DESCRIPTION OF REQUEST: The applicant is requesting the third six-month extension in accordance with Section 19.08.060 – H (Submission for Recording) of the previous subdivision code, which states that: “Within six (6) months following the date of final plat approval of the major subdivision application, the subdivider shall submit a recording plat subject to the requirements of Section 19.08.100 (Recording Play Submission) to the Subdivision Coordinator; provided, however, that a six (6) month extension to submit the recording plat may be granted by the City Plan Commission in the event that a delay is caused by action of the City, a public utility, or other governmental entity. A request for extension shall be made in writing by the subdivider on or before the initial expiration, and shall include a detailed explanation as to the reasons which merit the granting of an extension. Subsequent extensions shall meet the same requirements as the initial six (6) month extension.” The submittal of the recording maps is currently being delayed as a result of El Paso County’s policy stipulating that all necessary infrastructure and improvements be installed prior to the plat being recorded. CASE HISTORY/RELATED APPLICATIONS: • The City Plan Commission approved Peyton Estates Unit Eight (SUSU19-00018) on April 18, 2019 on a

major combination basis. The applicant is proposing to subdivide 70.147 acres of vacant land into 327 residential lots, one (1) 2.17-acre park, and two (2) stormwater ponds within the City’s Extraterritorial Jurisdiction.

• Planning received the extension request on October 18, 2019. • Planning received the second extension request on May 28, 2020. • Planning received the third extension request on December 23, 2020. CITY PLAN COMMISSION OPTIONS: City Plan Commission (CPC) has sole and final authority on subdivision matters. Subdivision applications and extension requests in conformance with all applicable code provisions shall be approved by the CPC. The Commission may take any of the following actions: 1. Approval: The CPC finds that the proposed request is in conformance with all applicable

requirements of Title 19 of the El Paso City Code. (Staff Recommendation) 2. Denial: The CPC finds that the proposed request is not in conformance with all applicable

ATTACHMENT 5 Planning & Inspections Department- Planning Division Developer / Engineer shall address the following comments: 1. Submit to the Planning & Inspections Department – Planning Division the following prior to recording of the

subdivision: a. Current certificate tax certificate(s) b. Current proof of ownership. c. Release of access document, if applicable. d. Set of restrictive covenants, if applicable.

2. Every subdivision shall provide for postal delivery service. The subdivider shall coordinate the installation and construction with the United States Postal Service in determining the type of delivery service for the proposed subdivision. In all cases, the type and location of delivery service shall be subject to the approval of the United States Postal Service.

Planning & Inspections Department – Land Development We have reviewed subject plats and recommend Approval. The Developer/Engineer shall address the following comments. 1. Label street classification of each typical street cross section on preliminary plat sheet. 2. Boundary closure report is ok.

Fire Department This property is located at the ETJ. No adverse comments to the extension. Sun Metro No objections to the request. Environmental Services Department No comments to request. Streets and Maintenance Department No objections to time extension. No comments on TIA. El Paso Water EPWU does not object to this extension request. The proposed subdivision is located within the East El Paso Extraterritorial Jurisdiction (ETJ) within one of the Paseo Del Este Municipal Utility Districts (MUDs) service area. The Paseo Del Este MUD receives wholesale water and wastewater service from the El Paso Water – Public Service Board (EPWU-PSB) in accordance with the Paseo del Este Wholesale Contract and EPWU-PSB Rules and Regulations No. 11. El Paso County The subject subdivision is still under construction and is only approximately 20% complete. El Paso County 911 No comments were received. Central Appraisal District No comments were received.
