Buenas Yan Hafa Adai! I am pleased to submit to you and your colleagues the above­referenced Official Zoning Map, F3 67S 52 and all related Zoning Amendment Maps (A-Ol thru A-08) for the Legislature's consideration. This is pursuant to Title 21, Guam Code Annotated (Real Property), Chapter 61 (Zoning Law), Part 4, Section 61647.

I have APPROVED the Official Zoning Map and all Amendment Maps that establishes the specific zoning designations in the "Dos Amantes" Planning Area, Place Name of "Ukudu".

As you are aware, the area was "unzoned" for decades while it was under the ownership of the United States Government. These parcels are known as "ancestral lands" and were subsequently returned to the Government of Guam; and, in-tum, returned to the original landowners, heirs or descendants. In their efforts to pursue the highest and best use for their properties, the property owners had organized themselves and with the assistance of a private planning consultant developed a "zoning map" for the area. This zoning map was then presented before the Guam Land Use Commission on February 28,2008, which then adopted it.

The Guam Land Use Commission then began the meticulous preparation of the Official Zoning Map and all Zoning Amendment Maps, which is now submitted for your favorable review.

- Provided are the Original documents: "DOS AMANTES" PLANNING AREA, OFFICIAL ZONING MAP F3 67S 52 (2 sheets), and AMENDMENT MAPs A-01 THRU A-DB.

- The Official Zoning Map, F3 67S 52 is the only document that has the signatory block for the Legislature's Chairman on Committee and Rules.

- The Amendment Maps A-01 Thru A-DB are original documents as well and has been signed by the Chairman of the Guam Land Use Commission and the Governor of Guam. Also included are the Notice of Actions for each Amendment Map. These are provided for information since it is relevant to the Official Zoning Map.

- All documents must be returned to the Department of Land Management upon final action and signature by the Chairman of the Committee on Rules on the "OFFICIAL ZONING MAP, F3 67S 5211 (both sheets). "NO SIGNATURE" is required by the Chairman of the Committee and Rules on the Amendment Maps A-01 thru A-08.

- These documents, the Official Zoning Map, F3 67S 52 and the Amendment Maps A-01 thru A-08 must be returned for recordation in the Department of Land Management.

RESOLUTION 2008-01

Establishing an Interim Zoning Map and Procedures for the Dos Amantes Planning Area

WHEREAS, 21 GCA Chapter 61 Zoning Law, provides authority for the Guam Land Use Commission (GLUC) to create zoning maps and Section 61105 authorizes the "approvals of zones"; and

WHEREAS, certain lands formerly held by the federal government have been returned to original land owners in the area generally north of Tumon Bay and west of Route 3, which area is generally referred to as the Dos Amantes Planning Area; and

WHEREAS, those returned lands do not have the benefit of zoning which would benefit the land owners by establishing zones under applicable Guam law; and

WHEREAS, it is in the public interest that the GLUC act to create appropriate zoning controls on these returned lands;

NOW, THEREFORE BE IT RESOLVED that the Guam Land Use Commission hereby creates aN. "Interim Zoning Map for the Dos Amantes Planning Area" in the form of the attached interim zoning map; and be it further

RESOL VED that this "Interim Zoning Map for the Dos Amantes Planning Area "shall continue in effect for a period of one year at which time it shall then become the "Final Zoning Map for the Dos Amantes Planning Area" and the GLUC shall cause such map to be forwarded to the Governor of Guam and the Guam Legislature for final approval; and be it further

RESOL VED that the GLUC shall permit every duly authorized land owner affected by this "Interim Zoning Map for the Dos Amantes Planning Area" to request an expedited zone change by making a written request to the Chairman of the GLUC at which time the Chairman shall schedule a public hearing before the GLUe for the purpose of hearing public comments as to why such requested zone change should be permitted. This expedited hearing shall not require the standard zone change application and is intended to be a simplified request for the benefit of the land owners. The GLUC shall, at the conclusion of such hearing, either approve or deny the request, or approve a different zone. The result of the GLUe action shall then cause the "Interim Zoning Map for the Dos Amantes Planning Area" to be amended. At the end of the one year period, the last amended "Interim Zoning Map for the Dos Amantes Planning Area" shall become the "Final Zoning Map for the Dos Amantes Planning Area" and transmitted to the Governor and the Guam Legislature for approval.

This Resolution was passed unanimously by the Members of the Guam Land Use Commission at its regular meeting held on the 28th day of February, 2008, as memorialized by the signature which appears below.

APPLICATION DESCRIPTION: The Applicant, Kil Koo Yoon, represented by David Tydingco, requests approval to Amend the "Interim Zoning Map" for the "Dos Amantes Planning Area" on Lot AL 002 now known as Lot 10184 and 5039, from an interim zoning designation of "R-2" Multi-Family Dwelling to "M-1" Light Industrial and "R-? Multi­Family Dwelling, Municipality of Dededo.

ACTION: The Guam Land Use Commission, by unanimous vote, approved the amendment of the "Interim Zoning Map" for the "Dos Amantes Planning Area" from an interim zoning designation of "R-2" Multi-Family Dwelling to "M-1" Light Industrial and "R-2" Multi-Family Dwelling (split zones) on Lot AL 002 now known as Lot 10184 and Lot 5039, as shown on Exhibit A. This amended "Interim Zoning DeSignation" of "M-1" and "R-2" shall remain as an "interim zone change" until February 2009 when the "Interim Zoning Map" for the "Dos Amantes Planning Area" shall become the "Final Zoning Map" and transmitted to the Governor and the Guam Legislature.

COMMISSION DECISION: The Guam Land Use Commission after considering its prior decision of "DISAPPROVAL" in its regular meeting of February 122009, concerning the Zone Change of Lot 5029-5-3; voted to APPROVE the applicant's request without conditions.

JUSTIFICATION OF RECONSIDERATION

Lot 5029-5-3 which was requested to be rezoned to "M-1" was heard on February 12, 2009 but the rezoning was disapproved. At the Commission's hearing on March 26, 2009, eight (8) other parcels in the same area were considered and approved for rezoning to "M-1." The Commission then reconsidered its February 12, 2009 decision of disapproval of the same zoning deSignation for Lot 5029-5-3 and voted to reverse its decision and approve the zoning to "M-1." The Commission cited that rezoning of Lot 5029-5-3 to "M-1" will be compatible with the other eight (8) parcels that were abutting and adjacent parcels.
