sealed envelope for upcoming Bharat Darshan Tourist train NZBD 228A, BAIDYANATH GANGASAGAR YATRA FROM 28.09.2018 to 05.10.2018 FOR THE DURATION OF 08 DAYS. EX JALANDHAR CITY RAILWAY STATION for providing the backend services in train tour Package to be operated for the domestic clientele. Composition of train will be 12 Sleeper class coaches (GSCN) + 2 Luggage cars (SLR) + 1 Pantry car (WCB) = 15 Coaches.

The period of Contract is initially for one trip as per the attached itinerary.

Total number of passengers in the full capacity of train will be ordinarily 804.

SCOPE OF WORK

1) Catering: Indian vegetarian Meal for onboard / off board during the duration of the package as specified in the itinerary. The standard menu for the meals to be followed is as under-

a) Morning Tea/Coffee (with & without sugar)

b) BREAKFAST – * Tea / coffee (with & without sugar) with Cutlet and 02 pieces of bread with butter or Upama with Sambhar and 02 pieces of Idli or Mendu Vada or Chole Bhature (02 pieces) or Payaj Kachori with Chatni or Poha with namkeen

c) LUNCH / DINNER- (Quantity unlimited)* Seasonal Vegetable/Paneer dish Dal Fry/ Kadhi Pakora Roti/ Paratha/Poori Rice/Pulao/Khichdi Papad (must be given once during the day) Anchar (branded only) Sweat must be given during dinner. Sabudana Khichdi with 2 pc banana for fasting passengers.

d) Evening tea (with & without sugar) with biscuits (Must for on board)

e) In case if there is full day train journey, butter milk/cold beverages (in summers) and soup/additional tea coffee (in winters) should be served in train.

f) Onboard meals and packed food will be provided in good quality disposable aluminum plates. No plastic plates/cups etc are permitted.

g) Repetition of dishes in two consecutive meals to be avoided. More than 60% of total number of meals (Lunch & Dinner) includes a green vegetable.

(*Per day Menu will be decided before the commencement of the tour)

2) Drinking water: Provision must be made for sufficient purified (RO) drinking water by keeping 20 liter water jars of FSSAI approved manufacturers for all the tourists at the time of meals and also as per the demand during the course of journey. Cold water must be provided in summer season. Service of water pouches is banned.

3) Road Transport: a) Good quality Non Air Conditioned coach (Bus) on seat in coach basis must be provided, irrespective of the

time of arrival and departure of the train at the destination for sightseeing and transfers. b) In case if buses are not available/ feasible at any specific place in the itinerary than alternative adequate

arrangement may be done only by pre intimation to IRCTC in coordination with IRCTC Tour Manager. c) For the children aged between 5 to 12 years, full seats should be provided. d) One pilot car should also be arranged for coordination at the destination.

4) Accommodation: Providing very clean and hygienic Non AC budget hotels/ Dharamshala / dormitory accommodation at the places of night halt or wash and change/fresh-up on sharing basis with sufficient number of bathrooms and toilets facility.

5) Housekeeping: 06 housekeeping staff (one staff for every two coaches) must be deputed with provision of sufficient cleaning material and instruments for the cleaning of train coaches (compartments and toilets) on regular interval.

6) Train Security: Unarmed security staff (one in each passenger coach) must be deputed in train during the course of journey to ensure the safety of tourists and their belongings. The security guard shall be responsible for the following -

a) To ensure non entry of unauthorized persons in the coach. b) To guard the coaches containing the tourist’s luggage, etc while stationed on platforms, yard and on

the run etc. c) Night patrolling.

7) Tour Escort: one educated tour escort (Hindi speaking/Regional languages) with each bus/coach for taking care of the passengers. He will ensure the following –

a) Cleanliness of the coaches/toilets. b) Providing relevant information/instruction to tourists about the tour & visiting places. c) Knowledge on first aid. d) Carriage watering at en-route stations. e) Interacting with Railway ticket checking staff. f) Ensuring the boarding and de-boarding of passengers in train and respective buses. g) All other relevant information to the tourists.

8) Souvenir: One single fold 25” inches gents & ladies umbrella with IRCTC branding (Printed Logo) will be provided to every booked passenger. A sample of umbrella is required to be approved by IRCTC prior to the procurement to ensure the specification, design, quality & branding of IRCTC.

9) Miscellaneous:

a) P.A. System: Public addressing system with battery backup should be provided with one operator.

b) Coach stickers: Adequate no of coach indication stickers and train name board, indicating both in English and Hindi, shall be placed on the coaches for information of passengers.

c) ID card: Good quality printed ID cards with carry pouches and printed ribbon shall be provided by the tenderer and shall be distributed to every passenger. Name and photos will be attested by IRCTC nominated officials at the time of commencement of tour. The identity cards are primarily to identify the staff on duty to facilitate the tourists on the tour.

d) Uniform: All the tour escorts, security staff and catering staff should be in uniform. Uniform will be prescribed by IRCTC and service provider should supply the same to the service staff.

e) Train Manager: Service provider shall depute one responsible and experienced train manger who will be responsible as over all in charge for onboard and off-board services.

f) First aid kit: Basic medicine and first aid kit with semi skilled staff shall be arranged during the course of tour.

TERMS & CONDITIONS

01. Selection of back end service provider will be based on competitive bidding (Financial Bid) among the Empanelled applicants for the above segment.

02. Services for which rates are required are mentioned in the scope of work and same is the part of terms and conditions.

03. License to manage the backend services of Bharat Darshan Tourist train will be awarded to the applicant quoting the lowest amount towards backend services PER PERSON FOR ENTIRE TOUR PACKAGE including all taxes.

04. Amount of GST should also be mentioned separately. Further increase/decrease in GST if any by the Government of India during the contract period shall not be applied to the quoted backend rates.

05. The quote will be based on per person for entire tour itinerary and remain similar for every booked tourists irrespective of their different boarding/de-boarding stations or the differences in departure and arrival time/date of train on journey starting stations.

06. As the package cost is fixed, IRCTC may negotiate with the successful back end service provider for reduction in the quote in order to ensure a minimum IRCTC margin for the operational feasibility of the tour on a case to case basis.

07. In case of late running of train during the return journey resulting, the late arrival at the origin place, service provider is bound to provide the catering and other onboard services to the tourists. The charges for the onboard services beyond the schedule itinerary will be borne by service provider till one additional day in the total duration of itinerary. However in case if arrival of the train delayed for more than one day beyond the total duration of itinerary from the actual departure of the train, than service provider may claim for catering charges beyond one day based on actual service and number of passengers availing the services. The rates for claiming additional catering services will be as under-

08. The backend service provider must also ensure proper services to the tourist during contingencies such as

accidents/derailments/late running of trains/unforeseen situation at the destination etc leading to the arrangement of additional services such as stay, wash & change, arrangement of transport etc if necessary. Since such conditions may arise occasionally hence IRCTC may take a view on the authenticity of additional services delivered due to the above exigencies over and above the listed services. A compensatory amount per person as detailed below may be payable to service provider for additional services-

09. Duration of the contract is from 28.09.2018 to 05.10.2018 However the contract period may preponed /postponed in case of changes occurred in the tour dates due to operational reasons of IRCTC/Railway. Quoted rates will be valid and applied if the date of commencement of tour is within the period of six months from the date of offer.

10. Total number of passengers in the train will ordinarily be 804.

11. Payment will made to the tenderer for actual number of travelling passengers as certified by IRCTC Tour Manager.

12. The quotes will be accepted purely on the basis of quality, price and service.

13. The Administration does not bind itself to accept the lowest or any quote or to assign any reason for rejection of any or all the quotes.

14. As per the Railway Board order, the composition of the Bharat Darshan rake is subject to increase by addition of SL / 3AC coaches.

15. The Bharat Darshan tour circuit mentioned in this tender document is only indicative. The final circuit/route of train shall depend upon the approval of Train routing by Railway Authorities and same will be as per the train order issued by Railways before the commencement of journey. All backend services including on-board and off-board has to be provided as per the final train schedule issued by Railways. However number of days in the total itinerary shall be counted from the date of actual date of departure.

16. In few cases due to operational constraints, one or two halt destinations may change by Railway/IRCTC before the commencement of tour, to which the service provider is to adhere to at the same rates quoted for the specific circuit within the same duration of tour.

17. The catering services on train should be done in the individual coaches/berths and at the accommodation/sightseeing locations, it can be buffet type /packed food or other convenient mode must be disposable.

18. All catering staff including kitchen and serving staff should use hand gloves, mask and cap.

19. List of staff dully signed and stamped on letter head should be submitted to IRCTC office at least 48 hours prior to departure.

20. All the staff should carry the medical certificate issued by Railway hospital along with police verification and photo ID card issued by service provider.

21. The backend service provider must also ensure collection and disposal of garbage.

22. The backend service provider will ensure that the Pantry Car of North Zone Bharat Darshan Special Tourist Train is managed by Trained Staff. The backend service provider shall also be required to follow the instructions relating to hygiene, quality parameters for kitchen, PFA, food handling, cleanliness, packaging etc. service provider should take requisite food license from Railway Authorities and all food handling staff should be medically certified as per Railway norms from time to time.

23. Service provider will arrange trucks/road vehicles to transport food to serve the tourists if the trains are moved away from the nominated railway stations to other stations for BPC, stabling due to non availability of platforms/in the yard .

24. Service provider may also arrange the discourse on special interests by appointing persons with knowledge of mythology/philosophy and also on tourism during the course of train travel.

25. In case if a registered medical doctor accompanying the train for medical services deputed by Service provider/IRCTC, arrangement of onboard services and separate accommodation for him should be done by service provider without any additional cost.

26. Staff of service provider will assist the tourists for providing Packaged Drinking Water and other pad items on MRP other than the usual provided in the cost of the package as per the demand on the in coordination and permission of IRCTC staff accompanying the trip in contingencies.

27. Service provider will bear the cost, throughout the term of the contract, for a comprehensive general liability insurance covering injury to or death of any staff(s) occurring in the said premises, including death or injury caused by the negligence of the Service Provider or the Service Provider’s failure to perform its obligation under the agreement. IRCTC will not be held responsible for any payment of compensation in this regard.

28. Inspection by Food/Health Inspectors – The service Provider will also be obligated to get his premises inspected by food/health inspectors at regular intervals in addition to having a food license from concerned state authorities. The Service Provider will make available the premises for the inspection by the IRCTC or any person so authorized by the IRCTC at any time.

29. The Service Provider shall be solely responsible for compliance with applicable laws such as GST Law, Provident Fund law, Labour Law or any other law of the land and registration/approval from statutory authority, and license under FSSAI etc if required.

30. All food ingredients being used for preparation/ service to the passengers shall bear FSSAI license number, as defined in the FSSAI act. IRCTC may define the brand/source of food ingredients and IRCTC instructions shall be binding.

31. The storage, handling of raw materials and finished products will be in extreme hygienic conditions and as per acceptable norms of the industry. Such storage, handling of raw materials and finish products certified as per

norms of the industry and its standards. The scrutiny in this regard by quality checks agencies standards to be set by IRCTC need to be followed. Food articles should not be kept on floor of the coach.

32. IRCTC reserves the right to get food samples/raw materials collect and tested at approved laboratories at the cost of the Service Provider.

33. Service Provider will ensure day to day upkeep and cleanliness of equipment including pantry car. The service Provider shall be responsible for all damages caused to the said pantry car and the equipment provided there in arising out of facts of omission and commission of their staff.

34. Service provider shall ensure that utensils, crockery etc. are washed and cleaned with clean water and standard quality detergent/soaps. Recycling dirty water for cleaning shall not be allowed. Service Provider shall not be allowed to wash utensils/services wares in coaches; washing should be done in pantry car only.

35. The backend service provider must also ensure for the safest and secured mode (Road/Water/Air) of travelling and reaching the destination mentioned in the itinerary clearly indicated to the individual passengers along with experienced staff/escorts/tour manager.

36. The backend service provider will also ensure that the Accommodation and transportation used for the passengers of Bharat Darshan should be authorized by Central/ State Govt. or local administration and the drivers of the vehicle should have a valid license to drive.

37. The backend service provider will also ensure and assist in placement of Bharat Darshan Rake at the respective destinations for onward journeys by coordinating with the respective Station Superintendent/ Master/ Shunting staff etc.

38. Berths in the pantry car will be provided as per availability for catering staff. All other amenities, men and materials required for catering has to be arranged by the service provider.

39. Two berths in each coach will be made available, i.e. one for the tour escort and one for security.

40. SLR: Sitting Portion of each SLR for 10 seats (Total 20 Seats) will be made available for use of service provider staff finalized for back end services. Luggage Portion, of one SLR (only one luggage compartment ie 5 ton) will be made available for storing the articles of service provider. However, if the additional luggage portion of the SLR is required for the back end services, it shall be charged and should be paid by the back end service provider at existing luggage rates for the entire journey or otherwise it will be kept in locked/ sealed condition.

41. The back end service provider shall ensure that no alcoholic drinks are consumed and no objectionable/prohibited material, weapons and firearms are carried on the tourist train.

42. In case of medical emergencies, including death, to the tourists while on tour, the service provider shall take immediate steps to render treatment/other services in consultation with the immediate relatives of the tourist, either accompanying or not, and the IRCTC Tour Manager and the cost of such services rendered shall be borne by the tourist.

43. The back end service provider shall provide complaint free service to the tourists of Bharat Darshan Special Tourist Train. The back end service provider should carry a Complaint & Suggestion Book and any compliant and suggestion received by the tourist must be forwarded to IRCTC.

44. The IRCTC official on the train will distribute and collect the printed format of feedback forms from the tourists on the performance of the tour. The grading in the tour will be a bench mark for rating the backend services and adverse comments will attract fine and repeated complaints will also be a tool for termination of the contract.

45. IRCTC & Indian Railways will have no contractual relationship/liability for the deficiency in services if any on account of back end service provider on the Bharat Darshan Special Tourist Train. The back end service provider will be liable for any deficiency of service under the Consumer Protection Laws. If any litigation arises due to deficiency of service provider, then service provider shall reimburse to IRCTC the whole cost of defending the case as well as the cost imposed, if any.

46. The back end service provider will indemnify the Railways/IRCTC for any loss or damage caused to railway property/administration/IRCTC/any of the passengers by any act or omission/ for any deficiency in services on his part or on the part of his Managers/Supervisors/ staff.

47. Execution of agreement - The successful Bidder shall be required to execute an agreement on non-judicial stamp paper of Rs.100/- at his cost before start of work. Till then the letter of award to the service provider shall form the binding agreement between IRCTC and the service provider.

48. IRCTC will not be liable for any liability arising under the labour laws or any other law of the land, incurred by the Service provider.

49. The successful service provider for providing back end services shall be required to give one time Bank Guarantee of Rs. 10 lakh to IRCTC valid for a period of one year against any damage/loss caused to Indian Railway/ IRCTC property/ any of the passengers or for any deficiency in services by the service provider or his staff etc. against all the tours operated by the Service Provider within the validity of Bank Guarantee. Bank Guarantee should be drawn from a scheduled bank.

50. In addition the back end service provider is required to deposit with IRCTC an amount of 5% of contract value not exceeding Rs.10 Lakh as Security Deposit. The Security Deposit will be refunded without interest by IRCTC at the time of peaceful / successful completion of license period as back end service provider of the Bharat Darshan Tourist Train after providing for settlement of all dues or arrears arising out of the use of rake/railway premises by the service provider.

51. The liability of Indian Railways as carrier will be limited to and governed by the Railway Act 1989 and rules made there under.

52. In case of request from the tourists for upgraded accommodation or otherwise any changes in hotels/road transfers, before departure or in the course of the tour, approval of IRCTC must be obtained or policy of IRCTC in this regard from time to time must be followed.

53. Service provider shall ensure to fulfill the legal procedure of Govt of Nepal, Bhutan and other restricted areas within India during the sightseeing of these places as per itinerary.

54. Termination clause

a) In the event of unsatisfactory service, poor quality of articles, persistent complaints from passengers, and

services below the standard or any failure or default at any time on the part of the service provider to carry

out the terms and provisions of the agreement to the satisfaction of the IRCTC (who will be sole judge and

whose decision shall be final) it shall be optional to the IRCTC to make any substitute arrangement it may

deem necessary at the cost and risk of the service provider or to forthwith terminate this agreement

without any previous notice to the service provider and in case of such termination the security deposit and

bank guarantee will be forfeited by the IRCTC and the service provider shall have no claim what so ever

against IRCTC or any of the officials in consequence of such termination of the agreement. No refund of

proportionate service provider fee shall be admissible in case of termination under this clause. The service

provider agrees to make good all cost and expenses, if any incurred by the IRCTC for making the substitute

arrangements referred to above. The service provider shall be also be debarred from participating in the

future projects of IRCTC for a period of one year

b) Either party can terminate the contract by giving one month’s written notice to the other without assigning

any reasons and without payment of any compensation, thereof. However IRCTC shall give only a 24 hours

notice for termination of the contract to the service provider when there is a major default in the

compliance of the terms and conditions of the contract or the service provider has failed to comply with its

statuary obligations. In that eventuality the service provider will move out of the premises of

IRCTC/Railways with his men and material immediately. This discretion of termination of this contract by

IRCTC will be exercised judiciously since the service provider is rendering essential and public utility

services.

c) In case of any event of default, it shall be lawful for the IRCTC any time thereafter to terminate the Service

provider agreement and forfeit the Security Deposit, SUBJECT HOWEVER to the IRCTC having given to the

Service provider fifteen (15) days prior notice in writing to remedy or make good such breach and in spite

of such notice the service provider having failed to remedy the breach. The License shall also be debarred

from participating in the future projects of IRCTC for a period of one year.

55. Penalty: In case of complaints regarding standard of services, behavior of staff, irregularities, negligence or loss

due to an action of the service provider resulting in loss of IRCTC, IRCTC will take immediate action by way of

fining upto 10 % of the contract value and/or termination or abeyance of empanelment depending upon the

severity of lapses/complaints, to be decided by competent authority of the Zone and/or in addition

disallowance the cost of services for deficiency of service on part of service provider.

56. The backend service provider will not be permitted by IRCTC to opt-out before the completion of the tenure of

the license period. However, in case of any change in the scheme by the Railway Administration, IRCTC shall

consider the case of refund of any amount on merit.

57. Notice to/by the Service provider - Any notice to be served on service provider’s shall be deemed to be sufficiently served if delivered at or sent by registered post/courier addressed to the service provider at their registered office or last known place of business. Any notice to be served by the Service provider on IRCTC shall be deemed to be sufficiently served if, left at the office/sent by registered post/courier addressed to the Group General Manager, Indian Railway Catering and Tourism Corporation at its Zonal office. 58. IRCTC will enter into an agreement only with the service provider who will be responsible for fulfillment of all service provider conditions with IRCTC. The IRCTC shall not enter into any agreement or deal with in any manner with any of the sub-service providers.

59. Force Majeure: IRCTC shall not be labile to the service provider in respect of any breach of the terms and conditions due to any event or circumstances beyond its reasonable control.

60. Arbitration: In the event of any dispute or difference arising under these conditions of the contract or in connection with this contract (except as to any matters, the decision of which is specifically provided for by these conditions) the same will be resolved by Arbitration, as per the provisions of ‘The Arbitration and Conciliation Act – 1996.’ The venue of the Arbitration Shall be Chennai. All questions, disputes and or differences arising under or in connection with this agreement or in touching or relating to or concerning the services, shall be referred to the sole adjudication of the officer/officers or persons nominated by the Chairman & Managing Director/IRCTC, whose decision in this regard shall be final.

61. Payment Conditions- (a) IRCTC will not make any advance payment to the service provider. (b) The backend service provider will raise bills to IRCTC on successful completion of each tour. Payment to the

service provider will be made after the receipt of the bills through NEFT/RTGS/E-Banking subject to the bills/invoice being in order.

(c) The Bill should be submitted in duplicate. The bill should contain details of GST No. of the firm duly printed on the bill.

(d) In cases of no-show, service provider is not eligible to claim backend charge for non turn-up tourists. (e) TDS as applicable will be deducted from the claim. (f) IRCTC may ask to produce the proof of remittance of GST element to respective tax authority by service

provider for releasing the GST amount in the bill.

62. Litigation & Compensation: In case of litigation & compensation arising out of bad services provided by service provider, IRCTC will be responsible for defending the same. However the cost of litigation and compensation will be borne by the service provider. In case of failure to do so IRCTC shall utilize the security deposit and bank guarantee for same.

63. Jurisdiction for litigation, if any, shall be the Court of Law situated at New Delhi. ******************

IMPORTANT NOTES:
