CF 10.4 Prior to the City Council public comment updates,

City Manager Moreno provided the following general updates. City Manager Moreno reported that the City received a notice from Golden State Water Company, who provides water service for approximately 300 homes in Paramount north of the 105 freeway, advising that recent water testing at one of its wells detected levels of PFOA and PFOS that were above the State’s precautionary notification level; however, the levels were lower than the State’s response level which could require a shutdown of the well.

City Manager Moreno also reported that the City is working with Los Angeles County Department of Health Services in preparation for the COVID-19 vaccine rollout and to secure additional local testing sites for the community. City Manager Moreno responded to comments made by Alfredo Banuelos at the December 15, 2020 City Council meeting.

Planning Director Carver gave the report and presented a PowerPoint Presentation on both items 10a and 10b. Mayor Lemons opened the public hearing asked if there was anyone wishing to testify. City Clerk Luce

Mayor Lemons expressed concern regarding possible parking impacts that could be created by the proposed development and asked if it would be possible to place a condition on the approval to address any potential negative parking impacts given that the City is contributing funds to the project to provide a percentage of low to moderate income housing availability. Discussion ensued concerning parking impacts and ways to address those impacts. City Attorney Cavanaugh stated that a condition could be included in the the Resolution approving the General Plan Amendment to address potential parking impacts. There being no one wishing to testify, it was moved Vice Mayor Olmos and seconded by Councilmember Cuellar Stallings to close the public hearing. Assistant City Manager Vialpando gave the report stating that the applicant has requested that the City Council continue the public hearing for consideration of Ordinance No. 1143 to the February 2, 2021 meeting of the City Council to allow the applicant additional time to review the agreement. Mayor Lemons opened the public hearing and stated that this is the time and place for the hearing of objections to the renewal of the Pipeline Franchise Agreement with Pacific Pipeline System, LLC. City Manager Moreno announced that notice of this hearing has been given pursuant to Section 6232 of the California Public Utilities Code and that no objections have been received. Mayor Lemons asked if there was anyone wishing to testify on this item. City of Paramount Code of Conduct and Rules of Decorum and Procedures for the Conduct of City Council Meeting

City Manager Moreno gave the report on both items 12a and 12b. Vice Mayor Olmos asked for clarification regarding enforcement of the Code of Conduct and asked if the enforcement procedures apply to members of appointed board and commission as well as council members.

City Attorney Cavanaugh confirmed that the due process procedures included in the enforcement section apply to all Public Officials, but the enforcement procedures vary depending on whether the public official is elected or appointed.

Assistant City Manager Vialpando and Management Analyst Elizarraras gave the report and presented a PowerPoint presentation. Mayor Lemons expressed concern that switching to a completely internet reliant VOIP phone system could impact the City’s ability to serve the community if internet service goes down. In response to her

concern about the reliability of the City’s internet service, Assistant City Manager Vialpando stated that leading up to this project, the City has completed a number of internet infrastructure improvements at City Hall and other facilities which increase the City ‘s ability to support such a phone system. In further response to the Mayor’s concerns regarding reliability of the service and back-up options in the event of an internet outage, Management Analyst Elizarraras stated that the proposed supplier, LogMeIn, Inc. has several layers of redundancy built into their system including the use of cellular data if necessary, and a backup analog system in the event of catastrophic internet outage. It was moved by Vice Mayor Olmos and seconded by Councilmember Cuellar Stallings to approve the terms of service with LogMeIn, Inc. for telecommunications services for a three-year term with the option to renew for additional one-year terms, at the discretion of the City Manager, in an amount of $34,275.51 for the first year, and $29,002 per year thereafter, and authorize the City Manager or designee to execute the agreement. COMMENTS/COMMITTEE REPORTS

Councilmembers

Vice Mayor Olmos reported that the Contract Cites Association is working with the County of Los Angeles on COVID-19 distribution plans on behalf of its member cities. She reminded her colleagues that the CCCA Legislative Tour starts this week and will take place virtually over the next three Thursdays. She also reviewed the League of California Cities’ 2021 focus areas which include housing, relief funding and broadband access.

Vice Mayor Olmos suggested that the City focus on a public education campaign to encourage the community to help keep Paramount clean. She also asked staff to provide an update on the community garden program at the next City Council meeting. She further suggested that the City share the COVID-19 vaccine resource information recently provided by Supervisor Janice Hann’s office through the City’s website and social media outlets. Lastly, she reminded the community to continue to wear a mask and limit gatherings to help slow the spread of COVID-19. Councilmember Aguayo reiterated Vice Mayor Olmos’ reminder to all residents to do what they can to reduce the spread of COVID-19 in the community including staying home when you can, wearing a mask and being diligent in washing your hands. In light of the recent unrest in the Nation’s Capital, she also reminded residents to be kind to one another during these difficult times in our Nation’s history. Councilmember Guillen concurred with Vice Mayor Olmos about the litter and trash around the community lately and encourage everyone to do their part. She thanked the City Manager for sharing the information about Golden State Water Company’s water testing results earlier this evening and suggested that the information be added to the City’s environmental website. She also suggested that the World Energy settlement information be shared on the website as well. Councilmember Cuellar Stallings reported that at the Gateway Cites Council of Governments meeting the Board was introduced to the new Cal Trans District Supervisor and heard a presentation from South Coast AQMD on the new Clean Fleet transportation program. Lastly, she thanked Bellflower Councilmember Victor Sanchez and the non-profit organization Community Family Guidance Center for selecting two Paramount restaurants to receive funds to provide food

assistance to a number of local families using the funds allocated by Supervisor Janice Hahn. Staff City Manager Moreno reported that the City is continuing its efforts to combat illegal street racing in the community and provide an update on recent successes that the LASD Lakewood Station Task Force dedicated to this objective has seen. He also reported that the Governor recently released the draft State budget which did not allocate any additional funding to cities for COIVID-19 assistance. He noted that the League of CA Cites will be advocating for funding on behalf of the cites, and will be calling on cites to help with the advocacy efforts. He also provided an update on the status of the upcoming Tierra Mia development project. Lastly, he reported that the information about the World Energy settlement has been posted to the City’s environmental website and the information from Golden State Water Company will be posted soon.

At 8:23 p.m. Mayor Lemons recessed the City Council meeting to convene the meeting of the Successor Agency for the Paramount Redevelopment Agency.

Councilmember Guillen suggested including language in the agreement that would provide assurance that the consultant will complete the scope of work within the specified amount of time and within the budgeted amount. Assistant City Manager responded that staff will work with the consultant to ensure both objectives are met. It was moved by Vice Mayor Olmos and seconded by Councilmember Guillen to approve a budget adjustment in the amount of $35,000 to retain a qualified consultant to conduct an Employee Compensation Analysis. 3. ORAL REPORT

Paramount Works App Overview CF 84, CF 43.1004

Assistant Public Works Director Ho gave the report and presented a PowerPoint presentation providing an overview of the Paramount Works App, including a demonstration on how the mobile application works and how it is used to respond to requests submitted by the community. Vice Mayor Olmos and Mayor Lemons both expressed appreciation to staff for implementing this useful tool for the community.

COMMENTS/COMMITTEE REPORTS

Councilmembers

Councilmember Guillen reminded everyone to stay home and stay healthy, and commented that her heart goes out to those that have suffered from or lost their lives because of the pandemic. She also reported that she has been attending the meetings about the Metro expansion project and the project is going along as planned. Councilmember Aguayo commented that she is attending the CalCities New Mayors/Councilmembers Academy and appreciates the opportunity to learn and hear from councilmembers from other cities. She also commented that she attended her first Greater Los Angeles County Vector Control District meeting and was amazed at the amount of information provided. She also reminded everyone to continue to be diligent about doing what they can do to limit the spread of COVID-19, especially as local health order restrictions are being lifted.

Vice Mayor Olmos expressed appreciation to the Community Services & Recreation team for making the extra effort to call the City’s senior population to assist in getting appointments to get the COVID-19 vaccine. Mayor Lemons also expressed her appreciation to the City Manager and the Community Services & Recreation team for their efforts in assisting residents with making and getting to vaccination appointments. She also reported that she attended today’s Los Angeles County Board of Supervisors meeting and encouraged the Board to include a distribution site in the City of Paramount for the COVID-19 vaccine. Staff City Manager Moreno stated that staff will bring an item to the February 2 City Council meeting to provide an update on the City’s efforts regarding vaccine distribution. He also provided an update on the Clutter Free Paramount event that took place on Saturday stating that 291 vehicles participated in the event and 19 tons of bulky items were collected. He also reminded residents about the upcoming workshops on the City’s Housing Element and Environmental Justice Element scheduled for February 1 (English) and February 3 (Spanish) from 6:00-8:00 p.m. Lastly, City Manager Moreno stated that a public comment request to address Item 1 was received from Alfredo Banuelos; however, it was received at 5:10 p.m. and the City Council had already taken action on the item and moved on to Item 2. He asked the Mayor how she would like to handle the request. The Mayor asked staff to inform Mr. Banuelos that the public comment period for that item closed before public comment request was received.

Subject: TREASURER’S REPORT FOR THE QUARTER ENDING DECEMBER 31,

2020 Background The City’s Finance Department is responsible for managing the cash and investment portfolio for the City, Successor Agency for the Paramount Redevelopment Agency, and Paramount Housing Authority. All funds are invested according to Section 53601 of the California Government Code and the City’s Investment Policy, which is annually revised and approved by the City Council. Cash Management Objectives The City’s investment objectives are to preserve the safety of funds and to maintain an adequate level of liquidity to meet anticipated expenditure demands. Investments are made in short term instruments where they earn competitive yields while maintaining safety and liquidity as primary objectives. As of December 31, 2020, total cash and investments equaled $29,419,417. Of this amount, $27,722,711 has same day liquidity. This comfortably ensures that sufficient funds are available to meet the City’s expenditure requirements for at least the next six months. As of December 31, 2020, the investments held by the City had a market value of $22,463,753. Compliance All investment transactions have been executed in conformance and compliance with the City’s adopted annual investment policy and California Government Codes. This report satisfies the reporting requirements of both the Government Code and the City’s Investment Policy RECOMMENDED ACTION It is recommended that the City Council receive and file the Treasurer’s Report.

Subject: ORDINANCE NO. 1148/ZONE CHANGE NO. 230 16675-16683 PARAMOUNT BOULEVARD Background This item is a request by Nima Golshani to change the official Zoning Map from C-3 (General Commercial) to PD-PS (Planned Development with Performance Standards)/ Mixed-Use Commercial and Senior Assisted/Independent Living Facility at 16675-16683 Paramount Boulevard in the C-3 (General Commercial) zone. This item is associated with Resolution No. 21:003/General Plan Amendment No. 20-2, heard earlier this evening by the City Council. The Planning Commission recommended approval to the City Council of this item at its December 8, 2020 meeting. Project Description The project consists of the construction of a three-story structure at the northwest corner of Paramount Boulevard and 70th Street. The building will contain two retail spaces and parking on the ground floor, residential units on the second and third floors, and a sun deck on the roof. The project area is made up of three parcels and has a total of 13,500 square feet of land. The southern parcel, measuring 14½ feet in width by 100 feet in length, is located in the City of Long Beach. The applicant will be working with the City of Long Beach for approval of that portion of the project. This dual-jurisdictional approval process is similar to a housing project from 2002 near the intersection of Hunsaker Avenue and 72nd Street, where three homes in the development have back yards in Long Beach. In that case, the City of Paramount was the “lead” agency for the entitlements and plan check. The project will contain seven units on the second and third floors, with a total of 12 units for assisted care, and two units for independent living. Four units on each floor will contain three bedrooms, with the remaining three units on each floor containing four bedrooms. The three bedroom units will contain two bathrooms, while the four bedroom units will contain three bathrooms. Each unit will have a shared kitchen and living room. The four bedroom units will range in size from 1,120 square feet to 1,155 square feet, while three bedroom units will contain approximately 1,000 square feet.

In addition to two retail suites on the ground floor, there will be a total of 27 parking spaces for employees and customers of the retail suites. One of the retail suites will contain 900 square feet, while the second suite will contain 1,100 square feet. The commercial spaces will most likely be occupied by tenants that will accommodate the needs of the residential occupants of the project, such as a hair salon or a pharmacy; however, a wide range of retail uses will be permitted in the PD-PS zoning regulations. In addition to the residential units, the second floor will contain an exercise room and an activity room. The third floor will contain a kitchen to prepare meals for residents and a dining room. Finally, the roof of the project will contain a sundeck for use by the residential occupants of the building. The facility will have a total of 48 employees, with an average of 15 people per shift. Employees will include:

The minimum age to reside in the complex is 55. The City will be contributing $300,000 from the Low-to-Moderate Income Housing fund to help with the construction of the project. Given this contribution, two of the 14 units will be designated for low-to-moderate income residents. Summary The applicant is requesting a zone change that will allow for the development of a mixed-use project that will provide assisted and independent living units, with two retail suites. With an aging population that is living longer, there is a growing need for projects such as this proposal. The approval of the project will help to meet an existing market demand for assisted/independent living facilities for seniors. As the location is near amenities including the public library, the Civic Center gardens, and shopping opportunities such as Northgate Gonzalez Market, it is well suited for an older population with limited mobility. Finally, the proposed development will eliminate blight at the southern entrance into the City. Environmental Assessment The City Council reviewed a Mitigated Negative Declaration for this project in connection with Resolution No. 21:003/General Plan Amendment No. 20-2.

THE CITY COUNCIL OF THE CITY OF PARAMOUNT DOES HEREBY ORDAIN

AS FOLLOWS:

SECTION 1. The Recitals set forth hereinabove are true and correct and incorporated herein by reference as if fully set forth herein. SECTION 2. Purpose and Findings. The City Council finds and declares as follows:

WHEREAS, California Constitution Article XI, Section 7, enables the City of Paramount (“the City”) to enact local planning and land use regulations; and

WHEREAS, the authority to adopt and enforce zoning regulations, including the location and boundaries of the various zones shown and delineated on the Official Zoning Map of the City, is an exercise of the City’s police power to protect the public health, safety, and welfare; and

WHEREAS, the City desires to ensure that development occurs in a prudently

effective manner, consistent with the goals and objectives of the General Plan as updated and adopted by the City Council on August 7, 2007 and reasonable land use planning principles; and

WHEREAS, the Planning Commission held a duly noticed public hearing on December 8, 2020 at which time it reviewed criteria for amending the Zoning Map, considered all evidence presented, both written and oral, and at the end of the hearing voted to adopt Resolution No. PC 20:037, recommending that the City Council adopt this Ordinance; and

WHEREAS, the City Council held a duly noticed public hearing on this Ordinance on January 12, 2021, at which time it considered all evidence presented, both written and oral.

defined in Section 51.3 of the California Civil Code, excluding the first (ground) floor of a building, provided the first floor contains commercial uses.

2. Animals. Dogs and cats as household pets within approved housing units, provided that the total number is any combination thereof shall not exceed two per housing unit. Livestock, including cattle, sheep, goats, horses, rabbits, rodents, poultry, fowl, and pigeons are prohibited.

3. Home garden. A home garden is permitted as a complement or accessory

to a completed development project. 4. Home occupation. A Home Occupation Permit may be granted pursuant

to Section 17.08.020 of the Paramount Municipal Code for residents in approved housing units.

5. Parking structure. A parking facility is permitted as a complement to a

mixed-use commercial and senior assisted and senior independent living facility.

6. Signs. Signs that comply with the Central Business District Design

Standards are permitted with Planning Department review and approval of a sign plans.

6. Satellite dish. The installation of a satellite dish shall not be visible from a public street.

7. Pole/antennae. No television or radio poles, antennae, or other external

fixtures other than those originally installed by the developer and any replacements thereof, shall be constructed, erected, or maintained.

8. Clotheslines. Clotheslines shall not be visible from the public right-of-way. 9. Trash/recyclables. Trash, recyclables, garbage, or other waste shall be

kept only in sanitary containers that shall be stored in a location so as not to be visible from the public right-of-way. All of said aforementioned containers shall be kept and maintained within the walls of the designated trash room of the approved building except when being emptied by a collector.

10. Storage. The storage or accumulation of junk, trash, and other offensive

or noxious materials is specifically prohibited. No burning on any lot shall be permitted except in fireplaces or barbecues, if any. No lumber, metals, machinery, equipment or building materials shall be kept, stored, or allowed to accumulate. Tenant storage shall be limited to the accessory storage on the premises and shall be within the approved and enclosed building.

11. Modifications. No alterations or modifications to the exterior of the

buildings, fences, railings, walls or other improvements constructed on the lot, and no changes to the grade or drainage pattern of the lot, shall occur without the prior consent of the Planning Director.

12. Home gardens. Edible plant materials shall be promptly harvested and

removed when mature or ripe. Plants not harvested for consumption shall be promptly removed or tilled into the soil. Planting areas fallowed between growing seasons shall be covered with mulch or similar material or otherwise maintained in clean condition until the next planting period. Weeds shall be promptly removed. Actions shall be taken to prevent and eliminate pests.

Development standards: 1. Setbacks. Building setbacks are to be as shown on the submitted site plan

and made by reference a part of this zone change. 2. Parking. Vehicular parking shall be provided and accessible as shown on

the approved site plan. 3. Signage. Signs that comply with the Central Business District Design

Standards are permitted with Planning Department review and approval of a sign plans.

4. Mailboxes. Mailboxes shall be installed by the developer and maintained in perpetuity. Fences, etc. Perimeter fencing requires separate Planning Department review and approval.

5. Security bars. No wrought iron, metal, steel, etc. security bars shall be

installed on exterior of any window. All exterior doors must be able to open without special knowledge or tools.

6. Tarps. The use of tarps is prohibited. 7. Landscaping/irrigation. Landscaping and irrigation shall comply with the

Water-Efficient Landscape Provisions of the Paramount Municipal Code. 8. Security wire. No barbed wire, concertina wire, razor wire or cut glass shall

be installed. 9. Business entrances. Ground floor tenant spaces shall have their primary

entrance located adjacent to the public street or sidewalk. Compliance with Chapter 17.72 of the Paramount Municipal Code relating to the PD-PS (Planned Development with Performance Standard) zoning. This zone change shall comply with all conditions set forth in Chapter 17.72 of the Paramount Municipal Code dealing with the PD-PS (Planned Development with Performance Standards) zone. SECTION 4. California Environmental Quality Act (CEQA). The City Council

adopted a Mitigated Negative Declaration for this project in connection with Resolution No. 21:003/General Plan Amendment No. 20-2.

SECTION 5. Severability. If any section, subsection, sentence, clause or phrase

in this ordinance or the application thereof to any person or circumstance is for any reason held invalid, the validity of the remainder of the ordinance or the application of such provision to other persons or circumstances shall be adopted thereby. The City Council hereby declares it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses, or phrases or the application thereof to any person or circumstance be held invalid.

SECTION 6. Effective Date. This Ordinance shall take effect thirty days after its adoption, shall be certified as to its adoption by the City Clerk, and shall be published once in the Paramount Journal within 15 days after its adoption together with the names and members of the City Council voting for and against the Ordinance.

RENEWAL OF PETROLEUM PIPELINE FRANCHISE AGREEMENT WITH PACIFIC PIPELINE SYSTEM, LLC

Situated adjacent to a global economy of petroleum and natural gas ports, the City of Paramount sits atop a robust network underground pipelines that run throughout Southern California and are maintained and operated by various petroleum franchises. Most of the petroleum pipelines originate many miles outside of Paramount but run beneath our City as part of a complex network of pipeline carrying product destined for larger ports in Long Beach and Los Angeles. Pipelines that run within the State of California are regulated by the California Public Utilities Commission (CPUC). Federal and State law preempts the City from regulating the operation, design and construction of pipelines. However, the City is entitled to franchise fees paid for directly by the franchisees. Pipeline fees are set forth in CPUC Code Section 6231.5(3) and are based on the length and diameter of the pipeline, adjusted each year according to the Consumer Price Index (CPI). For over 40 years, the City of Paramount has maintained a Franchise Agreement with various petroleum service companies for the operation of gasoline pipeline No. 63. Line No. 63 runs about 5,700 feet in length under El Camino Avenue, Alondra Boulevard, San Jose Avenue, and Ansmith Avenue. This pipeline has changed ownership over the years and is now serviced by Pacific Pipeline System, LLC (Pacific Pipeline). The Franchise Agreement for Line No. 63 expired in May 2019, and Pacific Pipeline has requested to renew the pipeline franchise for an additional 20 years. Pacific Pipeline is presently current in all its franchise payments, which are paid annually. According to the fee structure established by the CPUC, the estimated fee for Pacific Pipeline in 2021 is approximately $3,800, and will increase according to the CPI in subsequent years. It benefits the City to enter into a Pipeline Franchise Agreement so that we maintain some control and understanding in how they are maintained. For example, some of the provisions that are included in Franchise Agreements are that the franchisee must provide the City with copies of all environmental reports they file with environmental agencies; immediately notify the City in the event of a spill or environmental or safety threat; and, remediate damage according to applicable environmental laws.

Franchisees are strictly liable for all damage caused in connection with the use or operation of a franchise, or by any pipeline or other facility failure. This strict liability language under the CPUC Code is expressly included in the Franchise Agreement. As laws, regulations, development patterns, safety practices and pipeline technology change, staff recommends renewing the Agreements with Pacific Pipeline. The City Council may enter into a Franchise Agreement by Ordinance, which requires a Public Hearing, and adoption at a subsequent meeting by the City Council. A Notice of Public Hearing for Ordinance No. 1143 was posted in the Paramount Journal on December 24, 2020 announcing a Public Hearing originally set for January 12, 2021, but was continued by the City Council this evening. RECOMMENDED ACTION It is recommended that the City Council read by title only, waive further reading, introduce Ordinance No. 1143, and place it on the February 16, 2021 agenda for adoption. ORDINANCE NO. 1143

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARAMOUNT RENEWING THE PETROLEUM PIPELINE FRANCHISE AGREEMENT WITH PACIFIC PIPELINE SYSTEMS, LLC

WHEREAS, Section 6202 of the California Public Utilities Code (CPUC), which was created in response to the Franchise Act of 1937, authorizes the legislative body of any municipality to grant a franchise to any person, firm, or corporation, whether operating under an existing franchise or not, to use, or to use, or to lay and use, pipes and appurtenances for transmitting and distributing gas or industrial gas for all purposes, or to use, or to lay and use, pipes and appurtenances for transmitting and distributing oil or products thereof for all purposes, under, along, across, or upon the public streets, ways, alleys, and places within the municipality, upon the terms and conditions provided in this chapter; and WHEREAS, Section 6231(c) provides that the municipality is entitled to a franchise fee for any such operation of a pipeline that runs within its boundaries, pursuant to fees established in Section 6231.5(a) of the CPUC; and WHEREAS, in 1999, the City Council for the City of Paramount (“City”) adopted Ordinance No.904 establishing such a franchise fee through a Pipeline Franchise Agreement with Atlantic Richfield Company to operate Line No. 63, later assigned to Pacific Pipeline System, LLC., which is codified in Section 4.16, Article V of the Paramount Municipal Code (“Municipal Code”); and WHEREAS, the Pipeline Franchise Agreement with Pacific Pipeline System, LLC. expired in May 2019; and WHEREAS, Pacific Pipeline System, LLC. has submitted a request to the City to renew its Pipeline Franchise Agreement for operation of Line No. 63. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PARAMOUNT DOES ORDAIN AS FOLLOWS:

SECTION 1. The Recitals set forth hereinabove are true and correct and incorporated herein by reference as if fully set forth herein.

SECTION 2. The City Council hereby reauthorizes the Petroleum Pipeline Franchise Agreement with Pacific Pipeline System, LLC., as codified in Section 4.16, Article V of the Municipal Code, which shall be replaced in its entirety with the following:

Article 5. Pacific Pipeline System, LLC.

4.16.470 Grant of franchise. The City hereby grants to Pacific Pipeline System, LLC., its successors and assigns, hereinafter referred to as “grantee” subject to the terms and conditions herein contained, the right, franchise and privilege from time to time, for a period of twenty (20) years from and after the effective date of Ordinance No. 1143, to install, operate, maintain, replace, change the size of, abandon in place and/or remove pipelines for transportation of oil, gas, gasoline, petroleum, wet gas, hydrocarbon substances, water, waste water, mud stream or other substances transportable by pipeline together with all appurtenances and service connections necessary or convenient to properly maintain and operate said pipelines, including cathodic protection facilities for the grantee’s business, hereinafter collectively called “franchise property,” within the public streets, highways, alleys and other public ways or public property, hereinafter collectively called “streets,” of the City, as enumerated and described as follows: All that portion under El Camino Avenue, Alondra Boulevard, San Jose Avenue, and Ansmith Avenue. The total length of this pipeline is 5,700 linear feet.

4.16.480 Term of franchise. This franchise shall expire twenty (20) years from and after the effective date hereof unless sooner terminated, by ordinance, as herein provided. City reserves the right to terminate this franchise to its expiration date in the event:

A. Grantee fails to comply with any provisions hereof; provided, however, that if such failure of compliance shall be due to a cause beyond the reasonable control of grantee, the franchise shall not be so terminated. In the event grantee shall default in the performance of any of the terms, covenants or conditions herein and such default is curable, City shall give written notice to grantee to commence within ten days the work necessary to cure such default, and if grantee fails to comply with such notice, City may terminate this franchise.

B. The time within which grantee is obligated to commence, perform or complete any obligation hereunder shall be extended for a period of time equal in duration to, and the commencement, performance or completion in the meantime shall be excused on account of and for and during the period of, any delay caused by strikes, threats of strikes, lockouts, war, threats of war, insurrection, invasion, acts of God, calamities, violent action of the elements, fire, action or regulation or any governmental agency, law or ordinance, impossibility of obtaining materials, or other things beyond the reasonable control of grantee.

The City shall give the grantee thirty (30) days notice of any termination proceedings. 4.16.490 Compensation to City. As consideration for the franchise granted herein, the Grantee shall pay to the City the following fees:

A. Base annual fee: A base annual fee shall be paid within 60 days after the end of each calendar year and during the life of the franchise for each and every year, including the year of granting the franchise, according to the "franchise payment

period" as set forth in California Public Utilities Code Section 6231.5 (3), by multiplying the pipe length expressed in feet by the applicable base rate as follows:

For pipelines with an internal diameter not listed above, the fees shall be in the same proportion to the fees of a twelve (12) inch diameter pipe as the diameter of the unlisted pipe is to twelve (12) inches. The formula used in arriving at the annual fee shall apply to any existing, replacement, modification or extension of the pipeline.

B. Adjustments:

1. The amount of the fee provided for in subsection (a) of this Section, shall be adjusted at the time payment is due by multiplying the base fee by the “Consumer Price Index, All Urban Consumers for the Los Angeles - Anaheim - Riverside” area as published by the United States Department

of Labor, Office of Information for the month of September immediately preceding the month in which payment is due and payable, and divided by the “Consumer Price Index for June 30, 1989 = 100.0.”

2. In no event shall an annual fee be charged which is less than the base annual fee amount established by subsection (a) of this Section.

3. The indices specified in paragraph 1 of this subsection (b) are calculated and published by the United States Department of Labor, Bureau of Labor Statistics. If the Bureau discontinues the calculation or publication of the “Consumer Price Index, All Urban Consumers for the Los Angeles - Anaheim - Riverside area for June 30, 1989 = 100.0,” and no transposition table is available to convert to another index, then the amount of each annual adjustment in base fees shall be computed by using a comparable governmental index.

C. Proration of payments: In the event of abandonment of facilities, or in the event of

removal of such facilities by the Grantee, or in the event of the grant of a franchise with an initial franchise payment period of less than one year, the annual franchise fee required under subsections (a) and (b) of Section 4 shall be prorated for the calendar year in which such removal or abandonment or grant occurs as of the end of the calendar month in which removed, abandoned or granted.

4.16.500 Construction. A. Location of franchise property. The location of any franchise property installed

hereunder shall be first approved by the Public Works Director.

B. Quality control. All franchise property installed and maintained hereunder shall be constructed in a good workmanlike manner and in conformity with all ordinances, rules or regulations now or hereafter adopted or prescribed by the City. All pipelines installed shall conform to applicable U.S.A. Standard Code for Pressure Piping, in its latest revision.

C. Street excavations. Grantee shall have the right to make all necessary excavations in the streets for the purposes granted in this franchise, but nothing herein contained shall relieve grantee from the provisions of any ordinance or law that may be in force at the time, requiring permits to be obtained for street excavations before such work is commenced.

All excavation shall be made and refilled in strict compliance with all City ordinances that may be in effect at the time of the performance of the work and shall be so made as not to interfere unreasonably with the free use of the streets by the public.

Upon completion of the work for which street excavations are made, all portions of the street which have been excavated or otherwise damaged by such excavation work shall be restored to as good condition as they were in before the commencement of such work, to the satisfaction of the Public Works Director.

D. Emergency work. The grantee shall promptly repair any leaks or breaks in pipelines and conduits. If any portion of any street shall be damaged by reason of breaks or leaks in any pipe or conduit constructed under this franchise, the grantee shall at its own expense take immediate steps to repair any such damage and restore such street to as good condition as it was before such a break or leak. The repair must be done to the satisfaction of the Public Works Director. Such emergency repair of franchise property may be commenced without prior permit provided that grantee shall notify the Public Works Director and the Los Angeles County Fire Department’s Hazardous Materials Division as soon as a break or leak occurs. The grantee must still apply to the Public Works Director for a permit for emergency repair work no later than the next business day from the day the emergency occurred. The grantee shall promptly remove any contamination from streets and underground soil due to breaks and leaks of grantee’s pipelines or conduits. The removal of contamination must be performed to the satisfaction of the Los Angeles County Fire Department’s Hazardous Materials Division. Nothing

in the franchise shall be deemed to waive or release any claim the grantee may

have against any third-party arising by reason of breaks or leaks in any pipe or conduit constructed under this franchise.

E. Changes required by public improvements. If the Public Works Director shall determine that it is reasonable and necessary that franchise property be temporarily disconnected, abandoned, temporarily or permanently removed, temporarily or permanently relocated or substitute facilities installed, in order that the City, when acting in a governmental capacity, may relocate, change grade, construct, use, maintain, change or modify any street improvement or City-owned utility facilities, said Public Works Director shall give notice, in writing, to the grantee. Within thirty (30) days after the service of such notice upon the grantee, the grantee shall at its sole cost and expense begin and diligently prosecute the necessary work to completion. Upon failure to do so, the Public Works Director may cause said work to be completed and the grantee shall immediately pay for the same upon presentation of an itemized account of the cost thereof.

In the event that any franchise property is required to be abandoned in or permanently removed from any street or portion thereof affected, the Public Works Director shall approve such additional street location or locations as may be necessary to permit the installation of substitute facilities.

F. Abandonment of franchise property. The public works director, upon such terms and conditions as he may determine, may give grantee permission to abandon, without removing, franchise property installed under the franchise. The length of any pipe line, abandoned with such permission, shall not be considered in calculating payments due under the franchise following the date the public works director or his designated representative has inspected and approved in writing the abandonment work. The ownership of all franchise property so abandoned shall thereafter vest in the City.

4.16.510 Guarantee and responsibility. A. Bond. This franchise is granted on the condition that the grantee shall at all times

during the life of this franchise keep on file with the City a Faithful Performance Bond running to the City in the sum of $5,000.00 executed by a reputable surety entitled to do business in the State of California. The said bond shall contain the conditions that the grantee shall well and truly observe, fulfill and perform each and every term and condition of this franchise, and that in case of any breach of any condition of said bond, the whole amount of the sum therein named shall be taken and deemed to be liquidated damages and shall be recoverable form the principal and from the sureties upon said bond. The provisions of this section shall not exempt the grantee from compliance with any of the laws of the City in force during the term thereof which required the grantee to post a bond other than the bond required by this section.

However, where the grantee desires to show other evidence of financial responsibility for faithful performance, acceptable to the Public Works Director, the above Bond requirements may be waived by said Public Works Director.

B. Indemnification. The grantee, by the acceptances or use of the franchise hereby

granted, agrees to keep and save free and harmless the City, its officers, agents, or employees against any and all claims, demands or causes of action which may be asserted, prosecuted or established against them, or any of them, for damage to persons, or property, of whatsoever nature, arising out of the use by it of the City streets hereunder or arising out of any of the operations or activities of the grantee pursuant to this franchise, whether such damages shall be caused by negligence, excepting therefrom, however, any claim, demand or cause of action, which may be asserted, prosecuted or established against the City under the provisions of the Workman's Compensation Act for injury to, or the death of any of the City's officers, agents, or employees while acting within the scope of their employment and further excepting therefrom any claim, demand, or cause of action arising out of the negligence of the City, its officers, agents, and/or employees.

C. Avoidance of liability of City. The grantee shall further deposit with the City clerk a certificate of insurance naming the City as additionally insured in connection with this franchise, in the principal amount of at least ten million dollars ($10,000,000).

4.16.560 Franchise not assignable. Grantee shall not permit any right or privilege granted by the franchise to be exercised by another, nor shall the franchise or any interest therein or any right or privilege thereunder by in whole or in part sold, transferred, leased, assigned, or disposed of except to a corporation, merger, or reorganization, or to a subsidiary of grantee, or to any person, firm or corporation without the consent of the City expressed by resolution; provided, however, that the provisions of the franchise shall not require any such consent and no consent shall be required for any transfer by grantee in trust or by way of mortgage or hypothecation covering all or part of grantee's property, which transfer, mortgage or hypothecation shall be for the purpose of securing an indebtedness of grantee or for the purpose of renewing, extending, refunding, retiring, paying or canceling in whole or in part any such indebtedness at any time of from time to time. Any such sale, lease, assignment, or other disposition of this franchise, whether requiring the consent of the City or otherwise, shall be evidenced by a duly executed instrument in writing filed in the office of the City clerk within thirty days after such sale, lease, assignment, or other disposition. In addition, if the requested assignment is to an affiliate or to a joint venture in which grantee is a partner, the City shall not unreasonably withhold its consent to such assignment. 4.16.570 Filing of maps. Within ninety days following the date in which any franchise property has been installed, relocated, removed or abandoned under this franchise, the grantee shall file a map or maps in such form as may be required by the public works director showing the location, length, and size of all such facilities so installed, relocated, removed, or abandoned. 4.16.580 Acceptance. This franchise is granted and shall be held and enjoyed only upon the terms and conditions herein contained, and the grantee shall, within thirty (30) days after the adoption of this Ordinance granting said franchise, file with the City Clerk of the City of Paramount a written acceptance of such terms and condition.

SECTION 3. Severability. If any section, subsection, sentence, clause or phrase in this Ordinance or the application thereof to any person or circumstance is for any reason held invalid, the validity of the remainder of the ordinance or the application of such provision to other persons or circumstances shall be adopted thereby. The City Council hereby declares it would have passed this Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses, or phrases or the application thereof to any person or circumstance be held invalid.

SECTION 4. Effective Date. This Ordinance shall take effect thirty days after its adoption, shall be certified as to its adoption by the City Clerk, and shall be published once in the Paramount Journal within 15 days after its adoption together with the names and members of the City Council voting for and against the Ordinance. THE CITY COUNCIL OF THE CITY OF PARAMOUNT DOES HEREBY ORDAIN AS

SECTION 1. Chapters 10.04.010 and 10.04.020 of the Paramount Municipal Code is hereby amended in its entirety as follows:

10.04.010 County Traffic Code Adopted. Title 15 of the Los Angeles County Code, entitled "Vehicles and Traffic," being a code regulating traffic upon public highways, is hereby adopted by reference as the Traffic Code of the City. (Prior code § 29-1)

10.04.020 Penalties - Continuing Violations. A. The first and second violation of any provision of this title may be cited as an

infraction or punished as a misdemeanor. The third such violation shall be punished as a misdemeanor by a fine not exceeding $500 or imprisonment for a term not exceeding six months, or by both such fine and imprisonment. Such violations may also be redressed by civil action.

B. Each day that any violation of this title continues shall constitute a separate offense. (Prior code § 29-1.1)

Notwithstanding any other provision of this chapter, violation of any of the provisions of this chapter incorporating the County Health Code and portions of the County Consumer Protection Code is punishable as misdemeanor by a fine of not more than $500.00 or by imprisonment in the County Jail for not more than six months, or both. Each day during any portion of which any violation herein is committed, or continued to be permitted makes such violation a separate chargeable offense. (Prior code § 24-6)

COVID-19 VACCINATION PREPARATION EFFORTS IN THE CITY OF PARAMOUNT

Background Over the last few weeks, the federal and State Health Departments have made public plans for wide distribution of COVID-19 vaccines to local governments. The plan involves distribution of vaccines from the federal government, down to local Health Departments. The City of Paramount is regulated and served by the Los Angeles County Department of Public Health (DPH). DPH announced that it will start COVID-19 vaccine inoculations in phases based on priority of at-risk populations. DPH has made it clear that there will not be enough vaccines for everyone at the onset of distributions, however their plan is to distribute these limited vaccines in a fair, ethical, and transparent way. Healthcare workers and people living in long-term care facilities (such as nursing homes) will be offered the vaccine first. The county then added residents 65 years old and above to the list of eligible residents. The goal is for everyone to be able to easily get a COVID-19 vaccination as soon as large quantities are available; this may take a few months. Last week, staff met with representatives from Supervisor Janice Hahn’s Office, as well as members of the DPH responsible for Points of Distribution (POD) sites Countywide. The purpose of these meetings was to stress to the County that the City is adamant about being involved in mass distributions and express its desire to host a POD at Paramount Park. The County was appreciative of the City’s efforts and indicated that City resources would be taken into consideration of further POD planning. The County also cautioned that the unpredictable and limited supply of vaccine doses from the federal and State levels is a fundamental issue tempering plans to move forward with additional PODs and micro-distribution sites around the County. The following are two approaches intended to support our residents by ensuring they have access to vaccines as they become widely available.

Temporary Expansion of Medical Taxi Service The City’s current program for taxi-based transit to medical facilities outside the City was created to provide seniors and persons with disabilities the ability to transit approximately five miles outside of Paramount for these out-of-town medical visits. The City subsidizes the cost for each trip up to a maximum of $18.40 per trip, so that residents only pay $2 per trip. The program is available to seniors and persons with disabilities seven days per week between the hours of 6:00 a.m. and 9:00 p.m. Requests for rides are made to an Administrative Services Cooperative dispatch telephone number. Staff is recommending that the City Council approve a temporary expansion of the eligibility for this taxi-based medical transit program to include resident non-seniors that are seeking transportation to a medical facility or a County-approved COVID-19 vaccination site. Staff is also proposing that any trip to obtain the vaccine be provided at no cost to our residents. Currently, a vaccine distribution site located nearby at the Los Angeles County Office of Education in Downey is operating, but it is difficult to obtain an appointment and access to other sites is important in helping our residents obtain the vaccine. The estimated to the cost to the City would be approximately $5,000, paid for by Prop A County transportation funds. Once staff determines that the vaccine is widely distributed locally and more accessible, we will terminate the temporary expansion of eligibility and revert back to the original eligibility requirements. If approved, staff will use discretion when determining taxi transportation drive and wait times when to keep costs reasonable. Staffing and Resources to Support a Paramount Vaccination POD To assist the DPH with the operation of a potential vaccine distribution site at Paramount Park, staff proposes providing part-time City staffing to assist with traffic control and direction on the park site. This will consist of approximately five Community Services & Recreation Department staff over a 10 hour period, six days per week for an anticipated 18 week period. The proposed plan would cost approximately $75,900. Additionally, full-time staff will be providing supervisorial and liaison support with DPH at no additional costs. If approved by DPH, a potential vaccination site at Paramount Park will include City tables, chairs, and pop-up shelters. Similar to the other COVID-related uses for Paramount Park, Public Works staff will assist the operation with traffic lane setup on the park and Public Safety staff will assist with any traffic impacts that may occur off the park. When the City closed the books on the Fiscal Year 2020 budget, a COVID-19 relief reserve fund of $323,657 was established by the City Council using surplus funds. Subject: “EXPLORE PARAMOUNT” SHOP LOCAL CAMPAIGN Background Following State and County Health Department safety restrictions imposed on businesses to limit the spread of COVID-19, staff took immediate steps to help our local economy survive. As a result of these actions, the City assembled a Business Recovery Committee (Committee) composed of local business stakeholders, and developed a comprehensive Business Recovery Plan (Plan). On July 7, 2020, the City Council received a report on the Committee’s progress and the Plan to assist Paramount businesses survive shutdowns caused by COVID-19. As State and County restrictions continue to affect our business community, the City continues to work collaboratively with the Committee and explore opportunities intended to support our local businesses. The following is a report on the City’s efforts to launch a new “shop local” campaign to entice residents and visitors to support Paramount businesses. “Explore Paramount: Dine, Shop, Discover” Campaign In collaboration with the Chamber of Commerce, a new shop local campaign was developed based on a three-pronged approach: (1) Marketing and Advertising, (2) Incentivizing, and (3) Online Accessibility.

1. Marketing and Advertising The City’s communications consultant, Tripepi Smith, was retained in 2016 specifically to assist staff with complex communications and marketing projects intended to enhance public information. Tripepi Smith was primarily tasked with developing a branding and marketing strategy for “Explore Paramount: Dine. Shop. Experience.” A new logo and marketing strategy will help drive our efforts to help grow awareness of the new shop local campaign. This will also be an opportunity for the City to reinvigorate the Paramount Al Fresco program and marketing, as State Health Order regulations start to loosen. Combining the Al Fresco program marketing under the umbrella of “Explore Paramount” aligns with our efforts to implement a coordinated shop local approach.

2. Incentive Program As part of the “Explore Paramount” campaign, the Chamber of Commerce will organize a “Receipts for Rewards” program. The program will encourage Paramount business patrons to submit their receipts electronically to the Chamber of Commerce to enter into a weekly drawing to win gift cards to local businesses. In order to be eligible to enter the drawing, receipts submitted must show at least $50 spent at Paramount businesses. A drawing will be held virtually every week for a gift card from a local business. Startup costs for the program will be initially funded using $5,000 of CARES Act (CDBG-COVID) funds distributed by the City, supplemented by donations from local businesses.

3. Online Accessibility

Many small businesses in town do not have the capital or resources to establish a strong online presence, yet e-Commerce has played a vital role in how business is now conducted. In order to facilitate the digital transition for local merchants, staff is proposing a collaboration with Giftbar to provide an online e-gift card platform for Paramount business. Giftbar is a tech firm that provides digital gift card services to communities affected by COVID-19. Giftbar works with cities to give merchants technology to offer gift cards to their clients where social distancing would have prevented sales for these highly-impacted businesses. With an online site completely dedicated to Paramount businesses, local merchants will be able to sign up and create a unique profile and gift card program for their businesses through a Paramount-based website at no cost to the merchant or the customer. Staff believes that online digital gift cards may enable local businesses to access a new platform not previously available to them. For instance, local businesses that are not traditionally set up to provide digital gift cards, such as auto repair shops, car wash services, and other service providers may find success through this online platform provided for free by the City. The agreement between the City and Giftbar will be structured so that the City will subsidize all fees in order for both Paramount merchants and customers to maximize the benefits. The estimated cost to the City to implement the online gift card site is approximately $3,000 per year.

The City’s “Explore Paramount” campaign was presented to and well-received by the Committee on January 28, 2021. “Explore Paramount” will launch on February 3, 2021. Staff will also explore the feasibility of purchasing billboard ad space in the region to promote “Explore Paramount.” RECOMMENDED ACTION It is recommended that the City Council provide feedback on the “Explore Paramount” shop local campaign, and approve an amendment to the Fiscal Year 2021 Adopted Budget in the amount $3,000 for an E-gift card program and authorize the City Manager, or designee, to enter into a two-year agreement with Giftbar.

DEVELOPMENT OPTIONS Background Approximately 30 years ago, the City of Paramount had three functioning community gardens at various locations in the City. Two gardens were located in power company right-of-ways: a Department of Water and Power (DWP) site adjacent to the east end of Progress Park and a Southern California Edison (SCE) site at the intersection of Orange Ave. and Cortland Ave. The third site was in a vacant piece of land off Garfield Ave. and Petterson Lane, adjacent to the railroad right-of-way. Loss of Garden Sites The DWP garden site adjacent to Progress Park was eliminated with the development of the Jefferson School site in 1999. This former community garden is where the current school parking lot and hardscape playground area reside. The Garfield/Petterson site was eliminated approximately 12 years ago when Royal Truck Body required the property for an expansion of their facility. Unfortunately, the Royal Truck Body project did not come to fruition but the former garden site became part of a proposed turn-lane expansion for the Cal Met facility expansion which has two years remaining on the Conditional Use Permit for this development. While this remains City property should the Cal Met project not occur, the location of the community garden along a major boulevard and in an industrial zone subject to possible future projects makes it unlikely that we would recommend returning this site to community garden use. As a result of these community garden losses, the City of Paramount has only the Orange/Cortland garden remaining. This community garden site provides space for 28 individual gardeners. The Community Services & Recreation Department manages the use of the community garden by supervising the applications for the garden, providing access to the garden, and enforcing the rules and policies regarding use of the garden. The Public Works Department provides staffing to remove garden waste and debris and to provide any site maintenance and repairs.

Student Garden Site Approximately eight years ago, the City developed a small portion of land at the east end of Progress Park adjacent to the DWP right-of-way. The area was developed as a student garden using After School Education and Safety (ASES) funds in support of STAR programming at the Jefferson School site. The garden was closed during the 2018 drought and reopened in 2019 only to be shut down again in 2020 due to COVID-19 restrictions. Although the PUSD school sites remain closed and may not have students return for in-person instruction until next fall, we are going to temporarily reopen portions of the garden to 17 STAR families to plant and harvest between February and the middle of August when we anticipate students returning to campus. If this proves to be a successful expanded use of the garden site, we will look at keeping this operational format. This garden site is operated and supervised by the Community Services & Recreation Department through the use of STAR program staff. Additional maintenance of the site is provided by Public Works staff. Additionally, the Paramount Unified School District operates student garden sites at Collins School, the Odyssey STEM Academy, and Paramount High School West Campus. Plans exist for development of gardens at both Roosevelt School and the Paramount High School Senior Campus. Future Development Options We would like to expand opportunities for our residents to participate in a community garden but the obvious and primary obstacle is suitable available land. As we are all aware, Paramount is a built-out community and there are only a few usable options that could be considered for a community garden space. The primary options are to lease property from either DWP or SCE. Unfortunately, DWP is not currently accepting applications for any uses like community gardens on their property. SCE remains an option as they are still willing to enter into five-year lease agreements for such uses. We are currently engaged with SCE in submitting applications to construct a community garden on a portion of the SCE property along Rosecrans Ave. and a possible expansion of the existing Orange/Cortland community garden. We will also be exploring the possibility of a community orchard at Dills Park that would operate differently than a community garden but still provide our residents access to fresh fruit. Additionally, once COVID-19 restrictions are lifted, we will be exploring how we can assist the various households in town that grow fruits and vegetables in their yards with garden-share events where residents can exchange their excess produce with other residents. RECOMMENDED ACTION It is recommended that the City Council receive and file this report.

OF SAN CARLOS STREET Background On October 6, 2020, the City Council voted to adopt Resolution No. 20:029, which amended the existing procedures for establishing Neighborhood Permit parking in the City. Resolution No. 20:029 allows for staff initiated requests for Neighborhood Permit parking for areas with existing Neighborhood Permit parking and proposed areas affected by significant factors. Discussion On August 18, 2020, the City Council approved the construction of a mini-soccer court at the north end of Dills Park. The construction is an upgrade to the existing open park area. Although the mini-soccer court is intended for the nearby community, staff anticipates the mini-soccer court may attract more vehicles to the 6500 block of San Carlos Street challenging the local parking needs. The 6500 block of San Carlos Street is adjacent to the mini-soccer court. Resolution No. 20:029 provides authority for the Public Safety Director to recommend to the City Council approval of Neighborhood Permit parking on behalf of residents who may experience negative parking effects brought by expanding services such as the construction of the mini-soccer court at Dills Park. Analysis The Public Safety Department identified the following five parcels along the 6500 block of San Carlos Street and two parcels at the corner of San Jose Avenue that may face parking challenges brought by the mini-soccer court at the north end of Dills Park:

In October 2020, the Public Safety Department mailed voter surveys to the seven parcel property owners to obtain consensus on the permit-parking proposal. The Public Safety Department received an 86 percent response from property owners in favor of establishing permit parking along the 6500 block of San Carlos Street. Proposal Staff proposes to include the 6500 block of San Carlos Street in the Neighborhood Permit Parking program under the criteria authorized by Resolution No. 20:029. This staff initiated request would serve residents along the 6500 block of San Carlos Street with their local parking needs in preparation for the mini-soccer court at Dills Park. RECOMMENDED ACTION It is recommended that the City Council authorize Neighborhood Permit Parking for the 6500 block of San Carlos Street, which will be effective immediately. MIDDLE SCHOOL LOCATED BETWEEN ALONDRA BOULEVARD AND MYRRH STREET AND ASSOCIATED BUDGET ADJUSTMENT The City received a request from the Paramount Unified School District (PUSD) for street median modifications on Orange Avenue by the Zamboni Middle School located between Alondra Boulevard and Myrrh Street. For some time, PUSD has been working with a consultant to evaluate traffic conditions around several schools to enhance safety for the school children. A Traffic Improvement Plan was prepared and approved by PUSD that requires modifications to school property to create a new parking lot and drop off zones. This new layout will require the modification of the City’s existing street median to allow for turns into the new driveway entrance. PUSD will include, as part of their project, all modifications to the Orange Avenue median and will install drought tolerant planting to the section of median that is part of the project area. The planting will be similar to the rest of the drought tolerant converted medians city wide. We would like to use this opportunity to convert the remainder of the median not being altered by PUSD. Brightview Landscape Services, who currently is the City’s exclusive landscape maintenance contractor, provided a quote of $135,015.27. The City’s contract with Brightview allows for the addition of extra work. In an effort to maintain consistency in quality of landscaping and service, Brightview will be overseeing the project and making the improvements. According to the City’s purchasing policy, purchases of equipment or services in excess of $25,000 need to be approved by the City Council. The installation of new landscaping is provided in our existing landscaping contract with Brightview and, therefore, does not require competitive bidding. This will require a budget adjustment of $136,000 to the Fiscal Year 2021 adopted budget. If approved, this adjustment will be included in the midyear budget and Brightview, our landscape maintenance contractor, would perform that work under additional services. The attached maps show the proposed drop-off zone for the school and median modifications needed.

CENTURY BOULEVARD IMPROVEMENTS (CITY PROJECT NO. 9131) The City of Paramount Neighborhood Street Improvement 2020-21 Capital Improvement Project consists of Century Boulevard street resurfacing from Ruther Avenue to Barlin Avenue. However, Century Boulevard from Klondike Avenue to Barlin Avenue is located within the City of Downey. In order to assure a cohesive and uniform street rehabilitation project, the City of Downey is willing to partner with the City of Paramount by contributing to the costs for this portion of the project. This is common practice for cities where boundaries are shared. Recently, we partnered with the City of Compton for street improvements on Hunsaker Avenue. The estimated cost to the City of Downey is two hundred thousand dollars ($200,000). Attached, for City Council’s review and approval, is the funding agreement between the Cities of Downey and Paramount detailing the responsibilities for both parties. The City Attorney has reviewed this agreement and approved it as to form. RECOMMENDED ACTION It is recommended that the City Council approve the agreement with the City of Downey for the Century Boulevard improvements and authorize the Mayor or her designee to execute the agreement.

AND THE CITY OF PARAMOUNT

FOR CENTURY BOULEVARD IMPROVEMENTS

(CAPITAL IMPROVEMENT PROJECT NO. 9131)

THIS AGREEMENT (“Agreement’) is effective as of this ____ day of _______ 2021

(“Effective Date”), by and between the City of Paramount (“Paramount”), a municipal corporation,

and the City of Downey (“Downey”), a charter city, for the cooperative implementation of Century

Boulevard Improvements (the “Project”).

RECITALS

WHEREAS, the boundary between Paramount and Downey coincides with Century

Boulevard centerline;

WHEREAS, Paramount and Downey (jointly referred to as the “Parties” and

interchangeably as “Party”) agree that the Project is mutually beneficial to both Parties;

WHEREAS, the Project consists of the construction of street resurfacing with curb, gutter

and sidewalk improvements within the cities of Paramount and Downey on their respective

southern and northern halves of Century Boulevard: a) between Howe Street and Barlin Avenue

(Paramount’s and Downey’s east city limit);

WHEREAS, the estimated Project cost for Downey is approximately Two Hundred

Thousand Dollars ($200,000), inclusive of professional engineering and construction services.

Each Party is responsible for the portion of actual project costs proportional to the amount of work

completed within each Party’s jurisdictional limits;

WHEREAS, the Parties each have appropriated, or will appropriate, sufficient funds to

pay for the Project;

WHEREAS, Paramount shall construct the Project within each respective jurisdiction

consistent with the Project plans, and any work completed by either Party beyond the Project plans

within their respective jurisdiction shall be at the sole expense of said Party and shall not be

reimbursed;

WHEREAS, Paramount will conduct Request for Proposals and Invitations for Bids where

applicable for the Project, the responses to which will be jointly reviewed by the Parties;

WHEREAS, the Parties agree that Paramount will select an on-call consultant to perform

design, construction management and inspection services, and that the cost of the on-call

consultant shall be apportioned between the Parties in the same manner as other Project costs;

WHEREAS, the Parties agree to jointly select a contractor from responsive bids and

proposals and agree that Paramount shall execute a service agreement with the jointly selected

contractor or consultant; and

WHEREAS, as set forth herein, Downey shall reimburse Paramount for a portion of the

amount paid by Paramount for costs incurred in completion of the Project, apportioned in the

manner as set forth in Section 6.

NOW, THEREFORE, in consideration of the mutual promises and conditions in this

Agreement, the Parties agree as follows:

SECTION 1. Purpose of the Agreement.

The purpose of this Agreement is to provide for Downey’s reimbursement of a portion of

Paramount’s Costs Incurred in completing the Project and to provide for the defense of any action

arising against either or both Parties as a result of the construction of the Project. For purposes of

this Agreement, the term “Paramount’s Costs Incurred” includes costs incurred by the City of

Paramount, including, but not limited to, expenses arising from project management, design

consultants, funding management, construction materials and labor, and construction

management.

SECTION 2. Term of the Agreement.

The term of this Agreement shall commence on the Effective Date identified above and shall

continue until Downey has remitted to Paramount full payment of costs pursuant to Section 6 of

this Agreement, or until the Agreement is terminated as provided for in Section 8.

SECTION 3. Project Scope.

The Project will include the following elements:

Sidewalk improvements;

Americans with Disabilities Act improvements;

Rehabilitation of existing pavement;

Repair of miscellaneous concrete surfaces;

Any additional improvements deemed necessary by the Parties; and

Services necessary to implement the Project, including, but not limited to, planning, design

and environmental services, construction and construction management, funding

management and project management.

SECTION 4. Selection of Contractors and Consultants

Paramount shall conduct Requests for Proposals and Invitations of Bids where applicable, for the

Project. Paramount shall consult with Downey during the selection process regarding the

qualifications and costs presented in responding bids and proposals. The Parties will jointly select

from responding bids and proposals. Project contractors or consultants shall be hired by

Paramount. Downey has the right to review and comment on Paramount’s agreements with

contractors and consultants, prior to execution of the agreements. The Parties agree that any

provisions in the contractor or consultant services agreement requiring that Paramount is listed as

an “additional insured” shall also require that Downey is listed as an “additional insured.” The

Parties also agree that the agreement for contractor or consultant services shall require the

contractor or consultant to meet with Downey to provide information necessary to the Project.

During construction of Project, Paramount shall furnish an inspector or other representative to

perform the functions of an inspector. Downey may also furnish, at no cost to Paramount, an

inspector or other representative to inspect construction of the Project. Said inspectors shall

cooperate and consult with each other, but the orders of the Paramount inspector to the contractors

or any other person in charge of construction shall prevail and be final.

SECTION 5. Permits

Downey shall, upon approval of the construction plans for the Project, issue Paramount a no-fee

permit authorizing Paramount to construct those portions of the Project within Downey’s

jurisdiction.

SECTION 6. Reimbursement of Costs.

Downey shall be responsible for reimbursing Paramount for Paramount’s Costs Incurred which is

limited and proportional to eligible work completed within Downey’s jurisdictional limits

(“Downey’s Obligation”). Paramount estimates that Downey’s project cost is approximately Two

Hundred Thousand Dollars ($200,000).

Upon Downey’s receipt of an invoice for Downey’s Obligation for Project costs (“Project

Invoice”), such as services performed for, or materials used on the Project, Downey shall pay the

Project Invoice in full. In addition to the Project Invoice showing the balance of Downey’s

Obligation due, Paramount shall provide Downey with supporting Project documents, which

include, but are not limited to, construction as-built plans, construction and demolition

documentation, and centerline monument corner tie point records. Within thirty (30) days of

Paramount’s submittal to Downey of the Project Invoice showing the balance of Downey’s

Obligation and other items (as-built plans, construction and demolition documents and centerline

tie records) to Downey’s satisfaction, Downey shall remit payment to Paramount for Downey’s

Obligation as shown on the Project Invoice.

SECTION 7. Indemnification.

Each Party, as an Indemnitor, agrees to protect, indemnify, and hold the other Party (the

“Indemnitee”) and its employees, officers and agents free and harmless from any and all losses,

claims, liens, demands and causes of action of every kind, including, but not limited to, the

amounts of judgment, interests, court costs, legal fees, experts fees, experts costs, and other

expenses incurred by the Indemnitee arising in favor of any Party, including losses and claims

regarding personal injuries, death, or damages to property, and without limitation by enumeration,

all other claims or demands of every kind occurring or arising directly out of the negligent acts,

errors or omissions of the Indemnitor in the performance of its obligations and duties under this

Agreement, except when the injury to persons or damage to property are due or claimed to be due

to the Indemnitee’s negligence or willful misconduct. This provision is not intended to create any

cause of action in favor of any third party against either Party to this Agreement, but is intended

solely to provide for indemnification of a Party for liability for damages and injuries to third

persons or property arising from the Indemnitor Party’s negligent performance of this Agreement.

This Section 7 survives the termination or expiration of this Agreement.

SECTION 8. Default and Termination.

A. Notice of Default. If for any reason, a Party fails to fulfill in a timely and proper manner

its obligation under this Agreement, or a Party has violated any of the terms or

conditions of this Agreement, the non-violating Party shall provide a Notice of Default

to the violating Party setting forth the breached terms or conditions of this Agreement.

The violating Party shall then have thirty (30) days to cure the terms and conditions in

the written notice. The Notice of Default shall refer to this clause, specify the nature

of the alleged default, and shall specify the effective date of the termination in the event

that breach does lead to termination.

B. Failure to Cure. If the violating Party fails to cure and bring into compliance all terms

specified, the non-violating Party shall then have the right to terminate this Agreement

without further notice to the violating Party. Paramount shall only receive

reimbursement for Downey’s Obligation, if any is due pursuant to Section 6 of this

Agreement, for the portion of the Project performed in compliance with this Agreement

as of the termination date.

SECTION 9. Assignment.

The rights and duties of each Party are specific to the Parties and are not transferrable without the

consent of the non-transferring Party. Neither Party shall assign rights or responsibilities under

this Agreement without the express written consent of the other Party, which may be withheld for

any reason or no reason.

SECTION 10. Resolution of Disputes.

A. Disputes regarding the interpretation or application of any provisions of this Agreement

shall, to the extent reasonably feasible, be resolved through good faith negotiations

between the Parties. If following good faith negotiations between the Parties, the

Parties are unable to reach a mutually agreeable resolution to the dispute, either party

may commence an action in the appropriate court in Los Angeles County as described

in Section 15B.

B. Notwithstanding the indemnification provisions outlined in Section 7 above, if any

action, at law or in equity, is brought to enforce or to interpret the provisions of this

Agreement, the prevailing Party shall be entitled to recover reasonable attorney’s fees,

costs and expenses incurred in the pursuit or defense of said action, in addition to other

relief that may be sought and awarded. This Section 10B shall survive the termination

or expiration of this Agreement.

SECTION 11. Notice.

A. Any notice desired or required to be given pursuant to this Agreement or by any law

now or hereinafter in effect shall be given by personal delivery, or by enclosing the

same in a sealed envelope with postage prepaid, certified or registered mail, return

receipt requested, with the United States Postal Service.

B. Notice to Paramount shall be sent to following address: City of Paramount, 16400

Colorado Avenue, Paramount, CA 90723, Attn: Director of Public Works

C. Notice to Downey shall be sent to the following address: City of Downey, 11111

Brookshire Avenue, Paramount, CA 90241, Attn: Director of Public Works

SECTION 12. Force Majeure.

The respective duties and obligations of the Parties, pursuant to this Agreement, shall be suspended

while and so long as performance is prevented or impeded by strikes, disturbances, riots, fires,

severe weather, government action, war acts, acts of God, or any other cause similar or dissimilar

to the foregoing, which are beyond the control of the Party from whom the affected performance

was due.

SECTION 13. Waiver.

Either Party’s failure to insist upon strict performance of any of the terms or conditions of this

Agreement shall not be deemed a waiver of any right or remedy that the Parties may have, and

shall not be deemed a waiver of any right or remedy for a subsequent breach or default of terms or

conditions of this Agreement.

SECTION 14. Severability.

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void

or unenforceable, the remaining provisions will continue in full force and effect without being

impaired or invalidated in any way.

SECTION 15. Governing Law and Compliance.

A. In performing the duties and obligations pursuant to this Agreement, each Party is

responsible for its compliance with all local, State and Federal laws and regulations.

B. This Agreement shall be governed by and construed in accordance with the laws of the

State of California. In the event of litigation between the Parties, venue in the State

trial courts shall lie exclusively in the County of Los Angeles. In the event of litigation

in a U.S. District Court, exclusive venue shall lie in the Central District of California.

SECTION 16. Headings.

The headings, order, and grouping of provisions of this Agreement are for the purpose of

convenience and shall not be used to construe meaning or intent.

SECTION 17. Interpretation of Terms.

This Agreement is jointly prepared by the Parties. Therefore, this Agreement shall not be

construed against any Party on the basis such Party drafted this Agreement or any provision within

it.

SECTION 18. Entire Agreement and Exhibits.

This Agreement supersedes any and all other agreements, either oral or in writing, between the

Parties with respect to the Project. Each Party to this Agreement acknowledges that no

representation, statement or promise which is not embodied in this Agreement or any other

agreement shall be valid and binding. Any modification of this Agreement shall be effective only

if it is in writing and signed by both Parties.

SECTION 19. Authority.

The individuals executing this Agreement represent and warrant that they have the right, power,

legal capacity, and authority to enter into and execute this Agreement on behalf of the respective

Parties. This Agreement shall inure to the benefit of, and be binding upon, the Parties hereto and

their respective successors and assigns.

IN WITNESS WHEREOF, the Parties do hereby agree to the full performance of the

terms set forth herein.

PLANNING DEPARTMENT 2020 YEAR-END SUMMARY

Subject: ORAL REPORT – PLANNING DEPARTMENT 2020 YEAR-END

SUMMARY The Planning Department is responsible for the administration of the City’s land development process and implementing the long-range vision of the Paramount General Plan. A robust planning program through recent decades has been key in improving neighborhood and commercial quality of life as the City has committed to quality design, attractive housing options, and healthful and sustainable development. This oral report will summarize applications that the Planning Commission and Development Review Board reviewed and approved in 2020 and provide an update on other projects and activities. Other details will include permits issued and inspections completed by the Building and Safety Division of the Planning Department. Last year posed tremendous challenges with the COVID-19 pandemic, but we are happy to report that the Planning Department successfully adjusted and maintained a strong and safe continuity of service in the office and in the field.
