Respected sir, upon the latest decision of Road and transport Ministry of India on hike in truck axle load and i as a truck owner have the following problem in picking up the new load, Though the R.T.O department have updated all the old documents with old axle load limits into new load limits but still the Mining department has not updated their load limits in royalty so the problem is though we are legally allowed to load our trucks upon new load capacity, still the mining department is not allowing us to load our vehicles in these new load limits forcing us to move with the old limits so i would like to know that what steps should i do to make the mining ministry permit us to to carry the load with new limits

(i) Whether Ministry of Mines is aware that Department of Expenditure, Ministry of Finance vide OM No.4-21/201-1C/E.HI (A), dated 31st July 2018 has clarified that in case an employee is promoted or granted financial upgradation including upgradation under the MACP scheme on 1st January or 1st July, where the pay is fixed in the level applicable to the post on which promotion is made in accordance with the Rule 13 of the CC(RP) Rules, 2016, the first increment in the level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months qualifyi.. g service is strictly fulfilled.

(ii) Whether Ministry of Mines is aware that Department of Expenditure, DoP&T, Civil aviation and Ministry of Agriculture etc have revised the date next date of increment of those employees who has been given financial upgradation on 1st July, 2016.

(iii) Whether any representations from officials of Ministry of Mines have been received, requesting to revise their next date of increment?

In pursuance of the announcement made in Budget, 201647, the

Department of Investment & Public Asset Management (DIPAM)

issued Guidelines on Capital Restructuring of CPSEs on 27.05.2016,

laying down general principles and mechanism for payment of

dividend, buyback of shares, issue of bonus shares and splitting of

shares by the CPSEs. Thereafter, DIPAM has also issued 3 advisories

dated 26.9.2016, 21.11.2016 & 19. 12.2016 to the Financial Advisers

of all Ministries/Departments to ensure smooth implementation of

these guidelines.

Paras 5.3. and 5.4.of the guidelines dated 27.5.2016 provides as

follows:

5.3 Nonetheless, CPSEs are expected to pay the

maximum dividend permissible under the Act under

which a CPSE has been set up, unless lower dividend

proposed to be paid is justified after the analyses of

the following aspects on a case to case basis at the

level of Administrative Ministry/Department with

the approval of Financial Advisers.

(i) Net-worth of the CPSE and its capacity to borrow;

(ii) Long-term borrowings;

(iii) CAPEX/Business Expansion needs;

(iv) Retention of profit for further leveraging in line

with the CAPEX needs; and

(v) Cash and bank balance.

5.4 The analysis should confirm that the retention of

funds augmenting its net-worth is being optimally

leveraged to ensure higher investment by the CPSEs.

• The report for exemption, if any, in this regard will

be submitted by the CPSEs through their

Administrative Ministry to Secretary, Department of

Economic Affairs and Secretary, Department of

Investment and Public Asset Management (DIPAM)

before the end of second quarter of the financial

year..

In this regard, please provide following information/documents:

1.Dividend of a particular financial year is paid in the next financial

year after audit and approval of accounts in the annual general

meeting. So, Dividend for the financial year 2016-17 was due to be

paid in the financial year 2017-18. In this regard, please inform which

CPSEs under the administrative control of the Ministry of MINES

submitted requests to the Ministry of MINES for seeking exemption

from payment of MAXIMUM DIVIDEND PERMISSIBLE repeat

MAXIMUM DIVIDED PERMISSIBLE under the Companies Ac, 2013

pertaining to the financial year 2016-17, which was to be paid in the

financial year 2017-18 after audit and approval of Accounts in the

The central government has been asking the states since August 31 last year to submit their action plans for auctioning leases of 348 non-captive mines, which are going to expire in 2020. However, even after repeated reminders, only two states - Andhra Pradesh and Rajasthan - submitted their action plans till February 22 this year.

Here are my questions in this regard:


1. On November 24, 2017, Arun Kumar, the then Union mines secretary, wrote a letter to all mineral-rich states, wherein he requested them to submit their action plans by December 9, 2017. Has the Union mines secretary written any letter or email to the state governments -- regarding this matter of submitting action plans --- after November 24, 2017. If yes, please give me a copy of each such letter.

2. Andhra Pradesh and Rajasthan had submitted their action plans till February 22, 2018. a) Kindly tell me the name of the state governments that have submitted their action plan to the Ministry of Mines after February 22, 2018. b) Kindly tell me the date on which they submitted their action plan to Ministry of Mines. c) Kindly give me a copy of these action plans of state governments that were submitted with Ministry of Mines after February 22, 2018.

The Supreme Court had ruled in August last year that violations of enviromnent and pollution control laws in a lease were also to be considered illegal mining, which rattled miners because the penalty for this amounts to 100 per cent of the output. The verdict triggered penalties running into thousands of crores of rupees.

Here are my questions regarding this issue:

A. This is in reference to "Order under C.V.C.Act 2003" vide covering letter no.

018/MNS/004/380720 dated 23.05.2018 of the Central Vigilance Commission addressed

to Shri N.K.Singh, JS & CVO/Ministry of Mines. This order was received by Shri

N.K.Singh,JS & CVO/Ministry of Mines at 05:10 PM on 23.05.2018.

B. Vide abovesaid order, CVC has directed that an investigation be conducted into

complaint dated 10.02.2018 of Shri Basudev Bhatt against Shri T.K.Chand, CMD

NALCO and others. CVC further directed that "the report alongwith the departments's

specific comments/recommendation be submitted to the CVC within 02 months of receipt

of this order."

C. I am Basudev Bhatt and that the complaint dated 10.02.2018 against Shri

T.K.Chand,CMD NALCO and others is submitted by myself Taking cognizance of my

complaint, CVC has sent the directions vide abovesaid order dated 23.05.2018 to the

Ministry of Mines.

D. Ministry of Mines must share information, under RTI Act 2005, against my queries

below comprehensively and categorically. Any attempt to hide information or to mis-

represent facts under any ground/exemption will only establish possible complicity of

In the reference 6"' read above, the Director, Ministry of Mines, Government of India has informed that transfer of any mineral concession would have achieved finality only if a deed in this regard was executed before 12.01.2015 [i,e. the date of commencement of ,MDR Amendment Act, 2015]. As such the request made for transfer remains only a pending application, with the State Government not having -executed the transfer deed before the commencement of Amendment Act. Therefore, the said application for the transfer of prospecting license has already become null and void on 12.01.2015 under. section 12A(6) of the Amendment Act. The Director, Ministry of Mines, Government of India has finally opined that the section 12A(6) of the Amendment Act, 2015 has put an embargo on transfer of mineral concessions which were granted otherwise than through auction, the order dated 17.01.2015 issued by the Government of Telangana cannot be considered to be in accordance with the provisions of iyiMOR Amendment Act, 2015.

6_ Government after careful examination of the matter; hereby cancel :the orders issued by the State Government in the reference 3'd read above in which permission was accorded for transfer of Prospecting License for Manganese Ore & Limestone over an extent of 9441.9:3 Acres in Sy.Nos.1 to 31 and 36 to 62 of Pippalagaon Village, Jainath Mandat, Adilobed District from Sri G. Venkateshwar to M/s. Adilabad Alloys ft Associated Industries Limited for the unexpired Period of License upto 05_10.2015 under Rule 14(1)(vii) of M.C.Rules, 1960.

7. The Director of Mines ft Geology, Hyderabad shalt take necessary further action in the matter accordingly.
