Will the Minister for Petroleum and Natural Resources be pleased tostate:

(a) the present status of the Iran-Pakistan gas pipeline project; and

(b) whether any amount has been allocated for the said projectduring the current fiscal year, if so, the details thereof?

Mr. Shahid Khaqan Abbasi: (a) The Government of Pakistan is pursuingimplementation of the Iran Pakistan Gas Pipeline Project. For implementation ofthe Project, Pakistan has requested Iran for amendment in the Gas Sales andPurchase Agreement (GSPA) allowing both parties to complete the project in theextended period. A draft amendment has also been shared with the Iran in thisregard.

The Hon’ble President of Iran visited Pakistan on 26-27th March, 2016during which the Project also came under discussion. It was agreed by both sidesto revive discussion on the Project in the wake of removal of international sanctionson Iran. Pursuant to the meeting, Iranian side has invited Pakistan for meeting.Pakistan delegation is expected to visit Iran shortly for which necessary approvalhas been sought from the competent authority.

(b) An allocation of Rs. 25 billion has been made in the Budget2016-17 under the head GIDC for utilization in connection with gas infrastructuredevelopment, which includes Iran-Pakistan Gas pipeline Project.

(a) the amount collected by the Federal Government EmployeesHousing Foundation from Government employees for purchasingland for the Bara Kahu Housing Scheme, indicating also themeasurement of land purchased for the scheme so far;

(b) the time by which allotment and possession of plots will behanded over to those Government employees who havedeposited the required amount for the same; and

(c) whether it is a fact that the said Foundation has issued lettersof allotment of plots of Officers in Sector G-13 and 14, Islamabadbut the same have not been issued to the applicants of BaraKahu housing scheme so far, if so, the reasons thereof?

Mr. Akram Khan Durrani: (a)

i. The amount deposited by the allottees of Bara Kahu Housing Schemeis Rs. 6,551,250,000/- as on 10th December, 2016 by 16500allottees.

ii. Initially, Housing Foundation has purchased land measuring 3153Kanal 7 marla from M/s Green Tree (Pvt.) Ltd. in Bara Kahu,Islamabad in 2009.

(iii) Recently, Housing Foundation is going to purchase land measuring12,000 kanal extendable up to 20,000 kanal from M/S M/sInternational Center for Services Exchange (ICSE) at Bara Kahu,Islamabad in order to accommodate rest of applicants of MembershipDrive (Phase-I).

(b) i. The Provisional Offer of Allotment (POL) have been issued to themembers under housing scheme Phase-VI (Bara Kahu, GreenEnclave-I).

ii. Land purchased from M/s Green Tree will be handed over to theallottees of Membership Drive (Phase-I) after its development. TheHousing Foundation has finalized construction agreement withM/s Green Tree (Pvt.) Ltd. according to which contractor shallcomplete the development work within 2 years from the date ofsigning of the agreement.

(c) The Housing scheme in Sector G-13 and G-14 were launched 1996and 2004 respectively. Whereas the Membership Drive Phase-I for allotment ofplots in Bara Kahu Islamabad was launched in 2009. Hence the allotment in sectorG-13 and G-14 were issued before the launch of Membership Drive (Phase-I).However, allotment to members of Bara Kahu housing scheme will be issued afterapproval of layout plan from CDA.

Will the Minister for Housing and Works be pleased to state:

(a) whether it is a fact that a number of officers in grades 16 to 18living in Government Accommodations below their entitlementare not being allotted accommodations according to theirentitlement, if so, the reasons thereof; and

(b) whether it is also a fact that rent and other charges on accountof Government Accommodation are being deducted from thesalaries of the said officers as per their grades and not accordingto the accommodations they are living in, if so, the reasonsthereof?

Mr. Akram Khan Durrani: (a) Yes, it is a fact that a number of officersin grades 16 to 18 living in Government accommodations below their entitlementare not being allotted accommodations according to their entitlement so far.

(b) Yes, it is also a fact that rent and other charges on account ofGovernment accommodations are being deducted from the salaries of the saidofficers as per their grades and not according to the accommodations they areliving. The rent have been deducted as per Rule 25 of Accommodation AllocationRules, 2002.

(a) the installed capacity of electricity generation of Warsak Dam;and

(b) whether it is a fact that the said capacity of that dam hasdecreased due to silt filling in the same, if so, the details thereof?

(b) The installed capacity of Warsak Power Station has been decreasedto 185 MW due to severe erosion of turbines, guide vanes etc. resulted fromheavy sediment load carried by water of Kabul River. However, in order to restoreWarsak Power Station to its original installed capacity, PC-I amounting toRs. 22,254.235 million was approved on 27-10-2015 for its rehabilitation.AFD /KfW / EIB (EDPs) are providing a loan of Euro 130 million for which loanAgreement has been signed.

Hiring of Consultants for engineering support and Construction Supervisionis in progress. The combined evaluation report of Proposal submitted byM/s Dolsar has been approved by Authority on 13-06-2016 and the donar agencyAFD has also issued NOL on 28-06-2016. Contract Negotiations with Top Rankfirm is under process.

Will the Minister for Petroleum and Natural Resources be pleased tostate:

(a) the nature and tenure of appointment for the sitting ManagingDirector of OGDCL;

(b) whether it is a fact that the said Managing Director has dualnationality; and

(c) whether a person having dual nationality can be appointedagainst the said post under the rules or otherwise?

Mr. Shahid Khaqan Abbasi: (a) Office of MD/CEO is vacant and ChiefOperating Officer is discharging duties of the office of MD in addition to his ownduties.

(b) The officer performing functions of the office of Managing Directorhas dual nationality who was previously working in a multinational oil and gascompany overseas.

(c) There is no bar restriction on the appointment of any person inOGDCL having dual nationality. Will the Minister for Housing and Works be pleased to state the actiontaken by the Government against the consultants, contractors andofficials who were found responsible for using substandard materialand poor quality of constructions in the projects launched by PWDand National Construction Company during the last three years?

Mr. Akram Khan Durrani:

National Construction Company

NCL is a Construction company and always procure the business fromopen market through competitive bidding. NCL does not launch any project at itssown. NCL after procuring works, enter into contract with Clients and follow thecontract stimulations. Therefore, “Nil” report is submitted.

Pak. PWD.

The work awarded to Contractors is supervise by Pak. PWD. The staffalways remains present at site during execution of work. However criminal actionas details (Annex-I) has been taken through NAB and FIA against the Contractors/Officers who were found responsible for using substandard material and poorquality of work.

Will the Minister for Water and Power be pleased to state whetherIndia is building any dam on Pakistani rivers in violation of IndusWater Treaty, 1960, if so, the steps taken by the Government to raisethe same on International forums in order to get it stopped?

Khawaja Muhammad Asif: Yes, at present, India is constructing anumber of run-of -river hydroelectric plants/dams (HEPs) on the Western Rivers.The designs of these plants are mostly in violation of the design criteria specifiedby the Indus Waters Treaty 1960. India has provided us designs, under theprovisions of the Indus Waters Treaty, of four run-of-river hydroelectric plants;Ratle (850 MW), Lower Kalnai (45 MW), Miyar (100 MW) on the ChenabRiver and its tributaries while designs of Kishenganga HEP (330 MW) is locatedon a tributary of the Jhelum River called Kishenganga in the Indian held territory ofJammu and Kashmir while downstream of the LOC it is called Neelum River.Another dam Pakal Dul HEP (1000 MW) is a storage project with live storage of89,000 acre-ft (0.09 million acre-ft) has also been proposed on a tributary of theChenab River.

Much higher than the permissible pondage, lower intakes and deep orificespillways, are the usual features of Indian designs, provide India excessive controlover the flow of waters, which is against the explicit provisions of the Treaty.

The potential of using higher than the Treaty permitted control for India’sown advantage and to Pakistan’s harm exists because of the above-mentionedviolations of the provisions of the Treaty.

The Government of Pakistan, however, is fully aware of the plan of Indiandevelopment on the waters of Western Rivers. In accordance with the provisionsof the Indus Waters Treaty 1960, the steps are continually being taken to checkthe features of all the Indian projects, the information of which have formally beenprovided by India to Pakistan so as to see whether or not the design of suchprojects falls in accordance with the requirements of Indus Waters Treaty 1960.

In all cases where the violations are being noticed, the issues are beingtaken up with India for amicable resolution at the level of Permanent IndusCommission (PIC). ln case of no cooperation by India at the level of PIC, thefurther steps, such as the reference of the matter to both the Governments, as

provided for in the Treaty, are being taken. In case of failure at the level of both theGovernments the cases where needed are referred to the World Bank forappointment of Neutral Experts or the Court of Arbitration as per the provisionsof the Treaty.

The recent case of Kishenganga Hydroelectric Plant and RatleHydroelectric Plant is one of such instance where the case of technical objectionson both of these projects are eventually being taken for the third party arbitration.

During the last three years, Pakistan has been able to get favourable decisionfrom the Court of Arbitration in the case of Kishenganga HEP regarding the issuesof draw-down below the dead storage level and that of the environmental flows.This case was taken to the Court of Arbitration in the year 2010 and final awardwas announced in December, 2013. No resolution of any issue, however, hasbilaterally been achieved.

The relevant provisions of the Indus Waters Treaty 1960, which providesfor un-restricted water rights of the Pakistan on the waters of Western Rivers (i.e.Article-III of the Indus Waters Treaty 1960), and the one which deals with themechanism of disputes resolution (i.e. Article-IX), are at Annex-I.

Will the Minister for Religious Affairs and Inter-Faith Harmony bepleased to state:

(a) the names / provisions of Family Laws which provide forfinancial and social benefits to single mothers (widow / divorced)with kids; and

(b) whether any funds have been allocated for provision of the saidbenefits to those women / mothers during the current fiscal year,if so, the details thereof?

Sardar Muhammad Yousaf: (a) The Family Laws which are underadministrative control of Ministry of Religious Affairs and Interfaith Harmony, arethe personal Laws which specifically focus on issues of marriage, divorce,inheritance, custody and guardianship. Therefore, these laws do not contain anyspecific provision in this regard.

(b) Family Laws of minorities are silent about the provision of funds tosingle women. However, under a scheme of Minorities Welfare Fund, poor / needyminorities are granted financial assistance of up to Rs. 10,000/- once in a financialyear.

During the current financial year 4 minority women have been providedmarriage grant @ Rs. 25,000/-.

Will the Minister for Water and Power be pleased to state whetherthere is any proposal under consideration of the Government toabolish the taxes being collected in the electricity bills under the headsof F.C. surcharge, T.R. surcharge, N.J. surcharge and GST for thepoor people in the country, if so, when?

Will the Minister for Housing and Works be pleased to state:

(a) whether it is fact that the Pakistan Housing Authority (PHA)had constructed “C” and “E” types flats in sector G-11/3,Islamabad, if so, the number of flats constructed and handedover to the allottees so far; and

(b) whether it is also a fact that neither the facility of Sui-gas hasbeen provided to the said flats nor internal roads in that areahave been carpeted so far, if so the time by which those workswill be carried out?

Mr. Akram Khan Durrani: (a) PHA Foundation has constructed 208“C” type and 400 “E” type apartments at Sector G-11/3, Islamabad out of which191 “C” type and 360 “E” type apartments have been handed over to the allottees.

(b) Yes, due to moratorium imposed by the Federal Government SuiGas facility has not yet been provided at PHAF Flats, G-11/3, Islamabad. In thisregard a summary for relaxation of moratorium was moved to Prime Minister’soffice but was rejected. Hence, it was decided to carpet the roads after laying ofsui gas pipe lines.

(a) the quantity of petroleum products produced in the country duringthe last two years with product wise break up; and

(a) the quantity of petroleum products imported during the last oneyear and its comparison with that imported during the precedingyear;

(b) the names of countries from which the said products wereimported; and

(c) the rate at which each of those products were imported and therate at which the same were sold to the consumers in thecountry?

Mr. Shahid Khaqan Abbasi: (a) The quantity of petroleum productsimported during 2015-16 in comparison with 2014-15 is as under:

(b) Seventy percent of the Diesel is imported from Kuwait under thelong term contract between PSO and Kuwait Petroleum Company (KPC). Otherproducts are imported by Oil Marketing Companies (OMCs) from United ArabEmirates (UAE), Singapore, Malaysia, Europe and other countries in the Gulfregion.

(c) Month-wise details of import cost and selling price of 2015-16 areannexed.

It is clarified that the difference between selling price and import costcomprises of transportation cost, dealer/OMC margins and Govt. taxes.

JP-1 imports are made for export purposes.

(c) the number of experts hired by WAPDA to conduct research ongenerating electricity through those dams / projects during thelast five years?

Khawaja Muhammad Asif: (a) & (b) Yes, WAPDA has completedfeasibility studies / pre-feasibility studies on the following Run of the RiverProjects:—

(c) under Atricle 78 of the Constitution of the Islamic Republic of Pakistan,all revenues received by the Federal Government form a part of the FederalConsolidated Fund. The receipts from Petroleum Levy, therefore, also become apart of the Federal Consolidated Fund, from where all expenditures of theGovernment are authorized by the National Assembly.

(a) the amount collected through deductions of 5% rent chargesfrom the salaries of Government employees living in GovernmentAccommodations during the last three years with year wise breakup;

(b) the details of Government accommodations on which the saidamount was spent during that period with year wise break up;and

*Question No. 151. Senator Col. (R) Syed Tahir Hussain Mashhadi: (Notice received on 30-11-2016 at 10:50 a.m.)

Will the Minister for Water and Power be pleased to state whether itis a fact that the National Water Policy has not been announced sofar, if so, the reasons thereof?

Khawaja Muhammad Asif: The first draft of National Water Policy(NWP) was initially prepared in 2005 after long process of review and consultationswith all major stakeholders. It was processed for approval of Federal Cabinet,but could not be approved. In 2010, it was decided to update NWP by takingstock of the latest developments in the water sector, especially the climate changeand its impact on water resources. Subsequently, a joint Committee headed byAdviser MoWP, with members from WAPDA, PEC and WCAP was constitutedto finalize the NWP document. After detailed consultations and deliberations, andalso review of the Report of Friends of Democratic Pakistan — Water SectorTask Force, the finally edited NWP document was sent to Ministry of Law &

Justice in October 2012 for vetting and advice. Ministry of Law & Justice advisedthat “Legislative List of the Constitution, 1973 (4th Schedule) does not possessany such provision with regard to water policy, etc. As such it is evident thatit is a provincial subject and Federal Ministry, if considers necessary, mayissue this policy, in consultation with provinces through M/o Inter ProvincialCoordination”.

2. Updated NWP was circulated to all major stakeholders in July 2015.A one day brainstorming national seminar on NWP was held in Islamabad inDecember 2015. Draft NWP was again circulated to Provincial Chief Secretariesand related organizations in August 2016 for review and comments. Commentsreceived from stakeholders have been incorporated in the refined NWP inNovember 2016 by water and policy experts.

3. In order to finalize the NWP, in view of stake holder’s views Ministryof Water and Power organized a consultative seminar on November 28, 2016 atWAPDA Staff College, Islamabad. During consultative session, further view pointsfrom different stakeholders were taken and accordingly incorporated in final formatof draft NWP. All the stakeholders have shown positive response and consensusfor approval and finalization of NWP from competent forum.

4. The National Water Policy was sent to the Ministry of Inter ProvincialCoordination on 13-01-2017 for seeking approval of the Council of CommonInterests. After the said approval, the National Water Policy will be announced.

Will the Minister for Petroleum and Natural Resources be pleased tostate the number of persons working in BPS-09 to BPS-20 or equalscales in PSO, PPL, SNGPL and SSGCL with province-wise breakup?

Mr. Shahid Khaqan Abbasi:

(1) PAKISTAN STATE OIL (PSOL)

BPS Scale are not applicable on PSO and PSO has its own organizationaland salary structure. However, the province-wise breakup of regular PSOemployees is attached at (Annex-I).

(2) PAKISTAN PETROLEUM LIMITED (PPL)

Pakistan Petroleum Limited (PPL) is a public limited Companyincorporated under the Companies Ordinance, 1984 and its business is managedby an independent Board of Directors. PPL has its own procedures and gradingstructure, accordingly, the Government’s Basic Pay Scales (BPS) system doesnot apply to PPL.

However, the province wise-break-up of the number of persons workingin PPL as on 30th November, 2016 (Annex-II).

(3) SUI NORTHERN GAS PIPELINES LIMITED (SNGPL)

Present strength of executives (career term) of SNGPL up to BPS-20 orequivalent is 1515.

As regards strength of staff from BPS 09 to BPS 16 or equivalent, wewish to apprise that no equivalence has been issued for the positions in subordinatecadre. However, presently 7797 subordinate staff is employed in the company.The Grades/Province (domicile) wise details are at (Annex-III).

(4) SUI SOUTHERN GAS COMPANY LIMITED (SSGCL)

Mr. Akram Khan Durrani: (a)

Initially, the Housing Foundation executed an agreement withM/s Green Tree (Pvt.) Ltd. for the purchase of 3000 kanals privateland at Bara Kahu Islamabad for FG Employees. Land measuring3153 kanals 07 marlas has so far been transferred in the name ofFGE Housing Foundation.

In Bara Kahu Extension Project, about 6683 Kanal up to 20000Kanal land is being purchased from M/s International Center forServices Exchange in order to make it a part of Bara Kahu to meetthe housing requirement of the registered members.

(b) The survey work on land purchased from M/s Green Tree (Pvt.)Ltd. has already been completed. Whereas, the development work shall be startedafter finalization of construction agreement with M/s Green Tree (Pvt.) Ltd.According to which contractor shall complete the development work within2 years from the start of work.

The Provisional Offer Letters (POL) has been issued to the members ofMembership Drive, Phase-I under Green Enclave-I (Bara Kahu). WhereasProvisional Offer Letters (POL) to the member of Membership Drive-I underGreen Enclave-II (Bara Kahu) are going too issued soon.

Khawaja Muhammad Asif: (a) No funds have been allocated in PSDP2016-17 for the construction of Mohmand (Munda) Dam Project.

(b) Project is in “Study Phase” which comprises Detailed EngineeringDesign, preparation of Tender Documents & PC-I. Total cost of above saidactivities is estimated at Rs. 1097.760 Million, in which 87% is being provided byAfd in form of soft loan. Progress on these activities is 80% which is expected tobe completed by February 2017.

For Construction phase of the Project, the PC-I will be submitted toCDWP/ECNEC for approval after completion of detailed engineering design.

41Heat Rate Test under the terms of the PPA and 1994 Power Policy.However, the heat rate and plant efficiency test was conducted atthe time of COD of respective Power Plant. Now the plants havedeclined to carryout heat rate testing.For IPPs under 2002 Power Policy, NEPRA is the Authority todetermine tariff. No heat rate testing is done and plants are not carryingout heat rate testing.
