GUSII WATER AND SANITATION COMPANY
APPROVED TARIFF STRUCTURE FOR THE PERIOD 2017/18 TO 2020/21
Gusii Water and Sanitation Company (GWASCO) applied to the Water Services Regulatory Board (WASREB) for a review of tariffs for water services, for the period 2017/18 to 2020/21 as per section 72 (1) (b) of the Water Act, 2016.
Public consultation on the GWASCO application was carried out between 19th October and 20th November, 2017 with a public consultation meeting held on 17th November, 2017 at Culture Hall, Kisii Town, and a report submitted to WASREB in accordance to the requirements of section 139 of the Water Act, 2016. In response to a call for comments published on 28th November, 2017 by WASREB, and with a closing date of 31st December, 2017, no comments were received.
After considering the application, the written and oral submissions by all stakeholders during the consultation period, and based on latest available data, WASREB has determined an upward tariff review for GWASCO is justified in order to improve service delivery, operate sustainably and protect consumer interests by meeting the tariff conditions outlined below.

2.0 Sewerage Tariff
Sewerage is charged at 75% of the water billed for all customers with a sewerage connection.
Disconnected water accounts shall be charged based on the average of the last three months' sewer charges before the disconnection.

Annual budgets: The annual budget of the WSP will strictly be guided by this tariff structure. Investments: The investment provided for in this tariff (Annexe A) is strictly implemented and the regulator be informed accordingly.
Obligation for payment of administrative cost and regulatory levy: The provision made in this tariff for payment of administrative cost and regulatory levy is adhered to the letter.

Regulatory levy: Specifically the utility shall remit the regulatory levy on monthly basis being 1% of the billing as per Legal Notice No.36 of 2008.

Annual budgets: The WSP shall adhere to the budgetary levels set in the tariff.
Obligation for payment of Administration Cost and Regulatory levy: The provision made in this tariff for payment of administrative cost and regulatory levy shall be complied with.
Regulatory levy: Specifically, the utility shall remit the regulatory levy on monthly basis being 1% of the billing as per Legal Notice No. 36 of 2008.
Payment of arrears to RVWSB: NAWASSCO and RVWSB shall reconcile the arrears of the administration cost owed to RVWSB and the money paid as per the license of RVWSB and NAWASSCO's Service provision agreement.

Kibwezi—Makindu Water and Sanitation Company Limited (KIBMAWASCO) applied to the Water Services Regulatory Board (WASREB) for a review of tariffs for water services, for the period 2017/18 to 2020/21 as per section 72 (1) (b) of the Water Act, 2016.
Public consultation on the KIBMAWASCO application was carried out between 10th November and 17th December, 2017, with a public consultation meeting held on 17th December at Kambua Guest House in Kibwezi; and a report submitted to WASREB in accordance to the

requirements of section 139 of the Water Act, 2016. in response to a call for comments published on 19th January, 2018 by WASREB, and with a closing date of 19th February, 2018, no comments were received.
After considering the application, the written and oral submissions by all stakeholders during the consultation period, and based on latest available data, WASREB has determined an upward tariff review for KIBMAWASCO is justified in order to improve service delivery, operate sustainably and protect consumer interests by meeting the tariff conditions outlined below.
WASREB gives a one (1) month's notice to all existing and potential customers of KIBMAWASCO that the approved tariffs for the four financial years, 2017/18,2018/19 9 2019/20 and 2020/21 shall be as follows:

GUIDELINES ON THE USE OF INTERNET OF THINGS (loT) DEVICES
NOTICE is given for information of the general public and all stakeholders using or intending to use Internet of Things (loT) devices, Machine-to-Machine (M2M) based devices and devices with embedded Universal Integrated Circuit Card (eUICC), that the Communications Authority of Kenya has issued the following Guidelines on the Use of Internet of Things Devices in Kenya effective from the date of publication of this Gazette Notice.
The Communications Authority of Kenya ("the Authority") issues the following guidelines on the Use of Internet of Things (loT) Devices in Kenya.
These Guidelines apply to:
1.1 Internet of Things (loT) devices 1.2 Machine-to-Machine (M2M) based devices and 1.3 Devices with embedded Universal Integrated Circuit Card
(eUICC).
The terms used in these Guidelines have the same meaning as in the Kenya Information and Communications Act, 1998 (Act) and the International Telecommunication Union (ITU) unless where the context otherwise requires.

Type Approval of devices with embedded Universal Integrated Circuit Card (eUICC) will be undertaken
3.1 In accordance with the Kenya Information and Communications (Importation, Type Approval and Distribution of Communications Equipment) Regulations, 2010.
3.2 Devices with eUICC shall be required to comply with the GSMA RSP Architecture Version 2.014 of October 2016 and its successors.
Where Internet of Things (loT) and Machine-to-Machine (M2M) devices require the use of Mobile Station International Subscriber Directory Number (MSISDN), they shall be assigned numbering in accordance with the Kenya Information and Communications (Numbering) Regulations, 2010.
4.1 The numbers to be assigned for JoT and M2M devices shall be on a 15-digit numbering range (+254 xxx xxxxxxxxx).
4.2 The 15-digit number shall be in accordance with ITU-T Recommendation E.164 and shall have provisions for all subscriber facilities including but not limited to number portability, caller line identification (CLI) and access to emergency services.
The activation of loT and M2M devices and devices with eUICC shall be subject to subscriber registration in accordance with section 27 of the Act and the attendant Kenya Information and Communications (Registration of SIM-Cards) Regulations, 2015.
The Authority may review these Guidelines from time to time.
These Guidelines shall become effective from the date of publication in the Kenya Gazette.

8.6 ADVISE MIGORI COUNTY GOVERNMENT ON HUMAN RESOURCE MANAGEMENT AND DEVELOPMENT
This is one of the functions of the Board according to section 59, 1 (h) of the County Governments Act, 2012. In order to perform this function;

8.8 ADVISE MIGORI COUNTY GOVERNMENT ON IMPLEMENTATION AND MONITORING OF PERFORMANCE MANAGEMENT
This is one of the function of the Board according to section 59, 1 (I) of the County Governments Act, 2012. In order to perform this function, the Board has carried out the following activities:
The Board participated in the performance contracting workshop at Annex in Migori County. The participants in the workshop were Board Members, County Executive Committee Members (CECM) and the County Secretary. The objective of the workshop was to build the capacity of the participants to fully understand and implement the performance contract approach as a critical tool in improving service delivery through skills transfer, case studies and sharing of experience.
The Board has advised Migori County Government on performance Management Systems in Migori County. The Board will ensure that all employees in Migori County are on performance contract.
The board participated in a performance management course on 23rd to 26th November, 2016 at Flamingo Hotel Mombasa by CPF (Lap trust).
8.9 RECOMMENDATIONS TO SRC ON THE REMUNERATIONS PENSIONS AND GRATUITIES
This is one of the function of the Board according to section 59, 1(j) of the County Governments Act, 2012. In order to perform this function, the Board has organized and participated in the following activities-
The Board participated in a workshop at Kenya School of Government organized by the Salaries and remuneration commission for board members from various counties at the Kenya school of government, Nairobi.
The Board participated in this workshop organized for all the Public Service Board members drawn from all the counties. This was at Whitesands Hotel, Mombasa. In attendance was the LAPTRUST which also sensitized Board members on the Management of pensions and gratuities.
The Board participated in a workshop organized by the LAPTRUST Fund in Kisumu in which the Board members were taken sensitized Board members on the Management of pensions and gratuities.
The Board will conduct salaries survey in the year 2016/2017 to determine Salaries Pensions and then make recommendations to SRC
The Board participated in Job Evaluations in conjunction with Price Water House Coopers to advice Salaries and Remunerations Commission
9.0 RECOMMENDATIONS
On the basis of the findings and conclusions the Board made the following recommendations:

That Migori County Government undertake County Civic education forums to sensitize the Public on the Constitution of Kenya 2010, and County Government Act, 2012. The mandate on Migori County Public Service Board, Gender mainstreaming, Rights of Persons With Disabilities (PWDs).
That Migori County Government should support and encourage women and youth to organize Self- Help Groups and Co-operatives
That Migori County should conduct Baseline Survey on impact of Women Enterprise Development Fund (WEDF) on the Economic empowerment of Women in Migori County
That Baseline survey be conducted on the impact of Youth Enterprise Development Fund (YEDF) on the economic empowerment of youth in Migori County.
That National Values and Principles of Public Service, together with the rights enshrined in the Constitution should be mainstreamed in the activities of all departments in Migori County.

That Migori County Government ensure that there is public participation and stakeholder's engagement in the development of bills, policies, strategic plans, work plan and budget for the County. Public participation should be incorporated in all public processes.

That the youth, women, PWDs and marginalized groups should be involved in activities in Migori County.
That Migori County should accelerate the rate at which Bills are being developed and presented to County Assembly.

That a database of PWDs, women and youth capturing their qualifications and experience should be established in Migori County.
That Migori County should promote equality and freedom from discrimination in accordance with Article 27 of the Constitution of Kenya.

NOTICE is given to all residents and stakeholders of Wajir County that pursuant to the Physical Planning Act, Cap. 286, Urban Areas and Cities Act, Cap. 275 and the County Governments Act, 2012, that the County Government of Wajir intends to prepare the integrated strategic urban spatial development plans that will guide the growth and development of Bute, Eldas, Griftu, Hadado, Habaswein, Khorof-Harar and Tarbaj towns for a period of ten (10) years.
The purpose of the plans is to prepare a framewok that will promote integrated social economic development of these towns. INVITATION OF PUBLIC COMMENTS
Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.
The proponent, Devki Steel Mills Limited, is proposing to install and operate a steel milling plant where already manufactured steel will be reprocessed into various construction steel products. The proposed plant is designed to produce a total capacity of 300,000 tons of steel products per annum. It will consist of storage yard, 32 MW captive power plant, SMS and rolling mill. Support installations will include the following:
• Workshop—To cater for the day to day repairs and maintenance works.
• Fuel oil complex—To be used for fuel storage and lubrication
• Laboratory—For quality control, to cater for metallurgical and mechanical testing at rolling stages.
• Site buildings—These will include: Guest house, canteen, mosque and storage facilities.

THE following notes are for the guidance of persons submitting "copy" for inclusion in the Kenya Gazette, Supplement, etc.:
The Kenya Gazette contains Notices of a general nature which do not affect legislation. They are, therefore, submitted to the Government Printer directly.
Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney-General.
Bill Supplement contains Bills which are for introduction in the National Assembly.
Act Supplement contains Acts passed by the National Assembly.
All "copy" submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typewritten with double spacing. Copy should be clear, legible and contain no alterations.
Particular attention should be paid to the following points:
Signature must be supported by rubber-stamping or typing the name of the signatory in capital letters.
Must be correct and filled in where necessary.
Care should be taken to ensure that all headings to Notices and references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

"0 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.
(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.
It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
