THE IRRIGATION ORDINANCE, No. 32 OF 1946

IT is hereby notified that I, Wijeyananda Dahanayake, Minister of Agriculture and Lands, have by virtue of powers vested in me by section 45 (1) of the Irrigation Ordinance, No. 32 of 1946, as modified by the Proclamation published in G a z e t te E x tr a o r d in a r y - No. 9,773 of September 24, 1947, confirmed the scheme relating to Wennappuwa Irrigation Work in the Puttalam District of the North Western Province, prepared under Part V of the said Ordinance and approved at a meeting duly held on December 18, 1958, by the presc.ibed majority of the proprietors within the area benefited under that irrigation work.

IT is hereby notified that I, Wijeyananda Dahanayake, Minister of Agriculture and Lands, have, by virtue of powers vested in me by section 15 (1) (i>) of the Irrigation Ordinance, No. 32 of 1946, as modified by Proclamation published in G a z e tte E x t ra o r d in a r y No. 9,773 of September 24, -1947, approved the resolution set out in the Schedule hereto.

ScheduleThis meeting of proprietors within the area benefited under the

Wennappuwa Irrigation Work in the Puttalam District of the North-Western Province, approves the “Scheme relating to that irrigation work, and prepared under Part V of tne irrigation Ordinance, No. 32 of 1946, and set out in the following Sub- Schedule:—

SUB-SCHEDULESCHEME

1. Name of Scheme : Wennappuwa Salt Water Exclusion Scheme, Puttalam District, North-Western Province.

2. Extent and nature of lands benefited under the Scheme : Private lands 82 acres; Crown lands—acres.

3. Terms agreed upon: (i) The Government undertakes toconstruct/the maintenance of the entire Scheme comprising chiefly of: —

(a.) Earthen bund 12,000 ft. long... (b) (i) 3 Nos. 1 Bay regulators, (ii) 1 No. 2 Bay regulators, (iii) 1 No. 3 Bay regulator with lifting- gate up to au estimated cost of Bs. 75,000 and to maintain the entire work.

(ii) In consideration of the aforesaid undertaking on the part of the Government, the proprietors, on their part agree to pay from the date the maintenance of the scheme is taken over by Government an irrigation rate in perpetuity which shall be Bs. 2 per acre per annum and which shall be subject to revision by Government but so, however, that the amount payable shall not at any time exceed the average cost of maintenance per acre ascertained in the manner prescribed in section 55 (2) of the Irrigation Ordinance, No. 32 of 1916. as amended by the Irriga­tion (Amendment) Act, No. 1 of 1951.

THE Honourable the Minister of Health has been pleased to appoint,' under section 3 of the Indigenous Medicine Ordinance. No. 17 of 1941, Captain S. L. Mohamed, to be a member of the Board of Indigenous Medicine fnr the triennial period commencing from today, 23rd January, I960.

This is an award under section 17 of the Industrial Disputes tet No. 43 of . 1950 (as amended-by Acts,' Nos. 25 of 1956,'14 of 957. and 62 of 1957). referred the aforesaid dispute to me for settlement by dntration. The point at'issue in th:s case is whether the non- nplovment of Messrs. B. D. N. Perera' and A. P. Medawatta justified, and if sb, to'what-relief they are entitled.

■3. The Union avers that the summary dismissal of the above- named two persons was unjustified, According to.the proprietor of Messrs. Donald & Company, they were not dism’ssed but that they walked out of their own accord, thereby vacating their posts. It would appear that on 15th December, 1958, B. D. N. Perera who is a re-toucher employed’ at the studio had a row with -his immediate superior, N. Dharmadasa, • who is also a union member, over the production of a cartoon drawn by the latter depicting a man fishing, wh:ch cartoon was shown to the workers by one Cassian who .is also a worker there. This appears to have enraged B. D. N. Perera who became abusive and in the course of which he used indecent language in the presence of the female workers in the studio. He then threatened Dharma­dasa with bodily harm. The propr etor of the studio held an inquiry and questioned B. D. N. Perera who is said to .ha.ve. admitted his guilt and on being requested to apologise to Dharmadasa, he refused to do so saying that he would not apologise even if he had to leave this job. The. proprietor thereupon tendered his salary for the number of days he bad worked together with an extra month's salary, but he refused to accept it and walked out and did- not return for work. These facts are borne out by the proprietor, the witness Dharmadasa and the Manager, Lawrence, respectively, and i see no reason to doubt their evidence. In the circumstances I hold thatB. D. N. Perera vacated his job and that he is not entitled to any relief. The question of non-employment, therefore, does not arise. B. D. N.- Perera does not want to be re-employed at the Studio as he has made arrangements to ' start a business in vegetables from next month.

4. In regard - to Medawatta, the proprietor avers that he absented himself frequently without leave; by D. 4 he was warned against a repetition of this. It would appear that on 15th Janu­ary, 1959, Medawatta sent a telegram (D.I.) requesting sick leave. No medical certificate was tendered for this period, but a medical certificate was tendered to cover the period from 22nd January, 1959, to 26th January, 1959. As a result of his frequent absence he was informed that in future he would be paid a daily wage and that he would be paid only for such days as .he worked. On 5th February,' 1959, which was pay day, Medawatta refused to sign the register and draw his salary! He stated that he did so because he was informed that his salary would be cut for'the days he was absent. He further stated that he refused to sign the register because the entries were noted in pencil, although he admitted that he had signed it on previous occasions when also the entries were noted, in pencil. The fact that he left without receiving his pay bears out the Company’s position that he vacated his -post. In these circumstances I hold that he vacated his post and, therefore, the question of non- employment does not arise. He has now obtained a more lucra­tive employment at a studio at Piliyandala.

5. I hold that B. D. N. Perera is entitled to get his salary from 1st December, 1958, to 16th December, 1958 (16 days), at the rate of Rs. 145 a month, plus Rs. '11.78. as overtime. In view of Perera’s previous good conduct which the proprietor admitted, I allow him a further month’s salary. Indeed, the proprietor stated that he had decided to give Perera an extra month’s salary in view of his good conduct.

6. Medawatta is entitled to salary for 14 days at the rate of Rs. 5.33 a. day during December, 1958, and to 28 days’ salary during January and February, 1959, at the same rate. Although he is entitled to 28 days’ salary for January and February,I allo.w him a. full month's salary .by extending the period to 31 days—i.e., 3 days extra.

7. Payment to be made through the Assistant Commissioner of Labour (Industrial Relations), Colombo, on or before 15th February, 1960.

THE AWARD

This is an award under section 24 of the Industrial Disputes Act, No. 43 of 1950. It relates to an Industrial Dispute between the Nidhas Karmika Saha Velanda Sevaka Vurthiya Samithiya and Messrs. C. H, Z. Fernando & Co. Ltd., Colombo- 7.

2. The Honourable the Minister of Labour by his Order, dated 17.8.59, made under section 4 (2) of the aforesaid Act, referred this dispute to this Court for settlement. According to the statement of the Deputy Commissioner of Labour, dated 4th August, 1959, appended to the Minister’s Order, the matter in dispute between the parties is the non-employment of the follow­ing eight workers by the said Messrs. C. H. Z. Fernando & Co. Ltd.

"3. When the matter was taken up for hearing on 2nd 'Novem­ber, 1959, Mr. Mallawaaratchchi appeared for the Union and Mr. G. S. Sivaprakasan, Proctor, for the Company, On subsequent dates, of hearing Mr. R. A. Saranaoala. and Mr. Lionel Fernando respectively appeared for the Union.

4. Evidence was given by two of the workers, the Managing Director of the Company and his Storekeeper. The Company was engaged in plumbago business and enmloyed at its store in Rajagiriya these eight women workers. Beside the watcher no men workers were employed. Plumbago came into the store in 1 cwt. 1£ cwt. or 2 cwt. bags. When a lorry brought the plumbago each bag in turn was lowered by these workers into a two-wheeled hand" cart which was then pushed to a central spot in the store. There the bag was lifted out and its contents emptied on the floor. Drying, sifting, mixing and connected operations then tock place. For shipment the plumbago was packed in 2 cwt. bags and taken in the hand cart as before to be loaded into lorries. The loading was done by four workers lifting each bag up to the lorry when a male worker (Lorry Cleaner) in the lorry took it and stacked it. The exact weisrht of a bag handled by these workers is not of importance in the matter in dispute. But it is noteworthy, that while a worker stated in evidence that the weight was 2 cwt. 6 lbs. Mr. C. H. Z. Fernando himself stated “ tomorrow I am shipping 59 tons in 2J cwt. bags. ”

g. i t is in evidence, that .when these workers became • its members, the Union told them that the law did not require them to . carry loads and instructed them not to do the loading or unloading of bags of plumbago. The Union must have been a-ware that at a ll plumbago stores this loading and unloading is done by women workers and that the most effective way of introducing the reform it-seems to have desired was at Wages Board level.

When the Union submitted to the Company in January a list of 9 demands, it made no reference to loading and unloading.

6. When on Ju ly 19th. 1959, there were 25 tons of plumbagopacked in bags and ready for removal by lorries for shipment— the first in eight months—-then the opportunity came for the workers to refuse to load. The storekeeper, however., prevailed on them to do the loading this time also. At the same time they told the Storekeeper that they would not load, or unload, there­after. That evening the Storekeeper reported the matter to the Managing Director and upon his instructions. R . 3 was posted on the notice board of the stores on June 20th, stating that the eight workers had informed the’ Storekeeper., that they were _ no longer ■ prepared to do the work which they- had been doing during their-whole period of employment with’ the Company and that thus they had terminated their employment and were’ no longer in the service of the Company. Thus came the non- employment of these workers. ’

7. When the workers- gave- notice to the. Storekeeper on 19.6.59, that they would not thereafter do loading and nnlosd’ng were they vacating their posts ? W as it not a demand for a revision of the terms of employment ? I consider it was. That a certain item of work- had always been performed by workers is no reason'asainst their requesting for its omission. Whether such request'' is reasonable is another matter. Having, had a verbal report from the Storekeeper on what, transpired between

him and the workers, the Managing Director should have acquainted himself of the facts by means of a formal inquiry conducted by himself or - other person appointed by him. If he had acted less hastily he would have found that two of the eight workers who according to R. 3 hac informed the Store­keeper on the 19th of June of their refusal to load or unload thereafter could not have so informed as they were absent on that day. As however, they have elected to make common cause with the rest and had the same instructions from the Union as the others I include them in a common award.

8. The eight workers shall receive in lieu of notice of termina­tion of their services average' wages they earned for a month during the period of the three months March—May, 1959. This amount shall be paid to them through the Assistant Commis­sioner of Labour, Colombo Industrial Relations, No. 21, Vaux- hall Street, Colombo. 2, within two weeks of the publication of this Award in the C e y lo n G o v e rn m e n t G a z e t te .

Messrs. Punchi Singho & Sons, Limitedwas referred to me by the Acting Commissioner of Labour,by his letter dated 15.9,59 for settlement by arbitration under section 3 (1) ,(d) of the above Act. The matters in dispute as detailed by the Deputy Commissioner of Labour are:

■ (i) Wrongful discontinuance of P. B. Simon Silva,(ii) Non-payment of gratuity to P. B. Simon Silva for ths

26 years of service at the rate of one month’s wages for each year of service.

2. Both parties forwarded their statements as required by the Registrar under section 36 (1) (a) of the Act. The Union in its statement made the allegations stated in the previous paragraph.

3. Messrs. Punchi Singho & Sons Limited, in reply, deniedthe averments and justified -its action on the following grounds : — -

(a) The Management found it expedient and desirable torationalise its. business because of severe losses incurred. To this end, the proposed alteration in . the terms of employment. was effected

(b) Payment of gratuity-, had never been the practice in theCompany;

(c) The financial position of the Company at present precludedthe consideration of any- such demand.

4. Inquiry commenced on 24.11.59-when MrUP'. A. D. Samara- sekera, Proctor,.with- M r:’U ."E. Perera appeared fqr the Union

-and'outlined his case as follows:—Mr. P. B. Simon Silva, an employee of Messrs. Punchi Singho & Sons Limited for 26 years,- was informed, by -letter dated 30.7.57 (P. 1). that the terms.of his employment ..were to be , substantially altered. He stated that the letter implied two alternatives: (a) either to accept the altered terms of employment, viz. monthly salary to payment on piece-rate basis, or (5) to' consider the letter as notice, of termination of service. He contended that the treat­ment meted out'to him was .“ grossly unfa ir” .

5. Mr. W. T. ' P. Goonetilleke, Advocate, who appeared for Messrs. Pu'nchi■ Singho & Sons, Limited, prefaced his .case with the following observations : (a ) The business was run at a loss “ for a considerable tim e” and consequently the decision to convert the monthly rate basis into piece rate basis was justified as no mala fides could be attributed to the Management lor its action ; (b ) Further, the Court had no jurisdiction to try the case as it was a matter exclusively for a Labour Tribunal, as defined by the Act. -

6. Both parties made their submissions on the question of jurisdiction of this Court to hear the case on the claim for gratuity, after which I cited the relevant authority, "section 17 of the Act, and gave my order rejecting the objection.

7. It would be necessary to trace the historical background of this firm presently known as Punchi Singho & Sons, Limited, to the time when Mr. P. B. Simon Silva joined it. Though the firm was then known as Punchi Singho & Bro., it was virtually. run by one man, Muhandiram Batnaveera, the founder and proprietor of the concern. The workers held him in great regard and esteem as he was always ready and willing to afford them relief in their distress and trouble: Presumably tne workers were then a happy lot, quite contented . with the terms of employment and conditions of service prevailing at the time.

8. In 1950 the business was converted into a limited liability company and was styled as Punchi Singho & Sons, Limited. It was in the fitness of the progressive trend of the times that the business should have been so translated, covering as it did, the interests of the family members. The change of the status of business, however, might not have been so congenial to Simon Silva as it would have made him rather sceptical and apprenhensive. It must ‘be mentioned that, though the •business was incorporated into a limited liability company, it was the same family concern with Muhandiram Batnaveera holding larger number of shares in the present management and extend­ing wider powers and responsibilities to his sons. It is significant that it was in the first year of transition that the workmen were all allocated fairly substantial sums to . their credit in the books for payment as gratuity or retirement benefit.

9. The first issue before the Court is the alleged wrongful dismissal of P. B. Simon Silva, “ wrongful ” in the sense that an employee of 26 - years of service was written to by letter P.. 2, dated 30.7.57, intimating the .decision of the Management to pay the workers on a piece rate basis with effect from 1.8.57. Though it was not expressly stated, the Managing . Director deposed to the fact in his evidence, that the letter was also intended as.notice of termination of the services of P. B. Simon Silva, in the event of his non-acceptance of the variation in the terms of employment. The Management took up the position that the proposal of payment on piece rate, basis was discussed with Simon Silva and others concerned, in" view of the recurrent losses of the Company, and action was taken, thereafter.

of the years preceding 1950. It is also evident that a fair share of the accumulated profit had apparently gone into the business in the form of capital investment on shares by the new directors, the sons of Muhandiram Batnaveera. If this hypothesis is dismissed as untenable, though it seems extremely probable in the context of the circumstances, the only presumption is that Muhandiram Batnaveera had rightly utilised the profits up to i.4.50, the date of the change over of the business,_ to promote the interests of. his family after paying out certain amounts to his workers at the closing year of the old era.

13. Mr. H. V. S. Batnaveera, son of Muhandiram Batnaveera, the Managing Director of the firm deposed in his evidence that though a scheme of payment of gratuity was not specifically operative in the firm, a Bcheme as such, was contemplated by his firm as far back as 1950. The counsel for the Management, however, took up the position that the claim for payment of

"gratuity could not be entertained, as there had never been the practice of the Company to pay a gratuity to any of its employees in consideration of past service. In the light of the evidence before the Court, and the practice adopted by the Company in 1950, it. is abundantly clear that a scheme of payment of gratuity, though not expressed, was implied and existent in the Company. In reply to a "categorical question by the Court regarding the system of payment of gratuity existing in the Company, the answer of Mr. H. V. S. Batnaveera, the Managing Director o f. the Company was “ Yes; even now we will do th a t” . I would, therefore, conclude my finding that a system of payment of gratuity to its employees in consideration of past service, has been and is the practice in the Company.

14. It would be helpful," for the purpose of analysis, to split up the business period of the Company into—

(a) Pretransition period,(b) Post-transition period.

The change over into a limited liability company was effected on 1st April, 1950, so that P. B. Simon Silva was an employee of the present Management only for a little over 7 years'. He had thus spent- 19 years of his 26 years' service with Muhandiram Batnaveera, the proprietor of Mess s. Punchi Singho & Bro. The Trading and Profit & Lorn Account for the closing year of the pre-transition period 1.1.49 to 31.3.5 1 (B. 7) filed by the Manage­ment shows an item of Bs. 63,890.19 as salaries and bonus to staff and workers. There are the names of certain fellow wo:kers of P. B. Simon Silva who were paid various amounts as stated below: —

10. Simon Silva denied it. The peremptory manner with which the letter" P. 2 was worded does not support this contention. Further, if a general agreement was expressed or even implied in the discussion with the workers, it was inexplicable why- a l l ' the workers involved should have left the serv ce of. the Company shortly after. Simon Silva did not report himself for work as rightly expected of him in terms implied in the letter. P. 2. The. Management could not produce any supporting evidence to prove -their • contention. While conceding- the "right of the employer to retrench superfluous workers in" the process of rationalisation of the business, I hold- the - view that the procedure resorted to in'achieving the objective, gwas; not justified. P. B. Simon -Silva who was characterised by- the Management as "honest and hardworking " and who.-had -spent, the best .part of his life in the Company deserved niore humane treatment even- if: there -was -justification for retrenchment. He’ shonId..have been written to explaining the situation and the discussion with him months ahead, thus giving him sufficiently long notice, to look round and secure other suitable'employment.'-If-is hard luck for an employee at the end of his tether to be thrown out in this fashion .{& start life afresh. A bare month's notice as an alternative to the suggested terms of eniployment. .may, sound all right from a strictly legal angle, but" in'the industrial-sphere it is incon-eivable when the primary purpose of the legislature for industrial, regulations, is the maintenance of healthy employer- employee relations. The. Union, does not, seek compensation but only, gratmty for past service as relief for the manner in which his services were terminated.

15.. It would be noted that the name of P. B. Simon Silva is not' mentioned in B. 7. It is possible that what was paid to him was not specified as in the case of the first four. Simon Silva denied having’ received any sum as bonus or gratuity then. The

- Management was not in a position to furnish the Court with the “ break-down ” of the .last item in the above list, and could not adduce proof of payment of any sum as gratuity to Simon Silva along with the others. In the absence of any such proof .of such payment to Simon Silva. I am constrained to- give the benefit of the doubt to him. A close study- and comparison of Simon Silva’s service -and emoluments' with these of others, his fellow workers, (B. 3) will "disclose-the relative worth of P. B. Simon Silva to the Company. It cannot be said that the usefulness of Simon . Silva to the Company had depreciated in the year 1.4.49 to 31.3.50, considering "the fact' that a sum of B s ." 690 was allocated out of the profits of the following year to be paid to hind as "gratuity or’ retirement benefit. I would, therefore, hold" that P. B. Simon -Silva was entitled to recognition for his •19 year's of service in -the pre-transition period though not to the extent; of A. U. ,G. Tyrishamv and A. II. G. Baby Singho who" Were paid Bs. 2,985.27 and Bs. 2,752.42 respectively.-•": ; 16.- .It - was argued by the counsel- for the Company that -it would ;not-be" fair- to saddle the present Management with the •obligations of Muhandiram Batnaveera, the. proprietor of-Messrs. Punchi "Singho-'& Bro. Tn-this context-I retiterate my earlier observations-in paragraph 8— ■

11. P. B. Simon Silva was guilty of a few -lapses ia his evidence as pointed out by the counsel for the Management." "This :was- due*,--"partly, to .his. faulty memoryrto;-recall--two-yeaT .old incidents, and- partly ">to his p-edilection- to be evasive in his answers. It. should" be - mentioned; however,' .that the; basic material-issues' on" which the .Union" had'built up-its entire-case were unchallenged "by the Management.

12. -B onu s o r G r a t u i t y .-—The -learned counsel for the Manage­ment endeavoured to make out that. what was, credited, to. the employees, was in the nature o ft bonus for the year; a s■1950 happened- to -b e a, boom year. It is hardly conceivable that the yeaL .195"!,-:.should - have-.been "singled out as an exceptionally prosperous year to enable the Management.to ear-mark as.much as six months’ salary to each of_.the" employees to fie paid, at retirement.. It is evident that -"the- profit-accrued for" 1950 synchronizing with the transition which marked the change of status of the business, was the cumulative result of the working

17. I, would now refer to - the post-transition period of the business and the service of P. B. Simon Silva in the present •MftUauement. Simon Silva had* served"the present Management ■from 1.4.50 to 31.8.57. i.e.. a little over'7 yea-s. In the .year- of business 1.4.50 to" 31.3.51, run by the .present Management, -the Balance Sheet IE. 8) rhows a net profit of Bs. 51 928.64. P. B. Simon Si)va^waS.-therefore, credited with a sum of Bs. 690, .whichi-"ah stated by Mr. H. V. S, Batnaveera, the Managing Director, was gratuity payable to him at retirement. No further amounts have been credited to him since then, and no valid

reasons have been given for this omission. Mr. H. V. S. Ratna- veera, the Managing Director Btated in his evidence that they had made good profits up to 1953. A statement of net profits and losses as shown by the Company's Balance Sheets is appended below: —

18. I have scrutinised the Balance Sheets and the Profit &Loss accounts for the period 1950-1957. In both the years 1950 and 1951 the Company had made good profits as admitted by Mr. H. V. S. Ratnaveera, the Managing Director. The year ending 31.3.53, however, -was closed with an adverse balance of Rs. 7,595. A closer study of the accounts revealed, among other items, the item—■

19. It is evident that with the conversion of the business into a limited liability company, the outlook of the Directors too had changed to give themselves greater privileges and amenities to the detriment of workmen’s interests. Social justice demands that a worker should be paid a living wage to keep himself and his family of dependants in reasonable comfort. If a business which had previously .been run with a- degree of care and concern for all those engaged in the enterprise assumes a totally different character and outlook with its change of status, to inflate its financial load by such items as specified in the preceding paragraph, the result would*be foreshadow'ed. P. B. Simon Silva was started with Rs. 40 per mensem and was in receipt of only Rs. 125 per mensem at the time of his termination after 26 years of service. I therefore hold the view that the business during the period 1953-1955 was run by the Directors by an all-pervading sense of padding themselves, ■ creating thereby inevitable losses, in the years that followed.

20. In the light of my earlier analysis and observations, I hold that—

(а) The peremptory manner in which 'P . B. Simon Silva wasdiscontinued was unjustified, and hence " wrongful

(б) P. B. Simon Silva should be paid gratuity. I would assessthe quantum, not in the manner .as set out by the Union, but on the lines calculated by the Management to the other workers for the pre-transition period ending 31.3.50. P. B. Simon Silva had served the Management in this period for 19 years. I would fix a' sum of Re. 2,250 to be paid to him as comparably fair amount for his 19 years’ service with Messrs. Punchi .Singho & Bro., -as against Rs. 2,985.27 and Rs. 2,752 paid to A. U. G. Tvrishamy. and A. U. G. Baby Singho.

21. P. B. Simon Silva had served the present. Management for a little over 7 years. In the year ending 31.3.51, the Manage­ment realized as profit a sum of Rs. 51,928.64 out of which a sum of Rs. 690 was paid to him as .gratuity. I would, in the interests of equity and justice, allow further amounts proportionately for the years 1952, 1953. and 1954. In 1952, the Management had made a profit of Rs. 21,233.99—the figure given to the Court by the counsel for the Management and carried forward in the Company’s Balance Sheet (B. 18.) In the intervening years between- 1953 and 1957, the Balance Sheet •discloses mounting losses except for 1954 which registers a net 'profit of Rs. 5,738.51 despite the heavy personal item of Rs. 9,600 charsred for the year as entertainment -and .conveyance allowance to the. Directors, vide my comments in paragraph 18. .1 would, therefore, consider two months’ salary—Rs. 250, for 1952 and Rs. 250 for 1953 and 1954, aggregating Rs. 500, a further amount as gratuity for his service in the present Management.

22. The Union has made no claim for compensation and has confined its claim only for gratuity for past services, which is, in itself, a form of relief. I consider it fair and equitable' to

'order that a sum. of Rs. 2,750 comprising Rs. 2,250 for his services before the business was incorporated into a limited liab ility company, and Rs. 500 for his services after the lnoornoration, to be paid to Mr. P. B. Simon ' Silva through the Assistant _ Commissioner of Labour, Industrial Relations, Colombo, within 30 days of the publication of this award.

This is an Award under the Industrial Disputes Act, No. 48 of 1950, (as amended by Acts Nos. 25 of 1956, 14 and 62 of 1957). It is in relation to an industrial dispute between the Ceylon Mercantile Union (referred to hereinafter as the ’ ’ Union ") and Messrs. Colombo Assurance Limited (hereinafter referred to as the “ Management ”).

2. The Minister of Labour by virtue of the powers vested in him under section 4 (2) of the Industrial Disputes Act, No._ 43 of 1950, as amended, has on 11th September, 1959, referred the aforesaid dispute to me for settlement.

3. The statement of the matters in dispute, as forwarded by the Deputy Commissioner of Labour, is as follows: —

’’ Whether the non-employment of the following three employees is justified and to what -relief they are entitled: —1. N. Jayawardena,2. R. Hannibal,3; C. E. F . Dekker.

4. At the inquiry Mr. P. B.. Tampoe, General Secretary of the C. M. U., represented the Union while Mr. S. J . Kadirgamar instructed by Messrs Julius & Creasy appeared for the Manage­ment.

5. When the inquiry was resumed on the 28th January, 1960, after its last sitting on the 26th October, 1959, the parties arrived at a. settlement. Both parties were agreed that the settle­ment should be recorded in the following manner: —

“ The parties report to this Court that they have adjusted the matter in dispute. In view of the adjustment effected between themselves the Union and Messrs N. Jayawar­dena, R. Hannibal and C E. F . Dekker move to withdraw the dispute and their demand -for reinstate­ment and compensation.

The parties move that the Court, be pleased to make award accordingly.”

Disputes Act, No. 43 of 1950, dated 14th December. 1959, the Deputy Commissioner of Labour referred the following question as to the interpretation of paragraph 10 of my Award, dated 30th May, 1959, for decision by me : —

3. In my Award dated 30th May, 1959, published in the C e y lo n G o v e rn m e n t G a z e t te No. 11,771 of dune l- ’. 1959. I decided that each of the retrenched employees should be paid three months,’ gross wages as retrenchment relief, but I added that if they had been paid their full wages for the period 10th July, 1958, to 10th August, 1958, when they were under notice, they would be entitled only to two months’ extra wages. The difficulty with regard to payment has arisen as the retrenched employees have done a certain amount of work during this period.

4. This matter was considered in the presence of th» parties and it was agreed that in the case of those who worked during the period 10th Ju ly, 1958, to 10th August. 1958, thev won d be paid two months’ gross wages and in addition they should receive in respect of the period 10th Ju ly , 1958, to 10th August, 1 9 5 8 , a month’s gross w a g e s m in u s th e am ou n t, which had already been paid to them in respect of the number of days during which they had worked. A Statement filed, marked A, shows the number of days each of the retrenched employees worked during the period and the amount each one was paid.

The Honourable the Minister of Labour, by his Order under’ section 4 (2) of the aforesaid Act dated 21st August, 1959, referred to this Court an industr al dispute between the abovenamed parties for settlement. - The dispute between them, according to the statement of the Deputy Commissioner of Labour annexed to the Order of the Minister, is—

3. At the inquiry before me the Union was represented by Mr. Advocate S. Shanmugalingam instructed by Mr. S. Kanaga- ratnam and the proprietress by Mr. A. E. Dias, Visit:ng Agent of the estate, who was authorised in writing to represent the proprietress.

4. The d: spate arose as a result of the ’ compulsory acquisition of Tittaeta- Mukalana Estate by the Government. Consenuent on the acquisition notice issued on the proprietress on 20112.58 notice had been given by the proprietress to the labourers on the estate on 1.1.59 terminating their services.as at the end of February,1959. According to the proprietress there were oply nine labourers on the estate at the time that the acquisition notice was receiv­ed. In her wr’tten statement filed in this Court she states that Josalin Nona (No. 10) left the estate on 15.8.58 and that Rosalin and Emalin Nona (Nos. 11 and 12) left the estate on 1.3.58. The Union, in its statement filed in this Court, asks for a gratuity to be paid by the proprietress to the retrenched labourers at the rate of one month's wages for each year of service. The proprietress denies her liab il’ty .to pay any gratuity as the services of the labourers had to be terminated in view of the compulsory acoui- sition of the estate by the Government. She takes up the posi­tion that if any gratuity is payable it " should be paid by the Government. She further states that in her claim, made for compensation for the acquisition she included a claim on behalf of the workers for a gratuity at the rate of two weeks’ wages for' each year of service.

5. On the first date of inquiry, namely, 13th November, 1959, it was stated that the amount of compensation to be paid for the acquisition had not been determ ned by the Government Agent. As an application was made on that date for a postponement of the inquiry on behalf of the Union, the next date was fixed for

'28th January, 1930. An inquiry was made by the Registrar of this Court from the Government Agent in the meantime as to when the amount of compensation to be paid for the acquisition of. the estate was likely to be determined. By 28th January,1960, the acquisition inquiry had not taken place and there.wasno information available as to when it was likely to be held. After some discussion the parties came to a settlement with regard to the dispute in order to avoid further'delay. It was agreed that ten of the workers, omitting Rosalin and Emalin Nona (No. 11 and 12) should be paid a gratuity calculated at the rate of two weeks’ gross wages1 for each year of past ser­vice up to a maximum of five years, a period of over six months being considered as one year and a period of less than . six months, but over three months, being considered as half a year. The parties themselves have calculated the amount of gratuity each of the ten workers is to receive on the basis of this agreement and have filed with the Registrar a statement signed by them. According to this joint statement the gratuity to be paid to each of the workers is as follows: — ■

6. I consider the " above ’ settlement just and equitable and make my award accordingly that the ten workers referred to in the above paragraph should be paid by the- proprietress the sums noted against each nam e'as gratuity on account of their-

past service rendered to the proprietress. The last two workers named in the statement, of the Deputy Commiss’oner of Labour, namely Rosalin • and Emalin Nona (Nos. 11 and 12) will not be entitled to any gratuity as they had left her service long before the acquisition of the estate. The total of the amount of gratuity, namely Rs. 802.70, should be deposited by the pro­prietress with the Assistant Comnrssioner of Labour (Colombo Industr.al Relations), No. 21, Vauxhall Street, Colombo 2, within two weeks of the publication of this award in the G a z e tte . The Assistant. Commiss’oner of. Labour. .(Colombo Industrial Relations) should make. arrangements to’ pay the ten workers concerned the amounts due under this award, as early as possible.

I, Alfred Edwin Gogerly Moragoda, Commissioner for the Regis­tration of Indian and Pakistani Residents, do hereby give notice, under section 10 of the Indian and Pakistani Residents (Citizenship) Act, No. 3 of 1949, that I shall make order allow­ing each such'application under Sub-section's (1) and (2) of section

4 of the Act a s ' is specified in the. Schedule hereto unless any written objection to the making of -such .order, together with a statement of the grounds or' facts on which such objection is based, is received by me from any member of the pubi c within a period of one month from the date of publication of this notice.

Notice under Section 277 (5) to Strike off Metro Power Limited

WHEREAS there is reasonable cause to believe that Metro Power Limited, a company incorporated on 24.5.1950, under the pro- visions of the Companies Ordinance, No. 51 of 1938, is not carrying on business or in operation:

And whereas notice dated 23rd October, 1959,- was published in the Ceylon G o v e rn m e n t G a z e tte No. 11,929 of October 30, 1959, that the name of Metro Power Limited, would at the expiration of three months from that date, be struck off the register unless cause was shown to the contrary:

And whereas Metro Power Limited has not shown cause to the contrary within the period of three months aforesaid.

Now therefore I, Walter Mahesa Sellayah, Registrar of Com­panies, acting under section 277 (5) of the Companies Ordinance, No. 51 of 1938, do by this notice declare that Metro Power Limited, was this day struck off the'Register of Companies and the said Company is dissolved.
