REGULArrION OF THE PAIHTYA PERSIAPAN NASIONAL

Article 1. The"Panitya Persiapan Nasional" (National Preparatory Committee=N.P.C.)

is the joint organ of the Republic of Indonesia and the territories under

tne B.F.o. (Federal Consultative Assembly= F.c.a.), for the execution of the

task as stipulated in this Regulation.

Article 2.

The N.P.C. shall consist of 31 members of whom 15 shall be appointed by

the Government of the Republic of Indonesia and ,16 by the B •. F .O. (F.C.A.)

Article ,3. From its members the H.P.C. snall elect a Chairman a.nd one or more

deputy Cnairmen and it shall establish a general secretariat.

Article !f. To execute its task, the N.P.C. shall be authorized to act and to take

decisions, such in observance of the articles of this Regulation .

Article 5. The task of the N.P.C.:

a-) the preparation for the establishment at the earliest possible time

of the organs of the Government of the 11Republik Indonesia. Serikat",

necessary for the transfer of sovereignty, viz.: the election of the President as stipulated in article 69 (2) of the

Provisional Constitution a:nd the nomination of the cabinetformateurs

as stipulated in article 74 (1) of the Provisional Constitution.

Further, without prejudicing the competences of the Government, the

N . P.C . has as its task the J:)reparatJon for the establishment of the

Senate, ih accordance with art2.cle 81 of the Provisional Constitution,

and the establishment of the Representative Body in accordance with article 98, and further of the Provisional Constitution.

b-) the preparation J! the taking-over of the government 1 s task by the Government of tne rl.r.s . from the rrovisional Federal Government in

Indonesia at tne transfer o~ the sovereignty.

c-) the preparation for the actual taking-over of the sovereignty and the

regulation of the necessary formalities

d-) to maintain close contact with the u.~.c .. in accordance with the

stipulation of article 6 of the coverir~-resolution of the R. T.C.

For the exec..ltion of the subject laid down in article 5 under a sub 1,

yhe N.P.C. snall call in session the deputies mentioned in article 69 (2) of the Provisional Constitution, with the purpose to elect the Presjdent of the R.I.S.

It shall fix the time and place, at which the election shall take place

Article 7. 1) For the execution of the subject stipulated in article 9 sub b , the N.P.c. shall take all measures wh:lch are necessary for the preparation for the taking-over of the government's t 'ask by the Government of the .tl .I .S.

from the Provisional Federal Government.

2) For that pur.pose it shall immediately enter into consultation with the rovisional Federal Govt. a1~/or with the ~eads of the Dep&rtements of the

Central dministration . 3) The : • P. C. snall nominate persons, nembers or non-members of the ·• P. C. ,

who, on behalf of the r .P.c.,shall be informed aoout the onganization, shall

study the nost important pending problems, and shall work to promote tho

future transfer of sovereignty.

4) It shall enter ' nto consultation with the irovisional Federal Govt . with respect to matters of general policy and ~hall inform said Government of its views. If one or more territories of the • artners are involved in these qu~stions, the N.t.C. ·sLall also ente~ into consultation with the

governments c.q. the administration of mentioned territories of the

partners .

Article 8. Fer the execution of tJ.le subject mentioned in article 5 sub c, the

N .P .c. sna.11 prepare the x•egulation of t e formalities and shall in this matter consult with the Netherlands Government, the rovisional Govern ent,

the Government of Repuolik Indonesia and with the governments c.q . admini­strations of the member-territories, including all other organs concerned .

Article 9. The Chairman of the H •• c. and the deputy Chairmen, eventually assist-

ed by two or more ordinary members, nominated for trhe purpose by the N. P. C. , form a coramittee, which sh.all be in charge with the daily conduct of the work of the N.P.C. This committee is furtner designated as the

steerin0 comr:1ittee .

rticle 10. The Chairman or one of' the deputy Chairmen presides over the meetings.

He submits the subjects of the agenda to the meeting.

Article 11.

The meetings of the N.P.C. are called for by the Chairman, who will also d,raw up the agenda, such after consultation with the steering com­

mittee.

Article 12. 1) 'fhe meetings of the N.P.C. shall be closed and secret. 2) The meetings, if considered necessary by the steering committee, may be attended by advisors and experts, who, at the request of the Chairman., may speak on any subject, upon which their advice has been requested.

Article 12. l) The steering committee can se.t up committees and subcommittees and assign tasks to these committees.

2) As regards the tasks of the committees ~nd subconunittees., the steering cormnittee can give outlines and directives.

Article 11+• The steering committee is exclusively responsible for . and. competent to

the publication of official communiques on behalf of the N.P.C.

Transition-regulation. The N.P.C. shall continue the work of the now existing delegations

of the11 Republik Indonesia" an.d the F .c .A., towards the Netherlands dele­gation as well as the U.N.C.I.

Prof. Supoill.Q. bracht de vraag naar uoren, of men de ,l:)uitenlandse vcrtegcnwoordigers alhier op de plechtigheden van 27/28 December 1949 zou uitnodi6en, en zo ja van wie de invitatie zo~ noeten uitgaan. De kwestie is, dat de Consu;Ls-Generaal te Djakarta bij ·de Heder.landsc Regcring zijn ceaccrediteerd, zodat hun mandaat uiteraard ophoudt op het tijdstip van de souvereiniteitsovordracht.

1. Ofschoon de eis cnlijke overdracht der souvereiniteit t e

Amsterdam zal pluats vinden, bestaat ook behoefte ter ce lc-·

genheid van doze c;ebeurtenis hier te lande een plechtL;heid

te houdon. Een zodanic e plechticheid kan bestaan uit een

ovcrdracht door den Hor;en Vcrter,enwoordic;er van de Kroon

van het (alc;emeen) bestuur van Ind.onesie, hetwelk hij hier

te lande uitoefent namens de Konin6 in• der Nederlanden, aan

do Regerin:; van de Ropubliek dcr Veronie;de Sta ten van Indo­

nesie, Strict genomen is een dergelijke bestuursoverdracht

niet noodzakelijk, daar de Hoge Verter;enwoordi5er dit be­

Fada tan~gal 4 Januari 1950 ditanda tancani naskah Pcr­

njataan Kemordokaan Indonesia di kota Djakarta dalam rapat

tor£uka (dihadiri oloh SanCT Rnkjat) jang dilanGsungkan _olch

cabungan Senat dan Dewan Forwnkilan Rakjat (djikalau sudah

o.da). Declaration of Independence itu telah dirantjang lobih

dahulu oleh suatu Panitia Ketjil dan tolah disiarkan naskah­

nja koseluruh Indonesia sampai kowcdanaan, sehincc.;a po.da hari

penanda tancanan itu Rakjat dapat pula mendengarkan isi Per­

njataan itu. j
