Malaysia and Philippines to look rnto possible Joint patrols to secure theirmaritime routes in the seas around southern Philippines and Sabah. Separately in KualaLumpur, Malaysia's Defence Minister, l\.4r. Hishammuddin Hussein had said that otherStates could be roped in as'observers'in patrolling the Sulu Sea area while Malaysia,Philippines, Brunei and lndonesia work on trying to resolve the new piracy menace6.

Conclus:on

10. The ReCAAP ISC encourages the port authorities, littoral States' enforcementagencies to continuously beef up their surveillance, intensify patrols; and the shippingindustry to exercise strict vigilance when operating in the areas o, concern. Due to severalinformation gaps that pending verification, the PCG is continuously coordinating with localintelligence units to monitor and gather information about the developments of thesituation and the abducted crew.
