On the basis of site inspection of above cited project on 23rd January, 2015, point wise discussion with project executing authorities and subsequent information submitted so far, a comprehensive monitoring report is being submitted to Ministry for further necessary action and following comments and observations are forwarded to you for necessary action at your end. Accordingly, information and 'action taken report' on the following points may be submitted to this office urgently:­

The 'Consent to Establish' may be obtained under Air & Water Acts from the PSPCB and a copy may be sent immediately. Ensure 'Consent to Operate' under Air & Water Acts before starting possession of flats in the residential complex. Latest physical and financial progress about CSR activities may be informed. Uploading of six monthly progress report and monitoring reports on the web site of the Company may be ensured. Submit completion schedule of the project and total expenditure figures on construction as well as on Environment Management Plans. Submit the information about no. of workers employed and the funds spent on medicines and medical help to the workers during construction phase,ti11 date. Inform tentative schedule for installing the Solar system for common lighting and water heating. Inform the schedule for completing the Rainwater harvesting measures and submit the cleaning schedule for the same. Submit total quantity of fly ash utilized so far in the construction of the building. Proper functioning of Dual Plumbing line may be ensured to utilize the treated water for toilet flushing. UV system may be ensured with the STP. The efficiency of STP should be certified through established certified agency and a certificate should be submitted to this office in due course of time. Ambient Air Quality, Soil quality, ground water quality and Noise levels near DG sets should be monitored by some approved lab and the results should be submitted to this office from time to time. This monitoring will continue even during the operational phase of the project.

The total plot area of the proposed project is 33873.39 sqm having built up area of 37885.02 sqm. Change of Land use is not required as the site falls in M.e limits of Zirakpur. Layout plan of the project has been approved by M.e Zirakpur. The total water requirement for the project will be 219 KLD, out of which 162 KLD will be met from groundwater by installing tubewell and remaining 57 KLD will be met by recycling of treated wastewater. The total wastewater generation from the proposed project will be about 176 KLD, which will be treated in a STP within project premises. The project proponent has proposed to use 57 KLD of treated wastewater for flushing purpose, 28 KLD will be used for irrigation of green area and remaining 91 KLD will be discharged to public sewer in summer season. In winter season, 57 kid of treated wastewater will be used for flushing purpose, 8 kid will be used irrigation of green area and remaining 111 kid will be discharged to public sewer. In rainy season, 57 kid of treated waste water will be used for flushing purpose and remaining 119 kid of treated waste water will be discharged to Public sewer. The M.e, Zirakpur has issued NOe for giving sewerage connection from main sewer of M.e Zirakpur for discharQe of treated water after deposition of

applicable connection charges and other requisite charges. Green belt will be developed in an area of 5107 sq. meters which will be irrigated with treated wastewater. The run-off from the roof top will be recharged into groundwater after providing necessary pre-treatment and rainwater harvesting wells will be provided for recharging of rainwater into ground water. The total quantity of solid waste generation will be 650 kg/day, which will be segregated at source as biodegradable and non­biodegradable components as per the MSW(M & H) Rules, 2000. The organic/inert waste would be sent to the approved site.The recyclable waste will be sold to recyclers. The M.C, Zirakpur has issued C:l letter to the effect that the solid waste generated will be taken care by MC, Zirakpur. The hazardous waste shall be collected, stored and disposed off only in authorized facilities. The e-waste will be handled and managed as per E-Waste (Management & Handling) Rules, 2011.The used oil from D.G sets will be stored in an isolated place and would be sold out to the approved recyclers as per the provisions of HW(M, H & T) Rules, 2008. Total load of electricity required for proposed project, will be 1850 KW which will be supplied by PSPCL. The project proponent has proposed to provide DG sets as standby arrangement of power supply and same will be provided with acoustic enclosures. During construction phase, RS.29.50 lacs will be incurred for implementation of EMP and Rs. 13.00 lacs/annum will be incurred on account of recurring charges. It is clarified that the built up area of the project was less than 20,000 sq. meters in 2011. Hence, after obtaining all the required approvals, the project construction work was started in March, 2011. Later on more area was added and the built up area was enhanced to 37885.02 sq. meters. At that time the EC was obtained from the SEIAA, Punjab. The fact was brought to the notice of SEIAA, Punjab. On the instructions of SEIAA, Punjab, the construction work was stopped at the project site and the construction work was started only after getting the EC. The EC was granted in September, 2014 and the construction work at site was restarted in October, 2014. There is following progress on different components:­

The compliance of different conditions is given below:­

(A) Specific Conditions: 1. Construction Phase

(i) "Consent to Establish" shall be obtained from Under compliance Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the start of any construction work at site.

The "Consent to Establish" from PSPCB has been applied and the copy of application is submitted. The PA has been asked to pursue the matter and obtain the Consent to Establish on immediate basis.

(ii) All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

Being complied

There are about 40 labourers at the project site at the moment for construction work. It is gathered that the contractor has been made responsible to provide all sanitary and hygienic conditions to the workers during construction phase. Following measures have been taken by the contractor for implementation of the condition:­

~ To provide adequate number of toilets (at least one for every 25 labourers) with proper septic tank, vent pipe connector and soak pit for the construction labourers separate for male and females.

~ To ensure proper disposal of sewage so that sanitary conditions are maintained. ~ To ensure proper water sprinkler system on the construction sites to suppress

dust during handling of excavated soil.

(iii) A First Aid Room will be provided in the project Being complied both during construction and operation of the project.

The First Aid facilities have been provided at the construction site during construction phase to take care of minor medical treatments. The PA has been asked to intimate the expenditure done on providing medicines to the workers.

(iv) All the topsoil excavated during construction activities should be stored for use in horticulturellandscape development within the project site.

Being complied

There are no basements. But 10000 cubic meter of muck has been made available from the foundations. That muck was filled up in low lying areas and used for landscaping.

(v) Disposal of muck including excavated material during construction phase should not create any adverse effects on the neighboring communities and disposed off taking the necessary precautions for general safety and health aspects.

Being complied

It is confirmed that all the practical possible precautions are being followed in the whole construction work to ensure that there is no nuisance to neighboring communities during the disposal of muck excavated from the foundations.

(vi) Construction spoils including bituminous material and other hazardous materials must not be allowed to contaminate watercourses and the dump siteSi for such material must be secured 60

that they should not leach into the ground water.

Being complied

It is observed that the project authorities have taken all possible precautions to prevent water contamination during the handling of hazardous material including bituminous material during construction period. Following steps are worth mentioning:­

>- To ensure entire construction planning in such a way that there is minimum generation of construction waste like concrete, mortars and cemp.nt gOllts

>- To ensure reuse of construction material as far as possible. >- To ensure the removal of construction solids from the site as frequent as

possible. >- To establish litter disposal and collection points around all construction sites. >- To ensure proper measures to check any runoff from spoil piles. ~ To ensure transportation of construction spoils to officially designated dump sites

after obtaining necessary permission from relevant authorities.

Use of diesel generator sets during Being complied construction phase should be enclosed type and should conform to E(P)A Rules prescribed for air and noise emission standards.

(vii)

It is informed that one DG set of 62.5 kva capacity is installed during construction phase for power back up which is provided with acoustic enclosure. Diesel to the tune of 400 litres remain in store. Hence, the license from Chief Controller of Explosive is not required at the moment.

(viii) Vehicles hired for bringing construction material to the site should be in good condition and should conform to applicable air and noise emission standards and should be operated only during non-peak hours.

Being complied

It is confirmed by the PA that all the trucks are checked for their 'Pollution under Check' Certificates before entering into project construction area. The PA has been asked to submit the copies of few of the PUC's for our record.

(ix) Ambient noise levels should conform to Being complied residential standards both during day and night. The ambient air and noise quality should be closely monitored during construction phase.

The contractor has been instructed to keep all the construction activities in controlled manner to keep the ambient noise levels within residential standards during day and night time. It is confirmed that there is no complaint from any person in surroundings about high noise levels during construction period. Following measures have been taken by the contractor:­

~ To keep maximum physical separation between noise generators and noise receptors.

~ To maintain silencers and mufflers on construction equipments to keep the ambient noise levels within the prescribed standards.

~ To ensure that all powered mechanical equipments being used in the works should be of the most modern techniques available. The ambient noise levels have been monitored by the project authority

through some approved lab namely Industrial Testing Laboratory & Consulting House, Patiala in May, 2014 indicating all the results within permissible limits of PSPCB.

(x) Fly ash should be used as building material in the colistt'Uctloh as per tne provIsions ot l-ly Ash Notification of September, 1999 and amended as on August, 2003 (The above condition is applicable only if the project is within 100 km of Thermal Power Station).

Being complied

As the Ready Mixed Concrete is used during construction, the fly ash from 15 to 20% is being used in the ready mixed concrete.

Ready mixed concrete must be used in building Being complied construction.

(xii) Water demand during construction should be Being complied reduced by use of pre-mixed concrete, curing agents and other best practices referred.

It is confirmed by PA that ready mixed concrete and curing agents are being used during the building construction. Besides this, other best practices are also used to reduce the water demand.

(xiii) Separation of drinking water supply and treated sewage supply should be done by the use of dual plumbing line for separation of drinking water and treated sewage.

Complied

It is confirmed by the Project authorities that Dual plumbing pipeline has been provided for using the treated water for flushing.

(xiv) Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

Assured to comply

The PA has assured to comply this condition in due course of time.

Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code.

(xv)

The PA has assured that this condition will be duly complied.

Assured to comply

(xvi) The approval of competent authority shall be obtained for structural safety of the bUildings due to earthquake, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightening etc.

(xvii) Provision shall be made for housing of Being complied construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care etc. Housing may be in the form of temporary structure to be removed after the completion of the project.

It is informed by PA that this condition is being duly complied during the construction phase.

'2) Ooerational Phase: (i) The installation of Sewage Treatment Plant (STP) Assured to comply

and adequacy of disposal system should be certified by PSPCB and a report in this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. The discharge of treated sewage shall conform to the norms and standards prescribed by Punjab Pollution Control Board for such discharges. The project proponent shall discharge not more than 119 KLD of treated wastewater into public sewer.

Total domestic sewage will be treated through Sewage Treatment Plants (STP) with 175 KLD capacity. It is further promised that the certification from the independent expert will be got done only after 100% occupancy of the project and then forwarded to this office. Civil work on the STP is yet to be started. The PA has been asked to install UV system for disinfection of the treated water.

(ii) The project proponent will construct water harvesting tank for storage of the storm water for areas other than roof top and storage capacity shall be of 90 percentile of rainfall event. The stored storm water shall be used for fire fighting, irrigating green areas and other such purposes instead of using fresh water.

Assured to comply

The project proponent has assured to comply this condition in due course of time. This office will monitor satisfactory compliance of the condition from time to time.

(iii) The project proponent shall provide Assured to comply electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for re-using the treated wastewater back into the system for flushing and for horticulture pu rpose/g reen etc. and shall maintain a record of readings of each such meter on daily basis.

The project proponent has assured to comply this condition in due course of time. This office will monitor satisfactory compliance of the condition from time to time.

(iv) Adequate & appropriate pollution control measures Assured to comply should be provided to control fugitive emissions to be emitted within the Hotel/shopping complex.

Most of the open areas will be either covered with grass or bricks or trees and no areas will be kept open prone to dust emission.

Adequate treatment facility for drinking water shall Assured to comply be provided, if required.

The water for drinking purpose will be used only after proper treatment.

(vi) Rainwater harvesting for roof run-off should be implemented. Before recharging the roof run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/g reen area/roads/ pavements shall be connected with the ground water recharging system.

Assured to comply

Rainwater harvesting measures will be taken as per condition imposed by the SEIAA. It is informed that 4 rainwater harvesting pits with desilting chambers will be constructed.

(vii) The solid waste generated should be properly collected and segregated before disposal to the City Municipal Facility. The in-vessel bio­compost technique should be used for composting the organic waste. Prior approval of competent authority should be obtained.

Assured to comply

It is informed that the practice of segregating bio-degradable and non biodegradable waste will be adopted and then the waste will be disposed off by the project authorities by giving to Municipal Committee's approved/designated places. However, proper compliance of this condition will be monitored during operational phase in due course of time, The PA has been asked to establish Organic Waste Converter to GonVf!rt thf! kitchen waste and garbage into bio-compost.

(viii) Hazardous waste/E-waste should be disposed Assured to comply off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board.

As few DG sets of different capacities will be established for power back up and the waste oil/lubricant will be generated during their maintenance, the PA has been asked to comply following measures in respect of disposal of waste oil/used oil which is categorized as hazardous waste:­

>- The lubricant/waste oil from DG sets should be collected in separate containers with marking of "Hazardous waste" and the same may be disposed off by selling to registered recyclers only.

>- A register will be maintained by respective companies to keep a record of quantity of lubricant/waste oil generated by DG sets.

>- The project authorities will submit return in Form-4 and Form-13 to the PSPCB every year with the copies to this office.

(ix) The green belt design along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous variety.

Under compliance

The green belt development has been started. About 1600 trees and 5000 shrubs have been planted in the project area with an expenditure of RS.10 lacs. The PA has been asked to submit the details of plants planted with every six monthly progress report in the following proforma:­

(x) The project proponent should take adequate and appropriate measures to contain the ambient air quality within the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forestsl State Level Environment Impact Assessment Authority within three months.

Under compliance

The Project Proponent has taken adequate and appropriate measures to contain the ambient air quality within the prescribed standards. The ambient air quality was monitored by Industrial Testing Laboratory & Consulting House, Patiala in May, 2014 indicating all the results witllin the limils. The PA lIa~ been asked to get the monitoring done on regular basis.

(xi) Incremental pollution loads. on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project.

Assured to comply

The PA have assured to monitoring the ambient air quality, noise levels and ground water quality regularly during operational stage of the project by an outside approved or PSPCB.

(xii) Application of solar energy should be Assured to comply incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating.

It is confirmed by PA that solar lights will be used for the street lights. The PA has been asked to submit the plan in this regard in due course of time.

(xiii) Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

Assured to comply

It is confirmed that separate entry and exit provisions and one way vehicular movement has been made in the Housing Complex with sufficient parking in the open and stilts. Thus the Parking will be fully internalized and no public space will be utilized.

(xiv) A Report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about building materials & technology, R & U Factors etc. and submit to the SEIAA/Zonal Office of MoEF/CPCB in 3 months time.

Assured to comply

Energy conservation measures conforming to energy conservation norms incorporating details about building materials & technology and R & U factors etc. have been taken in the design of the Housing Complex. It is informed that CFL lights will be used in toilets and common areas, Detailed Energy Conservation Plan to be adopted by PA in this project is yet to be submitted. The PA has been asked to get the Energy audit done in respect of the energy conservation measures in the Housing Complex in due course of time.

(xv) Environmental Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project.

Assured to comply

The PA has assured to comply this condition in due course of time.

(B) General Conditions' (i) This environmental clearance will be valid for a

period of five years from the date of its issue or till the completion of the project, whichever is earlier.

Noted for compliance

As the initial 5 years of the validity will end in September, 2019 and the project will be completed till September, 2019 within the validity period.

(i i) The envi ron mental safeguards including Assured to comply environmental management plan contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority /State Expert Appraisal Committee should be implemented in true letter and spirit.

Although separate report has not been submitted by the project authorities about the implementation status of environmental safeguards contained in the EIA Report, the PA has assured to comply most of the environmental safeguards satisfactorily.

(iii) The entire cost of the environmental Assured to comply management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board.

The project proponent has agreed to comply this condition in due course of time. However, this office will monitor the compliance of the condition from time to time.

(iv) The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.

Assured to comply

The project has been monitored first time on 23.01.2015 and regular submission of six monthly progress report is yet to be ensured. The PA has been asked to submit six monthly progress report in 1st week of October and 1st week of April every year in soft and hard copies both as the report will be displayed on Web site of the Ministry of I::.nvironment & Forests in pursuance of the provisions of new EIA Notification no. 1533(E) dated 14th September, 2006.

(v) Officials from the Regional Office of Ministry of Complied Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority/State Level Expert Appraisal Committee/Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority.

The project proponent has agreed to comply this condition.

(vi) In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by State Environment Impact Assessment Authority.

Assured to comply

The project proponent has agreed to get a fresh environment clearance in case of change of scope of the project.

(vii) Separate distribution pipelines be laid down for use of treated effluent/raw water for horticultural/gardening purposes with different colour coding.

Assured to comply

The project proponent has agreed comply this condition in due course of time.

--15-­(viii) All other statutory clearances such as the

approvals from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, by project proponents from the competent authorities including Punjab Pollution Control Board and from other statutory bodies as applicable.

Being complied

It is informed that the clearances/NOC's from Municipal Committee of Zirakpur, Fire Safety Department and Ministry of Defence have already been obtained. The NOC from Ministry of Environment, Forests & Climate Change under the Forest (Conservation) Act, 1980 for the approach road to the Housing Complex is not necessary as the entry is from the internal road. Application has been submitted to PSPCB for issuing Consent to Establish under Air & Water Acts.

(ix) The project proponent should advertise in at Partially complied least two local newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded environmental clearance and copies of clearance letters are available with the State Level Environment Impact Assessment Authority and may also be seen at the website of SEIAA. The advertisement should be made within seven days from the day of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office, Ministry of Environment & Forests, Chandigarh.

The environmental clearance has been advertised in local news papers. The copies of the news cuttings are yet to be submitted.

(x) These stipulations would be enforced among others under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environmental (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification, 2006.

Assured to comply

'Consent to Establish'/NOC under Air & Water Acts is yet to be obtained from PSPCB. The PA has further been asked to get the Consent to Operate under Air & Water Acts before starting possession of the flats.

(xi) Environmental clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004 as may be applicable to this project and any other decisions of the competent court, to the extent applicable.

Assured to comply

The PA has promised to follow the verdict of Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.460 of 2004 as may be applicable to this project in due course of time.

(xii) The project proponent shall obtain CLU Assured to comply from the competent authority, if any authority insists.

The project proponent has agreed to comply this condition in due course of time. However, this office will monitor the compliance of the condition from time to time.

(xiii) The project proponent shall obtain permission Assured to comply from CGWA for abstraction of 162 KLD ground water.

The project proponent has agreed to comply this condition in due course of time. However, this office will monitor the compliance of the condition from time to time.

(xiv) A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishadl Municipal Corporation, Urban local body and the local NGO, if any, from whom suggestions I representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

Complied

This condition was duly complied.

(xv) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data 01"1, their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levels namely; PM2.5, PM10, S02, NOx , CO, Pb, Ozone (ambient air as well as stack emissions) shall be monitored and displayed at a convenient location near the main gate of the company in the public domain.

This condition is yet to be complied.

(xvi) The project proponent shall adhere to the com mitments made in the Environment Management Plan and Corporate Social Responsibility. Rs. 16.5 lacs(capital cost) & Rs.8.5 lacs(recurring cost) and during operational phase shall spend Rs.42.50 lacs (capital cost) and Rs.9.25 lacs(recurring cost) on the Environment Management Plan.

Assured to comply

The project authorities have assured to comply the condition in due course of time.

(xvii) The project proponent shall adhere to the commitments made in the Corporate Social Responsibility and shall spend Rs.6 Lacs as proposed or atleast minimum required to be spent under the provisions of the Companies Act 1956, whichever is higher.

Assured to comply

The project proponent has agreed to comply this condition in due course of time. However, this office will monitor the compliance of the condition from time to time.

(xviii) The State Environment Impact Assessment It is upto MoEFCC or Authority reserves the right to add additional SEIAA to decide safeguards! measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards! measures in a time bound and satisfactory manner.

It is upto the MoEFCC & SEIAA to decide the addition of any more environment safeguard/condition in the environment clearance letter. However, there is no recommendation from this office to add any more condition at the moment.

(xix) Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, 2010.

It is upto PA to decide. But as per records, no appeal has been filed by PA so far.
