Latif Condro Warsito (diajukan penuntutan secara terpisah) pada hari dan tanggal yang tidak dapat dipastikan sekitar bulan September sampai dengan bulan Desember 2010 atau setidak-tidaknya di tahun 2010 bertempat di RSUD R.Syamsudin, SH Kota Sukabumi Jalan Rumah Sakit Nomor 1 Kota Sukabumi atau setidak-tidaknya pada suatu tempat lain yang masih termasuk dalam Daerah Hukum Pengadilan Tindak Pidana Korupsi pada Pengadilan Negeri Kelas I Bandung yang berwenang memeriksa dan memutus perkara Tindak Pidana Korupsi berdasarkan Keputusan Ketua Mahkamah Agung Republik Indonesia Nomor : 191/KMA/SK/XII/2010 tanggal 01 Desember 2010 tentang Pengoperasian Pengadilan Tindak Pidana Korupsi pada Pengadilan Negeri Bandung, Pengadilan Negeri Semarang dan Pengadilan Negeri Surabaya, secara melawan hukum melakukan perbuatan memperkaya diri sendiri atau orang lain atau korporasi yang dapat merugikan keuangan Negara atau perekonomian Negara, perbuatan tersebut dilakukan oleh terdakwa antara lain dengan cara-cara sebagai berikut : ----------------------------------------------------------------------------------------------------------

- Bahwa awalnya pada tahun 2010 Rumah Sakit Umum Daerah R. Syamsudin,SH. Kota Sukabumi mendapatkan Dana Alokasi Khusus (DAK) Program Pengadaan Peningkatan Sarana dan Prasarana Rumah Sakit untuk kegiatan Pengadaan Alat-Alat Kesehatan Rumah Sakit dengan Pagu Anggaran senilai Rp. 4.426.510.000,- (empat miliar empat ratus dua puluh enam juta lima ratus sepuluh ribu rupiah) untuk pengadaan perlengkapan Bank darah dan IGD (Instalasi Gawat Darurat).

- Bahwa kemudian saksi dr. H.SUHERMAN. MKM., selaku Direktur RSUD R. Syamsudin, SH. Kota Sukabumi yang juga selaku Pengguna Anggaran telah menunjuk terdakwa Drs. Didi Subandi sebagai Pejabat Pembuat Komitmen (PPK) berdasarkan Surat Keputusan Direktur

RSUD R. Syamsudin, SH. Kota Sukabumi Nomor 57 Tahun 2010 tanggal 04 Agustus 2010 dalam Proyek Pengadaan Alat-alat Kedokteran (IGD dan Bank Darah) RSUD R. Syamsudin SH. Kota Sukabumi Tahun 2010.

- Bahwa sebagai Pejabat Pembuat Komitmen (PPK), terdakwa mempunyai tugas pokok sebagai berikut :a. Menyusun perencanaan pengadaan barang/jasa.b. Menetapkan paket-paket pekerjaan disertai ketentuan mengenai peningkatan penggunaan

produksi dalam negeri dan peningkatan pemberian kesempatan bagi usaha kecil termasuk koperasi kecil, serta kelompok masyarakat.

c. Menetapkan dan mengesahkan Harga Perkiraan Sendiri (HPS), jadwal, tata cara pelaksanaan dan lokasi pengadaan yang disusun oleh Panitia Pengadaan/Pejabat Pengadaan/Unit Layanan Pengadaan.

d. Menetapkan dan mengesahkan hasil pengadaan panitia/ Pejabat Pengadaan/Unit Layanan Pengadaan.

e. Menetapkan dan mengesahkan hasil pengadaan panitia/ Pejabat Pengadaan/Unit Layanan Pengadaan sesuai dengan kewenangannya.

f. Menetapkan besaran uang muka yang menjadi hak penyedia barang/jasa sesuai ketentuan yang berlaku.

g. Menyiapkan/melaksanakan perjanjian/kontrak dengan pihak penyedia barang/jasa.h. Melaporkan pelaksanaan/penyelesaian pengadaan barang/jasa kepada pimpinan

instansinya.i. Mengendalikan pelaksanaan perjanjian/kontrak.j. Menandatangani Pakta Integritas sebelum pelaksanaan pengadaan barang/jasa dimulai.

- Setelah spesifikasi tekhnis tersebut dibuat lalu oleh terdakwa diserahkan kepada saksi Rofinus Dero selaku Ketua Panitia pengadaan barang dan jasa, selanjutnya Saksi Rofinus Dero mengundang anggota panitia pengadaan lainnya untuk menyusun jadwal dan membuat dokumen lelang, dan terdakwa menetapkan dokumen lelang yang didalamnya memuat spesifikasi.

- Kemudian pada tanggal 04 Agustus 2010 Panitia mengumumkan paket kegiatan pengadaan alat-alat kesehatan tersebut di LPSE Jabar dengan nilai pagu sebesar Rp. 4.426.510.000,- (empat miliar empat ratus dua puluh enam juta lima ratus sepuluh ribu rupiah) dengan metode evaluasi sistem gugur dengan tahapan : evaluasi administrasi, evaluasi teknis dan evaluasi harga.

Mutiara Jaya Farma, PT Sinar Surya Semestaraya dan PT. L-Med Mitra Persada dan kemudian saksi dr.Hj.Ellis Fasta Martiana,Sp.PA menyampaikan hasil evaluasinya kepada Ketua Panitia (saksi Rofinus dero) bahwa yang layak dan memenuhi spesifikasi teknis dalam pengadaan barang alat kesehatan tersebut adalah PT. - Bahwa kemudian setelah Panitia melakukan evaluasi teknis, saksi Rofinus Dero (Ketua Panitia) menyampaikan kepada Terdakwa bahwa PT. L-Med Mitra Persada tidak memenuhi persyaratan secara teknis, meskipun penawaran dari PT.L-Med Mitra Persada merupakan penawaran terendah, namun pada saat itu Saksi Rofinus Dero mengatakan kepada Terdakwa bahwa saksi Rofinus Dero mau mengusulkan PT. L-Med Mitra Persada menjadi pemenang asalkan PT. L-Med Mitra persada mau mengadakan barang sesuai yang terdapat pada dokumen lelang dan pada saat itu PT.L-Med Mitra persada melalui Saksi Helmi menyatakan siap dan menyanggupi untuk mengadakan barang sesuai dengan dokumen pemilihan.

- Bahwa setelah terdakwa bersama sama dengan Saksi Rofinus Dero, dan saksi Helmi yang mengatasnamakan dari PT.L-Med Mitra Persada bertemu di Hotel Pangrango Selabintana Sukabumi, selanjutnya saksi Rofinus Dero tanpa sepengetahuan dari anggota panitia yang lain membuat Berita Acara evaluasi penawaran nomor : 05/PP/ALKES/UPT.PBJ-RSUD/2010 tanggal 6 September 2010 dalam poin b tentang evaluasi teknis nomor 6 menyatakan bahwa kesimpulan evaluasi PT.L-Med Mitra Persada

memenuhi syarat teknis sehingga saksi Rofinus Dero selaku Ketua Panitia mengusulkan pemenang lelang di LPSE dengan pemenang PT.L-Med Mitra Persada sebagai urutan pertama, kemudian Terdakwa selaku PPK menyetujui usulan tersebut melalui LPSE pada kolom Persetujuan evaluasi padahal terdakwa mengetahui bahwa PT. L-Med Mitra Persada tidak memenuhi persyaratan pada evalusi tekhnis, atas dasar tersebut saksi Rofinus Dero mengumumkan pemenang dengan urutan pertama PT.L-Med Mitra Persada.

- Bahwa pada tanggal 23 September 2010 Terdakwa selaku PPK menandatangani Surat Penunjukan Penyedia Barang (SPPB) Nomor : 3/PPK.RSUD_Alkes(paket 1)/2010 dan kemudian pada tanggal 30 September 2010 terdakwa bersama dengan saksi Latif Condro Warsito (terdakwa yang diajukan penuntutan berkas terpisah) selaku Direktur PT.L-Med Mitra Persada menandatangani Surat perjanjian untuk melaksanakan pengadaan alat-alat kedokteran (IGD dan bank darah) Nomor : 4/PPK.RSUD_ALKES/2010 tanggal 30 September 2010 dengan nilai kontrak sebesar Rp.4.126.500.000,- (empat milyar seratus dua puluh enam juta lima ratus ribu rupiah), dimana spesifikasi yang tercantum dalam dokumen kontrak tersebut tidak sama dengan spesifikasi yang ada dalam dokumen pemilihan yaitu :

- Bahwa dalam pemeriksaan barang, terdakwa hanya memberikan satu lembar dokumen kepada Tim P2B (Panitia Pemeriksa Barang) yang berisikan nama barang dan jumlahnya saja, tidak mencantumkan spesifikasi yang harus diperiksa oleh tim P2B dan dokumen tersebut sebelum diperiksa oleh tim P2B sudah terlebih dahulu ditandatangani oleh terdakwa dengan saksi Latif Condro Wasito, sehingga tim P2B tidak melakukan pemeriksaan spesifikasi terhadap barang yang diterima.

- Bahwa setelah Berita Acara Pemeriksaan ditandatangani oleh seluruh anggota tim P2B kemudian Saksi latif Condro Warsito membawa dokumen tersebut sebagai salah satu persyaratan pengajuan pembayaran.

- Bahwa pada tanggal 22 Desember 2010 Pemerintah Daerah Kota Sukabumi melalui Kuasa BUD menerbitkan 2 (dua) Surat Perintah Pencairan dana (SP2D) yakni :1. Nomor : 851/LS/DAK/2010 untuk Keperluan pembayaran langsung 100% Belanja

Pengadaan alat-alat kedokteran (IGD dan Bank darah) sumber dana DAK senilai Rp. 3.751.363.636.- (tiga miliar tujuh ratus lima puluh satu juta tiga ratus tiga uluh enam ribu enam ratus tiga puluh enam rupiah)

2. Nomor : 852/LS/DAK/2010 untuk Keperluan pembayaran langsung 100% Belanja Pengadaan alat-alat kedokteran (IGD dan Bank darah) sumber dana pendamping senilai Rp. 375.136.364.- (tiga ratus tujuh puluh lima juta seratus tiga puluh enam ribu tiga ratus enam puluh empat rupiah)

kepada saksi Latif Condro Warsito selaku Direktur PT.L-Med Mitra Persada yang beralamat di Jalan Kebayoran Lama No.24 Jakarta dengan Nomor rekening 0351005220 Bank Pembangunan Daerah Jawa Timur Cabang Jakarta.

- Bahwa akibat perbuatan terdakwa bersama-sama dengan saksi Rofinus Dero dan saksi latif Condro Warsito, dimana PT. L-Med Mitra Persada pada saat dilakukan evaluasi teknis barang yang ditawarkan tidak sama dengan spesifikasi yang ditetapkan dalam dokumen pemilihan penyedia barang, namun atas dasar kesepakatan antara saksi Didi Subandi, Rofinus Dero dan terdakwa PT. L-Med Mitra Persada disetujui sebagai pemenang sebagaimana yang diusulkan oleh Panitia serta PPK, selanjutnya terdakwa selaku PPK menandatangani kontrak dengan Sdr. Latif condro Warsito selaku Direktur PT. L-Med Mitra Persada, dimana dalam kontrak tersebut tidak mencantumkan spesifikasi teknis yang sesuai dengan yang ada dalam dokumen pemilihan namun kontrak tersebut dilampiri spesifikasi teknis yang ditawarkan oleh PT.L-Med yang sebagian besar berbeda dengan spesifikasi teknis yang ada dalam dokumen pemilihan, hal tersebut bertentangan dengan ketentuan :Pasal 10 ayat (5) huruf f Keputusan Presiden Republik Indonesia Nomor 80 tahun 2003 tentang Pengadaan Barang dan Jasa Pemerintah yang menyatakan “Panitia melakukan evaluasi terhadap penawaran yang masuk” dikaitkan dengan Keputusan Presiden Republik Indonesia Lampiran I BAB II huruf f poin 3 yang menyatakan “ penawaran yang memenuhi syarat adalah penawaran yang sesuai dengan ketentuan syarat-syarat dan spesifikasi yang ditetapkan dalam dokumen pemilihan penyedia barang/jasa tanpa ada penyimpangan penting/pokok atau penawaran bersyarat “ dan poin 8 yang menyatakan “ penawaran dinyatakan memenuhi persyaratan teknis apabila memenuhi spesifikasi teknis barang yang ditawarkan berdasarkan contoh brosur dan gambar yang ditetapkan dalam dokumen pemilihan barang jasa “.

g. Menyiapkan/ melaksanakan perjanjian/ kontrak dengan pihak penyedia barang/ jasa.h. Melaporkan pelaksanaan/ penyelesaian pengadaan barang/ jasa kepada pimpinan

- Setelah spesifikasi tekhnis tersebut dibuat lalu oleh terdakwa diserahkan kepada saksi Rofinus Dero selaku Ketua Panitia pengadaan barang dan jasa, selanjutnya Saksi Rofinus Dero mengundang anggota panitia pengadaan lainnya untuk menyusun jadwal dan membuat dokumen lelang, dan terdakwa menetapkan dokumen lelang yang didalamnya memuat spesifikasi.

- Kemudian pada tanggal 04 Agustus 2010 Panitia mengumumkan paket kegiatan pengadaan alat-alat kesehatan tersebut di LPSE Jabar dengan nilai pagu sebesar Rp. 4.426.510.000,- (empat miliar empat ratus dua puluh enam juta lima ratus sepuluh ribu rupiah) dengan metode evaluasi sistem gugur dengan tahapan : evaluasi administrasi, evaluasi teknis dan evaluasi harga.

- Bahwa dari pengumuman tersebut ada 35 perusahaan yang mendaftar, namun hanya 11 perusahaan yang memasukan dokumen penawaran serta lulus tahap evaluasi administrasi yaitu :1. PT. Catur Parahyangan2. - Bahwa kemudian setelah Panitia melakukan evaluasi teknis, saksi Rofinus Dero (Ketua Panitia) menyampaikan kepada Terdakwa bahwa PT. L-Med Mitra Persada tidak memenuhi persyaratan secara teknis, meskipun penawaran dari PT.L-Med Mitra Persada merupakan penawaran terendah, namun pada saat itu Saksi Rofinus Dero mengatakan kepada Terdakwa bahwa saksi Rofinus Dero mau mengusulkan PT. L-Med Mitra Persada menjadi pemenang asalkan PT.L-Med Mitra persada mau mengadakan barang sesuai yang terdapat pada dokumen lelang dan pada saat itu PT.L-Med Mitra persada melalui Saksi Helmi menyatakan siap dan menyanggupi untuk mengadakan barang sesuai dengan dokumen pemilihan.

- Bahwa setelah terdakwa bersama sama dengan Saksi Rofinus Dero, dan saksi Helmi yang mengatasnamakan dari PT.L-Med Mitra Persada bertemu di Hotel Pangrango Selabintana Sukabumi, selanjutnya saksi Rofinus Dero tanpa sepengetahuan dari anggota panitia yang lain membuat Berita Acara evaluasi penawaran nomor : 05/PP/ALKES/UPT.PBJ-RSUD/2010 tanggal 6 September 2010 dalam poin b tentang evaluasi teknis nomor 6 menyatakan bahwa kesimpulan evaluasi PT.L-Med Mitra Persada memenuhi syarat teknis sehingga saksi Rofinus Dero selaku Ketua Panitia mengusulkan pemenang lelang di LPSE dengan pemenang PT.L-Med Mitra Persada sebagai urutan pertama, kemudian Terdakwa selaku PPK menyetujui usulan tersebut melalui LPSE pada kolom Persetujuan evaluasi padahal terdakwa mengetahui bahwa PT. L-Med Mitra Persada tidak memenuhi persyaratan pada evalusi tekhnis, atas dasar tersebut saksi Rofinus Dero mengumumkan pemenang dengan urutan pertama PT.L-Med Mitra Persada.

- Bahwa terdakwa bersama-sama dengan saksi Rofinus Dero yang telah menetapkan PT. L-Med Mitra Persada sebagai pemenang dalam kegiatan pengadaan alat-alat kedokteran (IGD dan Bank darah) di RSUD R.Syamsudin, SH Kota Sukabumi tahun 2010, dimana pada saat dilakukan evaluasi teknis barang yang ditawarkan oleh PT. L-Med Mitra Persada, terdakwa mengetahui bahwa PT. L Med Mitra Persada tidak memenuhi syarat dalam spesifikasi tekhnis dan seharusnya terdakwa tidak menyetujui dan menetapkan PT. L-Med Mitra Persada sebagai pemenang, namun dalam hal ini terdakwa tetap menyetujui usulan dari Ketua Panitia Pengadaan yaitu saksi Rofinus Dero, karena adanya kesepakatan antara terdakwa Drs. Didi Subandi dengan saksi Rofinus Dero dan saksi Helmi yang mengatasnamakan PT. L-Med Mitra Persada tersebut PT. L-Med Mitra Persada tetap dimenangkan sebagai penyedia barang dan jasa.

- Akibat perbuatan terdakwa bersama sama dengan saksi Rofinus Dero dan saksi Latif Condro Warsito sebagaimana diuraikan diatas telah merugikan keuangan negara sebesar Rp. 759.613.807,- (tujuh ratus lima puluh sembilan juta enam ratus tiga belas ribu delapan ratus tujuh rupiah) atau setidak-tidaknya sejumlah itu.

--------- Perbuatan terdakwa diatur dan diancam sebagaimana diatur dalam Pasal 3 jo Pasal 18 ayat 1 huruf (b) Undang-undang Republik Indonesia Nomor : 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-undang Republik Indonesia Nomor : 20 tahun 2001 tentang Perubahan atas Undang – undang Republik Indonesia Nomor : 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo Pasal 55 ayat (1) ke-1 KUHPidana. -------------------------------------
