1. At its third session the Standing Subcommittee of the PCT Interim Committee for Technical Cooperation (hereinafter referred to as "the Standing Subcommittee") decided that with the aim of gradually developing a restricted list of periodicals to be considered for possible inclusion into the PCT minimum documentation, the International Bureau should address two requests for information to all members of the Standing Subcommittee.

2. Accordingly, the International Bureau distributed on October 26, 1972, in an Annex to Circular No. 1549, two requests (see Annex I).

3. This document reports on the answers received to the two requests. Only prospective International Searching Authorities answered. These are presently the national Offices of Austria, Brazil, Germany (Federal Republic of), Japan, the Soviet Union, Sweden, the United States of America, and the International Patent Institute in the Hague. No answers were received from the Patent Offices of the Netherlands and the United Kingdom, which are-prospective International Preliminary Examining Authorities.

THE ANSWERS TO REQUEST NO. 1

4. It is recalled that Request No. 1·sought :an indication by each prospective International Searching Authority of 100 periodicals, to be selected from all the world literature, which are in the experience of each Office's examiners considered to be the most useful in the sense that they are most likely to contain disclosures not available in the patent literature.

5. Furthermore, the 100 periodicals should be distributed as follows among the three main technical fields: 42 in the chemical field, 36 in the electrical and physics field, and 22 in· the mechanical field. The three main technical fields are defined as indicated in a note (No. 2) in the Annex to Circular No. 1549.

6. The answers received indicated, to a large extent, periodicals which had been indicated earlier in document PCT/TCO/SS/I/3(Annex). That Annex was therefore revised accordingly by eliminating those periodicals which were not again indicated,

and adding those periodicals not previously indicated.

7. Out of the originally listed 5"94 periodicals, 355 remained. The additions numbered 79, including 14 supplementary periodicals suggested by the United States Patent Office for consideration for inclus~on in the non-patent -literatur~ minimum documentation list.

8. The responding Authority and the technical field of the 79 additionally indicated periodicals are given in Table· I below.

9. The new list totalling 434 periodicals is giyen in Annex II to this document. Explanatory notes on the structure of Annex II precede the Annex itself and are not repeated here. Annex II also contains an Index by the three main technical fields in which the periodicals are listed in the order of decreasing number of Authorities indicating the same periodicals.

10. It has been envisaged that approximately 100 periodicals would be included in the "first list of non-patent literature" (the name under which the list has been commonly referred to in previous documents) • The following evaluations are presented for consideration by the PCT Interim Committee for Technical Cooperation (hereinafter referred to as "the Interim Committee") when deciding on which periodicals to include in the said "first list".

Selection of the same Periodicals by the Various Prospective International Searching Authorities: by Technical Fields; by Languages of the Periodicals

11. The question for which answers were sought was this: how many of the periodicals are listed by only one or by two, three, four, five, six, seven or eight of the prospective International Searching Authorities? Tables II and III provide the answers to this question, ~e II showing the breakdown by technical fields and Table III by languages of the pertooicals.

THE ANSWERS TO REQUEST NO. 2


12. It is recalled that Request No. 2 sought an indication of approximately 30 periodicals considered by each prospective International Searching Authority to be the most outstandingly important in the language of the country of that Authority. They should be indicated according to the same technical fields as in the Request No. 1.

13. All the prospective PCT International Searching Authorities with the exception of the Patent Offices of Austria and Brazil and the International Patent Institute responded to this request. The Patent Office of Sweden interpreted the request's expression "in the language(s) of your country" in a somewhat broader sense, and included correspondingly the most important technical publications in the languages of Nordic countries - Denmark, Finland, Norway and Sweden.

14. In total 155 periodicals were indicated in response to Request No. 2: 30 by Germany (Federal Republic of) , 30 by Japan, 28 by Sweden, 30 by the United States of America and 37 by the Soviet Union. They are listed in Annex III to this document. Explanatory notes on the structure of Annex III precede the Annex itself and are not repeated here. Annex III also contains an Index by the three main technical fields in which the periodicals are listed in the order of decreasing number of Authorities indicating the same periodicals as in Annex II in regard to answers to Request No. 1.

15. Before proceeding to a comparison of the answers so far reported on, there is one aspect of Request No. 2 on which some clarification must be given at this point. Request No. 2 contained, in relation to the periodicals to be named, the words: "Please indicate •.• in the order in which they are considered to be useful ... ". This qualification was considered only in part by the Authorities that answered this Request. Consequently the periodicals named by the five answering Authorities were arranged alphabetically inside each of the three main fields. To assist the Interim Committee in their discussions all answers to Request No. 2 are reproduced in Annex IV.

COMPARISON OF ANSWERS TO REQUESTS NO. 1 and NO. 2

16. 108 out of 155 of the periodicals indicated in answer to Request No. 2 are periodicals already included in the answers to Request No. 1. The reference serial number of these 108 periodicals in Annex III is therefore the same as the reference serial number assigned to these periodicals in Annex II. Furthermore the total number of Authorities that have selected any of the 108 periodicals in response to Request No. 1 is also indicated in Annex III to facilitate decisions by the Interim Committee.

17. An analysis of the number of Authorities selecting the 108 periodicals common to answers to both Request No. 1 and Request No. 2 found below in Table IV, in regard to technical fields, and in Table V in regard to language.

18. The balance of the periodicals between the 155 periodicals selected in answer to Request No. 2 and the 108 periodicals common to answers to both, Requests is some 47 periodicals. These periodicals, which have been suggested to be outstandingly important in the language of the country of the Authority making the selection have,. on the other hand, not been selected by that Authority for inclusion in its list of the 100 most useful periodicals in the sense that they are most likely to contain disclosures not available in the patent literature. ~The distribution of these 47 periodicals by technical fields and languages is as follows:

As the Offices selecting these 47 periodicals did not themselves include them in their listing of the 100 most important periodicals in the world non-patent literature the importance of these periodicals as far as being considered for inclusion in the eventual "first list" is greatly di~inished.

SUMMARY OF THE RESULTS ACHIEVED TO DATE

19. The following diagram illustrates the successive attempts of the Standing Subcommittee to narrow the body of non-patent literature to obtain a first list.

20. The diagram illustrates the narrowing process achieved in the Standing Subcommittee through the use of a succession of different parameters. The area delimited by th~ solid line represents the world's non-patent literature. The area delimited by the dotted line represents the 594 periodicals found in three or more of the prospective International Searching Authorities as a result of the earlier survey.reported on in document PCT/TCO/SS/I/3 and considered by the Standing Subcommittee at its first session. The area of the diagram encompassed by the broken line represents the 434 different periodicals which were selected in response to Request No. 1 as summarized above.

21. The area delimited by the asterisks represents the 155 different periodicals in the language of the country of the five prospective International Searching Authorities making the selection. It should be noted that the par~ of this area above the broken line represents the 47 periodicals which were selected by prospective Authorities which did not also include such periodicals among their selection of the 100 most useful periodicals. The area below the dotted line represents the 108 different periodicals which were selected in answer to both Request No. 1 and Request No. 2.

CONTINUATION OF WORK

22. The Interim Committee is invited to examine, and comment on, this progress report, in particular with respect to Tables I to V, the Diagram and Annexes I, II and III.

23. As one of the criteria for establishing a "first list" of non-patent literature minimum documentation was that a restricted number of approximately 100 periodicals would be sought, it would seem desirable to reach a decision on this aspect of the matter at this Session in the light of the findings of this progress report.

24. As another of the criteria was that the periodicals indicated by the prospective Authorities should be those, according to the experience of th~ir examiners, most likely to contain disclosures not available in the patent literature, it would seem also desirable to reach a decision at this Session on whether abstracting journals (secondary publications) containing summaries of disclosures appearing elsewhere (be they patent or non-patent literature) are to be conside~ed in this category or not. The answers to the two requests show differing views by the vario~s prospective Authorities. As the aim is to have a "first list" of periodicals whose disclosures constitute themselves the references to be cited, it would seem that abstracting journal~ do not fall into the category of periodicals contemplated for the "first list".

25· The Interim Committee is invited to make recommendations as t6 the orientation of further work with a view to establishing a "first list" of non-patent literature for the PCT minimum documentation.

In its October 1972 session, the Standing Subcommittee of the PCT Interim Committee for Technical Cooperation decided that, with the aim of gradually developing a restricted list of periodicals that would constitute the minimum documentation under Rule 34.l(b) (iii), the International Bureau should address two requests for_ suggestions to the members of the Standing Subcommittee.

Please find annexed the two requests. They are based on paragraphs 26 and 27 of the report of the Standing Subcommittee (document PCTITCOISSIIIII23, annexed) .

For your convenience, a copy of the documents referred to in paragraph 26 of the said report are also annexed (PCTITCOISSIII3 (Annex) and PCTITCOISSIIIII8) .

ANNEX to Circular No. 1549

Request No. 1

Please indicate 42 periodicals in the chemical field, 36 periodicals in the electrical and physics field, and 22 periodicals in the mechanical field, which, on the basis of the experience of the examiners in your Office, are the most useful in the sense that they are most likely to contain disclosures not available in the patent literature. The periodicals should be selected from all the world literature. In other words, the list should contain periodicals irrespective of their language and place of publication.

Request No. 2

Please indicate in each of the three fields (that is, chemical, electrical and physics, mechanical), in the order in which they are considered to be useful, in the sense that they are most likely to contain disclosures not available in the patent literature, the most outstandingly important periodicals publi~hed in the language(s) of your country. No specific number of periodicals has to be indicated; approximately a dozen in each of the first two fields and half a dozen in the third field would suffice.

Notes

1. The indications should identify the periodicals by their title, their publisher, their language and place of publication.

2. In the interest of uniformity, it is requested to consider each of the technical fields as meaning:

Chemical - mainly chemistry and chemical engineering but includes also metallurgy, textiles, paper, foodstuffs, medicine and biology;

Electrical _ mainly electricity and electronics, but and Physics includes also communications, data pro

cessing, automation, control and instrumentation, lighting, nucleonics and physics;

Mechanical - mainly mechanical and civil engineering, but includes also in general everything not included in the other two subdivisions.

When editions are published only in languages other than English, or when translations exist only between languages other than English, the alphabetical list shows the titles in their original language, indicating only in some cases, in parentheses, one of the titles in one of the other languages.

(vii) From "new serial number" 356 onwards the periodicals are arranged alphabetically inside three main technical fields (Chemical, Electrical and Physics, and Mechanical), The technical fields are to be considered as meaning:

Chemical -mainly chemistry and chemical engineering but includes also metallurgy, textiles, paper foodstuffs, medicine and biology~

Electrical. - mainly electricity and electronics, but includes also communications, data processing, and Physics automation, control and instrumentation~ lighting, nucleonics and physics_~

Mechanical - mainly mechanical and civil engineering, but includes also in general everything not included in the other two subdivisions.

(viii) The heading "Source" means the prospective Authorities that were.the source of the indications.

3. The alphabetical list is followed by an index according to the three main technical fields. Inside each field the periodicals are ordered by decreasing numbe;r- of Authorities indicating them.

1. Cette Annexe contient une liste alphabetique de 434 periodiques selectionnes parmi les publications au·monae entier par les huit Autorites Internationales de Recherche qui se sont proposees dans le cadre.du PCT, chaque periodique faisant l'objet d'une rubrique distincte.

2, La structure de la liste alphabetique est la suivante

i) Chaque rubrique est precedee d'un "nouveau numero de serie" (en anglais : "new serial number") qui est un nombre appa:J;"tenant a Une Serie nurnerique COnt-inUe de l a 434 f et d I Un "numer0 de Serie de reference (en anglais : "reference serial number") qui constitue le numero de serie du meme periodique dans la liste initiale (PCT/TCO/SS/I/3(AnnexY) et qui a ete conserve enfin de faciliter l'identification. La presente liste de 434 periodiques comporte 79 periodiques qui n'avaient pas ete repertories dans la liste initiale. Le dernier nurnero de· cet,te liste ini tiale etant le numero _59 4, ces 79 periodiques ont re~u des "numeros de serie de reference" s'echelonnant de 595 a 673 inclus;

ii) Chaque rubrique se rapporte a un seul periodique et comporte generalement trois lignes. La premiere de ces lignes contient le titre du periodique, la seconde le nom de son editeur, la troisieme l'adresse de cet editeur;

iii) Dans la premiere colonne situee a droite des rubriques est indiquee la langue dans laquelle e~t publie le periodique. E signifie anglais; F, fran~ais; G, allemand; H, hollandais; I, italien; J, japonais; R, russe; S, suedois.

iv) Dans les colonnes de droite suivantes, les cercles (0) indiquent celles des huit Autorites Iriternationales de recherche qui ont indique qu'elles considerent le periodique cornme appartenant au groupe choisi dans la litterature mondiale qui, compte tenu de !'experience de leurs exarninateurs, est le plus utile en ce sens qu'il offre la rneilleure probabilite de contenir des divulgations non disponibles dans la litterature de brevets. Une croix (+) signifie que le periodique correspondant a ete designe par l'Autorite co~cernee comme l!un des periodiques les plus importants publies dans la langue du pays. Engin, un asterisque designe ceux des 14 periodiques que l'Office des Brevets des Etats Unis d'Amerique a propose de prendre egalement en consideration.

v) Un 'A' majuscule situe a gauche de la colonne indiquant la langue identifie les recueils de resumes (.en anglais : "abstracting journals"). Seules 9 des 434 rubriques se rapportent l de tels recueils.

vi) Les periodiques dent les "nouveaux numeros de serie" s'echelonnent de 1 a 355 sont disposes en ordre alphabetique comme dans la liste initiale

a) Sous chaque lettre de !'alphabet sent repertories en premier lieu les titres commen~ant par les initiales des associations ou des organisations qui publient les periodiques correspondants (par exernple AIAA signifie "American Institute of Aeronautics and Astronautics);

b) Lorsque le titre du periodique, tel qu' il est pub lie, commence par le mot. "Journal" . "Bulletin" "Proceedings" "Transactions" et par des expressions analogues, le titre apparaissant dans la liste commence par les initiales ou le nom de !'association ou de !'organisation qui publie le journal ou le bulletin, etc,

c) Lorsqu'un periodique est publie dans differentes langues, il est indique en premier lieu en anglais dans la liste s'il en existe une edition ou traduction anglaise, et si son titre est connu. Dans un tel cas, le titre en version originale est toujours reproduit entre parentheses apres le titre en version anglaise, Lorsque des periodiques ne font l'objet d'aucune edition en langue anglaise, leurs titres apparaissent dans la liste dans leur Version originale accompagnes, s'ils sont traduits dans UnE autre langue, de leur traduction dans cette langue,

vii) A partir du "nouveau numero de serie" 356 les periodiques sont regroupes en trois domaines techniques principaux (Chimie, Electricite et Physique, Mecanique) et classes par ordre alphabetique dans chacun de ces domaines. Ces domaines techniques sont definis de la fa~on suivante :

EXPLANATORY NOTES

1. This Annex contains an alphabetical list of 155 periodicals selected, by each of five of the present eight prospective International Searching Authorities under the PCT, as the most outstandingly important in the language of the country of each of the Authorities. Each periodical is the subject of a special entry.

2. The structure of the alphabetical list is as follows:

( i) Each entry is preceded by a "new serial number", which is a number from an unintel_Tupted series of numbers from 1 to 155, and for the major part by a "reference serial number", which is the same that that entry had in the alphabetical list of Annex II. 108 of the 155 entries have a "reference serial number".

(ii) Each entry is concerned with one periodical and consists usually of three lines: the first contains the title of the periodical; the second, its publisher; the third, the address of the publisher.

(iii) In the first column on the right, the language of the periodical is indicated. D stands for Danish; E, for English; F, for French; G, for German; J, for Japanese; N, for Norwegian; R, for Russian; s, for Swedish,

(iv) In further columns to the right circles (O) indicate those of the eight prospective International Searching Authorities who indicated the periodical as the most outstandingly important in the language of the country of the~ prospective Authority.

(v) 'rhe last column on the right (Total Annex II) repeats the total from Annex II, in order to show how many of the Authorities indicated each of these periodicals as belonging to the group of periodicals they considered to be the most useful from all the world literature,

(vi) A capital 'A' on the left of the column indicating the language, flags the abstracting journals. There is only 1 of them among the 155 entries.

(vii) The periodicals are arranged alphabetically inside three main technical fields (Chemical, Electrical and Physics, and Mechanical) as the Authorities mostly indicated them. The Authorities also follow alphabetically.

(viii) The technical fields are to be considered as meaning:

Chemical -mainly chemistry and chemical engineering but includes also metallurgy, textiles, paper, foodstuffs, medicine and biology;

Electrical - mainly electricity and electronics, but includes also communications, data processing, and Physics automation, control and instrumentation, lighting, nucleonics and physics;

Mechanical -mainly mechanical and civil engineering, but includes also in general everything not included in the other two subdivisions.

(ix) The heading "Source" means the prospective Authorities ·that were the source of the· indications.

3. The alphabetical list is followed by an index according to the three main technical fields. Inside each field the periodicals which were listed also in Annex II are ordered by decreasing number of Authorities indicating them.

Cette Annexe contient une liste alphab~tique de 155 p~riodiques s~lectionn~s par cinq des huit Autorit~s Internationales de Recherche qui se sont propos~es dans le cadre du PCT, comme les periodiques les plus importants publies dans la langue du pays de chacune de ces Autorit~s. Chaque periodique fait l'objet d'une rubrique distincte.

2. La structure de la liste alphab~tique est la suivante

i) Chaque rubrique est precedee d'un "nouveau numero de s~rie" (en anglais : "new serial number") qui est un nombre appartenant a une s~rie num~rique continue de 1 a 155 et, dans la plupart des cas, d'un "numero de serie de ref~rence (en anglais : "reference serial number") qui constitue le num~ro de serie du meme p~riodique dans la liste de 1 'Annexe II. 108 des 155 rubriques portent un "numero de serie de ref~rence" (en anglais : "reference serial number");

ii) Chaque rubrique se rapporte a un seul periodique et comporte generalement trois lignes. La premiere de ces lignes contient le titre du periodique, la seconde le nom de son editeur, la troisieme l'adresse de cet editeur;

iii) Dans la premiere colonne situee a droite des rubriques est indique la langue dans laquelle est publi~ le periodique. D signifie dano~s; E, anglais; F, fran9ais; G, allemand; J, japonais; N, norvegien; R, russe; S, suedois;

iv) Dans les colonnes de droite suivantes, les cercles (0) indiquent celles des huit Autorit~s Internationales de recherche qui ant indique qu'elles considerent le periodique comme le plus important publie dans la langue du pays de l'Autorite concernee;

v) La derniere colonne de droite (Total Annex II) recapitule le nornbre total d'Autorites indiquees dans l'Annexe II afin de faire apparattre le nombre d'Autorit~s qui ant indiqu~ chacun de ces periodiques comme appartenant au groupe considere comme le plus u;:ile choisi parmi i:oute la li tt~rature mondiale;

vi) Un 'A' majuscule situe a gauche de la colonne indiquant la langue, identifie les recueils de resum~s (en anglais "abstracting journals"). Un seul de ces derniers figure parmi les 155 rubriques.

Les Autorites sont egalement dispos~es par ordre alphabetique. Les domaines techniques sont d~finis de la fa9on suivante :

Chimie essentiellement la chimie et le g~nie chimique mais egalement la m~tallurgie, les textiles, le papier, les denrees alimentaires, la m~decine et la biologie;

Electricite- essentiellement l'~lectricite et l'~lectronique, mais egalement les telecommunications, le et Physique traitement de donnees, !'automation, le contr6le et !'instrumentation, l'eclairage, la physique

nucleaire et la physique;

~~canique es~entiellement la m~canique g~n~rale et le genie civil, mais comprend ~galement, de fa9on g~nerale, tout ce qui n'entre pas dans l'une ou l'autre des deux autres categories pr~c~dentes.

ix) La designation "Source" se rapporte aux Autorit~s constituant les sources des indications.

The first proposal drawn up with reference to Request No. 1 consists of:

42 periodicals in the chemical field, also including metallurgy, textiles, paper, foodstuffs, medicine and biology;

36 periodicals in the electrical and physics field, also including communications, data processing, automation, control and instrumentation, lighting, nucleonics and phys~cs;

22 periodicals in the mechanical field, including civil engineering etc.

Most of the said periodicals are contained in the 'first list' of non-patent literature established by WIPO and are identified by their ordinal number in this 'first list' (PCT/TCO"/SS/I/3) . In adt.U tion several periodicals are indicated including some taken from the list proposed by the Soviet Delegation during the Third Session of the Standing Subcommittee in October 1972 (PCT/TCO/SS/III/8).

The second proposal drawn up with reference to Request No. 2 consists-of the Soviet Union periodicals enumerated in proposal 1 and arrar;ed according to fields of technology and to their importance for the work of examiners. However, it is necessary to point out that the sequence of the periodicals according to their importance is of a rough character since it was difficult to agree on a certain sequence owing to the fact that according to the above-mentioned WIPO Circular a given field of technology in fact includes several fields, for instance, chemistry including metallurgy, medicine etc.

Les propositions relatives aux periodiques de. la litterature autre que celle des brevets ont ete etablies en reponse aux demandes formulees dans l'annexe de la lettre-circulaire No 1549 de l'OMPI.

La premiere proposition elaboree conformement a la demande No 1 contient :

42 periodiques specialises dans le domaine chimique, celuici comprenant egalement la metallurgie, les textiles, le papier, les denrees alimentaires, la medecine et la biologie;

36 periodiques specialises dans le domaine de l'electricite et de la physique, celui-ci comprenant egalement les telecommunications, le traitement des donnees, !'automation, le controle et !'instrumentation, l'eclairage, la physique nucleaire et la physique;

22 periodiques specialises dans le domaine de la mecanique, y compris le genie civil etc.

La plupart de ces periodiques figuraient dans la premiere liste des documents de la litterature autre que celle des brevets etablie par l'OMPI et sont identifies par les numeros qui leur avaient ete attribues dans cette "premiere liste" (PCT/TCO/SS/I/3). Plusieurs periodiques ont egalement ete indiques a titre supplementaire, y compris certains des periodiques choisis dans la liste proposee par la Delegation Sovietique au cours de la troisieme session du Sous-Comite permanent en octobre 1972 (PCT/TCO/SS/III/8).

La seconde proposition elaboree en reponse a la demande No 2 contient les periodiques de l'Uniori Sovietique enumeres dans la proposition 1 et classes par domaines techniques et selon· !'importance qu'ils presentent pour les exarninateurs. Toutefois, il convient de noter que le classement des periodiques en fonction de leur importance s'est avere difficile a definir et ne presente qu'un caractere approximatif car, selon la lettre-circulaire de l'OMPI mentionnee ci-dessus, un domaine technique donne recouvre en fait plusieurs domaines, la metallurgie, la medecine etc. etant compr1ses par exempie dans -le domaine de la chimie.
