Admission in Government Educational Institutions) Bill, 2020, is hereby published for general
information under proviso to Rule 128 of the Rules of Procedure and Conduct of Business in the
Haryana Legislative Assembly :-

GOVERNMENT EDUCATIONAL INSTITUTIONS) BILL, 2020
A
BILL
to provide for reservation in admission in Government educational institutions to
persons belonging to the Scheduled Castes in the State of Haryana with special measures for
deprived Scheduled Castes and for matters connected therewith or incidental thereto.
Be it enacted by the Legislature of the State of Haryana in the Seventy-first Year of the
Republic of India as follows:-
1. This Act may be called the Haryana Group D Employees (Recruitment and Conditions
of Service) Amendment Act, 2020.
Short title.
2. In this Act, unless the context otherwise requires,-
(a) “Annexure” means the Annexure appended to this Act;
(b) “competent authority” means an officer appointed under section 5;
(c) “deprived Scheduled Castes” means such Scheduled Castes as specified in
Annexure;
(d) “Government educational institution” means any higher education institution
established and maintained by the Government or receiving aid out of the State
funds, imparting education leading to the award of a degree including a post-
graduate degree and shall include Government aided technical and professional
institutions;
(e) “Government” means the Government of the State of Haryana in the
administrative department;

(f) “prescribed” means prescribed by the rules;
(g) “Scheduled Castes” means Scheduled Castes notified under article 341 of the
Constitution of India.
Reservation. 3. (1) Twenty per cent seats shall be reserved for the members of the Scheduled Castes
while making admission in Government educational institutions.
(2) Fifty per cent of the twenty per cent seats reserved for Scheduled Castes for
admission in any Government educational institution shall be set aside for candidates belonging
to deprived Scheduled Castes as enumerated in the Annexure.

next year.
4. Where a seat set aside for candidate from deprived Scheduled Castes for admission in
Government educational institutions is not filled up in any academic year due to non-
availability of candidate of deprived Scheduled Castes possessing the requisite qualifications,
the same shall be made available to candidate of Scheduled Castes.
Competent
authority to issue
certificate.
5. (1) The Government may, by notification, appoint any officer as competent authority
for the purposes of carrying out the provisions of this Act.
(2) The competent authority shall, for the purposes of section 3, issue caste
identification certificate specifying the caste name of the Scheduled Caste, in such manner, as
may be prescribed.
(3) The competent authority shall, for the purposes of this Act, exercise such powers
and perform such functions, as may be prescribed.
(4) The competent authority shall be deemed to be a public servant within the
meaning of section 21 of the Indian Penal Code, 1860 (Central Act 45 of 1860).
Certificate of
identification. 6. A person belonging to the deprived Scheduled Castes shall, for the purposes of section 3,
support his candidature by a certificate of caste identification issued by the competent authority
under sub-section (2) of section 5.
Protection of action
taken in good faith. 7. No suit, prosecution or other legal proceedings shall lie against the competent authority,
officers of the Government for anything which is in good faith done or intended to be done
under this Act or any rule or order made thereunder.
Power to remove
difficulties. 8. If any difficulty arises in giving effect to the provisions of this Act, the Government
may, by order, published in the Official Gazette, make such provisions not inconsistent with the
provisions of this Act, as may appear to be necessary for removing the difficulty:
Provided that no such order shall be made under this section after the expiry of three
years from the commencement of this Act.
Power to make
rules. 9. (1) The Government shall, by notification in the Official Gazette, make rules for
carrying out the purposes of this Act.
(2) Every rule made under this Act shall, as soon as possible, after it is made, be laid
before the State Legislature.
Review of
Annexure. 10. The Government may, on the basis of such criteria, as may be prescribed and on the
expiration of ten years from the coming into force of this Act and at every succeeding period of
five years thereafter, review the Scheduled Castes included in the Annexure.

STATEMENT OF OBJECTS AND REASONS
Article 15 (5) of the Constitution of India authorises State Government to make special provisions, by law, for
the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes or the
Scheduled Tribes for their admission to educational institutions including private educational institutions.
Haryana provides 20% reservation for Scheduled Castes in admission in educational institutions as well in
services. Analysis of employee data reveals that the total representation of a section of the Scheduled Castes in
Government Services in Haryana, specified in Annexure (hereinafter, referred to as the ―Deprived Scheduled Castes‖)
is only 4.7%, 4.14% and 6.27% in Group-A, Group B and Group-C services respectively, even though their
population is about 11% of the total State population. It is further revealed that the population of other Scheduled
Castes in Haryana is also about 11% of the total State population but in respect of representation in Government
Services their share is 11%, 11.31% and 11.8% in Group A, B and C, respectively.
The reason for poor representation of the Deprived Scheduled Castes in Government services is also revealed
by the education data collected in Socio-Economic Caste Census survey 2011. The minimum prescribed educational
qualification for majority of the posts of Group A, B & C services in the State of Haryana is Graduation. The SECC
data reveals that in terms of education, only 3.53% population of the Deprived Scheduled Castes is Graduate, 3.75%
of them are Senior Secondary level and 6.63% are Matric/Secondary level. Also 46.75% of them are illiterate.
The social and educational backwardness of this section of Scheduled Castes make them a distinct class of
citizens, who are deprived the Constitutional right to equality of opportunity in comparison with the general
Scheduled Castes population due to lack of education. The Deprived Scheduled Castes are not able to compete with
other Scheduled Castes of the State of Haryana in respect of Government jobs. Therefore, there is a need to provide
proportionate distribution of benefits of reservation amongst various sections of the society and to uplift the Deprived
Scheduled Castes, who failed to take due benefit of the reservation system alongwith all other Scheduled Castes. It is,
therefore, desirable to make reservation in admission in Government and Government Aided Educational Institutions
for them.
With a view to ensure that creamy layer is excluded from benefit of reservation, State Government shall
conduct a periodical review to verify the backwardness of each of the deprived castes and include or exclude such
castes as may qualify the creamy layer criteria. Further, to ensure a more proportionate distribution of reservation
benefits for Scheduled Castes in respect of admissions in educational institutions at the Graduate & Post-Graduate
level, it is proposed to provide that while making admission at the Graduate and Post-Graduate level in educational
institutions, twenty per cent seats shall be reserved for the members of the Scheduled Castes of which fifty per cent
of the twenty per cent seats so reserved shall be offered to the applicants belonging to Deprived Scheduled Castes
enumerated in Annexure of the Bill, as a first preference from amongst the Scheduled Castes. Where the seats offered
to Deprived Scheduled Castes for admission at the Graduate and Post-Graduate level in educational institutions are
not filled up in any academic year due to non-availability of candidates of Deprived Scheduled Castes possessing the
requisite qualifications, the same shall, after the display of the final list of such admissions for that year be made
available to candidates of Scheduled Castes by the educational institutions.

MEMORANDUM REGARDING DELAGATED LEGISLATION
Clause 8 and 9 of the proposed bill empowers State Government to remove difficulties and to frame rules for
carrying out the purposes of the Act. This delegation of powers to the executive is of normal characters. Hence, the
memorandum regarding delegated legislation as required under Rule 126 of the rules of procedure and conduct of
business in the Haryana Legislative Assembly is enclosed.
