The present publication is the eleventh of an annual series containing statistics on murders occur­ring in Canada.

The information contained in this report has been submitted by the police departments and courts as part of their regular statistical reporting programme. Special statistical forms were prepared by each inves­tigating police department.

Because of the excellent assistance of all agen­cies involved, it has been possible to integrate the police (crime) statistics programmes with court statis­tics for murders.

The Bureau gratefully acknowledges the invaluable assistance of the police forces and courts, and -the Department of Justice whose co-operation has made this report possible.

Statistics Canada lIas produced a separate pub­lication 01' murder since 1961. Eacll edition includes data on all murders reported or known to the police and dispose(l. of by the courts during a consecutive five-year period. This edition of "Nurder Statistics" Includes the years 1970-~974.

Users of the data should note the follOWing:

(1) This publication covers murder incid'mts and vic­tims as reported by the police; however, the po­lice \~il1 usually lay the charge of murder only on ehe instructions of the Crown Prosecutor.

(2) The Criminal Code definition of murder has changed three times since 1961. Consequently, nny "behavioural" research based on these murder statistics will be affected.

Prior to September 1961, all murder lIas consid­ered capital and the only possible sentence was the death penaltv. After September 1961, it \~as divided into eapitDl and non-eapitnl murd~r. capital murder \~as premeditated murder QE. the murder of a police officer, prison guard, etc., or murder during the eonU11l.ssion of another criminal act. The penalty \~as death. All other types of murder wet'e considet'ed non-capital, and I~ere punished by mandatot'y life imprisonment. 1n December 1967, the Criminal Code sections dealing "Uh murder wex'e amended again, this time for a five-year trial period. Capital murder nm~ te:(ers only to the mut'der of a "Iaw officer, warden," etc. The penalty is death. Non-capitd mur­der refers to any bther kind. Life imprisonment is the minimum penalty. This trial period \~as extended for Mothet' five yeat's in 1973.

Table 1 reports trends in murder as defined in the Criminal Code of Canada and homicidal deaths as defined in "The International Classification of Dis­eases, Injuries, and Causes of Death" (\-/orld Health Organization). Readers are advised to refer to the definitions of murder given in Appendix II and foot­note 2 below Table 1 which illustrates the differen­ces between murder and, homicidal deaths.

The data submitted on reported murders for the years 1970-1974 is presented first, to show the legal procedures which have occurred and the frequency of murder, and secondly, to show details regarding the victims and the accused.

Hurders Reported 1970-1973

There were 1,817 murders t'eported in the years 1970 to 1973. As of December 31, 1974, 1,56& or 8602% of these had been clea"ed by the police by charge, suicide, or "otherwise".

Of the 1,505 persons charged with these murders,_ 1,416 were adults and 89 were juveni1es.

Jusqu'en 1961, Ie meurtre etait consi~ere qualiEie et la seule sentence ~tait la condamnation 11 mort. Lo meurtre qualifit'! etait un meurtre prcmedite ou Ie mellrtre d'un agent de polica, d'un gardien de prison, etc., ou le meurtre pendant la perpdtration d 'un autre acte criminel. En decembre 1967, les articles du Code criminel portant sur le Uleurtl:e ant encore ete modifies, cette fois-ci pour une periode d'essai de cinq ans. Actuellement, un meurtre n'est c1asse comme meurtre qualifie que si la victime est "un repre­sentant de In loi, un directeur de prison", etc. La punition est la peine de mort. Dans tous les autres cas, il s'agit de meurtres non qualifies. L'emprisonnement a per1'etuite est 1n sentence minimale. Cctte periode d'essa! fut extentionnee pour un autre cinq ans en 1973.

Le t.ableau 1 indique les tendances signa lees en ce qui concerne les homicides tel que precises dans le Code criminal du Canada et les d(\ces par homicide dans la "Classification statistique internationlllE' ,'es maladies, traumatismes et cau­ses de deces" (Organisatf ,mondide de la santt'!). Les uti-lisateurs sont pries de refeter nux dt'!finitions du meurtre detaillees dans l'Append~ce II et,le renvoi 2 au tableau 1 qui explJ.que les differences entre Ie meurtre et les dec'lls par homicide.

La statistique relative aux homicides signa16s pour les annees 1970-1974 est prt'!sent~e sfin de faire voir premierement les procedures instituees et la frequence de I'homicide ct, deuxi~mement, les details concernant les victimes et l~s accuses.

Homicides signales de 1970-197'3

Pendant 1es annees de 1970 a 1973, 1,817 meurtres ont ete signales. Au 31 decemb,e 1974 1es suretes en avaient classe 1,566 (86.2 %) par mise en acr,usation, pa. qeclaration de suicide, ou "autrement".

Sur les i,505 personnes :,ccusees d'homi'Cide, 1,416 etaient des adultes et 89 des adolescents.

Murders Reported in 1974

In 1974 there were 5~1) murders reported to Statistics Canada, As. at December 31., 1974, 450 tn. o2.~6"'~ of these murders had been cleared by charge, SUicide, or Iloth"rwise".

Of the 444 persons charged with the murdeu reported in 1974, 41l \Jere. adults end 31 ~e.re. juveniles.

As of December 31, 1974, 244 or 59.1-/. of the adults ...,ere sent to trial and 169 or 40.9% were not sent to trial.

Of the 169 adults not sent to trisl, 156 were pending prelim .. inary hearing.

"For murders reported in 1974, of the adult.s sent to trial as of December 31, 1974, 27 were acquitted and 102 were convicted of capl:'al or non-capital murder, manslaughter, or a lesser offence.

Of the 102 adults co~vkted, 56 or 54.9% were convicted of manslaughter or a lesser offence. (Juvenile ststistics are analysed on page 21).

The following three tables show the number of murders reported each year and their status as of December 31, 1973 and 19,'4. Although the clearance of offences and court decisions regarding each case need not have occurred in the same year the murder was known to the pOlice and reported to Statistics Canada, data in the tables for such clear­ances, court decisions, or any subsequent actions have been updated in that yc{\r.

In Table 2 it will be noted that the number of persons charged is lO'der than the number of murders -reported (vic.tims). this is due to the fact that some suspects conunit suiCide end some murders are unsolved. An incident or act of murder msy ha'IJe more than one victim.

Tables 2, 3 and 4 are designed to ,show the yearl s activity regarding murders and court proceedings. By showing these activities as of December 31, 1973 ami 1974 information regarding murders re­ported in the years 1970 ... 1973 is up-dated by one year and can be com­pared with the status of cases reported in 1974.

PART n. CI!ARACTERISTICS OF SUSPECTS AND VICTIMS

Table 10 Shows that in 1970 32.3%. of reported murders were of a domestic nature, in 1971 35.7%, in t972 33.47., in 1973 35.7%, and in 1974 36.3'1.; consequently, a breakdown was made of the relationship of the accused to the victim(s).

In each inc.ident the c.losest relationship 'tIaa cou.nted~ There­fore, a husband would be scored as murder~ng his wife or a' wife as murdering her husband. As all victims are shown according to the relationship of the accused, a husband who n1urdered his wife and a son 1o;Iould be scored as an incident where the 'husband murdered his wHe. The victims t data would show one vife and one Son being murdered.

If a husband tI1urdered his wife and El neighbour, the victims would be scored under immediate family as Q wife and .tother".

Immediate family includes! husband, 'Wife, father~ mother, son, daughter, brother, siste:r, and "other" (not one of the spec.ified ea tegories) •

Kinship includes: grandps'l'enes, grandchildren, uncles, aunts, nephews, nieces, COUSins" in-laws, foster parents and step-pat"ents.

Common-la'iJ includes: the common .. law husband and Wife, the common-law parents, and the children in such a union.

Murders which do llo~ fall into the breakdown Df domestic murders are classed as "no- dome.e:tic t'elntionshipH. This sroup is subdivided into those murders ,committed during the "comission of the other criminn I acc" and lIor::her".

In examining the details of those murders ..... hich Yere reported by police as cleated by chat'ge or otherwise, sho ..... ing no domestic relation­ship between the accused and the victims, the accused may have been insane, may have been involved in an argument immediately prior to the murder. may have been involved in an argument during a prolonged drink .. ing bout. There is also included in this group cases of jealousy, or professional killings carried out as deliberate acts in themselves and not during the commission of another criminal act.

Special Cases:

A murder can not be classified as a "domestic murder" unless the sus­pect is known. It is possible therefore, that some murders shown \.n-der "no domestic relationship", "unsolved ll , will eventually be classified as "domes tic" murders.

In domestic murder incidents involving 1 or more suspects and/or 1 or more victims, the incident is scored only once, and that according to the closest relationship of the accused to the victim(s). For ex~ ample, a son and his cousin were accused of the murder of his mother. This is first scored as a murder incident in the "immediate familyll because of th~ son~mother relationship. The victim is scored under "immediate family-mother". However, as regards the suspects, the son is counted under "immediate family" and the cousin under "kinship". In another instance. a husband killed his wife and mother-in-ls¥I. This is scored I1S one incident under "immediate familyll because of the hus .. band-wife :celationship; as regards victims J the wife is counted under lIimmediate family" and the mother-in-law under "kinship!!. The husband is counted as one suspect under 'Iinunediate family".

Table 13 shows that as a rep-ult of murders reported in 1974 there were 413 adults charged'with ch~ital or non-,?apital murder as of Decem ... ber 31, 1974. Of this "number 169 -Were not sent to trial, 'While 2.44 were sent to trial as of December 31, 1974.

Of the 244 adults sent to trial for murders -reporte.d in 1974 a total of 83 of the accused faced charges as II result of the death of a family kinship or common-law relation. There wer'!!" 10 of these 83 acquitted of the original or a lesser charge.

Those murders corranitted during the commission of another crimi­na I act show 4 of the 40 accused who were sent to trial were acquitted compared ~o 13 of the 121 accused aent to trial in the "no domestic re­lationship - other" category.

Of t:he 244 adults sent to trial for murders reported in 1974 102 were convicted, 2 for capital murder, 44 ['or non-capital murder, 52 for manslaughter.

Murder During the Commission of Other Criminal Act, 1961-1974

Each year a number of murders are reported by the police where the circumstances involve another breach of the Criminal Code.

In the publicati-an '%Jrder Statistics" J murders are classified according to the relationship between the victim and the accused. Where there is no domestic relationship between the victim and the accused, a further breakdown is made between those murders which occurred "during the commission of other criminal act" and !lather" circumstances.

In this study J homicides which occurred between members of a family but also involved the commission of another criminal offence are included. In some instances, it is not known whether the offence was committed prior to the killing of the victim or following the death as an afterthought or as an attempt to hinder the investigation.

This is an up-dated study; all available police and court inform­ation has been studied in order to derive the motive of various incidents which were considered doubtful in previous years. Since more murders are now seen to belong to this category, the number cf incidents and victims will not match the figures given for this categot'J in previous Statistics Canada publications on murder.

Four types of criminal acts were distinguished: robbery, sexual assault and rape, escape, and other. "Robbery" includes robbery, theft, and breaking and entering. "Sexual assault and rape" refers to attacks on males and females, whether in a heterosexual or homosexual context. Under "escape" are included attempts to escape irom a correctional insti­tution, to avoid arrest, or to escape detection as a parole or probation violator. All other types of criminal acts leading to murder, such as arson, kidnapping, assaults (not indecent), abortion. etc. fall under the "other" category.

Section 213 o·f the Criminal Code outlines various offences, where­by if death ensues to a victim, murder is included under the charges.

Table A shows a year-by-year comparison of total murder incidents and victims in Canada and the number each year of these that occurred "during the commission of other criminal act".

There were 4,139 totlll i.ncidents of murder claiming 4,604 total victims; 693 or 16.7% of these murder incidents involved another criminal act, and claimed 819 or 17.8% of the victims.

Robbery was the largest single type of criminal act with 450 incidents and 471 victims.

Le "vol qual"fi~" comprend le vol qualifi~, Ie. vol et l'introdUction par effraction. "L'attentat A la pudcur et Ie viol" comprend les attental:s 1), la pudeur d 'un home au d June femme, entre personnes de saxe diff6rent QU cntre personnes de mOme sexe. La statistique de l'homicide est recueillie au Canada h l'~chelle nationale depuis Ia Confad6ration. Dans les rapports du Comit~ mixte d'enquate du Senatel: de ls Chambre des commu­nes sur la peine capitnle, Ie chatiment corporel et les lote­ries (1956), des tableaux sont publies qui donnent Ie nombre de petsonnes reconnues coupables d'homicide selon l'annee de la condamnation el: Ie sexe, et le reglement definitif de toutes les affaires pour lesquelles la culpabilite d'homicide et la condamnation A mort ont et~ prononcees depuis 1867. En outre, d'autres tableaux indiquent l'age de la personne reconnue coupabl~ et son lien de parente avec la victime.

Le Comit~ declare que

"les chiffres canadiens les plus sOrs sont ceux qui ant ttai!: au prononce des sentences de peine capitale •.• Ces chiffres ne fournissent pas un historique complet des cas. L'expose complet devrait comprendre Ie nombre de meurtres presumes, Ie nombre de cas resolus par arrestation ou autrement, et indiquer la maniere dont les accusations ont ete reglees, c'est-A-dire so it par condamnation, soit par acquittement, soit par condamnation pour un delit moindre tel que l'homicide involontaire ••• "

Lorsque le Comite a tente d'integrer les donnees relatives nux deces par homicide A celles des condamnations a mort, il a decouvert que les statistiques

"sont incompletes et que les chiffres ont ete recueillis par diverses agences et qulils sont sans relation les uns avec les autres".

Voici h quelles sources le Comite a puise les donnees: les rapports des juges sut chaque per sonne reconnue coupable d'homicide, la statistique de l'etat civil, les rapports des tribunaux et la statistique policiere (criminalite).

Depuis 1921, Statistique Canada tecueille les chiffres des naissances, mariages et deces pour toutes les ptovinces sauf le Quebec qui s 'est joint. au programme de declaration en 1926.

De 1921 h i944, les statistiques de morta1ite etaient re. parties d'apres 1'endtoit ou l'incident se produisait. En 1944, on a choisi le lieu de residence conune fondement de la reparti­tion, et un systeme d'echange avec les Btats-Unis d'Amerique fut adopte en vertu duquel un Americain tue au Ganada ne serait pss inclus dans les cas d'homicides aux fins de la statistique canadienne de 1'etat civil.

La source des chiffres destines aux tableaux portant sur les deces par homicide declares dans les publications de l'etat civil est Ie registre prOVincial des deces, dans leque1 la cause du deces est cellc quiindique le rapport du coroner. 11 est done possible que le coroner rende un jugement de mort acciden­telle alors que des renseignements ou une enquete etablissent plus tard qulil s'agit d'un homicide. Les chiffres relatifs aux homicides qui sont pub lies conune statistiques de l'etat civil comprennent les meurtres, les infanticides, les homicides involoutaires, les homicides CaUSeR pat l'intervention de la police et les executions legales.

Les donnees reunies et publiees au sujet des homicides donnent leuombre dlaccusations, d'acquittements, de mises en jugement et de condamnations, aussi bien que des ranseignemcnts personnels ao suje~ des personnes reconnues coupables, tels que la reSidence, la profession, l'etat m&ttimonial, le clegre d'in­struction, l'age, l'usage d'alcool, 1.e lieu <;Ie naissance et la religion. Malheureusement, ces donnees sont incompletes. D'au­tre part, la statistique ne couvtsit pas, jusqu'en 1953, les

A further source of data on murders is crime sta­tistics publications based on police returns, which have been published by Statistics Canada since 1920. Not all police forces reported under this scheme nor was there a standardized reporting system until the intro­duction of the Uniform Crime Reporting Progranune which started on January 1, 1962. The general method of counting murder offences for statistical purposes is to count one offence for each victim. The example used to illustrate the rule of scoring offences against a person states "where one person murders three persons, count three murders, (three murders cleared by charge; one petson charged); however, three persons murder one per­son, count one murder"(l) (one murder cleared by charge, three persons charged).

In 1961, a detailed study on homicides in Canada was started by Statistics Canada in consultation \,'ith all the Provinces and the Department of Justice. In addition to the regular police teports, improved data collection techniques have been established to ensure that all murders are reported. Special homicide forms are sent out to police departments requesting d~tails of the repo~ted murder, the victim(s) and the accused person(s), whether tbe incident has been cleared by charge, suicide or by other means, or is unsolved.

Whenever S charge of murder has been made, each case is followed by means of regular court returns and where necessary by letters requesting confirmation of the status of each case.

The number of suspected murders reported to Statistics Canada are shown by the year they wete re­ported. It is possible therefore that a murder known to the police and reported in 1962 would not be clea-red until 1963 with a court decision being made the following year. In the present report, such clearan­ces, court decision and subsequent actions or decisions have been followed up to December 31, 1969. It is important therefore to note the effective date given for data included in s\\bsequent publications in this new murder statistical series because the status pf unsolved cases which later come before the coutt, cases where the suspect is eventually declared sane, cases awaiting trial· and so on, ate subject to yearly tevision.

Because the Uniform Crime Reporting instructions state that one offence is to be counted for each vic­tim, it is possible that an apparent increase in the number of reported murders may be attributable to a single incident. For example, in one recent year three men were chatged in the death of two men in one inci. dent, and this was classed as two murders, with one of the accused having been charged with both.

It should be noted that the number of reported murders need not e'qual the number of incidents, and that the number of persons charged need not equal either the number of charges or the number of murders.

Statistics re1atillg to murders and homicidal deatho in Canada prior to 196.1 cannot be fully inte­grated. En 1961, Statistique Canada, de concert avec toutes l.es provinces et Ie mini.stere de la Justice, commen9a une (\tude de­taillee des homicides au Canada. Outre les rapports r~guliers des sOtetes, des techniques ame1iorees de collecte des donnees ont ete etablies afin d'assurer que tous les homicides etaient signales. Les sOret~s re90ivent des formules speciales rela­tives aux homicides dans 1esquelles elles donnent llls details sur 1 'homicide signale, la ou les victimes et la ou les pet­sonnes inculpees, que 1 'incident soit classe par mise en acCu­sation, classe suicide ou classe sans mise en accusation QU

Chaque fois q'J 'une accusation d 'homi.cide est portee, Sta­tistique Ganada se tient au courant de chaque affaire au moyen des rapports reguliers des tribunaux et, lorsque c'est necessai· re, i1 demande par lettre de con firmer ou en est tclle ou telle affaire.

Le nombre de presumes homicides signales b Statistiquo Canada est reparti selon l'annee de declaration des homicides. 11 peut donc arriver qu'un homicide connu de la police et de­clare en 1962 ne soit pas classe avant 1963 et que I.e tribunal ne rende son jugement que llannee suivante. Dans 1e present rapport, les affaires classees, les jugements des tribunaux et les actions aU decisions ultetieures sont indiques pour una periode close le 31 decembre 1969. Par consequent, il importe de noter la date reelle des renseignements campris dans les publications subsequentes de la nouvelle serie statistique sur les homicides, car 1a situation des af£aires non resolues qui viennent plus tard devant les tribunaux, affaires dans les­quelles Ie suspect est finalement declare sain d'esptit, af­faires devant !ltre jugees, etc. sont soumisea h une revision annuelle.

Btant donne que les directives de la Declaration uni. forme de 1.a criminalite specifient qu'une infraction doit etre comptee pour chaque victime, une hausse apparente du non,· bre d'homicides signales pour un ml!me incident est possible. Ainsi, au coura d'une des dernieres annees, trois hommes ont ete accuses de la mott de deux autres au cours d'un seul in­Cident, et deux meurtres ont ete insctits, l'un des inculp6s etant accuse des,deux homicides.

Qualifving Circumstances

Culpable homicide'(i.e. murder, mnnslaugllter, infant1.cide) does not take place unless the death oc­curs within one year and one day from the time of the last event by \Jhich the. accused person caused or con­tributed to the death (210). Nor can un insane person be found guilty of culpable homicide (or nny other of­fence), the verdict in such a case being "not guilty on account of insanity" and the accused being remanded to.;:.t~\e custody of the prilvincial authority (16,5/12).

Procedure

The detection and punishment of culpable homicides ordinarily commences with h police investigation. Under the Parole Act, a person sentenced to life imprisol1lllent for non-capital murder and a person convic­ted of capital murder whose senten('e of dellth has been commuted to life imprisol1lllent are ordinarily eligible for parole after 10 years imprisonment. However, the prior approval of the Governor-in-Council is r~quired before releaSing such cases (684).
