n the 25th of February 2011 I completed a 1 mile swim to raise money for

A-CET (African children’s education trust).I would like to say a big thank you to

everyone who supported me with my swim,I was very happy that so many family andfriends sponsored me and encouraged mewith their wonderful messages.

A-CET is a great charity thatworks with local organisations tosupport thousands of childrenwith long-term scholarships andalso supports the building ofschools in rural areas where NOFEES are charged.

Syedna and Kothar love outside praise. Praise and pictures with white

people make them most happy. Bohras keepshouting and crying Mola Mola but they arepushed back and they must follow dress code,ID card, and salaam.

I wonder if these Ambani, Advani, policecommissioner, Canadian Council, BJP MPPiyush Goyal, CM Shri Prithviraj Chavan, etc.begged for Deedar of Syedna or were theylobbied and encouraged for the photoopportunities? These political leaders recieveheavy contributions from Kothar. Billions ofKothar money is invested in Ambani and otherindustries. A friend who was a hotel managerin Oberoi Mumbai once told me that if was toattend thee shareholders’ special session inMumbai, he or she will find many Shahzadaspresent.

During 100th birthday celebration procession,only Bohras took part in processions andrallies, other Muslims and Hindus wereconspicuously absent.

The Qur’an says “Qulu wa ashrabu wa laTusrefoon” - eat and drink but do not becomeextravagant. The money spent on the 100thbirthday extravaganza could have fed manyhungry people around the world. Imams andDais are supposed to set examples. Noreligious leaders of Islam celebrate hisbirthday save last two Bohra Dais andAghakhani Imam. We never hear aboutbirthday celebration of any Muslim king orPresident. Celebration of Prophet Birthday isrecent, previously the day was celebrated asBara Wafat because Prophet died also on thesame day. We never celebrate Molana Ali’sbirthday with fanfare.

Anyway, the 100th birthday has proved to begreat money making endeavor ever. Now

without losing time, Syedna is on tour offoreign countries. Millions are being collectedin visiting countries in Europe and the USA.Bohras have gotten tired of giving, they aregiven Qarz-e-Hasna for Syedna’s salaam andexpenses.

Bhaisahebs and Amils are actually part of theKothar. They get 20% of whatever they collectin name of Syedna. Therefore, they cheer andexert Bohras in giving. However, theythemselves don’t give as if they do not needany Sawab or Sharaf. They internallyunderstand the actual truth that this is allabout money - religion, Imam Hussain’sMatam, Darees etc. are just tools for excitingBohras.

Once in discussions with Orange county AmilMiyasaheb Fakhruddin Barwaniwala told methat there was no Jannat. Yet in everyTashaud/Tahiyat he recited Jannata haqqun-Jannat is a truth. He was a big crook and amanipulator; yet he had lot of influence withShahzadas.Many religious leaders and charities refuse toaccept tainted money such as stolen orembezzled money or money earned fromharam trades. However, there is no moralcompass when it comes to Bohra. Syedna,Shahzadas, Bhaisahebs, Amilsahebs, orMullahs never refuse money whatever sourceit may have come from.

In 1940s the previous Dai, Molana TaherSaifuddin, used to go house to house, doqadam, and demand salaam. He came to myhouse in Dahod and demanded Rs. 300. Myfather said his monthly pay was paltry Rs. 50and he didn’t have any money. The Chamchasaround shouted “Aapo nahi to mola naraz thaijase” then Syedna left our house. My fathercried, my mother got frantic. She borrowed alittle from relatives, added her own saving,and went next-door where Syedna had goneand offered her Rs. 300. My father wasshocked, he died after sometime. Our family

had no money for his medical care. I was leftwithout a father and my mother waswidowed. No Syedna or Bhaisaheb ever cameand helped us from the Zakat money that they

collected. I feel my terrible childhood couldhave been eased if Syedna had given whatbelonged to orphans and widows.

During 1960s I was working in Fort area inMumbai and after office hours I used to go toBadri Mahel and watch the dramas going onthere. Many Bohras will beg while doingsalaam to Syedna crying their poverty andtroubles. They Syedna would say “Sabar KaroKhuda Aapse” I always wondered whySyedna and Bhaisahebs themselves do not doSabar, why do they demand more and more?

The same tactic of collection continues todayeven in USA. As a matter of Bohra core belief,Indian Dawat’s jurisdiction is limited to Hind,Sindh, and Yemen. Molatena Hurrat alMalika’s and the first Dai, Molana Zoeb’s,mandate was for these three areas only. In thepast, Dais did not perform Haj while on Gadi,because Hejaz was outside their mandatedarea. Claiming USA, Europe, and othercountries is overstepping in the territory ofsome other Dai, whom we do not know - hemay be in seclusion. It must be rememberedthat Fatimid Imams had sent many Dais indifferent parts of Middle East. Case in point,Sulemani Bohras who hold the same corebeliefs as Dawoodi Bohras, their Dai nevervisit countries outside Hind, Sindh, and Yemen.

No transparent accounts are available aboutincome and expenditure. Though DawatHadiya Trust USA is registered, there is noinformation about its auditors. TheCommission’s inquiry into Dawat-e-HadiyaUK, found impropriety and made thempayback £365,000 (see article on right,Dawat-e-Hadiya investigation)

Dawat E Hadiya investigationIntroduction

1. This report is a statement of the results ofan inquiry under Section 8 of the CharitiesAct 1993 ("the Act").

2. Dawat-e-Hadiyah Trust (United Kingdom)("the Charity") was registered as a charityon 2nd July 1986. Its stated objects are "tocarry out such purposes for the relief ofpoverty and the advancement of educationor religion or otherwise for the benefit ofmankind anywhere in the world as the Daial-Mutlaq shall from time to timedetermine." His Holiness Dr. SyednaMohammed Burhanuddin, is the fifty-secondincumbent in the office of the Dai al-Mutlaq.The Dai al-Mutlaq is the supreme head ofDawat-e-Hadiyah who promotes and fostersthe interests of the Dawoodi BohraCommunity. The Charity’s turnover is in theregion of £2M.

Issue 3In March 2001, the Commissionbecame concerned that the charityhad failed to submit the Charity’sannual returns and accounts since1995 despite a number of attemptsby the Commission to obtain thesedocuments.

Issue 4The 1996 annual accounts weresubmitted in March 2001 and the1997 annual accounts in June 2001.Review of these raised concernsabout the large number of paymentsto persons related to the soletrustee, the Dai al-Mutlaq, and theNominees. The Nominees areappointed by the Dai al-Mutlaq toadminister the affairs of the Charityas de facto trustees. There are sixNominees of whom four are the sonsof the Dai al-Mutlaq. As a result theCommission instituted an inquiryunder section 8 of the Act on the 4thJuly 2001 with the aims to: obtain upto date and accurate accounts andannual returns; determine theNominees reasons for not complyingwith their statutory obligations withregard to the submission of annualreturns and accounts; and investigatethe connected person payments.

Findings 5.A series of payments had been made by theCharity to persons related and connected tothe sole trustee, the Dai al-Mutlaq and theNominees.

6. Whilst the Charity provided full detailsand explanations for all connected personpayments, the Commission considered thatrestitution was necessary because thepayments had been made in breachof trust. This was because, in determiningwhether the payments should be made, thepersonal interests of the Nomineeswere in conflict with their fiduciaryduty as trustees of the Charity.

Outcomes 7The Nominees have given the Commissionfull co-operation throughout the course ofthe Inquiry. The Nominees accepted thatrestitution was required and without delaypaid back to the Charity some £365,000,which represented the vast majority of thesum requested. The Nominees made a casethat the remainder of the payments weremade in good faith in furtherance of theobjects of the Charity and that it wastherefore unnecessary to make restitution inrespect of these payments. The Commissionestablished that these payments did notconflict with the Nominees fiduciary dutiesand in view of this, restitution of theremaining amount was not required.

8. The accounts and annual returns for1998, 1999 and 2000 were submitted inMay 2002.The Nominees explained thataccounts had been delayed due toconcentrating all of their efforts on theextensive building project of the NortholtMosque complex.

9. Commission officers scrutinized theaccounts for 1998, 1999 and 2000 onreceipt to ensure that they comply with theStatement of Recommended Practice onAccounting and Reporting by Charities (the1995 SORP). The Nominees agreed that infuture the audited accounts of the Charitywould be submitted to the Commission onan annual basis in accordance with thestatutory requirements.

10. The Inquiry was closed on the 5thSeptember 2002.

Wider Lessons 11. Trustees of charities with an annual incomeor expenditure of over £10,000 are required,under Part VI of the Charities Act 1993, tosubmit their accounts, an annual report andan annual return to the Commission withinten months of the end of their financial year.Trustees of charities with an income of lessthan £10,000 are obliged to produceaccounts within this time scale, but are notrequired to send them to the Commission.

12. Persons who, without reasonableexcuse, persistently fail to comply with therequirements of the Charities Act 1993 tosupply accounts and annual returns may beguilty of a criminal offence and may onconviction be fined by the courts.

13. The Commission will investigate anycauses for concern that are identified duringits monitoring of a charity’s annual returnand accounts.

14. A charity is entitled to the objectivejudgement of its trustees, exercised solely inthe interests of the charity, and unaffectedby the prospect of any personal advantageto themselves. The law requires charitytrustees not to place themselves in aposition where their duty to the charitymight conflict with their own interests, thatis, where they may have an incentive toneglect their duties as trustees. Moreover, acharity trustee is not permitted to profitfrom that position (unless he or she isexpressly authorised to do so). A trusteewho benefits from a position of trustwithout the necessary authority is liable torepay the benefit which he or she hasreceived.

15. If a charity wishes to pay one of itstrustees, the organisation needs to establishwhether or not the charity’s governingdocument contains a power to do so. If thegoverning document does not contain apower to pay trustees, the trustees must firstapproach the Commission for authority.

n Udaipur’s local Bohra kabristan(graveyard) the holy

grave of Sheikh Ahmed AliRajnagarwala(one of the teacher ofHonorable Sayeedna MohmmedBurhanuddin Saheb) and theadjoining grave were trashed byunknown people. They not onlydestroyed the holy shrine but alsochallenged the sentiments of thebelievers especially the Dawoodibohra Jamaat (Bohra Youth).

This shameless incident happened on13th March 2011. On getting theinformation about this shameless acta large sum of people collected onthe spot. By watching the spot it canthe sensed that this act was doneintentionally to hurt the sentiment ofthe people as well as it interruptedthe religious harmony, integrity andpeace of this beautiful city. Thegraveyard is one of the oldest andconsists of thousands and thousandsof grave on which the person lifehistory is engraved in Urdu/Arabicscript. By this it can be said that theperson or a group of persons who didthis job may know their targets andwere good in Urdu/Arabic too. Innocent mistake turned into a horrible storyAZAD has received the email below,outlining a disturbing story of how aninnocent mistake turned into a horriblestory.

Baadus Salaame JameelGiven below is the story of the current bloodbaththat is taking place in Khambhat. The roots ofthis story goes back nearly two years ago.

Genesis: Two Years agoOn a lazy afternoon, in the by lanes of ourMohalla, near Masjid, a group of youngsters areplaying a game of gully cricket. As it normallyhappened, the batsmen hit the ball and it landedin the masjid compound. Seeing this all theyoungsters immediately split and ran away, sincethe khaadim of masjid, like always, was expectedto scream and shout.

On the coaxing of some of his friends, onemumin youngster gathered the courage to collectthe ball, and while he was attempting this, theKhaadim trapped and caught him. But, this wasno ordinary afternoon. And what was about tofollow was something more dastardly in nature.The Khaadim, who is always at the mercy ofJamaat Aayaan members, was in a mood toteach the trapped youngster a lesson of lifetime.

He started mercilessly thrashing the muminyoungster who was caught in his trap. In thehallowed grounds of our masjid, a karbala likesituation was unfolding. The Khaadim, out toimpress his masters, like shimar in Karbala, hadbeaten the youngster so badly, that the muminyoungster’s neck was broken. He screamed forhelp, but no one came. The beating continued.

The badly beaten body of this mumin youngsterwas lying in the compound and when his friendscame to see him, they found him unconscious.They picked him up and rushed him to hospital,where it was revealed that he has gone intocoma with multiple fractures. The son of a poorlocksmith, who was barely managing his livingmeans and whom the entire Khambhaat Jamaatknew was living hand to mouth, was left withhis only son in hospital with mounting bills. Theentire medical cost for recovery of this lad hasrun upto Rs 2.25 lakhs, which includes operationin Ahmedabad.

The friends of youngsters were not going to keepthings lying down. They forced the then JanaabAamil Saheb to call for a meeting of Jamaatmembers and with them most of the youngsterswere also present in the meeting. Two membersof Aayaanul Jamaat for whom the Khaadim wasa stooge and served them like their personalservant and assistant, were against the prospectof firing this khaadim and took offence to the

fact that the youngsters were objecting fora”very small issue”in their opinion.But the youngsters were extremely forceful andsaw to it that the Khaadim was fired. For thetwo Aayanul Jamaat members this was apersonal loss of face, and not adl. They were noteven concerned what happened to the poorlocksmith’s son.

The Follow Up:As it happens in a small town with any smalljamaat, where Mumineen’s children have studiedin madrassa, friendships happen. Much in thesame vein, the young members of jamaat, whichincluded boys and girls had also developedfriendship. In the age of mobiles and internet,friendships extend to such fora like facebook,orkut etc.

In the above cricket story, some of theseyoungsters were friends with the daughter of thesame Aayanul jamaat who were not in favour ofloosing their stooge, the Khaadim. With passageof time, he called upon his daughter to cut offthe friendship with these fellows. And as everyobedient child is expected to act, she did whatshe was told to do.

The youngsters; who were net savvy, and alsomembers of the Taheri Cultural Centre (TCC), anAqa Moula TUS approved youth centre, did whatmost youngsters would do in today’s time. Theyused the computers of TCC from where, theymade a new facebook profile and got in touchwith the lady.

They also found out ways and means to extracther new mobile number by accessing facebookfrom a mobile phone. This was to prove a costlymistake, which many children do, and anopportunity for the girl’s father to exact revengefor his two year old face loss.

The father having come to know what hastranspired, got his act together. He filed an FIRwith cybercrime unit in Anand and initiatedproceedings against the three youngsters.Additionally, using the stature of his position inthe jamaat, he started using the jamaat topressurize the youngsters, their family, theirfriends and even their friends families.

They have gone so far as to bring a halt to allTCC activities and are trying their best to get thisAqa Moula TUS approved centre’s closure,website included, for which there is a misaal.

The Current Situation:The two Aaayanul Jamaat members, through theJamaat office and using their influence in thesociety at large, have made the youngsters; inthe middle of their exams; faced with a dire

situation. The following threats have been madeto them, their friends and their families:1] The Police have informed that they will take a

bribe of Rupees Four Lakhs to take back the FIR.2] The Youngsters, their friends and families in

the middle of their exams are made to attend police stations and hearings.

3] The Jamaat have threatened them they should submit a written apology and during one of the upcoming miqaat majlis, they will have to publicly accept their mistake and apologise.

4] If they fail to do so all their razas will be stopped.

5] Raza from Aqa Moula will be stopped in toto.6] The whole matter will be reported in local

media in such a way that they will be publicly humiliated.

7] One of the Aayanul Jamaat*, has gone to the extent of saying that Khambhaat will be made into second Udaipur [Khambhat ne biju Udaipur banavi desu].

8] The two Aayan’s have boasted, “No one will be able to save you from us” [tamne koi hamara si bachavi saksay nahi].

As of today the written apology has been givento Janaab Aamil Saheb

A bribe of Rupees Two lakhs has also beencollected and given to police, who are stilldemanding the remaining amount of two lakhs.

Conclusion:In Tanbehul Ghafelin, Syedna Hatim RA quotesMoula Ali saying that, “If I were to see a mumincommitting a mistake, I will throw a”chaddar”onhim.” Which means that a mumin’s mistake isnot to be publicized and should be covered up,though, in privacy we should call them,reprimand them if need be, and help them to doa tauba and in turning them to be a new leaf.

So is the current action of the Aayanul Jamaatmembers of Khambhaat justified?

The late Saifuddin Marzban was a staunchreformist and President of DBWS for anumber of years. We will miss him and wishthat Allah grant them strength as they cometo terms with their loss. Below is a poemdedicated to his memory from his grand-daughter Sakina and her husband, Zafer.

The keeper of time has no longer need for time!

Oh, gone are the days that shone with his chimes

No more “Bring me a gadget, PC, or just a hammer”

But an empty, silent room; too small less his clamour

They say he lived a long life of cheer and challenge

His path criss-crossing great deeds and daring

An inventor, entrepreneur, doctor and engineer …

Surely a chum even Leonardo would endear

But this humble gentleman, one we proudly called

friend

Touched us with his rhyme on luckiest day to this

Arif successfully completed the ToughGuy Challenge on Sunday 30TH January.Tough Guy is the world’s safest, mostdangerous taste of mental and physicalpain, fear and endurance.

It is an event run only on the last Sundayin January in the West Midlands wherecontestants from all over the world cometogether to take on the challenge.Tough Guy is an 8 mile off road allterrain course that tests your fear ofheights, tight spaces, fire, water andelectricity.

A particular favourite as a spectator wasto see competitors on all fours tackle 50feet of razor sharp wire charged withelectricity. All this is before they'vesprinted through blazing flames andswam in sub zero icy water!

As a rule all contestants must sign adeath disclaimer before being allowed toenter the competition. There were St

Johns Ambulances parked everywhere toassist with emergencies, accidents andhypothermia.

This year there were over 5000 thrillseekers including ex Iraq/Afghanistansoldiers, army cadets and keen sportsmenwho hoped to make it to the finish lineof which only 3220 managed tocomplete. My brother finished 469THwith a time of 2 hrs 2 mins. The winnerwas a German guy whose time was 1hr11 mins.

Arif has already summited Kilimanjaro;night dived in the Red Sea, swam withsharks and parachuted out of an airplanefor charity and commented when backhome ‘nothing comes close to the uniqueexperience of Tough Guy.’

Despite having suffered fromhypothermia after the event he will betaking on Mount Elbrus next year.
