Cleaning and disinfection are a ubiquitous topic of daily medical routine. The basic aim is to minimize the risk of infection for humans and animals. The thorough cleaning and disinfection of your endoscope influence much its optimum function and durability. Drying is an essential process of the hygiene concept.

Duringcleaningdirtisremoved.Thisstepisfrequentlyunderrated,butisessentialforthepreparationofallothersteps.Putyourendoscopeinanenzymaticdetergentsolution(e.g.VetZyme®)andmakeamechanicalpre-treatmentwiththespecialbrush(forexample,theinstrumentchannel).

Disinfectiontakesplacechemically.Putyourendoscopeintoadisinfectantthatisspecificallysuitableforendoscopes(e.g.VetClean®).Theexistinggerm-proofisreducedby1millioncFUto10cFU.

Therearedifferentprocedureforsterilization(e.g.gas-sterilization,autoclaving).Checkthatyourendoscopeissuitableforthisprocedure.Typicallyflexibleendoscopesareonlysuitableforgassterilizationbutnotforsteamsterilization.Rigidendoscopesaremarkedwiththeword„autoclave“isdistinguishedifsteamsterilizationispossible.Theexistinggerm-proofisfurtherreducedby10cFUto1CFU.

Foranoptimumresultinthecleaninganddisinfectionnotethefollowingpoints:

•Cleaningshouldbedonepromptlyafteruse.Previouswateringmakessense.•Checktheapplication(hands,face,endoscopes,instruments)toachieveanoptimaleffectandtopreventdamage.•Checkthespectrum(bactericidal,fungicidal,virucidal)yourdisinfectanttoselecttherightproductforyourneedsandtoavoiddamage.

•Productsofdifferentfunctionandmanufacturersshouldneverbemixed.Therecouldbedifferentreactions(effectsreaction,discoloration...).

•Strictlyfollowthespecifiedexposuretimeandtemperatureonthepackaging.•Detergentsanddisinfectantsmustbestoreddryandcool.Extremetemperatures(frost,heat>40°C)mustbeavoided.•Observetheinstructionsprovidedbythemanufacturerforuse(concentration,protectivemeasures).•Dryingisanessentialpartofthewholeprocess.

TermsandConditionsI.General1.Thefollowingconditionsareonlyvalidforoffers,deliveriesandservicesofDr.FritzGmbHhereafter referred to as the „supplier“ – if no otherwritten agreement has beenmade thatdiffersfromthem.2.Thesupplierherebyobjectstoanypurchaseprovisionsmadebythepurchaserthatarecon-trarytotheconditionssetbythesupplierorfromotherwisevalidlegalregulationsestablishedbyGermanlaw.Neitherwillthesupplierrecognizesuchprovisionsifasaresultofadeviationonthepartofthesuppliernofurtherobjectionsaremade.3.Thesupplier‘sgeneraldeliveryandpaymentrulesremaingenerallyvalidevenifindividualconditionsareinvalid.Thecontractpartnersarerequiredtoreplacetheinvalidconditionwithanotherprovisionthatinitseconomiceffectisascloseaspossibletotheinvalidone.4.Ifproductioniscarriedoutsolelyinaccordancewiththepurchaser’splans,thesupplierbearsnoresponsibilityifthelegaltrademarkrightsofthirdpartiesareviolated.Thesupplier‘sclaimstoredressforgoodsorservicesprovidedupuntilthatpointremainineffect.5.Germanlawalsoapplies,theCISG,however,doesnot.II.ConditionssubjecttochangeAlloffers,pricesandotherstipulationsaresubjecttochangeunlessotherwiseexplicitlyspe-cified.Alldocumentsandpapers that formpartof theoffer,suchasgraphics,diagrams, in-formationas toweightanddimensions,areonlyapproximateprovided theyhavenotbeenexplicitlydefinedasbinding.Thesupplierretainsownershipandcopyrightofallcostestimates,diagramsandotherdocuments,whicharenottobemadeavailabletothirdpartieswithoutthecorrespondingapprovalofthesupplier.III.Scopeofthedelivery1.Thesupplier‘swrittenorderconfirmationisdecisiveforthescopeofthedelivery.Supplemen-taryagreementsandchangesareonlyvalidwithwrittenconfirmationbythesupplier.2.Thesupplierreservestherighttomakechangestoconstructionandformthathavetodowithtechnologicalimprovementsorlegalrequirementsduringthedeliveryperiod,providedtheitemisnotsignificantlyalteredandthechangeisreasonableforthepurchaser.IV.Pricesandconditionsofpayment1.PricecalculationsaremadeaccordingtopricesvalidonthedayofdeliveryandaretobemadeinEuro/USD.2.Unlessotherwiseagreedupon,allprices,productsandservicesaresubjecttochangeexworks;thisdoesnotincludepackaging,shipmentcostsandtransportinsurance.Addedtothepricewillbyanylegallyrequiredvalue-addedtaxoranycomparabletaxesleviedbythecountryinwhichthedeliveryorserviceistaxable.Ifnootherspecialagreementhasbeenmade,thesupplierwilldeterminethemethodoftransport.3.Thesupplierreservestherighttomakechangesandcorrectionstoprices.Theminimumorder value is EUR 100.00 (net) per order.An additional processing charge of EUR 25.00(net)perdeliverywillbeaddedtoanypreliminaryshipmentsofordersthatdonotequaltheminimumordervalue.4.Allexpensesresultingfrommonetarytransactionsaretobepaidbythepurchaser.5.Unlessotherwiseagreeduponallpaymentsaredue30daysafter the invoicehasbeenissued(dateofinvoice)strictlynet.Theinterestratefordelayedpaymentsis10%perannumoverthebaserateoftheEuropeanCentralBank(ECB).6.Paymentbydraftisnotallowedunderanycircumstances.7.Withholding of payments or charging for any counterclaimsmade by the purchaser anddisputedbythesupplierisnotpermitted.8.Ifpaymentisnotmadeontimeandtherearejustifieddoubtsastotheabilityofthepurchasertopayoritscreditworthiness,thesupplierhastherighttodeclarealloutstandingchargesfromtheexistingbusinessrelationshipdueforpaymentandonlytoprovidefurtherdeliveriesandservicesifpaidinadvance.9.Anyapproveddiscountsandcreditsarenullifiedinthecaseofjudicialorextrajudicialcom-positionproceedings,insolvency,delayedpaymentorlegalprosecution.10.Custom-madeproducts–inparticularso-called„VOarticles“–canbechargedforonthebasisoffinalcosting.Custommanufacturedarticleswillingeneralnotbetakenback.Acan-cellationofordersofcustomizedproductsisonlypermissiblewiththeexplicitconsentofthesupplier.Inthecaseofcustommanufacturedproductsexcessorshortdeliveriesofupto15%overorundertheorderedamountcanbemadeandchargedaccordingly.11.Iforderedgoodsarereturnedwithoutjustification,orduetodefectsforwhichthesupplierisnotresponsible,wereservetherighttochargeaprocessingfeeofupto10%ofthenetinvoicevalue,atleastEUR10.00perreturn.12.PricesareshownwithoutVATtax.DeliverieswithinGermanyareonlypossiblewithaddedVATtax.V.Deliveryperiod1.Deliverydatesanddeliverytimesareonlybindingiftheyhavebeenacceptedasbindinginwriting.Thepurchasercanclaimcompensationforlossesinsteadoftheproductorserviceafterabindingdeliveryperiodorabindingdeliverytimewasnotcompliedwithonlyifthesupplieroralegalrepresentativeorauxiliarypersonofthesuppliercanbeimputedwithwilfulorintentionalnegligence.Theseliabilitylimitationsarenotvalidinthecaseofdamagestobodyorhealththatcanbeattributedtothesupplier.2.Adeliveryperiodbeginswith thedispatchof theorder confirmation, howevernot beforedocuments,materials,items,authorizations,approvalsandcompliancewithagreeduponpay-mentorotherobligationsareprovidedorfulfilledbythepurchaser.3.Thedeliveryperiodisconsideredtohavebeenadheredtowhenbythatdatethedeliveryitemshaveleftthefactoryorreadinessforshipmenthasbeencommunicated.4.Ifoutsideforcesorotherunforeseenobstacles,suchas,forexample,civilunrest,interrupti-onofoperations,strikes,lock-outs,etc.interferewithdeliverythedeliverytimewillbeaccordin-glyextended.Thesameappliesinthecaseofdelayeddeliveryofessentialmaterialsprovidedthesedelayscanbeproventohaveasignificant influenceonthemanufacturingprocessordeliveryofthedeliveryitemsandarenotcausedbythesupplier.5.After failing toadhere toanunbindingdeliveryperiodordelivery time thepurchasercandemand in writing that the supplier deliver the products in a reasonable time period if thepurchaserhasfulfilledallofitsduecontractualobligations.Thepurchasercan,afteradeadlinewasnotadheredto,onlydemandcompensationforlossesaswellasthedeliveryitselfifthesupplieroralegalrepresentativeorauxiliarypersonofthesuppliercanbeimputedwithwilfulorintentionalnegligence.Theseliabilitylimitationsarenotvalidinthecaseofdamagestobodyorhealththatcanbeattributedtothesupplier.6.Ifshipmentisdelayedattherequestofthepurchaser,beginningamonthafternotificationofreadinessforshipment,thepurchaserwillbechargedforcostsresultingfromstorage,atleast0.5%ofthenetinvoiceamountpermonth.Afterthedeterminationandsubsequentfailuretoadheretoareasonabledeadlinethesupplierhastherighttoobtainthedeliveryiteminanothermanner(priorsale)andtodelivertheitem(s)tothebuyeratalaterpointintime.VI.PartialdeliveriesThesuppliercanfulfilanorderwithpartialdeliveriesthataretobeseparatelypaidforaccordingtothepaymentperiodslistedinIV./par.5If thepaymentofapartialdeliveryisdelayed,thesuppliercandiscontinuetheremainingcompletionoftheorder.VII.Transferofriskandreceiptofdelivery1.Allrisk istransferredat thelatestwiththedispatchof thedeliverytothepurchaser,evenwhen partial deliveries aremade or the supplier has assumed other tasks or services, forexampleshippingcostsortransportandassembly.Attherequestofthepurchaserandathisexpense, thedeliverercan insure theshipmentagainstbreakage, transport, fire,andwaterdamage.

2.Iftheshipmentisdelayedduetocircumstancesthatthesuppliercannotcontrol,allriskistransferredtothepurchaserasofthedayofthereadinessforshipment,howeverthesupplierisrequired,atthepurchaser‘srequestandexpense,toprocuretheinsuranceofthepurchaser‘schoice.3.Thepurchaseronlyhastheright torefusetoaccept thedelivery itemif thedelivery itemshowssignificantdefects.VIII.Conditionalsales1.Thesupplierretainsownershipofalldeliverypartsdeliveredbyhimuntilthepurchaserhasfulfilledallobligationsfromcurrentandotherbusinesstransactions,especiallyanyoutstandingaccounts.2.Withintheframeworkofregularbusinessoperationsthepurchasermaya.)sellthesupplier’sdeliveryparts,unlesshehasnotpaidontimeorsuspendedpayment.b.)hasnotjoinedorcombinedthesupplier’sdeliverypartswithotheritems.Inthiscasethesupplierwillbegrantedco-ownershipinaccordancewith§§947,948oftheGermanCivilCode.c.)processormodifythesupplier’sdeliveryparts.Thisprocessingormodificationtakesplacewithoutexpenseforthesupplier.Ifasaresultoftheprocessingormodificationanobjectofsignificantlyhighervalueisproduced,thesupplierwillobtainco-ownership,whichcorrespondstotheamountofvaluehisdeliverycontributestothevalueofthenewobject.3.Thepurchasermayneithermortgagethedeliveryitemnortransferhistitlesforthesakeofsettlingdebt.Ifadeliveryitemismortgagedorseizedorotherwisemadeavailabletoathirdpartythesupplieristobeimmediatelyinformed.4.Inthecaseofresaleofthesupplier’sdeliverypartsoroftheitemthatresultsfromprocessingor combination of these parts, the purchaser is to immediately render the amount chargedthesubsequentpurchasertothesupplierincompliancewith§354aoftheGermanCommer-cialCode.Thisamountwillcorrespondtotheasyetunpaidinvoiceamountplusanyinterestaccruedandthesupplier’sexpensesfor thedeliverypart.ThepurchasermaycollectStand01.06.2006onoutstandingchargesaslongashedulyfulfilshisobligationstothesupplier.Ifthevalueofthereservedgoodstogetherwithothersecuritiesgrantedtothesupplierexceedstheoutstandingmoneyowedbythepurchaserbymorethan20%,thesupplierisrequiredtograntapprovalifrequestedbythepurchaser.5.Ifthepurchaserdoesnotpayontimethesupplierhastherighttowithdrawfromthecontractafterareasonablesettimeperiod.Afterwithdrawingthepurchaserisobligatedtoreturnanydeliveredgoods.IX.LiabilityfordefectivedeliveryitemsFor defective delivery the supplier is liable to the following clauses to theexclusionof anyotherclaims:1.Defectiveparts are tobe repairedor re-deliveredaccording to the fair judgement of thesupplier.Ifthesupplierchoosestorepairdefectiveparts,thesearetobesenttothesupplier‘sofficesRepairofdefectivepartswillnotbecarriedoutat the locationwhere theyarebeingused.Iftherepairisnotsuccessfulorthepartsarenotre-deliveredthepurchaserhastherighttoreducethepurchasepricebyareasonableamountor,ifthedefectiveitemisnotaconst-ructionservice,towithdrawfromthecontractathisdiscretion.Thediscoveryofadefectistobeimmediatelycommunicatedtothesupplier(within5workingdaysafterreceivalformissingpartsorbrokenparts).Replacedpartsbecomethepropertyofthesupplier.2.Thepurchaser‘srighttoassertclaimsduetodefectsisprescribedtooneyearbeginningwiththelegallydefinedbeginningoftheyearaslongas§§438par.1No.2or634apar.1No.2oftheGermanCivilCodearenotapplicableandthedefectsareunintentional.3.Thereisnoliabilityfordamagesthatresultfromthefollowing:Unsuitableorimproperuse,incorrectassemblyoroperationbythepurchaserorathirdparty,naturalwear,staining,incor-rectornegligenthandling–especiallyexcessivestrain–unsuitableoperatingfluidsorcleaningagents,replacementmaterials,chemical,electro-chemicalorelectricinfluences,providedthesupplierbearsnoresponsibility.4.Thepurchaser is requiredaccording to fair judgement togrant thesuppliera reasonableamountof timefor thecompletionofallapparentlynecessaryrepairsandreplacementdeli-veries.5.Thesupplierisnotliablefordefectsthatinvolvetheconstructionmethoddeterminedbythepurchaserormaterialdeliveredbythepurchaser.6.Theliabilityfordefectsisnotextendedbyrepairorre-delivery.AnewguaranteeperiodinaccordancewithVIII.2.Doesnotbegin.7.Otherclaimsbythepurchaser,inparticularclaimstodamagecompensation,whichdidnotresultfromthedeliveryitemarenotvalid.8.Thereisnoguaranteeforchangesmadeoroperationsperformedbythepurchaserorathirdpartyinanimpropermannerorwithoutpreviousauthorizationbythesupplier.Thereisalsonoguaranteefornaturalwearandtearorimproperuse.9.The supplier is not liable for consultation and suggestionsnot directly associatedwith adeliveryandthatarenotdefinedasbinding.Thisisalsothecaseforoperationormaintenanceinstructionsthatarenotdefinedasbinding.10.Theguaranteeisnotlimitedbytheaboveclausesifconditionsareinvolvedinwhichthesupplieroralegalrepresentativeorauxiliarypersonofthesuppliercanbeimputedwithwilfulorintentionalnegligence,thereisliabilityforthebody,healthorlifeofaperson,or§478par.4oftheGermanCivilCodeisviolated.X.Supplier‘srighttowithdrawfromcontractIfthepurchaserisfoundtobeinapoorfinancialsituation(forexampleinjudicialcompositionproceedings,executionmeasures)andifthesupplierlearnsofthisafterthecontracthasbeenclosedoraftertheclosingofthecontractasignificantdeclineinthepurchaser’sfinancialsituationbe-comesknownandthesupplier‘sclaimsfromthesupplycontractareputatrisk,thesupplierhastherighttowithdrawfromthecontractwithoutanyobligationtoredresswhilemaintaininghisclaimsfromthepartialdeliverycompleted,shouldthepurchasernotprovidesufficientsecuritywithinareasonableperiodoftimedeterminedbythesupplier.Thedeliveryperiodisextendedbythelengthoftimeofthisrighttowithholddeliveriesisbeingexercised.XI.Placeoffulfilmentandjurisdiction1.Placeoffulfilmentforthedeliveriesandservicestobeprovidedbythesupplierandplaceoffulfilmentforallfinancialtransactionsarethesupplier‘sheadoffices.2.Foralldisputesthatresultfromcontractualrelationshipsthecomplaintistobelodgedatthecourtpresidingoverthelocationofthesupplier‘sheadoffices,ifthepurchaserisamerchant,publicentityorapublicseparateestate.Thesupplieralsohastherighttolodgealegalcomp-laintatthepurchaser‘sheadoffices.3.Forrelationstonon-merchantsthepreceding isalsovalid ifafterclosingthecontract thepurchasertransfershisdomicileorplaceofresidencetoa locationoutsidethe jurisdictionallimitsofthecivilcodeoratthetimeofthelegalenforcementhisdomicileorplaceofresidenceisnotknown.4. If there are doubts as to the interpretation of the general export delivery conditions, theGermanlanguageversionhasprecedence.XII.DatastorageThepurchaseracceptsthatdataregardinghimrelevanttothefulfilmentofthecontractwillbestoredbythesupplier.
