The meeting began at 7:30 p.m.  Clerk of the Board Diane M. A regular meeting of The Board of Chosen Freeholders of the County of

Morris, State of New Jersey, was held on February 9, 2011, in the Freeholders

Public Meeting Room, Administration and Records Building, Morristown, New

Jersey. The meeting began at 7:30 p.m.

 

Clerk of the Board Diane M. Ketchum announced that adequate notice of

The Mendham Township Recreation Committee is requesting permission to

hang a banner over County Route 510 in Mendham Township from June 4-18 to

advertise the Patriot’s 5K Race.

 

On motion by Freeholder Murphy and seconded by Freeholder Nordstrom the

road closing request was approved.

Director Chegwidden stated:  “We will now consider for final

adoption the ordinance entitled ‘BOND ORDINANCE AMENDING BOND ORDINANCE

NUMBER 966150 FINALLY ADOPTED FEBRUARY 25, 2009, BY THE COUNTY OF MORRIS,NEW JERSEY, IN ORDER TO PROVIDE FOR A CHANGE AUTHORIZED BY SUCH

ORDINANCE.’”

 

Clerk Ketchum read the following ordinance:

 

BE IT ORDAINED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF

MORRIS, NEW JERSEY (not less than two-thirds of all the members thereof

affirmatively concurring), AS FOLLOWS:

 

Section 1.  Bond Ordinance number 966150 of the County of Morris, New

Jersey (the “County”), finally adopted February 25, 2009 entitled “BOND

ORDINANCE OF THE COUNTY OF MORRIS, NEW JERSEY, APPROPRIATING $200,000 AND

AUTHORIZING THE ISSUANCE OF $190,000 BONDS OR NOTES OF THE COUNTY FOR THE

DESIGN OF THE REPLACEMENT OF THE 24 INCH PCCP TRANSMISSION MAIN (M.C.M.U.A.

WATER DIVISION) IN PLEASANT HILL ROAD IN RANDOLPH TOWNSHIP, BY AND FOR THE

COUNTY OF MORRIS, NEW JERSEY” is hereby amended to read as follows:

 

Section 2.  Section 3 (a) of said Bond Ordinance number 966150 of the

County, finally adopted February 25, 2009, is hereby amended to provide for

the design and replacement of the 24 inch PCCP Transmission Main (M.C.M.U.A.

Water Division) in Pleasant Hill Road in Randolph Township. Therefore,

Section 3 (a) of said bond ordinance number 966150 shall read in the entirety

as follows:

 

“The improvements hereby authorized and the purposes for the financing

of which said obligations are to be issued are for the design and

replacement of the 24 inch PCCP Transmission Main (M.C.M.U.A. WaterDivision) in Pleasant Hill Road in Randolph Township, including all

work and materials necessary therefor and incidental thereto (all as

shown on and in accordance with the plans and specifications therefor

on file in the office of the Clerk of the Board of Chosen Freeholders

and hereby approved).”

 

Section 3.  Section 4 (d) of said Bond Ordinance number 966150 of the

County, finally adopted February 25, 2009, is hereby amended to provide for a

decrease of $90,000 in the amount of interest on the obligations authorized

by Bond Ordinance number 966150, costs of issuing said obligations,

engineering costs and other items of expense listed in and permitted under

Section 40A:2-20 of the Local Bond Law of New Jersey. Therefore, Section 4

(d) of said bond ordinance number 996150 shall read in its entirety as

follows:

 

“An aggregate amount not exceeding $110,000 for interest on said

obligations, costs of issuing said obligations, engineering costs

and other items of expense listed in and permitted under Section 40A:2-

20 of said Law is included in the estimated cost of said improvements.”

 

Section 4. All other details of the bond ordinance referred to in

Section 1 hereof shall remain the same.

 

Section 5. This bond ordinance shall take effect twenty (20) days after

the first publication thereof after final adoption as provided by the Local

Bond Law.

Freeholder Murphy presented the following resolutions:

 

(1)

BE IT RESOLVED, by the Board of Chosen Freeholders of the County of

Morris in the State of New Jersey as follows;

 

1. That the County of Morris hereby awards a grant not to exceed $375,000

from the FY10 Open Space and Farmland Preservation Trust Fund to the

Township of Denville for a project entitled Fels Property.

 

2. That the Board of Chosen Freeholders hereby accepts the dedication

Of any facilities under County jurisdiction, including but not limitedto sight triangle easements, bridge maintenance easements and roadway

dedications (per official map) as required by the grant agreement.

 

3. That the Treasurer issue a Certificate of Availability of Funds

indicating that funds are available from the Morris County Dedicated

Open Space Account #13-290-56-580552-888 and process payment to the

grantee or its designated agent as directed by the Office of the

Department of Planning & Development, all in accordance with this

resolution.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Chosen Freeholders of

the County of Morris in the State of New Jersey as follows:

 

1. That the Director of the Board of Chosen Freeholders is hereby

authorized to sign and execute the Deed of Easement between the County

of Morris and Constellation Solar I, LLC for an underground conduit

under Morris County property.

 

2. A copy of this agreement is on file in the Office of the Division of

Transportation and made a part hereof by reference, is hereby approved

and entered into by this Board.

 

3. This resolution shall take effect immediately.

BE IT RESOLVED, by the Board of Chosen Freeholders of the County of

Morris in the State of New Jersey as follows:

 

1. That the County of Morris hereby awards a grant not to exceed

$1,622,000 from the FY10 Open Space and Farmland Preservation Trust

Fund to the Township of Mount Olive & The Land Conservancy of New

Jersey for a project entitled South Branch Preserve Additions.

 

2. That the Board of Chosen Freeholders acknowledges the grant recipients

may share ownership of all or portions of the subject property with the

New Jersey Water Supply Authority, while the project still being

encumbered by Chapter 24 (P.L. 1997).

 

3 That the Board of Chosen Freeholders hereby accepts the dedication of

1. That the County of Morris hereby awards a grant not to exceed

$420,000 from the FY10 Open Space and Farmland Preservation Trust

Fund to the Township of Denville for a project entitled Rockaway

Project.

 

2. That the Board of Chosen Freeholders hereby accepts the dedication of

any facilities under County jurisdiction, including but not limited to

s sight triangle easements bridge maintenance easements and roadway

dedications (per official map) as required by the grant agreement.

 

3. That the Director of the Board of Chosen Freeholders is hereby

authorized to sign and execute an agreement for the aforesaid grant,

and the Clerk to attest to the same, a copy of which is on file in the

Office of the Department of Planning & Development made a part hereof

by reference.

 

4. That the Treasurer issue a Certificate of Availability of Funds

indicating that funds are available from the Morris County Dedicated

Open Space Account #13-290-56-580552-888 and process payment to the

grantee or its designated agent as directed by the Office of the

Department of Planning & Development, all in accordance with this

resolution.

WHEREAS, a contract was awarded for laundry services; and

 

WHEREAS, it has been determined that it is necessary to increase said

contract to provide for an increase in the level of 2010 services;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of

the County of Morris in the State of New Jersey that pursuant to Local Public

Contracts Regulations, contract modification as detailed on “Contract Change

Order Request” No. 1-24059 is hereby approved as follows:

advised by the Morris View Study Consultants that one way to enhance revenues

is to consider having Morris View enter into managed care contracts; and

 

WHEREAS, the County of Morris Board of Chosen Freeholders have been

advised by both County Counsel and County Risk Management that the managedcare contracts meet County requirements;

 

NOW, THEREFORE, BE IT RESOLVED, that the Morris County Board of Chosen

Freeholders that the Director of the Board of Chosen freeholders is hereby

authorized to sign the managed care contract between Morris View Healthcare

Center and United Healthcare Insurance Company.

WHEREAS, the County of Morris Board of Chosen Freeholders oversees the

Morris View Healthcare Center; and

 

WHEREAS, the County of Morris Board of Chosen Freeholders are committed

to increasing the potential revenues at that facility in order to continue to

increase its cost-effectiveness; and,

 

WHEREAS, the County of Morris Board of Chosen Freeholders has been

advised by the Morris View Study Consultants that one way to enhance revenues

is to consider having Morris View enter into managed care contracts; and

 

WHEREAS, the County of Morris Board of Chosen Freeholders have been

advised by both County Counsel and County Risk Management that the managed

Freeholders that the Director of the Board of Chosen freeholders is herebyauthorized to sign the managed care contract between Morris View Healthcare

Center and AmeriChoice of New Jersey, Inc.

BE IT RESOLVED, by the Board of Chosen Freeholders of the County of

Morris in the State of New Jersey as follows:

 

1.   The action of the Chief Sheriff’s Officer in signing and executing a

grant award from the New Jersey Department of Law and Public Safety for

a $78,595.00 grant under the FY10 Paul Coverdell FS Improvement Grant

Program on behalf of the Morris County Sheriff’s Lab, is hereby

approved, ratified and confirmed.

 

2.   Be it further resolved, that the Director of Finance and County

Treasurer is hereby authorized to accept the aforesaid funds, crediting

the appropriate account.

BE IT RESOLVED, by the Board of Chosen Freeholders of the County of

Morris in the State of New Jersey as follows:

 

1.   The Director of the Board of Chosen Freeholders is hereby authorized to

sign and execute an interlocal services agreement for emergency

radio dispatching services provided by the County’s CommunicationSystem to the Township of Mine Hill for 2011, a copy of which is on

file in the Office of the Department of Law and Public Safety and made

Fund to the Trust for Public Land for a project entitled Ellinwood

Tract.

 

2. That the Board of Chosen Freeholders acknowledges the grant

recipient may assign the rights, obligations, grant proceeds and

ownership of all or portions of the subject property to the Morris

County Park Commission, as permitted by the grant agreement, while

the project still being encumbered by Chapter 24 (P.L. 1997).

 

3. That the Board of Chosen Freeholders hereby accepts the dedication

of any facilities under County jurisdiction, including but not

limited to sight triangle easements, bridge maintenance easements

and roadway dedications (per official map) as required by the grant

agreement.
