I would oppose altering (amending) the mural you describe -can you focus meon specifically where it is or if you can photo it for me, if you happen to bedown town.


Maybe this evening I could meet you down town for 10 mins so you can showme the art with the same specificity you describe in the letter.

You’re a smart person with an artist’s eye and you could assist me inunderstanding what in part- or in whole- that offends you, and possibly offendsothers or the standards unknown to me set out by the ADL.

Louis Brandeis -first Jew appointed to the Supreme Court ( think he was 28 atthe time) also active in formulating ideas for the creation of a Jewish State-served on the court from 1916-1939–( more a secular Jew in practice).

In any event, Brandeis one of the earliest and deepest thinkers on firstamendment jurisprudence, said something to this effect: the best answer to badspeech ( I might add, an offensive mural as an example ) is not censorship butmore speech or good speech. I believe Brandeis would roll over in his grave rehow often the fear of anti-semitism is raised by some Jews to censor legitimatespeech or even protected hate speech- focused on us as Jews, the state of Israel,etc. We are supposed to be people of the mind.

I suggest the better solution is for you to write a critique of the piece but don’tdestroy( amend) some or part of the artist’s piece. Again think of what brotherBrandeis said.

Also see another Jewish star’s thought on the first amendment: AnthonyLewis’s -Freedom For the thought that we hate. Or his seminal first amendmentread: Make No Law: The Sullivan Case and the First Amendment.

Mark, I believe you would be big time dishonoring Justice Brandeis and other1st amendment scholars-by destroying ( amending) some or part of this man’smural- particularly since you have much less destructive first amendmentoptions.

The artist replied, first thru a City staff member and then to me directly that he features diamondson many of his works, and it represents “hardness” or durability or sharpness, and does notrepresent a religion or ethnic group, or an attack on such.

“You Jews control all the money anyhow” he added, by phone, one of three calls to me, fouremails, two texts and three posts on my blog. “You’ve gotten reparations since the Holocaust andwe black people have not”.

What triggered my interest in the first place was that the mural seems to spell out a slogan that themost radical and violent wing of the Black Lives Matter movement espouse: ACAB. All Cops AreBastards. To some people’s understanding, people who say or write this advocate violence againstpolice, as compared to merely reforming police or ending violence against citizens and endingviolence against Blacks specifically.

The ADL — Anti-Defamation League — tracks “ACAB” as a trope used against Jews. The phraseseems to have originated in political and ethnic struggles among white Europeans. Prisoners andgang members sometimes have tattooed that say “1312” — “A” is a 1, “C” is a 3 — or a series ofdots on their knuckles, like the evil preacher Robert Mitchum spells “love” and “hate” in themovie TK, or Radio Raheem has it i “Do The Right Thing” by the Black maker Spike Lee.


I suggested to the painter that if he met me in person he would not have found me threatening orwould not have found my question, even posed indelicately, as an attack.

“No, I would have punched you in the neck” he said.

That he claims the diamond is not signifying Judaism but also claims that Jews control theeconomy makes me doubt that the ACAB was unintentional or that he does not believe violence isexpedient against the police. Malcolm X said “by any means necessary” (which we can appreciatehere as BAMN), while the artist — ironically enough named like a U.S. Founding Father — signshis work BAMR. What does the BAMR stand for?

Personally I believe that Black Lives Matter is an extension of the Civil Rights movement in theAmerica South in the 1960s as evidenced by leaders and makers like Martin Luther King, NinaSimone and James Baldwin. My rabbi, Sidney Axelrad z’l’ of Congregation Beth Am in Los AltosHills, marched with The Revered Doctor King in Mississippi. When I first heard about BLM (andnot, of course, to be confused with the Bureau of Land Management who sometimes clash withthe Western Shoshone) I read that their plank included criticism of Israe. And there are many,sadly, examples of conflict between Blacks and Jews — in our Haggadah we repeat each year thatbecause we were slaves in Egypt we strive to help the less fortunate.

Besides threatening to punch me, BAMR — his name is Demetris Washington of Sacramento, age29 said he hopes I fall upon something sharp.

His mural spells out ALL COPS ARE BASTARDS in the tip of the pyramid, the crescent moon,the tip of another pyramid and the overall shape of the mural. It forms a shield. Unlike the other15 murals that seek to create sympathy for the victims of police violence and arguably racial bias,this mural is pure praxis. It is self-similar in that it features pyramids like in Egypt and is mainly aset of hieroglyphics. (Coincidentally or not, a staff person wore a cap to the creation event thatfeatures three dots and a line and signifies her interest in the Black hip hop group, TheHieroglyphics).

I met our fire Chief Geo Blackshire and he said he did not believe the mural meant to say ACAB.He said he has family members who are police. I also discussed this with Mayor Adrian Fine, alsoJewish, and Battalion Chief Yarborough, who is Black.

Today I met a Black woman from San Francisco and Milpitas named Coco who told me herbrother is a cop and that she too is offended by our “B”. (She likes the other 15 and wantssomething similar on the building she owns).

I’m not sure what to make of the fact that Demetris also called me, by phone: a bitch and a“nigger”. He tried to insult and attack further my mother, my children (whether or not I have any)my bloodline. A man named M- tried to suggest that Black people speak in code and DemetrisWashington also known as “BAMR…the artist” actually loves me.

I’m not sure. But as a precaution I suggest we amend our mural to eliminate the diamond and crescent glyphs.

Protect the mural, sure. Black Lives Matter, absolutely. But let’s stay civil and not grant licensefor hate and threats.

Almost every weekend night my client's band played a keg party; cops would show upand tell the band to stop or they would confiscate their equipment (not the kegs hahathat came later when the parents were held accountable)...Which in turn caused themusic to cease and desist immediately...My point being; the RPF (Rebholtz-PaolinettiFamilias) were quite often using their parents' vehicles for the non-coincidentalstalking and harassment and menacing and vandalism they directed at my client'sresidence...

So just like the time when a Sunnyvale cop found Mark Chapman and John takingbong hits with some beer at the corner of Henderson and El Camino Real under thebig trees in the two parking spots directly underneath; they took them both home totheir parents and told their parents the low down about what we were keeping on thedown low...In other words; cops used to do their jobs back then -- apprehendingteenage suspects and hauling them back to their home compounds to get them intoBIG trouble...

Because parents can straighten out teens in ways that cops can't -- and perhaps copsused to know this...When parents find out about a secret teen life -- that secret teenlife is quite often over...Leading us directly to; if POS/DPS/SCPD had just spoken tothe RPF parents (they had numerous chances) saying something like "a neighborseems to think that he is being bothered by your children using your vehicles; so if thevarious alleged disturbances do not cease and desist we will have to considerimpounding your vehicles at a later date..."


Which would have immediately caused an appropriate knee-jerk response within theupper ranks of the RPF clan; officially putting on police record what had occurredafter informing various RPF parental units of their childrens' misdeeds they perhapsinadvertently supported and/or perhaps did not know about; therefore causing animmediate end to what ended up as a years-long police-sponsoredharassment/stalking/menacing/vandalism campaign (YLPSNCHSMVC) that almosttook my clients' life... Tooth infections in his upper jaw could have burst into his brainand killed him right when the YLPSNCHSMVC was occurring...

(It was police-sponsored largely due to: 1) An SCPD police officers' personal vehicle(Don Paolinetti) often being used for the various non-coincidental disturbances by hisson Jake Paolinetti; 2) Excessive police harassment of my client on the part ofPOS/SCPD/DPS for lesser things (a SWAT team for Santa Clara Mayor-approvedduck feeding; and another SWAT team for cleaning up litter in the neighborhood etcetc etc -- defaming my client's good name and reputation with these SWAT-teams-for-nothing) while criminal threats made by Mister Olenak and and early-morning assaultalong with an assault by Crazy Tom Foley who was a drunk felon on parole at thetime of the attack (etc etc etc) were totally ignored by POS/SCPD Officers Seagraveand Lopez; 3) After trying desperately for many years to get Sunnyvale POS/DPS tostop the non-coincidental harassment with no end to the night time disturbances ~ bydefault the police inherited the mess due to their foot dragging and gross negligence(in other words; people screaming what sounded like death threats in the middle ofthe night right outside my client's window as he slept -- many times over and overwithout end right after an ambush in July 2007 that occurred right after my clientrequested a public hearing regarding (among other things) Pablo Lopez rubbing hisgenitals up against my client's leg "all sweaty" during his wrongful and falsearrest/kidnapping; which is the same thing Officer Pablo did to John's friend EggyG)...

Therefore; my client am not going away until fully compensated for all of this police-sponsored bullshit from HELL...He would make a better cop than any of your jokers inclown suits and this is obviously apparent; but since you don't have high qualitystreet-smart individuals like me running your ship; you're pretty much fucked...

No knock warrants have already been banned in Oregon and Florida.

Dear Palo Alto Human Relations Commission,

The supreme court found in many cases no knock warrants can violate the 4thamendment. In many cases police also fail to knock and announce with sufficienttime for the resident to answer the door resulting in a regular warrant being illegallyconverted to a no knock warrant.

Breonna Taylor, who had never been convicted of a crime was killed by police duringa no knock warrant, which did not meet the requirements as stated by the supremecourt and was thus illegal.

The SWAT team showed the warrant and thenentered searched his house and confiscated his computer (which they only reluctantlyreturned 9 months later). Turns out my neighbor had allowed one of his neighbors toshare his internet connection and unfortunately the middle school child of that otherneighbor had sent the threatening email to Greene Middle School. Despite gooddetective work, PAPD SWAT still got the wrong house and had they gone in with aflashbang the family would have been traumatized. Questions: Why is everyone so worried about Roger Stone's sentence being commuted when CaliforniaGovernor Gavin Newsom is letting 8,000 inmates out of prison over the next few months due to the Covidvirus? Which in a very large sense applies the latest liberal trend of being soft on criminals to savemoney; much like the RPF who were allowed to flee without recourse after their years-long illegal siegeon my clients' residence...With zero substantive; legally-required relevant evidence allowed by my clientin Manoukian's infamously notorious crooked courtroom...Isn't it a form of reverse class-baseddiscrimination to only let poor non-violent criminals out of prison and not relatively rich non-violentindividuals like Roger Stone simply for the purposes of political revenge?
