In its November 6, 1992 Memorandum to potentially responsible parties in the Solvents Recovery Services matter, EPA announced an auditing procedure whereby an individual PRP could obtain a review by EPA of the volumetric amounts attributed to that PRP in EPA's Volumetric Ranking. EPA also provided copies of the documents for PRP review upon which EPA had based its volumetric ranking. In accordance with the audit procedure, and with the limited extension granted by Gretchen Muench of EPA, Region I, I write on behalf of Ethan Allen Related Parties ("Ethan Allen"), consisting of five Ethan Allen Divisions, to challenge the 83,994 gallons of the hazardous substances attributed to Ethan Allen in EPA's interim ranking. Because Ethan Allen had less than 15 working days in which to prepare this audit request, Ethan Allen reserves its right to supplement that request.

proceeding both the amount and the nature of materials attributed to it by the EPA as well as any other issue with respect to this matter.

As the attached Transactional Review Form and other documents indicate, and as explained below, EPA's volumetric ranking for Ethan Allen is materially incorrect in the following respects:

A. Orleans Division

1. Non-Hazardous Substances. Ethan Allen specifically challenges the inclusion of 13,531 gallons of non­hazardous waste oils on EPA's volumetric ranking list. During the period 1986 through early 1991, Ethan Allen/Orleans Division generated used crankcase oil from maintenance activities for their fleet of delivery vehicles, and used compressor oil, which only came in contact with uncontaminated water during use. These oils were not hazardous substances within the meaning of CERCLA. Such oil comes squarely within the ambit of the express petroleum exclusion contained in Section 101(14) of CERCLA, 42 U.S.C. §9601(14), which defines "hazardous substance":

The term [hazardous substance] does not include petroleum, including crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under subparagraphs (A) through (F) of this paragraph. . . . (Emphasis added).

None of the statutes referenced in subparagraphs (A) through (F) of Section 101(14) specifically lists or designates waste oil as a hazardous substance. Moreover, application of the petroleum exclusion in CERCLA in this case is consistent with EPA's own interpretation of the exclusion and recent federal case law-See, Office of EPA General Counsel, "Scope of the CERCLA Petroleum Exclusion", (July 31, 1987) ("no petroleum substance, including used oil, can be a 'hazardous substance' except to the extent that it is listed as a hazardous waste")(emphasis added); Wilshire Westwood Assocs. v. Atlantic Richfield Corp., 881 F.2d 801 (9th Cir. 1989); Southern Pacific Trans. Co. v. California (Caltrans), 790 F. Supp. 983, 986 (E.D.Cal. 1991). To include waste oils in the interim ranking is contrary to CERCLA and EPA's own policy on the petroleum exclusion.

Prior to 1988, such waste oil was characterized on the Orleans Division hazardous waste manifests as a flammable liquid and given the EPA Waste Identification Number of DOOl. During

1988, presumably after the EPA clarified its position that used oils may fall within CERCLA's petroleum exclusion, such waste oils were properly listed as non-hazardous for purposes of compliance with federal statutes. During the entire 1985-1991 period, the waste oils were generated by the Orleans Division via the same process. Throughout this period, the flashpoints of such oils, as indicated by the attached Material Safety Data Sheets, would not qualify them as flammable pursuant to RCRA. Therefore, although, prior to 1988, used oil erroneously was designated as a "DOOl" waste, this used oil did not constitute a hazardous substance. Finally, SRS documents indicate that the Orleans Division shipped 330 gallons of a non-hazardous mixture of fuel oil, clay and gravel on 10/25/88. This mixture also qualifies for the petroleum exclusion. Ethan Allen's volume total should therefore be reduced by 13,531 gallons.

2. Solids. Ethan Allen also challenges the inclusion of materials identified as solids on EPA's volumetric ranking list for the Orleans Division. EPA's SRSNE documents indicate that certain solid materials were disposed of at a secure landfill. The limited information about site operations made available to date indicate that SRSNE handled only liquid materials at the site and did not operate a secure landfill. Although solids may have been transported by SRSNE, they were not disposed of at the SRSNE site and therefore also should not be included in Ethan Allen's volume total. Transactions pertaining to solids have been identified on the Transactional Review Form attached to this letter. Ethan Allen believes that on this basis a total of 9,4 05 gallons should be subtracted from Ethan Allen/Orleans Division's volume.

After subtracting the gallons attributed to non-hazardous and solid materials, Ethan Allen believes that the total volume for the Orleans Division cannot exceed 30,808 gallons.

B. Whitney Division

1. Duplicated volumes. EPA has double-counted two transactions. The first, dated 5/23/84, involves the shipment of 20 drums of solid materials to the SRSNE site. The Shipping Order (0701551), Manifest (0701553), and SRSNE Processing Document (0701552) all confirm that 20 drums total were picked up for delivery. Nevertheless, the EPA appears to have erroneously counted 21 drums. The second transaction, dated 8/26/87, involves a total of 3 drums of paint-related material and 2 3 drums (10350 pounds) of solid materials. Without explanation, EPA has counted this transaction twice and has provided two

copies of the same manifest and SRS processing document, although each copy has been given a different EPA document number. All of the SRSNE documents clearly support that only one shipment, totaling 1430 gallons, was made on 8/26/87. Based on these two errors, 1,485 gallons should be subtracted from Ethan Allen/Whitney Division's volumetric total.

2. Solids. For the reasons outlined above, Ethan Allen also challenges the inclusion of materials identified as solids on EPA's volumetric ranking list for the Whitney Division. EPA's SRSNE documents indicate that these solid materials were sent to a secure landfill. Transactions pertaining to solids have been identified on the Transactional Review Form for the Whitney Division attached to this letter. Ethan Allen believes that on this basis a total of 17,600 gallons should be subtracted from Ethan Allen/Whitney Division's volume.

After subtracting the gallons attributed to duplication and solid materials, Ethan Allen believes that the total volume for the VJhitney Division cannot exceed 2,695 gallons.

C. Beecher Falls Division

1. Solids. For the reasons outlined above, Ethan Allen also challenges the inclusion of materials identified as solids on EPA's volumetric ranking list for the Beecher Falls Division. EPA's SRSNE documents indicate that these solid materials were sent to a landfill for disposal. Transactions pertaining to solids have been identified on the Transactional Review Form for the Beecher Falls Division attached to this letter. Ethan Allen believes that on this basis a total of 3,245 gallons should be subtracted from Ethan Allen/Beecher Falls Division's volume.

2. Additional Transactions. During a review of its own records, Ethan Allen/Beecher Falls Division located a Vermont hazardous waste manifest, dated 10/11/89, indicating an additional shipment of 165 gallons of material to the SRSNE site. A copy of this manifest has been attached to Transactional Review Form II.C for Beecher Falls.

After subtracting the gallons attributed to solid materials, and adding the 10/11/89 transaction, Ethan Allen believes that the total volume for the Beecher Falls Division cannot exceed 660 gallons.

D. Island Pond Division.

Solids. For the reasons outlined above, Ethan Allen challenges the inclusion of materials identified as solids on EPA's volumetric ranking list for the Island Pond Division. EPA's SRSNE documents indicate that these solid materials were landfilled. Transactions pertaining to solids have been identified on the Transactional Review Form for the Island Pond Division attached to this letter. Ethan Allen believes that on this basis all of the materials allegedly sent to the site by the Island Pond Division, or a total of 4,125 gallons, should be subtracted from Ethan Allen's total volume.

E. Burnham Division.

1. Solids. For the reasons outlined above, Ethan Allen challenges the inclusion of materials identified as solids on EPA's volumetric ranking list for the Burnham Division. EPA's SRSNE documents for the other Ethan Allen divisions indicate that such solid materials were landfilled, and it is fair to assume that this is true of the solids from the Burnham Division as well. The single transaction connecting the Burnham Division to the SRSNE site has been identified on the Transactional Review Form for the Burnham Division attached to this letter. On this basis, all of the materials allegedly sent to the site by the Burnham Division, or a total of 605 gallons, should be subtracted from Ethan Allen's total volume.

Liquids. With respect to the Ethan Allen related parties generally, although EPA has compiled its volumetric ranking list on a waste-in basis, Ethan Allen emphasizes that the SRSNE documents provided by EPA clearly indicate that liquids attributed to Ethan Allen were used as fuel. Based on the limited information about site operations made available to date, Ethan Allen understands that such fuel was transported and utilized off-site. In other words, these liquids were not disposed of at the site and therefore could not have contributed to the contamination found there. Ethan Allen believes that EPA should not include them in Ethan Allen's volume total. Because EPA has indicated that it will not accept challenges at this stage to its waste-in assumption, Ethan Allen has not itemized each such transaction on the Transactional Review Form. However, Ethan Allen requests that EPA reconsider its position on this issue and permit Ethan Allen to submit evidence concerning the volumes of its wastes which were used as fuels. Furthermore, Ethan Allen reserves its right to challenge EPA's volumetric ranking list on this ground.

Even using EPA's waste-in assumption, Ethan Allen's volumetric share in the interim ranking is overstated. Based on EPA's waste-in assumption, Ethan Allen's volumetric share cannot properly exceed a total of 34,163 gallons. At a minimum, Ethan Allen's volumetric share in the interim ranking should be reduced to 34,163 and the waste-in assumptions should be re-examined. If the EPA is unwilling to make this revision, Ethan Allen expressly requests the opportunity to meet with representatives from the agency to discuss the basis for EPA's determination of Ethan Allen's volumetric share.
