Do-it-yourself debt collection
• The reminder– Unlimited, as long as it is not harassment under
the criminal code– Maximum 3 reminders fees of 100 DKK. Fees are
free of VAT– Minimum 10 days between every reminder that
includes a reminders fee
Do-it-yourself debt collection
• The warning– Before beginning debt collection (outside of
reminders), you need to send a ”warning of debt collection” in accordance with the Danish debt collection law § 10. • You will need to read the §, since the requirements are
quite strict, and you might lose your claim for collection costs, if you do not warn correctly.
Do-it-yourself debt collection
• Bailiffs court- If the debtor still does not pay, you may send the
case to bailiffs court - Bailiffs court charges a fee to handle the case, and
gives you the legal means to try to force payment - NB: Bailiffs court will not handle the case for you,
so you will still need to know the general collection laws
Do-it-yourself debt collection
• Recommendation– Do not attempt the debt collection on your own,
unless you are willing to take the time to understand the rules
– Bad/wrong debt collection can in the worst cases cause you to lose your claim
What not to do
• Do not harass the debtor• Do not threaten the debtor• Do not contact the debtor face-to-face
without prior warning
• Do not take it personal
