The rightwing group Alec is preparing to launch a new nationwide n~twork that will seek to replicate its current influence within state legislatures in city councils and municipalities.

The American Legislative Exchange Council, founded in 1973, has become one of the most pervasive advocacy operations in the nation. It brings elected officials together with representatives of major corporations, giving those companies a direct channel into legislation in the form of Alec "model bills".

Critics have decried the network as a "corporate bill mill" that has spread uniformly-drafted rightwing legislation from state to state. Alec has been seminal, for instance, in the replication of Florida's controversial"stand-your-ground" gun law in more than 20 states.

Now the council is looking to take its blueprint for influence over statewide lawmaking and drill it down to the local level. It has already quietly set up, and is making. plans for the public launch of, an offshoot called the American City County Exchange (ACCE) that will target policymakers from "villages, towns, cities and counties". The new organisation will offer corporate America a direct conduit into the policy making process of city councils and municipalities. Lobbyists acting on behalf of major businesses will be able to propose resolutions and argue for new profit-enhancing legislation in front of elected city officials, who will then return to their council chambers and seek to implement the proposals.

In its early pUblicity material, Alec says the new network will be "America's only free market forum for village, town, city and county policymakers". Jon Russell, ACCE's director, declined to comment on the initiative.

Alec spokesman Wilhelm Meierling also declined to say how many corporate and city council members ACCE has attracted so far, or to say when the new initiative would be formally unveiled. But he confirmed that its structure would mirror that of Alec's work in state legislatures by bringing together city, county and municipal elected officials with

corporate lobbyists.

liAs a group that focuses on limited government, free markets and federalism, we believe our message rings true at the municipal level just as it does in state legislatures," he said.

In December, the Guardian revealed that Alec was facing funding problems as a result of fallout from its backing of "stand-your-ground" laws, in the wake of the shooting in Florida of the black teenager Trayvon Martin.

The Guardian also disclosed that Alec had initiated a "prodigal son project", designed to woo back corporate donors that had broken off relations with the group amid the gun-law furore.

The extension of its techniques to city councils and municipalities across America offers Alec the chance to open up a potential source of funding that might help it solve its budgetary crisis. There are almost 500,000 local elected officials, many with considerable powers over schools and local services that could be attractive to big business.

Alec makes the appeal to corporations explicit in its funding material for the new ACCE exchange. It offers companies "founders committee" status in return for $25,000 a year and "council committee" membership for $10,000.

By joining ACCE's council committee, corporate lobbyists can "participate in policy development and network with other entrepreneurs and municipal officials from around the country". In committee meetings, lobbyists will be allowed to "present facts and opinions for discussion" and introduce resolutions for new policies that they want to see implemented in a city. At the end of such meetings, the elected officials present in the room will take a vote before returning to their respective council chambers armed with new legislative proposals.

Nick Surgey of the Center for Media and Democracy, which monitors Alec's activities, said: lilt just wouldn't be possible for any corporation to effectively lobby the hundreds of thousands of local elected officials in the US, which until now has left our local mayors and school board members largely free from the grasps of coordinated lobbyists. Alec is now trying to change that."

One of the main criticisms that have been levelled against Alec is that its influence distorts the democratic process by giving corporations a handle over lawmaking. Similar fears are now being expressed about the intentions of ACCE in American cities.

Natalia Rudiak, a Democratic city council member in Pittsburgh, Pennsylvania, said she was "offended" by the suggestion she needed an outside body such as ACCE, which is licensed in Arlington, Virginia, to tell her what her community needed.

"Local politics in America is the purest form of democracy," she said. "There is no buffer between me and the public. So why would I want the involvement of a third party acting on behalf of a few corporate interests?"

Rudiak added that she found ACCE's boast that it will be "America's only free market forum" patronising.

"If by 'free market' they mean weighing supply against demand ,in the best interests of the people of Pittsburgh," she said, "then we are debating those issues in the council chamber every single day."

regulatory. digital content is a real revolution. use and ownership are legally protected which means you legally cannot use the "valleylist" newsletter unless i say it's ok. most legal activity falls under existing copyright laws and the fcc's new digital copyright laws. ownership of the creative work is protected and belongs to the individual who created the creative work. digital media would appear to require new laws and

regulations. yet in practice there is no real need for a new batch of legal guidelines. the existing laws actually seem to cover the digital marketplace.

conclusion. better technology is the real winner at ces this year. robust complexity colors the content conversation. content is not software. entertainment is not really content. viewers are not end users. hardware is not really a computer. programming is not software though it is content. a lot of talented people continue to produce new programming. they strive to make the top 10. the rest suffer endlessly in ignominy and lack the fame needed to push through to the top.

I have lived in Palo Alto for many years, and am increasingly disturbed by how badly the city seems to be managed. I'm a very middle-of-the-road person, but it seems there are so many unnecessary problems. My complaints are in the form of some suggestions below:

1) Some one needs to be in charge -- The rotating mayor' seems like a counsel sinecure, with no one responsible for big issues and decisions. It favors insiders and connected interests groups. To the rest of us, its overly complex and opaque.

2) Hire only staff that are needed -- Current salaries and benefits are not sustainable in the out years, even if we have extra money now. Many jobs could be done more competitively and flexibly by going outside. The mix seems heavily skewed toward all inside and no outside.

3) Hire the right people -- The city had no one to manage big impact projects like the cost and schedule of the library, but we have large numbers of hugely expensive people at high salaries and huge life-time benefits for tree trimming and street cleaning. (A pet peeve --Observing expensive city employees riding sidewalk cleaners, but leaving it to the Street Team to sweep up the butts that collect in the gutter and around drains. It looks really bad.)

4) Move city facilities to edge of PA where it is less expensive and downtown traffic and parking are not impacted. City hall should not crowd out merchants and businesses from downtown.

5) Move functions outside of PA, if necessary -- Why cannot some services move outside the city boundaries if it cost to much to be inside or if you cannot attract staff at a reasonable cost? Recycle has and we have survived.

6 ) Avoid conflicts of interest -- As counsel members, commit to not taking money or direct support from developers and city employee unions -- represent us, not them. The recent city employee contract is very disturbing in multiple respects. (I find this as objectionable as what the Koch brothers appear to be doing.)

7) Show leadership in problem areas -- Give up things like reserved parking, share the pain.

8) Base decisions on facts and numbers as much as possible -- What are actual employee densities in businesses vs the fictions used when granting developers approvals related to parking? What are the

life-time costs of employee compensation agreements when agreeing to comp agreements? What does the city spend on staff (overhead) vs expenditures on actual programs and infrastructure? Cities are not businesses, but the only fair decisions are ones based on objective facts and measurements, and not on political pressures and interest group spin.

I caught police chief Dennis Burns and his subordinate officers violationg numerous Department Policies yet Mr. Gennaco failed to mention one violation in his report regarding my incident.

Here is a video of Gennaco stating to the Palo Alto City Council that there needs to be a tight policy regarding the use of tasers and that there should be an outside and Independent auditor to ensure that the

Mr. Gennaco stated this to the Palo Alto City Council in order to justify the equiping of P APD officers with tasers and to secure himself another Auditing contract with the city of Palo Alto.

Yet the second time a taser is used by the P APD Gennaco helps the P APD cover up their crimes. When caught red-handed, Gennaco uses his connections with the Department of Justice to cover up the cover up.

It's very simple, two PAPD policies require that the taser probes, taser cartriges, taser wires and AFIDS be secured into evidence; Palo Alto Police Chief Dennis Burns supervised the destruction of two taser probes, a taser cartridge, taser wires and a set of AFIDS in violation of department policy. The reason why Chief Burns destroyed these pieces of evidence is because he needed to cover up a second taser gun firing that had been edited out of the videos and taser gun memory devices, Data Ports.

Personnel from the Palo Alto Police removed and added dialog to the recordings, moved dialog around the recording; removed significant portions of the videos splicing the videos back together rendering a complete fabrication of the event in addition to removing the actual taser gun activation data.

My name is Joseph (Tony) Ciampi. I bring this complaint against Palo Alto

Independent Police Auditor, Attorney Michael Gennaco, Bar Number # 112969, as a result of his actions which occurred over the course of the last three and half years in which Mr. Gennaco knowingly concealed the crimes committed by the Palo Alto Police and Palo Alto City Attorney's Office, Don Larkin. Additionally, Mr.

Gennaco actually submitted a flawed and fraudulent report, Pgs. 5-6 of Exhibit 3, pgs 2-3 of report, to the Palo Alto City Council in order to conceal the crimes of the Palo Alto Police and therefore by way of his actions actually conspired with the Palo Alto Police and attorney Don Larkin to incriminate me of a crime by knowingly using falsified evidence, audio/video recordings and taser gun activation data, to do so.

Mr. Gennaco was first informed that Temores' MAV video had been edited on

May 13, 2008 approximately two weeks after I had first viewed the video. See Exhibit 1. At this time I had not viewed Burger's MAV video or the Taser videos because they had not been provided. Thus my complaint was about Temores' MAV video not the Taser

Videos. In Mr. Gennao's official report, Pgs. 5-6 of Exhibit 3, Mr. Gennaco conspicuously leaves out my complaint abut the Temores' MAV video being edited and falsified.

I first learned of the watermark on the MA V videos approximately March of 2009. I emailed Mr. Gennaco on April 19, 2009 and asked him why he, like the Santa Clara District Attorney and Crime Lab, had not analyzed the watermark. Mr. Gennaco responded on April 27, 2009 by stating that he could not provide much detail regarding his review of the incident, yet Mr. Gennaco had already completed his thorough analysis using independent experts and submitted it to the City of Palo Alto on April 13, 2009. Mr. Gennaco intentionally lied to me. See Pg. 2 of Exhibit 2 and Exhibit 3. It should be noted that the Mr. Gennaco's report was submitted to Palo Alto City Manager James Keene on or before April 13, 2009 and that the Mr. Keene apparently lost the

On August 5,2008 I informed Mr. Gennaco that the Palo Alto Police had violated Palo Alto Use of Force Policy 308.96 by not providing the Taser Guns Activation reports with the original police report. Mr. Gennaco refused to investigate at that time, but

would look into it after current proceeding had been resolved. See Pgs. 3-~ of Exhibit 2. Mr. Gennaco never addressed the blatant violation and left it out of his

official report. Mr. Gennaco made a false statement and never revealed the violation committed by the Palo Alto Police.

In Mr. Gennaco's official report regarding my incident, he states the Taser had no effect on me. That is a bold face lie. Officer Burger shocked me for a minimum of 20 seconds and probably closer to 30 seconds during the incident. The video evidence clearly demonstrates that I was being shocked with electricity and Ofc. Burger himself admits that I was being shocked with electricity. In fact, Ofc. Burger himself admits to

being shocked from his own taser wires, See lines 24-28 of Pg. 18 of Exhibit 38 and Video 9 of Exhibit 98 & Exhibit 99 of my complaint against Don Larkin, Inquiry Case No. 11-36148. Mr. Gennaco's assertion is contradicted by the evidence, See Exhibit s 9, 10 and 15 through 33.

In Mr. Gennaco's March 7,2010 report, he notes in another Taser incident that the Palo Alto Police had problems downloading the taser data and getting an accurate time stamp on it. It appears that the cover-ups continue, for the individual was subjected to two taser guns, a violation of Palo Alto Police Use of Force Policy, and went into

seizures. See Pgs 8-10 of Exhibit 2 and Pgs. 4-5 of Exhibit 5.

Mr. Gennaco asserted in his official report regarding my incident that the videos comported with the account of the incident documented in the written reports. That is another false statement made by Mr. Gennaco, for Officer Wagner's statement differs significantly from that in the videos and both Officers Temores and Burger make statements during the Pre-Trial Examination that contradicts the videos and taser gun activation data. In fact based upon Ofc. Wagner's statement in the police report that I went down to the ground two separate times getting up off the ground in between and Ofc. Temores testifying under oath to the same, both Officers Wagner and Temores have essentially testified and verified that the video footage of me getting up off the ground

has been removed from Temores' MA V video. See Exhibits 12, 24, 25 & 26. Wagner's statements are contradicted by the photographs, Exhibit 33. Burger's

statements are contradicted by the videos, Exhibit 29. Temores' statements are

contradicted by the Taser gun activation data reports, Exhibits 25 through 26. Johnson's and Bums' statements are contradicted by the taser gun activation data and the

videos, Exhibits 42-43.

Mr. Gennaco asserted in his official report that the "gaps" in the video tape of the taser videos was the result of the officers activating and deactivating the taser guns while switching modes. First, this act of switching modes would make it impossible for officers to comply with the Use of Force Policy 308.94 which states that the audio/video

function shall be activated at all times that the taser is pulled from the holster, See Exhibits 39 and 40 and Pg. 5 of Exhibit 41. Furthermore, Temores' own MA V video verifies that Burger's Taser Camera should be recording audio/video footage when

in fact it is not according to the PAPD, See Exhibits 6, 7 & 8.

Mr. Gennaco obtained a contract from the City of Palo Alto to conduct investigations of the Palo Alto Police regarding their use of taser guns. A contract in which an outside auditing mechanism, Mr. Gennaco, would ensure that Palo Alto Police Officers would be held accountable should they unlawfully abuse citizens with taser guns, Exhibits 34, 35 & 36. By covering up Palo Alto Police Officer Kelly Burger's torture of me by using electricity from his taser gun, Mr. Gennaco misrepresented to the people and the City of Palo Alto his true intentions and actions should he ever be confronted with holding officers accountable for the unlawful use of taser guns.

Mr. Gennaco's analysis is contradicted by Temores' and Burger's MAV videos, the Taser videos, the Taser gun Activation data which has been falsified, (Exhibit 14) and the Palo Alto Use of Force Policy. Mr. Gennaco has submitted a fraudulent report to the City of Palo Alto in order to conceal the crimes of the Palo Alto Police and to wrongfully

incriminate me of a crime by using falsified video and other evidence.. See Exhibits 15 through 33 and 44. Additionally I cite all of the evidence and exhibits submitted in Inquiry Case No. 11-:36148, complaint against Palo Alto Assistant City Attorney Don

Larkin.

I believe it completely improbable that the Palo Alto Police were capable of editing and tampering with the Data Ports inside the taser guns prior to Mr. Gennaco analyzing the evidence during the months of March, April and May. Given that three separate Santa Clara County Crime Lab Analysts failed to document the activation data in their official reports corroborates this assertion. As such I believe that Mr. Gennaco viewed and or knew that the activation data retained on the Data Ports completely contradicted the edited videos. Thus, there was and is no way that Mr. Gennaco does not know that the videos have been falsified. To this day, Mr. Gennaco refuses to address my complaint, my allegations and my evidence. Even if the Palo Alto Police initially duped Mr. Gennaco early on, there is no possibility that Mr. Gennaco is not currently aware of the tampering and falsification of the videos and taser guna activation data given all of the evidence I have provided to him and the City of Palo Alto. So the question is, why does Mr. Gennaco continue to conceal the tampering, suppression, destruction, editing and falsification of the evidence? The answer is Mr. Gennaco has conspired with the Palo Alto Police to incriminate me of a crime by using falsified evidence verified by his submission of a fraudulent report to the City Council of Palo Alto.

Mr. Gennaco has violated State Bar Rule 3-110 by failing to perform legal services for the public in his capacity as an Independent Police Auditor. Mr. Gennaco is paid by the citizens of Palo Alto whom he failed.

By submitting his official report, Exhibit 3, to the Palo Alto City Council and thereby making it a public document, Mr. Gennaco violated State Bar Rule 5-120 especially when he knowingly prepared the report in a false and fraudulent manner in order to conceal the Palo Alto Police Department's crimes which is a violation of State Bar Rule 5-200(A).

In preparing his false report and then submitting it to the City of Palo Alto, Mr. Gennaco violated Penal Codes 132 and 134. Mr. Gennaco's motive for preparing and submitting his false report was to cover up the crimes of the Palo Alto Police and Palo Alto Asst. City Attorney Don Larkin, a violation of Penal Code 32. Additionally, the evidence points to that Mr Gennaco had and has the motive to aid the Palo Alto Police Department's and Asst. City Attorney Don Larkin's intent to falsely incriminate me of a crime by using falsified evidence, thus, Mr. Gennaco violated Penal Code 182(a)(1)(2)(3)(5). As a result of these actions and omissions, Mr. Gennaco has violated Business and Professions Code 6068(a), 6106 and 6128(a) and therefore should be suspended from practicing law at the very least or more appropriately receive permanent disbarment for his despicable actions that are completely contrary to everything that the American Justice system is supposed to stand for.

It doesn't say whether all Google Fiber huts are this size. It doesn't say how many premises could be served by a hut. Is there room for such a hut at each of our electric substations? (A previous FTIP plan proposed putting FTIP substations at the City's electric substations.)

Google Fiber apparently also uses cabinets, but the cited checklist document doesn't discuss them.

We LOVE the changes on Arastradero and Charleston. We support the funding plan for the planned landscaped and raised medians on this corridor that will continue to improve this street for the many students who use this road to get to school. We also support funding for any and all bicycle and pedestrian plans, for the same reason.

We are neighbors, runners, and bikers, and have three kids who have walked or biked to Terman and Gunn, and we have noticed a DRAMATIC decrease in the number of really scary speeders (>3Smph) along Arastradero, especially in the morning hours. The street feels much more like the residential/school commute route that it should be.

We are also now commuting and running more errands on our bikes along Arastradero and Charleston (e.g., to Piazza's), and find it far more pleasant, calm, and safe than when we last commuted along Arastradero 7 years ago.

Also, we love the protected left turn lanes ... we used to nervously check the rear view mirror when turning left during the evening commute, because frequently we would see a near miss as the car speeding behind us would veer right at the last minute to avoid slowing down behind us ....

Please make every effort to keep the speed limit at 2Smph----30mph is just too fast for this neighborhood street.

Dear Ms. Nancy Shepherd, Honorable Mayor of the City of Palo Alto;

Palo Alto High School wants to express our deep gratitude for Palo Alto Fire Department's willingness to grill, flip, and serve pancakes to our staff on Wednesday, February 19th, 2014. All the volunteers were very friendly, helpful, engaging, and our staff really appreciated the time that they took to come and support Paly and our fundraiser. We would also like to express our gratitude to firefighter, Adam Poarch for working closely with Mary Ellen (Paly coordinator for event) to organize this event.

When Mary Ellen first asked if the fire department would be willing to volunteer to help at our pancake fundraiser breakfast, the PAFD suggested donating the money back for a good cause, which became a fundraiser for Camp Every town. Thanks to their departments kindness, efforts, and support we were able to raise approximately $900 from this event. With over 40% of our students receiving a scholarship for this camp, it is with great appreciation that we are able to send three more students to have this invaluable experience.

Once again, we want to thank the PAFD for their time and compassion, and we hope that we can make this an annual event.

If the 88-year old Buena Vista Mobile Home Park closes, it may result in the single greatest displacement of adults and children in our town's history. Of the 129 Buena Vista children, 99 are PAUSD students. We insist on a solution that includes Buena Vista residents continuing to live here with their children in our schools.

Goals of Buena Vista Residents and Supporters: - Work together to ensure residents have the option to remain in Palo Alto. - Ensure students will finish their education in Palo Alto .

. - Replace any of the 108 units of Buena Vista affordable housing that may be lost. - Work with residents to guarantee their fair treatment and their rights upheld.

Current Situation: . - Most residents own homes, renting a space from the property owner. - In 2012, Buena Vista's owner filed with the City to close and "relocate" residents. He

has the right to do so but must comply with state and city laws. - This" closure process" will continue well into 2015, if not beyond. - Most residents will lose everything if forced out - homes, jobs, friends, a safe

community, good schools, medi~al and elder services. Many children will lose extended family members (grandparents, aunts and uncles) with whom they have always lived.

- Legally required "relocation payments" from the owner to residents will not be enough to afford Bay Area market rents and area mobile home parks have few empty spaces, so residents will have to move out of the region.

- Prometheus Real Estate Group wants the city to up-zone the 4+ acres to build "180 upscale apartments for young tech workers" but no below-market-rate units.

Why Residents live at Buena Vista: - For the same reason many of us live in Palo Alto - so our children get a good

education while living in a safe community with good services. - A Palo Alto education is a family's way out of poverty - a golden door to a better

life. - It enables one-quarter of residents to live with extended families, owning separate

homes while providing mutual support for their children and elders. - It's affordable. The city terms it to be an important source of affordable housing.

Demographics: - About 375 people live at Buena Vista, many for decades. - 65 households are families with children. - 99 of the 129 children are students, mostly at Barron Park Elementary, Terman and

Gunn, including 2 autistic children in special high quality programs. - About 12% of Barron Park Elementary students live at Buena Vista.

- BV students don't drop out; they graduate. - Affordabl~ housing allows 7 young adults to pay tuition to attend college. - Elders make up 21 households, some of whom are disabled. - 95% of adults work. Fifty-five in Palo Alto or Stanford, cleaning schools and homes,

and working in our markets, restaurants, and offices. Some own small businesses. Most are what is termed the "working poor". One makes sandwiches at Driftwood Market, one is in charge of Mollie Stones bakery and deli, one is manager of Whole Foods produce, and one is a janitor at Gunn High.

PAUSD Recognizes Student Diversity as a "Fundamental Principle": - PAUSD policy states, " ... diversity of the student population and staff enriches the

learning experience for all students" . - 82% of Buena Vista households are Latino, and others are European, Tongan, and

Chinese-American. - Buena Vista includes much of Palo Alto's ethnic and economic diversity. - Most households are low or very low-income.

Children Should Not Become the Collateral Damage of Palo Alto Redevelopment: - Studies repeatedly show the quality of a child's educational experience is a principal determinant of that child's life course as an adult, including both socioeconomic wellbeing and health status. Losing the opportunity provided by Palo Alto schools could irreversibly alter the trajectory of these children's entire lives. (Amado Padilla, former PAUSD school board member & Prof of Education, Stanford) - Buena Vista students are 100% in graduating from high school and most aspire to

college. - P AUSD must keep its commitment to diversity and its Buena Vista students by working to ensure children finish their education here.

The City Must mitigate loss of 108 Units of "Essential" Mfordable Housing: - City policy states: To the extent feasible, the City will seek appropriate local, state and

federal funding to assist in the preseroation and maintenance of the existing units in the Buena Vista Mobile Home Park.

- Prometheus wants a zoning change to build bigger than current zoning allows. The City should grant nothing until residents' housing needs and the loss of affordable

. units must be resolved responsibly.

A Solution Must be Found: - Many continue to work on a solution, including Buena Vista residents and

supporters, Community Working Group (Opportunity Center, 801 Alma affordable housing), city staff, and elected officials.

- The owner has a right to sell his property, but also has a responsibility to the residents he will displace, as does the developer.

• The City-appointed hearing officer is now required to hold a hearing within 60 days to decide whether the mitigation measures offered by the mobile home park owner, including relocation benefits, are ade­quate to mitigate the adverse impacts to displaced park residents, subject to limitations in the law.

• The City will disseminate information about the date, location, and format of the hearing once the hear­ing officer provides this information. The hearing officer acts independently of the City and may also re­quest additional information prior to rendering a decision.

• The hearing officer's decision is appealable to the City Council. Under state law, the Council will not have

the ability to reject the property owner's application and prevent the closure of the mobile home park.

Any appeal of the hearing officer's decision to the City Council would only cover the adequacy of the pro­

posed mitigation measures.

SUBJECT: 2011-7636: Discussion of Amended Onizuka Air Force Station Redevelopment Plan, Amended Homeless Assistance Submission, Amended Legally Binding Agreement and District Agreement

REPORT IN BRIEF

On March 1, 2011, the Onizuka Local Redevelopment Authority (LRA) directed staff to substantially amend the 2008 Redevelopment Plan to include the following preferred uses: a public benefit conveyance for emergency services (expansion of the Fire Station #5 site); a public benefit conveyance for an educational use or a public park/ sports complex; expansion of .the Department of Veteran Affairs (VA) site; and acceptance of a reduced consolidated site for the two homeless housing providers. The Council further directed staff to explore the feasibility of transferring the providers claim to the City-owned Armory site and amending the Housing Assistance Submission (HAS) and Legal Binding Agreement (LBA) accordingly. .

On September 26, 2011, the Planning Commission unanimously recommended . that the City Council approve the Amended Redevelopment Plan, Amended . Homeless Assistance Submission, Amended Legally Binding Agreement, and District Agreement. The Commission also found that the Redevelopment Plan was consistent with the General Plan and Moffett Park Specific Plan.

The LRA reviewed the proposed changes and agreements on October 4, 2011 and provided comments. In summary, the LRA indicated. support of the Amended Redevelopment Plan and associated documents. Staff proceeded to prepare and post a Mitigated Negative Declaration for the Redevelopment Plan (Attachme:qt H) with supporting traffic and air quality analyses.

Staff recommends that the LRA conduct a public hearing, adopt the Mitigated Negative Declaration and approve the followfug documents:

• Amended Onizuka Air Force Station Redevelopment Plan; • Amended Homeless Assistance Submission (HAS); • Amended Legally Binding Agreement (LEA); and • District Agreement

SUBJECT: Job and Population Trends

The community is about to begin a process to update the Housing Element. The central focus is on the short term from 2015 to 2023. I know that staff is especially interested in identifying sites for housing that is affordable to lower income households as well as planning for the expected increase in housing demand. I know also that individual council members and community members had concerns about the regional projection process that led to the eight-year housing planning targets for Palo Alto.

To provide context for the Housing Element update, this memo summarizes the recent revisions to estimates of job growth in our area and the region and also provides an update on California Department of Finance population estimates and projections.

Strong Upward Revisions to Bay Area Job Growth Estimates

The state Employment Development Department (EDD) released revised job estimates on March 7, 2014. They show much stronger recent job growth for the state and region than was previously reported.

As currently reported the Bay Area added 54,300 jobs in 2011 (+1.7%), 118,500 jobs in 2012 (+3.7%) and 134,200 jobs in 2013 (+4.1%). These are all roughly double the national growth rate.

The San Jose metro area, which includes Palo Alto, added 23,500 jobs in 2011 (+2.5%),46,100 jobs in 2012 (+4.7%) and 45,300 jobs in 2013 (+4.4%) outpacing the region, state and nation.

The job gains occurred in professional services, information services and construction as well as gains in population serving sectors. This growth occurred even as government jobs were in decline, a trend that is now slowly reversing.

A relatively small portion of the upward revision to job growth was the result of including in-home supportive services in the EOO job series for the first time. A picture of Bay Area job trends relative to the nation since the pre-recession peak in July'2007 is shown below.

A portion of these job gains came as previously unemployed residents found jobs and thus did not add to population growth and housing demand. But unemployment rates on the peninsula are now in the 5% range and company plans for expansion remain strong.

Recent Population Trends

The Bay Area led all regions in percent population growth between July 2010 and July 2013-the latest data available. The region added 221,300 residents or an average of 73,800 per year. Santa Clara County added 67,300 residents or an average of 22,400 per year and was the second fastest growing county in California behind Placer.

The next population estimates for January 1,2014 will be released on May 1, 2014.

New OOF Population Projections

OOF is beginning the process of developing new population projections that they hope to release by year end.

The new process will involve coordination with ABAG and incorporation of regional job projections as required by DOF methodology (it was not done last time) and incorporation of the recent job trends described above.

While the future is uncertain, at the moment both regional and county job and population trends and outlook are running ahead of the growth expected in the recent ABAG Plan Bay Area projections.

Message from our President

Each year March 1 st kicks off Women's History Month and I have to ask myself, "Will there come a time when women have arrived at a place where designating a month to honor our contributions is no longer necessary?"

Not in my lifetime. So for now our National League is celebrating with <lwe.org b10g>, Twitter #wmnhist and #WHM and Facebook offerings of the countless ways League members across America have participated with marches and advocacy on voting rights, healthcare, education, equal pay, gun control, immigration reform, environmental protections, immigration and so much more. Read some of these stories and reflect on the women in your life who helped and are helping make this a better world for all.

Recently I was reading about online voter registration systems in at least 21 states. This means that almost 50% of all eligible voters in the U.S. live in states that provide this easy and convenient way to register to vote.

Most of these state systems currently leave out a significant and important part of the population - citizens who don't have a driver's license or non-driver's ID. The League is committed to working to remove this barrier so that all eligible voters can register and update their registration through online systems.

In the State of California it is possible to register to vote online with no driver's license or ID card, but it requires an additional step of printing out and mailing your application to the County Registrar of Voters. Please see https:11 rtv.sos.ca.gov/e1ections/register-to-vote/. This form is available in nine languages.

When you register to vote online in California with your DMV license number, you must also use the same name (first, middle, last) that appears on your license, as the system uses your DMV license signature on the online Voter Registration form. About 750,000 people registered online in the 2012 election cycle, and even more should be added in 2014.

In the meantime we are still conducting voter registration drives in the local high schools and the Veterans Hospitals. Please volunteer to help with this work by contacting Liza Taft at 494-3146. See page 3 for more information.

• Unanimously ratified the EAC vote on the letter submitted by LWVPA to the City Council encouraging the implementation of a traffic demand management program (TDM).

• The Nominating Committee has identified people for most of the board positions with the exception of the President. The slate will be voted on at the Annual Meeting.

• Voted to recommend the proposed 2014-2015 Budget which will be voted on by the membership at the Annual Meeting.

• The Annual Meeting on May 10 will be held at the Garden Court Hotel. Our speaker will be Catherine Martineau, executive director of Canopy.

• Voted to recommend support of the LWVBA (League of Women Voters of the Bay Area) program priorities:

• Patty Lum, with the Palo Alto Police Department, will be the speaker at the March Lunch with League.

"Water", and "Regional Planning on Climate Change Issues".

• League-a-Thon (LAT) is in full swing, calling non­members for contributions. We still need callers and clerks.

• Voted to recommend no new study at the local level, and to have three areas of emphasis. [Editor: see p. 5]

• Voter registration is being planned for the Palo Alto high schools.

The board held a debriefing discussion on the excellent Moderator Training Workshop on February 8.

What is League Program? League Program consists of all the positions that have been studied in the past and reaffirmed at our annual meetings, any studies that our League approves by vote at an annual meeting, our principles and any areas of emphasis that we choose for the coming year.

Program planning is a grass roots process by which a local League determines what it would like the League to be acting upon in the next planning period. The LWVPA held a program planning meeting on January 25. Those attending reviewed our current LWVUS, LWV Bay Area, LWV Santa Clara County and our LWV Palo Alto League Programs. Everyone was encouraged to review current program before coming to the program planning meeting. The recommendations from that day were reviewed again by the Board. In February, the Board voted on recommended Program for the LWVUS and the LWV. Bay Area and forwarded these recommendations to those Leagues. Our voice will be heard by those boards, which will then make recommendations to the delegates for vote at their respective conventions.

Recommendations from the program planning day for our local League Program were considered at our March board meeting. Those recommendations are on page 5 and will be voted upon at our Annual Meeting. Please come to our Annual Meeting on May 10 and have a say in next year's League Program.

Spring Voter Registration Once again it is time to register people so that they can vote in the Primary Election on June 3, 2014.

On Thesday, April 22 and Wednesday, April 23, we will be at Gunn High School during the lunch hour. Still to be confirmed are Thesday, April 29, and Wednesday, April 30, at Palo Alto High School.

During the first two weeks in May, we are planning to register people between 10 am and 2 pm at the Palo Alto and Menlo Park Veterans Hospitals. Later in the summer we will be providing Voter Registration forms after the Naturalization Ceremony in Santa Clara County.

It is always exciting to register folks to vote. Please let me know if you would like to join us. There will be an opportunity to learn how to do it before we start. It isn't difficult.

Housing Element 2015·2023: LWVPA has been invited to participate in a Community Panel that will advise the City on the update to the Housing Element approved in 2013. Doris Petersen will represent LWVPA. The updates will include identification and possible recommendations for rezoning of sites for an increase of about 600 potential housing units. This next Element will last eight years. If it is not updated on schedule, the City will need to update it again in four years. Doris is also attending the Palo Alto Council Regional Housing Mandate Committee meetings.

TOM, traffic and parking: LWVPA spoke to 01 the City Council on February 24 in support ofthe :' City's initiation of a Traffic Demand CITY OF

approved initial funding of the exploration process. The Council is concerned that when the residential parking permit program (RPP) starts downtown in January 2015, there will be extensive confusion about parking. The goal is to have as many short-term programs in place as they can manage by that time. The three legs to mitigate these problems are: 1. the parking permit program for neighborhoods that want

it· 2. a~ increase in parking supply such as a new garage, valet

parking, a more effective parking permit program; and 3. implementation of a TDM program to reduce the demand

for parking and traffic. One of the proposals is to study setting up a Transportation Management Association (TMA) that will manage implementation and management of a TDM program.

Sustainability: Palo Alto has hired Gil Friend as its chief sustain ability officer. His job is to help the various city departments find ways to use less energy and reduce the carbon footprint of the city.

Cubberley: The City held a public hearing on February 24, to discuss lease arrangements with the Palo Alto School District for Cubberley, Ventura and other related subjects. The lease is due to be renewed by December 2014. Basically, the City wants a long-enough lease that makes it worth the financial investment in repairs and upgrades to the facilities, and the City wants to eliminate the $1.8 million paid to PAUSD to keep it from developing school sites. This money could then be used to pay for improvements to the facilities. The school district, at a subsequent meeting, was not happy with the potential loss of funds.

Increase in TOT: On March 3, City Council voted to place on the November ballot an increase in the transient occupancy tax (TOT) from 12% to 14 %. The motion included making the construction of the public safety building a top priority on its infrastructure plan and funding it with Certificates of Participation (COPs). Funding for the public safety building will not go on the ballot. The current

list of infrastructure needs is different from the original Blue Ribbon Infrastructure Task Force 2011 report, mostly because of changes in the income sources available, readiness ofprojects and new needs that have been identified. The City Council Infrastructure Committee will review the proposed projects and reset project priorities and timelines based on a 14% TOT. This will come back to Council on consent calendar if all four members of the committee agree.

LWV Santa Clara County Council Midpeninsula Regional Open Space District: The district has completed a visioning plan for the next 40 years. A summary of the top 25 project areas and proposed improvements is available on the Midpeninsula Regional Open Space website http://www.openspace.org/top25tour. Gretchen Hillard has been following this issue for us.

Proposed Bay Delta Conservation Plan (BDCP): The LWV Santa Clara County held a public forum on the Proposed BDCP in San Jose on March 1. The Draft BDCP Plan and the draft EIR have been released. See ht1;p:/Ibaydeltaconservationplan.com and related articles at http:Uwww.sciaraco.ca.lwynet.org/.

Caltrain: The EIR for electrification of Caltrain has been released. See http:Uwww.caltrain.comlprojectsplans Comments may be submitted until April 29, 2014.

LWVUS: LWVUS joined a letter to U.S. House members opposing H.R. 3865. This legislation would prohibit the Internal Revenue Service (IRS) from adopting revisions in the rules used to determine whether an organization is operating exclusively for the promotion of social welfare for purposes of tax code Section 501(c)(4).

LWVUS submitted comments to the Environmental Protection Agency (EPA) supporting the proposed

standards for reducing carbon pollution .. ~ from new power plants. LWVUS said, "We

, stand in support of the updated proposal, and commend the EPA for continuing to seek public input on this historic regulation.

Taking steps to reduce the amount of carbon dioxide are essential to protect our children and future generations from the effects of climate change. LWVUS urges the EPA to go even further by limiting carbon pollution from existing power plants to achieve at least a 20 percent reduction below 1990 levels by 2020." http.;U www.lwv.orglcontentlleague-submits-comments-epa­regarding-carbon-pollution -standard-new-sources

LWVUS filed a merits brief in the U.S. District Court in Kansas supporting a decision by the Election Assistance Commission (EAC) to reject a request from Kansas and Arizona to require proof of citizenship with the national mail voter registration form. See the ~ release on this hearing.

The LWVPA Board Recommends the Following Local Program for 2014-15: Not-recommended Programs

1. Continuation of all current LWVPA positions.

If a member or members of the LWVPA wish to submit a Program item for the 2014-15 year that is not listed here, it must be submitted, in writing, by March 27,2014, to the LWVPA Board of Directors. It will then be listed as a not-recommended Program proposal in the Annual Meeting Kit. The not-recommended program proposal can be considered for inclusion in the Program by a majority vote of the members and adopted by a two-thirds vote of those present and voting at the Annual Meeting. New Program recommendations that have not been included in the Annual Meeting Kit will not be considered at the Annual Meeting.

1. Baylands issues, including but not limited to, the airport, possible anaerobic digester and flood control issues.

2. The City of Palo Alto 2010-2020 Comprehensive Plan, including environment, transportation and housing.

3. The implementation plans for the Infrastructure Blue Ribbon Task Force Report 2011 "Catch-up, Keeping-up, and Moving Forward."

4. Early childhood education 0-5 in collaboration with other Leagues.

Recommended LWV Santa Clara County Program*

Continuation of all current LWVPA positions for Santa Clara County.

* County Program is considered Local Program, but all five Leagues in the County must have identical wording for County-wide positions.

At our March Board meeting, we recommended that the members at our Annual Meeting confirm all current LWVPA positions and that there be no new local studies for the next year. The Board also recommended that the areas of emphasis be essentially the same as last year plus an additional emphasis on preschool 0-5 education.

In reviewing our current positions, all seem pertinent. Either we have acted on this position recently or we have been monitoring an elected body for its actions or non-action in that area or we would want to be able to act on this issue if it arose. The Board recommended that we keep all current positions.

There was no recommendation for a new study. This year we have been able to act as needed by applying both our current local positions and positions from other levels of the League.

The local areas of emphasis are similar to last year because these subjects are currently being considered.

The final draft of the Palo Alto Comprehensive Plan and its draft EIR have not yet been written. Community input is being sought for its vision, goals, policies and programs. The completion of the Plan is now set for December 2015. The last Housing Element was approved in August 2013, but the next one is due December 2014 with a possible delay of 4-6 months into 2015. If the Housing Element is completed in that time frame it will be eight years before it is reviewed again. If

it is not completed on time it must be redone in four years.

The implementation of the City's Infrastructure Task Force recommendations is a primary priority for City Council this year. A proposed 2% increase to transient

occupancy tax (hotel tax) to fund the public safety building was approved by City Council in March and will go to the voters in November. An initial funding plan to meet this city infrastructure program was also approved in March. Some of those items will be funded by the transient occupancy tax. So all of these issues are current.

In the Baylands, the control of the airport is being transferred from the County to Palo Alto. The replacement of the incinerator at the Regional Water Quality Treatment Plant is being pursued and the possible use of an aerobic or anaerobic composting facility is still being considered. The municipal golf course is under renovation and the lower section of San Francisquito Creek will be reconstructed shortly. In addition, City Council is considering a park-and-ride area along Embarcadero and Geng Roads.

Preschool education for 0-5 year olds was added to the recommended program because several members at the program planning meeting felt this is an urgent need, we have the positions, and the issue is active in the state and federal legislatures.

Education Committee The LWVPA Education Committee is growing. We will be having bimonthly meetings at Moldaw Residences. The next meeting will be a luncheon on April 3 at noon. We are also planning to meet with the Santa Clara County Department of Education regarding necessary county needs assessments and the current status of the costs and availability of space for children in the schools.

The Education Committee is addressing the current need, access and availability of early childhood services. Our plan is to work with other LWV Education Committees to develop a power point presentation that advocates for early education (birth to age 8) and is in alignment with the LWVC stated position(s) on early education. This presentation may be "localized" for regional, county, community, school district audiences. Topics would include: • the importance of partnering with other organizations

to develop a communications plan for building awareness and support for early education;

• the fact that not all children have access to quality early education;

• a summary of the number or percent of children not in quality early education programs; . .

• identification and a summary of the leadmg statewlde initiatives and advocacy groups for early education;

• whether these programs would provide the enriched, quality early education programs that are needed.

Eight-County Early Learning Forum .~.

On February 21, the Santa Clara County J. L!:lt Office of Education's Early Education ~ )If",

Local Planning Council (LPC) co-hosted a legislative forum as part of the Eight-County Early Care and Education Coalition. State legislators from across the Bay Area participated in an open dialogue about pending state legislation focused on early education, as well as the January State budget proposal and its impact on early care and education programs. More legislators participated in this year's event, which was filled to capacity.

Key Take-Aways: • The forum demonstrated the increased interest and

support for funding early education (birth to kindergarten) programs for low-income families. Both the State Senate and State Assembly are working on bills proposing ways to expand access to quality child care and preschool.

• The key message of Ted Lempert, President of Children Now, was that California and Governor Brown need to prioritize early education NOW. Our children can't wait, he said. No further research on long- term benefits or best practices is neede~. A. sufficient number of pilot programs and longltudmal studies have shown the benefits of increased resilience, attendance, third-grade reading levels, etc.

The 2014-15 State Budget: Child Care and Preschool Programs We studied the Governor's budget proposals for the state's child care and preschool programs, specifically, the case load and cost assumptions underlying the proposal. We found that the Governor's budget likely overestimates caseload and underestimates per-child costs, leaving child care funding a few million dollars short of fully covering 2014-15 costs. Once additional data is released in April, the Legislature will be able to develop more accurate caseload and cost estimates for the child care programs in 2014-15.

videos that were shown at the screening. Rafael, along with Ana Angel who directs the NV4Y program at Siena, took the NV 4Ystudents to The Lego Movie and were surprised that several students had not been to a movie theater.

At Menlo-Atherton High School, NV4Y is collaborating with YCS-YLAC's program. Students have decided to focus on foster youth. Working with NV, students have begun to think more about the questions they have about foster youth, the process, the organizations, the system, etc. Students are really interested in exploring the life of foster youth and breaking down the stereotypes associated with being a foster youth. Students have also begun learning about the film production process and interviewing techniques. Ana is getting help this semester from M-A NV4Y alumna Nimsi Garcia! Nimsi has been a great mentor to the students so far; they are inspired by her work and excited to learn how to make a film like hers!

We are still waiting to learn about our grant applications to the Palo Alto Community Foundation, the Palo Alto Weekly's Holiday Fund, the Woman's Club of Palo Alto and the YWCA Endowment Fund. We were pleased that we have received a PTA Mini­Grant from M-A. The grant is modest but we appreciate being recognized for a second year by the PTA.

The Housing and Transportation Committee will have a busy year. Doris Petersen will be attending the meetings of the Community Panel formed by the City to provide input on the Housing Element for 2015-2023. We will also continue to follow the parts of the Palo Alto planning process that affect our issues. These include TDM (transportation demand management) and the long-term fate of PC zoning.

Dear City Council members,

On behalf of the leadership team of Palo Altans to Preserve Neighborhood Zoning, we hope that in the coming months, you can implement the changes outlined below, as they align with many of the city's stated goals of open government, transparency, inclusion, and data driven decision making. We view these items as fundamental and vital improvements to our city's functioning.

Issue 1: "Impartial ballot language" for a municipal referendum is not impartial ifthe city attorney writes it. Please investigate how San Francisco creates impartial ballot language, and create and pass an . ordinance that has a process whereby the producers of a referendum work together with the city attorney to create ballot language that is actually impartial and satisfies both parties. This would be efficient, and waste less time and money producing legal challenges and make for a more amicable relationship between parties. It's also the right thing to do.

Issue 2: This city has demanding management needs, and most people who are talented and experienced enough to make good leaders for our city cannot run for office because they need to earn a living. This city faces big city problems, yet city council is stuck in a small town model of governance. Presently only those who are able to volunteer, (or who are supported by organizations that may benefit from their participation), can be on the City Council, yet, the City Council has great strategic, legal, fiduciary, planning responsibility, and faces increasingly complex situations. The City Council is faced with a huge amount of work that would benefit from some advanced skill sets, and it should be a fully paid position in order to attract great leadership. We also feel that the people elected to city council should represent geographic areas of the city, so that every part of our city feels included in decision making. This has not happened for a very long time. .

Issue 3: Residents continue to distrust traffic reports. We would like the city to have a short list of vetted traffic engineers that developers must choose from, and also require that those studies undergo peer review prior to being accepted by the planning department. The practice of accepting traffic reports that do not use current data and consistently make pronouncements that there will be no significant impacts is not going to help us make good decisions. A peer review process that considers cumulative data would help rectify this habit.

Issue 4: Often City Council meetings are distressingly inefficient, and decisions are delayed. We see that council members and members of the public are often ill prepared for city council meetings, because staff reports are issued only a few days before meetings so there is very little time to digest. Too frequently the council gets new information AT the meeting, and the public is completely excluded. Staff presentations have frequently been verbatim powerpoints of printed material and add little to a discussion, perhaps assuming that council has not read the materials (a good guess since the materials were not supplied in a timely way).

It's a process that all too often results in delayed decisions, and creates ineffective, inefficient, incomplete meetings, elongated and disorderly discussions, and poor outcomes. Staff reports released with too little time to read/reflectlconsult/question or gain clarity create cynicism about staff and council, even when everyone is working hard to produce a good outcome.

We believe that this issue can be solved by requiring all staff reports be submitted at least 10 business days in advance of every city council meeting, in order to allow council members, the public, and the press, adequate time to review issues, get questions answered, and exchange options and opinions. Staff presentations at meetings could then be of better quality: with presentations that layout the context and the issues, the pros and cons, (not just staff recommendations) summarize important questions raised, and invite discussion.

Additionally, this process could support the desire we all share for concision. Concision is something you require of the public, yet concision is not practiced on the council because there are too many open questions once the meeting commences. Creating the expectation that staff will adequately answer questions in the ten day period prior to council meeting is a practice you could institute, and a cultural shift you could achieve.

Logistically, skipping just ONE council meeting would get this synced up.

Issue 5: Presently Staff reports make recommendations, and avoid delineating the impacts of developments. They provide piecemeal information. (Whether this is a legal issue or not, it's bad governance.)

A. We would like to see each project report in a standardized format. With pros and cons that provide context and objectivity. Specifically, each report should have a standardized attachment that clearly states (for example) what the present zoning would allow, what the excess zoning request is, what the parking impacts are, what the traffic impacts are, what the infrastructure costs are, what the increased water demand would be, how (and which) schools will be impacted, in order that our city can keep track of cummulative effects of developments, and have transparency about these issues. This data should feed into an ongoing (published and updated) spreadsheet so the city and citizens can track issues and manage solutions proactively, not continuing to wait until the system is broken and the public is "activated." This is part of an essential data collection process that should be used to inform whether "more" is "better," and if not, what other options are there.

B. We also want to see staff reports include possible alternatives and state which parts of the comp plan are being addressed AND NOT ADDRESSED by the proposal. Parking issues are the most obvious (see italicized note below) but there are others too.

For example, if an area on EI Camino is zoned for a 12 foot sidewalk and a developer wants just 6 in order to build more low income housing, the report should use the language of the comp

plan to clearly state that (for example) "this request satisfies state mandates on behalf ofx units of low income housing, because it adds x number of units to the projected requirement of X, but it also removes public enjoyment of the streetscape and creates pedestrian and bike safety problems at this stretch of x and at intersection x for a distance of x. It also c01)1plies with the state underparking allowance, but if all inhabitants have cars it would add x numbers of cars to the adjacent neighborhood streets. This problem could be solved by requesting the developer build the parking even though it is not required, or paying into a fund in perpetuity, administered by the city, such that all inhabitants are provided with taxi service on demand, in order to preserve safety and neighborhoods." This would mean that reports would clearly define which specific parts of the housing element or comprehensive plan are being violated or and which are supported by the proposal. (And not with shorthand that refers to an item buried in the comprehensive plan) As it is now, the reports take positions without defining surrounding impacts, what is being lost, and without offering other options that could be considered. We want staff reports to offer options that could be considered. Here is an example of problems we experience:

Below are just three examples of staff reports which are void of important development information. Factual information is missing and not in the public record [except in the case for formal, expensive citizen appeal of 260 S. California}.

Consequently, the public record is never clear about implications of these developments. Attached is one such staff report.

In these cases we want to highlight absence of important information that affects the California Avenue business community and adjacent neighborhoods.

Consider three projects to illustrate inadequacies in staff reports.

To the best of our knowledge these projects are completely "Iegal" and within the zoning requirements. However, public trust and council stewardship are issues beyond simple legalities.

Fact #1 All-day, unrestricted California Avenue commercial core parking capacity is acknowledged to be maxed out midday almost every day.

Fact #2 Consequently, there is obvious, increasing non­resident short-term and all-day parking on the residential streets adjacent to the commercial core.

Fact #3 These three projects significantly expand the number of square feet originally on these three sites. In each case the staff report states that required parking exceeds the on-site parking ... . silently and implicitly assuming that tenant and customer parking is available somewhere within the commercial core! If the staff can state that parking is and will be available, then the staff report should say so. But parking will not be available.

In our opinion the staff reports are legal, factually deficient and intellectually misleading because the City Council and the general public are not informed about the cumulative negative impact from future tenant parking in the California Avenue Commerical Core. In this case there is no mechanism such as the University A venue Dowtown Development Cap(UADDC) to set a limit on development. The UADDC is mathematically flawed, is based on outdated assumptions and ineffective; but, it has forewarned to the Council to be proactive to address the ever-increasing'imbalance between commercial parking space supply and demand. "

We see these improvements as vital to our future, and hope that you will use your power as members of the city council to create processes that align with the your own stated goals of open government, transparency, inclusion, data driven decision making, and completeness, that will offer residents confidence in the city council's decisions. We have confidence that you care about good governance, and hope that you see the value these changes would have in creating a city that serves residents as well as businesses.

I don't know whether reporting the incident happened with me ,3 years ago will help me or not, whether you are going to take any action or not. I am not sure? But right now I take the courage in expressing the truth, because I completed the punishment which I haven't done (Referring to case no: 111-CH-003483 in Santa Clara Superior Court) is between Plaintiff Mark Zuckerberg and Defendant Pradeep Manukonda)

Let me introduce myself I am Pradeep Manukonda and I am the defendant in the above said case Now if I say that I am been framed in the case. Nobody is not to believe me ,Now it's time to report this incident because the restraining order issue from Santa Clara Court has expired as on 13 Feb 2014 against me by Mark Zuckerberg Face book Founder.

If I said something about this incident in the tenure of my restraining order, people will say I am cooking up some story and nobody is going to believe, that some of the police officials (I am extremely sorry to say about your Dept) both at Palo Alto and Milpitas police help Mr Zuckerberg in filing the case against me because when I gone for the interview at Face book Office Headquarters at Palo Alto in 2010 Dec, I was asked about the Face book security Mechanism(Since I am security Analyst and a Certified hacker by profession) and when I say there is major setback in whole online Security Architecture and when there ask me to demonstrate physical, I accesses their physical Internal face book Networks and demonstrate how user profile information is been misused by users as well as face book Engineers helping them to

increase the user profile account ,in order to be number 1 social networking site in the world. At that point of time I was not aware the face book management is planning of IPO (Initial Public Offering/Stock market Launch)

Then there threatened me if I am going to listen what there are saying then there are going to put the charges for Hacking of their website and at some pOint face book internal and logistic security team headed my Todd Sheets said that he previous worked as law enforcement personnel and he has good connection in Police department and there can file a case against me very easily. At that time I was new to California and I was petrified the way there behaves. Todd said we are going to drop your charges if you are going to listen and do what we say, with no option left for me I was forced to write those letters in the Face book office and then there ask me to FedEx letter to Mr Zuckerberg. When I tried to report these incident with my previous employer their fired me instead of helping me and said don't try to contact us in any matter or we will do the same filing the same as face book Then i came to know how Face book Founder Mark Zuckerberg can influence the people with his social status and the money he has.

And When I came to know that these letter written by me was used against me to get the Temporary restraining order in Santa Clara Superior Court issued by Judge Socrates Manoukian and when the court summoned me appear on Feb 22 2011, Mark Zuckerberg Attorney Brian Hennessy from Perkins Coie along with two personnel's one is Todd Sheets and another person I don't know the name who is in uniform came to house (0 201 755 E Capitol Ave, Milpitas) Brian Hennessy stated that his firm is in top 100 List Law firm in the world and there have access to Judge Socrates Manuokian, and Santa Clara County Sheriff's Office and get the order at a instance and said you cannot contest Mark Zuckerberg or us in his court. No one was going to believe you that you had an Interview at Face book Headquarters Palo Alto and what happen between you and Mr Zuckerberg at that point of time. And forced me sign the stipulation papers at gun point. I signed the stipulation assuming that Judge will ask me whether I signed the stipulation with my will atmy trail, but this was never happen because the judge issued the Permanent Restraining order much before the schedule date of trail (Feb 22 2011)

At present I Filed a Complaint my case with Commission on Judicial Performance and similar I filed two lawsuits in India (In the District Court of Ranga Reddy, Hyderabad, Andhra Pradesh). Case No: as 122/2012 and as 700/2012

Alii am requesting you, if you can do anything in my case, please do the needy thing and help me exposing the nexus between Corporate Law Firm helping Mark Zuckerberg and influencing Judicial System and getting the biased order towards a particular class

To make a note of it, I am not sure but as per my knowledge two cases filed by Mark Zuckerberg as a plaintiff with the same Judge Socrates Peter Manoukian

As both the cases are in favor of Mark Zuckerberg ,I don't know whether these happen to be with Judge Socrates Manoukian Intentionally or coincidentally

By reporting my case or exploiting the situation of Judge Manoukian is not going to benefit me in neither way. Alii am anticipating is that people should be aware of these things are happening because of Corruption at very high level

If you take up case and threat this email as my hand written complaint, I am going to furnish the in details
