PRTOCOLrelating to

TRADE NEGOTIATIONS AMONG DEVLOPING COUNTRIES

DETERMINED to contribute to the development of their economies and to promotsa sustained increase in their standards of living through efforts based on theirmutual co-operation;

RECOGNIZING the need for strengthaning their respective economies through theopportunities for expanding production and achieving benefits of speciallsationand economies of scale that might be provided by the growth of their mutual trade

NOTING the importance of expanding access on more favourable terms for theirgoods to one another's markets and of developing arrangements which foster therational and outward-looking expansion of production and trade;

RESOLVED to take appropriate action to this end and to reduce or eliminatetariff and non-tariff barriers that affect existing trade flows or inhibitdevelopment of now trading possibilities, through negotiations based on theprinciple of mutual benefit and open to all developing countries alikeirrespective of whether or not they are contracting parties to the GeneralAgreement on Tariffs and Trade (hereinafter referred to as "GATT");

MINDFUL at the same time of the need to take into account the development,financial and trade needs of individual developing countries;

REALLING that trade expansion, economic co-operation and economicintegration among developing countries have been accepted an important elements ofan international development strategy and as making an essential contribution tothe economic development of developing countries;

NOTING that the CONTRACTING PARTIES to the GATT have agreed that theestablishment of preferences among developing countries, appropriatelyAdministered and subject to the necessary safeguards, could make an importantcontribution to the trade among developing countries, and that such arrangementsshould be looked at in a constructive and forward-looking spirit;

The governments which have, through their representatives, accepted thisProtocol, have agreed as follows:

1.Application of concessions

The concessions exchanged pursuant to this Protocol shnll be applicable toall the developing countries which are parties hereto (hereinafter referred to as

the "participating countries").

2.Schedules of concessions

The concessions referred to above are and shall be embodied in schedules tobe annexed as integral parts of this Protocol.

3.Maintenance of the value of concessions

Object to terms, conditions or qualifications that might be set out in theschedules containing the concessions granted, a participating country shall notdiminsh or nullify these concessions after the entry into force of this Protocolthrough the application of any charge or measure restricting commerce other thanthose testing prior thereto, except where such charge correspond. to an internaltax imposed on a like domestic product, an anti-dumping or countervailing duty, orfees commensurate with the cost of services rendered, and except any measuresauthorised under paragraph 11 or applied pursuant to paragraph 13.

4. Committee Of participating countries

A committee of participating countries (hereinafter referred to as the"Committee") is hereby established, consisting of the representatives of thegovernments of the participating countries. The Committee shall meet from time totime for the purpose of giving effect to those provisions of this Protocol whichinvolve joint action and, generally, with a view to facilitating the operation andfurthering the objectives of this Protocol, and shall collect the statistical andother information necessary for the discharge of its functions. The Committeeshall adopt such rules of procedure as may be necessary. Decisions shall be takenby a majority of the votes cast except in the case of modification or terminationof the arrangements under this Protocol, and except in the case of accession tothis Protocol, when a two-thirds majority shall be required, and unless otherwisespecified. Any modification of the arrangements under this Protocol shall becomeeffective in respect of those participating countries which accept it andthereafter for each other participating country upon acceptance by it.5.Review

The Committee shall keep under review the arrangements under this Protocoltaking into account the objectives set out in the Preamble hereto. Not later thanthe end of the fifth year from the entry into force of this Protocol the Committeeshall undertake a major review of those arrangements to determine whether theyshould be modified, enlarged or terminated.

- 5 -6. Additions or enlargements to theschedulesofconcessionsThe Committee shall keep under review the possibility of promoting

negotiations for additions or enlargements to the schedules of concessions and mayat any time sponsor such negotiations.7.Provisionforperiodic renegotiation of concessions

It shall be open for a participating country during a period of three monthsImmediately preceding tho end of every three-year period from the entry into forceof this Protocol, upon notification to the Committee, to enter into renegotiationsfor the withdrawal or modification of any concessions in accordance with theprovisions of paragraph 9.

8. special circumstances

The Committee may at any time authorize the renegotiation of a concession inaccordance with paragraph 9 in special circumstances including these relating tothe development, financial or trade situation of a participating country whichshall have granted such concession.

9. Renegotiation for the withdrawal or modificationof concessions

In any renegotiation for the withdrawal or modification of a concession theparticipating countries concerned shall endeavour to maintain a general level ofconcessions no less favourable to their mutual trade than that existing prior tosuch renegotiations. For this purpose the participating country seeking to modifyor withdraw a concession shall enter into renegotiations with the participatingcountry or countries with which the concession was originally negotiated, or withany other country which has a substantial trade interest in the product orproducts affected as determined by the Committee. If agreement cannot be reachedbetween the participating countries concerned within six months from the end ofthe three-year period referred to in paragraph 7 or from the date on which theauthorization pursuant to paragraph 8 has been granted, as may be the case, theparticipating country seeking renegotiation shall nevertheless be free withinninety days therefrom, upon notification to the Committee, to modify or withdrawthe subject concession. In such event the other participating country orcountries concerned shall likewise be free before expiry of ninety days from thedate on which written notice of such modification or withdrawal is received bythe Committee to modify or withdraw from the partlcipating country seekingrenegotiation concessions which are substantially equivalent in the opinion of theCommittee.

10. Rules of origin

The application of rules of origin with respect to the concessions ombodiodin tho schedules annexed to this Protocol shall be governed by the provisions setout in Annex A.

Where, however, restrictions areintitued or intensified with respectte products covered by concessions,immediate noticeof such action nust be givento the Committee and such action may be the subject of consultations as providedfor in paragraph 12.12Consultations

Each particisating country shall accord sympathetic consideration to, andshall afford adequate opportunity for, consultation regarding such representationsas may be made by another participating country witn respect to any matteraffecting the operation of this Protocol.Thecommitteemay,atthe request of aparticipating country, consult with any participating country or countries inrespect o. any matter for which it has not been possible to find a satisfactorysolution through such consultation.

In addition, if any participating country should consider that anotherparticipating country has altered the value of a concession embodied in itsschedule or that any benefit accruing to it directly or indirectly under thisProtocol is being nullified or impaired as the result of th failure of anotherparticipating country to carry out any of its obligations under this Protocol oras the reseult of any other circumstancee relevant to the operation of thisProtocol, the former may, with a view to the satisfactory adjustment of thematter, make written representations or proposals to the other participatingcountry or countries which it considers to be concerned, which thus approachedshall give sympethetic consideration to the reprpesentations toor proposals made toit.

If no satisfactory adjustmentis effected between the participating countriesconcerned within 120 days from the date on which such representation or requestfor consultation was made, the matter may be referred to the Committee who shallconsult with the participating countries concerned and make appropriaterecommendateons. Where thecircumestances are serious enough, the Comittee mayauthorize a participating country to suspend the application to any otherparticipating country or countries of such concessions as the Committee deemsappropriate in the circumstances.13Emergencyactiononimportsofparticularproducts

If, as a result of unforeseen developments and of the effect of concessionsembodied in the schedules annexed to this Protocol, any product is being importedinto the territory of a participating country in such increased quantities and

under such conditions as to cause or threaten serious injury to domestic producersin that territory of like or directly competitive products, the importingcountry shall be free, in respect of such product, and to the extent and for suchtime as may be necessary to prevent or remedy such injury, to suspend theconcession. Before taking action pursuant to the foregoing it shall give noticein writing to the Committee as far in advance as may be practicable and shallafford the Committee and the participating countries having a substantial interestat exporters of the product concerned an opportunity to consult with it in respectof the proposed action. In critical circumstances, where delay would cause damagewhich would be difficult to repair, action may be taken provisionally withoutprior consultation, on the condition that consultation shall be effectedimmediately after taking such action. If agreement among the participatingcountries concerned with respect to the action is not reached, the importingCountry which proposes to take or continue the action shall, upon notification tothe Committee nevertheless, be free to do so; and if such action is taken orcontinued the affected countries shall then be free to suspend, not later thanninety days after notice of such action is received by the Comittee, andupon theexpiration of thirty days from the date of. receipt of such notice, the applicationto the trade of the country taking such action, of such substantially equivalentconcessions, the suspension of which the Committee does not disapprove.Nonetheless, where action is taken without prior consultation and causes orthreatens serious injury in the territory of a country to the domestic producersof products affected by the action, that country shall, where delay would causedamage difficult to repair, be free to suspend, upon the taking of the action andthroughout the period of consultation, such concessions or other obligations asmay be necessary to prevent or remedy the injury.

14. Accession of a developing country not a signatory to this Protocol

This Protoool shall be open for accession to all developing countries. Adeveloping country wishing to accede to the Protocol should make application inwriting to the Committee. The Committee shall take the necessary steps tofacilitate the accession of a developing country to this Protocol on termsconsistent with the latter's present and future development, financial and tradeneeds as well as post trade developments, and shall make arrangements for anynegotiations for the exchange of concessions which a participating country maywish to carry out with the developing country seeking accession. Participatingcountries shall also take these needs and developments into account in enteringinto or carrying out such negotiations. In the light of such negotiations theapplicant country may accede on terms agreed with the Committee.

The Comittee may agree that an applicant country may accede to the Protocolwithout such negotiations on terms agreed with the Committee.

15. Non-application of this Protocol between particular countriesThis Protocol shall not apply as between any countries accepting this

Protocol if they have not entered into direct negotiations with each other and ifeither of them, at the time either accepts this Protocol, does not consent to suchapplication.

- 8 -16.Temporary suspension of rights and obligationsIn exceptionalcircumstances, upon request to the Committee a participating

couentry may be authorized by the Committee by a two-thirds Majority comprising atleast half of the participating countries to suspend temporarily its obligationsunder this Protocol, subject to such conditions and for such specified period asthe Committee shall prescribe. During the period of suspension, otherpasticipating countries may, if they so wish,upon notification to the Committee,refrain from extending concessions in their schedules to the country concerned.

Any participating country may withdraw from this Protocol, such withdrawal totake effect six months from the day on which written notice thereof is received bythe Director-General to the CONTRACTING PARTIES to the GATT.18Withholdingorwithdrawlofconcessions

A participating country shall at any time be free withhold or to withdrawin whole or in part any item in its schedule of concessions in respect of whichsuch participating country determines that it was initially negotiated with acountry which has not become, or has ceased to be, a participating country. Aparteicipating country taking such action shall notify the Committee and, uponrequest, consult with countries which have a substantial interest in the productconcerned.

19. Opening for acccptance

This Protocol shall be open for acceptance by signature or otherwise by theconuntries which shall havemadé offrs of concessions in the negotiations.

20.Entry into forceThis Protocol shall enter into force, an among the govrnments which have

aaccepted it, on the thirtieth day after one half of the countries which shall haveexchange concessions in the negotiations have accepted this Protocol, and for eachgovernment which accepts thereafter on the thirtieth day following the date ofsuch acceptance.

21. DepositThis Protocol shall be deposited withthe Director-General to the CONTRATING

PiANTIEto the GATT,who shall promptly furnish a certifide copy thereof and anotifipation of ocah accprtacn e thereof, uPrsuant to paragraph 20 above, or ofaech accession theroto, pusruant to paragraph 14 above, to each participating

country.

22. Registration

This Protocol shallbe registered in accordance with the provisions ofarticle 102 of the Charter of the United Nations .

DONE at Geneva this eighth day of December nineteen hundred and seventy-onein a single copy, in the English,French and Spanish language, except as otherwisespecified with respect to the schedules annexed hereto, each text being authentic

Declaration.

Taking into account the objectives set out in the Preamole, the parties tothis Protocol areagreed that the implementation of commitments under customsunions or free-trade areas among developing countries shall not be affected by theprovisions of paragraph 12 of this protocol. Where, however, in implementingthese commitments a party to this Protocol increases a rate of duty bound in theschedules annexed to this Protocol, the provisions of paragraphs 8 and 9 shallapply.

It is the intention of parties to this Prctocol which participate in suchcustoms unions or free-trade area to use their best endeavours to ensure thatsuch agreements shall not, by virtue of their provisions governing treatmentapplicable in respect of third countries, prevent the implementation of theprovisions of this Protocol and the attainment of its objectives.

NOTANT l'importance d'un élargissement et d'une amélioration des conditionsd'accés qu'ils so font à leurs produits sur leurs marchés, ainsi que l'intretdo l'élaboration d'arrangeaments propres à favoriser une expansion rationnelle,conduiet dans un esprit ouvert de leur production et de leur commerce;

RESOLUSà prendreà cette fin des mesaures appropriées età réduire ouàéliminer les obstacles tarifaires et non tarifaires qui affectent les courantsd'échange existants ou entravent l'apparition de nouvelles possibilitésd'échanges, au moyon de négociations fondées sur le principe de l'avantagemutual et ouvertes dane les mêmes conditions à tous les pays en voie dedéveloppement, qu'ilssoient ou non parties contractantes à l'Accord général surles tarifsdouaniers et lecommerce (ci-aprés dénommé "1'Accord général");

SOUCIEUX en même tempsde la nécessité de tenir compte des besoins des paysen voie de développment an matiére de développement, de finances et decommerce;

RAPPELANT qu'il a été admis que l'expansion des échanges, la coopérationéconamique et l'intégration économique entre pays en voie de développementconstituent deséléments importants d' une stratégie internationale dudéveloppement et apportent une contribution essentielle au développementéconomique de ces pays;

NOTANT que les PARTIES CONTRACTANTES à l'Accord général sont convenues quel'éablissement de préférences entre pays en voie de déiveloppement, administréesde façon appropriée, et sous réserve que les sauvegardes nécessaires soientprévues, pourrait contribuer de maniére importante au commerce entre ces pays etque ces arrangements devraient être considérés dans un esprit constructif etorionté verse l'avenir,

Les gouvernements qui ont acceptéle présent Protocole par l'intermédiairede leurs représentants sont convenus de ce qui suit:

1. Application des concessions

Les concessions échangées en conformité du présent Protocole serontapplicable à tous les pays en voice de developement qui y sont parties(ci-aprés dénoamés "les pays participants").

2. Listes de concessions

Les concessionssusmentionné?es sont et soront reprises dans eos lisoes qiusercnt anneéxes au pérsent Protocoel dont elles front parties inétgrante.

3. Pérservation de la vaelur des concessions

Sous érserve des modaliéts, conditions au érserves qui pourraisnt être6oncéé? dans les lisets des concessions accLrdéesw aucun pays participant noréduira ni n'annulora ces concessions,aprés l'entrée an vigueur du présentProtocolo, en appliquant' des impositions ou des mesures restrictives du commerceautres que cells qui existaient antériesurement, sauf s'il s'agit d'impositionscorrespondent à des taxes intérieures frappant un produit national uimilaire,de droits antiduping ou comensateurs, ou de redevances correspondant aucoûtde services rendus, et sauf égalment s'il s'agit de mesures autorisées par leparagraphe 11 ou appliquées en vertu du paragraphe 13 du présent Protocolo.

4. Comité des pays participants

lI est crééen vertu des présentes dispositions un Comité des paysparticipants (ci-aprés dénommé "le Camité"), composé des représentants desgouvernments des pays participants. Le Comité se réunira périodiquemennt afinde donner effet aux dispositions du présent Protocols qui appellent une actioncollective, et, d'une maniére générale, de faciliter l'applications du présentProtocole de promouvoir la réaiisation des objectifs qu'il détermine l1rassemblera les renseignements, statistiques et autres, nékcesaiero &1'accopmlissement de ses functions. Le C moiét adoptera lee dispositionsconstitaunt son érglement iné0trieur qui eesront é+ecessaires.eeSséTdcisionsseront prisesà la majoréit des suffrages expréims, sauf pour la modification ou1abrogation des arrangements évprus par le éprsent Protocole et pourl'aeccssion au éprsent Protocole, cas dans lesquels la majoréit des deux tierssera requise, et sauf autres dispositions. Toute modification des arrangementséprvus pare l éprsent Protocole prendra effet pour les pays participants quilacceptent et, par alesuite, pour tout autre pays participant lorsqu'ill'auraaccepéte.

5.Examen

Le Comiét proécdera en permanence à. lé'valuation des arrangements pérvuspar le pérsent Protocole en tenant compte des objectifsé nonécs dans sonPérambule. Au plus tard à la fin de la cinquèäme anéneà compter de l'entére envigueur du present Protocole, le Comiét proécdera à un eaxmen approfnodi de cesarrangements afin de édterminer s'il convient qu'ilesoient modiféis,é tendus ouabroégs.

6. Additions aux listes do concessions ou extension de leur portéeLe Comité restera constarument attentif à toute possibilité de promouvoir

des négociations à l'effet d'apporter des additions aux lists de concessions oud'en étendre la portés laet poarra a tout mement parrainer de telles negociations.

7. Renégociation périodique des concessions

Dane les trois mois qui précéderont immédiatment l'expiration de chaquepériode triennale, la première de ces éeriodes commeçvant le jour de l'entéee envigueur du pérsent Protocole, tout pays participant aura la faculét, apérsnotificttion au Comiét, d'engager des reéngociations er vue du retrait ou de lamodification de toute concession, conforémment aux dispositions du paragraphe 9.

8. Circonstances spéciales

Le Comiét pout, en tout temps, autoriser la reéngociation d'une concession,conforOmment au paragraphe , dans des circonstances sépciales, notarment descirconstances touchant auévedloppement ou à la situation finacnè+re oucommerciale du pays participant qui auraaccodér cette concession.

9. Renégociation en vue du retrait ou delamo dification de concessions

11. Mosures concernant la balance dos paiements

Sons préjudice de ses obligations internationales existantos, tout paysparticipant qui juge nécessaire d'instituer ou de renforcer des restrictionsquantitatives ou d'autres mesures limitant les importations, on vue de s'opposerà la menace d'une baisse importantedo ses réserves monétaires, de mettre fin àune telle baisse, ou d'assurer un taux de croissance raisonnable desditesréserves, s'lefforcera de le faire guivant. dos modalités qui sauvezarrdent lavalcur dos concessions reprises dans les listes annexécs au présent Protocole.Cependant, lorsque des restrictions seront instituées ou renforcées en ce quiconcerne des produits faisant l'objet de concessions, la mesure seraimmédiatament notiftiée au Comité et pourra faire l'objet de consultationsconforéiment aux dispositions da paragraphe12 ci-aprés.

12. Consultations

Chaque pays participant examinera avec compréhension las représentations quepourra lui adrasser tout autre pays participant concernent toute questionrelative à l'application du présent Protocole et devra sc prOter à desconsultations au sujet de ces représentations. Le Comité pourra, à lademande d'un pays participant, entrer en consultations avec un ou plusieurs paysparticipant sur une question pour laquello une solution satisfaisante n' aura puêtre troué6e aumroyen des consultations péeciétcs.

Dans le cas ùo un réglewont n'ineterviendrait pas entre les paysparticipants inéecreséss dans un édlai de 120 jousr a omptcer de la date de cesrepérsentations ou de la demande de consultations, la question pourra ter porétedevant lo Comité qui consultors les pays participants inétresess êtreformulerades recomandations appropréies. Lorsque cls circonstances seront suffisammentgraves, le Comiét pourra autoriser un apys participant a suspendre,àå lé'gard detel autrc ou tels autres pays participants, l'applicition des concessions dontle Corniét estimera la suspension justiféie, compte tenu des circonstances.

13. Mesures d' urgence concernant l 'importation de produits particuliers

Si, par suite de l'évolution imprévue des circonstances et per l'effet desconcessions reprises dans les listes annexés au présent Protocolo, un produit estimporté sur le territoire d'un pays participant en quantités tellement accrues età des conditions telles qu'il porteou menace de porter un préjudice grave auxproducteurs nationaux de produits similaires ou de produits directamentconcurrents., le pays laportateur aura la faculte de suspendre la concession quiconcerne ce produit, danslamesure et pendant le temps qui pourront êtrenécessaires pour prévenir ou réparer le préjudice an question. Avant de prandredes assures en conformité des dispositions qui précédent, il an avisera le Comitépar écrit et le plus longtemps possible à l'avance. Il fournira au Comité sinsiqu'aux pays participants ayant un intérêt substantiel en tant qu'exportateurs duproduct en question, l'occasion d'.examiner avec lui les mesures qu'il so proposede prendre. Dana des circonstances critiques où tout délai entrainerait unpréjudice qu'i1serait difficile de réparer, des mesures pourront être prices àtitre provisoire sans consultation préalable, à la condition que les consultationsaient lieu immédiatement aprés quo lesdites mesures auront été prices. Si lespays participants intéressés n'arrivant pas à un accord aU sujet de ces assures,le pays inportateur qui se propose de les prendre ou de les maintenir enapplication aura néanmoins la faculté d'agir en ce sens aprés avoir adressé unenotification au Comité; s'lil exerce cette faulté il sera loisible aux pays queces measures l'éseraient de suspendre, dans un délai de quatre-vingt-dix jours àcopter de la réception par le Comité, de l'avis de leur application ou maintienen application et, à l'expiration d'un délai de trente jours à compter de celui oùle Comitéaura reçu cet avia, l'application, au commerce du pays qui aura pris cesassures, de concessions substantiellement équivalentes dont la suspension nedonnera lieu à aucune objection de la part du Comité. Nénmoins, si de measuresprises sans consultation préalable portent ou menacent de porter un préjudicegrave aux producteurs nationaux de produits affectés par elles, sur le territoired'un pays, ce pays aura la faoulté, lorsque tout délai à cet égard entra8nerait unpréjudice difficilement réparable de suspendre, dés la miso en application de cesmesures et pendant toute la durée des consultations, des concessions ou d'autresobligations dans la mesure nécessaire pour prévenir ou réparer oe préjudice.

14. Accession au présent Protocole de pays en voie de diveloppementnon signataires

Le présent Protocole sera ouvert à l'accession de tous les pays en voie dediveloppament. Tout pays en voie de dévoloppement qui désirera y accéder en ferala demande per écrit au Comité. Le Comité prendra les dispositions nécessairespour faciliter son accession au présent Protocole à des conditions compatiblesswec les besoins actuels et future de son développement, de ses finances et de soncommerce, ainsi qu'avec 1'évolution passée de ses échanges. I1 prendra desdispositions en vus des négociations pour l'échange de concessions auxquelles unpays participant voudrait procéder avec le pays en voie de développement qui

désire acoéder.Quanils engageront ou mèneront de telles négociations, les paysparticipants prendront également en considération les besoins et l'evolutionsusmentionnés. A la lumiére de ces negociations, le pays damandeur pourra accéderau présent Protocole aux conditions conveues avec le Comité.

Par décision du Comité, tout pays demandeur pourra accéder au présentProtocole aux conditions convenues avec le Comité, sans procéder à de tellesnégociations.

15. Non-application du pré?sent Protcolle entre des pays

Le pérsent Protocoel ne a'appliquera pas centre deux pays qui l'acacptent'ils ''ont pas snmagéeentre eux de néiociations directes et si l'wn des deux ne

consent pas à cette application au moment où l'un d'eux accepte ce Protocole.

16. Suspension temporaire de droits et d'obligations

Dans des circonstances exceptionnelles et sur demande adressée au Comité,tout pays participant pourra être autorisé, par décision du Comité prise à lamajorité des deux tiers réunissant la moitié au moins des pays participants, àsuapendre temporairement les obligations qu'il a souscrites en vertu du présentProtocols, sous réserve des conditions et pour la période que le Comité fixera.Pendant la période de suspension, les autres pays participants pourront, s'ils ledésirent, et aprés notification au Comité, ne pas appliquer au pays en questionles concessions reprises dans leurs listes.

17. Dénonciation du présent Protocole

Tout pays participant pourra dénoncer le présent Protocole, et cettedenonciation prendra effet à l'expiration d'un délai de six mois à compter du jouroù le Directeur général des PARTIES CONTRACTANTES à l'Accord généal aura reqçnotification par cérit de ladite dnéonciation.

18. Suspension ou retrait de concessions

Tout pays participant aura, à tout moment, la facult éde suspendre ou deretirer, en totalit0é? ou en partie, une concession reprise dans sa liste, motifpris que cette concession a ñété négociée primitivement avec un pays qui n'est pasdevenu pays participant ou qui a cessé de l'âtre. Le pays participant qui prendraune telle mesure est tenu de la notifier au Comité et, s'il y est invité, ilentrera en consultations avec les pays intéressés de façon substantielle auproduit en cause.

19. Ouverture à l'acceptation

Le present Protocole sera ouvert à l'acceptation par voie de signature ouautrement, des pays qui auront fait des offres de concessions au cours desnégotiations.

Teniendo en cuenta los objetivos eo ciados en el Preimbulo, las partes enel presente Protocolo convienen en quo las disposiciones del parrafo 12 nofectara~n al cumplimiento de obligaciones derivadas de uniones aduaneras o zonas
